Description
Coverage of the October 19, 2021 Cupertino City Council Teleconference Meeting.
(Live Streamed Version)
A
E
C
Thank
you
very
much
we're
going
to
go
on
to
our
ceremonial
matters
and
presentations.
C
C
C
As
item
number
two
item
number
one:
we
have
the
pleasure
of
recognizing
the
incorporator
of
cupertino
in
1955
and
he
has
been
in
florida
for
a
number
of
years
but
has
flown
across
the
country
to
visit
us
for
this
week,
and
so
I
would
like
to
present
to
you,
mr
boris
stanley,
who
is
95
years
young
today
and
he's
also
joined
by
isabelle
stanley,
his
his
wife,
and
so
we
are
on
item
number
one
presenting
a
proclamation
to
boris,
which
I
will
read
boris
come
on
over
welcome.
C
C
and
boris.
Here
is
your
proclamation
and
thank
you
for
everything
that
you
contributed
and
did
for
the
city
of
cupertino.
In
its
early
beginnings,
I
suppose
one
can
do
no
more
for
another
person
or
entity
than
closet
two
become
in
existence.
So
thank
you
very
much.
Well,.
C
But
there's
more,
we
actually,
we
actually
have
created
a
plaque
for
you,
boris
and
unfortunately
we
can't
get
all
those
words
into
a
plaque.
But
let
me
let
at
home
know
what
that
plaque
says.
It
says
the
city
of
cupertino,
boris
stanley
day
on
october,
19
2021
with
much
gratitude
for
your
role,
as
quote
midwife,
end
quote,
which
is
your
description
in
the
incorporation
of
the
city
of
cupertino
in
1955
from
the
city
of
cupertino.
F
First
of
all,
I
want
to
thank
the
council
and
you
for
your
guidance
in
this
situation
and
I'd
like
to
put
my
thoughts
as
to
the
function
of
approximation.
So
my
head
doesn't
get
too
big,
oh
sure,
when
the
the
city
of
cupertino
election
was
over,
there's
a
tendency
by
everybody
to
give
short
names
to
situations
and
one
of
those
that
cropped
up
with
what
you
just
mentioned.
F
That's
my
being
the
midwife
of
cupertino
and
actually
they
added
oftentimes
illegal
midwifer
cafeteria,
and
it
turned
to
be
prophetic
because
the
object
of
a
midwife
is
to
make
the
delivery
get
the
birth
and
normally
not
much
credit
after
it's
over
and
oftentimes
forgotten.
F
That
similarly
happened
here,
the
corporation
for
a
national
person.
The
gestation
period
is
nine
months.
For
somebody
like
this
corporation
event,
it
was
two
years
but
like
any
parent
knows,
that's
just
the
beginning,
and
it's
not.
Somebody
else
has
to
do
the
heavy
lifting
in
producing
an
adult
child
into
a
mature
grown
individual.
F
That
happened
here
now
we're
55
years
later,
and
we
have
a
city
council
with
his
predecessors,
who
did
some
of
the
heavy
lifting
the
proclamation
process
to
me
when
you
consider
that
you're
acknowledging
someone
who
is
an
individual,
not
much
leverage
and
a
city
council
that
is
the
head
of,
and
governance
of,
sixty
thousand
people
in
cupertino
is
a
disproportionate
thing,
but
actually
it
is
not.
F
What
you're
doing
really
is
one
of
the
principles
of
democracy
that
is
is
the
small
guy
has
a
chance
to
make
a
difference,
and
I
think
that
happened
here
and
I
happen
to
be,
incidentally
there
at
the
right
time,
perhaps
in
the
right
situation,
and
I
see
that
the
result
of
this
is
a
great
city.
You
took
us
on
a
tour,
I
can't
believe
what's
happened
and
we
end
up
with
something
that
has
a
fairly
sophisticated
city,
but
still
humble
and
not
chloe.
F
And
the
result,
I
think,
is
that
we're
demonstrating
democracy
at
work
and
I'd
like
to
think
that
every
time
there's
a
proclamation
that
the
council
or
whoever
is
the
government's
body
realizes
that
they
are
functioning
and
one
of
the
great
principles
of
democracy,
and
that
is
the
little
guy
can
be
heard.
F
So
as
a
consequence
of
what
you
guys
have
done
for
me
and
in
this
proclamation
I
have
a
lot
of
gratitude,
and
especially
since
I
was
prominent
before
election
day
into
oblivion,.
F
And
I
was
with
you
your
permission
to
have
somebody
else
to
add.
I
want
to
thank
the
council
again.
I
want
to
thank
you
and
your
guidance
and
this,
but
I'd
asked
whether
or
not
we
could
have
a
minute
or
so
if
somebody
had
a
question
of
me
that
they
had
that
they'd
like
to
answer
whether
it's
a
personal
or
just
inquisitive
or
sure,
or
even
if
they
have
some
disagreement
as
to
what
I've
said
or
what
we've
done.
C
Okay,
I
see
council
member
willie
has
his
hand
raised
councilmember
willie.
Do
you
have
a
question
of
mr
stanley.
H
H
F
Well,
that's
why
I'm
glad
you're
the
city
councilman,
that's
a
that's
a
heck
of
a
question
pretty
all-inclusive.
I
suppose
that's
one
reason
you
were
elected
because
you
seem
to
have
the
talent
of
john
of
deciding
things.
Having
situations
come
before
you
that
you
have
to
pass
on
what
the
mechanics
are
of
making
those
decisions
are
they're,
mostly
instinctive,
also
a
product
of
your
experience,
also
the
objectives
that
you
think
might
be
accomplished
by
what
you
face,
the
all
the
things
that
are
acquired
when,
when
there's
leadership
involved.
A
F
C
Great,
thank
you
so
much
and
isabel.
Would
you
like
to
come
up
and
say
hi
to
everyone
before
john?
Did
you
get.
H
I
yes,
when
we
talk,
yes,
I
haven't
had
a
chance
yet,
but
yes
thank
you.
So
much
argue
about
it
later.
You.
I
Die
well,
I
want
to
say
hello
and
of
course
doing
this
proclamation
for
my
husband
has
made
him
very,
very
happy,
and
we
thank
you
for
that
and
we
came
all
the
way.
I
don't
know
how
many
miles
it
is
I'll.
Ask
the
pilots
that
brought
us
from
florida
to
be
here
tonight
for
this,
but
we
came
a
long
way
and
we're
happy.
We
did
and
thank
you
very
much
thank.
C
You
boris
isabel,
thank
you
very
much
and
we
also
have
brad
and
dave
they're
pilots
in
the
in
the
plane.
C
And
but
but
I
will
say
if
any
members
of
the
public
are
interested
in
meeting
boris
and
isabel,
we
do
have
a
historical
society
event
happening
at
quinlan
center,
this
friday
at
7
p.m,
and
the
new
exhibit
that
they're
soft
unveiling
is
the
beginnings
of
cupertino
so
who
more
appropriate
to
be
there
than
boris
and
isabel.
So,
thank
you
very
much.
C
C
Is
there
okay?
Well,
let's
take
a
look,
see
how
we
I
see
that
jennifer
griffin
has
her
hand
raised,
and
so
let's
go
ahead
and
give
jennifer
some
time
to
speak
jennifer
welcome.
Did
you
want
to
speak
to
this
item.
J
Yes,
I
certainly
did.
Can
you
all
hear
me,
okay,.
J
Okay,
great,
thank
you
this.
What
an
honor!
I
am
so
pleased
that
that
you
all
were
able
to
come
out
from
florida
and
come
back
to
see
cupertino.
Now
we
love
our
city.
We
thank
you
so
much
for
taking
the
time
back
in
the
days
when
everything
was
orchard,
land
to
incorporate,
help
incorporate
cupertino,
and
we
will
do
everything
possible
to
make
sure
that
your
legacy
continues
in
our
beautiful
city,
because
we
adore
cupertino.
J
We
know
it's
lovely
history
and
we
are
so
proud
of
the
city
that
it's
become
and
it's
people
like
you
that
have
taken
you
and
your
lovely
wife
that
have
taken
the
time
to
make
sure
that
the
foundations
of
this
city
are
as
strong
and
wonderful
as
it
is
now.
Thank
you
so
much
what
a
delight
and
have
a
wonderful,
a
time
here
in
cupertino.
A
C
F
You
for
your
gracious
remarks,
there's
a
emotional
part
of
this
to
me,
because
I
had
a
disappointment
way
back
66
years
ago
and
a
little
sadness
that
from
the
efforts
of
me
and
others,
of
course,
but
in
this
particular
case
we're
talking
about
borah
stanley
on
proclamation
day,
and
it's
so
great
that
somehow
this
was
resurrected
and
I
appreciate
it
so
much
hey
everyone.
Let's
give.
A
C
Guys
say
hello
to
the
city
council:
we
must,
we
must
introduce
you
to
to
brad
and
dave
our
our
esteemed
pilots,
who
brought
isabelle
and
boris
here
all
the
way
across
the
country
come
on
guys,
come
on
in
wave
and
we'll
yeah.
Thank
you.
Thank
you.
Both
for
delivering
the
goods.
I
I
C
C
It
is
equally
an
honor
to
be
able
to
announce
that
the
city
of
cupertino
has
won
an
extremely
prestigious
award
statewide
and
here
to
present
it
we
have
our
peninsula
division
director
for
the
league
of
california.
Cities
welcome.
L
Well,
thank
you
so
much
what
a
treat
to
be
here
and
to
follow
that
really
motivating
and
adorable
sorry,
but
at
95.
If
that's
a
sign
of
what
city
government
can
do
for
your
cognition
and
your
passion,
I'm
sticking
with
city
government,
that's
a
fabulous
testament
to
those
guys.
So
I'm
pleased
to
be
here.
M
L
So
I
the
the
helen
putnam
award,
is
it's
just
a
lovely
thing,
it's
in
it's
in
line
with
what
I
think
is
is
happening
tonight,
which
is
celebrating
some
of
the
milestones
that
your
city
has
accomplished.
In
particular,
I
want
to
make
sure
that
I
recognize
council
members
mayor.
I
saw
you
in
sacramento
at
the
league
of
con
league
of
california
city's
event.
This
year
I
saw
council
member
moore
ling.
L
You
were
there
as
well
and
of
course,
councilmember
way,
who
is
now
part
of
the
peninsula
division,
executive
committee,
meaning
time
and
meetings
and
more
taxing
on
her
already
tight
schedule,
but
it's
a
way
of
participating
in
the
division
at
large.
So
thank
you
for
your
service.
I
have
a
brief
presentation.
This
shouldn't
be
more
than
about
a
minute
and
then
there's
a
30
second
video.
L
I
just
want
to
let
you
know
this
was
shared
with
2
000
local
electeds
around
the
state,
when
your
city
was
recognized
for
your
work
with
the
youth
commission
and
for
incorporating,
I
guess
it's
pizza
and
politics,
but
we'll
get
to
that.
Just
briefly,
let
me
share
my
screen
on
the
presentation,
which
is
the
helen
putnam
award.
L
This
is
this
program
that
our
officers
and
the
league
do
for
cities
around
the
state
to
continue
to
recognize
best
practices
and
to
improve
the
systems
we
we
engage.
Our
cities
with
these
are
the
current
members
of
the
peninsula
division
and
I'm
thrilled.
We
have
a
council
member
way
on
us
on
our
division
this
year
there
is
others
that
are
playing
roles,
active
roles,
council,
member
moore,
I
know
you're
on
a
pretty
serious
council,
a
task
force
right
now
and
others
are
contributing
in
other
ways
and
policy
committees.
L
But
the
work
is,
I'm
really
never
done,
but
let's
get
to
the
fun
part,
which
is
this
recognition
of
the
ruth
reeling
award.
I'm
going
to
play
a
short
video
here
and
it
really
is
only
30
seconds,
but
it's
really
fun
and
it
was
shared
with
the
entire
league
of
california
cities
at
annual
conference
this
year.
So
if
the
technology
works
and
the
screen
share
works,
we
should
be
in
business.
L
Congratulations,
you
have
given
voiced
to
young
people
and
given
voice
to
the
participatory
process
that
is
really
inspiring.
There
are
other
cities
around
the
state
that
saw
this
and
commented.
How
can
we
get
that
in
our
city?
So
you
may
get
some
inquiries.
I
just
want
to
give
another
30
seconds
on
what
the
helen
putnam
award
is.
Helen
putnam,
of
course,
was
elected
president
of
the
league,
california,
cities
in
1978.
L
L
This
award
is
established
in
1982
and
it's
sponsored
by
the
league
partners
and
it's
my
honor
to
award
the
city
of
cupertino
with
the
helen
putnam
award
on
behalf
of
the
league
of
california
cities.
So,
congratulations.
You
physically
have
the
award
there
into
your
city.
I
believe
good.
It
worked.
C
And
here
it
is,
thank
you,
seth,
wonderful,
directing
our
peninsula
division.
Thank
you
for
all
that
you
do
and
I
think
that
it's
also
very
fitting
that
we
have
as
well
the
first
teen
moderator
of
the
first
pizza
and
politics
here
tonight
to
provide
a
few
words.
C
But
I
would
also
like
to
symbolically
provide
this
award
to
our
former
teen
commissioner
and
a
person
that
I
recently
saw
because
she
won
a
crest
award
for
cupertino
recognized
as
extra
steps
taken,
and
I
realized
that
we
were
going
to
have
this
meeting
and
that
we
would
have
boris
here
so
hopefully
in
a
symbolic
transition
back
to
live
meetings
or
some
hybrid
form
we
can
bring.
You
live
kelly
tong,
so
welcome
kelly
and
here's
that
award
and
kelly's
proud
parents
are
here
as
well
to
tape
this.
N
N
N
I
am
proud
of
the
cupertino
saratoga
and
campbell
youth
and
teen
commissions
for
planning,
organizing
and
implementing
a
virtual
version
of
the
pizza
and
politics.
Despite
the
challenges
and
difficulties
presented
by
copenhagen,
pizza
and
politics
has
helped
teens
understand
the
importance
of
voting
in
the
diverse
political
viewpoints
of
different
candidates.
N
C
All
right,
thank
you
kelly
big
hand
for
all
the
teams
and
everyone
that
has
bookended
our
our
history.
We
have
such
hope
for
the
future
and
we're
able
to
honor
the
past,
and
so
we'll
go
ahead
and
put
this
to
balance
out
and
thanks
very
much
our
our
recognition
of
war
stanley
today
so
there's
the
helen
putnam
award
we'll
go
ahead
and
commence
with
the
rest
of
the
agenda
now
before.
C
Let
me
get
a
quick
adjustment
to
my
camera
here,
all
right
now
that
I
am
alone
in
the
office
and
able
to
comply
with
the
santa
clara
county
directives
I'll
take
off
the
mask,
madam
city
clerk.
Do
we
have
any
postponements
or
orders
of
the
day
to
report
out
today.
C
C
J
C
Hello,
I'm
sorry
siri
decided
to
talk
to
me
on
my
computer,
but
please
jennifer
feel
free.
I'm
sorry,
video.
If
we
can
reset
the
three
minutes
for
jennifer.
J
And
that
was
siri
all
right.
Welcome,
siri,
yes
hi!
This
is
jennifer
griffin.
I
am
just
so
inspired
to
see
one
of
the
gentlemen
and
his
wife,
who
were
here
at
the
founding
of
cupertino
and
with
the
putnam
award.
What
inspiration
for
our
youth,
our
future,
I
will
say
again.
I
am
so
convinced
that
the
cities
in
california
are
so
vitally
important
to
the
state
cities
were
here
before
california
became
a
state
in
1850.
J
They
were
here
with
the
there
were
cities
that
were
here
that
were
from
the
original
inhabitants
of
the
state.
Many
many
thousands
of
years
ago,
when
the
spanish
period
began,
mexico
period
began.
There
were
cities
that
had
been
established
and
that
have
transferred
into
california
and
have
become
part
of
the
united
states.
J
J
If
you
look
at
the
history
of
san
jose
and
the
cities
cannot
be,
what
do
you
call
that
the
new
term,
where
you're
trying
to
stamp
them
out
it
is
that's,
not
possible?
J
And
I
am
so
concerned
that
our
leadership
in
sacramento
and
even
in
washington
dc,
that
there
is
a
council
culture
for
our
cities,
and
I
am
more
adamant
too,
with
the
founders
of
our
city,
that
we
make
sure
that
cupertino
is
still
here
and
as
strong
and
vital
of
force.
200
years
from
now-
and
I
commit
the
rest
of
my
life
to
doing
that.
Thank
you
so
much.
C
O
Thank
you
and
thanks
for
the
proclamation
that
was
great,
because
I
don't
have
much
time
here
I
go,
so
I
have
a
question
that
came
up
recently
code
enforcement.
From
what
I
understand,
we
have
two
and
a
half
officers.
O
O
Another
thing
I
have
concerns
about
is
the
term
architectural
features
and
developments
commercial
development,
homes
too,
because
fireplaces
chimneys
go
into
that.
But
I
had
concerns
that
developers
take
advantage
of
that
term
and
the
fact
that
there's
very
little
enforcement-
if
they
don't
follow
the
rules-
and
there
are
specific
instances
of
that
kirsten-
has
some
pictures
of
some
at
main
street
if
she
wants
to
put
them
up
or
if
she
wants
to
share
them
with
you
later.
Oh
thanks
kirsten.
O
They're,
not
the
greatest
pictures
I'll
tell
you
now,
but
it's
hard
to
take
them.
They're
still
going
to
illustrate
my
point.
O
Well,
you
want
me
to
okay,
let
me
cure
some
while
you're
trying
to
do
that.
I'll
keep
going
and
another
thing
I
want
to
remind
everyone
or
inform
the
newer
people
is
if,
if
it's
going
to
be
insisted
on
using
the
term
community
benefit
in
the
future
in
any
document
or
any
negotiation,
despite
the
fact
that
this
buzzword
was
stricken
from
the
general
plan
years
ago,
it
just
needs
to
be
known
that
it's
very
important
to
include
the
entire
community
at
what
the
benefit
is
supposed
to
be
and
force
what
it
is.
O
C
O
M
Okay,
I
sent
in
some
slides
to
be
shared
during
my
presentation.
M
Okay,
perfect
so
hi
everyone,
my
name
is
tara
and
I'm
part
of
the
menstrual
equality
committee.
So
next
slide,
please
thank
you.
