Description
Coverage of the April 25, 2023 Cupertino Planning Commission Meeting.
A
A
A
A
B
B
I
pledge
allegiance
to
the
flag
of
the
United
States
of
America
and
to
the
Republic
for
which
it
stands,
one
nation
indivisible
with
liberty
and
justice
for
all.
Thank
you
can
we
have
the
roll
call
please,
commissioner,.
B
Okay,
so
our
first
item
of
business-
oh
wait!
We
have
a
ceremonial
matter.
That
is
not
happen
that
often
so
it's
to
receive
an
email,
phishing
campaign,
presentation
from
the
city's
infrastructure
division.
Oh,
who
will
be
presenting.
D
A
D
D
Cyber
security
threat
landscape.
Everyone
here
has
heard
of
viruses,
malware
hacking,
spyware,
Cyber
attack,
password
crackings
fraud.
You
know
adware,
but
what
are
we?
What
are
we
worried
about
here
at
the
city?
We're
mainly
worried
about
ransomware,
malware
fishing
and
then
access
to
public
network?
What
is
ransomware
you
want
to
ask
ransomware
is
when
a
hacker
takes
over
your
network,
your
data
and
holds
it
for
ransom,
typically
asking
for
some
some
amount
of
money.
You
know
malware
can
be
anything
malicious.
That's
installed
on
your
computer
on
our
Network.
D
Fishing
fishing
is
just
a
type
of
attack
that
the
hackers
and
will
use
to
obtain
information
or
infect
our
networks
with
malware
or
ransomware,
and
then
public
network
public
networks
are
networks
that
you
may
join
at
a
local
coffee
shop.
You
know
why
free
Wi-Fi
at
a
library
in
a
park
at
the
airport,
Etc.
D
All
right,
so
here
is
a
graph
from
2020
2022
of
global
cyber
Tech
Trends.
As
you
can
see
over
the
years,
the
amount
of
and
billion
in
has
gone
from
six
percent,
all
the
way
to
167
percent
in
Cyber
attack
trends.
D
D
D
Okay,
so
here's
our
here's
where
the
city
stands
with
our
cyber
defense
on
the
back
end,
what
you
don't
see
is
we
have
firewalls
encryptions
anti-viruses
installed
on
all
of
our
city
devices,
and
then
we
have
data
security.
D
So
what
we
do
here
and
therefore
in
the
infrastructure
team,
is
we
provide
training
through
now
before
we
have
our
annual
security
training,
which
takes
typically
between
15
to
20
minutes.
We
have
ongoing
phishing
campaigns
where
phishing
emails
are
sent
out
and
you
can
mark
them
as
fishing
if
you
click
on
them,
we're
notified
that
you've
you've
either
failed
on
the
the
training
or
you
clicked
on
the
on
the
attachments
or
links
as
another
means
of
cyber
security
is
in
your
emails.
You'll
notice
that
there's
a
banner
at
the
top.
D
D
D
You
know,
fortunately
we
have
you
know.
Our
training
has
a
lot
of
stuff
to
ignore
attachment,
launch
macros
files,
reply
to
emails
that
can
be
phishing.
D
D
So
what's
your
mission,
your
mission
here
from
is
to
complete
the
trainings
understand.
What
official
attack
is,
what
malware,
what
ransomware
is,
if
you're
ever
unsure
of
an
email
or
an
attachment,
feel
free
to
reach
out
to
the
IT
department.
There
is
a
fish
alert
button
in
your
outlook
at
the
top
that
you
can
click
on.
If
you
click
on
that
fish
alert
button,
it'll
send
it
to
us
and
we
can
review
the
emails
and
let
you
know
whether
or
not
it
is
a
phishing
email
or
it's
a
valid
email.
B
Yeah
I
have
one
question:
I've
been
getting
emails
for
many
months
or
even
a
year
from
something
called
the
innovation
technology
team
asking
me
to
take
security
awareness
training,
but
it
has
cautioned.
This
email
originated
from
outside
the
organization.
Do
not
click
links
so
I
have
not
clicked
any
links.
