avenue

ruiz
park.
The
dbw
has
agreed
to
include
the
construction
of
this
crosswalk
as
part
of
its
work
for
the
2022
construction
season
to
ensure
that
the
crosswalk
is
ada
accessible.
The
work
necessarily
will
include
from
sidewalk
some
sidewalk
alteration.
We
expect
that
sidewalk
worked
throughout
the
city
will
commence
by
early
summer
and
when.

vedau
asked
that
we
adopt
on
the
suspension
the
approval
except
the
under
approval
council.

working
on

very

know,

ruiz

heavyweight
champion
of
the

type

product

we

just
wanted

say.

our

for
just
recognizing
this

again
it's
just
something
that
we
should
all
be
proud
of
and
make
sure
that
this
place
will
be
easy
and
accessible
to
anyone
who
wants
to
go
in
there.

Dear
counselors,
I
am
writing
in
response
to
the
recent
city
council
order,
requesting
that
the
city
explored
legal
action
against
the
northeast
metropolitan
regional
vocational
school
district
regarding
the
cost
of
the
new
school,
the
city's
share
of
the
costs
and
or
the
district's
admission
process.
With
respect
to
each
issue,
it
is
my
opinion
and
the
opinion
of
the
city's
solicitor.
The
city
does
not
have
any
viable
legal
case
at
the
moment
and
we
strongly
recommend
against
legal
proceedings
regarding
the
cost
of
the
school
and
the
city's
share.

Specifically,
the
district
followed
to
the
letter
of
the
statutory
process
for
incurring
depth
for
the
purpose
of
constructing
a
new
school
when
a
member
of
any
regional
school
district
objects
to
paying
a
debt
for
a
new
school.
The
statute
allows
for
the
regional
school
district
to
pursue
a
district-wide
vote
determined
by
the
majority
of
those
voting,
see
mass
general
law
chapter
76,
section
16n.
C
That
is
exactly
what
occurred
here.
Further.
The
way
that
that
capital
debt
is
shared
across
the
district
proportionally
based
on
solely
upon
enrollment
is
set
out
explicitly
in
the
inter-municipal
agreement
that
they
established
the
district
more
than
50
years
ago.
So
there
is
no
basis
to
challenge
the
debt
or
the
cost
sharing.

As
for
the
admission
process,
that
is
a
matter
within
the
purview
of
the
department
of
elementary
and
secondary
education.
Dse
last
summer,
d-e-s-e
did
change
its
regulations
governing
the
emission
policies
of
all
vocational
technical
schools
and
required
that
each
school
develop
new
admission
policies
that
promote
equitable
assets.

The
better
approach
is
to
allow
the
ese
to
continue
its
oversight
and
monitoring
the
situation.
The
city
has
always
had
the
option
to
pursue
litigation
in
the
future.
If
it
subsequently
believes
desi's
efforts
have
been
ineffective
and
chelsea's
residents
are
being
denied
admission
due
to
unfair
process
practices,
although
I
do
not
recommend
legal
action
at
this
time,
I
feel
obligated
to
point
out
that
the
council
could
consider
in
the
alternative
of
withdrawal
from
the
district
for
reasons
set
below.

I
also
recommend
against
this
option.
The
inter-municipal
agreement
established
establishing
the
district
includes
a
procedure
if
any
member
wishes
to
withdraw
from
the
district.
Under
the
terms
of
the
agreement,
a
municipal
member
may
withdraw
with
the
affirmative.
Vote
of
two-thirds
of
the
members,
however,
is
highly
unlikely
that
eight
of
the
twelve
members
of
the
district
would
voluntarily
agree
to
any
withdrawal
by
chelsea,
given
chelsea's
required
trio
of
this
school
building
project.

In
one
recent
circumstance
involving
the
town
of
worthington.
The
massachusetts
legislature
allowed
exactly
that
to
occur.
Chapter
97
of
the
acts
of
2014
and
the
mass
massachusetts
appeals
court
held
this
legislative
action.
Despite
claims
from
the
regional
school
district
that
this
involved,
an
unconstitutional
impairment
of
contract
rights,
kennedy
versus
commonwealth
92,
mass
affiliate
court
644
of
2018
just
keep
in
mind
that
this
situation
with
the
town
of
worthington
did
not
involve
a
new
school
building
and
that
factor
could
make
the
legislature
more
hesitant
to
allow
withdrawal
over
the
objection
of
the
other
district
members.

However,
even
if
the
legislature
were
amenable,
I
do
not
recommend
this
course
of
action,
because
I
think
the
situation
for
elected
officials
would
be
untenable
once
the
new
school
opens.
Remember.
Our
goal
in
opposing
the
new
project
was
in
part,
to
generate
consideration
of
a
less
expensive
building.
We
never
denied
a
new
facili
facility.
Excuse
me,
a
new
facility
was
necessary,
but
with
our
efforts
unsuccessful,
we
are
now
faced
with
a
situation
where
this
new,
state-of-the-art,
luxurious,
school
building
will
become
a
reality.

If
chelsea
withdraws
now
from
the
district,
we
still
need
to
find
an
alternative
option
for
our
students
seeking
vocational
technical
training.
Undoubtedly,
we
would
secure
a
less
expensive
alternative
than
the
northeast
metropolitan
regional
vocational
school
district
with
its
costly
new
building,
but
it
will
also
mean
that
our
residents
choosing
this
vocational
law
option
for
their
children
will
be
sending
them
to
some
significantly
lesser
facility
with
fewer
programming
options.

At
that
point,
I
expect
chelsea
parents
who
would
feel
a
great
sense
of
dissatisfaction
and
equity,
given
that
their
neighbors
would
have
have
access
to
a
new,
state-of-the-art
high
school,
but
enrollment
in
that
new
high
school
for
their
own
children
will
be
prohibited
rather
than
trying
to
defend
that
difficult
reality.
It
seems
to
me
the
city
is
better
served
finding
a
creative
financial
solution
to
observe
the
annual
debt
service
payments
for
the
new
building.

scholarship
program
in
chelsea
continues
to
open
doors
of
opportunity
for
our
graduates
and
counter
systemic
challenges.
The
city
of
chelsea
has
done

right

residents
by
putting
educational
opportunity
first,
and
we
are
most
grateful
for
this
continuous
investment.
In
our
students
background
chelsea
public
schools
has
built
one
of
the
largest
early
college
high
schools
in
the
state.
This
investment
has
proven
to
significantly
increase
college
completion.

a
new
applicant
or
second
year,
returning
at
bunker
hill
community
college
applicant,
the
eligibility
requirements
for
new
applicants
are
as
follows:
one
chelsea
high
students
must
complete
three
bunker
hill
community
courses
successfully
with
a
seek
or
better
grade.
Seventy
percent
or
better
coursework
in
bunkail
community
community
college
foundational
classes
or
the
e-l-l-e-l-a
cluster
can
be
applied
towards
the
three
courses.
