board
has

power

Iowa
law
and

zoning
ordinance
of
the
City
of
Des
Moines
to
hear
requests
for
variances
and
exceptions
from
the
regulations
in
the
zoning
ordinance
to
consider
conditional
use,
permit
requests
and
to
consider
appeals
from
the
decision
of
the
staff
in
the
administration
of
the
zoning
ordinance
and
then
to
make
decisions
in
such
matters.

of
this
board
are
citizens
of
the
City
of
Des
Moines
and
have
been
appointed
to
this
board
by
the
City
Council.
The
board
members
are
volunteers
and
received
no
compensation
for
their
public
service.

procedure
on
how
this
works.

this

be
your
first

so
we
want
to
help
everyone
understand
our
process,
so
I'll
go
through
how
we
do
things,
but
then,
as
the
agenda
develops,
we
will
help
you
through
this,
so
so
don't
be
worried
about
the
process
or
procedure
will
will
guide
you
along
here.
First
of
all,
while
this
is
a
public
open
meeting,
it
is
a
formal
legal
hearing.
The
hearing
is
being
recorded
and
we
should
be

the
city's

board
is
required
to
base
its
decision
in
each
case
upon
the
criteria
established
by
law
for
the
type
of
relief
sought
by
the
applicant.

law
applicable
to
each
case
is
identified
in
the
written
staff
report.
If
the
facts
as
determined
by
this
board
demonstrates
that
the
criteria
established
by
law
for
granting
the
relief
has
been
satisfied,
then
the
board
must
grant
the
requested
relief.
Otherwise,
the
board
must
deny
the
relief
each
appeal
will
be
announced
in
order
and
the
staff
will
present
a
brief
explanation
of
the
appeal.
Any
written
comments
received
by
the
staff
prior
to
the
hearing
will
be
distributed

must
be
implemented,
constructed
or
otherwise,
utilized
within
two
years
of
the
date
of
the
decision

approval
shall
expire

looking
at
our
agenda
items

listed

first
port
of
first
portion
of
the
agenda,
known
as
the
consent
agenda.
Those
items
are
not
planned
to
be
individually
discussed
at
this
hearing.

side

Court
Avenue,

with
East
Fourth
Street.
The
new
tenant
wants
to
go
into
the
north
east
corner
of
the
building.
They
would
have
2,700
square
feet
of
tavern
space
within
the
main
level
of
the
building
and
then
a
mezzanine
level.

of
the

The
subject
property
is
the
shop
and
save
located
at
the
southwest
corner
of

14th
Street

board

held
a
few
hearings
on
this
site
over
the
last
few
years.

recently
last
year
there
was
an
appeal
of
Mazzoni
enforcement
officers
determination
that
they
determined
that
they
lost
the
illegal
non-conforming
rights
to
sell
liquor.

this

because

directed

remanded

able

sell

settled

neighbors

all
scared

go
outside

night
because
of
the
people
that
hang
there

there

a
lot
of
people
hanging
around
there.

be
helpful

keep

dialogue

understand

meet

concerns

authority

we
would

working
relationship

expand

operator

issues

got
along

invested

heavily

purchased

properties

intends

invest
heavily

site

point

in
previous
proceeding.
The
formal,
Neighborhood
Association
they're
voted

to

in
support
of
his
application,

sell
liquor
and
he's
sold
liquor
at
that
site
since
2007-
and
this
is
not
a
previous
testimony-
this
is
not
a
problem
site
as
issues
with
the
neighborhood
or
with
the
police.
