As a homeowner in an HOA community, it is important to understand the role of the HOA. In this training you’ll learn some commonly used HOA terms, the role of the board, the president and other leadership positions, your rights and responsibilities as a homeowner, and effective ways you can actively support your HOA.
A
A
Let's
begin
by
defining
homeowners
association
also
referred
to
as
hoa
a
homeowners
association
is
an
organization
that
makes
and
enforces,
rules
as
well
as
maintain
grounds
for
multiple
unit
buildings
like
condominiums
and
townhomes,
and
planned
communities
of
single-family
homes.
When
you
purchase
a
home
in
an
hoa
community,
you
are
automatically
a
member
as
a
member.
You
agree
to
abide
by
the
rules
and
regulations
and
to
pay
dues
known
as
hoa
fees
if
you've
never
lived
in
the
hoa
community
before
the
information
can
be
overwhelming,
intimidating
and
sometimes
confusing.
A
The
articles
of
incorporation
is
a
brief
document
that
contains
basic
information
about
the
association
to
include
the
name,
location
and
its
purpose
for
a
non-profit
organization
that
is
filed
with
the
secretary
of
state,
where
the
development
is
located
before
any
property
in
a
condominium
or
planned
development
is
sold.
The
developer
forms
a
condominium
or
homeowners
association
to
run
it.
The
association
is
typically
created
by
filing
articles
of
incorporation
for
a
non-profit
organization
with
the
secretary
of
state.
This
creates
the
association
as
a
legal
entity
often
called
the
articles.
A
A
Our
next
term
are
bylaws
hoa
bylaws
govern
the
internal
affairs
of
the
association.
They
should
cover
things
like
how
often
you
have
meetings,
how
many
people
are
on
the
board?
How
often
you
have
to
have
membership
meetings
and
what's
a
quorum,
they
describe
how
the
association
is
run,
set
out
voting
rights
and
procedures
and
contain
rules
for
such
things
as
how
to
call
a
meeting
and
how
often
meetings
should
be
held.
A
A
Next,
we
have
the
declaration
of
covenants
conditions
and
restrictions
also
referred
to
as
ccrs
ccr
has
established
a
set
of
guidelines
for
maintenance
and
architectural
standards
and
also
give
the
board
the
power
to
issue
violations
to
any
homeowner
who
is
not
in
compliance
govern
what
an
home
owner
may
or
may
not
do
to
their
property
declarations
are
filed
with
the
county.
They
create
binding
obligations
to
the
members
and
association.
A
A
These
rules
cover
things
such
as
restrictions
on
how
much
a
unit
or
a
lot
may
be
altered,
pets,
waste
disposal
and
the
use
of
signage
parking
and
recreational
facilities.
Ccr's
take
precedence
over
rules
in
terms
of
legal
importance.
Since
rules
are
purely
internal,
our
next
term
is
board
of
directors.
A
A
These
elected
volunteer,
unpaid
officials
are
responsible
for
all
operations
of
the
association
and
ensuring
the
community's
governing
documents
are
followed
and
enforced
board
members
volunteers
serving
on
the
hra
board
are
referred
to
as
board
members.
Every
board
includes
a
minimum
of
four
central
officer
positions.
President
vice
president,
treasurer
and
secretary.
A
We
will
talk
about
these
positions
in
more
detail
later
on.
In
the
presentation
our
next
term
is
quorum.
A
quorum
is
the
smallest
number
of
board
members
necessary
to
legally
conduct
the
business
of
your
hoa.
A
quorum
is
critical
anytime.
An
hoa
board
wants
to
conduct
official
business
change,
rules
or
vote
on
new
board
members.
Quorum.
Specifics
can
be
found
in
hoa
bylaws.
A
A
While
some
properties
are
self-managed,
meaning
all
hoa
responsibilities
are
managed
by
the
board.
Some
hoas
choose
to
have
a
property
management
company
to
assist
hma
management.
Companies
are
a
community
association
management
company
or
hoa
management.
Company
is
often
contracted
by
the
board
to
help
fulfill
duties.
The
volunteer
board
members
are
unable
to
carry
out.
Often
these
companies
will
help
support
maintenance,
accounting
and
other
community
efforts,
depending
on
the
association's
needs.
A
The
board
has
the
ultimate
responsibility
for
operating
the
association
board.
Members
must
deal
in
good
faith
on
behalf
of
all
the
homeowners
and
exercise
reasonable
care.
