Description
Coverage of the September 6, 2023 Cupertino City Council Meeting.
(Live Streamed Version)
A
A
B
D
B
Mayor
way
here,
there
is
no
close
session,
so
we
are
going
to
a
very
brief
ceremonial
item.
The
city
of
Cupertino
is
pleased
to
present
a
proclamation
in
honor
of
Suicide
Prevention
Awareness
Month.
This
is
the
time
to
raise
awareness,
to
help
shift
public
reception
and
reduce
stigma
around
mental
health.
According
to
the
U.S
surging
General
Dr
Vivek
Murphy
mental
health
has
become
the
defining
public,
health
and
societal
challenge
of
our
time.
We
continue
to
see
a
rise
in
race
of
suicide
here
in
the
United
States
and
on
behalf
of
the
city
of
Cupertino.
B
We
are
grateful
for
your
efficacy
and
the
work
you
do
every
day
to
improve
and
save
precious
lives
of
so
many
people
struggling
with
mental
health
challenges.
We
must
normalize
supporting
mental
health,
just
as
we
do
physical
health
and
we
call
all
leaders
to
speak
about
this
evenly
openly
and
honestly.
We
all
have
a
responsibility
to
our
community.
Thank
you
again
for
all
the
work
you
do
now
we're
moving
to
oh
yep.
We
can
clap.
Thank
you.
B
E
B
C
Do
you
wish
to
make
an
adjustment
to.
C
F
Welcome
back
everybody,
it's
good
to
see
you
all
now
that
we're
starting
up
September
in
the
fall
I
just
wanted
to
bring
up
a
couple
of
items
that
had
I
had
gone
through,
which
I
just
wanted
to
share.
One
of
them
is
sp423,
which
you
all
did
discuss,
which
I'm
glad
it.
Actually
we
thought
that
it
was
going
to
the
assembly
floor
this
morning,
but
it
was
not
voted
on
I
believe
it
will
be
taken
up
later.
This
bill
has
been
amended
severely.
F
F
This
could
be
anywhere
on
the
California
coast.
I
have
now
two
sets
of
household
members
that
live
in
the
coastal
Conservancy
area
in
Aptos
in
Santa
Cruz.
This
bill
terrifies
me
I
think
that
they
need
to
make
sure
if
they're
going
to
talk
about
deactivating,
the
coastal
commission,
they
should
put
it
in
a
separate
bill.
My
parents
worked
very
hard
in
the
1970s
to
a
stop
help
establish
the
coastal
Conservancy.
It
was
a
Statewide
vote.
I
wasn't
old
enough
to
vote
on
it,
but
I
know
that
they
voted
for
it.
F
I,
don't
appreciate
having
my
parents,
time
and
effort
and
money
go
to
waste
by
having
someone
try
to
take
down
a
Statewide
initiative
that
was
put
in
in
1976
by
the
people
of
California.
Therefore,
SB
423
is
a
hazard
and
a
nuisance
to
the
state
of
California
I
hope
that
it
does
not
get
out
of
the
assembly.
The
best
place
for
this
bill
is
on
the
suspend
also
I
have
attended
two
Fremont
Unified
High
School
district
meetings
about
the
trustee,
I
guess
they're,
trying
to
establish
some
sort
of
a
trustee
voting
area.
C
G
Thank
you.
Does
this
thing
work.
G
I've
lived
in
my
home
in
Cupertino
for
61
years
and
I
have
watched
the
population
of
wires
on
the
telephone
pole
in
my
backyard,
grow
and
grow
and
grow
and
I
think
they've
grown
beyond
the
capacity
of
the
of
the
pole
to
hold
them.
I
think
that
the
transmission
systems
in
Cupertino
for
the
areas
where
there
are
not
buried
transmission
lines
represent
a
hazard
and
Lahaina,
is
one
example
of
that
kind
of
Hazard.
G
I
also
see
that
ATT
is
bearing
their
wires
in
the
in
the
force
and
I'm
recommending
that
Cupertino
initiate
a
study
to
determine
the
feasibility
of
burying
the
wires
within
Cupertino.
G
My
situation
is:
I
live
in
the
Fair
Grove
neighborhood.
We
have
a
wooden
transmission,
Pole
or
a
pole
that
was
installed
over
70
years
ago.
The
pole
is
at
the
corner
of
my
property
and
holds
up
the
high
voltage
transmission
lines,
a
Transformer
to
convert
the
voltage
to
200.
G
Oh,
yes,
I'm,
sorry,
a
t,
a
t
telephone
wires,
the
plain
old
telephone,
atnt
internet
distribution,
cables,
a
TNT,
fiber
optic
cables,
a
t,
fiber
optic,
breakout
boxes
and
XFinity
distribution,
cables
and
breakout
boxes.
G
I've
experienced
power
outage
of
more
than
20
hours
each
year,
due
to
foliage
interference
with
the
lines
and
I
think
it's
dangerous
because
it
could
cause
a
fire
or
electrocute
when
the
lines
go
down.
The
poll
with
all
the
associated
wires
and
boxes
looks
terrible.
I
was
an
engineering
manager
for
many
years
and
if
a
technician
working
for
me
had
dressed
the
wires
in
the
way
in
which
they're
dressed
on
my
pole,
he
wouldn't
have
lasted
more
than
a
Cupertino
hour,
so
he
would
have
been
fired
and
I.
G
Think
that's
the
case
with
all
the
wires
in
Cupertino.
Cupertino
does
not
regulate
the
users
of
the
polls
to
the
best
of
my
knowledge,
and
there
is
no
rule
governing
the
quality
of
the
work
they
do.
The
work
they
do
is
terrible.
It's
only
put
up
there
to
work,
it's
not
put
up
there
to
be
safe
and
to
survive
so
I'm
also
recommending
that
Cupertino
has.
G
C
Also
recommending
the
super
you're
muted,
sir,
that
is
your
time.
You've
been
muted.
Please
observe
the
set
speaker
times.
Thank
you.
Next,
we
have
I
actually
skipped
over
Brooke
as
it
followed
by
Jacob
sterling
silver
Brooke
as
it
followed
by
Jacob
sterling
silver,
followed
by
Alex
Wyckoff,
welcome,
Brooke.
H
Thank
you,
Kirsten
I
would
like
the
city
council
to
reconsider
its
tactics,
or
at
least
the
majority
of
the
city
council,
to
reconsider
its
tactics.
If
I
wasn't
aware
that
Lewis,
Carroll
and
George
Orwell
were
deceased,
I
would
think
that
they
were
your
public
policy
advisors
because
there's
an
absolute
disconnect
between
you
rhetoric
and
your
actions.
You
talk
about
transparency
and
yet
at
every
turn
you
try
to
silence
the
public
and
put
impediments
in
place
to
keep
people
from
accessing
information.
H
You
talk
about
Kumbaya
and,
let's
all
get
along,
and
yet
the
May
9th
meeting
was
a
perfect
example
of
what
you
shouldn't
be
doing.
I
realized
that
public
service
is
difficult,
but
you
need
to
have
a
thick
skin.
If
you
want
to
be
venerated
and
if
you
don't
want
to
be
questioned,
you
need
to
go
off
and
start
a
religious
cult,
because
then
you
can
boot
people
up
when
they
disagree
with
you.
I
Hi
everyone,
my
name,
is
Jacob
sterling
silver
I
have
a
Goodwill
thing
to
try
to
bring
up.
It's
actually
I
didn't
know
it
was
Suicide
Prevention
month,
but
I
work
with
the
non-profit
with
a
couple
of
combat
vets,
and
we
try
to
deal
with
just
that.
The
veteran
suicide
isolation
is
a
bad
thing,
the
numbers
you
know
they
they
fluctuate.
They
say
it's
17
to
22
a
day.
Actually,
some
new
studies
have
started
to
show
that
they're,
not
counting
drug
overdose
or
alcohol-related
deaths,
which
is
kind
of
sad.
I
If
a
guy
overdoses
with
a
suicide
note,
then
that's
considered
a
suicide.
If
there's
no
note,
that's
considered
an
accidental
death,
so
that
number
could
be
as
close
to
double
from
some
of
the
research
I've
done.
I,
don't
know
how
accurate
it
is.
So
what
we've
been
doing
is
just
trying
to
get
in
between
the
isolation
and
the
veteran
I
had
a
I
had
a
friend
that
was
kind
of
going
through
it.
I
He
was
a
little
bit
depressed,
I
said
get
in
the
truck
we're
going
skydiving
and
he
wasn't
depressed
when
he
hit
the
ground,
so
we're
trying
something
different.
Trying
to
change
tactics,
are
they
sending
them
towards
therapy
all
the
time
it
starts
to
burn
them
out,
I,
call
it
Dr,
burnout
and
I
believe
they
get
bored
through
some
of
the
treatment,
especially
the
combat
vets.
So
if
we
try
to
do
anything,
we
can
to
get
them
out
of
the
house
and
we've
also
been
engaged
with
some
other
County
activities.
I
We
were
at
the
veterans,
Stand
Down
handing
out
300
pounds
of
free
ribs.
It
was
a
good
time,
but
some
of
the
Vets
just
can't
deal
with
big
events,
so
we're
trying
to
give
them
very,
very
intense
peer
support.
You
know:
go
out
to
the
range
I
took
a
marine
out
to
the
range
that
I've
been
there
in
five
years
and
he's
talking
about
two
deployments
in
his
head,
always
having
a
bunch
of
chatter
in
his
mind,
but
when
he
went
out
there
and
shot
some
clay
targets,
he
had
a
great
time.
I
He
said
all
that
shut
down
so
trying
to
get
them
to
do
something
that
excites
them
and
have
some
fun.
Hopefully
we
can
get
them
living
life
again.
A
lot
of
those
guys
were
heavy
heavy
adrenaline
lifestyle
and
we
take
them
back
and
throw
them
into
the
VA
system,
and
all
they
have
is
therapists
and
doctors
that
are
digging
up
old
memories.
I
They've
been
trying
to
drink
away
for
years,
it's
a
little
rough
for
them,
so
I
volunteered
down
that
VA,
for
it
was
about
six
seven
years
and
I
dealt
with
guys
dealing
with
addiction
issues
and
try
to
help
them
through
that
path
and
they're
just
bored.
We
got
to
do
something
different.
We
got
to
change
tactics
so
we're
going
around
asking
for
help
from
all
the
cities.
I'll
go
to
San
Francisco
down
to
as
far
south.
I
As
my
truck
will
take
me
to
every
city
council
and
see
if
we
can
find
some
support,
you
guys
have
my
information
we're
trying
to
get
into
local
papers
just
to
let
everybody
know
we're
here
and
if
there's
anybody
that
wants
to
help
out
with
the
actual
board
of
directors,
I'm
willing
to
talk
to
people
I'm.
Just
a
union
iron
worker
I
put
these
buildings
up,
I'm,
not
a
businessman
I
just
know
we
got
to
do
something
else,
because
it's
just
there's
too
many
of
them
behind,
and
it
doesn't
just
affect
that
individual.
J
You
Kristen
good
evening
Madam
mayor
and
city
council.
My
name
is
Alex
Wyckoff
and
I'm.
An
environmental
program
specialist
in
the
public
works
department
and
I've
worked
for
the
city
for
29
years.
I
am
also
the
cea
Local
21
Vice
chair,
fair
and
reasonable
wages
is
why
our
cea
and
OE
three
brothers
and
sisters
are
here
before
you
tonight.
J
A
revolving
door
of
Staff
causes
significant
uncertainty
when
building
an
organization's
succession
plan
a
failed
succession
plan
with
staff
who
are
not
fully
committed
to
the
city's
Mission
and
one
another
is
detrimental
to
being
able
to
deliver
the
service.
This
community
expects
institutional
knowledge
is
lost
and
very
difficult
to
develop.
One-Time
payouts
do
not
retain
staff
if
the
base
wage
cannot
compete
with
similar
positions
in
other
cities.
That
one-time
payout
money
is
not
reinvested
back
into
the
community
as
staff
receive
it
and
leave
for
higher
paying
wages
elsewhere.
J
J
We
ask
you
think
about
the
many
successful
Community
festivals
and
programs
offered
each
year
to
give
your
attention
to
the
well-manicured,
roadway,
medians
and
all
of
our
Parkland
to
remember
in
a
winner
of
Epic
weather,
where
we
had
little
to
no
roadway
flooding
and
minimal
tree
loss
to
the
significant
and
ever
increasing
number
of
building
and
development
projects
reviewed
and
inspected
and
to
making
sure
we
pay
our
bills
on
time.
There
is
so
much
more.
J
B
So
I
would
politely
ask
to
refrain
from
clapping.
Thank
you.
C
K
K
K
We
all
know
that
there
was
a
mistake
that
was
made
that
had
nothing
to
do
with
the
workers,
as
the
city
of
Cupertino
staff
we
all
are
asking
for.
All
we
are
asking
for
is
the
cost
of
living
raise.
This
was
earned
over
the
past
year.
The
cost
already
is
gone
if
they,
if
they
do
not
receive
the
cost
of
living.
A
raise
they
actually
are
resulting
in
a
pay
cut
coming
from
a
business
owner.
K
K
They
have
already
earned
their
cost
of
living
raise
and
it
is
important
that
they
receive
it.
They
will
continue
to
do
the
good
work
that
they
do.
They
will
continue
to
be
more
loyal
and
they
will
also
offer
solutions
that
will
create
more
income
to
the
city
if
they
do
not
receive
their
cost
of
living,
increase
and
feel
undervalued
and
hit
hard
financially,
they
will
either
leave
or
continue
to.
L
You
thank
you
for
having
me,
ladies
and
gentlemen
of
the
Deus,
thank
you
for
your
presence,
greatly
appreciate
that
my
name
is
Michael
Moore
I'm,
the
business
representative
for
operating
engineers,
local
number,
three
I
have
to
say
this.
Everybody
can
be
great
because
everybody
can
serve
the
men
and
women
behind
me
serve
this
city
with
a
lot
of
reverancy
and
Zeal
to
ensure
that
the
residents
have
everything
that
they
need
to
make
this
city,
productive,
fun
and
great
to
live
in
and
for
that
I'm
actually
grateful.
L
There
was
a
quote
by
this
great
gentleman
who
was
assassinated
many
many
years
ago,
and
his
quote
was
life's
most
persistent
and
Urgent.
Question
is
what
are
you
doing
for
others?
So
I
posed
that
to
this
Deus?
What
are
you
doing
for
others
and
those
others
are
the
men
and
women
that
are
standing
behind
me.
We
would
love
it
if
you
would
take
us
into
consideration
in
everything
that
you
do
keep
us
in
mind
for
the
things
that
we
do
for
you
and
the
residents
of
this
city
with
that
I
bid
you
Ado.
Thank
you.
C
M
So
my
name
is
Roberto
I
work
in
the
operators.
Engineer,
Union
and
I
just
wanted
to
come
up
to
you
guys
and
speak
more
on
how
the
lack
of
wages
that
we're
receiving
in
this
next
contract
affects
us.
I
know
they
already
spoke
to
it
a
little
bit
about
how,
without
a
decent
wages.
Here
we
will
be
taking
pay
cuts
and
how
that
would
affect
me
personally.
I'm
part
of
the
I
live
in
the
city's
BMR
program.
M
That's
the
below
Market
housing
program
and
I'm
lucky
enough
to
be
in
that
program,
but
even
even
programs
like
that
raise
your
rent
by
at
least
8.5
to
9
a
year.
So
luckily,
but
we've
we've
been
getting
from
the
union
over
the
years
has
been
able
to
cover
that
when,
in
a
year
like
this,
when
they're,
only
offering
1.7
or
whatever
it
is
I,
don't
even
I,
don't
I
don't
have
enough
to
even
cover
my
my
next
rent
increase
along
with
all
the
other
stuff.
That's
coming
along
in
in
January
with
Kaiser
going
up.
M
It's
going
up,
11,
11.7
percent
for
me
and
my
family,
which
you
know
is
in
my
current
situation,
is
mandated
by
Santa
Clara
County
that
I
have
to
have
you
know
Kaiser
or
whatever
it
is
a
health
type
of
health
insurance.
So
I'm
just
posting
it
out
there
to
you
guys
that
if,
with
all
these
increases,
I
don't
know
how
you
expect
us
to
to
come
in
and
do
the
work,
because,
obviously
we're
losing
out
on
money
every
time.
So
that's
obviously
piling
up
debt.
It
doesn't
really.
M
You
know,
vote
out
well
for
us
and
that's
me
who
lives
in
the
city.
I
could
only
imagine
some
of
these
other
guys
that
are
commuting
from
Super,
far
away
that
have
more
bigger
families
that
they
have
to
feed
and
no
it's
just
not
sustainable
for
us.
So
it's
just
something
that
that
needs
to
be
addressed
to
keep
everybody
here.
M
Happy
everybody
here
does
a
really
great
job,
and
it's
just
sad
that
we're
in
the
situation
that
we
have
to
come
up
here
and
and
tell
you
guys
about
this
when
we
get
nothing
but
Kudos
and
good
jobs
from
everybody
around
the
city,
everybody
loves
the
work
that
we
do
and
it's
just
a
bad
situation.
It
feels
like
to
me
at
least
that
we
have
to
come.
It
seems
like
beg
for
money
when
we
we've
done
the
work,
but
yeah,
that's
all
I
got.
Thank
you.
Thank.
N
Thank
you
good
evening,
Council.
My
name
is
Alex
corbless
I
am
the
President
of
the
Cupertino
employee,
Association
and
I'm
here
to
speak
to
you
about
the
same
thing
that
you've
just
heard
a
number
of
people
speak
to
you
about
pretty
eloquently
and
who
you
will
hear
quite
a
number
more
speak
about
I'm
sure
equally
as
eloquently
we
are
here
because
we
are
in
need
of
a
real
cost
of
living
adjustment.
N
I
assume
that
all
of
you
are
proud
to
serve
this
city.
You
wouldn't
be
on
Council
and
spending
this
amount
of
time
working
with
this
city,
if
you
weren't
and
I,
cannot
even
express
to
you
how
proud
the
people
standing
behind
me
are
also
to
work
for
the
city
and
the
amount
of
time
and
effort
we
dedicate
into
making
this
place
something
that
we
can
be
proud
of.
When
you
look
around
at
the
services
that
the
cities
provides.
That's
part
of
why
you're
proud
to
serve
here.
N
If
you
have
an
elderly
neighbor
that
it
maybe
is
a
little
lonely
and
needs
some
place
to
go,
that's
our
senior
center
as
part
of
our
Recreation
Department.
Maybe
your
niece
is
learning
to
play
basketball.
Well,
that's
me.
Those
are
programs
that
I
run,
maybe
that
Park,
that
your
niece
is
playing
basketball
in
might
be
maintained
by
Roberto
that
you
just
heard
speak
and
many
many
more
things.
If
a
new
coffee
shop
opens
down
the
street
from
your
house,
that's
another
city,
employee
that
has
done
work
to
make
that
happen.
N
The
if
you
and
your
daughter
ride
your
bike
and
ride
your
bikes
to
take
her
to
school,
that
safe
routes
to
school
program.
The
reason
that
you
have
a
safe
way
to
get
to
that
school
with
your
child
is
because
of
a
city,
employee
and
those
streets
that
you
took
to
get
there,
not
just
the
route
the
streets
themselves
and
the
bike
lanes
are
well
maintained
again,
because
even
more
city
employees
have
have
worked
to
make
that
happen
and
Roberto
said
it.
N
We
are
always
happy
to
do
it
and
we
do
now
and
then
get
a
praise
for
that,
and
we
appreciate
it
when
we
do,
but
as
trite
as
it
sounds,
you
can't
pay
the
bills
with
praise
rent
increases.
He
mentioned
11.
some
odd
percent
that
Kaiser
is
going
up
just
this
year
since
the
last
time.
The
city's
contribution
to
employee
health
has
gone
up.
It's
actually
almost
20
percent
that
just
Kaiser
has
gone
up
and
I
bring
up
Kaiser
because
it's
a
pretty
good.
N
C
Thank
you
Alex.
Next
we
have
Kendra
Middleton
Williams,
followed
by
John
martira,
followed
by
Sean
Sean
philbeck,
again
welcome
Kendra.
Yes,.
O
P
Here
and
taking
the
time
to
hear
us
out,
it's
pretty
important
for
any
City
or
municipality
to
have
the
actual
workers
who
were
there
doing
the
doing
that
it
takes
to
beautify
and
keep
up
a
city
and
every
single
detail
within
it.
You
know
what
makes
people
want
to
live
there.
Those
small
things
it's
important
to
have
these
blue
collar
workers
that
take
care
of
everything
that
make
everything
and
every
little
detail
run,
such
as
traffic
lights,
keeping
that
medians
grassy
and
green
trees,
trimmed
and
all
the
flowers
planted
in
my
15-year
memory.
