B
The
municipal
code
enforcement
board
consists
of
seven
members
who
are
appointed
by
the
city
council
we
serve
voluntarily.
It
is
this
board's
intention
to
promote,
protect
and
improve
the
health,
safety
and
welfare
of
the
citizens
of
clearwater.
By
providing
this
equitable,
effective
and
inexpensive
method
of
enforcing
certain
codes
within
the
city.
The
board
considers
new
business
items
in
two
parts:
first,
the
violation
and
then
affirm
relief,
formal
rules
of
evidence
do
not
apply.
Each
side
is
limited
to
15
minutes.
The
board
may
grant
additional
time
all
proceedings
will
be
conducted
in
a
calm
civil
manner.
B
B
B
Please
step
to
the
podium
and
state
your
name
and
address
for
the
record.
You
have
three
minutes
to
speak
on
a
subject
that
is
not
on
today's
agenda.
Hi,
I'm
kevin
garriott.
E
And
I
am
with
the
planning
and
development
department
building
department,
and
I
just
wanted
to
remind
you
that
there's
a
mic
in
front
of
you
and
to
kind
of
lean
into
that,
because
last
meeting
was
very
difficult
to
hear.
So
you
have
to
sometimes
kind
of
speak
towards.
A
B
G
Sandra
castle
is
105
96,
lena
street
central
florida.
I'm
sorry.
B
Okay,
do
you
admit
to
the
violation?
Yes,
yes,
okay,
then
thank
you.
Please
have
a
seat
in
the
front
and
I
will
call
you
back.
H
There's
actually
one
violation
is
going
to
be
a
declaration
of
violation
for
today,
that's
for
the
business
tax
receipt
that
was
obtained
for
the
rental,
the
other
violation
for
grass
parking
is
still
occurring
at
the
property
and
I
will
go
through
the
case
just
so.
We
can
take
a
look
at
it.
B
Okay,
can
we
do
the
declaration
on
the
the
btr
first?
Okay,
can
I
get
a
declaration.
D
I
moved
to
find
the
respondent
was
in
violation
of
the
code
as
referred
to
in
the
after
days
of
this
case.
The
violation
was
corrected
prior
to
today's
meeting
today's
hearing
and
we
enter
into
an
order
that
no
fine
be
imposed.
The
respondent
repeats
the
violation.
The
board
may
order
a
fine
up
to
five
hundred
dollars.
For
each
day.
The
violation
continues
to
exist.
H
H
I
H
Posting
was
posted
on
march
27
2022,
and
the
nose
of
hearing
was
posted
to
property.
On
june
10th
of
2022
turner
street
is
kind
of
a
skinny
street
in
clearwater.
There's
not
a
lot
of
parking
available.
A
lot
of
the
property
is,
there
are
skinny
long
lots.
Some
of
them
have
rear
parking
areas,
but
there's
been
a
lot
of
ration
just
parking
all
over
the
front
yard.
In
the
area
I
was
going
by,
I
saw
this
vehicle
parked
up
front
in
turner
street.
H
H
C
H
H
But
I've
been
back
to
the
property
several
times
the
business
tax
receipt
was
not
obtained.
There
was
still
a
grass
parking
issue
and
no
permits
pulled
for
any
of
the
any
of
the
driveway
additions
that
were
spoken
about
before.
So
on
the
4th
of
may
and
again
on
the
16th.
There
were
two
vehicles
parked
in
the
grass,
and
this
is
just
showing
proof
that
they
now
have
a
business
tax
receipt
in
our
seller
system,
so
that
was
taken
care
of
I
went
by
today
and
the
vehicles
weren't
there,
but
it
comes
and
goes.
H
We
had
a
conversation
today
about
keeping
in
contact
with
the
inspectors.
So
I
can
know
what
their
plans
are
going
forward,
because
I
hadn't
heard
that
from
them
for
a
few
months.
H
So
this
is
what
the
parking
looks
like
right
now
again,
one
of
the
vehicles
is
on
that
concrete
pad,
but
there's
only
about
space
for
two
vehicles,
any
third
vehicle
to
have
to
be
parked
next
to
it
in
the
street,
because
there's
no,
the
driver
doesn't
extend
all
the
way.
The
fence
on
that
side
of
the
home.
H
F
So
we
certainly
want
to
fix
the
problem.
You