I
didn't
know
if
it
was
a
phishing
email
or
if
this
is
really
the
security
awareness,
training.
D
So,
in
that
case,
I
wanted
the
real
one,
I
believe
I
may
have
sent
out
an
email,
because
the
notify
staff
I'll
double
check
to
make
sure
that
Commissioners
are
included
in
that
email.
Typically
because
we're
using
no
before
it's
an
outside
vendor
and
the
fishing
campaigns
come
from
no
before
they
will
include
that
Banner.
Okay,.
D
B
Yeah
I
was
worried.
I
thought
that
that
was
like
the
test
that
it
was
doing
so.
F
I
have
a
question
in
the
previous
one
of
the
charts
you
showed
quite
a
bit
of
you,
know
clickings,
and
you
know,
and
email
openings
I
mean
the
attachment
to
openings
by
our
staff.
So
did
that
kind
of
get
us
into
some
kind
of
a
trouble?
What
not
like
you
know,
I
want
to
see.
You
know
if
that
resulted
in
any
anything
disastrous
for
us.
D
C
B
B
B
Night
you
too.
Our
next
item
is
the
approval
of
minutes
from
the
March
25th
meeting.
If
everyone
could
take
a
look
at
the
draft
minutes
and
if
you
have
any
corrections.
B
Okay,
great
now
we
are
on
to
there's
no
postponements.
We
are
on
to
oral
Communications.
This
portion
of
the
meeting
is
reserved
for
persons
wishing
to
address
the
commission
on
any
matter
within
our
jurisdiction.
That's
not
on
the
agenda.
You
have
three
minutes,
and
state
law
in
most
cases
prohibits
the
commission
from
taking
making
any
decisions
with
respect
to
a
matter
not
on
the
agenda.
So
I
have
one
in-person
blue
card.
Welcome,
Jennifer,
Griffin,.
G
Good
evening,
Planning
Commission,
it's
good
to
see
you
all
here.
I
just
had
a
couple
of
comments.
Excuse
me.
Let
me
contain
the
hardware
here
we
attended.
Several
people
attended
the
scir
housing
element
meeting
last
Tuesday
night
I
believe
it
was
Tuesday
and
I
I'm
just
going
to
make
a
couple
of
comments.
I
think
the
staff
did
a
good
job
of
presenting
it.
G
There
weren't
a
lot
of
people
here,
I
think
there
were
only
three
people
in
the
audience,
but
there
has
been
a
tremendous
drop
off
in
planning
and
execution
of
the
housing
element
to
the
public
since
last
year,
last
year
was
gung-ho.
We
went
to
many
meetings,
the
public,
though
they
may
have
disagreed
with
a
lot
of
what
was
going
on,
had
very,
very
good
participation.
They
had
nothing
to
complain
about,
they
were
engaged,
they
were.
G
There
were
meetings,
meetings,
meetings,
meetings
this
year,
for
whatever
reason,
there's
been
nothing
just
silence
and
I'm
very,
very
concerned
that
we
are
in
an
extremely
critical
part
of
the
housing
element.
If
people
were
not
aware,
fifty
percent
of
the
cities
in
southern
California
have
still
not
gotten
a
valid
certification
by
hcd.
This
is
after
two
years
the
prospects
of
Cupertino
getting
an
actual
valid
certification
from
hcd
are
probably
only
10
percent.
We
need
to
have
engagement
with
the
public.
This
is
our
city.
We
need
to
know
what
is
going
on.
G
Hcd
should
not
be
a
full
an
adversary.
G
This
I
feel
like
this
housing
element
has
been
weaponized
against
Cupertino
and
the
cities
of
California
I'm
waiting
to
have
hcd
reverse
that,
but
more
and
more
as
I
go
along
with
the
two
years
of
this
housing
element.
The
sixth
cycle
I
feel
more
and
more
that
it
is
weaponized
and
it
is
trying
to
point
fingers
at
the
people
that
live
in
Cupertino
I.
Don't
think
I
have
done
anything
wrong.