P
The
insurance
offered
by
this
city
has
been
forgive
my
exaggeration
or
overstating,
but
it
has
been
ridiculously
expensive
and
it
is
now
cripplingly
expensive.
We've
reached
the
limit
and
a
point
where
nearly
every
service
is
Out,
Of
Reach,
because
the
Physicians
and
their
groups
have
canceled
affiliates
with
our
insurance
and
the
limitations
we
pay
for
those
and
the
most
expensive
Insurance
have
basically
become
unattainable
and
unusable.
Could
the
city
manager
please
make
themselves
known
because
I
looked
up
the
public,
accessible
salaries
today
and
earning
approximately
four
times
what
my
husband
earns?
P
It
seems
that
the
city
can
somehow
work
it
out
that
our
employees
are
making
a
more
commensurate
salary
to
afford
the
insurances,
afford
cost
of
housing
and
everything
that's
happening,
going
on
with
rent
increases,
housing
increases,
property
tax
increases
and
all
of
the
things
that
accompany
a
spike
in
the
economy
that
we're
seeing.
We
can't
expect
Municipal
Employees
to
go
on
at
the
point.
P
These
employees
that
are
all
standing
behind
me
take
pride
in
what
they
do.
It's
why
companies
such
as
apple
apple,
have
been
here
for
three
plus
decades
now
things
that
are
happening
in
terms
of
taxes
and
whatnot,
they
happen,
and
it
is
on
the
people
sitting
before
me
to
work
those
things
out
and
make
it
saborn
as
best
they
can
within
reason.
It
shouldn't
be
a
punishment.
P
So
with
that
said,
I
just
want
to
remind
everyone
that
at
some
point,
these
Municipal
Employees
are
going
to
get
to
a
point
where
they're
having
to
pay
a
courtesy
of
working
for
us
tax
and
the
last
time
I
looked
that
was
called
slavery
and
you
can't
expect
your
employees
to
go
further
working
at
these
wages
and
these
rates
paying
the
insurance
costs
that
they're
paying
and
expect
them
to
go
on.
It's
not
sustainable,
and
we
have
to
do
better
collectively.
We
have
to
do
better.
Thank
you.
Thank.
C
Q
Thanks
Kirsten
John
martir,
City,

Department
I've
been

Planner
worked
my
way
up
love
this
community
I
grew
up
here
in
the
West
Valley
40
46
years
now,
and
a
lot
of
what
I
have
to
say
is
has
already
been
said
so
I'll
keep
it
pretty
short
and
sweet.
Q
My
brothers
and
sisters
behind
me
who
have
been
brothers
and
sisters
of
me
since
I've,
been
working
here
and
especially
since
2016
when
I
joined
the
CAA
board
and
I've
continued
to
be
on
this
board
since
then,
because
I
feel
it's
very
important
to
advocate
for
these
folks
because
I
care
about
them,
we
care
about
each
other.
You
know
these
these
folks.
They
serve
the
community,
especially
as
residents
with
with
the
best
their
abilities.
Q
However,
as
you've
heard,
with
the
rising
Health
costs,
as
well
as
inflation
other
price
increases,
many
of
us
will
be
first
to
move
on
not
necessarily
from
our
homes
but
at
least
to
other
jobs.
Many
of
us
have
Decades
of
experience,
as
you
heard,
from
Alex
Wyckoff.
My
my
colleague
on
the
on
the
board
experienced
that,
if
lost
cost
of
community
more
financially
than
it
would
just
to
reinvest
just
to
reinvest
just
a
little
bit
in
the
workforce
that
you
already
have
all
we
asked
for.
You
guys
is
to
work
with
us
in
a
manner.
Q
C
H
R
Thank
you
so
first
I
wanted
to
start
off
by
saying
thank
you
to
the
the
city
council
for
allowing
us
all
to
speak
here
tonight.
As
she
stated,
my
name
is
Sean
John
philbeck
I
am
here
tonight
in
solidarity
with
my
brothers
and
sisters
with
OE,
3
and
local
21..
R
This
group
here
tonight
represents
the
backbone
of
this
city.
We
are
the
group
who
keeps
this
city
safe
during
the
pandemic
of
covid-19,
which
we
would
all
rather
forget,
but
it's
in
the
past,
and
we
are
also
the
group
that
responded
diligently
and
efficiently
during
the
storms
earlier
this
year,
and
we
were
also
able
to
help
out
with
numerous
events
in
the
city
as
well
as
keeping
this
city
beautiful,
safe
and
clean.
R
The
reason
that
all
of
this
is
possible
is
this
group's
hard
work,
our
diligent
training
and
our
overwhelming
dedication
mayor,
wait,
I,
don't
know
if
you
remember,
but
you
came
to
the
city
and
gave
us
a
proclamation
for
our
efforts
during
that
storm,
and
one
of
the
statements
you
had
made
was
that
you
were
so
proud.
The
city
of
Cupertino
did
not
have
to
declare
a
state
of
emergency
that
was
a
very
busy
day
for
us
and
I'll
be
upfront
with
you
about
that
that
we
just
jumped
into
action.
R
R
We
always
go
above
and
beyond
for
the
city
of
Cupertino
and
its
citizens,
and
we
will
always
continue
to
do
that.
I'm
going
to
leave
you
with
a
couple
of
thoughts.
R
One
many
of
my
co-workers
have
spoke
about
the
rise
in
medical
increase
and
I
can't
fathom
and
I
hope
you
could
fathom
what
it
would
be
like
to
not
be
able
to
afford
the
medical
increase.
Also,
there
are
a
few
employees
here
that
do
this
job
and
they
actually
go
to
another
job
as
well.
R
So
they
do
this
job
from
say
six
to
three
and
go
to
another
job
by
probably
four
or
four
Thirty,
and
if
not
the
same
job,
pretty
close
to
it
and
they're
working
long
hours
and
I.
Ask
you
this
that
we
were
there
for
your
you
and
your
time
of
need,
and
we
ask
that
the
favor
would
be
returned
to
us
that
you
be
there
for
in
our
time
of
need.
Thank
you
for
your
time.
C
S
First
mayor
way
said
the
normal
allotted
time
was
one
hour
for
an
agenda
item,
but
she
was
going
to
extend
it
to
90
minutes
with
each
person
allowed
to
speak
one
minute.
Typically,
when
there
are
a
lot
of
speakers,
everyone
speaks,
but
they
have
a
reduced
amount
of
time.
Everyone
speaks
because
every
voice
matters
second
I
believe
mayor
way
was
mistaken.
When
she
said
there
was
normally
an
hour
limit
for
public
comment
for
agenda
items,
nowhere
in
the
agenda
or
the
city
council
procedure
manual
or
in
our
Municipal
Code.
S
S
S
Fourth,
there
was
a
disruptive
behavior
by
a
high-level
City
staff,
member
that
it
was
allowed
to
continue,
but
the
same
disruptive
behavior
from
the
public
was
not.
The
disruption
was
so
loud
that
it
was
difficult
for
the
public
and
the
council
members
to
hear
what
was
being
said,
which
was
the
intent
of
their
action.
C
T
Hello
I'd
like
to
I,
wish
everybody
a
happy,
belated
Labor
Day
and
to
remember
what
Labor
Day
is
about,
and
it's
about
these
working
men
and
women
who
serve
the
community
and
I'm.
Thank
I'm.
Glad
they're
here
tonight
and
I
could
not
say
anything
better
than
what's
already
been
said,
I'm
really
proud
of
these
men
and
women
who
serve
this
city
and
I.
Thank
you
for
your
time,
so
that
was
ad-libbed
I'm
going
to
get
into
my
speech
now
so
good
evening.
T
Honorable
mayor
and
council
members,
my
name
is
Stanley
young,
with
ifpte
Local,
21
and
I'm.
Speaking
on
behalf
of
the
city
employees
who
I
represent
Cupertino,
we
know
that
the
city
of
Cupertino
has
budget
and
financial
challenges,
but
we
have
to
get
creative
to
make
sure
that
our
members
who
provide
the
excellent
services
to
the
communion
residents
of
Cupertino
maintain
their
Fair
wage
increases
and
salaries.
What
is
currently
being
offered
is
not
enough
to
keep
up
with
the
bay
area
of
cost
of
living
and
local
inflation.
T
We
have
also
seen
the
cost
of
Health
Care
has
continued
to
increase,
creating
a
burden
on
Family,
Health,
Care
and
individual
plants.
You've
heard
it
here
tonight
anywhere
from
10
to
20
percent
in
the
past
three
or
four
years.
It's
unacceptable
that
families
have
to
choose
between
holiday
gifts,
health
care
and
other
personal
needs
for
their
family.
T
Therefore,
I
ask
you
to
explore
new
options
to
make
sure
that
the
city
can
retain
the
staff
who
have
served
the
public
but
also
make
sure
we
can
recruit
new
employees
as
well.
This
is
vital
to
make
sure
that
there
are
employees
who
could
continue
to
provide
the
services
that
the
public
and
community
and
Cupertino
count
on
and
depend
on.
Our
Union
saw
what
happened
in
San
Jose
800
to
a
thousand
vacancies
in
a
place
where
it
cost
eight
hundred
thousand
dollars
or
two
million
dollars
to
build
a
home.
T
We
cannot
let
that
happen
in
Cupertino.
We
have
to
make
sure
our
members
can
afford
to
work
for
the
city.
Our
Union
wants
the
city
council
on
City
leadership,
to
put
city
employees
and
the
residents
of
Cupertino
first
they
are
one
in
the
same
and
we
don't
seek
division
within
the
community.
Actually,
we
need
the
community
support,
because
our
members
are
the
people
that
provide
those
Services.
You
heard
Alex
Corvallis
talking
about
safe
ways
to
school,
basketball
programs,
Senior,
Center
programs,
community
centers,
that's
our
members
who
do
the
work
for
the
citizens
of
this
city.
T
Think
of
all
the
City
events,
the
parks,
the
community
centers,
the
special
events
and
memories
that
families
have
created
here.
The
people
who
staff
those
are
our
members.
Please
invest
in
the
city,
employees
and
residents
by
making
sure
our
members
have
Fair
wage
increases
to
continue
to
serve
the
public
of
Cupertino.
Thank
you
for
your
time
and
consideration.
C
U
Good
evening
my
name
is
Josh
Rodriguez
and
I'm.
The
political
director
for
the
South
Bay
labor
Council,
representing
over
100
unions
in
Santa,
Clara
and
San
Benito
counties
I,
wanted
to
speak
up
on
behalf
of
the
city,
employees
that
are
here
tonight
and
just
say
that
the
offer
and
the
deal
as
it
stands
is,
is
an
odd
serious
deal.
It's
insulting
and
it's
disrespectful,
a
1.75
percent
increase,
doesn't
even
keep
up
with
the
cost
of
living.
It
doesn't
address
any
housing,
it
doesn't
address
the
rate
the
race
and
Healthcare
prices.
U
This
already.
This
is
one
of
the
most
expensive
counties
to
live
in
in
the
U.S
and
it
was
way
before
inflation
started.
Shooting
up
in
the
past
two
years
and
an
increase
of
1.25
is
just
not
serious.
The
city
employees
will
serve
better.
It's
these
workers
that
keep
the
city
going
and
it's
the
workers
that
deal
with
taxpayers
day
to
day
and
interact
with
all
the
citizens
and
provide
the
services
that
make
the
city
what
it
is.
U
I
think
City
leadership
needs
to
invest
in
their
workers,
so
we
can
have
a
functioning,
thriving
City
and
it's
time
to
get
serious
and
come
to
the
table
with
a
proposal
addresses
the
reality
that
these
workers
are
living
and
what
you've
heard
of
tonight
and
they
should
get
what
they
deserve.
Thank
you
for
your
time.
Thank.

Welcome
Jerry
365
I'm
here
to
support
my
union
brothers
and
sisters
and,
as
you've
heard
today
here,
they're
trying
to
get
a
fair
contract
to
be
able
to
take
care
of
their
families
and
health
care,
as
we
all
know,
is,
is
nothing
to
not
take
care
of
and
I
feel
that,
with
with
all
the
skyrocketing
of
living
and
the
benefits
that
these
people
and
these
workers
have
done
for
your
city.
I
live
here
in
Cupertino
I
moved
here
about
two
years
ago,
and
it's
one
of
the
most
beautiful
places.
V
I've
lived
and
definitely
has
a
lot
of
services
that
a
lot
of
other
communities
don't
have
I
lived
in
different
Bay
areas,
towns
of
the
Bay
Area
I
grew
up
in
Morgan
Hill
I've
worked
for
VTA
38
years,
so
I
know
the
whole
all
the
cities
and
communities
and
what
these
people
are
doing
here.
Keeping
your
city
safe,
clean
and
all
your
services
that
you
have
are
way
more
than
a
lot
of
other
cities,
and
you
should
pay
them.
What
they're
worth
should
give
them
a
fair
living
wage
increase.
Thank
you.

W
W
I
do
hope,
you're
hearing
over
and
over
I'm
hearing
that
these
people
are
feeling
and
there's
sort
of
an
excuse
being
used
about
the
financial
issues
and
not
yet
solved
for
the
city.
I
just
hope
that
each
and
every
one
of
you
and
everyone
listening
remember.

X
Good
evening,
council
members
I
have
a
number
of
disjointed
thoughts
this
evening,
nice
to
see
so
many
staff
here,
for
the
most
part,
I
found
highly
skilled
staff
to
be
patient
and
eager
to
help,
most
recently
with
code
enforcement.
Yes,
there
are
some
bad
apples,
but
good
apples
are
not.
They
deserve
closure
in
negotiations
and
I
would
Echo
Lisa's
comment
Regarding?
Why?
How
can
we
have
a
new
city
hall
got
money?
If
we
think
we've
got
money
for
that,
then
we
should
have
money
to
pay
people
anyway.
X
X
It
is
only
Klinger
production
that
has
permanently
ceased.
Clinker
can
be
imported,
other
materials
can
be
imported
to
make
cement,
so
Lehigh
is
continuing
to
protect
its
conditional
use
permit
to
manufacture
cement.
I
also
hope
that
the
city
staff
and
Council
can
look
at
the
new
Reclamation
plan,
because
it
does
not
bode
well
for
the
residents
of
Cupertino
regarding
air
pollution
traffic.
Our
Scenic

Etc
on
to
my
other
thoughts
regarding
valko
per
a
letter
from
the
Department
of
Environmental
Health.
X
Speaking
about
revealing
things
just
wanted
to
talk
a
little
bit
about
transparency,
something
that
our
council,
members
and
people
who
want
to
become
council
members
talk
about
a
lot.
We
want
transparency.
Why
is
the
park
and
rec
meeting
no
longer
videoed
and
what
is
the
cost
to
video
the
parks
and
rec
meeting
and
who
made
the
decision?
X
Last
of
all,
some
folks
have
referred
to
this
this
evening.
A
gentleman
who
testified
here
in
our
own
City
Hall,
passed
away
shortly
thereafter
on
our
grounds
and
I'm
just
devastated
that
our
mayor
has
not
volunteered
to
have
or
vice
mayor,
because
I
know
you've
done
Mona
with
silence
for
our
citizen.
We
have
had
moments
of
silence
for
other
people
and
not
him
and
it's
wrong,
and
especially
that
he
was
obnished
just
before
he
died
in
front
of
his
child
is
unacceptable.
Thank
you.
Y
Our
staff
do
on
a
daily
basis,
I
wanna,
specifically
speaking,
part
of
the
lowest
levels
of
staff,
that
the
time
in
management
costing
oh
I
want
to
draw
City
Convention
to
the
fact
that
we're
dealing
with
some
budget.
Y
Y
Can
you
hear
me
now?
Yes,
okay,
so
I
just
want
to
call
out
the
fact
that
money
has
to
be
found
somewhere
else
to
fund
the
needs
of
our
city
staff,
which
is
a
very
important
priority
and
I
want
to
call
your
attention
that
we
spend
on
non-essential
funding
to
programs
such
as
I
love,
Cupertino
website
such
as
Chamber
of
Commerce
funding
such
as
new
websites
for
online
shopping
and
subsidizing
festivals.
Y
Y
It
is
time
to
keep
the
lights
on
and
it
is
time
to
cut
all
non-essential
spend
on
activities
such
as
a
hundred
million
City
Hall.
At
a
time
when
you
need
to
be
focusing
on
our
finances,
you
spend
all
your
time
on
our
ethics
policies
and
unnecessary
agenda
items
that
do
not
deserve
time
and
priority.
Y
Out
of
the
many
study
projects,
we
have
over
15
study
projects
and
we
need
to
cut
our
study
projects
down
so
that
we
fund
salaries
for
the
people,
that
really
matter
and
I'd
like
you
to
cut
top
down
salaries,
I'm
glad
somebody
from
staff
I
think
Kendra.
It
was
that
spoke
out.
The
city
manager
makes
four
times
what
the
staff
make
and
we've
added
a
assistant
manager
and
an
associate
manager,
and
now
the
economic
development
committee.
We
need
to
cut
these
rules
at
the
top
so
that
we
fund
the
people
that
really
matter.
Thank
you.
Z
Hello
I'm
also
here
to
speak
on
Fair
wages
for
city
workers,
I
understand
that
it
may
be
difficult
to
meet
these
changes,
but
I
think
that
it
is
important
that
we
have
Fair
wages
for
all
workers,
but
especially
workers
of
our
city,
who
put,
who
dedicate
so
much
of
their
time
to
helping
our
city
run
and
helping
our
citizens
in
our
city
have
a
stable
lives
throughout
you
know
disasters
including
the
coven
pandemic
and
the
recent
storms
we
had
so
I
would
like
to
Echo
the
request
for
fair
wages
and
thank
all
city
workers
today.
Z
B
Thank
you,
Mana
city
clerk
I
want
to
thank
everyone
who
speak
today.
You
know,
and
you
take
your
time
to
speak
to
the
council
member.
We
really
appreciate
that
so
now,
I'm
going
to
close
the
oral
communication
and
we
are
going
to
move
to
consent,
calendar
items
number
two
to
five:
do
we
have
any
consent?
Calendar
that's
been
called.
Yes,.
B
So
what
you're
going
to,
if
there's
no
other
pool,
let's
open
up
for
a
public
comment
for
counseling
calendar,
two,
no
three,
four
five
two
is
being
pulled.
V
X
Hi
good
evening
again
had
a
couple
of
questions
about
the
accounts
payable.
There.
I
was
looking
just
through
it
quite
quickly
and
and
actually
a
couple
of
cup
questions.
One
is
about
the
Verizon
bills
and
I've
seen
this
before,
where
sometimes
there's
certain
people's
Verizon
bills
that
are
really
much
higher
than
others.
For
instance,
this
time
all
the
city
council
members
head
of
Verizon
bill,
but
vice
mayor
mohans,
was
huge
compared
to
the
other
ones,
and
so
why
is
that?
What
happened?
X
And
the
same
is
true
for
Mr
David
stillman's
a
card
was
much
higher
than
the
others
I'd
like
to
have
some
explanation
about
that,
because
we
care
about
how
our
dollars
and
Cents
gets
spent
in
the
city.
That
said,
the
other
thing
that
surprised
me
I
was
looking
into
how
How
the
City
reimburses
companies
on
this.
This
tax
sharing
agreement-
and
yes,
this
does
have
to
do
with
ap
so
hold
on.
X
So
what
happens
is
for
instance,
if,
as
somebody,
anybody
in
the
state
of
California
purchases,
an
Apple
product
online
Cupertino
gets
the
sales
tax
dollars
as
though
that
transaction
had
happened
within
Cupertino,
not
in
LA
Los,
Altos,
Los
Gatos,
whatever
it's
as
it
would
happen
here.
So
Cupertino
gets
a
benefit
of
that
sale,
but
this
tax,
which
is
a
buck
out
of
every
hundred
spent
and
then
Cupertino
remits,
35
cents
of
that
buck
to
Apple.
There's
a
similar
agreement
with
another
company
called
Insight.
X
So
one
question
would
be:
why
is
Cupertino
withholding
that
money
that
would
otherwise
go
to
Apple,
but
the
other
Curious
Thing
is
there
doesn't
seem
to
be
a
matching
invoice
and
you
know
usually
when
I
think
about
you
know
when
you
pay
people
money
that
there's
some
kind
of
invoice
attached
to
it.
So
so
that's
my
question
on
AP
at
my
second
question.
First
is
about
Verizon,
why
there's
inconsistencies
and
charges
on
for
for
individuals,
and
the
second
is:
why
are
there
no
matching
invoices
for
the
remitted
tax
payments
to
Insight
and
to
Apple?