know,
you
know
we
that's
an
investment
property
for
us,
so
we
want
the
values
to
continue
to
rise.
One
option
obviously
is
to
park
on
the
street,
but
that's
a
that's
a
tough
street.
It
is
tight
there.
A
lot
of
people
drive
crazy
down
it.
So
yeah
very,
very.
G
Fast
so
we
talked
to
the
residents
about
parking
on
the
street
and
they
were
all
opposed
to
that
because
you
know
if
my
car
gets
hit,
I
can't
afford
to
replace
it
and
everybody
speeds
up
and
down
there,
including
the
police,
the
fire
department
and
the
ambulances
yeah.
So
dan
has
been
very.
G
F
I
think
we
have
three
options:
either
the
street
parking,
which
might
not
be
a
very
good
one,
but
putting
a
parking
space
to
the
right
of
the
the
drop
of
the
the
sidewalk
or
extending
the
driveway
yeah
on
the
left
side.
So
we
just
need
a
little
bit
of
time
to
if
you
could
allow
that
to
to
research
our
options.
We
have
contacted
a
few
different
contractors
because
it's
not
homesteaded.
We
need
to
go
through
a
contractor
yeah
and
it's
a
little
difficult
to
get
all
the
people
and
get
them
to
come
out.
H
J
Construction
just
curious,
if
there's
any
risk
of
a
repeat
violation,
if
it's
a
long-term
tenant
in
the
house
or
is
it
kind
of
different
tenants,
it
is
okay,
so
they'll
probably
be
more
compliant
with
you
guys
once
you
yeah,
that's
great,
I
was
thinking.
Airbnb
is
just
no.
It's
so
much
turnover
their.
G
Annual
long
term
yeah
also,
there
are
apparently
several
departments
that
we
need
to
contact
within
the
city
for
visibility,
and
then
I
don't
know
I'm
calling
it
design
standards.
That's
probably
the
wrong
word
to
use,
but
so
we
have
to
contact
a
couple,
different
departments
to
find
out
what
you
know
what
the
rules
are.
As
far
as
how
they're
looking
you.
G
He
can
help
you
yeah,
I
didn't
realize
I
had
to
stay
in
touch
with
him.
I
thought
once
he
passed
it
off
to
the
other
somebody
else
in
permitting
maybe
or
the
anna's
somebody
that
I
I
kind
of.
I
didn't
realize
that
I
dropped
the
chain
of
command
with
him,
so
our
chain
communication,
so
I
didn't
realize
I
had
to
stay
in
touch
with
you.
Sorry
about
that,
but
no.
H
All
right,
daniel
chasm
code
enforcement
inspector
for
the
city
of
clearwater
for
908
turner
street
case
number,
37-22,
there's
currently
one
violation
here
for
grass
parking,
I'm
requesting
compliance
on
it
before
july,
22,
2022
or
a
final
150
per
day
per
violation.
For
each
day
the
violation
continues
to
exist.
I'm
asking
the
board
to
authorize
the
following
after
three
months
from
the
recreation
date
of
such
lien.
If
the
fines
and
fees
remain
unpaid,
the
city
attorney's
office
is
authorized
to
foreclose,
collect
or
settle
such
thing
using
any
legal
or
equitable
remedies
available
under
the
law.
J
I
moved
into
an
order
requiring
the
respondent
to
correct
the
violations
on
or
before
august
21st.
If
the
respondent
does
not
comply
by
that
date,
the
door
the
board
may
order
a
fine
of
up
to
250
per
violation
per
day.
If
the
violation
continues
to
exist
exist
if
fines
and
fees
remain
unpaid.
Three
months
after
such
lien
is
filed,
the
city
is
authorized
to
foreclose,
collect
or
settle.
Certainly.
A
I'm
sorry
miss
davis,
if
you
could
just
say
the
amount
of
the
daily
fine.
You
said
up
to
250.
J
Thank
you
150
per
day,
I'll
repeat
the
motion.
If
the
respondent
does
not
comply
by
that
date,
the
board
may
order
a
fine
of
150
per
day
per
violation
for
each
day.
Each
violation
continues
to
exist
if
fines
and
fees
remain
unpaid.
Three
months
after
such
lean
is
filed,
the
city
is
authorized
to
foreclose,
settle
or
collect
on
such
lien.
A