So,
just
a
little
bit
about
us
we're
a
group
of
six
seniors
who
currently
attend
cupertino
high
school
and
for
our
ap
government
class.
We
wanted
to
identify
a
problem
in
our
community
to
work
on
something
that
we've
noticed.
That
is
that
our
school
currently
provides
free
pads,
which
is
a
project
initiated
by
a
student
and
currently
continued
through
the
school
budget,
because
this
is
currently
a
cupertino
high
school
specific
program.
M
M
So
why
free
menstrual
products
we
believe
there
is
a
stigma
around
periods,
because
they're,
sometimes
labeled
as
unsanitary
or
shameful,
when
they're,
just
a
normal
part
of
female
anatomy.
Menstrual
products
are
also
also
become
extremely
costly,
as
they
are
a
necessary
monthly
exponential.
M
Okay,
so
first
we're
going
to
talk
about
ab367,
which
was
a
bill
that
was
recently
passed
and
what
our
group
did
to
promote
it.
So
ab367
is
a
bill
in
support
of
free
menstrual
products
in
public
schools
and
universities.
M
M
In
order
to
increase
the
accessibility
of
menstrual
products,
we
believe
it
is
important
to
reach
out
to
as
many
communities
as
possible.
One
possible
way
is
to
provide
menstrual
products
in
public
restrooms.
This
would
this
would
allow
us
allow
those
who
need
menstrual
products,
a
fixed
place
to
acquire
them
from
that
can
be
easily
obtained,
so
some
places
we
believe,
will
greatly
benefit
from
menstrual
products
are
restrooms
found
in
parks,
as
well
as
those
in
quinlan
community
center.
Another
potential
place
is
the
bathrooms
in
main
street,
which
are
privately
owned
by
sand
hill
construction.
M
M
We
have
a
solution
to
this
in
order
to
ensure
menstrual
products
are
secure.
There
are
a
variety
of
potential
dispensers.
One
possible
option
is
the
company
varigos
varigos
provides
touchless
dispensers
to
provide
menstrual
products
in
a
safe
and
sanitary
manner.
It
costs
three
hundred
dollars
per
machine
per
month,
which
covers
both
the
cost
of
maintenance
and
the
menstrual
product
supply.
M
We
hope
that
we've
struck
an
interest
in
you,
because
this
is
the
project
that
the
six
of
us
are
truly
passionate
about,
and
we
hope
you
consider
it.
Thank
you
for
your
time.
C
Tara
very
well
done.
It
was
really
an
honor
to
work
with
you
and
your
team
when
you
reached
out
to
council
and
councilmember
moore,
was
able
to
indicate
and
find
out
that
ab367
in
fact
was
in
front
of
the
governor
at
that
time
and
we
turned
over
a
very
quick
letter
from
my
office,
and
I
think
that
it's
just
such
an
exemplary
way
of
showing
that
the
system
really
works.
You
know
everything
I
think
is
converging
upon
this
point
from
this
meeting
up
to
this
time.
C
So
so,
thank
you
very
much
for
what
you
do.
We
will
certainly
keep
a
serious
effort
to
make
sure
that
this
implementation
is
very
successful
in
cupertino,
so
we'll
go
and
move
on
to
reports
by
council
and
staff
at
this
time.
Right
now,
we're
at
item
number
three
brief
reports
on
council
member
activities
and
brief
announcements.
C
So
this
will
be
announcements
of
anything
that
has
taken
place
of
note
since
our
october
5th
meeting
that
each
council
member
wishes
to
share
with
the
public,
we
have
approximately
a
minute
each
that's
one
minute
to
provide
some
of
those
updates.
Would
anyone
like
to
provide
those
updates?
First
on
our
city
council
I'll
go
buy
a
show
of
hands,
I
don't
see
any
hands
up
so
I'll,
go
ahead
and
call
council
member
way
who
has
her
hand
up
followed
by
vice
mayor
ciao,
councilman,
councilmember,
moore.
E
E
So
we
had
a
meeting
and
we
talked
about
how
do
we
educate
housing
options
to
our
residents
or
are
we
going
to
have
a
retreat
for
that,
and
then
we
all
attend
the
crest
award,
which
you
know
that
kind
of
automation
here
and
it's
really
a
wonderful
way
to
recognize
citizens
and
the
rolling
hills,
4-h
club,
I
think
council,
member
moore
and
councilmember
willie
and
we
attended
and
they're
really
a
bunch
of
really
great
kids
and
parents,
that's
in
our
community
diwali
and
we
meet
boris
and
isabelle
stanley.
P
Hi
so
last
thursday
the
cupertino
european
district
decided
to
close
three
schools
in
our
area,
regnert
meyerholz
and
john
muir,
and
then
they
will
expand
the
chinese
language
emerging
program
to
its
own
site
at
muir,
and
then
there
are
some
resident
inquiries
on
one
about
solar
panel.
Streamlining
and
the
city
already
has
an
online
process
to
apply
for
solar
panel
and
the
normal
turnaround.
Time
is
24
hours.
This
is
the
response
from
the
staff
and
then
the
sunlight
is
inquired
about
city
hall.
P
Seismic
study,
the
city,
actually
has
a
comprehensive
archive
of
the
past
consideration
of
the
civic
center.
Just
google
cooperatino.org
civic
center
you'll
find
the
archive
of
meetings
next
lehigh
cement
on
the
county
lawsuit
with
the
court
ruled
in
favor
of
the
county
by
sustaining
the
county.
Still
more.
That
means,
if
lehigh
will
require,
will
require
use,
permit
or
investing
determination
before
it
exports
aggregate
and
for
lehigh
information,
google
cooperatino.org
lehigh
summit.
H
Great
the
topics
I'd
like
to
briefly
cover
so
far
with
I
attended
the
homeless
jobs
program,
which
is
part
of
our
work
program,
which
was
between
staff
and
west
valley,
community
services,
and
let
the
community
know
that
they
have
reached
out
to
the
homeless.
They
are
hoping
to
have
two
homeless
people
on
that
work
program
by
mid
to
late
november,
great
also
attended,
as
councilman
way
said,
the
rolling
hills
50th
anniversary.
H
It
was
great
to
see
our
youth
run
a
meeting
similar
to
our
council
meetings
by
themselves
with
no
adult
interaction
needed.
It
was
great
50th
anniversary
4-h.
The
experiences
they're
giving
to
kids
hands-on
can't
be
over
estimated,
the
value
the
resident
that
talked
about
the
planning
items
of
privacy,
screening
deck
sizes,
the
architectural
features
I
agree
wholeheartedly.
We
need
to
study
those
make
sure
that
we
get
those
things
well
defined
so
that
they
don't
get
taken
advantage
of.
They
should
be
held
to
what
the
council
approves
and
that's
it.
H
Oh
and
I'll
just
say
that
for
the
crest
awards
I
got
to
present
the
kelly
tong
with
her
award
for
rising
star.
What
an
amazing
youth
great
so
I'll!
Leave
it
at
that
for
tonight,
but
thank
you.
Q
Okay
right,
thank
you.
So,
on
october
7th
I
did
attend
the
employee
service
awards
and
I
was
along
with
council,
council
member
willie
and
then
right
after
the
lunch
with
assembly
member
evan
lowe.
Q
There
was
something
mentioned
by
seth
miller
from
the
peninsula
division.
I
have
been
accepted
to
the
california
cities
aca
7
subcommittee
from
the
environmental
quality
policy
committee,
and
what
we're
going
to
be
doing
is
making
a
recommendation
to
the
league
of
california
cities
regarding
aca
7.
and
on
october
14th.
I
attended
the
vta
ribbon
cutting
ceremony
in
gilroy
for
the
rapid
568
line,
which
will
be
a
supplemental
route
substituting
for
or
in
addition
to
a
route
that
has
over
90
stops
between
gilroy
and
darydon.
Q
So
this
should
be
really
helpful
for
people
in
that
area
to
get
up
to
the
san
jose
area,
and,
let's
see,
I
also
attended
the
crest
awards,
the
4-h
50th
anniversary,
which
wonderful
events
and
also
the
diwali
festival
put
on
by
the
chamber
on
the
16th.
Thank
you.
C
Great,
thank
you
councilmember
moore,
so,
as
you
can
all
see
that
we've
had
a
very
full
docket
between
the
last
meeting
and
now.
In
fact,
there
were
a
couple
of
days
where
we
were
overlapping
and
it
was
really
nice
to
see
some
council
members
go
to
one
event
and
another
council
member
or
go
to
other
events.
C
So
what
I'll
add
to
that
is,
I
did
have
a
library,
joint
powers,
authority
meeting
where
I
represent
cupertino
on
the
district
that
that
manages
our
library
system
and
I'm
on
the
finance
committee.
There,
the
finances
for
the
library
system,
similar
to
our
city
they're,
looking
very
good
for
the
most
part,
and
I
would
say
that
one
notable
item
to
report
is
that
they
are
allocating
essentially
a
full-time
equivalent
for
support
services.
C
You
know
efforts,
and
so
we
are
also
looking
on
the
jpo,
the
jpa
board
of
library,
of
trying
to
outreach
to
the
population
that
might
need
some
social
services.
In
the
libraries
and
so
right
now,
this
is
essentially
going
to
be
divided
theoretically
between
milpitas
and
gilroy.
But
if
we
see
in
other
branches
the
needs
just
know
that
the
mechanism
is
there
and
so
in
cupertino
feel
free
to
reach
out
to
me.
C
C
I
did
attend
a
number
of
double
ten
ceremony
events
that
were
hosted
by
taipei,
economic
and
cultural
office,
as
well
as
by
the
county
thanks
to
otto
lee,
our
supervisor
in
santa
clara
county,
of
course,
we're
represented
by
joe
samidian,
but
also
to
dave
cortezzi
who's,
our
senator
now,
who
was
very
pivotal
and
making
sure
for
a
number
of
years
that
ceremony
could
take
place
at
county.
C
I'd
also
like
to
report
that
we've
been
going
over
a
number
of
events
for
mr
stanley
over
the
course
of
this
week
and
again
we
have
the
historical
society.
Soft
opening
of
the
exhibit
everyone's
welcome.
That'll
be
7
p.m.
This
this
friday
evening,
and
so
outside
of
that
I
did
have
one
more
item
that
I
wanted
to
describe,
but
I'm
kind
of
blanking
on
it
right
now
and
hoping
that
if
I
talk
long
enough
I'll
actually
remember
it,
but
unfortunately
that's
not
happening.
C
The
council
represents
various
interests
throughout
the
county
and
the
region
on
various
boards,
and
so
those
are
our
committee
assignments.
Would
anyone
like
to
go?
First,
I
see
vice
mayor.
Chow
has
her
hand
raised.
P
Hi,
so
on
the
8th
of
october
we
had
the
legislative
review
committee
meeting
the
lobbyists
gave
us
overview
of
the
bills
the
governor
signed
during
or
past
2700
bills
proposed
1100
bills
passed
the
at
that
time.
P
We
talked
about
the
schedule
for
the
upcoming
town
hall,
with
the
legislators
and
tong
hall,
with
residents
about
our
legislative
process
and
on
the
14th
of
october.
I
had
the
cities
association
meeting.
P
They
they
have
an
announcement
that
there
will
be
a
valley,
water,
drought
summit
on
october
23rd,
but
there
were
some
other
presentations,
but
the
main
issue
is
cities.
Association
will
be,
they
will
change
the
structure
to
be
from
unincorporated
to
join
the
powers
attorney
general
joint
powers
authority.
P
They
are
working
on
the
document
once
the
document
is
all
finished,
probably
in
three
months.
They
will
then
bring
it
to
the
console
for
approval.
Personally,
I
have
a
concern.
Why
do
I
even
need
to
move
to
joint
power
authority,
but
I
wasn't
on
the
board
last
year.
So
that's
something
other
council
members
you
might,
let's
not.
P
C
Just
reporting
out
on
you
know
yeah.
So
that's
all.
Thank
you
vice
mayor
next
we
have
council,
member
willie.
H
Yeah
so
on
the
13th
was
our
monthly
silicon
valley,
teen
energy
meeting
and
again
the
purpose
of
the
silicon
valley.
Team
energy
is
to
move
us
to
clean,
carbon-free
power,
and
so
this
was
basically
a
status
update.
Where
are
we
on
our
target?
H
silicon
valley,
clean
energy
that
only
started
in
2017
is
ahead
of
our
point
at
this
point
in
time
we
are
ahead
of
where
we
would
be
on
their
graph.
H
Q
Okay,
I'll
make
this
really
quick.
On
october
14th,
I
chaired
the
vta
pack,
where
we
discussed
the
transit
opportunity
development
policy
at
length
and
that
topic
is
going
to
be
coming
back
to
that
committee
to
be
discussed
some
more,
in
particular,
the
jobs
to
housing
ratio,
I'm
also
on
the
legislative
review
committee.
I
just
want
to
mention
that
sb
792
was
vetoed.
Q
That's
something
significant
with
regards
to
sales
tax
here
locally
and
if
you
want
to
know
how
all
the
bills
that
we
were
tracking
have
performed
just
take
a
peek
at
the
legislative
review
committee
web
page
and
there's
a
terrific
table
that
staff
has
provided
there.
Thank
you.
C
Thank
you
very
much.
I
actually
inadvertently
reported
that
on
my
jpa
library,
committee
assignment
and
so
I'll.
Just
keep
it
at
that.
So
we'll
go
ahead
and
move
on
to
item
number
five,
that
is
a
city
manager,
update
and
that
started
out
as
a
covet
update.
But
now
it's
more
of
a
generalized
update
from
the
city
manager
regarding
not
just
emergency
response
efforts,
but
also
other
business.
R
Yes,
thank
you,
mr
mayor
and
members
of
the
council,
I'll
try
to
keep
this
brief,
as
you
have
done.
First,
going
back
to
the
second
ceremonial
item,
I
got
my
start
in
city
government
serving
on
a
team
commission.
So
I
always
that
touches
the
heart
and
in
particular,
while
the
helen
putnam
awards
are
a
series
of
awards
done
for
all
sorts
of
city
services.
R
Moving
on
in
terms
of
the
public
speaker,
I
did
want
to
report
that
your
staff
is
already
working
on
the
menstrual
products
for
city
facilities
and
city
parks.
We
are
getting
price
estimates
now.
We
will
include
the
vending
opportunity
provided
by
the
committee
representative
today.
My
plan
is
to
fund
those
out
of
the
manager's
discretionary
fund
for
the
balance
of
this
year
and
then
to
bring
it
forward
to
council
as
a
budget
package
for
your
consideration
for
ongoing
service
in
future
years.
So
that's
why
we
are
pursuing
that
for
council
requests.
R
Also,
I've
been
asked
to
report
every
council
meeting
on
items
on
the
council
work
program,
and
so
I
did
want
to
report
that
one
item
on
your
work
program
for
this
year.
It
was
a
lower
priority,
but
staff
has
achieved.
It
nonetheless
was
the
dogs
off
lease
program
at
jolimon
park,
staff
reported
on
the
three
success
of
a
pilot
to
the
parks
and
recreation
commission
and
both
the
parks
and
rec
creation.
R
Director
and
myself
met
separately
with
representatives
of
the
dog
doctors,
community
and
we've
moved
forward
with
a
new
administrative
policy
to
allow
dogs
off
leash
on
an
ongoing
basis
at
charliman
park
and
we'll
be
reporting
back
periodically
on
there.
So
there's
one
item
checked
off
on
the
councilwork
program
for
this
year
and
we
will
be
doing
a
fuller
update
on
all
the
council
work
program
items
at
your
next
meeting
on
november
2nd
and
that
is
coming
forward
on
the
quarterly
basis
as
requested
looking
ahead.
We
also
have
something
to
celebrate
today
via
cupertino
restarted
today.
R
Serving
the
residents
of
cupertino
mass
are
required
for
all
passengers
and
the
driver
just
given.
We
are
still
in
a
coveted
effect.
These
service
hours
are
monday
through
friday,
7
a.m,
to
7
p.m,
as
well
as
saturday
9
00
a.m
to
5
p.m.
The
fee
pairs
are
four
dollars
per
trip,
but
there
are
discounted
pairs
available
for
weekly
monthly
and
other
needs.
You
can
get
more
information
both
on
the
city's
website
and
it
will
be
the
cover
story
of
the
november
scene
going
out
in
just
a
couple
weeks.
R
So
I'll
look
forward
to
that
parks
and
recreation
has
a
couple
great
events.
I
I
had
to
announce
the
nightmare
if
you'll
spare
another
moment
which
is
we
have
halloween
is
before
us
and
of
course,
we've
announced
previously
the
programs
doing
for
the
youth
of
our
community,
but
we
also
have
a
pumpkin
decorating
contest
for
seniors.
R
You
can
sign
up
as
individuals
or
it
can
be
grandparents
and
their
grandkids,
and
this
is
an
inaugural
program
that
we're
doing
for
the
first
time
and
you
can
carve
your
pumpkins
decorate
your
pumpkins
draw
or
paint
on
your
pumpkins.
All
you
have
to
do
is
submit
your
entries
by
halloween
day
and
I
think
that's
a
exciting
way
to
cross
our
community
boundaries
and
to
involve
youth,
grandparents
and
grandkids.
R
Together,
you
can
find
information
on
our
website
or
register
at
regforwreck.org,
which
is
our
online
portal.
I
did
want
to
mention
one
other
item
that
has
a
deadline
of
halloween
october
31st
at
5
pm
and
that's
to
apply
to
be
cupertino's,
22,
21,
22,
poet,
laureate,
and
so
that's.
The
annual
advocate
for
poetry
for
the
city
of
cupertino
and
the
application
deadline
again
is
halloween
to
make
it
easy
to
remember.
R
R
In
terms
of
county
statistics,
our
seven
day
average
continues
to
drop,
which
is
good
for
cupertino.
We
only
had
nine
new
cases
over
the
last
week
and
that's
a
a
low
mark
for
us
and
we
remain
the
city
with
the
lowest
case
rate
for
a
hundred
thousand
in
santa
clara
county
and
testing
continues
sponsored
by
the
county
at
our
senior
center,
and
the
easiest
way
to
remember
is
they'll,
be
on
the
first
and
third
mondays
for
november
and
december
at
the
senior
center,
and
we
had
355
tests
administered
yesterday.
So
it's
clearly
a
service.
R
C
P
R
Absolutely
I
almost
proactively
did
that,
but
I
was
worried
I
was
going
on
too
long.
