Description
City of Charleston Committee on Real Estate 12/14/2020
B
B
We
started
off
around
9
30,
so
the
ground
was
wet
and
then
you
know
what
happens
when
you
play
golf.
You
adjust
for
the
the
moisture
on
the
ground
and
then
the
heat
is
soft
out
by
the
sun
and
all
that
water
is
gone.
There's
a
different
course.
So
if
you
go
from
very
slow
to
very
fast
yeah,
it's
just,
but
it
was
wonderful,
I
mean
it
was.
The
whole
experience
was
just
terrific.
I
talked
to
marshall
afterwards.
I
just
couldn't
be
prouder
of
what
they
did
out
there.
It
really.
A
B
Isn't
it
I,
I
told
marshall,
I
hate
him
because
it's
so
much
more
challenging
than
it
was
before
and,
of
course,
the
the
creme
de
la
creme
was
by
seven
dollar
cheeseburger
and
beer.
They
have
a
special
muni
beer
out
there
as
a
matter
of
fact,
and
it's
a
brewery
off
of
azalea
avenue
next
to
the
pearl
scene,
property
right,
but
not
too
far
from
jenkins,
orphanage
yeah
that
had
this
so
that.
D
B
B
Of
azalea
avenue
by
jenkins
orphanage
is
that
holy
city,
no
not
holy
city,
but
they
brew
the
muni
beer
out
there,
oh
cool
yeah,
so
we
have
to.
We
have
to
find
a
council
meeting
workshop
at
that
new
brewery.
E
B
B
If
peter,
I
think,
we've
got
a
form
present,
councilman
wearing
may
may
be
absent,
so
I'm
gonna
go
ahead
and
call
the
real
estate
committee
meeting
to
order.
It
is
approximately
3
34.
B
On
this
beautiful
day
in
charleston
monday,
the
14th
of
december
council
member
appel,
you
have
the
helm
on
invocation
or
a
moment
of
silence.
Whatever
may
be,
your
preference.
E
All
right
well,
thank
you,
chairman
shade
and
y'all
at
hanukkah,
it's
the
fifth
night,
I'm
gonna,
I'm
gonna
drop
a
hanukkah
prayer
on
on
everybody
tonight
at
the
real
estate
committee
meeting.
How
about
that
I.
E
That
translates
to
praised:
are
you
our
god,
ruler
of
the
universe
who
made
us
holy
through
your
commandments
and
commanded
us
to
kindle
the
hanukkah
lights?
Short,
simple,
sweet
right
to
the
point,
and
I
hope
that
we
all
take
some
inspiration
from
the
the
hanukkah
season.
You
know
we're
sort
of
like
the
opening
act
before
christmas,
but
I
just
wish
everybody
a
wonderful
holiday
season.
B
I
thank
you
for
that.
That's
beautiful-
and
I
mentioned
to
you
before
I'm
on
the
list,
sir,
for
the
emmanuel
synagogue
in
my
district,
and
I
give
the
hanukkah
prayers
and
I
read
them,
and
it's
really
just
magnificent
and
you're
right,
they're
short
to
the
point,
but
boy
they
they
hit
the
nail
on
the
the
hammer
hits
the
nail
on
the
right
on
point
with
all
of
that.
So
thank
you
for
sharing
and
interpreting.
B
So
we
have
minutes
for
our
november
23rd
2020
meeting
I'll.
Ask
a
motion
to
approve
our
minutes.
B
Go
nude!
Okay!
Is
that
second,
second
council,
member
jackson,
all
those
in
favor
say
aye
aye
any
apparently.
Thank
you
very
much.
I
understand
that
item
c
is
going
to
be
deferred,
madam
clerk,
so
maybe
you
jump
ahead,
but
move
on
to
four
item
c
and
go
right
into
item
a
request,
approval,
a
short-term
lease
of
1221
square
feet
of
ground
floor
retail
space
and
the
charleston
technical
center
and
peter.
Are
you
going
to
take
that
because
I
see
your
smiling
face?
Oh.
F
Yes,
thank
you.
Thank
you,
sir.
