to

the

conflict

interest

death

mayor
paletko

everything
else
that
we
are
dealing
with
and
not
knowing
who
the
next
potential
temporary
mirror
is
going
to
be
or
may
or
until
november
is
going
to
be.

think
it'd
be
a
good
idea
to
have
some
sort
of
continuity
or
at
the
very
minimal,
maybe
until
june
or
may
at
the
very
minimal,
but
we
still
need
some
sort
of
opinion
and-
and
I
know
gary
can
give
us
one,
but
it
might
be
a
little
biased,
obviously
to
make
sure
there's
no
conflict
of
interest
there,
because
he's
going
to
be
representing
us
as
council
members,
but
at
the
same
time
he's
representing
a
lawsuit
against
us
representing
the
mayor,
politico
god
rest
his
soul.

like
to
suggest
that
we
hold
this
motion
under
bands
until
after
the
closed
session.
This
is,
as
council
members
have
indicated,
tied
directly
to
allegations
that
are
contained
within
the
lawsuit,
not
only
procedural
issues
related
to
how
the
corporation
council
is
appointed,
but
also
financial
issues
related
to
claims
associated
with
ability
to
perform
those
services,
despite
not
being
appointed
formally
by
council
at
the
time
of
the
nomination.

There's
additional
complications
now,
as
councilman
abdullah
indicated
in
terms
of
not
having
the
mayor
in
office,
to
create
a
new
appointment,
we're
not
sure
about
the
time
frame
associated
with
a
motion
for
reconsideration
and
whether
or
not
that's
even
timely,
under
the
charter
or
under
robert's
rules.
At
this
point,
and
so
with
all
of
these
kind
of
issues
that
are
just
coming
up
now
as
a
walk-on
item,
I
would
just
suggest
that,
if
we
table
this
until
after
the
closed
session,
we'll
have
a
time
chance
to
take
a
quick
look
at
it.

be
very

once

to
more
clearly
serve
in
the
role

there

problem,
then
I
assume
you
can
pipe
in
with
regard
to
this.
But
right
now
everything
because
of
the
mayor's
death
is
on
hold
and
essentially
whether
or
not
the
mayor's
lawsuit
would
continue
would
not
be
up
to
me.

It
would
be
up
to
the
successors
to
the
mayor,
both
personally,
namely
his
personal
representative
and
the
mayor,
who
would
end
up
succeeding
him.
So
two
things
to
note
with
regard
to
that.

The
lawsuit
only
contained
declaratory
and
injunctive
relief,
and
essentially
my
scope
of
services
with
the
mayor
was
clearly
defined.
I
would
certainly
not
on
anything
having
to
do
with
the
lawsuit
with
regard
to
this,
but
other
issues.
It
would
be
like
I've
worked
for
decades
with
the
city
council
and
I
would
still
be
able
to
do
so,
especially
during
this
very
difficult
time.

I
don't
think
there
would
be
any
problem
created
in
the
meantime
so
and
if
mr
mr
roberts
and
I
had
to
actually
discuss
this
briefly
in
case
there
was
some
question
in
terms
of
a
potential
conflict
or
anything
having
to
do
with
the
lawsuit,
because
I
thought,
especially
with
the
item
3.1,
a
that
I
would
not
be
able
to
in
any
way
address
anything
at
that
point.

I
would
clearly
have
a
conflict
with
regard
to
that
issue,
but
I
do
not
believe
that
I'm
prohibited
in
any
fashion
from
in
general,
representing
the
city
and
advising
the
council
with
respect
to
other
matters
that
have
nothing
to
do
with
the
lawsuit.

I
guess
I
would
just
respond
to
that,
and
obviously
this
is
related
to
the
litigation.
My
law
partner,
tom
brooch
is
involved
in
the
litigation
is
also
at
the
meeting,
and
so
he
might
want
to
weigh
in
as
well,
but
part
of
the
reason
why
this
is
relevant
for
closed
session
is
there
is
a
motion
for
disqualification
pending
with
the
court
because
of
the
conflict.

have
not
gotten
paid
in
six
months,
yet
I've
been
protecting
the
city
during
this
entire
time,
and
you
know
frankly,
this
is
very
difficult
and
if
it
wasn't
for
my
frankly
dedication
to
the
city,
we
would
have
had
some
very
serious
problems
potentially
in
the
meantime.

we
need
some
clarity
with
regard
to
this
at
this
time.
So
again,
I
would
want
to
obviously
get
paid,
but
I
would
be
honored
to
continue
to
serve
so.

favor

councilman
muscat

know
putting
on
agenda
and
also
in
favor
of
bringing
mr
miyaki,
especially
based
on
what
was
mentioned
by
mr
miyaki
right
now
with
covet.

