Protection
of
space
to
make
sure
that
there's
space
available
for
uses
for
the
hospital
and
uses
that
support
the
hospital
in
2015
bloomington
hospital
announced
that
they
will
be
leaving
the
current
campus,
and
so,
as
a
result,
this
situation,
necessitating
to
the
md
zoning
district,
is
drastically
changing.
So
this
again
is.
C
The
zoning
area,
while
business
professional
office,
is
not
permitted
in
the
md
zone,
which
is
all
of
the
gray
that
you
can
see
here
and
again.
The
red
is
the
petition
site
and
the
blue
is
the
hospital
campus.
Many
of
the
medical
uses
that
are
permitted
function
in
much
the
same
way
as
a
business
professional
office
use
does
including
the
other
use.
C
C
Not
anticipate
the
relocation
of
the
hospital
md
is
the
only
non
residential
zoning
district
in
the
you
do
that
does
not
allow
business
professional
office
use
in
any
future.
Comprehensive
rezoning
of
this
area
will
very
likely
include
that
is
a
permitted
use,
while
we
are
currently
working
on
the
gpp
timeline,
obviously,
for
comprehensive.
C
C
C
Variance
that
would
that
you'd
need
to
discuss
were
the
use.
Variance
to
be
approved
is
a
development
standards,
variance
from
the
parking
maximum
standard
so
based
on
the
proposed
use,
a
business
professional
office
and
the
existing
office
use
on
the
property
and
the
square
footage
of
the
building.
17.
C
C
C
C
C
Actually
need
it
to
be
able
to
function
at
this
site,
so
staff
recommends
approval
of
the
use,
variance
and
the
development
standards
vary
with
the
following
conditions.
Approval
of
the
parking
variance
is
for
the
existing
24
parking
spaces
only
and
that
approval
of
the
parking
variance
is
for
this
particular
type
of
office.
Use.
C
A
D
D
B
H
H
Well,
that
might
be
one
of
the
ways
we
can
bring
them
into
a
compliance
a
little
bit
if
you
know,
if
they're
not
adding
to
the
impermeable
surface
by
adding
a
concrete
pad-
and
they
already
have
too
much
parking,
sacrificing
one
parking
space
would
bring
them
a
little
bit
closer
to
compliance
right.
You're.
C
F
A
I
I
J
J
It
offers
affordable
properties.
Where
businesses
can
you
know,
small
entrepreneurs
can
buy
a
building
and
have
some
parking
and
access
to
the
downtown.
I
you
know
with
the
hospital
moving.
I
still
think
that
there's
a
great
opportunity
in
that
area
for
businesses
to
continue
to
expand
in
the
downtown
and
as
far
as
the
parking
is.
J
D
H
C
C
Request
before
you
tonight
is
twofold:
the
petitioner
is
requesting
a
use
variance
to
allow
the
use
communication
facility
in
the
auris
zoning
district.
If
the
use
variance
is
approved,
the
petitioner
is
required
to
install
sidewalk
along
the
lot
frontage
on
wiemer
road.
The
petitioner
is
requesting
and
development
standards
variance
from
that
standard.
So
before
we
get
into
the
petition,
I
just
want
to
make
some
brief
comments.
A
petition
or
council
heard.
C
C
C
C
C
C
C
C
From
the
you
do
for
the
property
to
allow
communication
facility,
but
we
do
want
to
acknowledge
that
citing
cell
towers,
it's
a
very
difficult
process.
Not
only
does
location
satisfying
coverage
and
capacity
needs.
Not
only
do
they
have
to
find
locations
that
satisfy
both
coverage
and
capacity
needs
for
the
carriers.
They
also
obviously
have
to
have
willing
property
owners
and
matches
owning
and
those
things
don't
always
collide
very
easily,
and
so,
in
this
case,.
K
A
K
K
K
K
K
Will
be
located
their
equipment
canopy
will
be
located
here.
You
can
see
three
other
rectangles
that
are
dashed
lines
that
say
future.
