to
the
weekend,
because
there
was
concern
about
the
business
being
operational
over
the
weekend.

put
a
couple
of
things
on
the
record,
first
and
foremost,
an
attorney

want
to
verify
this
that
I
sent
a
group
of
documents
that
I'm
going

and
ask
that
they
be
become
part
of
the
record.
There
is
also
a
there
are
actually
two
small
snippets
of
video
which
captured
pot
or
all
of
the
event
which
I
also
forwarded
on
to
attorney
heeman.

couple
of
things
I
want
to
present
to
the
committee
there's
going
to
be
the
testimony
of
major
patelano
who
was
in
charge
of
the
investigation.

this,
the
city's
first
witness
do.
We

we
don't
have
a

direct

attention

the
very
early
morning,
hours
of
march
28th,
this
past
sunday,
at
approximately
just
after
midnight,
let's
say
close
to
12

Was
the
police
department
able
to
determine
more
specifics
in
terms
of
how
the
incident
unfolded.

Yes,
several
witnesses
had
fled
the
scene
as
well
as
the
people
that
were
alleged
to
have
fired
the
weapons
in
front
of
the
pregame
lounge.
When
officers
arrived
there,
some
of
the
information
they
received
was
well
first,
let's
talk
about
what
they
observed
when
they
arrived.
They
observed
shell
casings
on
the
ground.
They
found
a
window
shot
out
and
two
adjacent
businesses
that
had
been
struck
from
there.
They
began
interviewing
witnesses.

They
provide
descriptions
of
vehicles
as
well
as
potential
suspects
in
which
those
vehicle
people
were
in
which
vehicles
they
were
in
broadcasts
were
put
out
to
be
on
the
lookout
for
these
certain
vehicles.
At
one
point,
we
determined
that
no
one
had
been
injured.
Luckily,
somehow
no
one
was
hit.
We
were
able
to
obtain
video
footage
of
the
incident,
a
small
snippet
one,
which
you
will
see
tonight-
that
you
have
a
copy
of
so
it
was.

Pre-Game
lounge
had,
or
we
were
told
that
they
hired
a
promoter
to
promote
their
lounge
and
it
attracted
a
large
number
of
people
from
all
around
out
of
state,
and
the
place
was
absolutely
full.
It
was
packed
and
at
some
point,
two
groups
had
an
altercation
believed
to
be
over
a
woman
inside
the
pregame
lounge
that
spilled
out
into
the
streets
which
they
dispersed
themselves.

A
short
time
later,
someone
came
as
you'll
see
in
the
video
driving
by
and
began
shooting
at
one
of
the
individuals
actually
two
of
the
individuals
they
returned
fire
and
a
volley
of
shots
went
back
and
forth,
and
it
it.
We
believe
we
believe
it
happened
and
it
started
with
inside
the
pre-game
lounge.

to

knowledge,
let's
strike

me
ask
you
this:
have
you
reviewed
the
officer's
report
of
michael
rocchio.

officer
rocchio
indicated
that
a
mr
lopez,
who
I
believe,
is
the
one
of
the
principals.
If
not
the
principal
of
the
club
was
interviewed
pursuant
to
this
incident.
Is
that
a
fair
statement?
Yes,
he
interviewed,
they
did
speak
and
did
he
describe
a
group
of
individuals
who
had
left
the
pregame
lounge
just
prior
to
the
shooting,
taking.

In
fact,
he
indicated
that
there
was
a
group
of
males
who
walked
outside
and
he
thought
it
was
unusual
because
it
occurred
during
peak
hours.
Do
you
recall
officer
rocchio
stating
that
in
his
report.

result
of
at
least
the
preliminary
investigation,
were
you
or
any
members
of
the
cranston
police
department
able
to
determine
if
any
of
the
individuals
who
were
inside

pre-game
lounge
were
involved
in
this
shooting
after
they
left

arrived
there

calls
they
received
were
directly
from
the
pregame
lounge.
When
we
reviewed
the
videotape,
you
will
see
people
coming
out
of
the
pre-game
lounge
involved
in
this
okay
and
they
fired
weapons,

that
would
lead
us
to
believe
that
they
had
the
weapons
also
inside
the
pre-game
lounge
prior
to
the
shooting.

