in
a
scooter
whizzed
by
me
in
the
parking
lot
up
the
handicap
access
beating
me
to

door
he
was
thrilled,
but
that
is
something
he
would
not
have
been
able
to
do
without
your
funding,

Tom
Dankert
for
shepherding
our
project
and
to
Paul
Fisher
for
being
our

council
has
come
down
to
go
time
for
which
the
city
council
has
to
adopt
a
proposed
budget
and
tax
levy
by
September
30th
and
submit
it
to

state

Minnesota

County
for
it
to
get
on
your
tax
statement
so
again
by
law.
This
has
to
be
done
by
September
30th.

Any
budget
discussions
can
increase
the
budget
in
the
next
couple
months,
as
we
fine-tune
some
things,
but
you
cannot
pay
for
them
with
taxes
so
that
this
is
the
maximum
tax
levy
you
can
put
out
at
this
point
in
time.
You
can
lower
it
during
the
next
couple
months
as
you
get
towards
the
truth
and
Taxation
hearing,
but
you
cannot
increase
it.
So.

The
proposed
tax
levy
for
2023,
which
was
unanimously
approved
at
the
last
work
session,
ends
up
at
8
million
two
hundred
and
eighty
three
thousand
dollars,
which
is
a
four
point.
Three
two
percent
increase
over
the
current
Levy.
Historically,
it
will
probably
have
about
one
percent
of
that
4.32
paid
by
new
development
within
the
community,
but
that
is
what
council
was
approved
at
the
last
work
session.
So
we'd
recommend
Council
approval
for
that
for
2023
taxes
and
set
our
public
hearing
for
December
7th
2022
at
six
o'clock
in
the
council
chambers.

that
actual
hearing.

related
note,
I
I
think
I,
even
though
the
position
for
the
code
enforcement
wasn't
approved
by
consulate,
I
did
hear
some,
maybe
some
affirmation
that
we're
willing
to
at
least
step
up
our

being
proactive
on
it
from
our
existing
employees,
rather
than
just
rely
upon
the
citizens
to
to
make
that
a
complaint
I'm
hopeful.
At
least
we
can
get
the
staff
that
we
do
have
a
little
more
proactive
and
searching
out
and
helping
out
these
homeowners
to
gain
compliance.

items
are
ordinances
that
counselors
discussed
in
the
past
a
couple
work
sessions.
This
first
one
is
for
the
Sidewalk
Cafe
ordinance.
It
was
discussed
at
the
August
15th
work
session
and
voted
to
remove
the
food
requirement
from
the
ordinance
additional
language
was
added
to
allow
all
types
of
liquor
license
holders
to
be
eligible
eligible
to
apply
for
this
license.
So
that's
what
you're
approving
at
this
point
in
time,
if,
if
it
gets
evolved,.

a
series
of
motion
and
a
couple
other
more
motion

Couture
ordinance
is
requiring
the
liquor
or
reviewing
the
liquor
ordinance.

so
these
next
two
ordinances
were
again
approved

prior
Council
meetings,
our
Council
work
sessions,
the
second
ordinance
modifies
the
number
of
subdivisions
in
chapter
five
of
our
code,
sections
5.62,
subdivision,
8
and
10
are
being
modified
to
conform
with
recent
Minnesota
State
Law
changes
which
allow
baseball
teams
or
managers
of
baseball
stadiums
to
hold
on
sale.
Wine
licenses
laws
changes
state
level
due
to
the
unavailability
of
3-2
beer.
We've
made
contact
with
the
marks
and
ballpark
Association.
They
do
not
plan
on
utilizing
this
type
of
license
at
this
time.

want

keep
our
code
up
to
date
and
harmonious
with
state
law.
Section
5.65,
subdivision
4
is
a
Sunday
on
sale
provision
which
would
allow
a
Sunday
on
sale
license
holders
to
start
serving
at
eight
o'clock.

the

meeting

at
the
work

being
modified
to
conform
with
State
Law
changes
which
allow
breweries
to
sell
different
sizes

amounts

breweries
in
town
and
they

not
plan

changing

operations

they
do,
our
coded
help
would
be
up
to
date
for
them
to
do
that,
and
then
the
third
allows
for

Packer
Arena
city
code
was
drafted
prior
to
pack
Arena
being
constructed.

2013
anyway,
has
asked
acted
as

fiscal
host
for
the
community
band.
This
allows
him
eligible
for
certain
grant
opportunities,
specifically
from
the
Southeastern
Minnesota
Arts
Council
or
CMAC
in
the
past,
they've
gotten
grants
of
up
to
five
thousand
dollars,
but
they
need
a
Fiscal
Agent
to
do
such
starting
in
2019
CMAC
actually
required
applicants
to
have
official
fiscal
sponsorship
agreement
which
we've
attached.
So
we
would
request
Council
approve
this
in
2022,
so
that
would
allow
the
community
band
to
apply
for
2023
grant
opportunities.