Those
are
that
is
those
are
the
areas
that
are
reserved
for
three
code:
three
additional
code,
locators
that
would
be
able
to
use
the
tower
in
and
so
that
space
is
reserved.
K
K
K
K
K
Radiofrequency
engineer
talks
about
the
reasons
for
that
for
this,
and
so
there
are
towers
in
the
area
there
are
existing
locations
and
we'll
see
that
in
just
a
moment
where
verizon
is
located
on
other
nearby
towers
or
relatively
nearby
towers,
but
that
these
locations
have
become
overloaded.
So
there
are
two
things
that
we
typically
talk
about.
We
have
the
we
have
cellular
service
phone.
K
K
The
in
the
ability
to
use
cellular
telephone
service-
that's
always
something
that
will
benefit
as
well,
but
isn't
necessarily
the
driver.
But
the
way
to
describe
data
versus
phone
is
the
phone
is
just
the
quality
of
the
call
or
the
drop
of
the
call
and
the
actual
radio
coverage.
If
you
think
a
data,
it's.
K
In
your
office-
and
you
have
six
or
seven
people
in
the
office
and
there
are
four
or
five
lines
I
may
be
the
sixth
person
to
want
to
get
on
the
phone.
At
that
moment
we
don't
have
a
problem
with
our
phone
service,
but
if
I'm
the
sixth
person
in
the
loan
and
the
lines
are
already
occupied,
then
I
simply
can't
access
that
line
to
use.
So
that's
similar
to
what
happens
with
the
increase
in
the
use
of
cellular
data
video
homes
that.
K
K
K
K
Within
a
zoning
classification
that
would
allow
the
use,
but
then
also
provide
for
adequate,
find
a
property
that
allows
for
adequate
setbacks
and
other
physical
attributes.
So
by
the
time
you
you
meet
all
these
qualifications,
you
find
yourself
in
a
situation
where
you're
locating
needing
to
locate
the
tower
in
a
pretty
finite
space,
and
so,
if
you
look,
then
it
tab.
Five
there's.
K
K
K
K
K
K
K
K
K
Based
on
the
need,
you've
got
a
very
specific
location
where
the
wireless,
where
the
tower
can
go
and
and
and
it
happens
to
be
on
this
property
in
this
classification.
It's
it's
a
residential
use
classification.
Obviously,
if
there
were
to
be
further
development
in
the
future,
wireless
communication
facilities
and
opportunities
are
seen
as
desirable.

H

H
C
F
B
F
B
B
B
That
might
happen.
There
are
still
that
there
is
still
desire
to
have
some
pedestrian
facilities,
major
pedestrian
facilities
on
wiemer,
we're
not
sure
which
side
of
the
road
would
be
on.
It
would
probably
be
a
sight
path.
That's
what
we're
thinking
at
the
moment,
just
to
the
west
of
wiemer
to
the
northwest
of
tap
and.
G
G
B
B
B
B
G
E
L
About
this
is,
however,
locating
of
communication
facilities,
the
complicated
process,
but
the
part
of
it
that
I'm
having
some
difficulty
with
it
involves
not
only
selecting
sites
that
aid
in
the
capacity
and
coverage
of
service
providers,
but
also
that
have
willing
property
owners.
What
are
you
getting
at
there
with
that
statement?
The
willing
property
owners
well
that
we
can.
C
C
C
We
anticipated
that
they
could
go
in
industrial
areas
and
business
parks.
You
know
off
to
the
side,
but
the
reality
might
be
that
they
need
to
be
also
located
in
places
we
didn't
originally
originally
envisioned,
and
that
comes
into
play
with
the
property
owners,
because
the
property
owners
of
those
zones
that
we
have
identified
may
not
be
willing
to
lease
to
a
cell
service,
but.
C
B
B
H
A
land
hasn't
been
developed
yet
for
no
sidewalk
at
all.
That
is
seems
very
strange
to
me
that
we
would
give
a
permanent
variance
like
that.