We're
going
to
see
we're
going
to
watch
the
the
video
momentarily,
but
before
I
get
to
the
video
I
just
want
to
go
over
some
of
the
past
incidents.
If
any
that
the
cranston
police
department
has
investigated
with
regard
to
the
pregame
lounge
and,
let's
go
back,
say
the
past.
Within
the
past
two
years,
have
the
cranston
police
department
been
called
upon
to
respond
to
the
pre-game
lounge
for
any
other
type
of
incidents
in
the
past
two
years,.

Yes,
we've
been
there
for
several
nuisance,
complaints
and
loud
music
and
disturbances,
but
one
that
does
stick
out
is
on.
In
september
of
2020
we
had
another
report
of
shots
fired
from
the
pregame
launch.

what
was

result,
if
anything
of
that
investigation
were
any
charges
ever
brought
or
what
were
the
findings.

didn't
we
weren't
notified
of
that.
We
learned
that
from
neighbors
and
we
responded,
so
it
was
never
reported
to
us
from
the
pre-game.
It
was
outside
the
pre-game,
we
were
told,
but
it
didn't.
We
were
unable
to
again
determine
who
it
was
that
was
involved
in
the
shooting,
but
we
did
get
a
report
of
that.

type

violation.

a

of

personal
knowledge
if
a
pregame
mileage

cited
by
the
department

business
regulation

certain
violations
of
the
covet
rules,
while
they
were
in
effect?

the
nature
of

violation

establishment

violating

mandates

fire

their
vehicles
and
we
believe
to
chase
down
the
person
who
fired
at
him.

vehicle

jumping
in
person
jumping
in
his
top
and
they're,
both
going
to
speed
off
towards
bombing,
see
that
vehicle
going
after
him
and
then
you'll
see
another
vehicle

go
after

local
business

next

the

down

shooting

vehicle
they
hit
the
ground.

them
get
up,

flashes

Those
are
gunshots

again
they
get
in
their
vehicles
and
chase
after
the
individual.

a
few
follow-up

upon
something
I

explore
and
let
me
ask
the
first
question:
is:
have
you
been
able
to
determine
up
to
this
point
roughly

approximately
how
many
shots
may
have
been
fired
in
total.

struck

farmington
dyer,
there's
a
business
on

corner

southwest
corner
and
that
building
was
struck,
which
is
almost
a
block
away.
It
was
struck
a
bullet
pierced
through
the
window
and
went
into
the
into
the
establishment.

sure
the
committee's
probably
familiar
with
the
area,
but
for
the
record
that
area
of
dire
avenue,
I
believe,
is
right.
Where
farmington
avenue
comes
into
dyer
avenue
that
corner

is

One
final

assuming

I'll

directly

you've
discussed
this
entire
incident
with
colonel
winquist
and
he's?
Has
he
been
apprised
of
what
we've
discussed
here
he
has
this
afternoon

based
on
those
discussions
with
him,
I'm
going
to
ask
you
if
you
have
an
opinion
as
to
whether
keeping
pregame
lounge
operational
poses
a
threat
to
the
health,
safety,
welfare
or
morals
to
the
people
of
cranston,
particularly
in
that
area.
So,
yes,.

did
discuss
it
all
of
us,
including
major
quirk,
and
we
come
to
the
absolute
conclusion
that
this
business
should
not
be
allowed
to
stay
open.
We
believe
it
faces
an
imminent
danger
to
all
the
people
in
that
area
and
that's
evidenced
by
the
calls
we've
been
receiving
with
loud
from
loud
music
to
gunshots.
People
are
afraid
to
come
forward
in
the
area,
they're
afraid
to
make
their
complaints
put
their
names
on
complaints.