This
is
just
Indiana.

has
asked

We've
been
working
on
this
project
together.
First
off
the
47
600,
a
contingency
fund
usage
is
actually
going
to
be
fund
balance
usage

we

left

continues.

there
are
some
issues
with

pool,
as

of
you
know,
so.
The
was
pulled
up
by
vandals
during
the
year.
The
pool
needs
to
be
sandblasted
and
repainted.
Mr
Merrill
has
worked

entity

paintball,
LLC
Who's
Got
High
grades
from
the
city
of
Albert
Lea
for
their
pool,
and
we
need
to
actually
get
this
done
before
the
pool
would
open
next
season,
so
they've
got
it
scheduled
ready
to
go
assuming
Council
approves
the
use
of
fund
balance
to
pay
for
the
project.

second
item
is
because
of
the
vandalism
we
had
we'd
like
to
install
some
security
cameras
to
monitor
the
system.
I
worked
with
Dave
to
go
through
his
existing
Capital
outlay.
The
council
approved
and
he's
got
some
Savings
in
some
other
areas
that
he'd
like
to
use
to.
Instead
of
do
for
those
areas,
because
they've
came
in
under
budget
to
use
for
security
cameras,
a
total
of
seventeen
thousand
estimated
costs
is
16.5.

hearing
was
held

the
last
council
meeting
to
review
the
I-90
bridges
project.
As
mayor
just
said,
it's
all
part
of
the
municipal
consent
procedure
that
is
followed
by
a
MnDOT
because,
as
the
folks
explained
last
week
or
at
the
last
meeting,
there
are
different
components
of
our
project
that
trigger
this
Municipal
consent
requirements.
So
at
that
meeting
there
was
presentation
given
by
MnDOT
Representatives
information
was
taken
from
the
public
and
input,
and
then
there
was
also
Council
discussion
on
the
matter.
I
Since
that
meeting
that
we
had
good
news
for
the
project,
there's
been
a
25
million
dollar
Federal
grant
that
has
been
allocated
toward
the
project.
We
don't
believe
that
that
will
impact
our
local
costs
at
all,
because
things
have
to
be
federally
eligible
to
be
reimbursed
by
the
federal
government.
I
So
the
next
step
in
this
Municipal
consent
process
is
for
Council
to
take
action
on
a
resolution
to
either
approve
or
deny
the
proposed
layouts
that
were
presented,
those
layouts,
meaning
the
the
size
and
the
shape
and
the
complexity
of
each
of
those.
What
was
it
six
or
eight
bridges
that
were
talked
about
through
that
process?
So
won't
go
through
that
in
any
more
detail.
It's
all
just
what
was
talked
about
at
the
last
meeting
and
open
it
up
to
any
questions
that
you
may
have.

we've

closely

Hormel
Foundation
through
this
whole
process.

They
are
in
support
of
this
project
and
we
anticipate
if,
if
not
100,
of
the
funding,
a
large
majority
of
the
funding
coming
from
the
Hormel
Foundation
to
cover
the
city
portion
or
the
local
portion
of
cost,
whether
it
be
the
bridge
Aesthetics
railings,
sign
all
those
components
together.
They
have
supported
this
project
with
proposed
funding.

projects
ongoing
out
at
the
airport
right
now:
the
taxiway
joint
project
we
brought
to
you
previously.
The
Federal
grant
cover
90
percent
of
the
costs.
Local
would
be
the
remaining
10
percent
of

costs
and,

Tom,
just
talked
about
for
the
community
ban.
In
this
case,
the
state
is
kind
of
the
Fiscal
Agent.
Those
federal
dollars
will
come
through
the
state.
So,
even
though
the
state
is
not
helping
with
funding
for
this
project,
the
money
will
be
routed
through
the
state.

this
is
very
similar,
except
in
this
case
MnDOT
is
supporting
the
project,
my
percentages
on
the
Memoir
off
there.
This
project
is
funded,
90,
Federal,

State
and
five
percent
local.
So

state

providing
money

this
project

with
being
again
the
pass-through
entity
for
the
federal
dollars.
So
we
would
recommend
Council
approve
this
grant
agreement
with
MnDOT.

Commission,
the
commission
reviewed
an
appeal,
as
noted
by
Madeline
Vander.

What
she's
asking
for
she
lives
on
a
corner
lot:
there's
sidewalk
on
both
sides:
she's
asking
to
put
a
privacy
fence
on
her
side
yard
up
to
the
property
line,
which
is
essentially
the
sidewalk.
Our
ordinance
requires
a
12
and
a
half
foot
setback.
So
thus
the
appeal
it
would
allow
her
to
use
the
entirety
of
her
yard
on
that
side,
and
then
she
had
indicated
that
she
was
worried
about
security.
She
had
had
some
vegetation
as
kind
of
demarking
the
property
line,
but
that
wasn't
sufficient.

The
Planning
Commission
reviewed
the
request
and
recommended
approval,
with
the
condition
that
the
fence
near
the
driveway
be
installed
at
an
angle
with
pedestrian
safety
in
mind.
It's
near
Sumner,
school
and
so
they're
they're,
probably
going
to
be
some
kids
walking
by
just
to
give
her
a
little
extra
visibility
as
she
backs
out
of
the
driveway.
The
Planning
Commission
voted
six
to
zero
for
that
recommendation
and
they
discussed
the
impacts
on
neighboring
properties,
public
right-of-way,
review
of
practical
difficulties
and
reasonableness
of
the
petitioner's
requested
use.
