marijuana
enforcement
officer
for
the
boulder
Police
Department.
As
you
may
know,
marijuana
is
legal
in
Colorado
and
with
that
comes
a
lot
of
questions
about
what
you
can
do,
what
you
shouldn't
do
and
general
enforcement
questions
so
we're
here
today
to
answer
any
questions
you
have
so
please,
chime
in
on
the
comment
field
and
we'll
get
through
them
and
let's
get
this
party
started,
sounds
good.

They
are
out
in
public,
but
our
city
has
decided
to
have
fairly
strict
advertising
guidelines
for
our
licensed
marijuana
businesses.
The
city
made
it
a
priority
to
try
to
protect
young
people
from
marijuana
advertising,
because
there
is
some
research
that
shows
continual
exposure
to
marijuana.
Advertising
lowers
the
perception
of
risk,
so
the
only
advertising
allowed
on
the
outside
of
our
marijuana
businesses
is
the
store
name
and
the
address
and
the
business
hours
they
can't
have
marijuana,
leaves
or
green
crosses,
or
anything
like
that.
So.

Have
a
marijuana
advisory
panel
that
the
city
manager
ordered
put
together
and
it
consists
of
twelve
members.
It
has
a
representative
from
Boulder
Valley,
School,
District,
Boulder,
County,
Health
Department,
see
you.
It
has
marijuana
industry
members
on
it,
Boulder
Chamber
of
Commerce
and
then
Boulder
city
staff
advises
with
them.
So
everybody
brings
their
issues
to
the
table
once
a
year
for
the
marijuana
advisory
panel,
and
then
we
sort
out
those
issues
make
compromises,
and
then
we
bring
our
final
decisions
before
City
Council
and
ask
them
if
we
can
go
forward
with
those
okay.

One
of
our
marijuana
industry
members
asked
on
the
marijuana
advisory
panel
asked
if
they
could
do
cold
water
extraction
in
the
licensed
grows,
and
none
of
city
staff
had
an
issue
with
that.
So
they're
now
allowed
to
do
cold
water
extraction
inside
the
grows.
As
long
as
it's
in
a
separate
room.

If
you
have
a
medical
marijuana
card
and
a
valid
ID,
you
can
also
purchase
two
ounces
of
medical
marijuana,
so
you
can
legally
have
two
ounces
of
medical
marijuana
on
you
in
public,
privately
in
your
home,
you
can
grow
up
to
six
plants
at
one
residence
in
the
city
of
Boulder,
and
the
city
of
boulders
municipal
codes
are
more
strict
than
the
states,
so
it's
six
plants
total,
regardless
of
doctor's
recommendation
number
of
people
living
in
the
household.
It's
just
six
plants
per
premise:

Private
property,
with
the
permission
of
the
private
property
owner,
but
where
the
public,
the
general
public,
would
not
have
access.
So,
even
if
a
restaurant
wanted
to
say
we're
private
property,
we
want
to
allow
marijuana.
The
general
public
is
allowed
to
have
access
to
restaurants,
so
would
not
be
allowed
there.

Is
something
that
most
folks
in
our
city
don't
know,
but
we
do
have
a
Municipal
Code
that
covers
marijuana
odor.
So
it
requires
a
warning
within
the
previous
year,
but
if
marijuana
odor
and
it
can
be
smoking
odor
or
it
can
be
plant
odor,
if
they,
if
it
bothers
somebody
else
in
their
household,
then
you
can
get
a
warning
and
if
it
continues
to
bother
somebody
else
it
within
a
year
you
can
get
a
ticket
for
marijuana,
odor,
okay,.

Marijuana
grows,
so
the
marijuana
team
I
had
just
briefly
mentioned,
have
a
building
supervisor
on
the
team.
He
spends
a
considerable
amount
of
time
at
this
licensed
crews
working
on
their
ventilation,
their
carbon
filters
to
try
to
contain
the
marijuana
odor
for
the
public,
so
they
don't
have
to
smell
in.

If
it's
a
using
complaint,
it'd
be
best
to
contact
the
police
departments,
a
patrol
officer
could
immediately
address
it.
If
it's
a
plant
complaint
like
it's
from
a
licensed,
Bureau
or
my
neighbor
I
think,
has
an
illegal
grow.
Then
there's
a
marijuana,
odor
complaint
form
on
the
city's
website.
It's
under
Boulder,
Colorado,
gov,
slash,
marijuana
and
there's
a
marijuana.
Odor
complaint
form
you
can
fill
out
in
the
marijuana
team
will
investigate
that
odor
complaint.
The
nice
thing
about
that
is.
It
allows
us
to
keep
statistics
on
the
number
of
complaints,
the
areas
of
complaints.