I
have
lived
in
my
city,
I
abided
by
the
laws,
I
participate
in
Civic
organizations,
etc,
etc.
G
But
why
do
I
feel
after
two
years
that
I
should
be
ashamed
of
living
in
my
city,
that
my
city
is
not
worth
being
a
city?
I,
don't
I
have
said
before.
I
disagree
with
my
state
level.
Electeds
I
disagree
with
the
governor
I.
Don't
disagree
with
Mr
Biden,
but
I,
don't
I
feel
uncomfortable
with
the
road
we're
going
down.
Why
is
hcd
and
the
housing
element
pointing
fingers
at
the
public
in
this
city?
We
have
done
nothing.
Okay,.
B
Okay,
I
don't
see
any
hands
raised
in
the
zoom
audience,
so
we
will
move
on
to
the
next
item.
This
is
public
hearing,
consider
a
conditional
use
permit
for
the
concurrent
sale
of
alcoholic
beverages
and
gasoline
at
an
existing
Chevron
gasoline
station
application.
Number
u-2022006
applicant
Steve
Rawlings
on
behalf
of
Chevron
stations,
location,
11010,
North,
De,
Anza,
Boulevard,
APN
309-42041.
This
has
continued
from
February,
14th
and
I
believe
we
have
a
recusal.
B
Okay,
maybe
we
have
the
staff
report,
please:
okay,.
I
J
J
This
was
previously
brought
before
you
at
your
February
14th
meeting,
where
Commissioners
voted
to
continue
the
item
to
allow
staff
time
to
gather
additional
information.
The
requested
information
has
been
provided
in
tonight's
staff
report
and
will
be
covered
later
in
the
presentation
related
to
the
proximity
of
schools
to
the
project
site,
as
well
as
ABC
licenses
issued
to
other
gas
stations
in
Cupertino.
Just
as
a
refresher.
The
project
site
is
located
on
the
corner
of
Homestead
and
North
De
Anza
Boulevard.
J
It
is
on
the
northernmost
border
of
the
city
of
Cupertino
abutting
Sunnyvale,
and
it
is
within
the
planned
General
commercial
zoning
District.
The
applicant
Chevron
stations
is
requesting
a
conditional
use
permit
to
allow
for
the
concurrent
sale
of
gasoline
and
alcohol
that
is
inclusive
of
beer,
wine
and
distilled
spirits.
J
J
J
This
map
shows
the
off
sale
ABC
licenses
within
the
city
of
Cupertino,
the
red
dots
to
market
the
type
20
licenses,
those
are
for
beer
and
wine
sales
and
the
green
dots
demarcate.
The
type
21
licenses
which
are
for
all
alcohols,
including
distilled
Spirits.
The
project
property
is
demarcated
by
the
yellow
dot
at
the
top
of
that
map,
and
then
these
blue
circles
indicate
the
five
gas
stations
that
were
presented
on
the
previous
slide.
J
J
And
so
when
considering
a
conditional
use
permit
for
the
concurrent
sale
of
alcohol
and
gasoline,
it
must
be
found
that
the
new
use
will
not
be
detrimental
to
the
property
or
improvements
in
the
vicinity
of
the
project
or
to
the
public
health,
safety
and
Welfare.
Additionally,
it
must
be
found
that
the
conduct
of
the
proposed
use
will
be
consistent
with
the
city's
General
plan.
Zoning
regulations
and
compliant
with
sequa
stop,
has
made
these
findings
and
outlined
them
in
our
draft
resolution.
J
B
K
Hi
good
evening,
I'm
Steve
Rawlings
very
nice
to
meet
all
of
you
in
person
this
evening.
I
I
do
not
have
any
additional
information.
I
worked
really
closely
with
Emmy
on
on
most
of
this
information,
obviously
I'm
available
for
any
additional
questions
that
anybody
may
have
for
the
record.
We
do
concur
with
their
recommendation
and
agree
to
all
of
the
conditions
of
approval,
as
presented
this
evening.