I
am
doing
a
review
of
code
enforcement
working
with
your
other
city
staff.
We've
already
relocated
our
two
code
enforcement
officers
from
the
sheriff's
office
back
to
city
hall.
Just
so
there's
a
better
coordination
and
communication
of
code
enforcement
needs
throughout
our
community
and
we're
now
reviewing
a
number
of
practices
that
I've
seen.
Other
cities
use
to
free
up
bandwidth
or
increase
code
enforcement
like
almost
every
city
in
california,
since
prop
13,
we
only
do
complaint
base
code
enforcement.
R
My
assessment
is
cupertino
is
relatively
well
staffed
because
we
have
two
and
a
half
code
enforcement
officers,
including
weekend
coverage
plus
we
have
a
separate
zoning
code
enforcement
officer,
so
we're
relatively
well
staffed
compared
to
other
cities
that
I've
managed
and
worked
with
in
northern
california.
So
what
I'm
really
focusing
on
is
some
of
our
systems.
What
can
we
do
to
make
the
work
throughput
even
stronger
and
better?
R
We're
also
looking
at
some
of
the
larger,
more
intractable
problems
that
have
persisted
for
years,
and
how
can
we
take
more
assertive
actions
to
make
sure
we
don't
have
long-standing,
problematic
properties
that
are
negatively
impacting
their
surrounding
neighbors.
So
this
is
a
comprehensive
review
that
I
hope
to
bring
a
report
on
to
you
before
the
end
of
my
tenure
as
your
interim
city
manager,
okay,.
P
P
Q
But
I
was
just
wondering
if
3-1-1
allows
for
anonymous
reporting,
or
must
you
provide
a
name,
because
some
people
might
not
want
to
use
that
if
they
need
to
provide
their
name,
email
address
and
phone
number.
If
the
city
has
all
of
that,
because
when
you
go
to
code
enforcement
here
you
have
that
anonymity
in
reporting.
R
You
know
I
cannot
answer
that
I'll
rather
report.
Well,
actually
I
just
got
the
answer.
Yes,
anonymous
is
okay,
the
beauty
of
technology,
so
you
can
report
anonymously.
Of
course,
we
can't
do
any
follow-up
with
the
person
who
files
anonymously,
but
for
many
of
the
cases
we
also
can't
do
follow-up
as
well.
If
there
are
privacy
considerations
involved.
C
Okay,
thank
you
very
much
and
hopefully
we're
we're
enforcing
evenly
across
the
board.
With
regard
to
our
various
demographics.
Let's
go
to
consent,
calendar
items
six
through
14..
Would
anyone
like
to
pull
any
items
on
our
consent?
Calendar
council
number
more.
Q
Okay,
mayor
paul,
I'm
not
sure
that
I
necessarily
want
to
pull
the
items,
but
under
item
10
there
is
an
hdl
payment
of
12,
000
and
under
item
13,
there's
an
hdl
payment
of
twenty
three
thousand
dollars.
I
would
like
to
have
an
explanation
of
those,
but
I
I
in
the
interest
of
time
I'm
not
really
wanting
to
pull
them.
So
if
there's
some
way
that
I
can
work
around
that,
I
will.
C
Q
C
It
won't
take
too
long
to
get
those
get
those
get
those
taken
care
of.
If
it's
just
a
quick
answer,
so
can
I
have
a
motion
for
items
six
through
nine,
eleven,
twelve
and
fourteen
councilmember
moore,
so
moved
and
councilmember
way?
Second,
is
there
any
care
for
discussion
on
these
seeing
our
hands
raised?
Madam
city
clerk,
would
you
please
vote
us
on
items
six
through
nine,
eleven,
twelve
and
fourteen
of
the
consent
calendar.
D
C
Okay,
now
we
have
items
10
and
13..
Let's
try
to
take
those
as
a
pair
councilmember
moore
did.
You
have
similar
questions
of
both
10
and
13
or.
Q
Yeah,
exactly
just
an
explanation
for
why,
at
this
time
we
are
making
the
12
000
approximately
payment
for
hdl
and
then
the
23
000
for
hdl
as
well
under
item
13..
R
Thank
you,
councilmember
moore
and
members
of
council.
Both
of
these
hdl
payments
are
for
balances
due
under
their
existing
contracts,
so
they're
not
for
expenditures
beyond
the
existing
contract,
and
that
was
the
information
I
received
from
our
staff
and
both
our
director
of
administrative
services
and
our
director
of
community
development
are
available
if
additional
details
are
required,
but
they're,
not
the
issue
that
was
brought
up
to
council
last
spring
about
amending
the
contract
for
greater
expenses.
That
issue
is
going
to
your
audit
committee
next
monday.
R
C
You
wait:
is
there
a
motion
for
items
10
and
13
on
consent.
C
Q
C
C
C
C
19.56.030
19.56.030,
f
and
so
forth.
I
believe
we'll
be
reading
this
again
through
the
city
clerk
as
the
second
reading.
Would
anyone
like
to
on
staff
present
any
information
on
this
item?
I'm
happy
to
go
on
to
our
council
to
see
if
there
are
any
questions
with
regard
to
second
reading
of
this
item
before
we
do
that,
if
there
are
none,
then
I
would
be
happy
to
open
it
up
to
the
public
for
any
comments,
given
that
this
is
second
reading
all
right.
C
C
C
J
J
I
still
feel
that
we
have
a
hostile
environment
in
sacramento
and
we,
the
cities
right
now,
are
suffering
the
consequences
of
core
legislative
planning
at
the
at
the
sacramento
level
by
the
rollout
of
the
housing,
dolls,
etc,
etc.
J
I
am
all
the
more
concerned
that
the
city
has
city
and
cities
across
the
state,
because
they're
trying
sacramento
is
trying
to
do
a
cancel
culture
on
the
cities,
and
I
don't
think
that
that's
appropriate,
because
people
live
in
cities,
but
I
think
that
the
density
bonus
situation
that
was
taken
along
with
this
ordinance.
The
city
has
worked
on
it
to
its
due
diligence.
J
We
have
to
protect
ourselves.
Land
that
is
up.
Zoned
is
worth
more
money.
I
think
that
is
the
sole
intent
of
this
housing
push
from
sacramento.
I
believe
the
governor
was
not
informed
correctly
and
that's
why
he
signed
all
these
bills.
I'm
sure
hoping
that's
the
case,
but
I
do
think
that
the
city
has
taken
its
time
to
make
sure
that
this
ordinance
has
been
worked
out
as
carefully
as
it
has.
People
will
criticize
the
city,
but
I
do
not
want
cancer
culture
for
cupertino
in
this
state.
Thank
you.
C
C
C
C
Okay,
your
hand
is
now
lower.
I
don't.
C
C
C
This
relates
to
organic
waste,
disposal
reduction
and
the
city
clerk
will
read
the
the
various
code
sections,
and
so
I
won't
read
those
so
let's
go
ahead
and
mr
city
manager,
you
do
have
your
hand
raised.
Do
you
want
to
speak
to
this
item
or
is
it.
R
I
just
wanted
to
let
you
know
there
is
no
additional
information
since
the
first
reading,
so
staff
is
available
to
answer
questions.
C
Okay,
great,
thank
you
very
much.
I
don't
see
any
hands
raised
from
council
and
so
I'll
take
it
to
the
members
of
the
public
again.
This
is
a
second
reading
of
an
ordinance
regarding
a
mandate
for
organic
waste
disposal,
reduction
per
state
requirement,
and
so
I
don't
see
any
members
of
the
public
with
their
hands
raised.
Madam
city
clerk,
would
you
please
conduct
the
second
reading
of
this
ordinance
on
item
16.
D
This
is
the
second
reading
and
enactment
of
ordinance
number
21-2231,
an
ordinance
of
the
city
council
of
the
city
of
cupertino,
amending
city
code
to
repeal
section
6.24.037,
adopt
a
new
section,
6.24.037
adopt
a
new
section,
6.24.038
and
amend
sections.

P
C
Would
anyone
like
mayor
chad's
motion
to
pass
the
second
reading
and
an
act
council,
member
willie,
yes,
hi?
Second,
very
good,
let's
see
for
a
discussion
on
the
second
connect
management
of
dash
two
two,
three
one,
and
so
madam,
could
you
please
conduct
a
roll
call
vote
on
this
item.
C
C
Okay,
very
good.
I
think
this
is
probably
a
good
time
to
take
a
brief
break.
We're
at
the
last
item,
I
believe
on
our
enumerated
agenda.
This
is
a
when
we
start
back
up
on
the
agenda.
It
will
be
item
number
17
under
public
hearings,
it's
approximately
eight
o'clock,
so,
let's
just
reconvene
at
805.
A
A
A
A
A
A
A
C
C
C
C
A
C
I
believe
that
mr
city
manager,
that
our
director
of
planning
of
community
development
has
a
presentation
this
evening
on
item
17.
Is
that
correct?
Okay,.
T
Thank
you,
mr
mayor.
Vice
mayor
and
council
members,
I've
been
food
director
of
development
with
me
tonight
is
pugosh
our
planning
manager.
We
also
have
some
consultants
with
us
as
well,
and
thank
you
members
of
mayor
for
the
introduction
of
the
item.
This
is
a
long
time
coming.
It
took
us
about
a
couple
years,
there's
a
pretty
big
list
of
objective
standards.
We
started
this
effort
a
couple
years
ago,
looking
at
the
code
and
ways
to
improve
our
general
plan.
T
The
commission
also
and
council
invited
the
members
of
public
for
to
inquire
about
just
aerials
and
general
plan
and
zoning
ordinance.
That
could
be
further
clarified
and
we
also
have
gone
to
plane.
Commission
last
last
month
in
september,
received
some
comments
and
endorsement
from
the
planning
commission.
T
C
We
seem
to
have
some
technical
difficulties
as
we
we
go
further
into.
Oh.
S
C
S
Perfect
all
right,
oh
yeah,
good
evening,
council.
I
am
sorry,
I'm
gonna
apologize
in
advance
for
a
fairly
long
presentation
only
because
it's
such
a
needy
topic
and
I'm
sure
there
will
be
a
lot
of
questions
about
it
as
well.
So
I
will
stop
in
the
middle
after
I
go
through
what
would
be
general
plan
amendments
that
are
proposed
following
that
I'll
continue
at
the
council's
pleasure
to
present
some
municipal
code
amendments
that
are
also
being
proposed
as
environmental
protection
standards.
S
S
There
have
been
certain
changes
in
state
law
that
require
their
housing
developments,
which
comply
to
objective
standards
immune
in
some
cases
in
the
city's
general
plan
and
zoning
and
in
fiscal
year.
1920.
A
work
program
item
was
added
to
update
the
general
plan
and
zoning
to
include
objective
standards
as
deemed
required
in
that
process.
S
The
city
attorney's
office
identified
some
suppressing
items
that
needed
to
be
updated,
including
some
prior
updates
to
the
parkland
dedication
ordinance
and
the
planned
development
zones
chapters
those
were
completed
at
the
end
of
2019.,
following
that
in
2020
there
were
some
additional
updates
that
were
identified,
I'm
sorry
not
in
2020.
still
in
2019,
some
additional
updates
were
identified
and
in
the
scene.
At
the
same
time,
the
planning
commission,
the
city
council,
invited
the
public
to
suggest
areas
that
could
be
clarified
further.
S
There
were
quite
a
number
of
large
items
that
were
collected
and
these
items
were
presented
in
september
2019
to
the
city
council.
At
that
time
the
city
council
authorized.
The
staff
depends
on
certain
items
identified
by
staff
and
the
city
attorney
to
prepare
those
amendments,
and,
additionally,
on
october,
1st
2019,
the
city
council
delegated
the
task
of
prioritizing
those,
the
bulk
of
the
items
to
the
city
manager
and
the
city
attorney's
office,
in
conjunction
with
planning
department
staff.
S
It
should
also
be
noted
as
background
information
that
sp
330
was
also
enacted
in
september
2019,
which
essentially
essentially
stated
that
there
could
be
no
reduction
in
the
intensity
of
housing
development
on
some
properties
without
a
corresponding
or
similar
increase
in
intensity
elsewhere
in
the
city.
I
just
wanted
to
give
that
background
to
give
context
on
how
these
items
were
prioritized.
S
All
of
the
items
were
then
prioritized.
As
I
mentioned,
there
were
quite
a
number
of
items.
They
were
meaty
topics.
There
was
some
research
that
was
involved,
and
these
were
all
prioritized
by
the
end
of
2020..
It
basically
prioritized
the
items
as
being
new
with
completion
items
which
are
being
presented
tonight
for
council
to
look
at.
There
were
current
work
program
items
that
were
already
underway,
one
of
which
has
already
been
completed
related
to
the
dark
sky.
S
There
were
some
items
that
were
already
completed
among
the
comments
that
were
received,
including
updates
to
the
parkland
dedication
ordinance
and
planned
development
zones.
There
were
possible.
There
were
some
that
were
identified
as
possible
housing
element
update
items.
S
S
With
that,
I'm
just
going
to
jump
into
the
general
plan
amendments
that
were
that
are
being
proposed.
I
would
like
to
point
out:
there
are
no
changes
to
heights
or
densities
that
are
allowed
currently,
so
the
edits
on
this
page
in
this
figure
are
only
to
clarify
existing
densities
and
existing
heights.
The
the
edits
are
in
two
areas:
one
is
to
the
footnotes
and
then
the
other
one
is
to
the
text
boxes
for
the
special
areas
or
the
gates
or
gateways
or
nodes,
I'm
just
going
to
zoom
in
on
the
footnotes.
S
As
previously
mentioned,
there
has
been
some
ongoing
concern
about
architectural
features
and
how
they
encroach
into
the
slope
lines
that
are
required,
and
so
there
was
language
added
to
clarify
that
architectural
features
are
the
only
architectural
features
that
do
not
include
the
usable
area
that
do
not
include
usable
areas
may
encroach
into
the
slope
line.
S
Additionally,
there
were
other
clarifications
made
where
you
know
just
to
make
sure
that
there
are
cross
references,
because
we
do
have
land
use
plans
or
conceptual
zoning
plans
or
other
guidelines
that
we've
adopted
already
for
setbacks
and
heights
adjacent
to
residential
areas.
So
we
wanted
to
make
sure
that
there
would
be
no
conflict
between
the
general
plan
and
an
adopted
plan.
So
we
wanted
to
reference
those
plans
in
this
language
which
we
have
done
with
the
second
edit
there.
Finally,
the
last
edit
is
another
repeat
of
that
first
edit.
S
That
was
made
in
the
first
world
point
there
with
regard
to
the
text
boxes
again,
there
have
been
no
changes
really
to
the
allowed
densities
or
reduction
or
an
increase
to
the
allowed
densities.
These
are
just
simply
clarifications
in
the
language
to
make
sure
that
the
city's
ongoing
intent
is
clarified
with
regard
to
densities
and
heights,
and
so
those
were
made
specifically
in
these
six
text
boxes
that
are
colored,
and
then
this
one
node
box
in
blue
just
to
make
sure
that
the
language
is
as
clear
as
can
be
for
applicants
and
for
the
city.
S
Additionally,
there
are
two
other
edits
in
chapter
three
one
is
in
policy
lu-1.1.
We
realized
that
there
was
no
reference
in
the
text
of
figure
lu-2
with
regard
to
density.
So
we
wanted
to
add
a
clarification
about
that
and
then
also
we
wanted
to
make
sure
that
there
were
some
nested
policies
in
in
whole.
Lu13,
the
intent
was
always
to
have
goals
lu-14
through
area
18
be
nested
policies
to
goal
lu13,
and
so
there
was
some
clarifying
language
added
to
the
general
plan.
S
For
that,
with
regard
to
chapter
six,
there
was
a
very
minor
edit
made
to
ensure
that
in
santa
cruz,
county
would
be
strongly
encouraged
to
engage
with
the
affected
neighborhoods
when
considering
changes
to
their
restoration
plan
for
mineral
extraction
activity
at
the
lehigh
or
the
stephensburg
quarry.
S
C
H
Yeah
hi
pewd.
Thank
you
very
much
for
the
presentation.
If
you
could
go
back
to
the
slide
that
talked
about
encroachments,
keep
going
keep
going
there.
You
go
that
one
architecture
at
the
very
end.
You
know
at
the
very
last
line.
Architectural
features
that
do
not
include
usable
area
may
encroach
into
the
slope
line.
H
So
I
you
know
the
resident
was
bringing
up
main
street
prior
to
being
on
the
city
council.
I
also
looked
at
that
I'd
really
like
to
request
that
city
staff.
Clearly
look
at
those
means
again.
H
Sorry
but
I
I
would
like
to
request
that
city
staff
look
at
that
and
make
sure
they
understand
how
developers
try
to.
H
Do
things
that
are
not
allowed
so
that
we
really
do
make
sure
that
this
verbiage
or
make
sure
that
the
process
where
city
staff
has
to
review
and
and
clearly
understand,
if
it's
usable
or
not,
and
so
I'd
like
to
request
a
a
post-mortem
on
those
so
that
we
make
sure
we
we
will
not
wind
up
with
that
situation
happening
again.
H
I'll
leave
it
at
that.
But
that's
my
request.
C
Thank
you,
councilmember
willie,
and
you
know
I'll
just
interject
very
briefly
before
we
go
to
council
member
moore
that
you
know
I
I've
experienced
firsthand
what
you're
talking
about,
because
of
course,
you
brought
this
up
to
me
a
number
of
years
ago
right
and
have
been
pointing
out
over
the
course
of
time
that
you
know
you're
just
scratching
your
head
wondering
why
you
know
certain
areas
that
were
supposed
to
be
non
non-occupied
ended
up
being
actually
occupied.
C
You
know
over
time
and
a
number
of
other
issues,
and
so
you
know
I
I
I
can
bear
attestation
to
the
to
the
consistency
of
your
concerns
over
the
years.
Next
we
have
council,
member
moore.
Q
Thank
you,
mayor
paul,
and
it's
it.
My
question
does
pertain
to
this
particular
slide
here,
and
it's
really
why.
Why
are
we
inserting
this
line?
Architectural
features
that
do
not
include
usable
area
may
encroach
into
the
slope
line
when
it
doesn't
seem
to
be
a
very
objective
standard.
It
seems
pretty
subjective,
you've
got
the
word,
may
I
don't
know
how
much
it
may
encroach
and
it
repeats
twice.
