This
will
be
the
meeting
of
the
board
flood
Board
of
adjustments
and
Appeals
and
is
called
to
order
on
June
4th
2019
agenda
of
today's
meetings
are
on
the
wall.
At
the
entrance
to
the
chamber,
please
remember
to
turn
off
your
cellphone's
to
ensure
complete
record
of
board's
action.
We
ask
that
each
individual
wishing
to
speak,
including
the
appellant
step
to
the
podium,
clearly
state
your
name
and
spelling
your
last
name
before
the
clerk
I
talk
to
funny
on
a
root
canal
swing,
state,
Florida
statute,
section
28
to
eight
six
point:
zero.
A
One,
zero
five
requires
any
party
appealing
a
decision
of
this
board
to
have
a
record
of
the
proceedings
to
support
such
appeal
code,
ordinance,
section
47.0.
Three
four
provides
that
decisions
of
this
board
shall
be
final
subject
to
judicial
review
in
the
circuit
court
were
reviewed
by
the
county
white
board
of
adjustments
and
appeals.
If
an
appeal
is
filed
within
15
days
of
today's
decision
in
the
case
involving
codes
adopted
by
countywide
application
and
enforcement,
now
I
ask
that
all
those
who
plan
to
speak
please
raise
and
be
sworn
in
by
the
clerk.

F
Right
we'll
do
that
I
would
want
to
put
on
the
record
from
Vicki.
You
did
hear
from
the
applicant
the
event,
but
we'd
like
to
put
that
on
the
record
right
that
she
had
acknowledged
this
and
had
said
she
was
going
to
attend.
Correct,
okay
and
I'd,
also
like
to
pawn
the
record
Sam
you
got
green
cards
returned
that
she
was
properly
notified
right.
F
Okay,
all
right.
So
this
is
a
property
1135
tangerine
street
that
we
did
a
housing
inspection
housing
code,
which
is
part
of
your
manual
hair.
It
isn't
included
in
there,
which
is
looking
for
basic
minimums
of
building
to
live
there,
and
we
have
a
presentation
to
show
you
some
pictures
of
the
violations.
F
I
I
say
good
afternoon
to
the
ward
yeah:
this
was
a
housing
complaint
that
came
in
and
when
I
did
an
inspection
at
11:35,
tangerine
Street
I
wanted
to
show
you
a
few
items
here.
They
were
cited
night
violations
from
our
housing
standard
housing
code
and,
as
you
can
see,
they're
from
chapter
3
sections
302.
I
I
305
point
16
point
to
have
some
issues
with
some
floors
and
I
see
three
or
five
point
three
point:
two
soffit
and
facia
305
point
five:
the
porch
and
three
or
five
point:
eight
windows
to
be
glazed
I,
sent
out
the
housing
report
back
in
January
30
1939
signed
on
March
4th
of
nineteen
I
didn't
sent
out
I'm.
Sorry
I
did
that
after
they
have
a
posting
on
the
property
on
four
to
nineteen.
I
I
11:35
tangerine:
this
is
the
home
in
question.
This
is
the
front
view
of
the
home
at
the
time
in
January,
29th
I
took
this
picture
and
we
start
kind
of
going
through
some
of
the
items
that
I
noted
on
the
side
of
home.
The
crawlspace
was
open
that
needs
to
either
be
screened
or
covered
to
prevent
any
kind.
Is
there
anything
going
inside.
I
You
know
I
noted
the
windowpane,
that
was
cracked
and
the
screens
are
kind
of
this
place
and
those
items
need
to
be
repaired.
This
is
the
interior
of
that
same
window
from
the
bedroom,
and
you
begin
to
see
some
of
the
writing
of
the
framing
around
the
window,
and
this
is
kind
of
a
sign
of
all.
All
the
windows
are
looking
again
another
picture
of
that
window.