B
G
Good
evening
again,
I
think
I
missed
the
Valentine's
Day
meeting,
but
I
do
remember
this
from
last
year.
I
think
this
had
come
in
and
there
was
a
discussion
about
the
different
types
of
licenses
for
alcohol,
which
I
found
fascinating.
I
really
didn't
know
much
about
it.
G
So,
in
terms
of
this
item
coming
back,
it
sounds
like
whatever
questions
you
you
all
had
from
the
14th
has
been
researched
and
my
I
I
know.
This
is
not
close
enough
to
Homestead
to
walk
there
very
quickly
because
you
can't
get
very
far
on
lunch
break
from
homestead.
You
can't
get
this
far.
I
know
that,
but
what
I
was
going
to
ask
about
is
in
terms
of
Cupertino
is
just
starting
to
get
license
plate
readers.
There
was
an
incident
I
think.
G
A
year
ago
there
was
a
hold
up
at
the
Prospect
and
the
South
De
Anza
Boulevard,
one
of
the
three
gas
stations
there
I
think
it
was
the
one
in
Saratoga
where
there
was
a
strong
armed
robbery
of
a
couple
at
the
gas
station
and
after
and
they
did
catch
the
perpetrators,
Los
Altos
Hills
caught
them
with
the
license
plate.
Readers
up
on
280
by
I
think
it
was
the
turn
off
to
Foothill
College,
so
I'm
wondering
at
this
point
in
terms
of
security
issues,
I'm,
not
just
picking
on
this
gas
station.
G
Since
this
gas
station
is
on
the
border
with
Sunnyvale,
will
we
have
license
plate
readers
in
this
area?
What
is
sunnyvale's
plan
for
license
plate
readers?
The
other
thing
is
I
just
wanted
to
know
in
terms
of
General
security
purposes,
whether
I
mean
having
observed
a
theft
at
the
CVS
in
Cupertino.
At
one
point,
the
clerks
have
always
been
told
to
not
engage
someone
that
is
trying
to
steal
something.
They
are
usually
allowed
to
walk
out
of
the
store,
at
least
in
CVS,
and
then
there's
an
alarm
or
the
clerk.
G
It
signals
the
police
Etc.
What?
G
How
does
this
work
with
a
mini
mart
you're
going
to
have
potential
I
just
believe
that
there
has
been
a
major
increase
in
in
crime
with
guns
everywhere
in
in
since
the
pandemic,
for
whatever
reasons
all
over
the
Bay
Area,
we
actually
were
coming
back
from
a
funeral
the
day
before
Easter
and
we
were
at,
we
were
on
I
think
it
was
682
hours
before
the
young
lady
was
shot
by
a
gun
in
Milpitas
and
killed,
and
I
can
tell
you
we
passed
through
that
area
because
we're
coming
back
from
Castro
Valley.
G
G
B
K
Certainly,
as
part
of
our
package,
we
kind
of
submitted
a
a
pretty
much
a
Securities
procedure
in
policies
outline
if
you
would
obviously
Chevron
is
one
of
the
largest
corporations.
They
operate
over
300
convenience
stores
in
California,
and
we
believe
that
throughout
the
years,
we've
kind
of
established
a
policies
and
procedures
that
have
been
effective
in
deterring
many
things
loitering,
as
well
as
as
theft.
Those
are
our
primary
concerns.
Our
stores
are
designed
a
little
different
than
some
of
those
larger
stores
are.
K
We
always
go
through
procedures
to
document.
You
know
who
who
the
people
were.
We
obviously
have
video
surveillance
cameras,
but
we
have
found
that
we,
we
have
not
had
an
overwhelming
problem
in
most
of
the
Chevron
stores.
We
do
have
two
employees
on-site,
which
does
make
a
difference,
because
some
stores
that
are
managed
by
only
one
person
they
can
easily
be
distracted
and
somebody
else
could
be
doing
something
there.
K
So
I
I
believe
that
our
security,
you
know,
policies
and
procedures
are-
are
have
been
established
through.