So
we
feel
that,
based
on
the
acts
that
have
taken
place
over
the
past
few
nights
there
that
it
needs
to
be
closed
and
that's
why
we
were
so
prompt
in
getting
this
hearing
going
before
this
weekend,
because
we
felt
that
something
could
certainly
transpire
at
this
place.

police
department

able

locate

these
people,

arrest
them

jail

actions,

home

have
three
children
running
around
like
maniacs
on
a
friday
night
in
my
house.

reason

because

usually
try

call
people

there's

issue,

drastic
step

we
don't

particular
case

with
this
particular
license
holder,
we've
done
that
in
the
past,
major
patellano
testified
as
to
an
incident
which
occurred
last
year
involving
a
shooting
and,
as
a
result,
we
brought
to
my
recollection
because
I
was
here
and
I
believe
I
handled
that
it
was
approximately
a
year
ago
we
brought
the
the
license
holder
in.

think
he
was
represented
by
attorney
heman
then,
and
we
discussed
some
of
the
issues
regarding
security
and,
regarding
you
know
the
some
of
the
other
issues
that
were
taking
place
down
there,
and
I
I
thought
we
had
worked
things
out
and
things
were
pretty
quiet.
I
think
for
a
while.

Unfortunately,
that
did
not
last
and
I
I
don't
have
to
spend
a
lot
of
time
on
it.
There
is
absolutely
no
question
that
a
shootout
occurred
on
dyer
avenue.
There
is
absolutely
no
question
that
people
who
were
inside
the
pregame
lounge
participated
at
some
point
in
this
exchange
of
gunfire.
Now
it's
not
up
to
the
city,
it's
not
up
to
the
police
department
to
figure
out.
You
know
motives
and
the
why
or
the
wherefore
that?
That's
not
why
we're
here.
That's
that!
That's
not
our
task!
It's
not
your
task!

If
this
shooting
took
place
two
hours
later-
and
it
was
down
the
other
end
of
dyer
avenue
or
down
toward
park
avenue
or
something
there
would
be
very
little
nexus,
there
would
be
a
very
tenuous
connection.
This
is
contemporaneous.
I
mean
this.
You
saw
for
yourself
with
your
own
eyes
and
you
could
hear
with
your
own
ears.
This
was
contemporaneous
in
time
and
geographically
it
took
place
literally
a
couple
of
feet
in
front
of
the
entrance.
It
took
place
nearly
when
these
people
walked
out
of
the
pre-game
lounge.
Obviously
something
was
going
on.

You
would
have
to
believe
that
this
was
the
biggest
coincidence
in
the
world
that
a
bunch
of
cars
just
happened
to
be
coming
down.
Dyer
avenue
just
happened
to
point
their
guns
at
people.
They
don't
know
for
no
reason,
I
mean
that
that
really
strains
logic
and
it
simply
doesn't
make
sense.
So,
unlike
some
of
the
other
cases
we've
had
in
the
past,
where
we've
had
things
like
underage
drinking
or
you
know,
we've
had
rowdyism
and
we've
had
things
like
that.

This
this
rises
to
a
whole
other
level
and
in
the
time
I've
been
here.
I
have
never
requested
revocation
of
a
license,
but
this
incident,
I
think
you
would
all
agree,
put
literally
put
people's
lives
in
danger.

This
wasn't
even
like
a
random
act
of
shooting
between
two
people,
arguing
it
wasn't
just
a
gun
going
off.
This
was
a
gun
battle.
I
mean
this
was
a
battle.
This
was
something
you
see,
you
know
in
chicago
or
something
like
that
and
it's
a
miracle.
There
was
a
business
owner
who
was
in
his
business
and
a
bullet
comes
through
the
window.

I
mean
it's,
it's
a
really
a
miracle,
I'm
not
trying
to
exaggerate
or
be
melodramatic,
but
it
really
is
surprising
and
thank
god
that
nobody
was
struck
by
a
straight
bullet
police
know
of
eight
shots
that
were
fired.
You
heard
major
panel
testify
that
there
were
probably
many
more.
These
are
semi-automatic
weapons.

So,
as
I
said
before,
you
know
it's
unfortunate.
We
hate
to
do
it,
but
the
business
owner
being
the
license
holder,
whether
it's
fair
or
unfair,
justified
or
unjustified.

The
court
has
made
it
clear
under
these
type
of
circumstances,
you're
responsible,
we're
going
to
pin
the
responsibility
on
you.
So
with
that
being
said,
I
believe
that,
and
the
clerk
can
correct
me
on
this,
but
I
believe
the
pre-game
holds
three
licenses.