You
know
the
situation
that
we're
in
we're
in
desperate
need
of
bringing
some
back,
mr
miyaki
and
with
his
experience,
he's
been
representing
the
city
for
so
long
and
right
now,
it's
very
critical
time
for
this
city
and
we
can't
go
out
and
try
to
bring
somebody
else
and
we
we
really
need
somebody
like
him
right
now.
At
this
point,
you
know
with
the
situation
that
we're.

just
want
to
mention
that
one
of
the
options
that
we've
got
now,
if
we're
going
to
just
wait
until
after
the
closed
session,
then
that
shouldn't
be
a
major
problem,
but
one
of
the
options
that
we've
got
available
to
us
is
we
could
appoint
him
as
our
attorney
subject
to
attorney
gary
miyaki
resigning
from
this
lawsuit
or
this
lawsuit
being
dropped.
That'd
be
not.
That
would
be
options
that
we've
got
and
in
that
particular
case
there
would
be
no
conflict
of
interest
at
number.

Two
that
I
want
to
mention
is,
I
know
gary
miyatki
has
worked
for
the
city
this
whole
time.
I
know
he
had
asked
the
administration
on
a
multitude
of
times
to
bring
us
options
for
possible
appointment
of
either
a
different
attorney
or
gary
miyaki
again.
I
was
always
in
favor
of
gary
miyaki
being
one
of
the
people
that
we
would
consider,
but
with
that
being
the
case,
he
continued
to
serve
not
in
an
official
capacity
as
an
attorney,
but
he
continued
to
provide
services
for
the
city
during
that
time.

Based
on
the,
I
assume,
the
mayor,
slash
us
as
a
council
advising
him
to
do
to
give
us
opinions
et
cetera,
et
cetera,
with
that
being
the
case,
a
hundred
percent
gary
matt
gary
miyake,
should
be
paid
for
the
time
that
he
put
in
for
the
city,
maybe
not
as
an
official
attorney
in
his
capacity,
but
as
an
attorney
in
general.

I'm
sure
gary
miyake's
integrity
would
not
allow
him
to
have
any
conflict

interest
with
that
lawsuit,
and
you
know
we
need
a
clean
slate

motions,

voted
not
to
keep
mr
miyake,
so
I
have
every
right
to
bring
it
back.

to
our
charter

think
it's
valid

miyaki

whoever
till
the
beginning
of
next
year,
which
would
allow
the
newly
elected
mayor
to
pick
his
own
people
and
go
from
there.
And
I
believe
mr
marbergs
has
something
to
say.

just
wanted
to
make
an
observation
with
with
regard
to
the
lawsuit.
I've
kind
of
purposely
stayed
out
of
that,
but
addressing
the
issue
at
hand
regarding
the
mayor's
appointment
of
mr
miyatki,
I
believe
the
position
taken
by
the
mayor
was
that
council
had
not
acted
upon
that
appointment.
Yet
I
would
remind
council
that
the
mayor
is
the
one
that
appoints
council
corporation
council,
subject
to
the
approval
of
the
council.

believe
the
appointment
was
never
voted
down
in
effect,
so
the
appointment
is
still
there.

believe
the
council
could
act
upon
that,
whether
that
be
by
reconsideration,
maybe
not
the
proper
vehicle,
but
it
would
just
be
a
renewed
motion
to
approve
the
the
prior
appointment.

Given
the
status
of
the
litigation,
there
is
the
potential
for
a
conflict
between
those
two
offices
and
since
she
is
one
person
serving
both
roles
at
the
present
time,
the
conflict
waiver
resolution
would
allow
us
to
go
into
closed
session
with
the
council
chair,
recognizing
that
she
has
two
hats,
while
she's
sitting
in
there
and
allows
us
as
special
counsel
for
the
city
council
to
engage
in
these
discussions
openly.

In
light
of
that,
we
don't
believe
that
there
is
an
actual
conflict
between
the
council
chair's
duties,
given
that
she
is
a
named
defendant
in
the
lawsuit,
and
so
so
that's
why
we
are
requesting
the
vote
on
the
closed
session
having
on
the
conflict
waiver
to
take
place
prior
to
going
into
closed
session.

second
resolution
that
was
presented
to
city
council
is
the
standard
resolution
associated
with
identifying
that
there
is
pending
litigation
and
requires
a
two-thirds
vote
of
the
council
in
order
to
authorize
the
closed
session.

to

council's
discretion.
It
is

privilege.
All
that's
required
is
that
you
are,

you're
meeting
with
your
attorneys,

the
pending

council

donations

the
impression

community

we

of
committee

citizens

more

because

mayor
deserves
us.
Anybody
that
committed
to
serve
this
city,
this
country
for
50
plus
years,
deserves
recognition.

it
coveted,
we
couldn't
give
them
the
right
recognition,
the
deserving
recognition.
So
I
think
we
should
just
move
with
this
and
just
find
out
the
amount
and
then,
at
the
point
we
determine
how
we're
going
to
actually
pay
for
it
and
again,
even
if
we
cannot,
as
a
city,
I'm
sure
there'll
be
a
lot
of
people
that
are
willing
to
donate
and-
and
I'd
be
more
than
happy
to
volunteer
myself
to
work
on
that
committee
also.

council

abdullah's
suggestions
