meeting
of
the
Chelsea
licensing.
Commission
today
is
Thursday
April
13
2023
I
am
joined
this
evening
by
fellow
Commissioners
Mike
mcateer,
Emily
cherniac
and
Alexandria
Christmas,
and
myself,
Marty
McAlpine
and
Cheryl
Watson
Fisher,
our
city
solicitor
and
Naomi
LeBron.
Our
licensing
admin
and
Peter
I.
Do
not

I

I

We
also
want
to
mention
that
last
time
there
seemed
to
be
a
little
confusion
around
what
the
commission
and
the
Department
thought
about
the
issuance
of
the
marijuana,
the
last
marijuana
retail
licenses.
We
want
to
recognize
that
the
process
for
the
issuance
of
the
marijuana
license
has
changed
due
to
recent
facts
that
several
potential
applicants
were
approved
by
the
city
land
use
boards.
In
our
February
meeting,
we
decided
to
have
a
Level
Playing
Field
for
all
those
who
applied
and
have
public
comment.

As
you
can
see,
there
were
two
applicants
at
the
last
meeting
that
were
found
to
be
suitable
and
issued
licenses.
Although
the
applicants
were
complete,
the
commission
and,
and
then
one
that
was
approved,
subject
to
submitting
financials,
which
I
believe
those
financials
were
submitted.
Yeah,
the
commission
announced
it's
in
its
intentions
in
that
February
meeting.

Unfortunately,
some
of
the
applicants
were
not
fully
prepared,
I
believe
the
one
that's
on
tonight
actually
came
down
with
covet,
unfortunately,
and
could
not
timely
file
his
the
department
misunderstood
and
thought
that
the
commission
wanted
all
the
applicants
at
one
time
at
this
time.
Although
the
licenses
had
been
approved,
those
licenses
approved
conditionally
based
on
the
ccc's
final
determination
and
issuance
of
the
occupancy
permit.
That
was
just
step
one.
Basically,
they
still
have
to
build
out
their
space
is
pursuant
to
the
special
permit
and
the
building
permit.

Then
they
still
go
back
to
the
CCC.
Who
will
re-again
look
at
every
single
thing:
pull
quarries,
look
at
their
finances,
get
their
finances
in
place.
A
lot
of
the
initial
finances
is
about
finding
a
location
and
build
out
the
location,
and
then
they
they
seek
at
their
occupancy
permit
time,
their
final
license
with
their
CCC
license
from
the
licensing
administrator.
So
if
there
are
any
issues
the
licensing
administrator
is
going
to
come
to
you
and
say
they
no
longer
meet
the
conditions,
and
we
now
have
an
open
license.

little
bit
of
confusion.
There
was
some
some
back
and
forth
as
to
why
some
things
were
being
reviewed
and
other
things
didn't
appear
to
match.
So
we
just
wanted
to
make
sure
that
everybody
understood
that
we
were
doing
our
best
to
make
sure
things
were
as
Fair
as
possible
in
a
situation
where
we
knew
there
was
a
large
number
of
applicants
with
a
minimal
number
of
licenses
available.

doing

best
to
give
everybody
a
fair
shot,
and
we
think
we
have
done
that
and
we
want
to
try
to
ensure
that
we
can
continue
to
provide
a
fair
rule
for
anything
moving
forward
in
any
sort
of
a
situation
working
with
information
that
is
provided
before
us
and
then
I
just
want
to
follow
up
on
that
I
believe
at
last
month's
meeting
you
stated
that
there
was
a
request
put
before
city
council
for.

An
adjustment
so
what's
pending
before
the
council,
the
hourly
so
a
couple
of
things,
we
have
to
change
zoning
to
some
specific
and
that's
the
hour.
For
some
reason,
the
hours
of
operation
were
put
in
the
zoning
Amendment,
not
the
regular
ordinance
and
the
ordinance
itself.
There's
a
review
on
the
amount
of
retail
licenses
that
we
are
going
to
issue
right
now.
We
are
capped.
At
six.

just
have
one
question
in
regards
with
all
the
applicants
that
was
presented
to
us
on
the
last
meeting:

guess:
I
was
still
confused.
All
of
them
had
the
provisional
licenses,
except
for
one
so
going
forward.
Should
we
open
up
for
another,
you
know
a
request
for
a
license:
should
they
have
their
provisional
license,
approved
or
sent
to
us
before
they're
presented
to
the
commission
so.