Is
that
correct,
madam
clerk?
So
at
this
point
in
time
we
feel
the
mayor
police,
chief,
colonel
lindquist,
in
conjunction
with
the
solicitors
department.
We
just
feel
that
to
allow
this
business
to
continue
to
operate
at
this
juncture
simply
poses
too
great
a
threat
to
the
people
of
cranston
and
particularly
to
the
people
in
that
area.

It
sounds
to
me,
like
they're,
being
terrorized,
so
this
is
really
a
pretty
egregious
situation
and
I
think
it's
one
that
really
calls
for
the
most
severe
sanction
and-
and
that
would
be
at
this
point,
revocation
if
the
department
of
business
regulation
wants
to
review
it,
which
I'm
sure
they're
going
to
at
some
point,
be
that
as
it
may,
let
them
do
it,
but
I
think
at
this
point
I
think
we
we
really
need
to
protect
the
people
of
cranston
at
this
point
and
and
keep
this
business
closed.

start
with
some
law
because
there's
a
lot
of
case
law
on
this
and
while
it's
a
unique
case
to
the
city
of
cranston,
it's
not
a
unique
case
in
the
state
of
rhode
island.
Unfortunately,
these
things
happen
far
more
than
they
should,
in
a
supreme
court
case,
cesaroni,
the
supreme
court
defined
disorderly
conduct
in
use
in
the
licensing
context
as
contemplating
conduct
within
a
premises
where
liquor
is
dispensed
under
a
license
that
causes
either
directly
or
indirectly
conditions
in
a
neighborhood
in
an
annoyance
of
or
disturbance
of
the
residents
thereof.

One
of
those
groups
is
shown
to
have
been
patrons
on
video.
We
don't
we've
not
seen
video
I've
not
seen
video.
That
shows
the
other
group
there,
where
customers
of
an
establishment
is
not
in
and
of
itself
enough
to
take
their
criminal
conduct
and
transfer
it
over
to
a
licensee
and
revoke
their
liquor
license.

But
I've
been
through
these
cases
before
I've
had
worse
situations
than
this
more
egregious
facts
than
this,
where
the
department
of
business
regulation
has
said.
This
is
a
criminal
case,
not
a
licensing
case,
and
that's
because
the
other
piece
of
this
puzzle
is
in
ajc
enterprises.
The
supreme
court
also
said
that,
while
it
is
true
that
a
licensee
is
responsible
for
the
conduct
of
its
patrons
outside
of
his
establishment,
there
must
be
a
causal
nexus
therein.

Now
I
had
to
prepare
a
case
here.
Having
received
police
reports
thanks
to
mr
verdecchia,
getting
them
to
me
just
two
hours
before
this
hearing,
that
police
report
contains
only
one
state
related
to
what
happened
or
didn't
happen
inside
it's
all
we
have
notice
of,
and
it
says
two
unnamed
witnesses
in
the
report.

Two
shooters
who
fired
shots
outside
were
both
patrons
and
inside.
During
the
time
that
that
altercation
took
place.
Neither
of
them
were
involved
in
that
altercation.
They
were
on
the
peripheral
level.
They
both
exited.
They
each
went
to
a
vehicle.
They
stood
around
in
the
parking
lot
for
five
or
six
minutes.

Quote
while
the
two
incidents
happen
close
together,
there
is
not
enough
evidence
to
make
a
finding
that
that
shooting
arose
from
the
disturbance
within
the
club.
Another
one
delicos

incident
where
there
was
a
party
bus
outside
people,
exited
van
gogh
on
their
way
to
the
party
bus.
There
was
a
stabbing
and
a
fight
quote.

There
was
no
evidence
of
any
disturbance
starting
inside
the
bar
and
spilling
outside,
where
it
culminated
in
a
fight,
because
there
was
no
disturbance
inside
no
inference
can
be
made
that
the
fighting
occurring
outside,
existed
or
somehow,
indirectly
related
to
something
that
happened
inside
I
can
go
on
and
on.
I
won't
I've
had
many
of
these
cases.
I
would
urge
you
all
to
look
at
the
vibe
case,
which
is
a
recent
one
21lq004,
because
attorney
videkia
makes
the
point
that
maybe
dbr
will
start
looking
at
these
cases.
They
do
look
at
them.