This
is
a
proposed
lease
from
january
1
to
april
30th
to
accommodate
the
staff
of
the
charleston
digital
corridor
in
anticipation
of
their
space
in
the
main
building
getting
complete,
hopefully
by
that
day.
F
So
it's
that's
short
of
a
term
and
then
it
converts
to
month
to
month,
if
we
need
for
it
too,
and
it's
for
the
retail
space
in
the
basement
and
the
ground
floor
of
the
parking
garage
as
as
stated
there
and
that's
where
they'll
set
up
shop
just
as
soon
as
we
can
get
everything
straight
over
there.
So.
B
D
I
didn't
have
a
question
peter
or
I
don't
think
we're
doing
this,
but
are
there
any
tenant
up
fits?
Are
we
having
to
make
any
special
accommodation
could
be
at
their
expense,
correct.
F
B
B
Much
better,
thank
you.
I
had
it
on
the
wrong
dial,
so
I
had
to
make
it
make
that
adjustment
item
b
is
a
request
for
authorization
of
the
man
to
execute
a
construction
management
agreement.
I
believe
sterling
you're
going
to
handle
this
for
us.
I
think
this
is
a
continuation
of
our
last
meeting.
We
had
with
the
daniel
island
tennis
center
is
that
correct.
A
A
There
is
no
fee
associated
with
this
agreement.
The
agreement
delegates
all
authority
to
charleston
tennis
to
manage
the
construction
of
the
renovations
that
are
going
to
be
happening
and
charleston
tennis
will
be
the
entity
that
contracts
directly
with
the
construction
contractor.
A
The
city
will
not
be
a
party
to
those
contracts.
The
city
will
assign
a
project
manager
from
our
capital
projects,
division
just
to
participate
and
attend
meetings
and
and
be
a
part
of
everything.
However,
it
will
be
a
more
limited
role
than
our
usual
participation.
A
Our
capital
team
and
our
parks
department
will
be
reviewing
any
items
that
come
up
that
have
to
do
with
maintenance
responsibilities
for
future
maintenance
of
the
facility
that
the
city
will
be
responsible
for
and
then
the
city
will
be
processing
all
the
requests
for
payment
of
invoices
and
applications
through
our
finance
department
and
those
will
be
paid
out
of
the
restricted
account
which
has
the
million
dollar
contribution
from
the
city.
A
We
will
make
as
an
initial
deposit
when
we
execute
these
agreements
and
then
thereafter
after
the
one
million
dollars
is
depleted,
this
will
be
made
out
of
the
donations
that
we
received
from
mr
navarro.
I
do
have
one
request
with
your
approval
of
this
item
tonight.
A
I
would
request
that
you
allow
us
to
amend
the
title
of
the
document.
We've
been
referring
to
this
as
a
construction
management
agreement.
However,
I
did
receive
a
request
from
the
attorneys
today
that
they
would
like
to
change
the
title
to
simply
say,
management,
and
the
reason
for
that
is
that
charleston
tennis
llc
is
not
going
to
be
licensed
under
south
carolina
as
a
construction
manager
and
so
to
avoid
any
confusion
on
that
issue.
We
just
would
rather
call
it
a
management
agreement.
B
Very
good,
all
right,
so
with
that
explanation
and
small
change
as
to
the
title
of
the
document
from
construction
to
management,
agreement
I'll
entertain
a
motion
to
approve
item
b.
A
C
B
Go
for
the
next
moment
and
I
think
over
my
life
that
there
was
a
second
any
further
discussion.
H
H
B
You
know
it's,
it's
pretty
good
when
you
are
still
around
yeah,
but
with
those
grammar
school
teachers
have
passed
on
and
you
got
fond
memories
of
them.
So
yeah.
H
Well
again,
it's
a
special
time
and
we
were
just
doing
a
period
of
separate
but
equal.
And
I
can
remember
when
we
were
separate
but
unable
to
possibly.
H
Oh
yeah,
but
they
were
preparing
us
to
at
that
time,
go
to
the
so-called
white
schools
at
the
time,
and
she
says
remember
that
one,
it's
just
not
you
and
your
family.