B
So
I
will
close
the
public
comment
for
consenka
under
3,
4
and
5..
Do
we
want
to
email
the
residents
answers
later.
E
Anyway,
we'll
follow
up
with
Miss
fry
separately.
B
All
right,
thank
you.
So
if
Harbor
Council
discussion,
three
four
five,
if
not
I,
would
like
to
have
a
motion
and
a
second
please
yeah,
I
moved.
B
B
Thank
you.
So
we
are
moving
consent.
Calendar
number
two
to
the
end
of
the
agenda.
Now
we
are
going
to
public
hearing.
Do
we
need
a
rest
tonight?
No,
okay,
okay!
So
there's
no
public
hearing,
so
we
are
going
to
action
item
items
number
six
and
seven.
It
has
a
similar
tone
to
it.
B
So
I
would
like
to
propose
that
we
consider
number
six
and
seven
at
the
same
time
that
we
will
hear
number
six
stat
presentation
and
give
staff
time
to
ask,
give
council
member
at
time
to
ask
questions
and
then
we'll
listen.
We'll
have
staff
present
number
seven
and
Council
have
time
to
ask
questions
so
that
we
can
consider
him
at
the
same
time.
Is
that
okay,
with
my
colleagues.
B
Okay,
so
okay,
we!
What
about
my
other
colleagues.
B
AE
Hi
good
evening,
mayor
way,
council
members,
Christine,
Alfaro,
director
of
administrative
services
and
I
will
actually
be
turning
the
presentation
over
promptly
over
to
Annie
Rose
Haverhill
with
Moss
Adams,
who
is
the
city's
internal
auditor
for
the
presentation.
AF
AF
In
terms
of
the
purpose
of
this
work,
this
assessment
was
designed
to
evaluate
the
effectiveness
of
the
city's
management
and
governance
collaboration.
The
goal
was
to
ensure
that
all
of
the
practices
that
are
in
place
are
well
aligned
with
best
practice
and
set
everyone
up
for
Success
moving
forward.
We
wanted
this
to
be
constructive
and
really
focused
on
how
can
the
city
move
forward
in
some
of
the
areas
where
there
is
continuing
issues?
AF
So
the
scope
of
this
work
looked
at
a
variety
of
different
items,
including
things
like
council
meeting
procedures
and
resources,
working
relationships
and
collaboration
as
well
as
training
and
onboarding.
I.
Do
also
want
to
highlight
that,
while
this
assessment
looked
at
city
council
as
a
whole,
we
also
reviewed
the
Committees
and
commissions
as
part
of
this
work,
to
understand
how
those
governance
groups,
the
processes
that
support
those
groups
are
also
functioning
in
terms
of
the
methodology.
The
primary
work
for
this
project
was
conducted
between
March
and
June
of
this
year.
AF
Our
work
is
typically
done
in
four
phases
where
we
start
off
with
project
initiation,
and
then
we
move
into
fact
finding
for
this
review.
We
conducted
interviews
with
23
members
of
City
staff
and
Council,
we
reviewed
documents
and
conducted
best
practice,
research
as
well.
Then
we
brought
those
items
together,
performed
our
analysis
created
a
draft
report
that
was
reviewed
with
the
management
team
to
validate
facts,
and
then
it
was
brought
forward
to
the
audit
Committee
in
July.
AF
AF
So
shifting
into
the
observations
and
recommendations,
the
first
area
that
we
looked
at
was
policies
and
procedures,
and
the
city
has
established
many
policies
that
we
would
expect
to
see
that
are
well
aligned
with
best
practice.
So
that
is
a
very
strong
Foundation
to
be
starting
from,
but
there
are
some
opportunities
that
we
noted
to
increase
the
effectiveness
of
some
of
your
current
policies.
AF
Do
want
to
note
that
there
are
several
items
in
here
that
are
very
closely
connected
to
some
of
the
discussion
that
will
be
taking
place
for
agenda
item
number
seven
as
well,
so
just
want
to
flag
that
there
will
be
discussion
and
Direction
around
some
of
these
overlapping
topics
once
we
get
to
that
item
too.
So
that
is
the
case
for
this
first
item,
as
well
as
for
the
second,
which
is
focused
on
meeting
Cadence
and
processes.
This
is
another
area
where
positive
progress
is
already
being
made.
AF
While
we
were
performing
this
assessment,
the
adoption
of
the
city
council
procedure
manual
we've
received
a
lot
of
good
feedback,
saying
yes,
we're
headed
in
the
right
direction.
This
is
setting
up
all
involved
for
success,
but
we
want
to
continue
focusing
in
this
area
to
make
sure
that
these
City
Council
meetings
are
as
productive
as
possible.
So
the
recommendation
here
again
is
really
to
continue
the
work
that
is
happening
here
and
making
sure
that
everyone
fully
is
aware
of
those
procedures
and
are
held
accountable
to
fulfilling
them.
AF
Looking
at
the
municipal
code
guidelines,
we
have
a
recommendation
around
making
sure
that
there's
a
consistent,
practical
criteria
to
determine
when
information
requests
might
require
excessive
staff
time
in
order
to
complete
to
make
sure
that
that
code
guideline
can
be
applied
consistently
and
then.
Finally,
thinking
about
when
we're
speaking
of
roles
and
responsibilities,
how
can
we
ensure
that
those
are
well-defined
and
clarified
for
all
involved
through
things
like
governance,
trainings
and
Retreats
as
well?
AF
The
fourth
item
here
is
related
to
that.
Looking
at
onboarding
and
training.
This
is
another
area
where
recently
the
onboarding
and
orientation
process
has
been
updated
and
we
received
some
positive
feedback
that
that
has
been
a
step
in
the
right
direction,
but
that
it
could
be
further
strengthened,
specifically
by
adding
items
to
do
with
roles
responsibilities,
but
also
just
practical
application
of
guidelines
so
that
those
trainings
are
kind
of
taken
out
of
the
theoretical
and
brought
more
down
into
the
practical.
AF
Our
fifth
area
was
looking
at
ethics
and
compliance,
and
the
city
is
already
performing
many
of
the
best
practice
elements
that
we
would
expect
to
see
in
a
comprehensive
Ethics
program.
But
there
was
one
Gap
that
we
noticed
in
terms
of
compliance
enforcement
in
relation
to
form
700
disclosures.
So
our
recommendation
is
just
about
closing
that
Gap,
the
fifth
area
was
related
to
strategic
Direction.
So,
as
you
all
know,
every
governing
body
setting
the
Strategic
direction
is
a
major
piece
of
what
you
all
do
here
and
the
work
plan.
AF
The
two-year
work
plan
is
again
a
good
step
in
the
right
direction
to
prioritize
annual
initiatives.
However,
we
would
recommend
that
the
city
consider
developing
a
longer
range
plan
like
a
five-year
strategic
plan
to
help
ensure
long-range
strategy,
but
also
continuity,
as
there
are
shifts
in
leadership
over
time
as
well.
AF
Number
seven
was
in
relation
to
community
engagement.
This
is
another
item
that
I'm
imagining
will
come
up
in
agenda
item
seven
as
well,
but
this
is
looking
at
the
fact
that
you
have
a
very
active,
vocal
and
engaged
Community,
which
is
absolutely
fantastic
within
that
space.
It's
important
to
make
sure
that
there's
a
wide
range
of
opportunities
for
people
to
be
providing
feedback.
In
many
ways
the
city
has
established
excellent
avenues
for
Community
engagement,
and
we
noted
some
additional
opportunities
to
do
that.
AF
First
and
foremost
is
just
making
sure
that
there's
good
alignment
before
the
city
integrates
or
begins
major
initiatives
so
that
there's
good
alignment
between
expectations
of
City
Council
in
terms
of
what
community
engagement
will
look
like
and
how
that
is
carried
out
by
staff
and
staff
capacity.
For
that.
The
second
recommendation
is
to
continue
current
efforts
to
establish
a
statistically
significant
representative
Community
survey,
so
that
you
can
ground
decision
making
and
really
have
that
broad
understanding
of
across
our
community,
in
particular
some
of
the
folks
that
we
might
not
hear
from
always
are
there?
AF
So
then,
shifting
gears
into
the
commission
and
committee
work
that
we
reviewed.
The
first
thing
we
looked
at
was
the
actual
structure,
number
focus
and
goals
of
the
commissions
and
committees
that
are
in
place.
You
have
many
commissions
and
committees
here,
which
is
the
really
critical
part
of
local
government,
so
that
you
can
have
that
as
both
an
engagement
tool,
but
also
really
relying
on
the
expertise
of
the
community
members
that
participate
in
those
groups.
AF
There
are
some
opportunities
to
increase
the
effectiveness
of
these
groups
and
ensure
that
everyone's
time
is
being
really
well
used,
as
they
are
participating
in
these
groups
as
well.
Our
first
recommendation
here
is
related
to
establishing
a
charter
for
each
group
so
that
it's
very
clear
what
are
the
roles
and
responsibilities
of
those
group
members
in
particular,
because
many
of
your
groups
are
advisory
in
nature.
AF
The
second
recommendation
is
around
reviewing
the
governance
groups
themselves.
We
identified
some
options
to
potentially
bring
together
some
of
those
groups
again
with
the
focus
of
knowing
it's
a
significant
allocation
of
resources,
both
in
terms
of
the
group
members
and
the
staff
that
support
these
groups,
so
ensuring
that
they
are
as
streamlined
as
possible,
while
also
getting
what
you
need
from
these
groups
in
terms
of
their
advisory
capacity.
AF
AF
The
ninth
area
was
looking
at
the
member
selection
process
right
now
there
are
several
groups
that
could
potentially
benefit
from
adding
some
baseline
qualification
criteria
for
those
groups.
So
we've
noted
several
areas-
that's
certainly
not
true
for
all
groups
or
even
most
groups,
but
several
of
the
groups
could
benefit
from
that,
and
we
have
noted
that
in
the
report
as
well
10
when
we
were
looking
at
the
operations
thinking
through
things
like
onboarding
meeting
procedures,
work
plans,
those
areas.
AF
Finally,
shifting
into
our
last
two
observations,
these
are
more
focused
towards
staff
members,
but
the
first
thing
that
we
wanted
to
note
is
that
it
requires
really
significant
investment
of
Staff
time
to
support
these
groups,
and
so
we
want
to
make
sure
again
that
that
staff
time
is
being
used
as
effectively
as
possible.
We
know
that
these
groups
are
incredibly
important
and
we
want
to
make
sure
that
the
processes
are
as
efficient
as
can
be.
AF
Some
of
the
recommendations
here
are
just
around
reviewing
to
ensure
that
there's
consistency
and
clarity
about
who
needs
to
attend
these
meetings,
whether
it's
the
staff
liaison
the
department
director
or
both
and
then
finally
providing
training
to
staff
Liaisons
again
so
that
they
have
a
very
consistent
Baseline
knowledge
around
what
is
expected
of
them
in
these
roles,
and
our
final
piece
is
on
communication
and
change
management.
This
is
a
general
note.
AF
We
know
that
the
organization
has
gone
through
a
pretty
extreme
period
of
flux
and
change
in
the
last
several
years,
so
as
shifts
are
being
made,
especially
in
relation
to
some
of
these
governance
groups.
Thinking
about
how
can
we,
internally
as
a
management
team,
focus
on
communication
and
change
management,
to
ensure
that
staff
are
brought
along
on
those
decisions
and
changes
as
well,
so
with
that
I
will
close
out?
Thank
you
so
much.
AD
AB
Questioning
so
was
any
commission
members
interviewed
and
how
about
any
residents
who
we
actually
serve,
how
they
observe
as
our
Effectiveness.
Thank
you
thank.
AF
You
for
your
question,
so
we
did
not
interview
any
commission,
member
or
residence
as
part
of
the
scope
of
this
work.
We
did
interview
staff
members
that
support
the
individual
commissions
and
committees
to
get
their
understanding
of
current
processes,
but
because
the
focus
was
really
on
those
internal
processes,
it
was
restricted
to
staff
and
city
council.
B
Council,
member
I
don't
see
any
lights
coming
up.
So
if
councilman
from.
D
AF
We
tried
to
focus
our
observations,
obviously,
on
the
most
critical
areas,
so
I
will
say:
I
do
think
that
all
the
areas
are
important.
Some
of
the
areas,
though
there
is
current
work,
already
happening.
Many
of
these
areas
actually
and
so
I
would
say,
focusing
on
completing
the
current
work
that
is
in
progress
would
be
an
excellent
start
for
this
and
then
coming
back
and
picking
up
some
of
the
newer
additional
pieces
got.
D
It
and
then,
with
respect
to
observations
one
and
two
and
their
related
recommendations,
especially
to
you
know,
continue
current
efforts
to
implement
the
city
council
procedures
manual
and
hold
meeting
participants
accountable.
Are
there
any
more
specific
recommendations
that
you
would
make
there
it's
a
little
broad?
Yes,.
AF
Absolutely-
and
we
do
go
into
some
more
detail
in
the
report
itself,
but
I
think
the
the
main
piece
that
we
wanted
to
highlight
there
is
that
you
have
what
you
need
in
the
procedure
document
in
general.
Most
of
what
you
need
is
in
there
already
so
now
it's
a
matter
of
making
sure
that
everybody's
aligned
bought
into
those
and
have
a
really
strong
understanding
of
how
to
apply
those
procedures
and
abide
by
them
on
a
regular
basis.
AF
Yeah,
so
this
is
one
in
relation
to
in
your
Municipal
Code.
You
have
the
guideline
that
says.
Essentially,
if
there's
going
to
be
significant
staff
time
that
is
needed
for
this.
How
do
we
determine
that?
And
there
are
some
additional
guidelines
within
the
municipal
code
that
that
kind
of
bring
down
one
level
of
specificity?
AF
The
recommendation
here
is
really
around
saying
what
are
some
of
the
internal
processes
or
even
sort
of
decision
tree
that
we
would
want
to
go
through
as
a
management
team
to
determine
that
so,
for
example,
an
initial
request
might
take
10
minutes
to
complete.
So
you
say
yes,
we're
going
to
respond
to
this
respond
away,
and
then
it
turns
out
that
there
might
be
follow-up
information
or
it
turns
out
that
there's
one
additional
piece
that
we
didn't
realize
before
that
then
might
take
and
start
eating
into
that
time.
AF
Essentially,
and
so
we
have
seen
some
cities
develop
a
simple
decision-making
tree
that
says
at
this
point
in
the
process.
That's
when
we're
going
to
cut
it
off
in
alignment
with
the
municipal
code.
Obviously,
it
falls
with
under
that
umbrella,
but
that
way
it
can
make
it
a
little
bit
easier
internally,
as
that
decision
is
being
made
on
each
request
so
that
that
can
be
applied
as
consistently
as
possible.
D
It
and
then
taking
it
sort
of
to
the
next
logical
step,
which
is,
if
you
do
have
something
that
might
be
instead
of
a
work
program
item.
Are
you
familiar
at
all
with
San
Jose's
early
consideration
response
form
no.
I
AD
AA
Thank
you
for
the
presentation
we,
along
with
the
council
member
fruen.
We
had
the
opportunity
to
look
at
this
a
few
weeks
ago
as
part
of
the
audit
committee
proceedings,
I
had
a
specific
question
about
the
Strategic
Direction
portion
of
your
report.
It's
probably
based
on
best
practices
from
other
jurisdictions.
AA
How
does
it
actually
work?
We
sort
of
live
at
it
in
a
time
when
there's
constant
change
and
to
even
plan
one
year
ahead
is
is
a
challenge
in
itself.
So
does
it
even
make
sense?
I
know
it's
a
good
thing
to
think
strategically,
but
how
does
it
work
and
what
would
be
your
recommendation
to
put
that
into
practice
in
Practical
terms?
Absolutely.
AF
And
you
are
not
alone
on
that
at
all.
In
terms
of
recognizing
that
things
are
coming
up
every
year,
things
are
coming
up
every
month
that
might
need
to
be
taken
into
consideration.
Typically,
what
we
see
this
done,
as
is
you,
might
set
a
three
to
five
year.
Strategic
plan
where
you
say
here
are
the
major
goals.
Here
are
the
major
initiatives
that
we
wish
to
accomplish
during
that
time,
but
it's
not
a
promise.
It's
not
saying
we
are
absolutely
are
going
to
do
all
of
these
things.
AF
It's
saying
this
is
where
we
are
hoping
to
go.
This
is
where
we
would
like
to
aim
as
a
city,
then
on
an
annual
basis.
Typically,
what
this
looks
like
is
the
management
team
will
get
together
and
select
from
the
Strategic
plan.
Here
are
the
items
that
we
think
would
make
sense
to
move
forward
this
year.
They
would
bring
that
to
city
council.
You
all
would
weigh
in
on
that
set
priorities
for
the
year
and
do
that
in
advance
of
your
budgeting
cycle,
so
that
those
can
be
brought
in
and
budgeted
for.
AF
AD
C
Mayor
I
have
three
speaker
cards
for
speaking
comments
in
Community,
Hall
and
I
see
one
hand
on
Zoom
Jennifer
Griffin,
followed
by
Peggy
Griffin,
followed
by
Lisa
Warren
and
one
more
by
Rhoda.
Frye
welcome,
Jennifer.
F
Thank
you
good
evening,
city
council,
I
think
the
Moss
Adams
I
believe
has
done
a
thorough
job.
I
have
worked
in
government
situations
at
jobs
and
I
worked
at
laurale,
Space
Systems,
which
held
government
and
federal
contracts
and
international,
so
I'm
used
to
Audits
and
audit
trains.
F
Etc
going
on
I
I
think
that
it's
good
that
Cupertino
had
the
audit
happen,
but
I
will
tell
you
that
having
come
here
for
23
years
since
2001,
when
we
annexed
and
five
years
previously
at
the
Board
of
Supervisors
in
Santa
Clara
County,
when
we
had
Mr
submittian
and
Mr
Bell
as
both
Board
of
Supervisors
for
my
neighborhood
of
Rancho
Rinconada
I,
have
seen
a
lot
of
things
happen
and
I
find
it
hard
to
believe
that
everyone
in
the
Board
of
Supervisors
and
the
last
23
years
and
Cupertino
have
been
doing
it
wrong.
F
I
I
think
that
it's
good
to
have
audits
it
could
it's
good
to
take
recommendations,
but
I
can't
believe
that
everything
that
we
have
done
for
the
last
30
years
has
been
inadequate
or
wrong.
I
mean
there
are
a
lot
of
things
that
have
happened
in
these
Chambers.
We
did
all
of
the
Apple
stuff.
There
was
a
lot
about
people
in
2010.
F
We
never
had
particular
problems
with
City
Council
Members.
This
is
the
first
year
that
has
been.
It
appears
that
there
are
some
problems
and
I
I.
Don't
blame
the
other.
Two
I
I
think
that
we're
going
to
have
to
work
through
this
I.
Also
right
now,
we've
eliminated
the
environmental
Review
Committee,
the
design,
Review
Committee
and
the
legislative
Review
Committee.
We
have
had
no
Planning
Commission
meeting
for
the
last
three
months
and
now
I
understand
that
the
park
and
rec
is
not
being
televised.
We
have
no
committees
left.
F
What
have
we
got
bike
and
pad
and
the
the
Fine
Arts
committee
and
the
library
committee
I
mean
I.
We
we
have
like
three
or
four
committees
left,
so
I
think
these
Moss
Adams
has
worked
very
diligently,
but
we
have
no
committees
left,
there's
nothing.
F
Maybe
we
don't
need
staff
members
to
run
those
committees,
but
I'll
tell
you.
Last
year
we
were
full
and
loaded
and
running
and
to
me
we
participated
in
everything.
It
was
like
being
at
the
University
I,
had
so
much
that
I
got
out
of
my
last
year
in
Cupertino
the
last
this.
The
last
nine
months
has
been
like
being
in
Nursery
School
I
swear
to
God
and
I
have
a
bachelor's
degree
in
Biochemistry
and
I
have
taken
Master's
level
classes
in
Biochemistry.
C
S
Good
evening,
council
members
and
staff
I
believe
in
audits,
I
think
they
can
be
very
helpful
in
moving
in
the
right
direction
and
identifying
problems,
particularly
in
the
finance
area.
S
I
also
agree
in
training
and
I
think
that
top
of
the
list,
rosensburg's
rules
and
brown
act
in
detail
cover
many
aspects
of
it
and,
in
particular
the
minute
they're
elected
the
minute.
Don't
wait
till
they've
been
served
and
sat
on
the
diocese
for
a
month
before
the
first
meeting,
or
they
don't
show
up
work
plans
for
commissions,
I'm
disappointed
that
the
Commissioners
were
not
interviewed,
because
there
are
issues
with
our
commissions.