I
mean
it's
meant
to
be
residential
single-family,
there's
room,
I
don't
know
how
much
room
there
is
for
parcels
there,
but
would
you
say
80
homes
at
least
it
seems
very.
C
C
H
The
sidewalk
right
there
it
removes
a
bargaining
chip
from
the
city
if
you
guys
want
to
shift
a
trail
farther
into
the
property,
and
you
know
wander
off
the
road
a
little
bit.
I
hate
to
get
rid
of
that
I'd.
Call
it
a
bargaining
chip
if
they
don't
want
to
develop
or
it's
inappropriate.
So
you
say
if
we
decided.
H
C
Make
a
conditional
upon
this
upon
this
use
that
it
so
that
you're
only
you're
only
issuing
this
variance
for
this
use,
like
with
the
last
variance
we
only
issued
the
you,
only
approve
the
parking
variance
for
that
particular
use,
and
that,
if
other
use
has
gone
to
the
property
of
that
would
issue
would
need
to
be
revisited.
Does
that
sound.
B
F
I'll
start,
thank
you
I'll
I'll
move.
I.
H
F
F
L
L
G
B
B
B
Little
direction
from
the
board,
if
you
wanted
to
go
the
route
of
the
permanent
sidewalk
variance,
that
was,
you,
know,
kind
of
sunsetted
or
switch
it
over
to
a
determinate.
If
you
want
to
switched
over
to
terminate,
we
can
work
on
writing
some
findings
quickly
here
for
the
criteria
for
the
determinant
paragraph
is
I'm
not.
H
H
L
G
G
A
K
C
Other
sidewalk
findings
that
we
looked
at,
and
so
I
think
you
could
just
accept
the
two
that
we
have
prepared.
I'm
just
going
to
read
them
for
clarity
is
that
okay,
okay,
the
approval
will
not
be
injurious
to
the
public
health
safety,
morals
and
general
welfare
of
the
community.
His
staff
finds
no
injury
to
the
public.
This
portion
of
the
street
has
existed
for
many
decades
without
a
sidewalk.
The
nearest
sidewalk
on
the
east
side
of
this
portion
of
south
wiemer
drive
is
over
nine
hundred
and
fifty
feet
to
the
north
number.
C
Two,
the
use
in
value
of
the
area
adjacent
to
the
property
included
in
the
development
standards
variants
will
not
be
affected
in
a
substantially
adverse
manner.
Staff
finds
no
substantially
adverse
impacts,
although
the
construction
of
sidewalks
on
all
streets
is
desirable.
This
sidewalk
at
this
point
will
have
negligible
positive
benefits
to
an
area
that
has
no
existing
adjacent
sidewalks
and
that
is
adjacent
to
a
topographically,
difficult
site
and
then.
C
Let's
see
the
strict
application
of
the
terms
of
the
unified
development
ordinance
will
result
in
practical
difficulties
in
the
use
of
the
property
that
the
practical
difficulties
are
peculiar
to
the
property
in
question
and
that
the
development
standards
of
variance
will
relieve
the
practical
difficulties.
That's
one.
We
do
not
have
a.
C
Jacent
law
or
tracks
are
at
present
undeveloped,
but
it
appears
that
at
some
future
date
these
lots
or
tracks
will
be
developed,
increasing
the
need
for
sidewalks
for
protection
and
convenience
of
austrians.
I
would
propose,
as
a
finding
of
fact,
that
yes,
the
property
and
adjacent
properties
are
currently
undeveloped.
There
is
a
planned
unit,
development
to
the
north
that
will
likely
be
developed
at
some
time
in
the
future,
but
is
not
currently
in
the.
C
C
B
A
Artery
between
some
significant
recreational
sites
that
we
have
in
bloomington
and
I've
watched
the
residential
development
in
that
area,
and
I
think
it's
only
going
to
increase
so
and
I've
been
on
the
board
long
enough
to
know.
Sidewalks
are
a
slippery
slope
literally
and
figuratively.
So
I
will
be.