Q
S
Sure,
with
regard
to
architectural
features,
we
do
have
a
definition
of
architectural
features
in
our
municipal
code.
We
also
have
a
definition
of
usable
area
in
our
municipal
code,
we
kind
of
relied
on
those
to
come
up
with
practice
language
in
particular.
S
If
council
may
recall
we,
when
it
was
discussed
at
the
prior
meeting,
there
were
comments
from
the
council
about
how
there
would
be
no.
You
know
there
may
be,
may
not
be
concerned
if
there
was
a
balcony
that
encroached
into
the
slope
line,
for
example,
or
if
there
was
a
chimney
feature
that
encroached
into
the
slope
line,
or
you
know
a
small
window
pop
out,
or
things
like
that,
and
so
based
on
those
comments.
Q
Okay,
thank
you
and,
and
to
the
point
of
the
apple
building,
with
the
with
the
it's
actually
a
usable
area
that
would
be
in
the
slope
setback
area
too
much.
S
That
is,
that
is
an
anomaly
I
do
have
to
accept.
I'm
not
sure
how
that
happened,
but
in
terms
of
you
know
whether
that
kind
of
feature
would
be
allowed
in
the
slope
line.
It
would
not,
because
that
is
definitely
considered
usable
area.
Q
Okay,
now
going
back
to
the
old
eir
from
2014,
there
were
some
heights
which
were
studied
in
in
that
report.
Do
those
have
any
bearing
on
on
this
general
plan
table
with
the
heights
here.
Q
Okay,
and
could
we
actually
be
increasing
a
density
in
this
table
if
we,
if
we
select
to
do
that
at
this
time,
I'm
wondering
if
we
have
a
lower
density
than
what
we
think
we
might
need
to
have
to
accommodate
our
arena
numbers?
Could
some
of
these
actually
be
increased
to
accommodate
that,
and
also
the
height?
Is
that
something
we
could
do
at
this
time?
Can
you.
Q
Looking
at
south
fans
a
special
area
with
a
maximum
height
of
only
30
feet
and
let's
see
it,
looks
like
a
density
south
of
highway,
85
only
5
to
15
units
per
acre
and
that
number
seems
super
low
because
sp9
is
now
taking.
You
know
an
8,
1
8
acre
lot.
Your
density
can
go
apparently
up
to,
I
think
at
least
four,
but
possibly
six
units
so
for
one
acre.
Q
S
So
that
was
the
intent
of
the
council
from
the
councils
from
the
past
in
terms
of
the
lower
densities
in
the
south
vienza
area
and
the
lower
heights.
That
is
something
that
the
city
will
probably
be
looking
at
when
it
redoes
its
housing
element.
But
that
is
not
something
that
was
evaluated
with
this
particular
general
plan
amendment,
and
I
don't
believe
that
that
can
be
amended
at
this
time
because
it
has
not
been
noticed
or
you
know,
evaluated.
Q
P
Okay,
yeah
so
yeah.
This
is
on
this
same
slide,
since
we
are
trying
to
make
objective
standards
for
projects
that
could
be
streamlined
without
any
discretionary
approval.
That
means
this
any
architectural
feature
should
not
exceed
slope
line.
If
they
would
like
any
of
the
architecture,
feature
to
exist,
look
lying.
The
project
should
go
through
the
discretionary
approval
process.
That
should
be
what
we
are
doing
here
and
therefore
we
should
strike
this
and
specifically
point
maybe,
or
do
it
we
need
to
conjure
up.
P
Our
architectural
features
should
be
below
the
slow
plan
to
be
clear,
then
that's
clear
in
objective
step.
Maybe
we
should,
I
think,
to
be
objective
and
clear.
We
should
specify
here.
Architecture
features
should
be
below
slope
line
and
and
architectural
features
above
slope
line
require
discretionary
approval.
Something
like
that
is
that
legally,
is
that
legal
on
mr
city
attorney.
G
So
this
this,
you
know,
I
think,
consistent
with
what
you
said
earlier.
It
is
up
to
council
whether
they
want
to
clarify
this
provision
to
state
that
the
architectural
features
are
included
or
excluded
from
the
slope
line.
P
Okay,
good-
and
this
doesn't
affect
the
density
right
and
since
especially
if
balcony
is
considered
architectural
feature,
that's
actually
a
usable
area.
So
it's
it
gets
fuzzy,
whether
architecture
official
for
something
is
considered
a
feature
or
not.
Therefore,
it
requires
discretionary
approval,
yeah
and
then
the
second
is
the
third
bullet,
also
that
we
say
in
the
last
sentence
in
any
adopted
design
guideline.
This
will
be
established
under
project
review,
but
when
there
is
no
project
review,
then
that
means
there
is
no
standard.
P
But
this
is
when,
where
slope
lines
are
not,
space
is
not
established.
So
we
are
saying
when
slope
lines
are
not
established
in
any
of
the
plane,
it
will
be
established
under
project.
You
can
always
say
when
slope
lines
are
not
established,
the
project
require
review
or
how
do
we,
or
maybe
we
should
settle
in
with
them
when
slope
line
is
not
established,
it
needs
to
be
one
to
one
for
example.
So
we
need
to
set
us
objective
standard.
Otherwise
it
could
be
a
hundred
to
one.
S
So
we
did
actually
do
the
evaluation.
Vice
versa,
in
terms
of
where
we
do
not
have
a
slope
line
established.
The
only
places
we
do
not
have
a
slope
line
established
for
residential
development
is
at
the
apple,
infinite
loop
campus
that
affects
the
area
that
about
gosh.
Is
it
randy
lane?
I
think?
S
Oh,
I
think
it
is
randy
lane
behind
the
apple,
infinite
loop
campus
and
along
lynette
lane,
which
is
a
lane
in
sunnyvale,
and
there
are
some
sunnyvale
residents
that
are
across
minute
lane
behind
the
cupertino
village
shopping
center.
S
So
those
are
the
two
main
areas
where
there
are
no
setback
and
height
limits
everywhere
else
that
we
reviewed,
based
on
our
conceptual
zoning
plans
or
land
use
plans
that
we
have.
There
are
setback
and
height
limitations
that
are
spelled
out
with
regard
to
the
apple
infinite,
loot
campus,
I
do
not
believe
residential
uses
are
allowed
at
the
apple,
the
infinite
loop
campus,
so
that
is
not
a
streamlined
parcel,
so
you
can't
really
develop
a
streamlined
project
on
that
site.
S
With
regard
to
the
cupertino
village
center
there
are
residential
uses
are
allowed
at
25
minutes
to
the
acre.
However,
there
is
like
I
said
there
is
a
60
foot
wide
or
80
foot
wide
street
there
that
separates
residential
uses
from
the
edge
of
that
particular
parcel.
S
That
is
some
you
look
at
the
disposition
table
that
we
provided
is
attachment
c
in
there
there
were
some
concerns
about
being
running
afoul
of
sp330
and
therefore.
P
P
S
That
was
not
the
city,
attorney's
assessment
and
the
disposition
table
that
was
put
together
was
upon
the
advice
of
the
city
attorney,
and
so
there
are.
There
were
certain
concerns
related
to
sbq
30,
and
we
were
advised
that
that
happened
at
a
later
time,
in
conjunction
with
the
housing
mining
company.
P
So
I
I
would
hope
that
we
consider
that
with
sbgi,
because
probably
that
would
need
to
be
considered
together.
Yeah.
G
Yeah,
just
just
just
just
to
clarify
vice
mayor
chow,
so
there
there
was
a
concern
with
with
potential
down
zoning
sb30
doesn't
prevent
us
from
changing
the
zoning
indefinitely,
but
it
does
that
does
require
corresponding
changes.
So
there's
no
net
increase
in
density,
so
the
choice
choice
here
was
made
to
make
what
are
really
clarifying
changes
and
not
changes
that
possibly
change
density.
G
If
you
know
if,
if
we
are
going
to
be
looking
at
increasing
density
in
certain
zones
in
the
city,
there's
the
possibility
to
look
at
these
offsetting
changes
elsewhere,.
P
Okay
and
then
so
then
we
still
have
some
areas
of
the
city
that
has
no
standard,
and
these
areas
of
the
city
could
still
be
have
projects
that
will
be
streamlined
without
discretionary
approval
and
then,
according
to
the
language
right
now,
then
there
is
no
standard
for
those.
B
S
In
dart,
I
can
answer
that
vice
mayor.
Actually,
we,
when
we
updated
our
planned
development
zoning
ordinance
back
in
december
2019.
S
There
was
a
conscious
decision
to
ensure
that
if
there
was
a
streamlined
development
most
of
these
sites,
where
there
are
no
setback-to-pipe
ratios,
potentially
avoiding
residential
uses,
those
were
fine
development,
zoning
districts
and
so
the
plan
development.
Zoning
district
essentially
states
that,
if
you
are
bringing
in
a
discretionary
approval
in
a
plan
development,
zoning
district,
it
has
to
meet
our
r3
zoning
requirements
and
there
are
setback.
Requirements
spelled
out
in
the
arctic
zone
requirements
and,
as
a
result,
any
discretionary
project
would
have
to
make
their
project
be
like
an
r3
project.
S
K
P
R3
zone,
okay,
so
that
so
it's
specified
there.
Yes,
so
can
we
clarify
it
here,
then
that
if
it's
not
specified
in
the
plant
development
ordinance,
it's
specified,
it
has
to
meet
earth,
r3,
zoning
or
or
it
could
be
established
during
project
review,
which
means,
if
it's
discretionary
approval,
then
they
may
not
need
to
comply
with
all
three.
They
can
have
other.
S
A
G
Yeah,
so
so
I
I
think
what
pew
is
saying
is
that
that
a
project
would
need
to
comply
with
objective
zoning
standards
so
separate,
and
apart
from
anything,
that's
in
the
general
plan,
the
project
would
have
to
comply
with
the
zoning
ordinance
and
the
zoning
ordinance.
It
includes
the
are
the
r3
provisions
the
zoning
coordinates
would
apply.
I.
P
Mean
yes,
so
it
probably
doesn't
need
to
say
r3,
but
just
say
it
should
comply
with
the
plan
development,
the
municipal
code
chapter
or
something
for
the
plant
development
right
I
mean.
P
G
So
we'd
have
to
go
back
and
look
at
the
specific
language.
I'm
not
sure
that
the
language
this
language
in
the
general
plan
speaks
to
specific
zoning
districts,
and
so
it
might
take
a
fair
bit
of
word
spending
together.
That's
fine.
S
Yes,
it
is
actually
those
two
parcels
are
designated
as
the
neighborhood
commercial
parcels
and
for
neighborhood
commercial
areas.
The
density
maximum
residential
density
is
at
15
units
per
acre,
and
that
is
the
oakmont
shopping
center
at
the
corner
of
the
southeast
corner
of
homestead
and
blaine.
S
Okay,
I
did
want
to
point
out
that
just
going
back
to
the
architectural
features,
I
know
vicente
charlie
said
that
you
could
consider
architectural
features
encroaching
into
the
slope
line
as
a
discretionary
item,
but
if
we
specify
clearly
in
the
general
plan
that
architectural
features
cannot
encroach
that,
we
cannot
allow
that
without
a
general
plan
amendment
for
each
project
as
they
come
in.
So
I
I
just
wanted
to
mention
that.
P
So,
if
waste,
I
think
all
I'm
asking
is:
if
there
is
encroachment,
it
will
need
discretionary
approval,
so
it
needs
to
go
through
the
review
and
planning
commission
so
how
that
can
be
specified.
I
don't
think
that
needs
a
general
plain
amendment,
but
we
need
to
state
in
a
certain
way
that
if
you
want
to
encroach,
we
want
to
review
it.
How
is
what's
the
use
right.
S
I
think
we'll
have
to
go
back
and
evaluate
that
language,
but
if
we
were
to
include
very
clearly
in
the
language
that
architectural
features
did
not
encroach
into
the
slope
line,
then
that's
the
end
of
that
in
terms
of
a
project.
They
would
need
a
general
plan
amendment
to
be
able
to
do
that.
S
For
residential
developments
that
are
multi-family,
it
doesn't
state
that
anywhere,
except
here,
the
only
place
that
it
states,
that
is
in
the
r1
zoning
district
and
r1.
S
I
think
it
also
might
stated
in
the
rhs
the
residential
hillside
that
architectural
features
such
as
bay
windows
and
things
like
that
can
encroach
into
a
setback,
but
it
does
not
specify
that
or
not
this.
This
also
applies
to
non-residential
development,
such
as
office,
buildings
and
technological.
P
Sorry,
one
more
upper
right
corner,
the
south,
the
spatial
area.
It
says
the
maximum
is
5
to
15
per
acre.
How
come
you
have
a
range
for
the
max.
S
That
is
how
it
has
always
been
in
the
south
area.
It
is
also
for
the
mona
vista
village.
It
is
in
some
areas,
it
is
zoned.
Actually,
the
land
use
map
has
4.4
to
12
units
per
acre.
P
S
It
isn't,
I
think,
on
the
land
use
map
it
is
I'd
have
to
look,
but
it
is
my
understanding
that
it
is
commercial,
slash,
residential
with
no
general
plan
density
specified
and
on
the
land
use
map.
But
I'd
have
to
look.
P
And-
and
it's
just
feels
like
these-
two
are
inconsistent
one
side:
you
have
okay,
it's
specified
in
the
length
use
map
loop
there
if
it's
not
spiced
right
there.
We
have
this
max-
and
here
you
have
here
is
a
wrench,
but
you
didn't
say
that
the
the
max
is
not
a
range
it's
specified
in
somewhere.
S
On
the
land
use
map,
we
have
ranges:
for
example,
certain
home
developments
are
10
to
20
minutes
per
acre.
There
are
some
areas
that
are
20
to
35
growing
units
quicker.
We
also
have
actually
all
single-family
residential
is
one
to
five
to
one
units
per
acre.
So
the
general
plan,
the
land
use
map-
does
have
the
incidence
ranges
on
it.
S
Oh
okay,
it
isn't
uncommon.
A
S
This
precedes
my
time
here
in
cupertino.
Q
Thank
you,
mayor
paul,
so
going
back
to
the
same
footnotes,
chapter
three
figure,
lu-2
page
with
regards
to
the
building
planes.
I
just
want
to
clarify
that
one
of
the
issues
that
we
had
was
the
word
bulk:
maintaining
the
building
bulk
but
below
the
one-to-one
slope.
Q
So
I'm
glad
that
that
word
has
been
struck,
but
I
just
want
to
clarify
that
when
we're
talking
about
the
arterial
arterial
boulevard
curb
line
that
those
would
just
be
wolf,
stevens
creek
to
about
where
the
post
office
is
on
the
west
side
of
town
and
then
dansa
boulevard,
and-
and
so
I
I
don't
want
people
to
think
that
the
encroachment
note
here
that
that
is
affecting
residential
neighborhoods
because
of
what
these
streets
actually
are.
Q
I
also
want
to
clarify
that
the
curb
line
by
your
definitions,
which
I
I
don't
know
what
they
are,
is
if
there
is
street
widening
required,
is
it
the
curb
line
before
the
widening
or
after
because
it
could
make
a
you
know
a
significant
difference
for
where
the
the
face
of
the
building
would
be,
and
then,
where
is
that
pointed
to
so
that
a
developer
doesn't
say?
Q
Oh
I'm
using
the
existing
curb
line
and-
and
I
don't
have
to
do
the
final,
because
there's
nothing
telling
me
that
is
there-
is
that
pointed
out
somewhere.
S
So
it
generally
is
from
the
the
final
curb
line,
the
public
curve.
If
somebody
develops
any
private
streets
or
anything
on
their
property,
the
slope
line
does
not
apply
from
that.
Q
S
Yes,
and
if,
if
it
is
required
as
an
environmental
mitigation,
for
example,
because
of
how
the
project
ends
up
being,
then
yes,
it
it
it
could.
It
depends
on
where
the
the
curb
line,
I'm
trying
to
explain
this
so
so
when
you
come
to
an
intersection
and
if
you
need
to
have
a
right
turn
pocket,
for
example,
the
curb
line,
usually
where
we
look
at
it
is
where
the
main
line
is
and
not
where
you
where
you
would
put
in
a
right
turn,
for
example.
S
S
Q
S
Q
S
We
would
have
to
work
pretty
closely
with
public
works,
to
make
sure
that
most
streets
have
some
sort
of
width
that
is
required,
whether
it's
120
feet
from
curb
to
curb
or
whatever
that
is,
and
we
would
work
with
public
works
to
figure
out
where
that
would
be
and
figure
out
where
the
slope
line
would
be.
C
I
think
councilmember,
moore
and
vice
mayor
ciao,
I
think
in
the
interest
of
going
ahead
with
the
presentation
I'm
going
to
go
ahead
and
so
so
pew.
How
many
check-ins
did
you
have
I
see
that
the
estimated
time
of
the
presentation
was
20
minutes
initially.
C
Okay,
so
what's
your
estimate
for.
S
I
would
say
about,
I
think
I
went
for
about
five
minutes.
I
would
say
about
15
minutes.
C
S
No,
I
don't
think
we
have
any
more
check-ins,
I'm
happy
to
go
through.
I
know
I'm
going
to
respond
to
some
council
questions
that
were
asked
so.
S
Okay,
let
me
restart
my
presentation
here.
L
S
All
right,
so
moving
on
to
the
municipal
code
amendments
again,
staff
is
recommending
that
a
new
chapter,
17.04
environmental
protection
standards,
standard
protections,
the
requirements
be
added.
It
starts
with
the
definitions
that
are
applicable
to
that
chapter
with
regard
to
applicability
of
all
these
requirements.
Essentially,
it
has
been
proposed
that
all
projects
that
involve
a
subdivision,
construction,
ground,
disturbing
activities
or
tree
removals
be
subject
to
these
requirements.
S
If
you
are
subject
to
some
of
these
requirements,
if
and
your
non-residential
or
residential
project
with
four
or
more
units,
you
would
have
to
provide
a
construction
management
plan
and
or
show
that,
how
you're
meeting
those
requirements
on
permit
plans
if
you're
a
residential
development
with
less
than
four
units
or
if
your
additions
are
remodels
or
if
you
have,
if
you're
a
tenant
improvement,
those
requirements
would
need
to
be
shown
on
permit
plans.
S
S
Okay,
this
chapter
can
be
seen
as
though
divided
into
two
pieces.
One
are
things
that
are
required
prior
to
project
approval
and
the
other
things
are
requirements
that
are
prior
to
permit
issuance.