Their
members
are
motivated,
they're
energized.
They
want
to
participate
and
unplanning.
S
S
Also,
when
you
aren't
I
believe
in
a
work
plan
for
the
commissions
but
I
think
the
Commissioners
should
have
a
say
on
it,
it
should
not
be
dictated
by
staff.
It
should
be
a
Cooperative
list
and
also
cancellation
of
commissioning
meeting.
Commissioner
meetings
should
be
decided,
cooperatively,
not
just
dictated
down
anyway.
Thank
you,
I
hope
you
think
about
that.
W
So
there's
we
are
in
a
stuck
in
a
mud.
It's
like
being
a
burning
man
last
weekend.
I
would
assume
so
the
city
council
has
adopted
a
list
of
recommendations
from
one
of
the
several
paid
for
Consultants.
They
have
had
one
example
that
I
want
to
highlight.
Is
the
city
council
should
continue
to
use
the
city
work
program
as
a
way
to
implement
council's
goals,
and
the
city
should
rely
on
the
work
program
to
focus
resources
and
determine
staffing
needs?
W
I,
don't
see
that
really
happening,
and
if
it's
happening
it's
not
transparent
and
public
is
not
being
allowed
to
have
input
and,
as
said
before,
Commissioners
are
on.
Committees
are
not
even
allowed
to
have
input
because
their
meetings
are
canceled,
they
could
have
study
sessions
if
they
don't
have
a
true
agenda
and
I
know
that
takes
staff
time.
But
it's
important.
These
people
have
engaged
in
the
city
to
help
and
they're
not
being
able
to
do
so.
There's
just
this
spinning
wheel
of
drama,
that's
going
on
for
almost
nine
months.
W
That
is
not
serving
the
city.
Well,
at
all,
we
live
in
an
increasingly
nasty
world
right
down
to
our
own
City.
It
feels
as
though
silencing
those
at
the
top
of
the
city's
org
chart,
which
is
the
residence
and
compartmentalized
governing,
is
the
new
transparency
I'm.
Not
in
favor
of
that
it
seems
that
serial
punishment
and
individual
investigation
is
a
new
working
together.
W
W
W
C
X
Hi,
thank
you
for
your
report
and
it's
a
great
opportunity
that
you're
here
I
hope
that
you
can
comment
on
the
sudden
non-televising
of
our
Parks
and
Rec
commission
I'm,
really
hoping
that
the
city
council
can
work
with
staff
to
figure
out
a
way
to
restore
televising
this.
These
important
meetings
they
will
become
more
important
moving
on
because
we're
going
to
be
growing
our
population.
We
want
to
make
sure
that
we
have
enough
land
for
for
parks
and
what
we
do
with
our
parks
and
I.
Just
think.
X
It's
terrible
thing
and
reduces
the
transparency,
and
maybe
we
could
do
have
some
kind
of
a
video
light.
It
doesn't
have
to
be
as
good
as
the
video
that
we
do
for
city,
council
or
planning,
but
let's
please,
restore
it
and
I
really
want
an
explanation
as
to
why
how
it
got
eliminated
in
the
first
place.
We
really
do
want
to
encourage
public
engagement
and
transparency.
X
We
hear
transparency
over
and
over
again,
and
it
makes
me
sad
to
see
what
just
repeat
what
my
predecessors
have
said
to
see
how
the
way
things
are
going
and
I'd
also
like
to
remind
the
council
and
staff
about
the
Bagley
Keen
open
meeting
act.
The
meetings
of
public
bodies
and
writings
of
public
officials
and
agencies
shall
be
open
to
public
scrutiny.
X
But
if
you
take
that
opportunity
away,
we
don't
have
the
opportunity
to
engage
publicly,
and
that
is
why
I've
sincerely
think
the
Council
for
keeping
item
six
and
seven
on
this
agenda
separate.
If
they
had
been
heard
together,
it
would
have
been
confusing
and
if
had
they've
been
heard
together.
That
means
that
it
would
reduce
the
opportunity
for
public
engagement
and
isn't
that
what
we're
here
for.
X
So
that's
what
I
have
to
say:
sorry
for
being
a
little
disorganized,
but
anyway
I'm
hoping
you
can
make
some
suggestions
about
how
we
can
make
Parks
and
Rec
commission
work
for
us.
Thank
you.
C
Y
Good
evening,
city
council
I
have
to
wonder
we're
seeing
the
council
meet
after
more
than
a
month
and
what
are
the
priorities
that
this
type
of
agenda
items
show
up
as
the
priority
for
the
council?
How
does
the
work
program
set
priorities?
That
of
all
the
things
you
could
be
talking
about?
We
could
have
been
talking
about
finances.
We
could
have
been
talking
about
funding,
City
staff.
We
could
have
been
talking
about
the
housing
element.
We
could
have
been
talking
about
the
sign
ordinance,
but
yet
we're
here.
Y
Y
Y
Y
AG
Great
thank
you
good
evening,
city,
council,
members
and
mayor
way.
I
wasn't
intending
to
speak
on
this
topic
tonight.
I
am
Jennifer,
Sheeran
and
I'm
here
tonight.
Only
speaking
as
myself.
Thank
you
for
this
assessment.
I
want
to
say
thank
you.
Without
taking
an
assessment,
we
can't
determine
how
well
we're
doing
it's
clear
that
our
city
had
a
lot
of
issues
and
how
it
was
run
before
this
year.
AG
Meetings
lasted
until
all
hours
of
the
night,
for
example,
I
personally
was
at
a
meeting
in
2018
that
lasted
until
4
a.m.
That
means
staff
was
there
until
4am.
Following
that
meeting,
we
all
have
heard
about
documented
abuses
of
our
City's
procedures
and
Municipal
Code
not
going
to
go
into
that.
A
lot
of
that
has
improved
with
our
new
Council
and
our
new
procedures.
No
one
is
being
silenced.
Everyone
has
the
same
amount
of
time
to
speak
as
before.
It
can
be
frustrating
when
council
members
that
you
supported
are
no
longer
in
office.
AG
This
doesn't
mean
that
anyone
is
being
treated
other
than
respectfully.
The
council
meeting
is
a
business
meeting
for
the
council
to
set
direction
for
the
city
to
do
business,
I'm
glad
that
we're
moving
in
that
direction.
Thank
you
for
doing
that
and
for
all
the
changes
that
you
have
made
now.
Everyone
in
the
city,
including
our
staff
and
not
just
a
handful
of
residents,
have
the
opportunity
to
speak.
It's
about
8,
15,
PM
right
now,
and
the
nice
part
about
it
is
we're
all
still
awake
to
give
meaningful
input.
C
B
Right,
thank
you.
Mada
city
clerk,
I,
want
to
thank
all
the
residents
and
attendees
will
speak.
Thank
you
for
speaking
of
your
mind
and
then,
where
I
want
to
bring
back
to
the
council
for
Council
input
or
we
I
think
this
item
is
to
accept
the
Enterprise
leadership
assessment.
Audit
final
report
to
receive
it
I
would
bring
back
to
council
for
five
minutes.
Discussion
or
you
know,
would
you
believe
God
want
to
say
councilman
Richard.
AB
I
have
more
questions
so
I
think
I
understand
this.
For
this
internal
audit
we
don't
interview
Commissioners
or
residents.
However,
as
a
city
government
funded
by
taxpayer
dollars,
our
goal
is
to
serve
the
residents.
So
I
would
like
to
understand
what
kind
of
assessment
is
there
that
would
actually
evaluate
the
effectiveness
of
the
city
serving
the
residents
getting
their
feedback,
because
it's
very
easy
to
conduct
a
meeting
be
very
happy
with
how
it's
conducted,
because
we
think
we
got
everything
we
want
done,
but
the
residents
might
feel
totally
left
out.
AF
Took
a
professional!
Thank
you
great
question.
Thank
you.
So
the
note
that
we
have
about
the
representative,
Community
survey,
I,
think
really
speaks
to
the
need
that
you're
speaking
to
there,
that
would
be
an
excellent
tool
to
gather
annual
feedback
from
a
broad
array
of
your
community
members
about
the
their
perception
of
what
is
the
direction
of
current
city
government.
Do
we
feel,
like
it's
headed
in
a
positive
direction,
a
negative
Direction
being
able
to
provide
feedback
on
exactly
the
topics
that
you're
talking
about?
AB
That
really
doesn't
answer
my
question,
because
we
are
talking
about
effectiveness
of
the
city
council,
meeting,
commission
meeting
and
the
other
products
and
pro
Parks
direct
programs.
For
example.
How
do
I
evaluate
the
effectiveness
of
these
programs?
Community
survey
might
help
us
with
low-term
strategic
plan,
but
I
feel
that
this
yeah.
So
how
do
we
is
there
some
kind
of
assessment
that
you
can
recommend.
AF
Well-
and
this
might
not
be
fully
answering
your
question,
but
to
provide
a
little
bit
more
context
in
terms
of
when
we
were
looking
at
the
effectiveness
of
meetings.
Some
of
the
things
that
we
were
looking
at
were
things
like.
What
is
the
average
length
of
the
meeting?
How
how
effectively
are
you
able
to
move
through
topics
and
agenda
items?
AF
So
you'll
see
in
the
report
that
we
call
out
some
of
the
specific
criteria
that
we're
using
to
determine
and
to
evaluate
Effectiveness
and
while
Community
input
was
not
necessarily
part
of
the
criteria
that
were
used
for
that?
It
is
well
aligned
with
best
practice
in
terms
of
what
we
would
consider
to
see
at
the
municipal
level
for
things
like
Community
meetings
and
the
collaboration
of
this
team.
AC
So
that's
my
first
question
and
then,
with
regards
to
the
sister
cities
committee,
did
you
find
what
that
assignment
actually
entails
and
how
often
the
committee
members
who
were
assigned
to
that
committee
would
would
meet
and
what
their
purpose
was
and
if
not
then
I'd
like
to
hear
a
little
bit
more
about
that?
Okay,
that's
it!
Thank
you.
AF
Thank
you
so
much
so
to
clarify
the
tables
that
have
the
breakdown
of
the
staff
hours.
Those
are
pulled
from
a
previous
staff
report,
so
all
those
numbers
were
gathered
previously,
which
is
why
they
speak
to
some
of
the
commissions
and
committees
that
were
eliminated
subsequent
to
that.
So
we
included
them
in
this
report,
mainly
to
illustrate
the
the
level
of
investment
that
is
needed
for
a
lot
of
these
groups,
but
it
doesn't.
AF
It
is
not
a
full
documentation
of
the
current
staff
time
that
is
spent
on
the
current
groups,
because
it
does
take
into
account
some
of
those
additional
groups
that
have
since
that
time
been
reduced
or
eliminated.
So
that's
one
piece
there.
As
I
mentioned,
we
did
not
speak
with
any
of
the
commissioner
committee
members,
so
I
can't
speak
to
any
of
of
their
experiences.
There.
AC
AE
AD
B
I
like
to
ask
a
couple
questions,
so,
in
your
opinion,
the
way
you
assess
this
tool
are
you
using
the
standard
best
practice
to
assess
if
another
city
asks
you
to
do
the
same
thing.
This
is
what
you
would
do.
AF
B
Thank
you.
So,
when
I
look
at
it,
your
recommendations,
counseling
different
categories,
I,
think
council,
member
Freeman
asks
you.
You
know,
which
one
do
you
think
are
the
most
important
ones
and
use
that
concentration.
Otherwise,
we
have
already
started
and
finished
that
in
that
case,
I
think
that's
a
good
recommendation.
I
want
to
follow
up
with
council
member
Charles.
Why
are
we
not
you
know
getting
public
engaged
or
getting
commission
or
engaged?
So
in
your
opinion,
as
a
profession,
profession
know
who?
Who
knows
what
to
do?
AF
So
when
we
put
together
a
scope
for
this,
you
can
set
it
up
in
a
couple
different
ways
for
this
type
of
project,
and
sometimes
the
goal
is
to
really
understand
what
is
the
community
perception
of
these
groups?
What
do
we
need
to
be
shifting
in
terms
of
our
internal
operation,
to
ensure
that
we're
meeting
Community
needs?
That
would
be
one
particular
type
of
assessment.
AF
D
And
just
a
quick
follow-up
on
my
earlier
question
about
observation
and
recommendation
number
two:
there
is
a
subsection
there
with
a
recommendation
on
effective
meeting
facilitation,
specifically
at
the
end
where
it
says,
encourage
respectable
and
constructive
dialogue
among
council
members
and
established
clear
rules
and
protocols
for
productive
meetings.
Are
there
specific
rules
and
protocols
that
you
think
we
would
benefit
from.
AF
Is
in
the
procedures
manual,
so
I
believe
that
that
is
covering
99
of
what
you
need
and
I
think
the
one
percent
remaining
is
going
to
be
up
to
this
group
to
come
back
review.
That
say:
is
it
meeting
our
needs
as
a
team,
but
in
terms
of
alignment
with
best
practice
that
is
I
would
say
that
is
covering
what
we
would
expect
to
see
it
cover
there.
The.
AF
B
Thank
you,
council,
member
from
any
more
questions.
I
want
to
follow
up
with
one
question
from
the
comment
of
one
of
the
speakers.
The
this
whole
assessment
actually
to
me
feels
like
we
are
concentrating
on.
How
can
we
use
specs
practice
to
do
business
open
up,
listen
to
public
comments,
but
still
move
the
business
of
the
city
council
forward
so
that
we
can
complete
the
council's
test
of
doing
business?
Is
that
a
good
description
of
of
this
assessment.
AF
I
think
it
absolutely
encompasses
a
really
critical
part
of
this,
which
is
we
want
to
make
sure
that
you
all
have
the
tools
that
you
need
to
do
your
business
really
effectively.
I
think
a
piece
of
that
is
community
engagement
for
sure,
but
the
vast
majority
of
what
we
were
looking
at
here
actually
does
not
necessarily
touch
on
community
engagement.
B
Also,
a
comment
I
want
to
make
is
I
feel
that
this
gives
us
all
five
of
us
and
the
public
be
on
the
same
page
following
the
same
Precision.
So
we
can
all
understand
what
we
we
have
time
to
express
our
opinions.
We
have
time
to
share.
We
have
time
to
discuss
time,
to
ask
questions
and
time
to
make
decisions
together.
I
feel
that
it
gives
us
a
good
framework
how
we
can
move
forward
to
have
backed
backs
practice
and
understand
each
other
framework
of
how
we
move
together.
B
Okay,
that's
okay,
I'm
done
with
my
comment:
if
vice
mayor,
Mohan,.
AA
Thank
you,
mayor,
I,
wanted
to
follow
up
on
Maya
Grace
comments
a
second
ago.
The
way
I
perceive
this
is.
This
is
a
status
of
how
city
government
a
Cupertino
city
government
is
functioning
at
this
point
in
time,
and
it's
an
assessment
of
how
things
stand
our
how
things
stand
at
this
time.
AA
AF
I
can
imagine
that
there's
a
couple
different
pieces
going
on
here,
because
there
is
quite
a
bit
of
current
or
in
progress,
work,
that's
already
happening,
and
so
obviously
we
would
not
want
to
get
in
the
way
of
any
of
those
items,
but
for
any
items
that
would
be
new
items
of
business.
That
is
certainly
something
that
I
think
would
be
up
for
for
discussion
here,
in
terms
of
which
of
those
items
you
would
like
to
move
forward
with.
Most
of
these
items
are
things
that
fall
within
the
sphere
of
city
council.
AF
AA
A
AH
That
so
so
I
mean
there
are
some
some
recommendation
recommendations
presented
with
the
next
item
and,
as
you
know,
some
recommendations
that
the
city
attorney's
office
has
made
as
well
as
some
additional
points
for
discussion
that
we
are
directing
Council
to
several
of
which
flow
out
of
the
mouse
Adams
report
that
you're
hearing
so
so
I
think
I
would
refer
you
to
that,
and
but
of
course,
if
there
are
other
things
that
Council
wants
to
prioritize,
that's
that's
the
purpose
of
this
discussion
this
evening.
E
B
AB
Yeah
so
I
think
an
organization
often
has
conflicting
goals.
For
example,
the
city
staff
might
want
things
to
be
more
effective
and
things
are
determining
the
quickly.
AB
But
the
public
wants
deliberation
to
be
done
in
public,
and
then
they
want
us
to
take
time
to
listen
to
their
input
and
then
take
the
time
to
deliberate
and,
as
a
result,
an
effective
meeting
may
not
serve
the
goals
of
the
residents
and
for
the
record,
I
think
for
the
last
two
years,
at
least
on
when
mayor
Paul
was
conducting
the
meeting,
we
rarely
go
over
midnight
and
we
he
said
time
limit,
but
does
allow
us
time
to
deliberate,
so
I
wonder
as
an
expert
when
there
are
comforting
fleeting
goals
in
your
organization,
which
is
normal,
and
we
want
that.
AB
AF
I
think
the
key
there
is
making
sure
that
everyone's
on
the
same
page
and
well
aligned
and
you
have
consistent
expectations.
So
that's
where
your
procedures
really
come
into
play
because
they
provide
you
a
framework
so
that
everyone
is
aware,
here's
the
moments
for
public
input.
Here's
how
we're
going
to
take
that
into
account.
Here's
how
we
move
forward
with
the
discussion
so
I
think
that
the
framework
and
procedures
are
really
excellent
tool
to
start
you
on
that
path.
To
balance
those
those
competing
needs
as
well.
B
So,
thank
you.
If
there
are
no
more
comments,
we
can
move
to
number
seven.
The
reason
why
I
was
going
to
combine
it
because
I
think
the
actions
is
in
number
seven.
So
right
now
we
have
finished
number
six.
Unless
someone
has
still
have
some
comments,
do
we
need
to
take
a
break
okay?
So
let's
take
a
five
minute
break
and
we
can
come
back
to
number
seven.
A
A
A
A
B
AC
AC
AH
B
All
right,
I
would
say
the
basis
why
you
want
to
be
recused.
Okay,.
AC
AC
The
district
attorney
I
have
already
been
advised
that
I
would
need
my
own
legal
representation,
underscoring
the
fact
that
the
City
attorney
is
working
at
the
behest
of
the
council
majority,
because
this
item
contemplates
both
municipal
code
violations
and
censure,
which
the
City
attorney
has
offered
no
due
process
for
the
evaluation
of
yet
I
would
have
a
foreseeable
Financial
impact
in
order
to
hire
my
own
legal
counsel.
Under
these
conditions,
I
must
recuse
myself.
Thank
you.
B
All
right,
we'll
move
on
to
number
seven
review
of
council
member
compliance
with
Municipal
Code
chapter
2.17,
recommendations
in
May,
2023
fact-finding
report
and
related
governance
issues
and
I
believe
we
have
a
staff
report
from
attorney
Jensen.
AH
We
do
thank
you
mayor.
Let
me
share
my
screen.
C
AH
C
C
I
I
can
share
my
screen.
I,
don't
think
they
were
expecting
to
share.
C
AH
AH
So
mayor
members
of
council
I'm
here
today,
we
also
have
have
Linda
Dobby
here
at
the
staff
table,
I
will
be
giving
a
brief
presentation,
and
both
of
us
will
be
available
to
answer
questions
after
the
presentation,
so
we're
here,
as
as
indicated
in
the
title
of
the
agenda
item
to
monitor
progress
towards
compliance
with
the
findings
and
recommendations
in
the
May
2023
report
prepared
by
Miss
Dobby,
and
that
again
was
a
follow-up
on
what
was
the
the
December
22
grand
jury
report.
AH
AH
The
grand
jury
report
first
identified
a
cultural
distrust
between
the
city,
council,
members
and
City
staff.
It's
a
second.
It
noted
that
that
Council,
that
that
culture
of
distrust
negatively
impacted
City
operations,
including
the
the
loss
of
skilled
experienced
personnel
and
third,
the
the
grand
jury
report,
noted
the
changes
in
the
city's
ethics
policies
over
the
past
few
years
and
recommended
strengthening
the
city's
current
ethics
policy.
AH
As
a
result
of
the
the
findings
of
the
grand
jury
report,
this
the
city
attorney's
office
in
conducted
an
investigation
of
council
member
conduct
and
other
concerns
identified
in
the
report
consistent
with
Council
Direction
Miss
Dobby,
was
retained
to
conduct
that
investigation.
AH
Her
investigation
largely
confirmed
the
findings
of
the
grand
jury
report
noted
that
council
members
failed
to
comply
with
Municipal
Code
chapter
2.17,
which
sets
forth
the
the
council
staff
relation
under
the
council
management
form
of
government.
