the
Bloomington
Planning
Commission,
the
Planning
Commission
is
made
up
of
seven
volunteer
Bloomington
residents
appointed
by
the
city
council.
Tonight
we
have
five,
which
is
a
quorum.
The
commission
advised
that
the
city
council
on
development
proposals,
development
standards,
long-range
planning
and
transportation
issues.
Our
work
is
informed
by
the
city's
comprehensive
plan,
various
District
plans
and
the
city
code.

some
items.
The
commission
makes
a
recommendation
with
the
city
council
having
the
final
decision-making
Authority.
We
have
three
of
those
items
tonight.
In
other
cases,
the
Planning
Commission
can
approve
or
deny
an
application
subject
to
an
appeal
to
the
city
for
each
action
item.
There
will
be
a
staff
report,
an
opportunity
for
the
applicant
to
present
at
any
time
for
any
member
of
the
public
to
provide
testimony.

the

As
a
reminder,
this
is
we
prepare
as
a
planning
division
to
collect
and
consider
right.
Many
small
changes
to
our
code
that
by
their
own,
would
not
Merit
the
process
of
of
reviewing
and
and
going
through,
the
process
of
public
hearings,
and
so
that's
what
we're
doing
here
today
with
miscellaneous
issues,
and
so
let's
get
started.

So
here's
where
we
were
so.
You
may
recall
that
in
October
2022
we
came
here
for
the
study
session.
We
have
since
put
the
ordinances
to
legal
for
review,
and
so
now,
with
this
sweet
animation,
you
can
see
that
we
are
here
for
our
public
hearing
and
then
after
this
we
will
be
going
to
City
Council.

So
we
did
reorganize
so
from
the
time
that
you've
seen
us.
Last
till
now
we
have
reorganized
our
ordinances
into
two
categories.
The
category
that
you
see
on
the
screen
with
the
red
box
indicates
that
it
is
considered
a
cleanup
or
a
housekeeping
note,
and
that
means
that
it
is
either
a
word
change
or
removing
a
reference
or
removing
a
reference
to
a
section
of
code
or
to
a
a
principal
use
that
no
longer
exists.

So
the
first
amendment
has
to
do
with
catering
businesses
adding
them
to
the
use
table.
Currently
catering
major
catering
business
is
permitted
in
i1,
I2
and
I3,
but
not
in
fd2
and
catering
business
is
similar
to
food
manufacturing
or
restaurant
use,
which
is
an
allowed
use
in
the
fd2
zoning
District.
So
this
would
be
just
adding
catering
major
business
as
permitted
use
and
the
next
one
has
to
do
with
exterior
storage.
The
city
has
seen
issues
with
businesses
displaying
outdoor
merchandise
improperly,
such
as
unblocking
sidewalks
or
putting
them
in
a
parking
space.

Ordinance

is
the
tent
code,
and
so
the
definition
of
tent
did
not
specify
the
composite
parts
of
a
tent
it.
It
just
talked
about
the
structure
in
and
of
itself,
and
this
has
resulted
in
some
enforcement
issues
where
the
frame
of
the
tent
was
left
up
for
longer
than
the
allowed
time,
and
so
with
working
with
our
environmental
health.
Colleagues,
we
have
updated
the
definition
of
tent
to
include
the
composite
parts.

Senior
parking
standard
for
a
party
room,
so
this
one
we
removed
the
party
room
parking
requirements
for
senior
housing,
much
like
we
did
for
multi-family,
and
that
was
something
that
when
we
looked
it
was
just
kind
of
a
holdover.
So
we're
we're
proposing
to
remove
that
requirement.

Work
vehicle
parking
storage.
This
one
is
putting
in
code
a
practice
that
we
have
been
using
in
the
planning
division.
When
we
talk
about
site
development,
if
there
are
spaces
for
vehicles
that
are
for
the
on-site
business,
we
would
require
that
the
parking
for
those
Vehicles
not
be
part
of
the
required
parking
that
is,
is
needed.

The
next
one,
the
city
code
currently
does
not
have
an
exception
for
temporary
fences
for
construction
purposes,
and
this
issue
can
arise
when
non-residential
buildings,
such
as
fire
stations
and
park,
structures
which
are
in
residential
zoning
districts
are
constructed
and
they
want
a
temporary
fence.
So
this
basically
gives
them
allowance
to
have
a
temporary
fence
for
construction
purposes.

The
home
business,
prohibition
of
on-site
vehicle
sales-
this
was
a
issue
commissioner
cooked
in
you
had
some
questions
about
in
terms
of
if
you're
selling
a
vehicle
for
a
family
member
and
so
with
review
with
some
of
our
enforcement.

