Tonight's
agenda
has
both
an
open
session
item
as
well
as
a
closed
session
component
with
multiple
items
we'll
be
taking
on
the
open
session
item.
First,
the
subject
is
consider
adopting
a
resolution
authorizing
continued
remote
teleconference
meetings
of
the
legislative
bodies
of
the
city
of
cupertino
for
the
period
november
30th
2021
through
december
30th
2021.
Pursuant
to
the
brown
act
as
amended
by
ab361
madam
city
clerk,
do
you
have
a
do?

Mayor
yes,
just
quickly
under
new
law
ab
361,
also
government
code
54953,
which
is
noted
on
our
detailed
on
our
agendas,
the
city,
council
and
other
city
legislative
bodies
may
continue
meeting
exclusively
via
teleconference.
So
long
as
a
state,
emergency
declaration
remains
in
place
and
the
statutes
conditions
for
permitting
remote
meetings
are
met.
Council
must
find
that
state
or
local
officials
have
imposed
or
recommended
measures
to
support
social
distancing
or
that
the
state
of
emergency
continues
to
directly
impact
the
ability
of
the
members
to
meet
safely
in
person.

That
determination
must
be
reviewed.
Every
30
days
thereafter,
council
adopted
resolutions
affirming
these
findings
on
october
5th
and
november
2nd
to
allow
teleconference
meetings
to
continue.
The
county's
health
officer
continues
to
recommend
that
governmental
entities
limit
indoor
activities
to
protect
participants
who
are
not
fully
vaccinated
and
state
department
of
industrial
relations.
Emergency
temporary
standards
continue
to
require
or
recommend
social
distancing.

sure
if
the
questions
are
better
now

after

couple
questions

Do
we
have
a
current
expectation
ballpark
for
when
we
might
be
back
in
person?
So
that's
question
number
one
question
number
two,
you
know:
is
it
going
to
be
possible
to
have
a
dual
meeting
where
we
are
in
person
at
community
hall,
but
there
is
still
the
zoom
feature,
because
there
will
be
limited
seating
and
spaces
in
community
hall
and
so
that
you
know
it's
called
a
hybrid.

The
city
managers
group
hears
about
every
other
week
from
the
county
on
where
they
think
the
path
is
of
the
pandemic
and
I'll
tell
you
from
the
last
meeting.
I
don't
think
the
mask
mandate
will
be
lifted
anytime
before
february,
in
terms
of
being
legally
required
to
wear
a
mask
indoors
unless
you're
eating
drinking
or
have
a
health
exception
or
are
in
a
private
office.
So
the
mask
mandate,
I
believe,
is
going
to
be
continuing
for
a
while,
and
then
you
have
the
new
variant
coming
in
and
the
holidays.

I
know
there's
some
trepidation.
We
could
see
a
worsening
of
circumstance
come
the
new
year
rather
than
a
veteran
and
that's
what
we
have
to
watch
staff
could
move
to
a
hybrid
model
when
the
council
wants.
I
think
we'd
want
a
couple
weeks
to
do
some
thorough
testing
to
make
sure
it
works
or
a
dual
model.
As
the
council
member
called
it.

The
feedback
I
got
from
council
before
is
that
there
was
no
interest
in
wearing
masks
while
on
camera,
and
even
at
this
meeting
right
now
for
the
public
portion
was
in
community
hall,
you
would
all
have
to
be
wearing
masks
while
you're
on
camera.
If
you
were
all
together
in
community,
all
the
only
exception
is
to
remove
your
mask
while
you
take
a
sip
of
water
or
or
or
something
like
that,
I
heard
previously
from
council
that
there
wasn't
much
interest
in
wearing
masks
on
camera.

It's
obviously
up
to
the
council
to
decide
and
I
believe
the
mayor's
the
authority
has
been
delegated
to
the
mayor.
Regarding
that,
so
my
suggestion
would
be
wait
and
see
what
early
january
mid-january
is
like
and
decide
if
you
want
to
give
it
a
try
in
late
january,
with
mass
or
wait
and
see
if
mass
will
be
gone
in
february,
and
then
you
can
go
to
the
dual
model.
I'll

so
if
we
go
to
in-person
meetings
there,
there
is
a
requirement
to
provide
public
access
to
the
to
the
meeting
room.

so
personally,
of
course,
I
prefer
to
meet
virtually
where
it's
just
too
easy
to
walk
into
the
room
from
the
comfort
of
a
home
or
office.
However,
our
children
are
attending
schools
daily,
wearing
masks
for
hours
and
under
whatever
variant.
There
are-
and
I
do
miss
that
when
the
public
is
able
to
attend
the
meeting
in
person,
not
only
they
can
see
us,
but
also
they
can
see
each
other
communicate
with
each
other,
not
just
watching
a
meeting.
So
there
is
something
that
we
have
missed.

the
public
have
missed
to
be
able
to
connect
with
each
other
since
early
last
year,
and
so
I
would
like
to
know
what
other
cities
have,
because
I
do
know,
there
are
also
meetings
and
school
board
meetings
that
come
back
to
the
in
hybrid
mode,
where
the
the
board
or
city
council
are
in
person,
and
some
public
member
will
be
allowed
in
with
certain
conditions,
such
as
vaccinated
mandate,
and
there
is
capacity
limit.
So
I
would
like
to
know
what
other
cities
are
already
providing
hybrid.

virtual
after
a
certain
public

outburst

their
virtual
community
meeting.

and

attorney
can
correct
me
here.
I
don't
believe
that
I
think
it
ab361
allows
the
council
and
other
wages
legislative
bodies
such
as
city
commissions,
but
it's
not
a
requirement
to
have
one.

would

make
the
findings
in

way
that
they
would
apply
differently
to
subsidiary
boards
and
commissions
and

the
council.

kind
of
a
fine
line

walk

hand,
you're
saying
it's
safe
enough
for
the
council
to
meet
in
person,
but
not
safe
enough
to
for
for
other
bodies
to
meet
in
person.

theory
we
could
probably
do
that
based
on

social
distancing
requirements
in
santa
clara
county
or
not
requirements,
but
social
distancing
recommendations
in
santa
clara
county,

so
that
I
think
I

that
would
be
possible.

direction
that
council
wants
to
go.

losing
some

that
they

to
have,

council

public

need
of
every
neighbor

neighbor
needed

kind
of
fence
the

ramages

own

big
strip
of
this
needed
a
new
fence.

had
four

fences
in