So,
with
regard
regard
to
the
requirements
that
are
required
prior
to
project
approval,
we
kind
of
divided
them
up
by
area
of
I
hate
to
use
the
word
impact
but
area
that
is
being
affected.
For
example,
if
it's
air
quality,
you
would
prepare
an
operational
health
risk
assessment
if
the
project
exceeds
certain
thresholds.
S
S
It
needs
to
identify
and
implement
tdots,
which
are
I
we
have
our
consultant
here,
who
knows
exactly
what
they
are
and
or
measures
that
are
basically
capable
of
reducing
risk
to
an
acceptable
level
within
a
project
if
a
certain
risk
thresholds
are
exceeded
and
those
risk
thresholds
are
identified
in
the
municipal
code,
the
proposed
municipal,
if
the
project
is
supposed
to
indicate
what
area
that
site
is
located
on
on
the
back
men's
planning,
healthy
places
map
and
if
it
is
an
area
that
is
identified
as
implement
best
practices,
then
that
project
needs
to
install
hire
more
filters,
locate,
openings
and
buildings,
away
from
emission
sources
and
plant
trees
as
required,
and
and
that's
all
those
are
all
requirements
that
back
then
has
in
place
with
regard
to
hazardous
materials.
S
If
the
phrase
one
asc
indicates
that
there
is
a
potential
for
contaminants,
then
the
project
applicant
must
prepare
a
phase,
two
esa
report,
and
then
all
these
reports
must
be
completed
in
accordance
with
commonly
accepted
industry
standards
and
those
are
identified
within
the
closed
municipal
code.
S
Amendment
with
regard
to
traffic
africans
are
to
provide
a
vnt
analysis
to
indicate
compliance
with
our
recently
adopted
emp
standards
and
then,
additionally,
with
regard
to
vibration,
if
they
anticipate
that
vibration
causing
equipment
will
be
used,
they
need
to
provide
a
vibration
study,
their
alternative
standards
identified
if
vibration
in
inducing
equipment
must
be
used,
and
so
those
are
identified
in
the
proposed
municipal
code.
S
Again,
now
moving
on
to
the
requirements
that
are
prior
to
permit
issuance
with
regard
to
air
quality,
this
is
an
ongoing
requirement
that
we
have
about
controlling
dust
during
construction,
basically
is
to
implement
backbench
requirements,
there's
also
a
requirement
to
control
construction
exhaust
if
you're
considered
a
large
project.
A
large
project
is
something
that
is
on
greater
than
one
acre
or
that
involves
more
than
two
months
of
construction.
S
They
have
to
use
higher
emission
standard
equipment
pursuant
to
batman
requirements.
There
are
also
all
projects
are
also
required
to
use
low,
bocp
in
interior
and
or
architectural
coatings
for
that
project.
S
With
regard
to
hazardous
materials,
if
there
is
soil
remediation
that
is
required,
as
indicated
by
the
base
2
esa,
then
you
know
there's
cleanup
that
would
be
required
through
an
appropriate
agency,
and
there
is
language
in
the
proposed
municipal
code
about
which
agency
they
can
utilize,
there's
also
regarding
greenhouse
gas
emissions
and
energy,
there's
a
requirement
that
the
they
complete
the
climate
action
plan.
There's
a
development
project,
consistency
checklist
that
being
completed
and
provided
with
their
application,
biological
resources,
essentially,
birds.
S
There
are
federal
and
state
requirements
about
protecting
nesting,
birds
and
board
eggs
during
construction,
and
so
it's
essentially
try
to
avoid
the
nesting
season.
But
if
you
can't
avoid
nesting
season
nesting
season
during
construction,
then
you
have
to
conduct
an
initial
pre-construction
survey
to
identify
whether
they're
in
nests
in
the
trees
that
might
be
impacted
by
your
construction.
S
S
If
nesting
birds
or
eggs
are
found,
then
there
must
be
follow-up
surveys
and
those
are
have
to
be
conducted
at
14-day
intervals
and
that
biologist
basically
identifies
a
a
buffer
around
which
you
can't
construct,
or
things
like
that,
to
ensure
that
the
birds
are
not
impacted.
S
There's
also
requirements
about
special
status
use
impact
during
construction.
If
a
building
is
not
secure
and
has
been
vacant
for
a
while,
then
bats
can
actually
roost
in
there
and
so
very
similar
requirements
to
nesting
birds
about
getting
a
biologist,
making
sure
that
if
there
is
a
if
there
are
boosting
bats,
found,
conduct
follow-up
surveys,
there's
official
requirements.
If
the
maternity
roost
is
found-
and
essentially
you
know
whether
it's
birds
or
bats,
you
have
to
follow
the
recommendations
of
the
biologist
if
the
nest
of
either
kind
is
found.
S
Cultural
resources
within
the
city,
it's
divided
into
areas
with
known
or
no
known,
cultural
resources.
If
there
are
no
known
cultural
resources,
then
the
contractor,
the
main
contractor
has
to
provide
materials
to
the
construction,
crew
and
contractors
with
information
on
how
what
site
indicators
could
be,
and
then
laws
pertaining
to
cultural
resources.
S
And
then
there
are
instructions
identified
if
cultural
resources
are
found
on
the
site
with
regard
to
areas
that
have
known
cultural
resources,
those
are
identified
in
the
general
planning
ir
and
essentially
for
those
areas.
You
retain
a
qualified
archaeologist
to
prepare
a
report
on
whether
there
are
how
the
proposed
project
impact
the
cultural
resource.
S
If
something
can
be
done,
how
it
can
be
if
it
cannot
be
constructed
without
impacting
it,
then
you
know
they
have
to
consult
a
tribal
representative.
They
have
to
file
a
report
with
the
california
historical
resource
information
system
and
with
the
city
they
have
to
determine
whether
the
resource
is
eligible
to
be
listed
in
the
register
of
historical
resources
and
basically
identify
ways
to
minimize
effects
to
that
particular
resource.
S
Among
other
cultural
resources,
there
are
human
remains
of
native
american
burials.
There
are
state
requirements
related
to
that
and
any
project
would
have
to
comply
with
those
requirements
and
those
are
written
into
the
proposed
municipal
with
regard
to
hydrology
and
water
quality.
Basically,
the
main
thing
to
do
is
control
stormwater,
runoff
contamination,
and
there
is
a
reference
to
the
city's
existing
requirements
relating
to
stormwater
pollution
prevention
and
watershed
product
protection.
S
With
regard
to
noise
and
vibration,
there
are
some
noticing
and
science
site
signage
requirements
prior
to
start
of
an
activity.
Essentially,
applicants
must
prepare
and
submit
a
construction
noise
plan
to
comply
with
our
already
adopted
standards.
With
regard
to
vibrations,
the
notices
must
be
sent
out
to
within
300
feet
of
the
project
site
and
there
are
requirements
to
conduct
a
pre-construction
surveys
and
then,
after
use
of
the
vibration
surveys,
to
make
sure
that
there
are
no
impacts
to
the
sensitive
receptors.
S
There
are
requirements
related
to
paleontological
resources,
the
requirements
for
what
to
do.
If
you
find
parliamentological
resources
on
site
with
regard
to
utilities
and
service
systems,
we
do
have
a
certain
requirements.
S
Rather,
I
should
say
the
pupuccino
century
districts
had
certain
agreement
with
santa
clara
sanitary
district
and
other
sanitary
districts
about
how
much
peak
wet
weather
flow
can
be
during
when
there
is
wet
weather,
and
so
there's
just
references
to
how
those
can
be
reduced.
Or
how
that
can
you
know
by
reducing
inflow
or
infiltration
within
the
csds
system,
and
also
to
encourage
people
to
increase
onsite
water,
reuse,
just
gray
water
or
to
reduce
water
usage.
S
Overall,
there's
also
a
requirement
to
obtain
a
letter
of
clearance
from
the
genome,
sanitary
district,
which
is
pretty
standard,
and
also
to
ensure
that
there's
adequate
water
supply
and
food
structure
to
obtain
letters
from
the
appropriate
water
service
provider
regarding
the
connections
etc.
S
Any
violations
of
any
of
these
requirements
or
violations
of
the
municipal
code
and
moving
on
to
the
secret
review.
There
was
an
addendum
prepared
to
the
2014
general
finally
ir
which
indicated
there
were
no
subsequent
environmental
reviews
required,
because
there
are
no
substantial
changes
to
the
project.
S
That
would
require
the
pepper
preparation
of
a
new
eir
and
it
concluded
that
significant
and
unavoidable
impacts
of
the
proposed
project
are
no
more
than
what
was
previously
disclosed
or
analyzed
in
the
final
eir.
S
With
regard
to
the
municipal
code,
amendments
there's
a
number
of
sql
exemptions
that
are
found
and
those
are
listed
on
this
page,
and
I
just
want
to
conclude
by
saying
that
the
planning
commission
reviewed
the
item
on
september
28th
of
this
year
and
voted
on
a
401
with
a
commissioner
sharp
absent
to
recommend
that
the
city
council
adopt
the
addendum
the
general
plan
amendments
and
the
municipal
vote
amendments,
and
with
that
I
can
conclude
this
presentation
by
recommending
the
council
adoptees
the
resolution
and
conduct
the
first
reading
of
the
ordinance
and
mr
mayor.
S
I
just
wanted
to
note
that
I
do
have
some
responses
to
some
council
questions
that
were
asked.
If
you
wish
me
to
go
forward
with
those.
C
S
I
have
a
few
slides
here.
There
was
a
question
about
what
is
the
cost
of
construction
management
plan,
the
operational
hra,
the
phase
one
and
the
phase
two
reports
again.
These
reports
are
currently
required
of
discretionary
projects.
S
In
any
case,
many
of
the
costs
are
generic
to
all
these
projects
and
it's
really
hard
to
pass
out
the
cost
for
each
part
each
item,
but
we
do
have
our
consultant
here
and
she
may
be
able
to
help
some
price
tags
to
that
and
this
the
adoption
of
these
standards
is
to
ensure
that
all
ministerial
or
discretionary
projects
provide
these
important
reports
that
are
necessary
for
environmental
protection.
S
There's
a
question
about
vehicle
miles:
traveled:
what?
If
the
project
does
not
comply
with
the
city's
vmt
standards?
What
options
are
available?
There
are
any
number
of
project
improvements
that
will
help
a
project
the
vmt
standard.
These
include
providing
bike
lanes
providing
bus
passes.
These
are
just
some
options
that
will
help
reduce
vmt.
S
What
kinds
of
equipment
will
cause
vibration?
It
seems
that
almost
all
projects
will
need
to
use
some
kind
of
equipment
that
will
cause
vibrations.
So
this
item
covers
almost
all
projects.
What
about
cost
and
length
of
time
to
comply?
There's
actually
specific
equipment
that
are
considered
vibration
generating
these
include
things
like
all.
All
equipment
causes
some
vibration,
but
some
are
actually
damaging
to
buildings
and
other
structures.
S
These
include
vibratory,
rollers
or
pile
driving.
In
any
case,
discretionary
projects
are
required
to
comply
with
requirements
related
to
vibration.
These
would
just
be
codified
to
ensure
that
ministerial
projects
would
be
covered
as
well.
S
We
just
wanted
to
clarify
that
construction
workers
would
be
provided
with
materials
that
help
them
identify
indicators
of
cultural
resources,
and
this
training
would
be
provided
by
the
contractor
to
the
construction
crews
to
make
sure
they
they
understand
how
to
identify
basic
archaeological
site
indicators,
etc.
With
regard
to
paleontological
resource
resources,
there
was
a
question
about
whether
every
project
would
have
to
retain
a
qualified
paleontologist.
S
The
answer
is
basically
that
only
areas
that
are
only
projects
that
are
in
areas
with
known
cultural
resources
would
have
to
retain
a
qualified
paleontologist
with
regard
to
utilities
and
service
systems.
There
was
a
question
about
who
are
the
experts
experts
that
provide
the
reports
related
to
utilities
and
service
systems.
S
S
There
was
also
a
question
about
written
approval
from
the
appropriate
water
service
in
general.
The
utility
provider
does
provide
these.
You
know
letters
to
say
that
they
will
serve
or
they
can
serve
a
project.
In
particular,
there
was
a
question
about
the
general
plan
amendments.
How
many
of
these
refinements
are
new
and
or
upgraded
requirements?
S
There
was
a
thought
that,
though
there
are
no
changes
to
the
intensity
or
density
of
development.
Does
this
add
costs
by
requiring
these
refinements
just
wanted
to
clarify
that
there
are
no
new
or
upgraded
requirements?
The
general
plan
amendments
are
simply
clarifications
to
clarify
the
city's
prior
intent
and
does
not
add
cost
to
the
project.
S
Again,
how
do
we
define
minor
modifications
are
adding
significant,
more
cost?
Consider
minor
modifications?
The
proposed
changes
to
the
general
plan
do
not
add
costs
to
a
development
because
they're
already
required
of
discretionary
projects.
S
The
changes
also
do
not
involve
any
changes
to
the
height
density,
florida
ratio
or
how
development
or
how
much
development
can
occur
on
a
property,
and
so
again
these
are
just
clarifications,
and
none
of
these
proposed
changes
result
in
new
or
more
severe
environmental
impacts
than
those
already
studied
in
the
2014
general,
and
there
are-
and
I
had
my
recommended
action.
I
already
stated
that
before
with
that,
I
conclude
my
presentation:
okay,.
C
P
You're
welcome
so
first,
our
general
plan
in
does
have
a
level
of
service
standard.
I
mean
right
now,
it's
not
required,
but
then
we
are
allowed
to
still
consider
that
and
it
seems
now.
P
S
It
is
my
understanding
that
the
public
works
transportation
department
is
working
on
some
sort
of,
or
maybe
working
on,
something
related
to
a
level
of
service.
At
this
point,
that
is
not
being
considered
with
this
particular
municipal
code
amendment,
but
any
anything
that
the
council
adopts
can
be
inserted
into
this
particular
after
in
the
future,
as
in
one
council.
This.
S
I
know
that
they're
working
on
a
city
guide
and
city-wide
inventory
of
emt
and
that
might
somehow
play
into
this
los
standard
again.
That
is
something
that's
high,
so.
P
The
vmt,
what
their,
what
a
question
was
in,
if,
if
they
don't
satisfy
the
epmt
requirement,
they
can
do
mitigation,
but
if
they
need
to
do
mitigation,
can
they
still
do
the
minister
approval,
because
who
can
decide
that
whether
their
mitigation
method
of
using
bus
pass
and
bike
is
satisfactory?.
S
So
in
terms
of
the
I,
I
don't
want
to
use
the
word
mitigation,
because
that
is
a
a
term
used
for
sql
review.
S
These
are
just
environmental
protection
standards
that
the
city
is
choosing
to
adopt
with
regard
to
how
much
reduction
they
see
in
bmt,
by
providing
bus
passes
or
by
providing
bike
lanes,
and
things
like
that
that
is,
that
has
to
be
based
in
certain
scientific
data,
and
I
know
that
is
built
into
vmt
tools
and
and
studies
that
have
already
occurred.
So
those
are
pretty
specified
in
past
studies.
P
S
Discretionary,
so
how
much
reduction
one
sees
in
bmt
by
providing
bus
passes
or
by
providing
bike
lanes
have
been
studied
extensively
and
those
reductions
are
what
they
would
see
in
their
vmt
study.
It's
not
as
though
they
can
claim
a
much
higher
reduction
by
providing
the
bus
classes,
but
they
certainly
have
a
many
options
to
pick
from.
Yes.
In
order
to.
P
Have
they
studied
extensively,
but
do
they
do
these
studies
applied
to
cupertino.
S
So
that
is
something
again
in
terms
of
how
we
can
formulate
this,
for
a
ministerial
project
is
how
we've
written
it
up
at
this
point,
and
this
is
something
that
my
understanding
is,
that
the
transportation
department
is
going
to
go
into
deeper
with
their
city-wide.
You
know.
P
That's
still
very
discretionary.
Okay,
we
started
guarding
the.
I
think
we
had
an
issue
with
our
only
streamlined
project
that
it
was
on
the
court
easy
list
or
it's
not,
and
there
was
a
confusion
so
with
what
we
are
proposing.
You
are
proposing
here
clarify
that
for
future
projects.
We
know
exactly
what
so
the
you
are
requiring
more
report.
Will
they
be
need
to
be
submitted
before
they
propose
a
project
or
is
that
would
that
be
after.
S
And
all
of
these
requirements
are,
we
can
only
meet
requirements
of
the
project
when
they
apply.
We
cannot
make
requirements
of
a
project
that
has
not
applied
for
a
while
yeah.
Q
Thank
you,
amer
paul
this.
This
might
take
us
a
second
to
pull
up,
but
the
there
was
a
map
that
was
referenced.
The
bay
area,
air
quality
management,
district
planning,
healthy
places
map.
If,
if
somebody
could
pull
that
up,
I
would
appreciate
it
and
and
there's
there's
a
couple
of
reasons
why
one
is
that
there
was
a
valco
specific
plan
which
did
show
that
there
were
air
quality
impacts
along
wolf
road
and
that
map
does
not
indicate
it.
Q
And
the
second
issue
that
I
see
is
that
we've
fairly
recently
had
the
council
approval
of
the
the
westport
project,
and
I
see
that
that
entire
property
is
within
within
the
area
where
they
want
you
to
implement
best
practices,
and
that
would
be
to
install
air
filters,
merv,
13
or
higher,
and,
to
my
recollection,
we
did
not
have
any
of
any
of
those
improved
filtration
filters
required
for
that
property
and
the
entire
property
is
within
within
that
area.
Q
So
I'm
concerned
about
that,
because
it's
a
a
senior
living
area,
assisted
living
area
and
now
we're
finding
out
that
when
we
had,
we
approved
it
after
this
they
would
have
had
the
merv
13
automatically
required.
I
think
so.
I'm
a
little
surprised
that
this
didn't
pop
up
before
so
the
two
two
things
is
that
I'm
concerned
about
the
the
wolf
road
air
quality
issue
and
that
it's
it's
not
including
this
so
is.
Did
I
stall
enough
to
get
the
map
up.
Q
Well,
just
take
my
word
forward.
All
the
major
all
the
major
members
are
in
that
implement
best
practices
for
the
air
quality
because
they
were
impacted
either
from
the
freeway
stevens
creek
boulevard
or
the
85
through
the
city.