It
also
noted
that
there
was
interference
with
the
city
manager's
exclusive
authority
to
hire
fire
and
discipline
subordinate
employees
as
part
of
the
consideration
of
Miss
Dobby's
original
report.
The
city
attorney's
office
was
directed
to
return
to
Council
in
four
months
with
a
report
on
progress
towards
compliance
with
Municipal
Code,
which
is
why
we're
here
this
evening.
AH
You
also
just
heard
the
July
2023
Enterprise
leadership
assessment
from
prepared
by
our
internal
auditor
Adams
summarized
and
discussed
that
that
Enterprise
leadership
assessment
grew
out
of
a
20
December
2022
report,
an
Enterprise
risk
assessment
which
expressed
concerns
about
the
length
of
the
City
Council
meetings
about
the
potential
role
of
confusion
related
to
council
members
directing
operational
matters.
AH
AH
The
Enterprise
leadership
assessment
that
you
heard
earlier
today
reports
progress
towards
intimate
implementing
the
recommendations
in
the
grand
jury
report
and
that
Miss
Dobby's
made
2023
fact-finding
report
and
those
include
the
development
and
implementation
of
the
council
procedures
manual
and
improved
practices
for
Council
staff
Communications,
such
as
the
expanded
use
of
one-on-one
meetings.
However,
the
assessment
also
notes
areas
of
continuing
concern,
including
concerns
about
the
efficiency
and
effectiveness
of
Council
meetings
and
the
city's
publication.
The
effectiveness
of
the
city's
public
participation
processes.
AH
So
all
of
these,
the
reports
that
that
Council
has
received
over
the
past
year
or
so
have
tend
to
point
to
the
same
conclusions.
They
show
that
there
has
been
a
history
of
a
pervasive
lack
of
trust
between
council
members
and
City
staff.
They
note
that
the
council
members
do
not
seem
to
consistently
understand
their
role
within
the
council
management
form
of
government
and
they
point
to
concerns
about
the
effectiveness
of
city
council
as
a
policy
and
decision-making
body.
AH
This,
the
purpose
of
this
progress
report
is
to
is,
is
to
to
monitor
progress
towards
compliance
with
those
goals
and
compliance
with
Municipal
Code.
As
as
indicated
in
the
May
2023
report.
This
report
will
focus
on
four
of
the
recommendations
in
the
May
2023
fact.
AH
Finding
report
the
report
that
the
recommendation
that
council
members
avoid
governance
by
email,
providing
direction
to
staff
outside
of
notice
meetings
through
email
that
they
that
the
council
and
staff
aim
to
improve
Council
staff
relations,
that
the
council
and
making
its
decisions
gives
proper
weight
to
professional
advice
of
City
staff
and
other
professionals,
and
that
the
city
manager
and
and
her
staff,
as
well
as
the
City
attorney
work
towards
addressing
council
members,
need
for
information
to
make
informed
decisions
as
part
of
their
job.
AH
As
noted
in
your
staff
report,
the
Miss
Dobby's
follow-up
investigation
has
found
significant
Improvement
towards
achieving
this
goal.
The
number
of
emails
per
week
to
the
city
manager
from
Council
Members
has
decreased
from
about
50
to
70
per
week
prior
to
May
1st,
to
approximately
25
to
30
per
week
with
council
member
Moore
and
Chow
significantly
decreasing
their
emails
to
the
city
manager.
Staff
staff
interviewees
also
generally
noted
a
decrease
in
accusatory
or
caustic
emails
from
council
members
and
improvements
in
in
their
working
environment,
flowing
from
grading
greater
professionalism
from
among
the
council
members.
AH
Foreign
number
two
is
Council:
Members
should
attempt
to
improve
the
contentious
relationship
that
certain
members
had
with
City
staff
and
should
communicate
any
concerns
about
staff
to
the
city
manager.
Who
is
accountable
to
the
city
council
for
her
staff's
performance
and
again,
you
know.
We
see
significant
Improvement
here
since
May
interviewed
staff
noted
an
improvement
in
the
tone
of
emails
received
from
from
council
members
and
based
on
observations
of
recent
city
council
meeting
civility
among
council
members
and
among
council
member
and
staff
during
meetings
is
improving.
AH
And
here
once
again,
we
definitely
see
significant
Improvement
towards
meeting
this
goal.
Council
members
have
consistently
taken
advantage
of
preparation
preparation
sessions
regarding
major
agenda
items
such
as
the
budget
in
the
housing
element,
and
have
generally
used
those
sessions
as
an
opportunity
to
engage
constructively
with
professional
staff
and
obtain
information
to
help
them
make
decisions.
AH
There
has
there
were
reports
amongst
interview
staff
of
some
lingering
distrust
and
at
times,
disagreement
about
the
role
of
council
members
within
the
council
manager
form
of
government,
and
this
is
sometimes
reflected,
for
example,
in
Council,
Members
Reliance
on
their
own
research
or
a
non-expert
opinion,
as
as
opposed
to
professional
advice.
But
again.
Overall,
the
the
message
here
is
is
significant
Improvement
and
progress
and
effort.
AH
And
the
final
recommendation
with
that
is
was
numbered
as
recommendation.
Seven
in
Miss
Dobby's
report
is
the
city
manager
should
explore
ways
to
resolve
council
member
needs
for
information,
given
limited
stack
resources,
EG
one-on-one
meetings-
and
here
you
know
we
do
note
substantial
progress
towards
meeting
this
goal,
but
concerns
remain
about
council
member
city
manager,
Communications
city
manager,
Wu
has
offered
council
members
with
multiple
opportunities
to
inquire
information
regarding
agenda
pending
agenda
matters
through
one-on-one
meetings
or
through
larger
meetings
with
City
staff
on
major
agenda
items.
AH
There
has
been
an
unwillingness
to
participate
in
one-on-one
meetings
on
the
part
of
council
member
Moore
council.
Member
Chow
has
has
expressed
willingness
to
participate
in
in
these
meetings,
but
her
participation
has
been
uneven.
AH
Should
note
that
that
both
have
passed
have
have
consistently
participated
in
subject
matter,
specific
briefings
regarding
major
agenda
items?
However,
the
effectiveness
of
the
city
manager
and
her
staff
in
providing
professional
advice
to
all
council
members
will
continue
to
be
limited.
If
some
council
members
do
not
participate
in
one-on-one
meetings.
AH
Based
on
based
on
this
observed,
progress
in
addressing
concerns
identified
in
the
May
2023
fact
finding
report,
where
there's
certainly
progress,
even
if
it
is
it,
places,
uneven
and
imperfect
the
city
attorney's
office
is
recommending
restoring
council
member
Moore
and
child's
committee
assignments.
AH
Other
recommendations
that
grow
out
of
the
May
2023
report
and
the
follow-up
investigation
include
developing
a
revised
ethics
policy,
which
is
underway
continuing
to
provide
training
on
the
brown
act
to
council
members
and
to
provide
training
on
rosenberg's
Rules
of
Order.
We
would
also
emphasize
that
all
council
members
are
strongly
encouraged
to
attend
one-on-one
meetings
with
the
city
manager
and
or
City
attorney.
AH
Thank
you.
The
significant
progress
that
has
noted
in
the
staff
report
in
the
presentation,
I,
don't
think,
should
be
read
to
minimize
some
of
the
ongoing
governance
issues
that
the
city
is
continues
to
face.
There
continues
to
be
a
difficulty
understanding
the
distinction
between
operational
and
policy
issues.
It's
improving,
but
it's
it's
it's
still
there.
AH
There
are
ongoing
concerns
about
the
efficiency
and
effectiveness
of
Council
meetings
that
were
expressed
continue
to
be
expressed
by
our
internal
auditor
and
there
also,
as
noted
in
the
the
internal
audit
report,
the
overall
public
engagement
in
the
government
process,
with
the
exception
of
a
handful
of
issues,
is
limited
and
and
not
necessarily
affected
effective
with
limited
exceptions.
You
know,
City
Council
meetings
are
poorly
attended
and
dominated
by
a
relatively
small
number
of
residents.
AH
As
a
result,
as
noted
in
the
Enterprise
leadership
assessment
council
members
may
not
have
it
may
have
an
over
Reliance
on
anecdotal
evidence
and
or
public
comment
that
may
not
be
representative
of
the
wider
Community
perspective.
AH
The
over-reliance
of
the
opinions
of
a
small
number
of
Highly
engaged
residents
has
the
potential
to
systematically
bias
decision
making
and
lead
to
sub-optable
Optimal
decisions
in
the
city.
These
issues
remain
concerning,
despite
the
progress
in
implementing
the
recommendations
of
the
fact-finding
report
and
the
procedural
changes
made
through
the
adoption
of
the
procedure
procedures
manual.
AH
I'll
close
with
some
potential
policy
responses
to
the
concerns
identified,
so
one
would
be
to
to
update
the
council
procedures
manual,
which
is
on
the
agenda
tonight,
so
we
will
be
certainly
be
considering
that
the
second
would
be
additional
Council,
trainings
or
workshops
to
address
the
concerns
identified
in
the
grand
jury
report.
AH
Initiatives
requiring
commitment
of
significant
staff,
time
or
other
resources
would
be
incorporated
into
the
city
manager's
recommendations
for
future
city
work
programs
unless,
of
course,
Council
decided
to
re-prioritize
items
in
this.
This
year's
work
program.
B
Thank
you
see
attorney
Jensen
I'm,
open
enough
for
questions
by
Council
council
member
ciao
and
a.
AB
AH
AB
I
believe
city
manager
also
indicated
to
her.
She
should
see
her
own
legal
account,
so
that's
my
understanding,
I
think.
Maybe
some
of
your
words
were
taken
as
such.
That's
why
she
feels
she
is
at
risk.
I
want
to
clarify
that
and
then.
AB
I,
the
Civil
grand
jury
report
heavily
leaned
on
undisclosed,
Anonymous
interviews,
a
practice
practice
that
has
significant
shortcomings
by
allowing
numerous
inaccuracies
to
be
included
without
any
cross-examination
or
collaboration.
Evidence.
In
my
own
interview
with
the
Civil
grand
jury,
I
diligently
raised
concerns
and
provided
materials
via
email
correspondence.
However,
it
is
disheartening
to
note
that
my
inputs
were
selectively
excluded
from
their
final
report.
Consequently,
it
is
evident
that
the
report
lacks
the
balanced
and
the
factual
representation
that
is
essential
for
a
comprehensive
understanding
of
the
situation.
AB
The
top
report,
despite
its
label
as
fact-finding
report,
conspicuously,
lacks
any
substantial,
substantiated
facts
or
references
to
support
its
claims.
The
Santa,
Clara
County
deputies,
district
attorney,
Mr
John
Chase
of
the
public
integration
unit,
agreed
that
there
is
no
evidence
of
any
municipal
code
violation.
Instead,
the
top
report
contains
a
compilation
of
biased
Anonymous
opinions
put
forth
by
me.
Stop
the
void
of
any
accompanying
transcripts.
B
B
AH
B
Sorry,
it's
about
professional
advice,
to
accept
professional
advice
from
professionals.
I
feel
that
we
still
have
a
big
discrepancy
on
that.
The
grant
your
report
was
not
considered
a
professional
document.
Miss
Linda
Dobby's
report
is
not
considered
a
professional
document
from
certain
council
members,
so
I'm,
not
so
sure
how
this
item
is
being
has
made
any
progress.
That's
my
first
question
I
feel
that
this
question
this
hasn't
made
any
progress.
The
second
one
is
is
force.
Oh.
E
AH
I
do
think
I
do
think.
We've
noted
we've
noted
some
improvement,
I
I
think
it
is
so.
One
thing
that
was
noted
in
this
in
the
staff
report
in
the
presentation
is
I.
Think
in
the
the
active
and
constructive
participation
of
all
council
members
and
briefings
that
are
along
around
topics
like
the
housing
element
and
the
budget
and
and
and
and
then
Council
addressed
those
issues
quite
successfully.
When
we
got
to
the
meeting.
AH
AH
So,
of
course,
we
could
have
more
room
for
improvement
and
council
members
I
think,
have
different
views
on
the
weight
to
give
professional
advice
versus
other
sources
of
information,
and
that's
that's,
I,
think,
okay,
sort
of
normal
and
understandable,
but
I
I
do
think
that
that
that
that,
based
on
Miss
Dobby's
follow-up
investigation,
there
there's
observable
Improvement
and
I
think
certainly
an
effort
made
in
that
direction
by
by
council
members,
Moore
and
ciao,
and
so
so
that
that
That's,
the
basis
for
the
finding.
In
the
report.
Okay,.
B
Thank
you.
Another
question
I
want
to
ask
is
for
city
manager.
Why
is
it
if
I
not
hearing
or
incorrect,
that
you
have
one-on-one
meetings
with
five
of
us
and
but
there
are
some
lacking
one-on-one
meetings
with
councilmember
John
councilman
Moore?
Have
you
make
every
effort
to
accommodate
your
time
and
their
desire
of
when
they
could
meet
because
I
get
so
much
from
one-on-one,
so
I
think
that's
really
important.
My
question
is
you:
have
you
made
every
effort
to
make
sure
you
accommodate
on
Council
Members
workload,
work
time
and.
E
Thank
you.
Thank
you,
mayor,
wait
for
that
question.
So
I
do
me
with
each
of
the
council
members
on
a
weekly,
101
and
I
allotted
one
hour
each
hour
each
week,
understanding
the
council,
member
fruen
and
council
member
Chow
has
a
full-time
job,
so
I
do
my
best
to
accommodate
everyone's
schedule.
I
have
not
had
a
chance
to
meet
with
council
member
Moore,
since
February
I've
had
consistent
meetings
with
the
council
member
Chao,
probably
up
until
June
or
July
of
this
year.
Understanding
the
council
member
child
possibly
had
a
workflow
issue.
E
So
the
dialogue
between
me
and
council
member
Chao
has
significantly
reduced,
but
I
have
emails
and
a
follow-up
conversation
trying
to
accommodate
council
member
Chow's.
B
B
D
D
It
I'll
just
read
it
in
full,
so
that
said,
interviewed
staff
noted
several
instances
in
recent
months,
where
council,
member
Moore's
conduct
in
particular
fell
below
standards
for
civility
and
consequently
undermined
efforts
to
build
a
constructive
relationship
with
the
city
manager
and
our
staff.
It
should
be
noted
that
council,
member
Moore
apologized
to
staff
in
at
least
one
of
these
instances
after
jumping
to
conclusions
based
on
incomplete
information.
D
In
addition,
council
member
Moore's
refusal
to
participate
in
one-on-one
meetings
with
the
city
manager
and
or
City
attorney,
is
a
serious
hindrance
to
efforts
to
build
an
effective
working
relationship
among
Council
appointed
staff
and
all
council
members.
This
first
section
about
conduct
falling
below
standards
of
Civility
seems
at
odds
with
the
rest
of
the
the
text
here,
involving
how
council
member
Moore
has
interacted
with
staff.
Can
you
elaborate
on
what
precisely
has
meant
here.
AH
So
I
think
that
there
is
an
overall
trajectory
of
improvement
in
tone
and
and
and
and
and
and
as
far
as
being
less
accusatory,
less
hostile,
less
argumentative
and
and
then
you
know,
at
least
in
certain
sentences
settings
open
to
to
constructive
exchange
of
information.
AH
That's
not
to
say
that
you
know
the
behavior
is
perfect,
I
mean
I,
don't
think
any
of
us
would
want
to
be
held
to
a
standard
of
being
perfect
and
so
I
think
it
was
important
to
note
that
that
you
know
that
it's
it's
that
that
you
know
you
know.
Of
course
people
are
going
to
fall
below
that
standard
of
perfection
sometimes,
but
but
the
conclusion
is
based
on
an
overall
trend
towards
Improvement
and
sort
of
I.
AH
Think
based
on
the
review
of
the
facts
and
apparent
effort
of
improvement,
but
but
I,
but
it's
no.
The
the
the
conduct
you
mentioned
is
noted
in
the
staff
report
because
it
would
be
inappropriate
to
give
you
know
just
to
look
at
everything
through
rose-colored
glasses
and
say
that
there
are
no
remaining
problems.
B
AB
So
my
question
is
as
long
as
the
same
line
have
we
gotten
any
Community
feedback
about
the
council,
members
performance
and
the
staff
relationship,
because
I
feel,
like
the
staff
report,
seems
to
be
a
collection
of
Staff
opinions,
but
I
have
heard
from
community
members.
They
sensed
a
sense
of
hostile
hostility,
even
from
staff
towards
community
members.
In
these
past
few
months
and
this
kind
of
hostile
hostility
wasn't
there
last
year,
wasn't
there
the
year
before.
But
there
is
this
hostility
towards
council
members
and
community
members.
AH
AB
AB
AI
AI
Similar
kinds
of
issues
that
have
been
raised
with
respect
to
the
four
recommendations
and
I
can
tell
you.
Oh
the
other
thing
I
did
was
I
watched
all
of
your
Council
meetings.
I
also
watched
one
of
your
public
engagement
with
the
budget
and
I
would
really
like
one
of
those
budget
and
bite
t-shirts,
love
it
love
it
love
it
best
thing
you
can
do
when
you've
got
physical
challenges.
AI
I
can
tell
you
that
not
only
staff
when
I
interviewed
them,
180
degrees
just
felt
better
about
things.
The
management
team
is
working,
you're,
acting
respectful
toward
them.
They
feel
good
about
that.
That
gives
them
a
little
bit
of
confidence
so
that
they
feel
that
they
can
really
step
up,
and
not
only
they
are
very
professional,
but
also
you
know
present
everything
to
you
in
a
very,
very
professional
way.
I
watched
the
thing
I
was
really
impressed
and
trust.
Me
I've
been
around
the
block
watching
lots
of
council
people.
AI
You
know
from
day
one
of
my
career
and
one
of
the
things
that
I
really
was
impressed
with
was
the
use
of
PowerPoint
not
only
for
your
housing
authority,
but
but
that
really
helps.
It
is
probably
one
of
the
most
effective
things
that
you
can
do
to
get
the
public.
AI
You
know
information
there
very,
very
good
job
on
that
so
yeah
when
I,
when
I
watched
it
and
all
of
a
sudden,
you
passed
the
budget,
I
thought
wow.
Okay,
because
I
that
that
I
was
betting
to
myself,
that
you
know
not
going
to
happen
yeah,
they
did
housing
elements
absolutely
very
impressed,
and,
quite
frankly,
this
was
a
different
Council
that
I
had
originally
viewed
you're
respectful
toward
each
other.
AI
You
ask
questions,
you
know
there.
There
are
some
issues
with
that
substitute
versus
the
alternative
motion
kind
of
thing,
but
that
takes
practice
so
yeah,
so
that
that
was
my
methodology
and
that's
how
I
came
up
with
the
recommendations
and
sent
them
in
you
know,
obviously
the
recommendations
but
sent
them
into
your
City
attorney.
B
Dobby,
do
you
have
any
more
questions?
If
not
I
will
I'm
going
to
open
up
for
public
comment?
Please.
C
F
Good
evening
city,
council,
I
think
Miss
Dobby
did
an
excellent
job
in
the
report.
Chris
did
an
excellent
job.
We
are
all
adults,
we
have
all
worked
professionally
in
different
locations.
F
This
is
where
we
are
I'm
going
to
say
right
now.
We
need
to
move
on.
There
are
a
lot
of
other
critical,
pressing,
dangerous
things
that
are
going
on
in
our
state.
People
are
trying
to
take
away
our
local
control.
I,
don't
know.
If
you
all
understand
the
stress
load
that
the
public
has
been
under
from
the
last
year.
F
Do
too
the
housing
element
the
housing
bills,
not
knowing
about
the
trustee
drama
going
on
with
Fremont
Unified
High
School
District.
That
happened
in
March
I
did
not
hear
a
word
uttered
anywhere
about
it.
Until
I
received
a
postcard
in
the
mail
from
Fremont
unified.
Two
weeks
ago,
I
immediately
went
I,
mean
I
went
to
Fremont
I
mean
Homestead.
My
husband
went
to
Monte
Vista.
Both
of
my
parents
went
to
the
Old
Mountain
View
High
School,
my
grandmother
went
to
Willow
Glen
and
my
grandfather
went
to
Campbell,
High
School
I
know
our
high
school
districts.
F
A
F
40
people
five
women-
now
you
can
understand
the
stress
load
I
was
under
at
a
tech
company
as
a
female
programmer
in
1980
and
1990.
I
know
what
the
stress
load
is.
You
have
to
perform.
You
aren't
there
unless
you're
good
at
what
you
do
and
at
2
A.M
in
the
morning
you
have
computer
systems
crashing
and
you
are
responsible
for
bringing
them
back
up
again,
because
the
entire
satellite
department
at
Laurel
is,
is
ready
to
go
in
the
morning.