Often
they
disagree
with
municipalities
in
vibe,
they've
begun,
awarding
attorney
fees
because
of
making
decisions
that
are
in
clear
violation
of
the
case
law
that
they
and
the
supreme
court
have
been
handed
down.
So
I
urge
you
to
look
at
that
because
again,
very
similar
facts
very
similar
request,
and
now
the
taxpayers
in
that
case
are
going
to
pay
mr
petraka's
bill
for
winning
the
appeal.

this
is
serious
stuff
I
mean
I
understand
it.
These
people
all
should
go
to
jail.
They
all
committed
crimes,
they
put
people
in
danger,
but
that
wasn't
because
of

cranston
residents

taxpayers.
First
off.
I
want
to
thank
the
members
of
my
team
for
their
financial
expertise
as
we
develop
this
proposed
budget,
I'm
surrounded
by
a
tremendous,
knowledgeable
staff
of
experts
who
have
worked
extremely
hard
on
this
budget
over
the
last
two
months
that
I
present
to
you
tonight.

One
year
ago,
as
a
newly
inaugurated
mayor,
I
proposed
a
budget
that
met
the
needs
of
our
city
and
you
overwhelmingly
adopted
a
budget
that
allowed
us
to
deliver
essential
city
services
and
meet
the
constituent
needs
of
all
cranstonians
tonight.
I
again
present
a
comprehensive
and
prudent
financial
plan
for
our
city
that
is
worthy
of
your
support.

Once
again,
I
am
confident
that
we
are
moving
towards
a
renewed
and
prosperous
quality
of
life
that
has
always
made
cranston
so
special
as
I
travel
the
city,
I
feel
the
pulse
of
optimistic
resonance
and
while
we
had
many
difficult
choices
to
make
last
year,
we
were
able
to
provide
a
local
government
that
did
not
require
an
increase
in
local
taxes
in
the
face.
A
very
limited
increase
in
state
aid
and
the
need
to
successfully
implement
a
city-wide
tax
revaluation.

We
found
the
way
to
keep
the
cost
of
our
government
down
in
the
last
15
months.
I
have
been
very
pleased
with
us
success
on
many
fronts.
As
I
promised
we
made
sure
the
city
financial
posture
stayed
strong
rating
agencies
who
look
closely
at
our
fiscal
health
and
business
practices,
give
us
very
positive
grades.

We
want
all
to
enjoy
the
restaurants
that
make
this
a
special
venue
and
a
vibrant
community
setting
the
rebirth
of
the
gazebo
area
and
soon
to
be
built.
New
neighborhood
park
will
make
all
of
us
proud,
but,
as
we
have
focused
on
these
merchant
areas,
we
have
also
focused
on
the
safety
and
appearance
of
our
neighborhoods.

this
year
I
had
requests
from
numerous
departments
for
new
positions.
After
careful
review
and
in
light
of
the
overall
budget
status,
I
determined
that
a
limited
few
positions
are
warranted.
At
this
time,
I
will
expect
all
department
heads
to
continue
managing
constituent
needs
with
current
staff
levels.

While
our
residents
benefited
by
those
decisions,
we
must
now
acknowledge
that
the
increased
cost
of
our
governmental
obligations
continued
to
rise.
Over
that
same
period,
however,
prudent
the
spending
was,
we
cannot
expect
to
rely
on
the
same
limited
pool
of
local
dollars
for
increased
expenditures
that
continue
to
rise,
my
fellow
taxpayers
and
members
of
the
city
council.

The
budget
I
present
tonight,
if
adopted
by
you,
will
result
in
a
nominal
2.85
property
tax
increase.
No
other
increases
are
proposed
for
sewer
fees
or
any
other
fees
to
place
that
in
perspective,
we
looked
at
several
homes.
Around
cranston
three-bedroom
colonials
in
edgewood
will
see
an
increase
of
127
dollars
in
taxes
in
garden
city,
a
three-bedroom
ranch
will
increase
by
one
hundred
and
thirty
eight
dollars.

want
to
take
a
moment
to
publicly
recognize
and
thank
finance
director
bob
strom
for
his
13
years
of
working
for
the
city.

will
be

last
budget

sincerely