I
I
I
I
I
H

G
My
name
is

I'm,
the
one
that
called
in
the
initial
it's
my
full
name
is

ir
I
ca,
but
I
just
used
Bao,
it's
just

Karthik
CA,
RT
y
you're
welcome
I
called
in
the
initial
report
to
the
city
of
Clearwater.
Mr.
Swinton
did
an
excellent
job
with
the
presentation,
pretty
much
detailed
everything
that
is
going
on
with
the
units
at
this
time.
I
moved
out
as
of
this
past
Friday,
but
things
have
gotten
worse
there.
There
are
a
lot
of
little.
G
They
look
like
little
long.
Fruit
flies
that
are
flying
around
the
house.
Now
I
mentioned
to
mr.
Swift
that
there
are
roaches
that
are
behind
the
oven.
We
see
them
in
the
clock.
She
tried
to
say
that
I
was
the
one
that
brought
them
they're,
not
getting
it
in
there
and
I
looked
there
for
years.
She'd
never
said
anything
to
me
about
them.
So
obviously
it's
not
true.
G
D
C
Okay,
I've
been
the
property
owner
since
1990
and
obviously
land
a
purchase
of
property.
It
was
nothing
the
way
it
looks
now
when
I
first
got
the
property
it
had.
Holes
in
the
Floyd
was
a
typical
tenement
Shack
and
over
the
years
have
done
several
intermittent
renovations,
I
own
several
properties
in
clean
water
and
also
st.
Pete,
and
they
are
not
in
any
deplorable
condition,
as
has
been
painted
by
whoever
I
also
want
to
say
that
I
have
never
seen
a
copy
of
the
report.
C
Until
today,
I
got
a
copy
yesterday
sent
to
my
email
and
the
building
where
I
work
and
I
generally
work
out
of
town,
but
the
building
that
I
work
in
you
really
can
see.
Google
Chrome,
it's
the
email
I
mean
the
old
Internet
so
but
anyway,
I
was
able
to
see
it
today,
but
prior
to
that,
I
had
no
knowledge
of
what
was
in
that
report.
I
called
mr.
Swenson
several
times.
I
have
been
down
to
the
court
to
the
department
where
he
works
and
I
mr.
C
Swenson
I
think
he
is
a
person
who
made
these
allegations
and
I
have
also
been
down
there.
I
ended
up
speaking
to
his
supervisor,
going
to
for
me
that
he
would
call-
and
he
never
did
with
multiple
calls
so
ox.
Actually,
today
was
the
first
time
I
got
to
see
the
report,
because
the
reports
would
go
to
the
property
and
the
tenants
would
take
control
of
them.
Historically,
when
I've
sent
people
to
fix
anything
out
the
property,
they
owe
a
lot
of
the
individuals.
They
come
back
and
told
me
about
the
person
who's
sitting
there.
C
That
she's
very
mean
I
also
have
copies
of
Texas
between
myself
and
that
individual,
and
they
have
informed
me
that
she's
very
difficult
to
deal
with
she
is
very
belligerent.
She
has
gotten
rid
of
several
of
my
tenants.
I
have
copies
text
copies
from
them,
how,
when
they
get
home
to
work
they're
in
their
bed
when
she
gets
home,
she
harasses
them,
and
a
lot
of
the
tenants
have
moved
out.
C
As
a
result,
I
chose
not
to
put
anyone
in
there
while
she
was
here
while
she
was
there,
she
moved
out
last
Friday
I,
evicted,
her
and
I
chose
not
to
bring
anyone
in
that
environment
because
it,
you
know,
if
I
have
people
who
are
there
after
she
leaves
whatever
she
told
them.
It's
going
to
be
repeated
to
subsequent
tenants.
So
I
chose
to
not
there
so
I
I,
don't
know
what
she
was.
What
what
her
side
is,
but
I
do
know
that
whenever
requests
came
over
to
me
to
fix
anything,
it
was
done.
I.