I'm
not
sure
the
one
tonight
has
a
provisional
license.
We
were
following
what
we
thought.
The
board
wanted.
Okay,
so
a
provisional
license.
When
we
initially
did
the
rules
and
regulations,
we
thought
a
provisional
license
meant
a
lot
of
weight
with
the
CCC
it
really
for
them.
It's
just
a
preliminary
step.

The
CCC
is
so
behind
on
issuing
those
those
licenses.
Since
we
started
this
process,
it's
changed.
People
are
issued
a
provisional
and
they've
been
sitting,
for
example,
one
of
the
licensed
situations.
Last
week
they
have
a
provisional
in
another
city
and
and
they've
had
it
for
a
while.
So
I'm
just
saying
is
that
a
provisional
is
sort
of
like
something
we
were
trying
to
avoid.

If
you
get
this
provisional
and
you
sit
on
it,
it's
sort
of
like
holding
liquor
licenses,
that's
that's
what
we
thought
we
were
doing
when
we
required
it,
but
it
doesn't
prevent
someone
from
just
holding
a
license.
So
I
recommend
that
within
a
couple
of
months
we
bring
some
of
them
back
because
one
do
they
have
the
provisional.
Do
they
get
their
final?
Where
what
is
their
progress,
because
there's
no
reason
to
hold
up
licenses?

If
someone
doesn't
have
the
financing
or
anything,
the
licensing
commission
may
need
to
be
spend
a
little
bit
more
time
administratively
with
these
applicants,
so
that
it's
fair
to
others
who
may
start
to
be
building
their
process.

up
a
good
point,
so
one
of
the
questions
that
I
would
have
is,
if
we're
seeing
that
these
provisional
licenses
are
no
longer
something
that
is
necessarily
something
we
should
be
viewing
as
a
requirement
at
the
start.

we
need
to
do
something
to
edit
the
rules
and
regulations
to
make,
so
it
no
longer
states
that
in
there?
So
there's
no
question
as
to
why
a
decision
was
made.

also
changed
the
process
on
the,

the
law
change
we
no
longer
get
the
added
three
percent,
so
we've
amended
our
hcas.

agreements,
the
current
retail
licenses
did
not
need
to
be
amended
because
they
came
at
they
just
signed
host
Community
agreements
that
were
just
on
one
document,
but
Western
Front
rise
and
Joe
locan
all
had
to
sign
and
amended,
and
we
no
longer
get
that
added
funding.
We
will
review
the
regulations,
mind
you.
We
were
ahead
of
the
curve
in
Chelsea
with
these
regulations.
We
just
wanted
to
have
something
in
place.
We
can
review
them.
Other
cities
and
towns
now
have
regulations.

the
commission
received
a
communication
regarding
taxi
fare
rates.
We
received
several
letters
and
I
will
read
the
first
one
as
they
are
all
virtually
the
same
letter
and
inform
you
of
who
sent
them
the
first
one
States
I

Alvarado

City
Taxi,
Incorporated,
respectfully,
and
kindly
asking
you
for
an
increase
on
the
taxi
fare.
The
reason
that
I'm
asking
you
is
because
the
increase
on
the
gasoline
and
the
cost
of
living
is
getting
very
expensive.
Also,
the
vehicle
repairs
too
I
will
appreciate
it
if
I
can
get
help.

license
administrator
has
started
pulling
the
rates
and
fees
from
the
cities
and
towns
that
are
surrounding
us,
so
that
you
have
some
information
ahead
of
time.

the

Kiwanis
lately
and
I'm.
Now,
a
member
and
as
such,
my
goal
here
is
to
to
help
their
fundraising
and
one
of
their
main
goals
is
to
provide
scholarships.

years
when
I
was
a
counselor
I
helped
raise
funding
and
awareness
for
the
summer
jobs
program.
They
really
are
meeting
their
meets.
You
know
their
needs

think
specifically
because
they
are
getting
a
little
extra
money.