There's
actually
quite
a
few
signs.
First
is
generally
odor.
That's
usually
the
first
sign
that
residents
pick
up
on.
There
can
also
be
a
lot
of
car
traffic
coming
and
going
from
that
house.
Sometimes
rental
car
license
plates
with
red
plates
on
them.
Out-Of-State
license
plates
in
order
to
for
unlicensed
grows,
which
are
sometimes
called
illegal
grows,
but
they're
unlicensed
grows
so
they're
more
than
six
plants
in
one
household.

For
those,
the
reason
why
the
city
limited
the
plants
to
six
or
less
is
because
they
don't
need
any
additional
help
to
grow
in
a
house,
so
they
don't
need
any
extra
co2.
They
don't
need
any
extra
lighting,
high
intensity
lights,
so
the
city
said
six
are
less
because
they
don't
want
her
escaping.
They
don't
want
extra
electrical
hookups.
They
don't
want
venting
to
be
an
issue.
They
don't
want
co2
to
be
an
issue
in
residential
areas
without,
if
you
know
the
fire
department
overseeing
it.

So
some
of
the
signs
of
excessive
number
plants
are
having
to
support
the
growth
cycles
of
those
plants
with
high
intensity
lights
and
those
lights
draw
a
lot
of
electrical
power,
so
sometimes
electrical
lines
get
spliced
and
other
issues
that
heat
and
humidity
from
those
lights
and
from
the
watering
will
build
up
in
the
house,
and
it
needs
to
be
vented
out
of
the
house,
which
is
usually
where
the
odor
complaints
come
from,
but
so
venting
will
be.
Actually,
you
know
sometimes
drilled
through
the
outside
of
the
wall
of
the
house
or
through
windows.

You
can
see
venting
coming
out
of
windows,
so
those
are
those
are
some
good
signs
because
of
the
heat
and
humidity
issues.
Sometimes
they'll
have
extra
air-conditioning
box.
So,
instead
of
just
one
air
conditioning
unit
you'll
see
three
air
conditioning
units
which,
for
one
household
is,
is
you
know
completely
unnecessary,
so.

know
we
hear
on
a
regular
basis.
People
will
think
things
aren't
aren't
worth
calling
the
police,
because
they're
they're
really
busy.
They
know
we've
got
a
lot
going
on,
but
calling
on
a
marijuana
odor
sounds
like
it
is
really
important,
because
it
might
be
our
first
clue
that
something
is
going
on
in
the
home
that
needs
further
investigation.

Is
really
important
and
if
the
person
who's
calling
can
actually
get
an
idea
if
the
marijuana
odor
is
coming
from
a
licensed
gross,
sometimes
they
can
tell
because
they
have
large
warehouse
complexes
near
them
and
they
know
there's
licensed
growers
in
them
or
if
they
think
that
their
neighbor
has.
You
know
an
excessive
number
of
plants
and
is
growing
and
maybe
even
distributing
it's
it's
helpful
if,
when
they
call
if
they
have
an
idea
of
where
the
odor
is
coming
from,
usually
in
issues
where
smoking
odors
coming
through
vents
and
condominiums
the
caller,
you
know.

pretty
good
idea
of
where
the
odor
is
coming
from,
but
we
do
want
to
investigate
those
because,
with
the
legalization
of
marijuana,
we're
trying
to
take
away
the
stigma
of
marijuana,
so
having
really
stringent
rules
about
it
makes
it
much
more
enforceable
makes
it
more
safe.

lot
of
oversight
has
helped
to
keep
it
safe
for
the
community.
Well,.

good
question:
most
people
sometimes
don't
know
what
they're
seeing,
but
those
are
some
of
the
points
I
touched
on
with
a
lot
of
vehicle
traffic
coming
and
going
rental
car
license
plates
venting
coming
out
of
windows
or
you
know,
drilled
in
the
side
of
houses.
A
lot
of
marijuana
odor
is
usually
associated
with
excessive
number
of
plants
and
a
house
extra
air-conditioning
units.
Sometimes
you'll
hear
fan
noise
because
there's
fans
inside
the
house
to
try
to
control
the
humidity
and
heat
electrical
splicing,
which
needs
to
be
addressed
immediately.