We
looked
at
this
and
we
are
it.
It
seems
like
this
isn't
really
speaking
to
that.
It's
speaking
to
more
of
a
more
of
a
business
operation
where
people
acquire
cars
from
auctions
and
then
are
selling
multiple
vehicles
on
their
home
lot
effectively
running
a
commercial
operation
which
is
not
the
intent,
but
in
terms
of
like,
if
there
is
a
family
member
or
a
vehicle
sale
that
needs
to
happen
I'm
talking
with
our
our
compliance
that
it's
they
are
working
with
with
members
of
the
public.

we
we
have
with
that
understanding.
We
have
kept
the
ordinance
as
part
of
miscellaneous
issues
and
then
body
art,
so
body
art
is
piercing
tattoo
parlors,
looking
at
the
the
spaces
where
this
use
type
was
allowed
or
or
the
zoning
districts
that
these
use
types
were
allowed,
it
seemed
restricted
in
a
way
that
perhaps
was
based
on
a
stigmatization
of
this
form
of
art
of
this
of
this
retail.

So
we
are
proposing
that
we
open
up
body
art
to
be
much
like
any
other
retail
sales
and
services
accessory
dwelling
units,
the
utility
hookup
requirements,
the
this
is
based
off
of
the
guidance
from
our
city
engineering
department,
about
how
should
we
manage
the
requirements
for
adus
for
metering
and
hookup
for
sanitary
sewer,
and
so
with
this
we
are
recommending
that
detached
and
that's
something
that
I
believe
that
we
have
added.
Since
the
last
time.

were
here
to
specify
that,
with
detached
accessory
dwelling
units
that
we
are,
we
are
not
prohibiting
it
and
in
fact
we
are
requiring
special
or
we
are
requiring
to
be
served
by
multiple
sewer
and
water,
except
with
special
permission
by
the
city
engineer.

so

designated,
as
the
planning
agency
in
this
case

required
to
review
municipalities,
Capital
Improvement
plan
for
consistency
with
the
comprehensive
plan,
and
so
that
is
the
action
item
before
you
this
evening
is
to
review
the
2023
through
2032
CIP,
for
compliance
with
the
comprehensive
plan.
I
I
will
note
that
Larry
economy
scholler
who's,
the
city's
Chief
Financial
Officer,
is
in
attendance
in
the
chambers.
As
my
understanding
to
answer
any
questions
you
might
have
that
are
more
detailed
about
the
CIP
but
yeah.
Let's
just
jump
in
I
have
a
very
short
slide
deck
here.
So,
as
I
mentioned
this,
this
action
before
tonight
is
required
by
state
law.
I
So
the
document
itself
is
available
online.
It's
quite
a
lengthy
document.
There's
I
counted
there's
over
180
projects
that
were
included
in
the
CIP.
The
tenure
CIP
this
go
around
and
I
would
note
that
planning
staff
did
go
through
item
by
item
on
all
of
those
projects
proposed
in
the
CIP.
I
So
some
of
the
major
or
I
should
say
that
the
way
the
CIP
breaks
it
down.
Some
of
you
have
gone
through
this
before,
but
they
break
it
down
in
five
categories:
City
facilities,
Park
development,
sewer
water
and
storm
water,
South,
Loop,
port
authority
projects
and
surface
Transportation
projects.
Some
of
the
more
notable
projects
in
this
this
10-year
cycle
include
the
494
35W
interchange
associated
with
that
is
the
Portland
Avenue
Bridge.
It's
part
of
the
494
project.
I
There's
some
City
investments
in
as
part
of
that
MnDOT
project
on
the
Community,
Health
and
Wellness
Center
is
included
in
the
CIP,
multiple
fire
station
projects,
including
new
fire
stations,
as
well
as
renovation,
renovation
of
existing
facilities
and
then
a
whole
fairly
lengthy
list
of
upgrades
of
to
existing
city
city
city
facilities,
including
improvements
to
Civic,
Plaza,
and
you
know
other
other
City
facilities
and
then
a
whole
list
of
Park
improvements.
I
Utility
infrastructure,
as
well
as
a
very
long
list
of
Transportation
improvements,
just
to
know
what
a
comprehensive
plan
if
you've
reviewed
the
document
closely
isn't
going
to
get
into
the
granular
level
of
detail.
I'm
discussing
all
these
various
individual
projects,
it
does
talk
about.
I
You
know
certain
larger
projects
like
the
Community
Health
and
Wellness
Center
or
fire
stations
when
it
talks
about
Community
facilities.
But
most
of
these
things
on
the
on
the
180
are
going
to
be
very
kind
of
in
the
weeds
of
nuanced
and
detail
that
you're
not
going
to
find
in
a
comp
plan.
So,
just
as
a
reminder,
what
the
meaning
of
compliance
is
is
that
the
projects
themselves
are
consistent
with
the
goals,
objective
strategies
and
the
the
text
of
the
plan
and
in
the
Judgment
of
planning
staff.
I
After
reviewing
the
list
and
reviewing
those
chapters
of
the
comprehensive
plan,
we're
confident
that
the
projects
and
the
CIP
are
consistent
and
in
compliance
with
the
comprehensive
plan.
So
with
that
I
would
present
a
recommended
motion
and
certainly
I
can
stand
for
questions
and,
as
I
noted,
the
city
CFO
is
in
attendance
as
well.