C
Would
like
the
members
present
to
know
that
I
am
NOT
a
slumlord?
My
motto
is:
if
I
can't
live,
there
would
not
have
anyone
living
there.
People
often
tell
me
that
I
spend
too
much
money
on
my
properties
to
fix
them
up,
because
they
look
better
than
the
average
property
that
tenants
reside
in
so
I
feel
that
the
reason
there
was
a
discord
with
their
person
who
called
mr.
Simpson,
was
because
she
felt
she
was
better
and
they
do
have
text
to
prove
that
than
the
people
who
are
was
bringing
their
and
as
a
result.
C
But
while
both
of
us
were
in
the
court
in
court,
while
I
was
the
victim,
Hersh
I
saw
maybe
one
or
two
of
the
pictures
which
I
had
never
seen
before,
and
the
judge
even
commented
that
the
property
is
beautiful.
Again,
I
used
to
be
an
inspector
for
the
state,
I
inspected,
nursing
homes
and
you
could
go
in
to
go
into
any
building.
You
could
find
the
fault
of
anything
and
I
once
had
a
supervisor
who
said
you
could
always?
C
Think
it's
unfair
when
someone
could
go
to
the
city
and
I
read
their
the
rules
where,
if
I'm
driving
by
and
they
see
a
property
in
disrepair,
could
call
the
city
and
the
to
make
them
fix
it.
So
it
doesn't
have
to
be
someone
who
lives
there.
Anyone
can
do
that,
but
I'm
sure.
If
you
go
into
Clearwater
any
day,
you
will
find
properties
that
needs
fixing
and
it's
not
done
the
same
gentleman
who
came
out
to
my
property.
He
was
fully
aware
that
their
house
next
door
was
in
ill
repair
for
many
years.
C
There
were
extension
ports
hanging
and
he
did
nothing
about
that
and
I
knew
he
knew
about
it
because
when
they
before
they
put
that
sign
for
no
dumping
up,
there
I've
seen
him
there
in
his
vehicle
and
he
knew
that
property
was
and
he
chose
to
not
act,
and
the
rule
says
if
even
if
I'm
driving
by
and
I
see
something
I
could
report
it.
If
you
live
there,
you
could
report
it.
C
H
H
Let's
in
your
appeal
that
the
building
code
has
been
either
misapplied
or
misinterpreted,
you're
asking
this
board
to
overturn
the
decision
of
the
building
department
of
AeroGarden.
Do
you
have
any
questions
relative
to
that
issue
before
mr.
Swinton,
because
the
issues
with
yourself
and
your
land
and
your
tenant.
C
H
C
H
C
H
H
H
H
C
C
A
C
A
C
Right
he
said
I
think
he
said
a
certified
mail
I
can
swear
to
that,
but
whatever
was
sent
was
certified
and
I
work
out
of
town
and
if
something
is
at
the
peel
box-
and
that
is
my
mode
of
communication,
if
something
is
sent
to
the
peel
box-
and
it's
not
picked
up
during
the
day
when
the
post
office
is
open
or
during
the
time
there
a
lot
of
time
for
pickup.
It
goes
back
to
the
sender.
A
C
C
Legally
use
the
peel
box,
that's
where
my
taxes
go
and
I've
never
had
issues
getting
anything
from
the
municipality,
but
the
method
he
chose
to
use
was
the
signature,
but
again
I
know.
Historically,
people
have
done
both
they
would
send
the
certified
and
they
would
also
send
an
uncertified
copy
and
usually
I
would
get
a
certified
that
a
certified
copy.
In
this
case,
I
got
neither
and
I,
took
a
day
off
and
came
and
went
to
see
him
in
his
office,
but
when
I
got
there,
he
was
in
the
field,
his
supervisor.
C
A
E
I
Yes,
I
received
one
voicemail
on
my
line
at
the
time
that
I
received
this
complaint.
I
didn't
make
the
call
return.
Call,
as
my
supervisor
allows
me
to
do
so.