You
all
are
representative
of
us.
If
you
all
don't
know
the
subject
matter,
then
they're
going
to
think
we
can't
teach.
You
know
I
mean
that
was
I
mean
I
was
10
or
11
years
old
when
she
told
me
that
she's
94.
very
grateful,
but
anyway
miss
harrison
back
to
the
piece
where
mr
navarro
will
contribute.
H
A
Well,
we
we
do
have
our
donation
agreement,
which
was
a
separate
agreement,
and
then
we
also
have
our
lease
agreement,
so
this
is
sort
of
just
the
third
part
of
that
we
do
address.
You
know
all
of
the
parameters
of
the
division
and
the
restricted
account
and
all
of
those
things
documents
as
well.
H
So
the
reason
I
asked
that
question
higgins,
mr
mill
on
higgins-
I
mean
on
carl
richardson
park
what
we
now
call
carl
richardson
park.
We
actually
had
an
agreement
to
buy
that
property
and
prior
to
closure,
the
seller
died
and
then
costa
the
state
tried
to
back
out
the
agreement
which
led
to
you,
know
the
city
filing
eminent
domain
and
all
of
that
to
be
able
to
get
the
property.
So
I
just
wondered
if
we
thought
about
that
on
the
front
end
on
this
one
right
here.
B
You're
you're,
fading
in
and
out
for
some
reason,
yeah.
C
C
B
C
A
B
C
B
That's
charlestown
landing.
I
know
what
it
is.
H
As
a
matter
of
fact,
right
across
the
carl
richardson
park
is
what
you
see,
you
actually
look
right.
B
Yeah
we're
talking
about
that,
and
so
my
earlier
picture
that
we
had
on
public
safety
was
a
picture
of
the
of
a
sunset.
My
dogs
mud
was
on
that
and
the
marathon
I
was
swimming.
So
I
thought
I
better
change
my
background.
Something
else.
B
That's
okay!
You
were
following
up
on
councilmember
waring's
question
about
in
the
event
of
dealing
with
this.
A
That's
correct:
I
just
wanted
to
clarify
that
the
agreement
isn't
with
mr
navarro
personally,
it
is
with
bmoc
capital
or
I'm
sorry,
bmoc
sports,
one
llc.
So
there
is
an
entity
behind
the
agreement.
It's
not
a
person,
so
I
just
wanted
to
make
that
clear,
even
though
obviously
it's
mr
navarro's
entity.
H
Well,
it
would
survive
if
that
entity
has
the
money
to
do
it.
It
doesn't
survive
if
that
entity
doesn't
have
the
money
to
do
it.
I
know
it's
a
touchy
situation,
but
again
you
go
back
I'll
give
another
example.
You
go
back
to
the
gear
yarn
prior
to
starting
the
gear
yard.
You
know
this
public
private
partnership,
the
city
had
this
commitment
wrapped
up,
but
the
public
private
partnership
wasn't
already
in
place,
and
so
council
did
not
vote
to
move
forward
the
contract
until
50
of
those
dollars
were
in
place.
H
What
actually
happened
was
a
strong
backer
came
and
made
sure
that
those
dollars
were
in
place.
City
council
voted
to
move
forward
with
the
billing
of
the
gear
yacht
and
it
happened,
but
in
the
event
that,
because
we
would
look
like
idiots,
if
we
didn't
have
the
money
to
do
yard
and
charlie,
we
had
50
of
the
money,
so
we
didn't
have.
If
that
other
half
didn't
come
in,
we
would
had
a
building
halfway
finished.
H
You
know
built
into
nowhere
if
you
will
and
then
that
other
50
was
committed
to
very
quickly
and
and
the
process
went
forward.
So
I'm
just
you
know
just
thinking
down
the
road
in
the
event,
how
does
that
other
amount
is
guaranteed,
and
I
I
think
we
should
think
about
that
in
this
agreement.
D
A
Okay,
good,
I'm
sorry
mayor,
just
repeat
what
you
just
said:
I
think
you're
correct
the
the
city
will
not
be
the
one
entering
into
the
construction
contract.