That's
the
first
part.
I've
only
got
five
minutes,
so
I'm
gonna,
I'm
gonna
quickly.
Q
Move
on
to
the
second
part,
which
I
have
a
issue
with
a
serious
issue
with,
is
that
our
resolution
says
that
since
the
certification
of
the
final
eir,
the
city
has
proposed
certain
refinements
to
the
project
consisting
of
clarifications.
Q
It
has
existed
of
the
existing
language
in
the
general
plan
without
any
changes
to
the
intensity
or
density
of
development
and
there's
another
section
written
about
the
saying
that
there's
no
change
to
intensity
and
density
and
the
problem
there
is
that
our
eir,
that
was
approved
certified
in
2014,
had
for
the
balco
site,
800
maximum
residential
units
and
the
2
million
square
feet
of
office,
and
it
had
heights
maximum
heights
depending
on
where
you
are
in
the
project
of
85
feet
or
160
feet,
and
that
is
if
certain
requirements
were
met
like
having
ground
floor
retail
and
and
the
like.
Q
So
the
issue
I
take
is
that
we
now
have
new
significant
different
information
about
the
development
of
that
site.
So
you've
got
three
times
as
many
residential
units
and
to
me
that
seems
to
throw
us
into
the
category
of
needing
a
supplement
to
the
eir,
not
just
this
addendum,
but
having
to
do
some
actual
serious
updates,
and
I
was
wondering
if
the
attorney
could
comment
on
that.
Thank
you.
G
Yeah,
so
a
couple
of
responses
to
that.
Thank
you,
councilmember
moore,
so
so
so,
you're
absolutely
correct
that
the
eir
didn't
include
the
the
level
of
intensity
that
we're
seeing
at
the
the
falco
development.
G
However,
when
you
look
citywide,
the
eir
did
consider,
impacts
that
are
are
consistent
with
with
what
we're
seeing
and
so
there
isn't
any
new
information
that
that
would
really
indicate
that
there
is
a
more
severe
or
different
environmental
impact
that
was
studied
in
the
eir
and
that
that's
the
standard
for
preparing
a
supplemental
eir
instead
of
an
addendum
there's
also
a
case
law
that
that
implies
that
there,
but
there's
required
to
be
a
nexus
between
the
changes
to
the
project
and
the
new
information.
And
you
know.
G
Specifically,
I
would
also
add-
and
this
was
was
added
to
the
staff
report
that
went
to
council-
that
you
know
independently
of
the
addendum-
that
the
you
know
that
these
changes
are
as
a
standalone
project
would
be
exempt
from
c
both
because
there
is
a
specific
exemption
for
in
environmental
regulatory
measures
that
that
covers
the
objective
environmental
standards
and
then
overall,
the
the
the
common
sense
objection
that
they're
that
there
could
not
be
given
the
nature
of
these
changes.
G
There
could
not
be
a
significant
impact
to
the
environment,
so
both
of
those
exemptions,
either
at
least
collectively,
would
cover
the
project.
So
staff
took
a
more
conservative
approach
by
preparing
an
addendum
here,
but
I
I
do
believe
that
the
project
is
exempt
from
sql
as
well,
and
and
council
could
could
take
a
building,
suspenders
approach
to
sql
compliance
and
that's
what
we're
recommending.
Q
Okay
and
this-
and
this
does
save
the
city
money-
basically,
if,
if
you're
able
to
assert
that
it
is
following
the
the
letter
of
the
law,
then
that
we
can
just
do
the
addendum
and
that
we're
we
are
not
subject
to
a
challenge.
G
Yes,
I
I
think
that
we
are
are
on
sound
legal
ground.
It
would
take
obviously
additional
money,
hiring
a
consultant
and
as
well
as
time,
to
prepare
a
supplemental
eir.
The
addendum
is
a
streamlined
process,
so
I
think
we're
on
sound
legal
ground
both
with
respect
to
the
addendum
and
with
respect
to
the
exemptions.
Q
Okay,
okay,
I
do
find
it
a
bit
confusing
because
they
studied
800
residential
units
at
that
location
and
now
they're
at
2402,
which
were
never
studied
and
you've
added
the
30
acre
green
roof,
which
was
never
a
part
of
the
the
general
plan
but
you're
certain
that
we're
on
a
good
legal
ground
despite
a
triple
increase
there.
Okay,
all
right!
Thank
you.
H
Yeah,
you
know
the
the
one
resident
that
spoke
during
public
comment.
You
know
reminded
us
about
concerns
with
exercises
and
also
privacy
protection
are
those
in
the
work
plan.
That's
in
process,
because
you
know,
can
you
clarify
that
portion.
S
I
can
try
to
with
regard
to
deck
sizes,
and
possibly
that
is
something
that
we
could.
We
could
consider
with
any
sb9
updates,
considering
all
lots
could
be
sub
split
and
subdivided,
and
but
with
regard
to
an
r1
ordinance
updates
in
general.
That
is
not
on
the
work
program
at
this
time,
and
it
could
be
something
that
the
council
could
prioritize
for
the
upcoming
fiscal
year.
H
Okay,
I'll
make
a
note
of
that.
Can
you
give
us
a
brief
idea
of
what
is
being
considered
in
the
general
in
the
work
plan
item?
That's
currently
being
worked
on.
S
G
S
S
H
That's
my
memory
is
that
there
were
three
different
categories
and
back
in
that
time
there
was
no
sp9,
and
so
ones
that
are,
you
know,
perhaps
not
being
covered
tonight.
I
would
have
expected
them
to
be
covered.
You
know,
under
the
work
plan
you
know,
based
on
the
original,
the
original
verbiage
from
city
staff
about
you
know,
there
were
three
categories
of
changes
based
on
complexity.
S
So
that
was
the
original
suggestion
from
staff,
and
then
the
council
authorized
the
city
manager
and
the
city
attorney
to
go
forward
and
re-prioritize
all
the
items
that
were
on
the
list
and
that's
where
we
came
out
with
the
six
categories,
which
was
you
know,
things
that
could
be
completed
now,
which
is
what
was
being
presented
tonight,
things
that
have
already
been
completed
or
moving
forward.
So
the
six
categories
that
I
originally
talked
about
at
the
beginning
of
this
presentation.
S
There
are
a
number
of
items
that
need
to
be
considered
with
the
housing
element
update
because
of
concerns
related
to
spp30
and
other
state
laws
and
there's
many
items
that
have
already
been
completed
that
is
identified
in
attachment
c.
There
are
some
items
that
are,
you
know,
ongoing
work
program,
items
that
include
design
standards.
That
is
a
project
that
is
ongoing.
S
There
is
updates
to
the
density
bonus
ordinance.
We
just
need
to
reevaluate
whether
those
can
be
done,
considering
all
that's
happening
at
the
state
level,
with
new
laws.
So
so
all
of
these
have
been
kind
of
prioritized
based
on
how
they
interact
with
existing
state
laws,
or
you
adopted
state
laws.
H
Yeah,
so
I
mean,
if
I
point
out
to
just
we'll
point
to
just
one
of
the
topics
that
you
brought
up
the
design
standards
I
mean
yeah.
I
think
some
of
our
concerns
were
you
know
the
objectiveness
of
some
of
the
design
standards,
and
so
I
think
it
would
be
good
for
us
to
know
you
know
what
is
or
is
not.
I
mean
if
tonight's,
the
end
all
other
than
for
sb9
or
other
than
the
housing
element
I
mean
even
with
those
maybe
more
the
housing
element.
H
We
should
know
what
is
being
looked
at.
You
know
the
list
so
that
we
could
identify.
Did
we
capture
it?
Is
staff
capturing
everything
if
they're
not
capturing
everything
and
at
the
next
review
or
housing
element.
I'd
really
like
to
be
sure
that
we're
not
going
to
be
scratching
our
head
and
saying
what
happened
to
these
other
items.
H
S
That
the
work
program
is
already
adopted
by
the
council,
and
so
that
is
certainly
you
know
available
online.
We
also
have
that
list
is
available
in
attachment
c.
When
we
talk
to
our
planning
consultant
as
we
are
evaluating
our
housing
element,
we
will
be
going
through
all
the
items
that
are
identified
in
that
list
that
are
identified
as
consider
in
conjunction
with
the
housing
element
update.
S
So
we
will
be
going
through
that
list
and
considering
whether
there
are
any
changes
we
can
make
to
our
standards
or
any
of
our
policies
with
regard
to
all
the
items
that
are
identified
in
that
list.
So
with
regard
to
you
know
your
concerns
about
single
family
decks
in
general.
That
is
not
an
objective
standard
concern
from
a
streamlining
perspective,
member
willie.
That
is
a
you
know.
That
is
something
that
is
discretionary
at
the
at
the
council's,
or
you
know
discretion
if
there
are
certain
concerns
related
to
that.
S
R
Thank
you
very
much
pew.
Thank
you,
councilman
willie,
for
raising
the
questions.
We
will
be
back
in
at
your
next
meeting
with
an
update
of
the
work
program
for
the
city
council.
If
there's
specific
issues
you'd
like
addressed
as
we
fulfill
that
work
program,
we
can
pursue
those
based
on
council
direction
at
that
time,
or
we
can
add
them
to
future
work
programs.
R
I
did
want
to
reiterate
that
sb9
was
dropped
in
city's
laps
unexpectedly
by
the
legislature
and
governor,
so
we
are
moving
that
up
the
priority
list
and
bringing
that
as
well
to
your
next
council
meeting
in
terms
of
the
issues
before
you
tonight.
We
have
a
set
of
amendments
and
adjustments
that
have
been
unanimously
recommended
by
the
planning
commission
that
we
ask
you
to
focus
on
given
the
constraints
of
the
brown
act
and
that
further
work
be
considered
in
the
work
program.
Discussion
coming
forward.
H
It
sounds
good.
I
I'm
just
still
a
little
bit
concerned
that
there
are
some
pretty
big
cracks
for
things
to
fall
through.
I'm
still
absolutely
you
know
I
mean
we
had.
You
know
a
real
eye,
opener.
H
You
know
a
couple
years
ago
when
we
found
that
you
know
without
objective
standards,
we're
we're
just
at
the
mercy,
and
so
we
pointed
out,
you
know
a
lot
of
them,
but
I'm
just
not
really
certain
that
all
the
ones
that
we
have
heard
prior
that
are
now
complete
or
the
ones
added
that
are
being
worked
on
tonight,
capture
everything
and
when
we
say
well,
sb9
or
the
housing
element,
while
it's
possible
that
some
of
our
concerns,
you
know
wind
up
in
those
two
categories.
H
I'll
look
at
the
attachment
and
try
and
see
if,
if
there's
any,
but
I
would
hope
each
of
us
on
the
council
would
try
our
best
to
jog
our
memory
and
and
prevent
things
from
falling
through
the
crack
and.
C
Appreciate
that
yeah,
so
I
I
basically
pushed
over
all
my
time
to
overage
here,
councilmember
way
we
haven't
heard
from
you,
so
let
me
let
me
go
to
you
first.
E
Thank
you,
mayor
paul,
so
I
have
a
couple
of
questions.
Maybe
can
be
answered
really
quick
and
maybe
just
a
general
comment.
So
I
is
the
all
the
inspections,
orders
and
surveys
that
has
to
order
these
are
for
non-residential
project
and
residential
project
of
formal
unit
units.
All
right
is
this
correct.
E
S
No,
so
so,
if
you
are
for
a
fewer
units,
you
would
still
have
to
provide
the
esa.
We
have
to
do
all
of
it.
S
E
I
see
so
back
to
council
member
willie's
question
so
if
it's
a
sb9
project
that
they
split
the
lot
into
two
two
areas,
so
that's
this
is
all
covered
correct!
Oh
okay!
So
that's
my
first
question.
The
second
one
is
all
this
really
and
you
know
environmental
standard
environmental
protection
requirements.
Are
they
state
required
or
are
they
specific?
Are
city
required.
S
So
you
know
I
let
me
bring
terry
mccracken
a
terrier.
If
you
could
answer
that
question,
I
knew
you
probably
will
be
better
people
to
answer
that.
B
Yeah
I'll
be
happy
to
the
requirements
that
we
came
up
with
were
all
they're,
all
federal
or
state
laws
right
now
that
are
currently
required.
So
the
purpose
is
again
to
clarify
and
make
sure
like
you're
saying
tonight:
they
don't
fall
through
the
cracks.
E
Okay,
so
my
next
question
is
a
general
comment.
I
feel
residential
project
of
four
more
units.
If
there
are
four
units,
I
feel
there
are
small
that
they're
they're,
not
major
developers,
they're
small
developers,
to
of
all
this
refinement.
E
E
It
might
defer
a
lot
of
smaller
family
project
that
they
just
don't
want
to
do
it
or
they
feel
that
it's
too
much
thing
and
they
might
push
them
to
sell
it
to
a
bigger
developer,
and
is
that
something
that
could
happen?
Is
this
too?
My
sense?
Is
there
a
lot
of
reports
a
lot
of
things
they
need
to
do?
Are
these
really
customary
their
state
federal
required?
It's
not
like
too
much
for
them
to
comply.
S
It's
pretty
standard,
you
know.
An
esa
report,
for
example,
is
generally
prepared
when
property
sells
is
my
understanding
when
there's
property
transfer
generally
banks
and
other
entities
require
asa
phase
one
report,
and
so
you
know
it's
not
something
that
is
out
of
ordinary
for
cities
to
require
in
development.
E
B
Yeah,
a
health
risk
assessment
is
really
just
looking
at
what
are
the
there
there's
a
lot
of
things
that
you
could
look
at,
but
it's
primarily
looking
at
like
air
particulate
matter
and
again,
my
area
of
expertise
is
sequoia,
so
we're
usually
concerned
about
in
sql
the
impact
of
the
project
on
the
environment.
So
we
want
to
make
sure
that
diesel,
particulate
matter
or
other
air
pollutants
are
not
causing
harm
to
a
neighboring
use.
B
So
the
health
risk
assessment
is
try
to
determine
what
equipment's
going
to
be
used.
How
much
grading
is
going
to
occur
like
what
is
going
to
be
the
disturbance,
that's
going
to
cause
that
pollution?
So
that's
the
health
risk
assessment.
There's
two
kinds
of
health
risk
assessment,
though
there's
a
construction
one
which
would
be
sql
oriented,
is
the
project
gonna
cause
it
on
the
environment.
B
What's
in
what's
presented
here
is
also
the
operational.
So
this
is
something
that
you
wouldn't
get
in
a
sql
document.
It's
whether
the
project
itself
is
going
if
the
environment
is
going
to
affect
the
the
project-
and
this
goes
back
to
kind
of
like
the
healthy.
The
map
that
kitty
was
talking
about
councilmember,
moore.
E
B
It
it
depends,
there's
criteria
that
you
have
to
meet
the
standards
for
so
we've
tried
to
spell
out
some
of
that
criteria.
You
have
to
be
within
a
certain
proximity.
You
have
to
use
a
certain
type
of
equipment-
okay,
so
it's
not
just
you
don't
just
have
to
blanket
like
do
one.
You
have
to
check
the
check
the
list.
E
All
right,
one
last
question:
just
generally
speaking
so
the
these
requirements
they
can
easily,
I
mean
the
reports,
people
they
can
easily
have
experts
access
to
experts
to
do
it.
E
So
I'm
sorry
question
my
question
is
say:
if
I'm
a
homeowner
and
I
bought
a
piece
of
land
and
I
want
to
rebuild
a
home,
I
look
at
all
these.
Are
they?
If
I
say
I
asked
come
to
the
city
ask?
Well,
I
don't
know
where
to
get
a
house
risk
assessment.
I
don't
know
how
to
get
a.
You
know:
construction
management
plan.
The
city
will
be
able
to
provide
me
with
resources,
so
I
can
go
get
them.
S
So
in
general,
I
do
want
to
again
reiterate
if
you're
a
single
family,
home
and
you're
replacing
a
single
family
home
there
are
some
of
these
reports
that
you
don't
have
to
do.
A
construction
management
plan
is
something
a
contractor
can
pull
together
fairly
easily.
These
are
fairly
standard
requirements.
S
You
know,
so
there
are
templates
out
there
that
you
can
pull
together.
There's
a
bunch
of
resources
out
there
that
one
can
put
together
a
construction
management
plan.
E
Okay,
so
my
question
is
the
city
can
help
any
homeowner
or
any
construction
small
businesses
to
to
require
to
fulfill
all
these
requirements.
C
All
right,
thanks,
spouse
from
our
way
we're
pretty
much
exhausted
of
time
all
around
I'll.
Get
to
you
vice
versa,
but
be
brief
in
your
follow-ups.
I
have
a
a
very,
very
straightforward
question.
So,
as
I
had
mentioned
earlier,
I
was
following
you
know
the
the
progress
of
some
of
the
concerns
that
council
member
willie
had
over
a
particular
project,
and
I
think
another
council
member
pointed
out
that
that
was
shown
in
a
photograph
earlier
in
public
comment
tonight.
C
You
know
I
I
wonder
when
you're
looking
at
something
like
an
architectural
feature
that
is
not
supposed
to
be
occupied
or
usable,
how
does
that
slip
through
our
enforcement
mechanism
and
if
it
was
slipping
before,
has
something
changed
where
we
can
have
that
kind
of
sense
that
it
won't
happen
again
in
the
future
and
so
collateral
to
that
question
is:
are
there
some
very
clearly
referenceable
things
like
compliance
checklists,
that
we
can
objectively
look
at
to
make
a
determination
of
how
our
city
is
going
about
determining
whether
these
requirements
are
being
met.
T
No
yeah,
mr
mayor
benford,
church
community.
I
can
respond
to
that
very
quickly
that
hasn't
that
hasn't
occurred
in
recent
past.
I
can't
speak
to
how
it
may
have
occurred
for
a
project.
I
think
it's
different
staffing
back.
Then
we
have
a
different
planning
manager
now,
so
I
can't
really
speak
to
how
it
actually
happen.
I
can
only
speak
to
it
that
hasn't
happened
in
more
recent
years.
C
Well,
so
so
give
us
a
sense
inside
the
department
how
the
compliance
is
being
enforced
in
a
way
that
perhaps
it
wasn't
you
know,
are
we
using
the
same
checklist?
Are
we
using
the
same?
You
know,
mechanisms
of
ensuring
that
compliance.
I
I
mean
the
personnel
has
changed,
but
I'm
not
really
certain.