And
at
the
very
least,
if
nobody
can
remember
anything
else,
911
is
appropriate.
If
you
know
there's
electrical
splicing
or
it
looks
like
there's
something
really
dangerous,
they
can
call
the
non-emergency
dispatch
number
if
there
isn't
anything
immediately
dangerous.
You
know
about
it.
So
that's
the
three
zero
three
four
four
one,
three
three
three
three
that
goes
to
dispatch
and
they
can
report
the
complaint
which.

Is
a
great
point
because
I
know:
we've
responded
to
incidents
within
the
city
over
the
last
few
years
where
there
have
been
explosions
due
to
you
know:
butane,
hash,
oil
extraction
and
and
marijuana
grow
operations.
So
it's
it's.
Definitely
a
public
safety
issue
and
worth
taking
the
time
to
contact.

It
is,
and
I
can
tell
you
that
in
some
of
those
instances,
after
the
fact,
neighbors
would
tell
us
that
they
had
some
concerns
about
the
activity
that
was
going
on
at
the
house,
but
they
didn't
know
how
to
report
it.
They
were
nervous
about
reporting
it.
They
didn't
want
their
neighbor
to
be
mad
at
them
or
find
out
that
they
reported
it.
So
we
can
actually
take
complaints
anonymously.

Is
no,
there
is
no
law
about
tobacco
dur.
As
far
as
being
similar
to
the
marijuana
odor
code,
the
marijuana
odor
complaint
we're
trying
to
keep
it
specific
to
marijuana.
There
are
laws
governing
where
you
can
smoke
cigarettes.
You
know
a
certain
distance
outside
of
the
ingress
and
egress
of
restaurants,
but
those
are
much
different
than
married.
The
marijuana
odor
codes,
okay,.

In
two
thousand
voters
passed
amendment
20,
which
legalized
medical
marijuana.
There
was
a
period
of
time
where,
after
league
is
a
legalization
of
medical
marijuana,
there
really
were
not
licensed
medical
marijuana
businesses.
It
wasn't
really
until
about
2009-2010
that
the
federal
government
started
trying
to
loosen
some
of
its
regulations
in
states
where
marijuana
was
legal
and
then
States
felt
more
comfortable,
actually
licensing
medical
marijuana
businesses
and
then
in
2000
12
voters
in
Colorado
passed.
The
recreational
marijuana
amendment,
which
is
amendment
64
and
then
in
2014,
is
when
recreational
marijuana
businesses
started
being
licensed.

There
they
can,
but
with
numerous
restrictions,
so
the
child
would
have
to
have
a
medical
marijuana
card
which
they
would
have
to
have
a
doctor's
or
a
physician's.

medical
doctors
recommendation
for
that
they
would
have
to
have
a
parent
or
guardian
with
them
in
order
to
purchase,
but
under
18
can
purchase
marijuana
if
they
have
a
medical
marijuana
card
and
they
have
a
parent
or
guardian
with
them.

There
are
actually
a
lot
of
substances
that
get
faked,
so
sometimes
it's
just
flavor
like
a
blueberry
flavor,
sometimes
it's
actually
nicotine
and
it
can
be
flavored,
nicotine
or
sometimes
it's
marijuana,
concentrate.
So
in
order
to
tell
the
difference,
you
actually
need
to
get
your
hands
on
the
cartridge.
That's
inserted
into
the
vape
pen.
The
cartridge
is
pretty
much
the
only
way
that
you'll
know
what's
being
vaped,
but
this
is
an
example
cartridges.

These
are
actually
nicotine
cartridges,
they're
flavored,
which
is
why
the
different
colors,
this
product
is
called
the
jewel
it's
a
fairly
popular
vape
pen
with
minors.
According
to
my
school
resource
officers,
even
though
they're
not
allowed
to
have
it
be
in
possession
of
it
and
then
it
the
cartridge
is
inserted
inside
the
jewel.
That's
this
longer
portion
here
and
then
the
jewel
heats
up
this
concentrate
in
here
and
that's
where
the
vapor
comes
from.
That's
inhaled.

marijuana,
where
you
can
call

actually
speak
with
marijuana
people
who
are
educated

it.

a

marijuana

that
sounds
like
it's
a
great
resource
for
all
ages.
As
you
know,
during
cold
and
flu
season,
you
get
written
a
script
from
your
doctor
quite
often
that
you
could
find
out
if
and
how
it
would
interact
with
marijuana
use

and
I
know
marijuana.
Now
it
takes
so
many
different
forms.
It's
you
know
not
just
the
flower.