You
know
trial
and
error
and
they
continue
to
improve
and-
and
we
haven't
had
any
problems
at
this
store
that
has
been
selling
previously
and
I,
wouldn't
anticipate
that
we
would
have
any
additional
problems.
B
Okay,
thank
you
well
yeah.
Why
don't
you
stay
up
here.
B
Any
of
the
attendees
on
Zoom
with
a
hand
raised
for
Pub
for
comment
on
this,
so
I
will
start
so
this
station
has
been
selling
beer
and
wine
without
a
city
use
permit
for
the
last
28
years.
So
can
you
explain
why
that
is.
K
I,
it
was
news
to
me
too
I.
I,
honestly,
don't
have
an
explanation.
Abc
issued
a
license
in
1995
I,
don't
believe
that
any
of
the
Chevron
people
that
I
work
with
were
certainly
not
involved
in
this
type
of
operation.
For
the
company
we
did
do
a
records
request
from
ABC.
They
came
back
with
no
documentation
which
is
not
out
of
the
ordinary
ABC,
archived
their
archives
kind
of
end
in
about
that
time,
frame,
94
or
95.
So
I
I
have
no
explanation
as
to
what
went
on
28
years
ago.
K
You
know
saying:
hey:
is
there
a
use
permit
required?
Is
there
a
use
permit
in
place
and
so
on
and
so
forth?
What
happened
here?
I
I
have
no
idea.
Okay,.
B
B
But
okay,
that's
fine
and
you
know
it's
a
misunderstanding,
but
what
really
concerned
me
is
when
I
went
over
to
that
station
a
couple
of
weeks
ago
and
there
they
were
already
selling
hard
liquor
and
I'll
share.
My
screen
here.
If
I
can,
let's
see
is
that
shared
there
I
can't
okay
share
here
we
go
so
here's
a
picture
I
took.
Is
it
up
on
the
screen
or.
B
So
they
were
selling
white
claw,
which
is
a
spirit
about
two
weeks
ago
and
then
I
went
back
a
few
days
ago
and
here's
all
the
cardboard
covering
the
beer
and
wine
cooler,
apparently
because
it
was
discovered
there
was
no
use
permit,
which
is
fine,
but
I.
Just
I'm
a
little
upset
that
the
station
was
selling
Spirits,
even
though
you
only
have
a
type
20
license
from
ABC.
B
Okay
and.
B
K
Bit,
there's
there's
two
so
when
you
make
an
order,
I'm
a
retailer
and
I
get
a
type
20
license.
We
have
to
purchase
through
a
licensed
distributor,
okay,
Southern,
Wine
and
Spirits
is
one
of
the
big
ones
and
there's
a
few
others
out
there,
Southern,
Wine
and
Spirits
or
or
whoever
the
distributor
is
or
directly
from
one
of
the
alcohol
producing
companies.
K
They
are
not
allowed
to
sell
you
something
that
is
not
within
your
license.
So
there
is
a
a
second
check
to
this:
they
they
are
not
able
to
hand
off
a
distilled
Spirit.
If
you
only
have
a
type
20,
because
they
have
responsibility
in
the
action
as
well
as
well
as
Chevron
does
and
I
believe
that
white
Claw
is
covered
under
a
type
20
license.
B
Okay,
at
the
previous
meeting,
where
we
discussed
this,
it
was
a
big
thing.
You
said
you're
losing
business
because
you
can't
sell
beverages
like
white
claw,
so.
K
Thought
that
what
we
talked
about
were
things
like
Mike's,
Hard,
Lemonade
or
some
of
these
pre-made,
you
know
cocktails
cut
water
is
a
is
a
big
distributor
in
those
as
well
and
I
mean
we
could
probably
look
it
up
really
quickly.
B
No,
that's
okay,
yeah!
That
I
think!
That's
all
I
have
right
here
now
let
some
of
the
other
Commissioners
go.
If
anyone
wishes
to
speak
Mooney,
okay,.
F
Okay,
so
I
I
visited
the
site.