inform
the
folks
at

as
to
why
we
break
out
South
Loop
projects.
I
Yeah
chair,
commissioner
cook
done,
CFO
controller
might

served
on
the
CIP
committee
might
even
have
a
better
answer
for,
but
my
understanding
it
more
so
has
to
do
with
a
lot
of
the
funding
sources
for
those
projects
coming
from
specific
sources
of
Taxation.
That
fund
a
lot
of
improvements
in
the
South
Loop
probably
inform
why
it's
broken
out
into
a
separate
category,
but
I'd
certainly
welcome
Lori's
guidance
and
knowledge
in
that
Arena
as
well.
If
she's,
willing
or
able.

this

was
identified

one

the
city,
pearls
back
in

would

very
early
2000s
and
it
just
stuck

CIP
as

area

much
development
potential
that
it
just
created
an
area
that
really
identified
all
the
projects
in
that
very
specific
area.

long
period
of

both
our
own
reminder

the
public
in
the

the
five
categories
you
talk
about,
especially
in
one
city
facilities,
two
parks
and
five
surface
Transportation
talk
about
how

staff
work
together,
both

planning

also
with
our

colleagues
in
the
city
who
look
at
issues
of
equity
and
public
health
and
and
those
things
that
are
not
always
intentional,
but
are
a
result
of
some
of
the
decisions
we
do
or
don't
make
in
these
processes.

One
thing
I
would
say
about,
as
it
relates
to
equity
and
Community
Health
I
think
the
CIP
committee,
its
roster
and
kind
of
Who's
involved
in
that
conversation
of
prioritization
and
what
projects
get
added
is
broader
than
it's
ever
been.
Is
my
understanding.
So
there's
a
lot
more
people
at
the
table
who
are
kind
of
you
know
talking
about
and
debating
the
merits
of
certain
projects
versus
others
and
through
different,
and
they
all
come
from
different
disciplines
and
lenses.
I
I
Is
that,
while
the
comprehensive
plan
is
you
know,
incredibly
Broad
and
and
far,
you
know
wide,
reaching
account
plan
does
reference
all
these
various
sub
plans,
like
the
alternative
transportation
plan,
like
the
sewer
plan,
like
the
park
master
plan,
where
there's
a
tremendous
amount
of
staff
collaboration
that
goes
into
those
more
detailed
plans,
and
so
what
you
see
with
the
cap
is
actually
the
implementation
element
or
the
tool
to
actually
get
a
lot
of
the
projects
that
are
identified
in
these
kind
of
sub
plans
done.

And
so,
when
there's
a
lot
of
Staff
collaboration
having
taken
part
in
the
park
master
plan
process,
for
example,
that
was
led
by
Park
staff
and
their
Consultants.
There
was
a
very
wide
range
of
staff
that
were
involved
in
that
from
Public
Works
to
Community
Development
to
other
departments
within
the
city,
and
so
I
would
just
say
that,
as
the
city
is
kind
of
working
on
these
long-range
planning
efforts
throughout
the
seven
divisions
of
the
city
and
and
kind
of
what's
going
on
throughout
the
community.

think
about,
because
when
we
worked
on
the
comprehensive
plan
and
commissioner

that

did

those
gaps

work

those
issues
and

I
think
one
of
the
areas
where
we

have
an
eye
on

improved

a

shape

of

plans

components

those
visions

a
tax
immigrant
financing
proposal
and
HRA
administrator

What
we
have
before
you
is
that
the
city
and
Authority
are
considering
the
establishment
of
a
tax,
increment
financing,
Redevelopment
district
for
nine
thousand
Penn
Avenue
South
and
2325
West
90th
Street,
better
known
as
europolis.

So
what
is
this
project?
Well,
this
project
is
proposed
to
be
about
a
2400
square
foot.
Restaurant
expansion,
the
West
Edition,
would
include
an
enlarged
kitchen
storage,
freezer
space
and
new
trash
room,
and
the
East
Edition
would
include
74
additional
indoor
seats.
There
would
also
be
an
outdoor
patio
seating
with
58
seats
and
a
new
facade
that
includes
stucco
metal
and
a
substantial
amount
of
glass.