Okay
case
3922
respondents,
martin
l,
altener
trust
lawrence
j
finkel
at
3312,
south
betty
lane,
in
violation
of
code
for
roof
maintenance
and
residential
rental
business
tax
receipt.
Is
there
anyone
here
to
speak
on
this
case?
B
No,
okay.
Are
you
requesting
a
declaration.
H
H
There
are
two
violations
here
for
code:
section,
3-1,
502,
d1,
d3
and
d5
for
roof
maintenance,
clean
roof
and
false
roof
elements
and
code,
section
3-2302
for
residential
rental
business
tax
receipt,
the
notice
of
violation
was
sent
on
march,
1,
2022
and
again
on
april
4th
2022
compliance
date
of
april
1st,
2022
and
april
9
2022..
There
was
an
affidavit
posting
posts
on
april
4th
2022
and
a
notice
of
hearing
was
posted
on
june
10th
2022..
H
This
is
312
south
betty
lane.
It's
a
duplex.
When
I
first
showed
up
the
property
I
could
notice.
There
was
some
issues
with
the
fashion
on
the
front
there
on
the
side
of
the
building.
There's
some
really
tall,
bushes
they've
drawn
my
eye
and
I'd
seen.
This
was
some
damage
behind
where
the
bushes
were.
I
had
spoken
with
a
man
claiming
to
represent
the
owner.
Who
was
a
property
manager?
H
This
was
the
posting
of
the
affidavits
for
the
violations,
because
I
never
received
a
green
card.
I
took
another
look
at
the
property
at
the
same
time
was
still
being
rented
at
the
time
with
no
btr
in
our
system,
we're
back
in
the
11th
after
the
compliance
date
and
took
a
closer
look.
They
had
chopped
down
the
trees
in
the
bushes,
but
when
I
took
a
closer
look
to
the
patio
area,
the
entire
roof
has
collapsed
in
there,
which
was
somewhat
hidden
by
the
bushes
that
were
still
there
and
there's
sunlight
coming
through.
H
And,
as
I
took
a
look
further
back,
there
were
more
issues,
more
algae,
mildew
on
the
property,
and
then
it
seems
the
entire
rear
of
the
property
has
been
wrapped
in
a
tarp
and
there's
a
tarp
on
the
roof
as
well.
I
tried
contacting
the
property
manager
who's
spoken
with
me.
Once
I've
been
no
one's
gotten.
K
H
H
I
H
J
Any
reason
you're
not
unable
to
reach
the
owners
like
is
it
just
not
listed?
There's.
H
H
This
is
case
number
39-22
through
12
south
betty
lane,
two
violations
for
roof
maintenance,
residential
business
tax,
receipt,
requesting
compliance
honor
before
july,
22nd
of
2022
or
550
per
day
per
violation.
For
each
day.
The
violations
continue
to
exist.
We're
asking
the
board
to
authorize
the
following
after
three
months
from
the
recordation
date
of
such
lane.
If
the
fines
and
fees
remain
unpaid,
the
city
attorney's
office
is
authorized
to
foreclose,
collect
or
settle
such
lien
using
any
legal
or
equitable
remedies
available
under
law.
J
Yeah
I'll
make
a
promotion.
I
moved
to
enter
an
order
requiring
the
respondent
to
correct
the
violations
on
or
before
july
22nd.
If
the
respondent
does
not
comply
by
that
date,
the
board
may
order
a
fine
of
150
per
day
per
violation
for
each
day.
Each
violation
continues
to
exist
if
fines
and
fees
remain
unpaid.
Three
months
after
such
lean
is
filed,
the
city
is
authorized
to
foreclose,
collect
or
settle
such
lien.
H
Appliance
can
be
met
for
the
roof
maintenance
by
removing
all
tarps
from
the
roof,
repairing
any
damage
to
the
roof,
fascist,
soffits
and
roof
of
the
patio.
In
addition,
please
remove
all
debris
from
the
roof
and
comply
permit
for
residential