You
know
last
week
and
I
saw
that
what
a
you
know
picture
that
he
showed
I
also
visited
the
residential
apartment,
complex
right
behind
it,
with
the
assumption
that
you
know
those
are
the
people
that
would
have
been
notified
about.
You
know
this
license
issue.
So
I
have
a
question
to
the
staff.
Like
you
know.
F
Do
we
know
who
are
all
the
people
that
we
notified
is
that
you
know
the
residential
Community
right
behind
the
you
know
this
gas
station
or
no
is
it.
You
know
the
across
the
street
I'm
just
curious.
You
know
to
know
who
who
are
notified.
F
300
feet:
okay,
yeah,
so
so
they
should
be
within
300
feet
because
they're
right
right
behind
and
so
did
that
communication
go
to
the
residents
living
in
those
apartments
or
the
property
owner.
F
Property
owner,
okay,
so
none
of
the
residents
seem
to
be
aware
of
you
know
this
license
issue
right,
so
they
were
concerned
and
I
did
tell
them
like.
No.
If
you
have
concerns
you
know,
here
is
the
details.
You
know
you
can
come
and
speak
at
this
meeting,
but
none
of
them
seem
to
have
received.
You
know
any
notification.
The
tenants,
not
the
landlord
I,
did
try
to
contact
the
landlord
the
leasing
office,
but
you
know
it
went
to
voicemail
and
left
a
voicemail.
F
So
so
so
that's
you
know
my
extent
of
you
know
learning
and
talking
to
Residents
and
around
that
and
if
nobody
showed
up-
and
you
know
to
express
their
concerns,
you
know
it
is
I-
guess
you
know
they're,
okay
right,
so
so
so
my
understanding
right,
the
pro
so
the
process
right
so
right
now
Chevron
has
been
selling.
F
You
know
type
20
like
alcohol
right
so
that
are
like
you
know
beer,
and
you
know-
and
you
know
wine
for
the
last
20
years
with
the
ABC
permit,
but
not
the
city
permit
right.
So
anybody
to
sell
you
know
you
need
a
ABC
permit
and
as
well
as
you
know,
the
city
permit,
so
they
had
the
ABC
permit,
but
not
the
city
permit.
So
we
learned
about
it.
We
notified
them,
they
seem
to
have
stopped
it,
and
so
now
the
type
21
license
that
they
are
asking
for
it
covers.
F
You
know
both.
You
know
the
distilled
liquid
as
distilled
liquids
as
well.
As
you
know,
the
the
other
type
20
liquids
is
that
correct.
Yes,.
F
F
F
Okay,
because
the
reason
I'm
asking
is
and
I
went
through
this
process
myself,
so
I
did
send
my
the
conditions
that
they
attached
to
the
ABC
license.
Personally,
not
as
a
commissioner.
Personally,
you
know,
I
was
able
to
attach
some.
You
know,
criteria
for
the
ABC
license,
I
shared
it
with
you
know,
City
attorney
and
as
well
as
another
mayor
that
got
discussed
in
the
last
meeting.
So
so
it's
up
to
the
residents
and
if
they
want
to
attach
you
know
any
conditions
to
the
ABC
license
so
for
the
City
license.
E
E
C
J
C
J
B
Okay
and
I
believe
no
other
gas
station
mini
Marts
have
a
type
21
license.
Is
that
true?
That
is
correct?
Okay
right,
so
there
was
one
other
issue.
I
noticed.
Let
me
see
if
I
can
share.
Oh
sorry,
go
ahead,
I.
C
Also
looked
at
I
mean
I
saw
the
ABC
documentation
on
what
is
covered
on
a
type
20
or
type
21,
but
it's
just
hoping
for
clarification.
Type
21
would
also
allow
hard
liquor
as
far
as
like
full
bottles
of
vodka
or
Rum
Brandy
Etc
right,
yes,
correct,
okay
does
the
so
I
guess.
If
I
can
ask
a
question
to
the
applicant,
are
you
and
is
the
intention
to
sell
ulcers,
because
I
think
you
you
were?
You
were
mentioning
like
Mike's
Hard
Lemonade,
which
is
vodka
mixed
with
you
know,
whatever
sparkling
water.