talking
to
John
I
said
you
know
all
right,
they're,

Vine

think
you

Where
else
can
we
do
some
good
and

think
you

providing

Chelsea
High
School
students
through
this
Kiwanis
would
be
a
worthy
cause,
so
this
is
going
to
be
advertised
as
such
as
a
scholarship
race
towards
Aquinas
and
other
than
that
again
long.
History,
no
issues
over

years
that
they've
had
you
know.
As
far
as
you
know,
the
patrons
it
really
is
a
big
family
event.
Every
time
I
go
down
there,
lots
of
family
I.
Think
a
lot
of
families
are
looking
forward
to
it.
It's
like
a
kickoff
to
the
springs
kickoff
to
the
summer.

it's
a
really
good
good
field
of
rent
and
again
with
the
new
entrance,
we
should
be
able
to
take
care
of
the
concern
between
the
squabble
between
the
neighbors.

was
more
of
a
squabble
between

we've

addressed

if
this
is
approved,

again
reach

school
department.

superintendent
has
been
great
in
allowing
us

the

crossed
great
weather.

board
will

we're
not
disputing
the
facts
here

guess
the
issue
comes
down
to
there
should
be
a
sanction.

they

want
a
revocation,
but
we
read
the
report,
so
the
facts
are
not
in
dispute.

just.
What
do
we
do
with
those
facts?
What

can
say
is
the
business
has
been
around
since
2017?

have

employees
they're
all
tip
certified
the
woman
who
was
the
waitress
on
the
day
in
question
Juliana
she
was
suspended
for
a
couple
of
weeks.
The
business
had
a
an
immediate
they
meet
every
week,
but
they
had
a
what
you
call
it
emergency
meeting
afterwards
to
say
that
this
type
of
behavior
can't
be
tolerated
in
the
future,
I
told
him
he's
lucky
that
the
person
didn't
drive
that
nice.
You
know
I
mean
those
are
the
type
of
concerns
that
I
relate
to
him.

He
was
not
there
during
that
time
period,
but,
like
I
said
they
spoke
with
the
staff,
they
suspended
the
woman,
they
didn't
fire
her
and
if
they
can
explain
it,
they
didn't
fire
it
because
they
felt
she'd
been
working
it
for
a
year
and
a
half,
and
they
thought
she
was
a
good
employee.
Just
made
a
mistake
that
day,
so
they
didn't
want
to
let
her
go
but,
like
I
said
they're
not
here
to
dispute
the
facts
before
the
commission.

open
it

everybody

clearly
reading

job

business

been

that
is
actually
highly
concerning,
because
that
means
they're
not
taking

roles
seriously.

situations

has

strikes
against
them

serving
before
you
even
handed

license.

big
one
serving
while

what
the
commission
said.

last
time
that
you
came
before

were
suspended,
that
that
doesn't
really
make

feel
like
you're,
going
to
do
what
you're
supposed
to

moving

generally,
an
establishment
shouldn't
really
be
coming
before
the
licensing
commission
multiple
times.

typically
means
they're
not
doing

they're
supposed
to
there's
lots

establishments

exist

decades

licensing
board.
So
to
have
somebody
that's
coming
before
the
board
regularly
is
a
little
concerning
to
me
fellow
commissioners,.

what
you're
telling

but
what

see
is
there

supervision.

have

waitress
who's
just
over
serving
him

very
lucky.
He
didn't
get
into
an
incident.

I'm
very
disappointed.
I
am
here
to
help
the
community
and
have
you
know
like
restaurants
like
yourself,
to
serve
and
and
provide
the
service
that
you
want
to,
but
I
cannot
condone
this.
This
is
one
probably
many
you
just.
This
was
probably
just
caught
I'm
very
disappointed,
I,
don't
know
what
we're
gonna
do,
but
I
mean
there
has
to
be
a
lesson
learned
here.

agree:
this
is,
this
is
not
the
first
time
your
employees
were
clearly
familiar
with
that
individual.
My
guess
is
that
this
is
not
uncommon
for
this
individual
to
probably
consume
a
decent
amount,
because
nobody
seemed
very
surprised
by
the
demeanor
and
you
you
stated
something
about
how
he
was
going
to
get
in
a
car
he
refused
to
get
in
the
car
as
a
licensed
establishment.
We
are
responsible
for
what
that
person
does
after
we
serve
them.