receipt
by
obtaining
a
residential
rental
business
tax
receiver
by
ceasing
to
rent
the

B
L
L
Okay,
this
is
for
a
light.
It's
a
town
hall
have
to
have
a
contractor
to
work
on
a
town
home
the
owner
put
in
a
light
in
the
back,
and
I
sent
notice
a
violation
on
1019
2021,
12,
27
2021
and
315
20
22.
L
compliance
was
for
november
of
november
18,
2021
january
18,
2022
and
november
sorry
april.
4
2022..
L
I
received
the
return
receipt
in
october,
can't
give
you
a
date
because
I
can't
remember,
but
I
mark
it
with
yellow,
highlight-
and
I
saw
her
handwriting
and
I
said
to
myself
really
nice
handwriting
and
then
the
december
and
march
cards
came
back.
Unsigned
notice
of
hearing
was
posted
on
the
property
in
march,
and
I
I
got
that
certified
mail
return
was
in
april
6
of
2022.
L
Called
and
let
us
let
me
know,
said
that
it
was
so
bright
that
it
was
coming
into
his
house
and-
and
I
looked
in
the
computer
to
see
if
there
was
a
permit
to
apply
for
nothing.
L
L
L
L
I
L
Okay,
so
we
are
recommending
that
compliance
be
on
or
before
july,
29th
2022
I'll
give
should
be
enough
time
to
find
a
contractor.
I
know
they've
been
very
busy,
but
more
than
enough
time,
a
fine
of
150
dollars
per
day
after
three
months
of
the
recreation
date
of
such
lane.
If
the
fines
and
fees
remain
unpaid,
the
city
attorney's
office
is
authorized
to
foreclose,
collect
or
settle
such
lien
using
any
legal
or
equitable
remedies
available
under
the
law.
J
I
moved
into
an
order
requiring
the
respondent
to
correct
the
violations
on
or
before
july
29th.
If
the
respondent
does
not
comply
by
that

the
board
may
order
a

of

per
violation.
For
each
day.
Each
violation
continues
to

if

such
lean
is

the

is
authorized
to

or

such

M
Since
there
isn't
any
water
there,
it
becomes
a
very
inhabitable
place,
I'm
sure,
and
so
that
is
the
violation
at
this
time
again
I
have
not
been
inside
and
honestly,
I
don't
care
to
do
it,
but
I'm
sure
the
individual
that
lives
there
from
what
we
understand
in
the
neighbors
are
the
ones
that
are
complaining.
B
O
Hi,
I'm

I'm

To
answer
your
question.
The
only
thing
I
can
say
is:
maybe
I
don't
know
if
the
city
requires
you.
O
J
M
I
have
not
currently
been
in
contact
with
him.
I
mean,
if
you
want
to
hear
from
respect
to
brown.
She
has
more
insight
on
who
this
individual
is,
and
you
can.
She
can
speak
on
that
yeah.
Thank
you.
P
P
My
last
contact
with
the
property
owner
was
december
22nd
when
we
were
moving
forward
with
a
towing
of
that
vehicle
that
you
saw
there,
and
at
that
time
we
had
a
very,
very
hostile
scary
encounter
with
the
property
owner.
He
doesn't
come
to
the
door,
but
he
did
once
the
tow
was
happening
and
we
had
to
have
the
police
out
and
he's
there.
Okay,
all
right
and
he
wants
to
stay
off
the
radar,
but
the
neighbors
are
stricken.
P
P
Mr
monroe
has
demonstrated
some
mental
capacity
issues
in
the
past.
I've
experienced
those
things
firsthand
so
the
neighbors,
even
though
they
are
not
here
today.
You
know
they're
scared,
they're,
very
scared
and
his
vehicle's
been
taken
away.
It
had
to
get
towed
back,
it
doesn't
operate
so
he's
just
there
under
the
radar
inhabiting
the
house
to
our
knowledge.
So
that's
why
we
asked
he's
the
owner
of
the
house
correct
and
it's
a
homestead
property.