K
In
our
other
stores,
we
do
offer
bottles,
they
are
stored
behind
the
cashier
they're,
usually
in
a
four
foot
like
two
foot
and
many
times
smaller
type
of
case
that's
behind
there.
But
as
I
had
mentioned
everybody
else.
One
of
the
big
drivers
of
this
is
are
those
kind
of
Premium
egg
cocktails
which
are
out
in
the
in
the
coolers
there.
But
that's
that's
a
big
driver
for
the
entire
industry,
most
other
C
stores
are
are
many.
Many
sea
stores
are
asking
for
that.
K
Chevron
has
added
type
21
licenses
to
I've
done
them
all
so,
like
20
20
of
their
stores
and-
and
we
continue
to
do
it
and
I-
see
other
c-store
operators
doing
doing
the
same
thing
and
it's
to
kind
of
Meet.
The
customer
demand
for
the
that
type
of
product.
B
Hey
is
that
it
okay,
so
my
other
question
and
I
will
share
my
screen
again.
If
I
can.
Okay,
so
I
did
take
a
picture
of
the
application
to
sell
alcoholic
beverages.
So
I
was
a
little
concerned.
B
This
is
actually
a
change
in
license
right
because
you
have
a
type
20
licensing,
you're
looking
for
type
21,
so
that
is
not
indicated
on
your
sign.
That's
in
the
window
at
the
bottom,
where
it
says
premises
are
not
now
or
already
licensed.
That
is
not
indicated,
so
those
were
two
things
also
technically,
if
you
look
at
the
tax
assessor
APN,
that's
not
the
right
address,
but
it's
close
enough.
B
It's
actually
in
the
assessor's
office,
it's
Sunnyvale,
Saratoga,
Road
I,
think
it
changes
right
after
Homestead,
but
I'm
a
little
concerned
that
somebody
coming
to
look
at
the
sign
you
know
might
not
and
not
seeing
any
alcohol
in
the
store.
Right
now
might
say.
Oh
this,
you
know
this
is
a
new
license,
not
a
change
in
license.
So
can
you
explain
why
the
public
notice
is
not
filled
out
completely.
K
Company
that
that
I
work
with
does
does
the
noticing
and
those
notices
are
photographed
and
they
are
sent
to
ABC,
and
this
one
note
of
notice
was
originally
done
in
March
of
2021.
So
it's
I'm
a
little
surprised
that
it's
been
up
for
two
full
years
because
statutorily
there
it's
up
for
30.
B
B
K
B
Yeah
to
me
this
is
was
a
change
in
licensed
privileges
because
you
have
a
type
20
you're,
applying
for
a
type
21.,
so
yeah
I'm
kind
of
disappointed
that
this
public
notice
is
not
accurate
and
then
yeah
as
I
see
the
date
down
there.
It's
been
up
for
more
than
two
years
now:
okay
and
I.
Guess
that
is
all
I
have?
B
Oh,
is
there
any
more
discussion
before
we
have
a
motion?
I
have
one
question
for
the
City
attorney.
You
know,
they're
asking
for
a
type
21
use.
Permit
I
mean
every
other
gas
station
has
a
type
20..
L
The
CMC
provides
for
a
conditional
use
permit
for
sale
of
alcoholic
beverages,
including
beer
and
wine,
in
this
case
there
there's
seeking
to
sell
distilled
Spirits
as
well,
and
at
this
point
we
have
substantial
evidence
presented
to
to
support
issuance
of
that
as
mandated
by
that
code,
and
so
you
know,
I
I,
don't
know,
there's
any
evidence
to
suggest
any
requirement
to
limit
it.
So.
B
Okay
I
mean
we.
We
did
have
one
written
communication
that
you
know
cited
evidence
of
increase
in
crime
based
on
the
sale
of
you
know,
sale
of
spirits,
I.
L
E
So
yes,
I,
move
that
the
Planning
Commission
adopt
the
proposed
draft
resolution
as
denoted
in
attachment
one
to
number
one
find
the
project
exempt
from
SQL
and
two
to
approve
the
conditional
use
permit
u-22
2022-006.