It
will
be
charleston,
tennis,
llc,
charleston,
tennis
llc
will
then
come
to
us
to
reimburse
or
to
pay
invoices
out
of
that
restricted
account,
and
so
the
way
that
we
have
worded
this
particular
agreement.
A
It
says
that
those
funds,
our
payment
out
of
the
restricted
account,
is
contingent
upon
receipt
by
the
donor
of
the
donations
as
we
go
because
they
are
going
to
be
making
payments
on
an
incremental
basis
as
each
invoice
comes
in.
So
if
the
money
is
not
in
the
account
because
the
donor
has
has
not
deposited
the
donation
amount,
then
the
city
you
know
is
not
responsible
for
making
that
payment
does.
A
B
A
The
the
first
million
dollars
will
be
paid
by
the
city.
You
know
toward
the
renovations
which
you
know
includes
the
portion
that
we
would
have
been
responsible
for
renovating
this
year
anyways
and
then,
when
that
one
million
dollars
is
depleted
from
then
on,
it
will
be
contingent
upon
receiving
those
donations.
As
we
go.
C
A
Yes,
that's
right,
and
actually
I
think,
councilmember
waring.
We
we
did
that
at
your
suggestion,
maybe
at
the
when
we
first
brought
this
with
a
term
sheet,
but
they
will
provide
a
letter
from
the
bank
showing
the
ability
to
pay
the
aggrega
amount
of
the
donation,
which
is
estimated
to
be
about
40
million
dollars.
B
But
it
is,
it
is
an
important
question
because,
when
we're
dealing
with
these
llcs
and
in
my
experience
with
litigation,
llcs
can
come
and
go,
and
customer
appellate's
not
even
said
as
well
as
come
from
overwhelming
llcs
come
and
go,
and
so
you
sort
of
want
this
hybrid
of
the
llc's
of
signature
on
that
and
sometimes
with
a
personal
guarantee,
but
they
go
back
in
the
event
or
the
personal
guarantee
if
that
person
is
all
over
with
with
us
in
this
world.
What
does
that
lead
us,
except
for
in
the
state?
B
The
estate
would
still
be
on
the
hook
for
for
that
obligation.
B
H
Sterling
for
bringing
that
up
yeah
I
mean
that
experience
was
born
out
of
that
commitment
from
the
bank.
Frankly,
a
letter
credit
for
the
bank
was
the
piece
that
gave
comfort
for
us
to
move
forward
with
the
yard.
So
if
we've
got
that
here,
that's
then
I'm
fine.
A
And
we
don't
have
the
letter
yet,
but
you
know
I'll
definitely
request
that
we
we
get
that
in
hand
before
we
move
forward
executing
everything.
B
Without
explanation,
I'll
then
call
the
the
the
matter
for
a
vote
all
those
in
favor
of
approving
of
item
b.
As
I
know,
I'm
saying
yes,
as
amended,
hasn't
been
done.
Hi
hi
hi
any
opposed.
You
always
have
it
all
right.
Gioda
you'd,
like
you,
called
me
before
the
meeting
and
we're
deferring
item
numbers
to
c.
B
Is
there
anything
you
need
to
add
to
that
before
we
move
on.
G
No
sir
asv
america
street
ventures
wants
to
add
other
language
to
the
agreement,
and
our
legal
counsel
did
not
have
an
opportunity
to
review
that
in
its
entirety,
and
so
we
need
to
just
defer
until
we
can
look
at
the
other
aspects
that
they're
asking
us
to
consider
on
the
contract
or
on
the
exchange
agreement.
G
B
D
Mr
chairman,
could
I
address
just
an
issue
on
item
c,
just
to
inform
you,
mr
chairman,
and
the
committee
members,
one
of
the
issues
that
has
come
up
with
this
proposed
trade,
and
it
is
a
you
know,
a
proposal
because
there's
still
a
inspection
period,
if
you
will,
even
after
second
and
third
reading,
there's
it's
like
a
contract.