That
is
stress,
load.
Okay,
you
all
have
been
there
we're
in
an
engineering
environment.
F
We
have
tech,
people,
Etc
I,
I,
say
again.
It
is
time
to
move
on.
I
went
to
staff
meetings
regularly
run
by
our
engineering
department.
Every
Wednesday
and
I
was
of
the
IT
team.
It
is
time
to
move
on
and
I
say
this
kindly
I
think
that
very
important
topics-
I
and
I-
commend
you
for
talking
about
sb423
and
the
cast
bill,
but
we
need
to
move
on
and
deal
with
the
real
world.
Thank
you.
H
Thank
you.
Just
for
the
record.
I
wasn't
given
a
cue
card
by
an
AstroTurf
group,
I'm,
fully
capable
of
putting
my
own
foot
in
my
mouth
on
May
9th.
This
Council
created
a
hostile
work
environment
for
some
of
its
members,
made
a
spectacle
of
yourselves
made
a
spectacle
of
the
city
and
deprived
the
city
of
its
strongest
advocates.
H
There
was
also
a
settlement
mentioned
during
this
meeting
and
I
went
back
and
I
reviewed
it
and
what
was
stated
wasn't
quite
accurate,
so
I
would
like
to
enter
a
copy
of
the
settlement
letter
and
this
and
the
demand
letter
into
the
record.
So
people
can
review
it
and
make
their
own
conclu
draw
their
own
conclusions
now.
700
people
that
are
not

Cupertino
signed
a

feel
that
they've
been
disenfranchised
by
your
actions.

The
staff
report
written
by
City
attorney
Chris
Jensen
noted
in
in
quote
in
particular
emails
from
council
member
ciao
were
almost
uniformly
polite
and
respectful
kudos
to
her.
He,
however,
noted
several
instances
where
council,
member
Charles
conduct,
in
particular,
and
these
are
direct
quotes,
fell
below
standards
for
civility
and
consequently
undermined
efforts
to
build
a
constructive
relationship
with
the
city
manager
and
her
staff.
AJ
In
addition,
city
council,
member
Moore's
refusal
to
participate
in
one-to-one
meetings
with
the
city
manager
and
or
City
attorney
is
a
serious
hindrance
to
efforts
to
building
an
effective
working
relationship
among
Council
appointed
staff
and
all
council
members,
end
of
quote
of
the
city.
Attorney's
report
I'm
respectfully
asking
the
city
council,
the
city
manager
and
the
City
attorney
to
be
mindful
of
the
distinctions
in
response
between
council
members
more
and
ciao
and
apply
enforcement
actions.
AJ
With
these
distinctions
in
mind,
it
is
particularly
disturbing
to
me
that
a
council
member
could
refuse
to
meet
one-on-one
with
the
city
manager.
The
council
members
are
elected
to
cupertino's
council
member
city
manager,
form
of
governance.
The
previous
problem
cited
by
the
grand
jury,
an
independent
investigator
included
council
members,
Moore
and
Charles,
inappropriately
going
directly
to
staff
rather
than
the
city
manager.
AJ
The
refusal
of
council
member
Moore
to
meet
one-on-one
with
the
city
manager
is
glaring
in
his
adamant,
continued
non-compliance
with
our
form
of
civil
governance
and
her
frequent
recusals
council
member
Moore
has
behaved
differently
than
council
member
Chao
since
May
of
this
year
and
should
be
treated
differently
as
a
consequence
of
her
actions.
At
the
very
least
council
member
Moore
should
not
be
given
back
all
her
committee
assignments.
AJ
AK
My
name
is
Eugene.
Lee
I
represent
a
lot
of
parents
residents
in
cusd.
We
really
care
about
how
Cupertino
city
I
mean
all
everything.
Why?
Because
Cupertino
city
is
the
heart
of
cusd,
School
District
ours,
our
school
district,
you
know,
have
a
lost
issue
and
the
Cupertino
city
has
a
lot
of
issue
too
I.
Do
people
vote
you
guys
be
our
council
member?
We
don't
care
you
like
each
other
or
not.
Please
remember
the
campaign
is
done
is
stopped.
Please
don't
do
this,
it's
not
fairly
to
treat
it
to
people.
AK
I
just
really
feel
heartbroken
that
you
know
our
council.
Member
cannot
talk
to
the
city.
Staff
have
to
go
through
the
city
manager.
Oh
well,
this
is
a
good
news
or
you
know
new
policy.
I
really
don't
understand
that.
But
anyway,
there
is
a
lot
of
things.
I
want
to
know.
You
know
what's
wrong
with
asking
questions,
you
know
if
you,
if
you
know
there
is
something
like
do
their
own
research
to
be
better
information
and
not
be
a
rubber
stem,
a
recommendation
what's
wrong
with
that
seeking
data
via
the
public
right
act
fundamentally.
AK
Well,
anyway,
you
know
parents
residents,
don't
care
about
the
things
what's
wrong
with
that,
you
know
we
have
you
know
if
we
vote
our
representative
to
build
a
council
lay
huffler
right
to
speak
to
for
us.
They
have
like
right
to
do
their
own
job
and
you
know
I,
don't
understand
what
the
the
jury,
the
grand
jury
is.
AK
You
know
this
whole
investigation.
It
seems
like
a
drama.
A
drama
you
know
seems
like
a
setup.
I,
don't
understand
this.
You
know
what
kind
of
research
just
one
side
of
research
and
just
interview
for
seven
to
eight
people.
Only
then
you
know-
and
also
you
know
just
do
this-
please
this
is
a
Silicon
Valley
people
are
bright
and
high-tech
engineer.
You
know
High,
you
know
you
know
high
education,
residence,
stop
stop
doing
this.
Please,
please
restore
restore.
You
know
Kitty
and
the
young
child
to
to
back
to
the
commission
position
for
this.
AK
C
AK
W
Thank
you.
My
intention
was
not
to
sound
like
I'm
sticking
up
for
any
one
particular
person
or
two,
but
given
what
has
transpired
since
this
discussion
started,
I
feel
the
need
to
do
some
of
that
and.
W
Last
time
this
came
up
with
the
first
reporting
of
the
consultant,
the
Quinn
council
member
Moore
recused
herself.
She
explained
why,
as
I
recall,
the
mayor
questioned
it.
You
know
it
I,
don't
believe
it
matters
why
there
should
be
a
discussion
between
the
mayor
and
the
City
attorney
about
whether
council
member
Moore
needed
to
recuse
herself.
She
chose
to
on
the
information
she
was
given
by
staff
and
chose
to
do
what
she
felt
was
necessary
to
protect
her
family
and
herself
and
her
money
and
yet
she's
after
she's
off
the
dice.
W
You
drag
her
around
like.
Why
can't
you
just
accept
she
recused
herself,
because
she
was
told
this
and
she's
tried
to
give
you
more
reasons,
but
you
should
well
anyway.
I
don't
want
to
get
emotional
about
it,
but
if
it
were
any
of
you,
I
would
be
saying
the
same
thing,
because
it's
ridiculous
Behavior
she
gave
her
reason
and
I
can
also
say
that
let's
see
one-on-one
meetings,
I,
don't
believe
they're
always
one-on-one
they're
meant
to
be,
but
I
think
oftentimes.
W
W
A
X
Hi
I
agree
with
the
proceeding
speakers,
with
the
exception
of
Ms
sadati.
It
saddens
me
that
people
who
support
ciao
and
more
have
been
vilified.
Their
accomplishments
have
been
eclipsed
by
their
political
opponents,
just
want
to
mention
a
couple
of
of
their
accomplishments,
and
this
is
just
minuscule
compared
to
what
they've
done,
but,
for
instance,
councilmember
ciao
secured
massive
funding
for
the
Via
ride,
share
program
and
more
found
Hazmat
at
Falco.
This
was
in
public
reports
that
had
been
ignored
by
City
staff.
X
You
know
the
reports
say
that
council
members
should
not
seek
outside
information
through
her
duty
to
our
City's
residence.
Moore
has
single-handedly
saved
us
from
a
potent
human
health
hazard
that
would
have
impacted
us
for
generations
to
come.
Cupertino
residents
are
eternally
grateful
to
council
member
Moore
for
doing
her
own
research.
X
Moore
was
posed
poised
to
chair
the
Valley
Water
Commission,
which
is
pretty
impressive,
because
they've
got
18
about
18
members.
Her
leadership
would
have
served
our
community,
her
qualifications
and
contributions
to
that
body
are
in
your
agenda
packet
for
numbers.
Item
number
seven
and
you
know
I
I,
just
I
have
to
say
no
wonder.
Councilmember,
Moore
and
child
to
a
less
extent,
have
not
gone
to
one-on-one
meetings.
Staff
is
continuing
to
vilify
and
investigate
and
stop
these
investigations.
X
I
am
deeply
deeply
deeply
troubled
that
the
City
attorney
engaged
the
services
of
Ms
dowby
before
getting
the
go-ahead
from
Council
I'd
like
to
understand
how
that
happened.
Maybe
I've
got
it
wrong,
but
I
think
the
community.
When
we
look
at
the
data,
the
community
needs
to
understand
this.
This
is
backwards
I'm,
seeing
a
double
standard
where
other
council
members
have
made
defamatory
comments
without
penalty
without
reminders,
defamatory
comments,
a
question
for
the
City
attorney.
X
If
politically
motivated
majority
Council
recommended
municipal
code
violation,
would
the
City
attorney
represent
Ms,
Moore
I
think
the
answer
is
no.
Under
these
circumstances,
I
wouldn't
want
to
attend
a
one-on-one
with
the
city
attorney
or
the
city
manager,
either
by
supporting
Warren
Chow
I
feel
like
I,
am
not
allowed
to
support
the
three
others,
but
sometimes
I
do
support
the
three
y'all
y'all
need
to.
C
C
N
AL
AL
AL
So,
even
if
she
doesn't
agree
with
you,
she
will
always
be
polite
and
try
to
calm
you
down
and
give
you
all
the
reasons
that
all
the
logic
process.
She
has
already
come
come
to
this
solution,
and
you
know
she
is
not
only
the
hero
for
Chinese
communities,
so
Millions
a
valid
activist
who
just
unfortunately
passed
away
this
year,
he
was
called
Leon
he's
a
hero
for
winning
for
first,
she
being
willing
to
Champion
the
Voice
who
are
being
silenced
solar
service.
So
by
the
way
do
you
know
what
Dalai
it
means.
AL
Italian
means
a
person
who
belongs
to
one
of
the
lowest
Castle
in
Union
City.
So
this
censorship
was
a
circus
show
in
the
first
place
and
apparently
the
people's
voice
were
not
heard.
You
listen
to
this
cry.
Ladies.
Oh
man,
I
think
you
can
listen
to
it
100
times
without
changing
your
mind,
but
I
think
so,
just
starting
from
last
night,
when
the
petition
was
circulated,
the
whole
country,
the
whole
USA,
has
known
about
this
circus,
show
and
I'm
very
interested
in
learning
how
this
is
going
to
end.
AL
So
when
I
later,
when
I,
when
I
was
listening
to
the
recommendations,
number
one
was
like
so
surprising,
all
right
so
recommending
or
consumable
not
to
send
the
email
to
to
the
city
stuff
you
instead
relying
on
more
on
one-on-one
talks.
AL
What
the
camera
recommendation
is
that
right,
it's
not
not
only
not
efficient,
but
it's
also
very
easy
to
to
violate
and
to
bury
those
key
informations
that
the
public
record
act
would
require
later
and
I.
Think
that's
why
a
lot
of
credit
decision
making
information
was
lost
in
the
history
of
Cupertino
city
operation,
so
the
recommendation
in
the
service
is
ridiculous
by
itself.
C
AM
Thank
you
good
evening,
city,
council
and
staff
I
respectfully
ask
that
you
make
and
pass
a
motion
to
return.
Council
members
be
more
and
Liang
Chao
to
their
commission
roles
as
soon
as
possible.
Agenda
item
number
seven
asserts
that
City
Council
meetings
are
dominated
by
a
small
majority
of
residents
that
do
not
represent
the
larger
populace.
AM
As
such,
I
would
like
to
note
that
this
request
is
backed
by
a
petition
with
715
resident
signatures,
and
it's
still
growing
by
the
moment,
given
how
quickly
these
signatures
have
been
gathered
in
the
span
of
hours
not
days
restoring
chow
and
more
to
commission
assignments
appears
to
be
the
will
of
the
substantial
portion
of
the
public.
While
you
can
maintain
the
current
status
quo
of
only
three
out
of
five
council
members
serving
on
commissions,
the
numbers
indicate
that
this
may
not
be
a
popular
decision.
AM
We
want
the
city
council
that
can
work
as
a
team
and
resolve
disagreements
productively.
Moreover,
we
have
seen
council
members
more
in
ciao
bending
over
backwards
to
be
polite
and
courteous
to
staff
and
fellow
council
members
is
the
job
of
a
council
member
to
scrutinize
their
fellow
council
members
or
to
work
together
to
solve
the
city's
problems.
AM
We,
the
residents,
will
be
extremely
grateful
and
appreciative
if
you
show
that
you
are
now
ready
to
resolve
your
differences
and
restore
previous
ways
of
functional
leadership.
More
specifically,
we
would
like
council
members
more
and
child
restored
to
commissions
immediately
not
next
year,
and
also
that
the
process
process
of
assignment
be
collaborative
and
thoughtful.
For
example,
we
are
hearing
that
council
member
Moore
has
extensive
experience
not
only
on
the
VTA,
but
also
with
the
Water
Commission.
So,
let's
keep
in
mind.
AM
C
Y
When
you
get
a
diverse
mix
of
people
from
a
variety
of
different
backgrounds,
communication
is
going
to
be
different,
so
you
cannot
set
one
standard
on
what
is
professional
communication?
What
is
a
mode
of
communication?
What
does
it
mean
to
trust
an
hour?
All
of
these
are
once
one's
view
of
how
it
ought
to
be
here
in
Silicon
Valley.
We
have
a
great
Melting
Pot
of
hundreds
of
different
countries
and
cultures.
Y
You
are
not
going
to
have
the
same
experience
if
you
were
to
be
in
the
city
of
let's
just
say:
Los,
Altos
or
Los,
Altos,
Hills
or
Atherton
or
Oakland
or
any
other
City.
Every
city
is
unique
and
different,
based
on
its
rest
in
population
and
the
city
council
is
a
mirror
image
of
the
residents
that
have
voted
U.N.
Y
So
I
ask
that
you
have
some
tolerance
for
the
diversity
of
experiences
and
cultures
that
we
all
bring
in
for
all
of
those
that
come
in
from
different
real
daytime
jobs
outside
of
political
service
or
Civic
service.
You
understand
that
there
is
no
one
culture.
If
you
worked
at
an
HP,
that's
a
totally
different
culture
from
today's
professionals
that
maybe
work
in
an
aggressive
company
such
as
a
startup.
Y
They
were
together
for
30
40
minutes.
Maybe
I
witnessed
a
very
respectful
conversation,
a
great
amount
of
Cambridge
area,
I'm,
sure
the
city
manager
remembers
that
and
so
I
feel
like
politics
is
getting
in
the
middle
of
City
staff
and
council
members
and
let
us
not
make
a
bad
situation
worse.
Let
us
look
ahead.
This
is
not
Washington
DC.
We
don't
need
a
quagmire
here.
There
are
no
two
political
parties.
Thank.
C
AG
Good
evening,
city,
council,
members
and
mayor
wait
again
I'm
Jennifer,
Sheeran
and
I'm
here
tonight.
Speaking
only
as
myself,
I
followed
these
distressing
issues
since
I
witnessed
some
of
them
firsthand,
followed
by
the
grand
jury
report
and
subsequently
followed
by
the
confirming
special
investigator
report.
I've
said
on
many
occasions
that
when
our
elected
officials
violate
our
city
codes
and
procedures,
we
residents
should
expect
them
to
acknowledge
their
errors
and
strive
to
do
better
for
the
sake
of
all
of
our
residents.
AG
This
is
the
reason
we
elected
them
to
do
the
best
for
our
city
and
all
its
residents,
not
just
the
residents
who
agree
with
them.
Based
on
the
staff
report.
I
see
that
council
member
Chao
is
working
towards
improvements
in
her
relationships
with
City
staff.
The
volume
of
emails
and
legislative
through
email
has
declined.
She's
also
been
attending
some
one-on-one
meetings
with
both
the
city
manager
and
City
attorney.
I
appreciate
that
council
member
Chow
is
doing
so.
It
is
still
this
evening
very
concerning
and
surprising.
AG
However,
the
council
member
child
does
not
accept
any
responsibility
for
her
actions
or
the
documented
violations,
so
that
that
does
give
me
pause.
Unfortunately,
it
doesn't
appear
that
council,
member
Moore
is
making
the
same
level
of
improvements
as
council
member
Chow
kingly.
She
has
still
refused
to
meet
without
the
city
manager
or
City
attorney
since
February
there
are
still
issues
and
incidents
occurring
with
staff
council.
Member
Moore
also
appears
to
not
be
willing
to
take
responsibility
for
her
actions.
Reinstating
all
committee
assignments
now
means
there's
no
impetus
for
future
Improvement.
AG
This
seems
premature
at
this
time.
I
asked
that
another
review
happened
in
six
months
to
determine
if
improvement's
continuing,
there
still
seems
to
be
a
list
of
very
concerning
outstanding
issues
that
still
need
Improvement
for
council
member
Moore.
This
has
nothing
to
do
with
different
cultures
or
not
liking
a
fellow
council
member.
It's
a
matter
of
respect
and
for
following
our
Municipal
codes
and
regulations.
We
should
all
want
that.
AG
AN
Okay,
can
you
hear
me
now?
Yes,
okay,
great,
thank
you
for
the
opportunity
to
speak
today,
I'm
here
to
sort
of
say,
please
move
on.
Let's
act
up
the
recommendations
to
reinstate
council
members,
ciao
Moore
to
their
respective
committees.
We
ask
a
lot
of
questions.
That's
exactly
what
data-driven
people
want
and
that's
what
a
majority
of
our
population
is.
The
majority
Council
I
have
a
recommendation
for
you.
Maybe
you
should
do
your
homework
and
also
learn
to
ask
some
questions
instead
of
targeting
them.
AN
Tempting
the
city
and
attorney
mentioned
as
part
of
the
observations,
ineffective,
Council
meetings,
guess
what,
for
the
past
nine
months
we've
had
we've
been
working
mostly
on
irrelevant
issues.
Another
comment
made
by
the
city
city
attorney
as
part
of
the
presentation
and
I'm
paraphrasing
Europe,
a
particular
group,
tends
to
attends
the
meeting
and
then
and
sort
of
effectively
manipulates.
The
policy
case
in
point
was
the
Civil
grand
jury
report.
AN
Perhaps
you
should
take
that
recommendation
seriously
after
the
presentation
mayor
Ray
mentioned
about
the
two
council
members,
not
accepting
professional
opinions,
it
might
help
your
male
way
to
actually
go
and
seek
your
own
opinion.
Instead
of
rubber
stamping
what
the
staff
presents,
another
thing:
you
should
disagree
with
the
staff,
but
it's
good
to
have
your
own
opinion.
A
baseline
is
a
good
thing,
please,
just
and
last
before
I
get
to
the
last
thing.
AN
Please
do
not
think
of
making
up
for
the
budget
shortfall
by
selling
T-shirts.
That
would
be
it
clearly
a
stupid
idea
on
behalf
of
over
700
people
who
have
signed
the
petition.
I
am
sorry
council,
members,
Joe
or
chow
and
more
for
what
you
went
through
with
this
crazy
grand
jury
report
so
may
away.
As
council
member
Liang
pointed
out,
we,
the
public,
don't
get
enough
and
clear
information.
We
want
you
to
work
on
useful
things.
We
want
to
hear
the
details.
Please
reinstate
both
council
members
to
their
respective
committee
assignments.
C
AO
I
unmuted,
yes,
okay,
great
check
the
button
winner
is
so
black.
Thank
you
very
much
and
good
evening
Council
and
mayor
and
staff
I
I
keep
hearing
about
the
one-on-one
meeting
with
the
city
manager,
but
I
couldn't
find
anything
in
writing
that
says
it
is
required
if
it
is,
if
there's
a
reference
to
it,
being
required
on
any
I,
went
to
other
cities
and
just
kind
of
did
a
Google
Search
and
trying
to
see
if
I
could
find
it
and
I
just
couldn't
find
it.