E
E
B
Okay,
I
guess
we
can
have
a
vote,
but
with
your
lights,
I
keep.
B
Oh,
that's
true,
yeah
you're,
absolutely
correct!
Is
there
any
further
discussion
before
we
vote.
E
H
B
F
Okay,
so
yeah,
so
there
are
quite
a
few
residents.
You
know
that
reached
out
to
me,
especially
on
the
Bollinger
in
that
area
side
concerned
about
you,
know
the
development,
that's
the
upcoming
rezoning,
as
part
of
you
know
the
housing
element,
and
so
I've
been
talking
to
them
and
trying
to
explain
the
process
to
them
and
encouraging
them.
You
know
to
participate
in
the
process
right
so
early
in
the
process
right.
So
so
that's
the
only
city
business
that
might
dealt
with
with
the
residents.
H
B
My
turn
so
at
the
end
of
March
I,
attended
the
planning
commissioner
Academy
down
in
Garden
Grove
California
excellent,
excellent,
three-day
event.
B
I
attended
the
sessions
on
SQL,
which
are
very
interesting
and
complicated,
and
on
the
last
day
there
were
two
great
sessions.
Jason
Ryan
of
the
league
of
California
cities
spoke
about
various
bills
coming
before
the
legislature
and
what
the
position
of
League
of
California
cities
is
on
those
most
notably,
was
sb423,
which
is
coming
up.
B
That
will
be
an
extension
and
modification
of
SB
35,
so
the
league
is
opposed,
and
one
of
the
reasons
is
that
bill
would
override
every
City's
inclusionary
housing
requirements,
including
ours,
which
are
now
15
for
rental
and
20
for
for
sale.
So
the
league,
usually
they
take
up
like
an
opposed
unless
amended,
but
in
this
one
they
were
strongly
opposed.
They
took
just
an
opposed
position
on
that.
I
was
also
oh
and
following
Jason
we
had
Dan
Walters,
who
is
a
columnist
for
Cal
matters,
and
he
spoke
I.
B
Don't
think
my
fellow
Commissioners
were
there
for
that
they
had
to
leave.
It
was
a
very
good
explanation
of
how
we
got
into
our
affordable
housing
situation,
starting
with
prop
13.
B
and
then
prop
98,
which
was
the
mandatory
Educational
Funding,
and
then
the
state
having
to
backfill
that
prop
98
money,
because
Redevelopment
took
money
away
from
the
state
and
then
finally
Jerry
Brown
any
Redevelopment
agencies,
which
kind
of
starved
the
funding
stream
for
affordable
housing,
which
is
why
we
are
in
the
situation.
We
are
now
where
there's
very
little
affordable,
housing
being
built,
there's
just
there's
no
money
for
it,
and
he
mentioned
the
current
fiscal
crisis
in
the
state
that
that
money
will
not
be
forthcoming
from
State
coffers.
B
So
that
was
my
experience
there
a
week
and
a
half
or
two
weeks
ago,
I
went
to
Sacramento
on
my
own,
not
as
part
of
the
Planning
Commission
and
again
that
we
were
lobbying
various
legislators
urging
them
to
provide
money
for
affordable
housing
and
that
that
was
interesting.
I
think
there
were
about
30
of
us
there
and
we
split
up
and
talked
to,
and
a
lot
of
legislators
really
do
want
to
provide
that
money.
B
This
question
is:
where
is
it
going
to
come
from,
given
the
state
state
budget
crisis
right
now,
and
that
was
it
I
don't
know
if
you
guys
want
to
talk
about
Planning,
Commission,
Academy
Seema
and
to
Josh?
If
you
want
to
say
anything
about
your
experience
there,
and
that
was
it
now
we're
on
to
Future
agenda
setting.
Does
anyone
have
any
things
they
would
like
to
see
on
a
future
Planning
Commission
agenda.
B
Oh
okay,
seeing
nothing
else.
We
will
adjourn.