For
each
day,
the
violation
continues
to
exist.
We're
asking
that
the
board
also
arrives
they're
following
after
three
months
from
the
recommendation
date
of
such
lien,
the
fines
and

remain
unpaid.
The

is
authorized

using

remedies

20Th
27th,
I'm
sorry
over
27.
J
J
If
the
respondent
does
not
comply
by
that
date,
the
board
may
order
a
fine
of
up
to
fifty
dollars
per
day
for
violation
for
each
for
each
day,
each

continues
to

Hey
this
again
is
case.
Excuse

there's

notice

for
today's
hearing
was
sent
out
on

and
that
certified

said
receive
527
22..
This
property
is
located
just
office,
golf
the
bay
and
just
west
of
lake
behind
the
church's
chicken.
If
you
know
that's
located,
this
is
a
view
of
the
behind
the
green
building.
The
shed
which
is
located
on
this
would
be
the
south
side
of
the
home.
C
B
Okay,
that's
it
do
you
have
a
timeline
on
when
you
think
you'll
have
that
plan
from
an
engineer.
J
It
just
takes
longer
when
you
actually
speak
with
them.
They're
booked
like
30
days
out
just
in
their
time
constraints.
So
if
you
do
need
more
time,
you
should
let
us
know
and
request
that
that
way
we
can
deliberate
and
see
if
that's
something
we
can
do
maybe
60
days,
I
don't
know.
If
you
think
30
is
fine,
then
we
can
60
days.
Okay,
thank
you.
Okay,.
M
I
I
have
no
problem
with
the
60
days
the
recommendation
for
this
work
without
permit.
We
were
requesting
the
issue
of
the
permit
be
issued
on
before
july
22nd
or
find
up
150
per
day
for
each
state
of
violation
continues
to
exist,
also
asking
if
the
board
authorized
the
following
after
three

from
the

date
of
such
lane,
fines
and
fees
remain
unpaid.
The
city

is

such
thing
using
any

are

I
E
J
Okay,
okay
I'll,
do
the
motion
and
it's
150..
Yes,
okay,
okay,
I
moved
into
an
order
requiring
the
respondent
to
correct
the
violations
on
it
before
august
21st
that
the
respondent
does
not
comply
by
that
date.
The
board
may
order
a
fine
of
up
to
150
per
day
for
violation
for
each
day.
Each
violation
continues
to
exist
if
fines
and
fees
remain
unpaid.
Three
months
after
such
lean
is
filed,
the
city
is
authorized
to
foreclose,
collect
or
settle
such
lien
I'll
stop.