AO
AO
I
personally
feel,
like
it's
I,
don't
know,
makes
me
kind
of
nervous
when
a
council
member,
just
speaking
to
the
manager
and
having
possibly
you
know,
speaking
about
let's
say
three
people
talk
to
that
one
manager
about
one
topic
and
they're
convincing
the
manager
and
it
just
kind
of
feels
like
the
reverse
of
chrome
act.
If
you
would
I
it
to
me,
it
just
seems
that
way.
Of
course
it's
if
it's
being
done
and
it's
a
common
practice,
then
great.
My
question
is:
please
give
us
a
reference,
something
that
says
it
in
writing.
AO
The
professional
the
question
about
whether
or
not
they're
they're
accepting
their
professional
advice
and
that
always
worries
me
because
it
depends
on
who
you
fire.
It
could
be
the
professional,
for
example,
last
they're
during
the
meetings
for
Valco,
they
hired
professionals.
That
said,
they
didn't
recommend
a
phase.
Two
well
guess
what
it
turned
out,
that
a
phase
two
was
required
and
that
phase
two
did
find
contamination.
AO
So
if,
if
they
had
listened
and
well,
that
council
did
listen
to
quote-unquote
professional
advice,
but
if
council
member
had
had
listened
to
that,
then
we
wouldn't
have
had
the
benefit
of
finding
contamination.
So
one
of
the
public
comments
that
you
know
I
know
it
doesn't
feel
comfortable
to
not
have
your
council
members
chosen
and
kind
of
made
it
seem
like
we're
just
no.
This
is
all
about
back.
AO
Facts
is
all
we
want,
and
so,
if
facts
is
what
they're
bringing
to
the
table,
whether
or
not
they
are
listening
to
professionals
I
think
it's
irrelevant.
Another
point
is
the
commissions,
the
commissions
that
they
were
removed
from
have
nothing
to
do
with
the
complaints
that
were
spoken
against
them
or
were
rendered
against
them.
So
they
were
on
a
commission,
they
they
didn't
get
any
complaints
from
the
commissions.
They
were.
Thank.
B
AB
Jury
reports
heavily
leaned
on
undisclosed,
Anonymous
interviews,
a
practice
that
has
significant
shortcomings
by
allowing
numerous
inaccuracies
to
be
introduced
without
any
cross-examination
or
cooperative
evidence.
In
my
own
interaction
interview
with
the
city,
the
Civil
grand
jury,
I
diligently
raised
concerns
and
provided
the
materials
via
email
correspondence,
however,
is
these
are
threatening
to
know
that
my
inputs
were
selectively
excluded
from
their
final
report?
Consequently,
it's
evident
the
report
lacks
the
balance
and
factual
representation.
That
is
essential
for
comprehensive
understanding
of
the
situation.
AB
The
W
report,
despite
its
leg,
bought
as
fact-finding
report,
lacks
any
substantial
facts
or
references
to
support
its
claims.
Instead
The
W
report
contains
a
compilation
of
biased
Anonymous
opinions
put
forth
by
Miss
Darby,
devoid
of
any
company
transcripts
for
cross-examination
or
verification,
thus
preventing
the
possibility
of
a
balanced
assessment.
Expert
opinions
are
valued
only
if
they
are
supported
by
solid
evidence.
One
notable
relevance
from
the
W
report
is
its
inability
to
unearth
any
evidence
of
a
municipal
code
violations
involving
current
or
former
council
members.
AB
The
Santa
Clara
County
Deputy
district
attorney
Mr
John
Chase
of
the
public
Integrity
unit
agreed.
There
is
no
evidence
of
any
Unicode
violation.
However,
it
is
regrettable
that
the
report
has
achieved
a
different
kind
of
success:
the
creation
of
a
hostile
city
government
in
our
city.
The
consequences
of
the
W
report
are
not
limited
to
to
council
members.
They
extend
through
the
Cupertino
residence,
whom
we
have
strong
sworn
to
serve.
The
act
of
stifling
questions
from
Council
Members
is
fundamentally
opposed
to
the
principle
of
transparency
and
accountability.
Similarly,.
AB
Quashing
dissenting
voices
under
the
guise
of
efficiency
is
a
direct
assault
on
the
foundations
of
democracy.
It
is
my
strong
belief
that
this
report
and
the
associated
agenda
item
run
counter
to
democratic
values,
due
process
and
the
principles
of
good
governance.
More
importantly,
they
do
a
disservice
to
the
residents
of
Cupertino,
whom
we
are
duly
bound
to
represent.
Every
voice
should
be
respected
and
valued.
It
is
concerning
that
the
staff
report
labels
certain
voices
as
unrepresentative,
reflecting
a
troubling
pattern
in
our
city
of
disrespecting
Cupertino
residents,
who
take
the
time
to
attend
Council
meetings.
AB
B
Okay,
so
now
we
have
three
council
members
left
on
the
diocese
and
comments
from
councilmember
froon
or
vice
mayor
Chao,
I've.
B
B
You
know,
I
do
believe
that
we
have
both
of
them
have
made
genuine
improvements
and
I
was
ready
to
move
on
and
because,
as
council
member
Charles
said
collectively
and
collaboratively,
I
feel
that
I
have
nobody
to
collaborate
or
collectively
do
anything
so
I
feel
this
is
a
Deja
Vu
to
me
again.
So
I
am
going
to
stop
right
here.
So,
let's,
if
any
council
members
would
like
to
make
any
comments,
vice
mayor
Mohan,.
AA
Give
me
away
comments,
were
you
know
just
to
reiterate
that
we
are
not
here
to
engage
in
the
details
or
the
fact,
findings
of
the
grand
jury
report
or
the
city's
response
to
the
grand
jury
report
or
the
Miss
Derby's
fact-finding
report.
We've
we've
done
all
this,
then
the
new
thing
that
we
discussed
today
was
the
Moss
Adams
Enterprise
risk
assessment
report,
so
I'm
not
sure
if
there's
any
purpose
in
sort
of
going
over.
AA
All
the
details
of
these
reports,
which
have
already
been
discussed,
I
I,
looked
at
the
positive
elements
that
came
out
of
all
the
discussion,
including
the
city
attorney's
recommendations.
AA
There
has
been
Improvement
and
that
was
the
whole
purpose
of
our
discussions
in
earlier
in
the
year.
We
wanted
to
make
sure
that
there
was
there
were
steps
taken
to
remediate
some
of
the
problems
that
staff
had
encountered,
that
several
other
people
had
encountered,
and
so
this
is
the
next
step
we
had
said
six
months
from
now.
We
will
review
progress
made
in
the
areas
that
were
troubling
city
city
attorneys
report
indicates
that
there
were
improvements
that
some
substantial,
some
not
so
substantial,
but
improvements.
AA
AA
I,
don't
want
to
keep
revisiting
this
over
and
over
again,
but
I
I
think
this
served
a
useful,
useful
purpose
and
will
continue
to
serve
a
useful
purpose,
because
we
know
what
the
the
range
of
Good
Conduct
should
be,
and
we
know
what
should
what
is
outside
the
bounds
of
of
Good
Conduct.
So
at
least
we
are
all
familiar
with
this
and
we
all
have
an
obligation
to
stay
with
certain
rules
and
regulations.
If
we
all
have
to
be
a
collaborative
group,
we
you
know
many
people
pointed
it
out.
AA
We
we
all
need
to
work
together
and
believe
me,
in
spite
of
all
the
things
that
you
have
heard,
we
have
accomplished
a
lot
in
the
last
nine
months
and
I
think
we
should
all
feel
good
about
that.
So,
having
said
that,
I
accept
the
city,
attorney's
recommendations
and
his
observations
that
you
know.
While
there
hasn't
been
total
and
complete
Improvement,
there
has
been.
You
know,
relatively
positive
steps
that
we
as
a
council
and
staff,
and
the
public
have
all
taken
so
I
feel
hopeful
about
that.
D
D
I'm
particularly
disappointed
by
the
continuing
apparent
desire
on
the
part
of
council
member
Chao
to
defend
her
actions,
rather
than
accept
that
there's
a
real
report
written
by
a
real
professional
that
found
real
problems
in
the
city,
we've
enacted
changes
in
order
to
try
to
address
that
those
enactments
caused
better
things
to
happen.
That's
the
the
Crux
of
what
the
city
of
attorneys
report
today
is
about.
D
B
So
one
more
comment,
I
like
to
say,
is
I
I,
really
feel
there
was
a
heavy
personal
attack
on
Linda,
Dobby
and
I
was
not
comfortable
hearing.
It
I
do
believe
that
Linda
is
a
professional
and
she
does
the
best
practice
to
provide
a
report
to
us
and
I
I
feel
really
bad
about
a
comment.
So
I
apologize
on
behalf
of
a
council
and
that's
why,
when
I
say
professional
advice
hasn't
really
been
observed,
but
that's
okay,
because
city
of
attorney
Jensen
said
nobody's
perfect.
B
We're
not
perfect
I'm,
not
perfect,
so
I'm
willing
to
really
like
recommended
by
a
lot
of
people.
Let's
move
on
and
really
work
on
the
same.
You
know
same
platform,
so
I
do
believe
that
we
do
need
some
more
training
together.
Maybe
some
Team
Building
Together
learn
the
rules
of
running
meetings
and
I.
B
So
I
would
hope
that
we
could
move
on,
but
we
agree
to
train
be
trained
together,
have
something
building
and
really
make
sure
our
council
is
representing
of
all
residents
and
move
on
and
I
am
willing
to
move
on.
Okay,
even
without
a
petition,
I
read
the
report.
I
was
ready
to
move
on
anyway,
very
disappointed
that
council,
member
Moore
wasn't
even
Auto,
I,
hope,
she's
listening
and
councilmember
child
left
board.
That's
what
the
deja
vu
really
hit
me.
Okay
and
I
want
to
tell
you.
B
It
was
very
difficult
in
May
for
me
to
make
that
decision,
but
I
felt
I
did
not
have
Collective
or
collaborative
council
members
on
the
dials
and
I
just
failed.
The
deja
vu,
but
I
am
willing
to
move
on,
but
with
the
condition
that
we
Trend
and
work
together.
We
need
to
have
professional
trainers
to
really
you
know,
put
us
in
the
same
room
and
then
we
can
really
have
some
team
building
and
set
up
some
ground
rules
so
that
we
can
really
take
care
of
our
city
business
and
represent
all
our
residents.
Well,.
D
Here's
what
I
was
going
to
suggest
as
a
a
compromise
given
what
we
witnessed
today
and
what
is
in
the
report
and
what
you
would
like
to
achieve
with
regard
to
conditioning
the
return
of
commissions
is
that
we
would
engage
in
the
additional
training
as
a
condition
of
having
engaged
in
that
additional
training
that,
when
we
do
the
council
reorganization
in
December,
which
would
be
the
natural
point
at
which
we
would
make
new
committee
assignments
anyway,
that
every
single
city
council
member,
is
then
considered
for
committee
assignments
as
normal.
B
Yeah,
as
a
city
manager
question,
how
soon
can
we
arrange
a
five
week
of
five
council
members,
be,
you
know,
learn
together
to
not
just
the
team
building,
but
also
the
the
rules
of
outrun
meetings
and
things
like
that.
E
So
through
the
mayor,
we
had
a
workshop,
scheduled
tentatively
in
August
to
provide
governance,
training
and
potentially
to
tap
into
Rosenberg
and
also
effective
use
of
the
meeting.
We
could
I
mean
with
September
being
a
little
heavy
because
we're
all
going
to
a
conference
in
mid-september.
We
could
probably
arrange
the
meeting
based
on
everyone's
availability,
late,
September,
early
October,
but
then
again,
pending
on
everyone
else's
availability,
as
well
as
the
facilitator's
ability.
B
AA
AD
AA
Yeah,
let
me
make
a
small
comment.
Sure
I
am
in
favor
of
restoring
the
the
committee
assignments.
However,
I
also
wanted
to
look
at
the
practicality
of
it
where
in
September,
many
of
these
meetings
don't
happen
once
a
quarter.
So
I'm
not
sure
there
are
that
many
meetings
left
between
now
and
December
in
January.
We
all
have
to
we
all
get
new
assignments
to
committees.
So
does
it
make
sense,
just
in
Practical
terms
to
wait
till
January
or
December
when
we
make
these
reassignments
to
committees.
AD
B
B
A
A
A
A
A
D
AD
B
B
But
if
the
training
and
doesn't
happen
that
we
that's
I,
don't
know
how
to
avoid
how
to
say
it.
That's
it's
a
condition
that
that
has
to
happen,
but
we
don't
wait
until
December
say
if
we
have
our
meeting,
have
our
training
right
away
in
October,
then
after
the
training,
let's
we're
going
to
restore
all
the
Committees
right
away.
B
D
I
would
I
would
decline
that,
if
only
because
I
think
that
one
it's
not
particularly
practicable
first,
because
of
how
soon
we
would
be
back
at
reorganization
in
December
anyway,
as
the
vice
mayor
mentioned,
we
wind
up.
You
know
with
very
few
of
these
meetings
left
between
now
and
the
end
of
the
year.
D
B
Okay,
so
how
about
this
I
didn't
give
up?
Okay?
How
about
this
that
number
one
that
we
all
attend
number
two!
As
soon
as
we
attended,
we
restored
it,
whether
it's
November
October,
because
if
we
can
arrange
it
fast,
they
still
have
a
couple
of
meetings
that
they
could
attend,
and
so
I
would
like
them
to
have
that
as
soon
as.
B
AA
So
can
we
say
that
the
council
is
this,
like
a
can
I
just
that
Council
adopt
the
staff
recommendation
of
the
following
changes
that
all
five
council
members
attend:
additional
training
on
all
the
stuff,
Council
governance,
rosenberg's
rules
of
orders
and
the
topic
of
effective
collaboration
between
staff
and
council
members
and
among
Council
and
staff
and
council
members
and
among
council
members
before
December
23,
and
then
not
say
that
as
a
condition
of
successfully
just
say
that
all
restoration
of
council
committee
assignments
be
considered
as
part
of
the
annual
appointment
of
council
members.
D
D
Sure
maybe.
D
A
AA
AH
Either
vice
mayor
Mo
Hunter,
the
clerk
read
the
motion
for
the
recruit
okay.
C
B
Okay
may
I:
may
we
invite
the
council
members
back
because
we
do
have
one
more
item
to
go
through,
which
is
number
and
I
will
ask
for
Council
extension
or
not.
AH
We
have
we
could
we
we
can
start.
We
have
six
minutes
to
start
the
next
item.
We
would
need
to
have
a
vote
to
extend
the
meeting
past
11
o'clock.
Okay,.
B
B
AH
So
we're
we're
here
today
for
this
item
to
consider
updates
to
the
Cupertino
city
council
procedures
manual,
you'll
recall
on
February
7th
2023.
The
city
council
adopted
a
resolution
approving
the
city
council
procedures
manual,
the
adoption
of
the
procedures
manual
addressed
and
identified
deficiency
in
the
city's
governance
policies,
and
the
manual
includes
rules
and
guidelines
for
communication
among
Council
and
staff,
meeting
management,
decorum
and
and
decision
making,
among
other
things,
as
part
of
the
resolution,
the
city
council
is
part
of
the
motion.
AH
The
city
council
directed
The
City
attorney
to
return
to
council
to
consider
potential
revisions
to
the
manual
in
six
months.
Moss
Adams
discussed
the
manual
in
its
report
today.
The
Enterprise
leadership
assessment
notes
that
the
manual
is
in
alignment
with
best
practices
and
characterizes
the
adoption
of
manuals,
positive
progress
towards
increasing
the
effectiveness
of
City
Council
meetings.
AH
Consistent
with
this
observation,
their
the
average
length
of
meetings
has
decreased
slightly
from
5.5
hours
into
calendar
year,
2022
to
5.2
hours
in
calendar
year
2023
and
more
significantly,
the
total
number
of
meetings
has
been
cut.
AH
Almost
in
half
in
the
period
from
January
through
August
20
to
22
versus
this
year,
total
meeting
time
was
reduced
by
approximately
one-third
factors
contributing
to
this
more
effective
functioning
of
the
council
include
the
efficient
use
of
the
newly
adopted
informational
calendar
for
items
that
don't
require
Council
action,
more
effective
Council
deliberations
and
an
increased
focus
on
council's
policy
making
responsibilities,
and
the
Enterprise
leadership
assessment
also
observes
that
interviewed
staff
noted
that
the
procedure
manuals
were
welcome.
Improvement.
AH
However,
you
know
there
are
con.
There
do
continue
to
be
challenges
in
in
in
implementing
the
manual
and
it
does
depend
on
whether
city
council
adheres
to
the
practices
in
the
manual
consistently
and
willingly.
AH
With
that
I,
we,
the
staff
report,
does
discuss
some
potential
revisions
to
the
manual
based
on
the
experience
of
working
with
it,
since
it
was
adopted
in
February.
The
these
These
are
are
summarized
on
this
slide
here:
potential
revisions
to
section
four,
to
clarify,
clarify
the
distinction
between
and
and
naming
conventions
for,
advisory
bodies.
This
is
a
recommendation
from
the
Moss
Adams
report,
revised
section
5.6
to
incorporate
additional
training
requirements
again.
AH
This
is
this
is
consistent
with
the
Moss
Adams
report
and
could
be
considered
as
a
separate
policy,
rather
than
an
amendment
to
the
the
procedures
manual,
potential
revision
to
section
8.2,
to
revise
the
rules
of
order
to
improve
the
effect
of
efficiency
of
of
council
deliberations.
Council
has
adopted
Rosenberg
Rules
of
Order,
but
but
it
is
free
to
modify
those
to
increase
the
efficiency
of
meetings
if
it
so
chooses
to
help
this
particular
body
function
more
efficiently.
AH
Another
potential
change
would
be
to
revise
section
8.3,
which
would
just
simply
formalize
the
adopted
practice
of
providing
written
reports
of
council
activities
that
that
seems
to
to
to
have
worked
well,
and
we
we
could
make
sure
that
that's
clear
in
the
rules
and
and
finally
potential
revisions
to
section
8.4
to
develop
more
detailed
procedures
for
shortening
and
consolidating
time
and
consider
adopting
overall
time
limits
for
comments
by
individual
speakers.
AH
AH
So
the
city
attorney's
office
seeks
Direction
on
potential
Provisions
to
this
this
manual
today,
we'll
return
to
council
with
for
approval
of
any
revisions
consistent
with
Council
Direction,
with
that
I
will
be
available
for
questions.
Thank.
B
You
CD
attorney.
Thank
you.
Cd
attorney
Jensen
questions
from
the
council.
Can
you
keep
that
so
the
recommendation,
the
yeah?
Thank
you.
B
If
not
I
have
a
question.
General
question
is
even
when
we
have
the
council
procedures
manual
passed.
If
three
council
members
decide
to
change
it,
we
can
still
change
it.
Yes,
correct,
okay
and
then
I
didn't
know
that
the
rule
of
we
can
also
change
the
rule,
as
we
think
seek
fit,
even
with
the
robbers
rules
that
we
adopt.
We
can
still
put
it
in.
AH
Yes,
council
is
free
to
drop
his
own
rules
of
procedures.
Rosenberg's
rules
is
is,
and
Robert's
rules
are
the
two
models
that
that
are
models
that
are
commonly
used,
It's,
Not
Unusual
for
for
governing
bodies
to
have
modifications
to
the
default
rules
of
procedures
and
consistent
with
the
Moss
Adams
presentation.
You
know
you
would
want
to
adopt
something
that
works
for
this
specific
body
which
might
be
different
than
what
works
for
other
understand.
B
C
F
F
This
is
what
Nancy
Skinner
did
in
a
b
330,
where
they
tried
to
limit
the
public
asking
questions
about
environmental
impacts
on
building.
This
is
what
okay.
This
is
what
the
public
is
dealing
with.
This
is
what
our
life
has
become
from
the
last
five
years
of
the
bills
and
I'm
not
going
to
be
shut
up.
I
will
tell
you
that
the
Fremont
Unified
School
District
was
very
gracious.
The
two
times
I
was
there.
In
the
last
two
weeks,
I
had
a
full
three
minutes.
They
listened
courtesy
to
my
questions.
They
asked
questions.
F
F
I
haven't
seen
that
here,
I'm
waiting,
I'm
waiting
to
be
impressed.
Therefore,
I
sit
on
my
rear
end
in
those
uncomfortable
chairs
for
hours
on
end,
yes,
they're
uncomfortable,
but
that's
why
we're
here
and
I
will
tell
you
right
now.
If
somebody
wants
to
come
and
sit
in
the
chairs
with
me,
be
my
guest
but
I
am
not
having
it.
I
am
not
going
to
feel
guilty
because
someone
stays
at
home
playing
video
games
or
maybe
going
out
to
dinner
that
that
they
can't
come
I'm.