It
doesn't
matter
that
you
did
the
right
thing,
then
and
put
them
in
a
car
which
didn't
even
happen
in
this
case.
What
matters
is
that
you
over
served,
because
whatever
happens
then
ends
up
your
fault.
That's
why
you
are
lucky
that
nothing
happened
and
nobody
was
killed,
because
your
establishment
would
be
to
blame.

That's
that's
the
fun
of
owning,
an
establishment
that
sells
liquor
and
that's
why,
when
we
do
these
things,
it
is
so
important
that
we
follow
the
rules
and
it's
not
easy.
You
guys
are
running
a
business.
You
want
to.
You
want
to
sell
to
your
customers,
but
you
want
to
be
able
to
continue
to
sell
to
your
customers.
So
that's
where
you
have
to
do
the
responsible
thing
and
shut
your
customers
off
before
they
are
intoxicated
to
that
level.

need
your
staff
to
actually
follow
the
tip
certification,
so
if
they
have
actually
all
completed
that
tip
certification,
that
tells
them
that
they
need
to
slow
down
that
process.
That
tells
them
that
when
you
have
somebody
that's
drinking
very
quickly,
you
slow
that
down.
You
bring
them
water,
you
take
a
little
longer
to
give
them
drinks.

We
were
on
I,
think
it
was
beer
number
12
and
your
waitress
was
putting
a
beer
at
the
table
while
he
was
still
in
the
bathroom
and
it's
not
like
your
establishment
was
so
busy.
She
wasn't
going
to
have
another
chance
to
get
over
to
him.
She
had
all
the
time
in
the
world.
So
your
team
is
completely
to
blame
for
putting
that
beer
there
so
quickly.

The
individual
who
drank
it
should,
in
my,
in
my
opinion,
as
somebody
who
is
a
licensee
I,
always
believe
that
the
person
who
does
it
should
also
be
to
blame.
But
as
the
person
who
holds
the
license,
we
are
more
liable
than
the
person
that
consumed
it.
It
is
your
job
to
make
sure
that
you
are
enforcing
those
rules
and
you
can't
be
there

That
means
your
team
has
to
be
trained
properly,
every
single
person
and
if
you
can't
be
there
and
your
wife
is
in
the
back
and
she
can't
watch
the
front,
then
you
need
somebody
else,
who's
responsible
out
in
that
front.
That's
going
to
follow
the
rules
and
protect
your
business,
because
that
is
not
protecting
your
business,
and
that
shows
that
you
had
two
individuals
that
were
over
serving
this
person
because
he's
clearly
drunk,
and
you
had
two
employees
that
over
served
him.

yards
away,
I
heard
the
call
the
drunk
gentleman
against
the
wall,
the
Good
Samaritan
woman.
That's
a
store!
My
90
year
old
mother
goes
to
probably
five
times
a
day,
because
she
can't
walk
that
far.
This
business
has
been
before
you
before
many
times
the
neighbors
to
the
right
of
them.
If
you're
looking
out
the
dry,
cleaner
I
bring
my
closer
every
day.
They
complain
to
people
urinating
I
drive
by
every
Friday
night
Saturday
night
Sunday
night
groups
loitering
packing
like
wherever
they
want
to
park.

noticed
the
same
pickup
trucks
there
from
nine
in
the
morning
till
nine
at
night,
I
don't
have
the
plates
with
me.
We've
been
before
I've
been
well
doing
this
since
2007.
in
the
past
you've
seen
businesses
that
you
can't
tell
to
serve
the
service.
This
is
clear.
This
service
there's
this
place,
should
be
out
of
business
I'm,
a
neighbor
I'm
sick
of
walking
by
there
at
night
I.
It's
it's
just
been
at
least
four
or
five
times
we
go
there
all
the
time
in
licensing
inspections
which
we
do
to
every
business.

They
don't
get
it.
It
is
a
Scourge
to
the
neighborhood.
If
you
ask
the
businesses
the
Prattville
map,
the
young
woman
who
work
there,
you'll
get
the
same
answers
I'm,
just
hoping
that
the
board
really
takes
this
serious
I've,
been
here
since
2007
and
since
they've
had
the
business
they've
been
before
you
at
least
twice
a
year
for
infractions.
This
is
the
most
daunting
like
I,
don't
care
if
they
go
to
the
ADCC,
no
one's
not
proving
service
here
so
I
hope
you
take
that
into
consideration.