J
J
A
N
B
P
P
Basically,
there's
one
violation
of
this
property
for
lot:
clearing,
I.e,
it's
overgrowth
or
an
accumulation
of
undergrowth.
It's
a
residential
property
and
countryside
and
basically
they've
got
an
obstructed.
Sidewalk,
it's
super
obstructed
and
we
just
can't
get
them
to
do
anything
about
it.
I
said
a
notice
of
violation
was
posted.
On
april
26th,
I
issued
a
courtesy
letter
on
march
22
and
I
first
went
to
the
house
on
march
4th
and
left
the
door
hanger
I've
been
to
the
house
five
times
to
leave
word
and
still
nothing.
P
P
I
did
get
the
certified
mail
green
card
back
on
may
5th,
2022
from
the
property
owner,
which
is
it's
a
rental.
It's
a
registered
rental
that
part's
sorted
out
all
right.
This
is
you're.
Looking
at
enterprise
road,
this
property
backs
up
to
enterprise
road.
This
is
a
super.
Well,
traveled,
sidewalk
and
on
april
25th
you
can
see
there's
barely
any
sidewalk
left
under
there.
Their
hedges
are
just
growing
way
into
the
sidewalk.
There's
leaves
everywhere
it's
a
mess.
People's
heads
are
running
into
things
there
and
I
get
calls
about
it
all
the
time.
P
It's
just
ongoing.
Here's
a
picture
of
my
posting
at
the
property
on
april
26
at
the
front
people
live
there,
but
there
it
is.
This
was
june
17th,
as
you
can
see,
that's
my
face.
You
know
you
cannot
get
down
this
sidewalk
without
running
into
things.
It's
just
so
narrow
and
it's
just
not
safe.
That's
a
main
road
right
there
and
then
the
right-of-way
all
the
way
out
to
the
street.
P
What
you're
seeing
there
extends
out
the
entire
length
and
it's
pretty
it's
really
long.
It's
a
really
long
frontage
and
there's
another
view.
Looking
east.
The
other
way
you
can
just
see
the
sidewalk
gets
skinnier
and
skinnier,
and
it's
really
hard
to
get
by.
Here's
an
example
of
what
a
real
sidewalk
looks
like
next
door.
Okay,
so
just
kind
of
comparing
you
know
bad
good,
that's
it!
D
Move
to
internet
order,
finding
the
violation
of
code
and
require
the
response
to
correct
violations
within
five
days
of
board's
written
order
if
respondent
does
not
comply
with
the
time
specified.
The
city
may
take
all
responsible
actions,
including
entering
onto
the
property,
to
abate
and
maintain
the
nuisance
and
charge
the
respondent
with
the
response,
reasonable
cost,
which
will
become
a
lien
on
the
property
if
cost
fines
and
fees
remain
unpaid
for
three
months
after
subscribe,
the
city
is
not
provided
for
close,
collect
or
settle
such
lien.
Yes,.
N
H
H
So
this
is
172
north
belcher,
it's
closest
to
drew
and
belcher
it's
a
interesting
property.
I
don't
quite
understand
what's
going
on
there,
but
there
seems
to
be
some
activity
at
the
property.
I
found
this
toyota
4
runner
with
no
license
plate
on
it,
so
post
the
vehicle
with
notice
with
today's
hearing
and
a
compliance
date.
H
That's
what
the
vehicle
looks
like
after
being
posted
and
went
back
on
the
9th
of
june
and
the
vehicle
still
has
no
license
plate
notice.
It's
still
on
the
vehicle
went
back
on
the
16th.
The
vehicle
has
been
moved.
It
looks
like
it's
been
cleaned,
but
there's
still
no
license
plate
on
it,
and
then
I
went
back
today
and
again.
They
still
have
no
license
plate
on
the
vehicle.
H
H
To
contact
me
or
anything
but
looks
like
someone's
taking
notice
case
number
47-22
172
north
belcher
avenue
one
violation
for
an
operative
vehicle
and
requesting
compliance
honored
before
five
days
from
the
date,
the
board
renders
its
order
and
the
nebraska
board
authorized
the
following
for
the
compliance
division.
Take
out
reasonable
actions,
including
entry
in
the
property
to
abate
and
maintain
the
nuisance
and
charge
the
violator
with
reasonable
costs
which
become
the
lien
on
the
property
after
three
months
from
the
recordation
date
of
such
lanes
of
fines
and
fees
remain
unpaid.
B
I
have
a
question
yeah
on
that
like
would,
if
they
were,
I
guess
going
through
the
process
of
getting
a
tag.
Is
that
something
that
you
would
be
able
to
find
or
know
that's
beyond
what
you
are
responsible
for
if.
H
We
have
a
system
called
david
which
we
can
use.
I
could
look
up
the
vin
to
see
if
it's
currently
registered,
but
even
if
it
was
registered,
you
still
have
to
display
the
license
plate
on
the
vehicle.
With
the
tag
and
of
course,
if
someone
was
to
contact
me
and
say
I
have
a
date
with
the
dmv
to
get
the
license
plate,
I
would
certainly
give
them
time,
but
no
one's
contacting
me.
B
H
D
I
moved
to
enter
an
order
finding
the
respondent
in
violation
of
code
and
required
the
respondent
to
correct
the
violation
within
five
days
of
the
board's
written
order.
If
the
respondent
does
not
comply
within
the
time
specified.
The
city
may
take
all
reasonable
actions,
including
entry
onto
the
property,
to
abate
and
maintain
the
nuisance
and
charge
the
respondent
with
the
reasonable
cost,
which
will
become
a
lien
on
the
property.
If
costs,
fines
and
fees
remain
unpaid
for
three
months
after
such
lean
is
filed,
the
city
is
authorized
to
foreclose,
collect
or
settle
separately.