Now,
we'll
take
a
look
at
some
of
those
roles
in
a
little
bit
more
detail,
president,
the
president
presides
over
meetings
and
makes
sure
all
members
of
the
board
have
the
opportunity
to
give
their
opinion,
and
the
decision
that
is
made
is
done
so
only
after
appropriate
discussion
and
with
the
best
interest
of
the
community
in
mind.
A
A
A
One
of
the
primary
responsibilities
of
the
board
of
directors
is
to
comply
with
governing
documents
in
state
law
board.
Members
must
be
familiar
with
the
state
law,
the
declaration
or
ccrs
the
bylaws
and
other
documents
which
form
a
contract
among
homeowners
within
the
hoa
the
board
members
of
a
fiduciary
duty
to
the
homeowners
to
manage
and
operate
the
association
by
making
rational
informed
decisions
in
good
faith.
A
Fiduciary
duties
include
three
basic
components:
the
duty
of
care,
the
duty
of
loyalty
and
the
duty
to
act
within
the
scope
of
authority.
First,
the
duty
of
care
to
meet
duty
of
care
board
members
must
make
informed
decisions
board.
Members
must
do
their
due
diligence
before
they
act
or
vote
on
an
hoa
matter.
A
A
A
As
a
homeowner
in
our
hoa
community,
we
can't
stress
enough
the
importance
of
knowing
your
documents.
Here
are
some
things
to
pay
attention
to
architectural
standards.
A
homeowners
association
may
adopt
architectural
standards
to
preserve
the
aesthetic
quality
and
property
values
within
the
community.
A
Architectural
standards
often
regulate
exterior
design
elements
such
as
paint
colors,
exterior
finishes
and
landscaping
materials.
Architectural
standards
often
establish
the
procedure
through
which
a
homeowner
may
obtain
the
association's
approval
for
desired
architectural
improvements
and
modifications
maintenance
requirements.
Every
homeowners
association
has
maintenance
requirements
and
regulations
that
are
unique.
It
is
important
that
you
familiarize
yourself
with
your
hoa's
governing
documents,
so
you
can
be
knowledgeable
about
maintenance
requirements
that
will
help
you
stay
in
line
with
community
guidelines.
A
As
a
homeowner,
you
have
individual
rights
based
on
the
laws
of
north
carolina
and
the
documents
you
signed
at
the
time
of
purchase
here
are
a
few
of
those
rights,
the
right
to
participate
in
meetings
of
the
board
of
directors
and
to
be
heard
the
right
to
enter
into
dialogue
with
your
association
board
of
directors.
With
regard
to
any
problem
you
may
perceive
in
the
development
the
right
to
a
hearing,
should
you
be
accused
of
violating
any
declaration
or
rules
and
regulations
governing
your
community,
the
use
of
common
areas
such
as
clubhouse
and
recreational
facilities?
A
A
A
As
previously
mentioned,
when
you
purchase
a
home
in
an
hoa
community,
you
are
a
member
as
a
member,
you
have
a
vested
interest
in
what
is
happening
in
your
community.
Here
are
some
ways
you
can
play
an
active
role
in
your
hoa
community
attend
association
meetings.
Many
homeowners
association
struggle
with
resident
participation
meetings,
attending
association
meetings
is
a
great
way
to
stay,
informed
and
updated
about
important
association
issues.
A
You
can
also
learn
more
about
how
and
why
decisions
are
made
vote.
Your
vote
counts.
You
hear
this
all
the
time
and
the
statement
rings
true
when
it
comes
to
your
hoa.
This
is
your
opportunity
to
have
a
say
in
who
leads
the
association,
how
it
is
run.
The
budget
and
future
plans
pay
dues
on
time
paying
your
dues
contributes
to
the
upkeep
of
your
community
and
can
help
you
avoid
costly
fees
for
non-payment
next
run
for
elected
office.
Hoa
boards
need
strong,
competent
and
caring
leaders.
A
If
that's
you
lend
your
time
and
expertise
to
serve
on
your
hoa
board.
Next
serve
on
a
committee.
Many
hoa
boards
establish
committees
to
address
specific
community
issues
and
tasks.
Committees
may
be
standing
or
ad
hoc.
They
are
a
great
way
to
lend
your
talents
to
your
community
participate
in
group
activities.
A
A
It
is
very
important
that
you
are
aware
of
who
lives
around
you
so
that
you
can
be
informed
if
something
is
awry
and
you
would
know
who
to
contact
participate
in
neighborhood
watch.
Many
neighborhoods
have
neighborhood
watch
groups
as
a
way
to
safeguard
themselves,
their
neighbors
and
their
property
from
crime.