If
that
really
speaks
to
how
we're
perhaps
approaching
you
know
particular
particular
tools
that
we're
using,
because
I
don't
think
we
have
that
much
transparency
as
to
how
this
compliance
process
is,
is
being
insured.
T
Sure
I
can
respond
to
that
as
well
apologize.
It
wasn't
clear
enough.
I
wasn't
blaming
on
just
personal
change.
I
think,
with
personal
change
and
leadership
change
you
have.
Policies
are
changing
as
well.
We
have
developed
checklists
internally
to
ensure
that
projects
are
reviewed
on
a
consistent
basis,
so
implemented
fairly
to
all
the
projects,
same
district
and
the
same
requirements.
T
So
we
have
developed
new
checklists.
We
have
so
that's
one
way
for
us
to
kind
of
catch.
These
things
on
early
in
a
plane
review
process
also
reviewing
the
condition
approval
as
well.
So
we
do
have
new
new
developments
of
those,
and
also
two
is
with
I
apologize
and
also
with.
C
Those
checklists
and
your
your
processes
is
that
something
that
could
be
prepared
for
us
to
get
a
sense
of
you
know
what
that
what
that
process
looks
like
internally.
T
Sure
and
when
a
project
is
assigned
to
a
planner
planner
will
utilize
that
that
checklist
verify
the
project
against
a
checklist.
A
checklist
then
gets
confirmed
and
evaluated
by
the
planning
manager
to
make
sure
that
we
have
double
survives
on
the
evaluation
of
the
project,
so
that
is
a
new
process,
new
ish
of
the
last
four
or
five
years
or
so.
So
that's
that's
something!
That's
that's
different!
T
C
T
C
T
Too,
is
is
been
a
helpful
tourism
electronic
review,
so
we
we've
had
the
electronic
submittals,
so
that
makes
the
revaluation
of
plans
and
verification
those
things
a
lot
quicker,
not
easier
and
accessible
both
in
the
office
and
also
on
site
in
terms
of
conditions,
approval
on
the
planning
and
building
side
of
things
we
both
have.
We
have
a
staff
that
does
inspection.
Obviously,
you
have
billing
inspectors.
T
C
We
have
a
definition
of
an
architectural
feature
who
is
ensuring
more
compliance,
who's
going
out
there
and
examining
the
actual
site
and
going
okay
this?
This
was
a
satisfactory
architectural
feature
and
you,
you
indicated
an
internal
review
of
some
decision,
that's
made,
but
but
how
does
that?
How
does
that
operate
and
is
it
operating
differently
now
than
it
was
say
four
or
five
years
ago?.
T
S
No,
I
was
just
going
to
add
that
we
do
do
a
final
planning
review
prior
to
a
certificate
of
occupancy,
to
make
sure
that
you
know
architectural
features.
C
Oh
so
so
greg.
I
I
see
that
one
of
the
red
lines
on
slide
page
seven
actually
has
two
sentences
where
they
state
they're,
adding
quote
architectural
features
that
do
not
include
usable
area
may
encroach
into
the
slope
line.
My
questions
are
directly
relevant
to
those
changes,
so
I'm
not
sure
why
this
wouldn't
be
subject
to
the
purview
of
our
our
of
our
questions
regarding
this.
G
I
think
the
question
is
just
how
you
know
how
far
you
know
we're
going
from
from
the
matter
that's
being
proposed
into
code
enforcement
concerns,
and
so
I
I
mean
I
do
think
you
know
the
general
question.
G
C
Sure,
but
to
help
me
understand
how
this
is
going
to
impact
our
city.
I'd
like
to
get
some
clarification
as
to
I
I
mean
I'm,
not
okay,
well,
in
any
event,
if,
if
I
can
get
an
answer
to
that,
I'd
appreciate
it,
because
I
I
think
it's
obviously
material
to
our
understanding
of
how
this
sentence
will.
C
You
know
affect
this,
because
this
operative
document.
S
So
I
was,
as
I
was
mentioning
just
to
wrap
up.
We
were
just
we
do
be
planning
final
inspections
and
to
verify
that
the
space
that
was
proposed
as
another
that
would
be
proposed
in
an
architectural
feature
would
not
would
continue
to
be
one.
But
again,
I
would
like
to
also
point
out
that,
with
this
change,
we
are
actually
allowing
architectural
features
to
to
go
into
the
slope
line,
whereas
earlier
it
talked
only
about
the
primary
bulk
and
it
didn't
necessarily
identify
that
only
architectural
features
could
encroach.
C
S
We
also
define
usable
area,
and
so
again,
if
it
is
things
like
a
chimney,
if
it
is
like
a
little
the
window,
which
is
not
usable
not
like
an
extension
of
floor
area
or
if
it
is
truly
just
like
a
little
juliet
balcony
or
things
like
that.
That
truly
do
add.
Architectural
in
crystal
building
are
what
is
considered
architectural
features
and
not
spaces
where
you
could
actually
put
a
desk
or
a
nook
or
things
like
that.
C
Okay,
so
so
suffice
to
say
these
types
of
compliance
requirements
are
not
like
other
portions
of
our
municipal
ordinance,
where,
where
enforcement
is
complaint
driven
correct,
I
mean
these
need
to
be
complied
with
from
the
outset,
and
somebody
needs
to
do
their
job
to
ensure
that
compliance.
C
All
right
vice
mayor
ciao,
you
have
your
hand
raised.
C
From
from
the
five
minutes,
you
used
quite
a
bit
of
time
earlier
that
it
wasn't
timing,
but
from
that
five
minutes
I
only
have
you
at
21
seconds,
but
we'll
give
you
a
couple
more
minutes
beyond
that.
P
Thank
you.
So
the
question
is
regarding
speech:
330,
it
used
to
be
that
project
is
deemed
when
the
project
is
deemed
complete.
It
locks
in
the
zoning
and
standards
at
that
time,
but
this
bill
would
allow
a
project
to
lock
in
the
standard
with
only
a
preliminary
application.
P
So
have
we
adopted
anything
to
to
specify
what's
preliminary,
that
they
will
be
locking
in.
G
P
G
G
P
And
that's:
okay!
I
don't
have
much
time.
Please
give
me
an
update
on
what
our
current
standard
for
preliminary
application
and
the
question
is.
There
is
one
slide
that
says
we
are
adding
strongly
to
encourage
santa
clara
county
with
to
communicate
with
affected
neighborhoods,
so
adding
strongly
versus
just
encourage
encourage.
What
do
we
expect
that
they
will
do
differently.
P
S
I
can
try
to
attempt
to
answer
that
in
terms
of
that
particular
proposed
language.
It
did
come
from
a
member
of
the
public.
We
kind
of
ran
with
what
that
member
of
the
public
wished
for
this
particular
general
plan
strategy
to
say:
if
the
council
wishes
to
you
know,
add
any
more
qualifiers
or
any
other
direction
it
could.
But
we
we're
trying
to
defer
to
that
particular
public.
S
P
We
can
think
about
that
later
and
then,
in
terms
of
property
research,
I
think
one
concern
with
the
falco
project
was
the
property
research
wasn't
done?
P
The
the
report
was
like
two
or
three
years
old
in
terms
of
property
line,
easement
deed
restriction.
So
do
we
have
any
requirement
that
they
need
to
provide
those
that's
within
certain
day
of
when
they
submit
the
application.
S
For
example
for
title
reports
we
like
to
see
title
reports
that
are
within,
I
believe
it
is
a
year
that
is
standard
practice
as
an
industry
standard
so
for
usa
reports.
That
is
something
that
we
would
consult
with
terry
and
figure
out
a
time
and
put
that
in
our
application.
P
Forms
great,
thank
you
last
question.
So
attachment
c
is
a
list
of
the.
I
think
the
list
we
had
and
they
separated
into
five
categories.
Could
we
get
an
update
of
the
status
for
each
of
these
items?
I
and
my
understanding
is
what
we
are
doing
today
is
part
of
this
immediate
completion
and
the
next
category.
P
Current
work
program
items
refer
to
not
this
year's
work
program,
but
2021
work
program
from
last
year.
So
I'm
really
confused.
Are
these
done
no
or
not?
So
maybe
you
can
give
me
an
update
later
and
this
completed.
That's
fine
and
then
we
have
housing
elements,
part
that
it
says
fy2223,
but
probably
that's
your
typo
down
now.
Okay,
that's
fine!
P
So
should
maybe
I'm
thinking
there
are
possible
work
program,
I'm
thinking.
Maybe
the
city
council
should
have
a
study
session
to
go
through
this
and
prioritize
again
because
this
is
kind
of
from
before,
and
we
have
two
new
council
members
here
right
so
yeah
sorry,
don't
know
you
can
answer.
So
I'm
I'm
down
here.
Yeah.
S
With
regard
to
the
current
work
program
items,
I
just
wanted
to
add
that
the
everything
that's
labeled
design
guidelines-
you
know
that
is
an
ongoing
work
program
item
from
the
fiscal
year,
2021
that
is
rolled
into
this
year
that
has
not
completed
we.
The
council
approved
the
contract
in
april
this
year,
so
that
work
is
ongoing
density
bonus,
stuff.
We
have
to
reevaluate
those,
you
know,
requests
and
suggestions
to
make
sure
we
don't
run
afoul
of
current
state
law
or
any
other
requirements.
S
The
other,
the
heart
of
the
city,
work,
work
program
item
is
on
hold
of
sorts
because
we're
waiting
to
see
what
happens
with
the
housing
element-
and
we
might
you
know
we
might
have
to
reevaluate
how
to
update
all
that
we
have
to
with
regard
to
that,
and
then
we
also
you
know
there
is
the
council:
has
a
work
program
item
update
at
its
next
meeting,
so
I'm
sure
we
can
talk
more
about
it.
Then.
C
Okay,
let's
go
into
councilmember
more
councilmember
moore.
Did
you
have
some
brief
follow-up
questions
or
comments
or
questions
clarifying
here.
Q
Yes,
a
couple
of
things
I
was
wondering
if
air
quality
monitors
could
be
added
to
there.
There
was
one
of
the
sections
on
air
quality
perimeter.
Air
quality
monitors
during
demolition.
Q
If
that's
a
possibility
somehow
to
work
that
in-
and
I
was
also-
I
did-
have
input
already
on
on
these
items-
so
I
am
in
that
the
matrix
already
for
suggestions,
but
one
of
one
of
the
ideas
from
the
planning
commission
was
to
not
just
have
the
setbacks
be
on
the
boulevards,
but
we
wanted
some
other
roadways
to
be
included,
and
I
I
cannot
remember
what
they
were
called
at
the
moment,
but
I
was
wondering
why
that
that
wasn't
added
in
at
this
time
or
is
the
idea
that
we're
going
to
revisit
this
again
next
year
and
and
add
in
more
items
at
that
time?.
S
Q
This
the
slope
staying
under
the
like
the
one
to
one
slow,
correct.
Q
S
Are
already
setback
and
other
setback
requirements
on
properties
along
those
particular
streets.
Q
Okay,
okay,
that's
fine,
and
what
about
the
the
air
quality
monitors
and
I
have
a
kind
of
a
more
specific
type
of
question
for
terry
mccracken,
and
maybe
these
both
will
go
to
terry.
Can
we
ask
for
having
air
quality
monitors
around
these
these
larger
construction
sites,
and
then
I'm
just
wondering
as
a
process?
Let's
say
we
have
a
an
active
dry,
cleaner,
that's
there
that
has
just
recently
closed
and
that's
that's
a
project.
That's
that
is
subject
to
these
new
rules.
Q
I'm
going
to
assume
a
phase.
One
esa
is
going
to
find
a
wreck
recognize
an
environmental
condition
there,
because
it's
a
dry,
cleaner.
Let's
say
it's
been
there
for
50
years.
So
what
would
happen
next?
Would
they
be
required
to
have
a
phase
two
environmental
site
assessment
or
or
what
would
happen?
Q
And
then
I
have
a
kind
of
a
separate,
separate
one
which
is
where,
where
the
dry
cleaner
is
gone,
it
had,
it
was
used
to
be
there.
It
vanished
in
we'll,
say
the
1980s.
It
was
never
listed
anywhere
for
having
hazardous
materials.
All
you
have
is
a
directory
listing.
Q
Is
there
any
way
that
that
would
be
flagged
to
have
soil
testing
and
a
phase
two
environmental
site
assessment?
Thank
you.
B
Okay,
let's
see
if
I
can
break
these
down,
I
think
the
the
what
you're
asking
about
like
the
dry
cleaning,
that
the
phase
one
would
recognize
that
and
then
they
would
recommend
the
phase
two
all
of
phase
one.
The
phase
one
is
really
just
a
very
sophisticated
existing
conditions
report.
It
just
tells
you
what's
there
and
it
runs.
B
You
know
the
the
searches
through
all
the
different
databases,
and
so
it
should
recognize
that
use
and
then
recognize
because
of
that
use,
here's
what
needs
to
be
done
to
clean
it
up,
and
so
then
you
probably
need
to
do
some
kind
of
sampling,
because-
and
that
might
maybe
answered
both
your
questions,
I'm
not
sure
because
it
should
pull
up.
If
something
was
there
15
years
ago
or
30
years
ago,
that
the
records
go
back
pretty
far.
Q
Okay-
okay,
that's
good,
so
that
that
would
mean
that
these
these
particular
sites
or
would
need
to
have
at
like
the
edr
database
search,
run.
Q
Okay
and
any
idea
what
that
costs
just
curious.
B
You
know
the
phase
one
it
really.
The
cost
is
dependent
on
the
size
and
the
type
of
use.
So
let's
say
it
was
just
the
the
the
dry
cleaning
that
was
going
to
be.
You
know
changed
to
a
different
use.
Now
it's
going
to
be
a
daycare,
it
would
be
a
very
nominal
fee
like
we
would
run
like
place.
Works
would
run
a
report
like
that,
for
maybe
a
thousand
you
know
time
labor
research,
but
if
you
had
to
do
something
like
I
don't
know
about
comal
and
do
a
phase
one.
Q
Okay
and
going
back
to
the
first
question,
is
there
some
way
that
we
can
require
air
quality
monitors
on
the
perimeter
of
large
sites
and,
what's
the
for,
with
regards
to
demolition
and
fugitive
deaths
to
what's
the,
if
you
did
have
it,
would
it
just
be
giving
you
a
reading,
saying
yeah?
It's
really
dusty
out
here,
sorry
to
hear
that
or
does
it
have
any
teeth
associated
with
it.
B
That's
a
really
good
question.
I
would
have
to
go
back
and
actually
ask
one
of
our
experts.
We
haven't
ever
required
air
quality
monitors
like
the
one
you're
talking
about
like
what
we
see
in
purple-
purple
air,
for
example,
if
you're
familiar
with
that
one,
but
I
think
it
might
do
exactly
what
you
just
said:
it's
dusty
during
grading
and
so
you're
picking
up
dust,
and
so
but
it
might
be
your
trigger
to
actually
you
know
water,
the
site,
but
I
think
it's
a
really
good
question
I
I
will
get
back.
Q
Okay
and
yeah,
I
have
one
of
the
purple
air
monitors
and
they're
pretty
affordable,
and
it
does
do
pm2
and
a
half
and
2.5
and
10
as
well.
Okay,
thank
you
all.
C
Right,
thank
you,
councilmember
moore.
Let's
go
on
to
our
members
of
the
public
before
we
bring
it
back
to
council
for
follow-up
comments.
We
have
two
hands
raised
right
now.
Those
are
from
lisa
warren
and
peggy
griffin
I'll
remind
our
members
of
the
public
that
you'll
need
to
have
your
hand
raised
by
the
time.
The
first
person
concludes
speaking,
and
so
everyone
will
have
up
to
three
minutes
to
speak.
Lisa
welcome.
O
Thank
you
so
this
this
attachment
c
and
the
comment
and
the
it's
from
2019
from
what
I
gathered
with
pew's
presentation,
and
so
when
it
says,
staff
and
city
attorney's
office,
we're
not
talking
about
the
city
attorney
nor
the
city
manager
that
we
currently
have,
and
I
just
I'm
hoping
that
they
both
weighed
in
on
this
and
because
in
that
two
years,
plus
there's
been
a
lot
of
things
that
happen.
That
may
make
these
comments
change
so
I'll.
Just
trust.
I
hope
that
that
has
happened.
O
I
want
to
say
objective
standards
are
moving
targets,
they
will
be,
they
are,
and
it
will
never
not
be
the
way
our
governor
etc
are
behaving.
So
I
just
want
to
make
sure
that
there
is
some
mechanism
to
quote
unquote
legally
appropriately
continue
this
conversation
and
whatever
gets
passed
tonight
it
it
should
include
language.
It
says
that
we
also
allow
for
future
changes,
because
you
can't
hit
a
brick
wall
and
not
be
able
to
make
changes
in
the
future.
O
You
need
to
set
it
up
so
that
that's
okay
to
do
and
I
hope
that's
doable
and
I
hope
to
do
it.
In
my
opinion,
with
immunity
code
with
privacy
screening
and
the
balconies
and
yada
yada,
I
don't
think
it.
I
think
you
need
to
go
beyond
a
study
session.
O
People
want
their
privacy
so
not
to
include
the
public
and
have
input
from
them,
and
I
can
give
you
lots
of
input
on
privacy
planning
problem,
that's
already
in
place,
and
so
can
the
planning
commission
from
a
few
years
back
and
yada
yada
yada.
So
please
make
it
a
community
workshop
and
then
a
study
session
if
need
read.
I
think
arctic
architectural
features
the
line
if
it's
not
going
to
be
stricken
and
it
needs
kept
in
there.
O
In
my
opinion,
it
should
say
slope
line
and
setbacks.
There's
no
reason
not
to
include
setbacks,
because
nothing
should
be
encroaching
in
a
setback
either.
If
you
don't
put
in
this
specifically
someone's
going
to
wiggle
around
bike
lanes
traffic
count,
I
think
logan
level
of
service.
You
know
you
really
need
to
see
if
these
bike
lanes
that
are
being
spent
lots
of
money
on
are
even
being
used
because
in
mind.
O
C
J
Thank
you,
mayor
darcy.
Yes,
lots
of
griffins.
Oh
that's
good!
We're
we're
concerned
anyway,
thank
you
to
the
staff
you
guys
are
like
having
to
slug
through
this.
You
know
it.
I
can
tell
you
after
21
years
and
five
years
in
the
county.