F
F
I
I
there
are
times
when
you
remember
there
are
family
situations,
but
to
me
things
are
so
grave
and
dim
in
this
state
right
now
that
the
public
is
being
stressed
to
the
breaking
point
and
I
will
tell
you,
everything
that
is
happening
in
this
state
is
happening
at
the
federal
level
and
it's
not
Mr
Trump
there.
There
are
forces
that
are
trying
to
take
down
the
state
as
well
as
the
Federal
I
I.
So
that's
why
we
come
here.
C
S
Good
evening
again,
Council
and
staff,
you
have
reduced
the
Public's
ability
to
speak
through
the
use
of
informational
calendar,
no
mention
or
discussion
allowed,
except
during
oral
communication.
The
inability
for
the
public
to
pull
consent
items
packing
the
consent
calendar
with
multiple
issues.
The
public
wants
to
discuss,
making
them
undiscussable
because
they
can't
be
pulled
forcing
the
public
to
combine
all
their
comments
from
multiple
consent
items
into
one
comment:
period:
Changing,
Times
and
days
of
Council
meetings,
making
it
harder
for
working
people
to
attend
and
moving
regular
meetings
to
another
day.
S
So
they
become
special
meetings
with
no
oral
Communications.
These
have
significantly
reduced
overall
public
participation.
You
do
not
need
to
do
more.
Instead,
I
suggest
the
following
changes
to
the
manual
consolidation
of
time
between
speakers
known
as
seeding
time.
Allow
speakers
to
only
speak
once
with
all
seated
time
being
contiguous
with
their
own
time.
S
Do
not
allow
speakers
to
speak
two
different
times
on
a
single
agenda
item
for
combining
speaker
times,
remove
the
requirement
for
the
need
for
five
people
and
allow
any
number
up
to
a
maximum
of
five
always
explain
the
rules
for
consolidating
time.
At
the
beginning
of
a
Hot
Topic
and
with
multiple
Hot
Topics
schedule
them
out,
even
if
it
takes
multiple
meetings,
foreign
detailed
training
on
rosensburg's
rules
and
the
brown
act
for
both
Council
and
staff.
S
C

AJ

an

meetings
to
discuss
for
hours
each
instance
of
infraction
or
lack
of
good
faith
in
deciding
the
consequence.
Each
time
the
council
needs
to
make
the
enforcement
process
automatic
and
clear,
then
the
consequences
of
infractions
or
refusals
will
be
clear
to
awe
beforehand
and
efficient
in
the
running
of
city
and
city
council
business.
AJ

If
you
think
that
is
the
new
transparency
I
I'm
at
issue
with
that
we
need
transparency.
We
need
a
voice
and
I'm
I'm
actually
really
disappointed
that
it
would
even
be
suggested.
This
came
up
last
time
six
months
ago,
and
you
chose
not
to
do
this
limit
of
10
minutes
each
or
whatever
it
is.
It
might
turn
out
to
be
after
deliberation.
I
just
think
it's
a
wholeheartedly.
It's
very
wrong
thing
to
do
for
so
many
different
reasons
and
Peggy
mentioned
many
of
them
and
I
think
you
all
know
better.
X
X
It
seems
that
there
is
some
proposed
changes
to
the
manual,
but
I
saw
the
summary,
but
there
wasn't
any
red
lines
so
and
I
didn't
have
time
to
compare
the
old
with
a
new,
so
it'd
be
really
helpful
to
the
public
when
changes
are
proposed
that
we
can
see
exactly
what
they
were,
and
that
said,
I
hope
that
you
I've
made
this
suggestion
before
I'm,
going
to
make
it
again
and
I
I
hope
that
you
can
consider
doing
an
anatomy
of
Peace
training,
in
addition
to
the
other
things
that
you're
talking
about
it's
a
very,
very
sad
day
for
the
residents
of
Cupertino
today
and
I
hope
you
make
the
right
decisions
on
this
item.
C
AG
Hi
good
evening
again,
city,
council,
members
and
mayor
way,
I'm
speaking
again
on
behalf
of
bowling
myself,
the
new
council
member
procedures
put
in
place
earlier
this
year
had
made
a
significant
difference,
with
meetings
being
run
much
more
efficiently
and
respecting
the
time
and
opinion
and
work
of
all
participants,
and
that
includes
our
includes
residents
and
staff.
AG
Like
all
processes,
a
bit
of
refinement
can
be
necessary
once
the
major
changes
are
in
place,
I'd
like
to
suggest
one
change,
which
would
help
us
move
forward
towards
meetings
that
are
as
City
attorney
Jensen,
as
stated
quote
a
forum
for
carrying
out
the
council's
function
as
a
decision-making
governing
body,
meaning
you
guys
are
not
there
just
to
listen
to
us
talk
all
evening.
It's
for
you
to
make
decisions.
AG
AG
You
know
if
a
specific
council
member
gets
more
time,
but
it
allows
the
entire
Council
to
determine
if
debate
should
continue.
Instead
of
only
one
person,
it
also
keeps
the
meeting
running
in
efficient
and
business-like
manner,
with
residents
able
to
gauge
how
long
each
agenda
item
will
take.
That
means
it's
much
more
likely
that
residents
will
be
able
to
speak
during
public
comment,
because
we
will
know
when
the
agina
item
is
actually
going
to
happen.
Excuse
me
I.
AG
Y
Hello
city
council
I
would
like
to
ask
that
you
provide
input
that
this
change
to
the
procedures
manual
be
tabled
and
no
action
be
considered.
I
would
like
to
ask
that
you
please
keep
in
mind
that
the
public
is
the
top
of
the
ox
chart.
You
work
for
the
public,
City
staff
work
for
you
and
therefore
the
unelected
officials
suggesting
changes
and
being
accepted
by
a
council
that
is
on
diets
with
just
three
members
with
two
off
the
stage.
Y
I
would
actually
ask
that
you
consider
postponing
the
rest
of
the
agenda
in
deference
to
the
citizens
of
Cupertino
that
are
unrepresented
on
their
dice.
The
three
of
you
do
not
represent
the
100
view
of
the
residents
of
Cupertino
and
to
act
in
providing
input
on
this
topic
that
takes
away
public
input.
Time
is
doing
a
disservice
to
how
democracy
is
supposed
to
work.
Y
I
would
also
respectfully
remind
you
that
efficiency
is
measured
in
hours,
not
minutes.
These
procedure
manual
changes,
look
to
save
minutes
of
the
time
spent
on
diets
when,
in
fact,
this
whole
agenda
could
have
been
killed.
You
would
save
hours
of
meeting
time
if
you
did
not
have
this
agenda
when
you
overrule
the
Planning
Commission
and
spend
hours
discussing
LED
signage
on
280,
that
was
inefficiency.
Y
Y
In
fact,
the
legacy
of
this
mayor
and
this
term
of
the
council
will
probably
be
that
you
majored
in
minor
things
and
minor
in
major
things.
20
years
from
now,
who
will
look
back
on
this
Council
and
say?
What
did
you
give
us?
Did
you
give
us
some
new
trails?
Did
he
give
us
new
parks?
Did
he
do
any
major
projects
that
will
stand
the
test
of
time
20
30
years
from
now?
Y
AD
B
You
very
much
mother
city
clerk
I'm,
going
to
close
the
public
comment
and
come
bring
back
to
the
council
for
deliberation
and
discussions.
So
I'm
going
to
start
by
asking
a
question.
If
my
memory
serves
me
correctly,
I
was
very
reluctant
to
get
to
time
minutes.
This
wasn't
an
invention
of
this
Council
I.
B
Think
even
Council
mayor
Paul
had
minutes
to,
and
he
always
counted
minutes,
and
the
only
thing
he
allows
is
we
can
give
minutes
to
to
other
council
members
did
I
remember
correctly
that
he
did
have
a
time
limit
for
each
council,
member,
okay,
so
I
I
hope
that
another
being
said
that
mayor
Wade,
like
invented
this
many
things
so
I
just
want
to
make
it
clear.
Actually
I
was
very
alert
reluctant
to
be
the
timer,
so
I'm
going
to
have
council
member
more
first
and
then
follow
by
council
member
Chao.
AC
Okay,
thank
you
mayor
way.
One
change
that
we
did
have
was
that
deliberations
could
be
ended
by
a
majority.
AC
Okay,
so
I
I.
There
were
a
couple
of
items
that
I
would
like
to
have
some
more
clarification
on
within
this
policy.
One
is
item
5.5
regarding
travel,
I,
think
it's
just
a
matter
that
would
need
some
more
clarification.
AC
I
was
appointed
through
Cal
cities
for
the
third
year
in
a
row
to
be
on
their
Environmental
Quality
policy
committee,
which,
because
of
the
pandemic,
didn't
meet
in
person
and
in
the
final
meeting
this
year
they
met
down
and
Pomona
and
I
attended
that
one
at
my
own
expense.
So
I
would
like
to
clarify
in
the
language
as
to
these
outside
committees,
because
they
are
not
Council.
AC
Appointments
to
have
Council
make
a
decision
on
or
to
as
far
as
I
understand,
to
have
a
council
member
removed
from
so
this
first
one
item
5.7
that
was
regarding
the
the
manager's
budget
that
one
needs
some
clarification
because
of
the
document
that
they're
referencing
and
I've
mentioned
this.
In
the
past,
so
if
somebody
would
from
staff,
would
look
into
that
item
6.6
it
to
me,
it's.
AC
You
know
critically
important
that
council
members
have
access
to
information
and
I
made
some
a
couple
of
requests
this
year
and
I
was
denied
that
information
based
on
staff
workload
in
a
decision
by
the
the
city
manager.
So
those
the
the
reasons
are
no
longer
there.
The
schedule
conflicts
are
no
longer
there.
AC
So
I'd
like
to
understand
when,
when
the
the
block
from
getting
information
ends-
and
you
know,
I
appreciate
members
of
the
public
that
have
told
me
if
you,
if
you
need
information,
just
ask
me,
I'll,
ask
the
city
and
I
think
that
that's
one
of
the
Hallmarks
of
when
you
have
poor
law
laws,
poor
that
are
too
restrictive,
then
people
start
going
around
them
and
that's
what
that's
what
I
was
noticing
is
people
were
trying
to
to
help
me
to
get
around
them,
which
isn't
what
the
intention
is
item
8.5.
AC
It
seemed
that
at
the
July
18th
meeting
agenda
item
on
SB
403
that
we
had
a
brown
act,
violation
where
members
of
the
public
had
turned
in
their
speaker
cards
and
if
they
were
on
Zoom,
they
raised
their
hands
and
weren't
allowed
to
speak
and
the
total
amount
of
time
was
limited
for
people
to
speak.
And
then
the
amount
of
time
for
each
individual
was
limited.
Such
that
you
had
a
number
of
people
who
who
weren't
weren't
allowed
to
speak
and
I
would
like
to
understand.
If
that
is
a
a
brown
act.
AC
Violation
and
I'd,
like
some
clarity
regarding
the
municipal
code
regarding
Municipal
Code
2.08.090c
states
that
the
city
council's
discretion
is
to
establish
time
limits
for
discussion.
But
in
this
particular
agenda
item,
which
is
item
13
from
July
18th.
AC
The
the
mayor
unilaterally
made
that
decision
to
shorten
the
time
and
then
the
the
total
time
allowed
and
then
the
individual
time.
So
it
would
seem
that
it's
the
spirit
of
the
brown
act
to
allow
members
of
the
public
who
are
following
the
rules
for
public
comment
that
they
would
be
allowed
to
speak
and
not
have
certain
people
disallowed.
AC
So
I
would
like
to
have
that
clarified,
also
with
regards
to
and
I
just
sent
an
email
to
the
city
clerk
with
regards
to
the
to
any
violations
enforcement
of
the
rules
I
sent
from
the
city
of
Los
Altos,
their
accountability
policy
for
the
Los
Altos
City
Council.
In
fact,
the
removal
from
committee
assignments
is
a
resolution
done
by
resolution
of
censure
in
Los
Altos
and
they
have
other
levels
of
of
enforcement
and
Punishment.
AC
If
you
were,
if
you
will
so,
they
have
informal
admonition,
formal
admonition
or
Accenture
public
hearing,
and
then
they
have
their
disciplinary
action
with
a
formal
admonition
or
resolution
of
censure.
So
there's
a
whole
process
that
you
go
through
so
I
mentioned
about
due
process.
We
need
to
have
a
set
of
rules
for
that.
That
would
be
followed
so
that
we
don't
simply
have
a
council
majority
that
says
Hey
I
want
to
yank
them
off
their
assignments.
I
I
I'll
take
whatever
was
said
here
and
I'll
use
it
to
my
advantage.
Thank
you.
AH
AD
B
AB
So
oh
I
can,
okay,
so
for
I.
Have
a
question
on
6.6
council
member
access
to
information.
AB
The
current
procedure
I
want
to
have
a
question
about
compliance
with
this.
It
says
the
city
manager
shall
ensure
such
information
is
communicated
by
staff
in
full
and
with
Candor
to
console,
and
the
staff
will
make
every
effort
in
response
in
a
timely
and
professional
manner,
to
all
requests
made
by
individual
council
members
for
information
assistance
provided
that
in
the
Judgment
of
city
manager.
The
request
is
not
of
a
significant
magnitude,
either
in
terms
of
workload
or
policy.
AB
Don't
think
this
is
being
carried
out
because
information
requests
made
by
other
council
members
I'm
not
aware
of
I,
would
like
us
to
follow
this
procedure.
Put
it
on
the
agenda,
maybe
as
information
item.
That
here
is
the
information
request
and
here's.
The
is
the
justification
that
it
couldn't
be
fulfilled
due
to
workload
that
information
the
public
should
be
have
access
to
and
the
other
council
members
should
have
access
to
following
the
procedure
menu.
Thank
you
who
can
on
City
attorney
respond
to
that.
AH
Yeah
I
think
I
think
the
intent
was
to
be
the
give
the
full
Council
the
opportunity
to
weigh
in
whether
it
would
make
sense
to
have
staff
resources
directed
at
a
research
effort.
Certainly,
I
can
work
with
the
city
manager
on
how
to
effectively
Implement
that.
AB
E
To
remember,
if
I
may,
if
I
remember
correctly
earlier
during
the
year,
councilmember
Moore
wanted
to
talk
about
the
renter
tax
with
council's
Direction
and
also
discretion.
We
went
ahead
and
put
it
on
the
agenda
for
Council
to
decide
if
we
want
to
go
ahead.
I
think
that
fits
into
what
council
member
Chow
was
talking
about
in
terms
of
gathering
information
and
put
it
on
the
agenda
for
the
public
to
weigh
in
and
also
for
Council
to
consider.
In
addition,
there
were
a
lot
of
conversations
centered
around
SP,
403
and
SB
423.
AB
To
weigh
in
summer
is
my
time
so
I'd
like
to
reclaim
my
time.
That's
not
on
that
response
does
not
comply
with
this
item.
The
what
you
mentioned.
The
word
agenda
item,
requests
that
the
council
decides
if
we
want
to
schedule
time
for
that
agenda
item
here.
This
item
is
regarding
information
request.
AB
One
example
is
the
request
for
senior
center
Budget
on
specifically
on
I,
think
on
Bingo
and
some
501c
organization,
that's
receiving
city
funding
and
fee
waivers
and
that
information
I
believe
it
was
rejected,
but
it
should
have
been
put
on
the
agenda
for
the
full
Council
to
decide
and
for
the
public
to
to
provide
input
if
they
want
the
same
information.
Thank
you.
AH
Yeah
I
mean
I,
think
I,
think
the
city,
the
city
manager
and
the
mayor
obviously
controlled.
The
final
agenda
and
I
mean
an
exercising
control
over
the
final
agenda.
I
mean
I
think
they
would
consider
whether
that
kind
of
request
is
is
something
that
Council
should
really
be
considered.
Considering
or
whether
that's
you
know
an
illegal
interference
with
operational
functions
of
the
city,
yeah.
AB
D
So,
just
to
follow
up
on
the
the
last
set
of
comments,
I'd
encourage
staff
to
look
at
a
procedure,
that's
in
use
in
San
Jose
when
it
comes
to
requests
from
Individual,
council
members
or
groups
of
council
members
that
are
going
to
take
a
significant
amount
of
time
or
resources,
and
that
might
impact
the
work
plan.
It
goes
by
the
rather
unfortunate
name
of
the
early
consideration
response,
but
it
is
a
very
good
mechanism
for
trying
to
filter
this
sort
of
things
that
everyone
feels
like
staff
have
addressed
it.
Here's
a
response.
D
Maybe
we
need
more
clarity.
Maybe
it's
just
not
practicable
or
it's
going
to
take
some.
You
know
an
ungodly
amount
of
time
and
money
to
accomplish,
but
then
everyone
at
least
gets
gets
a
response
and
to
the
extent
that
we
need
to
alter
the
the
procedures
manual
to
reflect
the
decision
tree
first
to
get
there
and
then
this
procedure,
then
I
think
that's
probably
worthwhile.
D
The
other
thing
I
would
I
would
strongly
encourage
bridge
is
to
take
the
comments
of
Mrs
Sharon
rather
seriously,
with
respect
to
you
know,
rules
that
have
some
sort
of
operation
of
law.
In
order
to
help
the
chair
to
manage
time,
I
think
that
that
is
always
going
to
be
a
frustration
for
anybody
who's
sitting
there
and
it
would
be
helpful,
I
think
if
we
had
rules
that
were
designed
around
that
purpose,
so
that
you
you
don't
have
to
engage
an
enormous
amount
of
discretion.
D
Things
will
happen
for
you,
I
think
that
that's
a
wise
change.
The
last
thing
I
really
wanted
to
bring
up,
is
you
know
again
taking
from
the
San
Jose
model?
It
is
a
very
large
city.
There
are
not
many
procedures
that
I
would
consider
adopting
here
from
there,
but
this
other
one
that
I
do
think
is
very
helpful,
might
help
all
of
council
when
it
comes
to
constructing
motions
in
the
city
of
San
Jose.
There
is
a
very
useful
colleagues
memo
system.
D
It
is
designed
around
you
being
able
to
within
either
yourself
or
a
brown
act
group
propose
a
particular
Motion
in
advance
with
the
justification
following
it
that
can
be
circulated
with
the
agenda
packet
or
immediately
thereafter,
even
before
the
actual
date
of
the
council
meeting
I've
found
that
at
least
for
that
City
it
is
an
extremely
productive
use
of
time.
It
means
that
everyone
has
a
fairly
well
crystallized
idea
of
what
they're
trying
to
achieve,
rather
than
having
to
try
to
construct
on
the
Deus.

AD
Okay,
any
second,
okay,
second
by
so
let's
vote
by
like
please.
AD
B
Thank
you
so
you've
finished
your
comment,
so
I
think
council,
member
vice
mayor
child,
used
to
have
your
minutes
and
I
have
four
minutes
I,
so
so
I'm
gonna
say
can
see
attorney
Jensen.
You
got
some
comments
from
us.
Do
you
think
you
can
you
have
enough?
So
you
can
come
back
with
recommendations.
B
AH
I
can
certainly
take
into
to
account
the
comments.
I
would
also
appreciate
feedback
and,
and
perhaps
a
vote
on
Council
on
the
changes
that
were
discussed
in
this.
The
staff
reported
in
the
presentation.
B
All
right,
councilman
Richard,
you
have
the.
AB
Okay,
I'd
like
to
make
a
motion:
you
want
to
make
motion.
Okay,.
AB
Like
to
motion
to
table
it,
this
item
for
another
six
and
a
month
to
come
back
and
because
we
are
still
implementing
the
current
one
and
the
recommendation
from
the
city
attorney
I,
don't
think
they
are
essential
and
they
are
still
vague.
AB
Let's
just
do
our
best
I
think
the
current
menu
and
we're
putting
a
good
effort
in
that.
Let's
do
our
best
to
implement
that
and
smooth
out
the
wrinkles
and-
and
that's
not
not
spend
more
time
on
this
until
six
months
later.
Okay,
so.
AC
More
and
I
second
I
would
also
like
to
see
something
along
the
lines
of
that
Los
Altos
policy
perhaps
brought
back.
So
we
have
some
process.
AH
AC
B
Okay,
so
let's
vote
by
light.
C
Charles
motion
Chows
motion
passes
with
Freon
and
way
voting
no.
AH
Yeah
understood:
okay,
thank
you.
So
we
are
adjourned
by
rule.
Unless
Council
wants
to
vote
to
take
up
the
the
consent
calendar
item
that
was,
that
was
pulled
from
consent.
We.
B
Do
have
consent
unless
we
want
to
anybody,
want
a
motion
for
five
minutes.
We
took
over
the
calcium
calendar
number
two
I.