This
Redevelopment
would
be
using
incompatible
land
uses
and
or
outdated
buildings.
In
particular,
there
is
a
current
blighted
building
on
one
of
those
Parcels
that
this
would
be
removing
and
redeveloping
where
that
blighted
building
currently
is
and
then
goal
number
four
promote
continued
economic
development
for
the
city
and
the
region,
and
so
there
are
two
strategies
here
that
are
closely
identified
with
this
Redevelopment
proposal:
strategy,
4.4
of
leveraging,
Partnerships
and
funding
tools
to
Foster
public
and
private
investment
in
infrastructure,
Economic,
Development
and
Community
Services.

this
is
an
application
for
tax
increment
financing.
However,
this
project
in
particular,
has
leveraged
funding
from
the
state,
in
particular
from
deed
for
the
Redevelopment
and
the
removal
of
this
blighted
building
on
that
second
parcel,

definitely
leveraging
Partnerships
and
funding
tools
and
then
strategy,
4.6
of
fostering
entrepreneurship,
job
growth,
business
retention,
expansion
and
recruitment,
specifically
business
retention
and
expansion,
is
a
part
of
this
strategy

this
free
development.

process?

we

request
that
you
determine
if
this
proposed
Tiff
plan
and
project
area
are
conformed
to
the
2040
comprehensive
plan,
and
then
we
would
go
before
the
city
council

December
5th,
for
a
public
hearing
and
then
the
HRA
board
on
December
13th
for
review
and
possibly
approval
of
the
Tiff
plan
and
agreement
and
to
enter
into
the
agreement
with
the
HRA
for
the
Tiff
and
I
can
stand
for
any
questions.

Statute,
a
certain
percentage

tax,
increment
financing

city

Bloomington

chosen

allocate

port
authority
and

percentage
to
the
HRA.
So
the
HRA
board
has
heard
about
this
project.
I
provide
them
updates.
They
also
were
informed
and
on
board
when
the
application
was
submitted
to
deed
for
the
funding.

grant
funding
that
this
project
has
been
awarded
last
or
earlier
this
week,
I
actually
did
have
a
HRA
board
meeting
where
I
updated
them
to
let
them
know
here
is
the
process.
We
would
go
to
the
Planning
Commission
first,
because
it
does
need
to
be
determined
that
it
does
conform
with
comprehensive
plan
as
a
whole.

it
goes
to
the
city
council,
for
the
city
council
to
approve
creation
of
a
tiff
District
approving
the
project
area
in
the
Redevelopment
plan,
and
then
it
goes
to
the
HRA
board
to
also
review
and
approve
the
plan,
but
also
approve
entering
into
a
tiff
agreement,
which
is
how
it
becomes
executed
completely.
So
they
know
about
it.
But
they
have
not
ruled
or
approved
anything
yet.

building

vacant

used

is
it
truly
condemned
in
the
sense
that
it
can't
be
redeveloped
in
the
manner

when
I
was
reading
the
packet.

the
deed
application

be
submitted,
there

be
a
process

completed
on
the
building,
so
our
building
official
actually
did

inspection

building
and
did
confirm
that
the
building
is
actually
blighted
and
cannot
be
redeveloped
in
its
current
state.
It
would
have
to
be
removed
and
the
new
building
would
have
to
be
erected.
I
do
believe
on
manager.

guard

correct
me,
but
I
do
believe
that
the
use
for
this
area
cannot
be
a
gas
station
again.
So
there's
that
and
then
I
do
believe
that
what
came
before
you
was
the
re-platting
and
the
rezoning
so
that
there
could
be
a
development
here
and
part
of
the
rezoning
was
that
it
needed
to
be
rezoned,
because
previously
looking
housing
would
not
work
there.

the
impact

residents

dollars

that

What
does
a
tiff
do
and
how
does
it
impact
residents
from

dollars

cents

a
very
simple
term,
we
are
taking
a
structure,
a
building,
a
plot
of
land
that
isn't
has
no
tax
base.
It's
not
collecting
anything,
it's
not
bringing
any
value
to
the
area,
and
it's
also
is
blighted.
So
even
though
that's
not
really
the
best
term.
That
is
the
term
that
we
have
it's
it's
an
eyesore,
and
so
by
being
able
to
offer
a
mechanism
such
as
tax
increment
financing,
we
are
allowing
for
redevelopment
to
happen
which
overall
increases
the
tax
base.

increasing