They
have
a
inspection
period,
but
they
didn't
want
to
proceed
with
buying
some
of
these
lots.
D
You
know
without
some
assurance
from
the
city
that
even
if
the
trade
fell
through
whether
the
city
was
still
interested
in
buying
those
lots-
and
I
I
wanted
to
share
with
you
and
and
committee
members
here-
that
that
I've
communicated
to
them
that,
yes,
the
city
is
still
interested
in
purchasing
those
lots,
because
they're
part
of
that
dutch
dialogues,
water,
living
with
water
plan
for
for
that
portion
of
the
east
side
and
and
those
lots
meet
that
goal
of
of
handling
water
storage
and
drainage.
D
So
so
I
have.
I
just
want
to
share
with
y'all
that,
even
even
if,
for
whatever
reason
this
passes,
and
then
the
humanities
group
decides,
they
don't
want
to
consummate
the
entire
swap
that
we
still
would
like
to
proceed
and
buy
those
lots
not
for
affordable
housing
purposes
so
much
but
for
drainage
purposes.
H
Wearing
agree
with
that,
I
support
that.
I
some
of
you
all
may
be
familiar,
but
very
early
on
on
the
bridge
site
there
was
an
iteration
where,
in
effect,
colonial
lake
type
ponding,
if
you
will
would
have
been
on
the
bridge
site
and
you
would
have
had
houses
around
a
colonial
lake
creation,
it
was
going
to
be
done
specifically
for
the
flooding
problem
over
there.
Mr
man,
I
think,
if
we
probably
can
take
through
the
archives,
you
probably
can
find
a
drawing
to
that.
H
You
know
versus
because
we're
putting
affordable
housing
on
those
sites
right
now,
so
some
use
of
storm
water
retention
type
effort
over
there.
Obviously
it's
warranted.
I
know
from
the
area
you're
talking
about
so
it
makes
a
lot
of
sense
to
move
forward
forward,
regardless
of
you
know
whether
the
swap
works
out
or
not
so.
B
Thank
you,
sir.
Thank
you
all
for
those
comments,
so
sean
johnson,
thank
you
for
bringing
that
to
our
attention
and
we'll
wait
until
january.
I
suspect,
until
we
we
address
that
issue
coming
back
up.
So
thanks
for
that
and
we'll
move
forward
with
the
fact
all
right,
so
we
have
two
annexations
one
in
district
six
and
the
others
in
in
district
number,
two
councilmember.
E
B
C
B
Discussion,
I'm
glad
that
councilmember,
sheila
and
gregory
are
joining
the
fray.
With
this
little
contest
run
out
of
the
year.
C
B
In
the
oppose
the
eyes
have
it:
this
is
our
last
meeting
of
the
calendar
year
on
real
estate,
as
I
mentioned,
to
our
public
safety
committee
folks.
Thank
you
all
for
the
opportunity
allowing
me
to
serve
as
your
chairman.
B
I've
enjoyed
it
and
it
certainly
gives
a
different
perspective
on
the
business
of
the
city
when
you
get
more
into
the
weeds
of
this
business
with
our
real
estate
and
our
management,
and-
and
I
do
think
that
probably
one
of
the
issues
we
need
to
be
addressing-
and
we
had
this
as
our
discussion
in
our
budget
considerations-
if
there
are
any
surplus
properties
that
we
need
to
jettison,
we
need
to
be
thinking
about
that
next
year.
B
So
that's
one
of
the
focuses
we
have
and
we
also
brought
up
some
other
items
with
annexation
of
these
donut
holes
and
annex
just
looking
at
an
archaeology
study
ordinance
as
well.
So
those
are
things
we're
going
to
continue
to
be
looking
at
next
year.
The
other
items
I'm
sure
they'll
be
popping
up.
I
suspect
we'll
have
a
busy
2021,
but
I
just
want
to
tell
you
all
about.
B
Thank
you
for
your
patience
with
me
and
I
really
do
enjoy
serving
on
this
committee
and
the
work
that
we
we
do
for
the
city.
So
thank
you.
Thank
you,
mr.