I
got
a
voicemail.
It
said
it
was
full,
so
there
was
no
way
for
me
to
leave
a
message.
I,
don't
know
about
multiple
calls
that
she
said
that
I
actually
made.
I
However,
if
I
guess
we
going
far
as
the
certified
mail,
that
is
the
legal
way
that
we
have
to
notify
the
tenants
or
the
owners
is
by
certified
mail
based
on
what
the
property
appraiser
has
as
an
address.
We
have
to
send
that
because
we
have
to
get
a
receipt
back,
that
they
received
it.
If
we
get
the
letter
back
unsigned,
we
post
the
property,
which
I
did
that's
the
second
legal
way
to
do
it.
She
did
not
respond
to
the
posting
and
that's
why
we're
here
today.
A
C
F
Well,
I
would
just
like
to
point
out
that
she
was
aware.
Miss
Williams
was
aware
of
something
up:
April
29th
when
she
made
this
application,
whether
she
was
aware
in
April
of
what
she
was
applying
for
or
appealing
whether
she's
aware
now
today
our
ultimate
goal
is
for
compliance.
You
just
get
those
repairs
made,
and
you
know
we
are
all
fine
with
a
reasonable
amount
of
time
to
do
that
and
really
that's
our
only
our
only
reason
for
visiting
the
property
is
just
get
the
repairs,
the
maintenance
done
on
the
building.
C
C
Okay
said
I
think
if
I
go
over
there,
the
grass
would
be
uncut,
because
I
sent
someone
to
cut
the
grass
and
she
told
him
don't
cut
the
grass.
These
are
things
I've
had
to
deal
with
her,
so
when
people
were
sent
another
leading
to
this,
but
to
do
other
things,
they
were
met
with
hostility,
and
that
is
why
she
had
to
get
out
of
the
property,
because.
C
To
to
what
has
happened
when
I
have
problematic
tenant,
it
would
be
in
my
best
interest
to
get
them
out
because
bigger
issues
when
I
knew
she
was
preventing
people
from
going
there
it
could.
It
should
have
been
at
that
time
that
I
I
got
rid
of
her
instead
of
waiting
months
later
for
all
of
this
to
escalate.
A
C
C
B
C
And
I
did
I
will
say
this
when
we
were
in
court,
she
had
the
pictures
showing
the
judge
why
she
refused
to
pay
rent
and
so
I
said.
Let
me
see
those
pictures
and
so
I
did
see
one
with
her.
There
was
a
hallway
light
and
well
what
what
triggered
me
to
do
that
she
was
alleging
that
there
were
wires
that
are
hanging
and
I
know
I'm,
not
that
killest.
Obviously,
when
it
comes
to
wiring,
you
know
your
antlers
are
going
to
go
up,
so
I
definitely
wanted
to
see
that
particular
one.
C
C
B
C
B
F
E
H
The
existence
or
nonexistence
of
the
code
violation
is
really
matter
that
is
within
the
jurisdiction
of
the
code
enforcement
or
we're
a
city
and
can
make
their
case
as
a
violation.
What
you're
being
asked
to
do
in
this
case
is
to
determine
that
the
building
official
or
a
staff
has
misconstrued
over
supply
the
building,
so.
A
A
H
C
F
If
you
want
to
come
down
to
our
office,
meet
with
either
samurai
or
both
of
us
set
an
appointment,
and
you
know
we'd
like
to
hear
what
your
proposal
is
for
bringing
these
repairs
into
completion
and
and
we're
over
100
South
Myrtle
second
floor,
sweet
tooth
tent
or
if
you,
if
you're
at
work
or
whatever
and
I,
want
to
do
it
by
phone.
We
can
do
that
to
know
we
can
kind
of
accommodate
whatever
you
need.
C
C
C
F
Architects
engineers
contractors
is
the
makeup
of
the
board
yeah.
We
live
in
Clearwater.