with
this

packaging
and
then
any
edible
product
should
also
have
each
individual
like
each

gummy
for

recently
stores
were
allowed
to,
sell
marijuana
concentrate
in
this
form,
but
now
the
state
has
said
this
glass
part
would
have
to
be
completely
opaque.

law
says
locked
in
and
closed
in,
the
definition
of
enclosed
includes
covered
and
the
state
expects
it
to
be
a
substantial
structure
that
locks
in
order
to
keep
minors
out
the
city
consider
is
locked
in
and
closed
to
be
inside
a
building
so
like
a
residence
or
a
shed
like
a
lock
shed.
If
there's
minors
in
the
house
or
minors
that
come
over
to
the
house,
the
state
says
that
this
medical,
those
marijuana
plants,
have
to
be
kept
in
a
separate
locked
in
a
closed
space
that
the
minors
can
access.

We
do
really
similar
enforcement
as
the
liquor
enforcement
officer.
We
do
compliance
operations,
which
is
when
we
send
a
minor
with
a
fake
ID
or
their
vertical
valid,
minor,
ID
and
inside
of
a
dispensary,
and
we
make
sure
that
those
dispensaries
are
not
selling
to
the
minor.
That's
one
of
our
our
biggest
forms
of
compliance
for
selling
to
minors
is
that
those
compliance
operations,
they're
usually
referred
to
as
stings
by
the
businesses
in
general.

We
actually
have
quite
a
few
dispensaries
who
do
a
really
good
job
of
confiscating
fake
IDs.
The
majority
of
our
dispensaries
are
well
trained.
They
go
to
classes
to
spot
fake
IDs.
They
have
installed
software
called
IntelliJ
or
different
forms
of
software
that
help
them
identify
fake
IDs.
So
right
now
we're
working
on
getting
all
of
our
dispensaries.
Just
a
hundred
percent
well-trained,
it's
very
difficult,
because
fake
IDs
keep
getting
better.

You
can't
use
a
buff
card,
so
the
state
of
Colorado
says
it
has
to
have
a
date
of
birth
and
a
photo
on
it.
That's
the
very
basic
standard
and
then
for
marijuana
and
alcohol.
There's
separate
forms
of
ID
that
are
acceptable,
so
marijuana
is
pretty
stringent.
The
only
forms
of
a
you
know,
ID
that
are
acceptable
at
marijuana,
dispensaries
or
wellness
centers
would
be
driver's
licenses.

Pretty
much
all
of
our
municipal
codes
are
different
than
Boulder
County
bulgur
County's
majority
of
marijuana
laws.
They
rely
on
state
law,
primarily
that's
what
they
enforced.
We
have
two
full
chapters
and
in
our
title

our
Municipal
Code
that
cover
compliance
for
recreational
medical,
so
pretty
much
every
aspect
that
the
state
has
hit
for
enforcement
of
marijuana
businesses.
The
city
has
also
duplicated
it
and
decided
how
they
want
to
enforce
each
of
those
areas.

It
does
show
is
that
post
legalization
of
recreational
marijuana,
the
past
month,
use
amongst
young
people
is
increasing
and
that's
year
to
year
to
year,
it's
increasing
our
anecdotal
evidence
from
school
resource
officers
that
work
in
the
schools
every
day.
You
know
the
stories
they
tell
me
is
also
that
they're
seeing
more
possession
of
marijuana
in
the
schools
amongst
young
people.
Since
it's
been
legalized,
okay,.

Can
you
can,
if
there's
driving
behaviors,
that
the
officer
witnesses
and
they
have
reasonable
suspicion
for
a
traffic
stop?
They
can
do
that.
The
legal
limit
is
five
nanograms
of
Delta
Delta.
Nine
is
which
is
essentially
THC
in
the
blood
you,
probably
unless
you're
really
chronic
user
won't
really
know
how
much
THC
is
in
your
blood.
You,
you
know.
There's
most
people
don't
have
an
ability
to
test
themselves.
So
it's
far
far
wiser
just
not
to
drive
at
all,
okay
using
marijuana
and
the
system.

know
the
human
body
metabolizes
it
differently,
so
smoking
marijuana
and
eating
edibles.
You
know
the
main
effects
of
them
are
different,
so
smoking.
You
know,
marijuana
is
a
quicker
effect
and
it
would
have
liked
a
person
quit
more
quickly
and
eating
edibles
takes
longer
for
the
body
to
process.
So
there's
those
factors
to
weigh
in.

marijuana,

at
least
want
to
give
them

not
seek
medical
attention
for