This
stuff
is
some
of
the
most
just
mind-boggling,
mind-boggling
mind-blowing.
J
How
do
we
plan?
How
do
we
deal
with
this?
How
do
we
protect
the
city
with
all
of
these
housing
bills?
Sb
330.
we're
talking
about
a
major
dead
bill
that
came
out.
This
is
a
stupid
bill.
I
don't
know
whether
this
I
can't
remember
whether
this
was
jerry
brown
that
signed
it
or
gavin
signed
it,
but
I
mean
yeah.
Okay,
it's
like
it's
the
bill
that
never
ends.
You
can
only
have
three
meetings.
You
can
you
know
now
I
forgot
what
the
other
thing
is.
J
I
think
that's
why
we
didn't
have
this
because
it
was
given
to
us.
While
we
were
planning
this
then
so
the
city
should
be
able
to
say
we
can
we're
we're
okaying
this
tonight.
Our
legislation,
we're
okaying
our
thing
tonight,
but
we
have
the
right
to
rewrite
it,
because
the
state
is
rewriting
all
these
bills
over
and
over
again
1174
with
mr
grayson,
that's
like
an
addendum
to
sb-35.
J
Let's,
let's
learn
from
the
way
our
legislator
and
our
governor
is
acting.
I
have
notes
all
over
the
place.
I
have
concerns,
I'm
glad
that
lisa
brought
up
the
architectural
features.
I
you
know
sb9
and
10.
They
are
going
to
be
bombs
on
this
city
you're.
I
am
terrified
at
what's
going
to
happen
to
the
neighborhoods
and
I'm
mad.
We
have
not
had
been
able
to
talk
to
any
of
the
legislators
about
it.
J
I'm
not
voting
for
this
governor
again,
I
hope
there's
another
democrat
that
comes
up,
but
I'm
angry
about
what
has
been
taken.
We've
been
taken
advantage
of
our
neighborhoods
are
under
assault
and
we're
not
allowed
to
say
anything
well
as
far
as
I'm
concerned,
the
city
has
to
protect
itself.
We
have
to
write
our
own
legislation
because
believe
me,
whoever's
run
in
sacramento
is
not
they
don't
want
to
share.
They
don't
want
to
talk
to
us.
They're
cancelled
culture,
cupertino
the
public
and
local
control,
so
yeah.
J
If
we
have
to
rewrite
this
stuff
in
two
weeks
because
of
all
the
bills
and
wait
until
ab1401,
where
you
cannot
drive
a
car-
and
I
I
suppose
the
next
thing
will
be-
is
that
you
can't
go
to
school
after
you're,
12
years
old,
like
the
taliban,
so
yeah,
we
have
to
protect
ourselves
because
I
have
zero
credibility
with
this
current
government.
Thank
you
staff.
Thank
you.
Everybody.
K
Good
evening,
in
regards
to
the
gpa,
the
architectural
features
sentence
on
the
figure
lu2
strike
the
sentence
completely
in
both
places
and
make
it
clear
the
building
must
be
below
the
slope
line
period.
K
K
K
Once
a
project
is
built
and
the
building
inspections
are
complete.
No
one
verifies
compliance
after
approval.
K
K
I
also
would
like
to
thank
the
city
attorney,
the
city
manager
and
the
staff
for
the
continued
work
to
ensure
the
remaining
items
are
completed.
Clear,
objective
plans
and
laws
benefit
everyone
and
make
your
work
easier
when
you
have
to
apply
them.
So,
thank
you
all
for
your
work
and
please
keep
doing
it
good
night.
C
Thank
you,
peggy
and
we'll
bring
this
back
to
council
at
this
point.
Vice
mayor
chow,
you
did
have
your
hand
raised
prior
to
public
comment.
Did
you
want
to
bring
forward
a
motion
for
discussion
at
this
point,
or
did
you
have
any
other
follow-up
clarifying
questions
before
we
begin
the
delay.
P
I
I'll
make
a
motion
to
adopt
the
staff
recommendation
for
the
resolution
and
the
municipal
code
ordinance.
P
However,
I
have
some
additional
amendment
besides
that
so
stafford
recommendation
plus
strike,
the
architectural
features
that
do
not
include
usable
area
may
encroach
into
the
slope
line
from
both
places
in
the
figure
lu
to
footnote
a
second
on
the
same
footnote.
It
says
when
the
stop
line
is
not
established.
This
will
be
established
during
project
review.
I'd
like
to
revise
this
to
say,
project
review
shall
be
required
when
it's
not
established.
P
Okay
and
then,
then
I
have
some
questions,
so
this
is
my
motion
for
now.
C
Okay,
so
your
amendments
seem
to
be
all
on
trigger
lu2
yeah,
I'm
not
as
clear
on
your
second
one.
C
And
it
says
where
slope
lines
or
other
other
apple
will
heighten
setback
limits
for
projects
adjacent
in
residential
areas.
Yeah
there's
some
there's
some
grammatical
issues
it
should
be
are
not
established
in
a
specific
plan,
conceptual
zoning,
our
language
plan
and
any
adopted
design
guidelines-
comma
this
is
actually
should
be.
These
will
be
established
during
project
review.
Are
you
saying
that
you
want
to
add
to
that
sentence?.
A
P
So
replace
this
part
to
be
project
review
shall
be
required.
P
And
I
believe
council
member
mormont
has
said
something
about
air
filter
that
I'm
willing
to
consider
the
mainly.
C
C
Okay,
well,
the
staff
have
anything
to
say
with
regard
to
that,
I
I
think,
what's
basically.
A
A
P
S
I
don't
think
state
law
will
allow
us
to
set
that
standard.
Vice
mayor,
a
child.
If
there
is
no
standard,
there
would
be
no
standard,
but,
like
I
mentioned,
if
most
of
the
city
is
planned,
development
and
they
would
have
to
if
they
were
a
streamlined
project,
adhered
to
the
r3
requirements
that
have
setbacks
already.
P
P
I
think
council
member
moore
also
mentioned
about
the
setback
and
slope
of
neighborhood
street.
Yes,
you
are
saying
we
cannot
do
that
because
of
sp330,
but
sb
330
is
only
in
effect
until
2025..
It's
not
forever
that
that
has.
P
P
This
part
is
from
the
general
plan
for
the
urban
village
item
8.
It
says
for
urban
village
development
mixed
use,
we
need
the
neighborhood
buffers,
setbacks,
landscaping
and
building
transitions
to
buffer
a
barton
in
single-family
residential
areas.
So
I
believe,
I
think
we
we
so
this
is
just
one
of
them
that
I
find
out
now.
I
think
we
probably
have
some
languages-
that's
not
objective
now,
but
it's
there
to
say
we
want
a
smooth
transition.
P
S
So
again,
if
somebody
came
in
with
a
discretion
with
a
streamlined
project,
they
would
have
to
comply
with
r3
standards,
no
matter
what
the
zone
means.
That
is
what
our
zoning
code
says
and
that
our
three
zoning
ordinance
has
setbacks
established
already,
and
I
think
the
city
attorney
might
have
something
to
add.
S
All
all
properties,
zoned
art.
G
Yeah
only
to
sort
of
bring
the
focus
back
to
this
specific
question,
so
I
there
there
would
be
no
problem
making
your
proposed
change
to
the
general
plan.
Vice
mayor
chao,
if
there
were
a
situation
where
it
conflicts
with
state
law,
which
I
think
would
be
relatively
rare,
given
some
of
the
the
discussion
that
you
just
had
with
pew,
then
of
course
you
know
we
would
have
to
apply
state
law,
but
there's
no,
no
reason
legal.
A
C
Okay,
councilmember
moore,
you
have
your
hand
raised.
Did
you
want
a
second
count
of
vice
march
house
motion.
Q
Thank
you,
mayor
paul.
I
just
want
to
clarify
that
her
motion
vice
mayor,
your
motion,
mentions
the
resolution.
Did
I
also
hear
the
ordinance
in
that
motion
as
well
yeah,
both
so
that
you
have
okay
and
I
did
not
have
any
changes
with
the
merv
13
filtration.
Given
the
way
the
the
map
is
at
back,
med.
Q
So
I
I
don't
have
a
change
on
that.
Just
just
so,
you
know
okay,
so
if
that
is
the
case,
then
I
do
second
that
motion
okay.
C
C
Okay,
I
don't
see
any
further
hands
raised
at
this
point.
That
being
the
case,
we
do
have
a
motion
council.
Member
way,
your
hand
is
raised.
Yes,.
C
Well,
vice
mayor
chow
moved
the
staff
recommendation
in
addition
to
a
couple
of
changes
that
she
had
on
her
screen
a
moment
ago.
Right.
E
C
Okay,
so
that's
the
hands:
let's
go
ahead
and
conduct
the
roll
call
vote.
Madam
city
clerk.
Q
Mayor
paul,
may
I
just
clarify
that
so
we
do,
we
do
have
the
we've.
We
struck,
the
architectural
features
notes
both
of
them
correct
and
then,
and
then
we
do
have
this.
Could
I
have
the
final
part?
The
project
review
shall
be
required
read
out
because
I'm
not
quite
catching.
It.
P
Q
See
yeah
I'd
like
to
see
it
on
the
actual
lu2
figure
before
we
do
the
conduct
the
vote.
If
someone
could
just
pull
pull
up
figure,
l
u2
or
I
can
pull
it
up
and
if.
S
It
pleases
the
mayor,
I
can
share
my
screen.
C
Yeah,
I
guess
we'll
either
be
page
seven
of
your.
C
Okay,
I
take
it
you're
not
able
to
edit
the
the
language
pew
in
your
presentation.
It's
probably
a
pdf
of
some
sort.
I
guess.
S
C
Okay,
so
just
to
confirm
vice
mayor
chow
you're,
suggesting
that
we
simply
change
the
language
at
the
end
of
that
sentence.
From
quote
this
will
be
established
during
project
review.
To
what
you
had
indicated
on
your
screen,
which
I
believe
was
project
review
shall
be
required.
Is
that
correct.
P
C
Okay,
this
is
what
I'm
going
to
do
at
this
point.
Vice
versa,
I'm
going
to
ask
the
city
clerk
to
conduct
the
first
reading
of
ordinance
number
21-2232
at
this
time
and
I'll
ask
you
to
reintroduce
the
motion
in
accordance
with
the
language
that
we
we
use,
madam
city
clerk.
If
you
could
conduct
the
first
reading
of
ordinance
number
21-2232,
please.
C
Okay,
thank
you
and
so
vice
mayor.
Could
you
please
just
reintroduce
your
motion
with
the
the
first
reading
having
been
conducted
by
the
city
clerk?
Please.
C
Your
resolution
portion
can
remain
the
same
just
just
with
the
language
that
the
reading
would
be
as
conducted
as
by
the
city.
P
P
And
sorry
resolution
number
21-093
and
ordinance
number
21-2232,
including
the
stated
amendment,
as
shown
here,
to
be
read
by
title
only
and
that
the
city
corpus
reading
constitute
the
first
reading
thereof.
P
C
Quick
clarification:
that's
resolution,
zero,
nine,
seven.
C
Okay,
great
and
remind
me,
I
think
this
is
councilman.
G
G
C
Okay,
so
I
think
we
should
be
fine.
Let's
go
back
to
council
member,
more
council
member.
More
will
you
still
second
that
motion?
Yes,
okay,
and
did
you
have
anything
further,
no
great,
madam
city
clerk?
Would
you
please
conduct
our
role?
Our
world
cup
thanks.
D
C
C
Okay,
great,
thank
you
very
much
we're
on
to
the
non-enumerated
items
on
our
agenda.
These
are
ordinances
and
action
items
of
which
there
are
none
for
new
ordinances.
Oral
communications
have
concluded.
We
now
have
council
on
staff
comments
and
future
agenda
items.
Let
us
start
with
our
city
manager.
C
Mr
larson,
did
you
have
any
staff
comments
that
you
wanted
to
share
with
the
public?
To
conclude,
the
meeting.
C
Oh
well,
thank
you.
Thank
you
greg.
I
appreciate
that
and
so
future
agenda
items.
So
do
my
fellow
council
members
have
any
items
that
they
would
like
to
bring
forth
for
possible
consideration
in
the
future.
Councilmember
moore,
you
have
your
hand
raised.
Q
Well,
I
I
actually
have
have
just
two
two
quick
comments:
one
I
thought
it
was
pretty
exciting
to
see
the
ab
367
pass
through
and
and
having
these
the
student
students
have
such
a
quick
turnaround.
I
think
that
was
really
exciting
and
second,
I
know
the
the
city
council
had
assigned
the
planning
commission
to
go
through
the
general
plan
objective
standards
a
couple
of
years
ago.
I
it's
to
me.
Q
I
I
think
this
that
this
attachment,
with
all
of
the
the
changes
and
staff
input
is,
is
really
exciting
to
see
this
coming
to
fruition.
Finally
and
yeah,
this
is
great
and
it
was.
It
was
really
wise
of
you
to
assign
the
planning
commission
that
task
all
right.
Thank
you.
Thank.
C
You
councilmember
moore
and
thank
you
for
your
your
your
years
of
work
on
this
since
your
time
on
planning
commission
as
well.
Okay,
I
don't
see
any
further
hands
raised
at
this
time,
and
so
did
you
speak
to
any
potential
future
agenda
items.
P
P
What
do
we
mean
by
that,
and
also,
if
possible,
I
think
we
should
have
standard
for
setback
and
slope
for
neighborhood
streets,
even
if
it
might
not,
it
might
interfere
with
sp
330
then
at
least
it
should
be
in
the
code
and
maybe
for
before
2025
a
project
could
take
exception
on
that,
and
then
another
thing
is
another.
One
is
a
new
item
that
we
all
know
that
the
april
park
apple
park,
property
parcel
property
tax.
P
Although
the
property
is
incorporating,
the
property
tax
goes
to
santa
clara,
unified,
then
santa
clara
unified
has
a
funding
of
twenty
thousand
dollars
per
student,
while
cusd
has
the
funding
of
nine
thousand
dollars
per
student.
P
So
it's
a
huge
gap
between
the
two
district
and
as
the
number
of
students
goes
down
in
both
districts,
their
number
goes
up
a
lot.
We
don't
go
up
much,
so
the
gap
gets
bigger
and
bigger.
So
I
think
this
is
a
good
time
for
us
to
request,
possibly
redistricting,
so
that
we
can
bring
that
parcel
into
cusd.
P
I
understand
this
might
be
a
school
district
issue,
but
I
think
our
school
district
is
financially
limited
and
I
would
like
the
cupertino
maybe
to
do
some
initial
study
on
the
city.
I
mean
of
cupertino
to
do
some
initial
study
on
what
needs
to
be
done,
because
if
we
can
bring
that
back
into
it
will
benefit
our
residents
and
then,
if
it's
feasible,
maybe
we
can
bring
direct
cities
manager
to
talk
to
the
superintendent
of
cusd
to
support
their
their
action
in
case
they
they.
They
would
like
to
proceed.
C
Okay,
thank
you
vice
versa.
I
mean,
I
guess
just
a
brief
clarifying
question:
does
does
anyone
you
know
between
well
what
greg
or
or
chris
do
know
whether
this
is
a
lafco
issue,
or
is
this
something
that
is
dealt
with
differently
in
in
school
districts?.
G
So
it
is
that
I
actually
it
is,
it's
actually
not
a
lafka
issue.
I
initially
thought
that
it
was
it.
I
believe
it's
it's.
This
county
office
of
education
is
the
the
the
agency
that's
responsible
for
setting
or
changing
school
district
countries.
P
C
Okay,
oh
well,
I
do
see
a
couple
of
hands
raised,
vice
very
chow
and
so
focusing
on
vice
mayor
chow's
item
here,
councilmember
moore
did
you
want
to
speak
to
any
of
that.
Q
Yes,
I
would
like
to
hear
some
comments
about
the
the
feasibility
of
having
that
change.
When
you
look
at
the
apple
campus,
the
headquarters
is
assessed
at
832
000,
that's
the
the
spaceship
part
and
then
south
of
that
is
675.,
but
I
think
procedurally,
it's
a
million.
I'm
I'm
off
one.
It's
832
million
versus
the
675.
Q
Now
I
I
support
it
I,
but
I
would
like
to
know
if
it's,
if
there's
the
feasibility
from
staff
of
spending
our
time
on
this,
because
I
think
it
would
be
challenging
to
ask
for
for
the
funding
shift,
but
if
it's
possible
I'd
love
to
hear
it.
So
I
I
certainly
like
to
hear
some
information
about
this
I'll
indicate
some
interest
there.
C
H
M
H
Don't
accept
that
I
think
we
ought
to
be
looking
at
it
as
hard
as
we
possibly
can.
Our
our
schools,
our
children,
are
the
ones
that
are
being
short
changed
so.
C
Yeah,
thank
you,
councilmember
willie,
all
right,
so
we'll
we'll
leave
it
at
that.
I
see
the
support
for
it.
I'll
I'll
speak
with
our
city
manager
and
city
attorney
assistant
city
manager
tomorrow,
and
come
back
with
what
some
of
these
feasibilities
are
for
our
our
scheduling
going
forward
into
the
foreseeable
future.
C
So
at
this
point
we
are
at
the
end
of
our
our
agenda.
Thank
you
very
much.
It's
been
a
a
very
good
meeting.
I
I
thank
staff.
I
know
that
this
is
you
know
a
set
of
items
that
were
a
long
time
in
their
development,
and
you
know
appreciate
all
the
work.
That's
been
done.
Obviously,
a
number
of
people
you
know
elected
appointed
and
in
the
community.
Our
community
members
have
just
done
so
much.
C
I've
seen
this
over
the
years,
and
you
know
I
want
you
all
to
know
for
everyone
who
has
poured
over
along
with
staff.
You
know
things
like
the
general
plan
amendment
or
40-year
plan,
etc.
That's
much
appreciated,
so
thanks
very
much
have
a
great
night.
Today
is
october
19th.
C
We
are
continuing
to
conduct
our
city
manager
interviews,
which
will
continue
this
weekend.
I
think
that
process
is
going
well
overall.
Our
next
meeting,
I
believe,
is
on
november
2nd.
Is
that
correct,
okay
thumbs
up
from
st
matrix
great,
so
I'll
adjourn
this
meeting
of
the
regular
city
council
meetings
of
the
city
of
cupertino
until
november
2nd
2021
thanks
very
much
and
everyone
have
a
happy
halloween,
take
care.
