rules
and
procedures.
The
plan
and
zoning
commission
is
generally
an
advisory
body
to
the
city
council.
The
city
council
will
hold
a
public
hearing
and
make
the
final
decision
on
all
matters
before
the
commission
other
than
site
plans
and
subdivision
plats.
Unless
denials
or
conditional
approvals
thereof
are
appealed.
A
Applicants
will
be
given
10
minutes
to
present
the
request
proponents,
and
then
opponents
from
the
public
are
then
allowed
to
speak
in
that
order
with
each
speaker
allowed
a
maximum
of
five
minutes
applicant
is
then
allowed
five
minutes
for
a
rebuttal.
The
hearing
will
then
be
closed
and
the
commission
will
discuss
and
vote
on
the
issue.

design
alternative

allow

retention
of
a
5
foot
tall
chain
link
fence
within
the
front
yard
area.

subject
property
is
located
at
2504
des
moines
street,
which
is
in
the
fairground
neighborhood.
It
contains
a
single
family
dwelling.
I
have
a
few
pictures
that
show
the
existing
fence
you
can
see.
They
went
ahead
and
built
a
five
foot
tall
chain
link
the
black
clad
chain
link
fence
in
an
l-shaped
area
in
the
front
yard.
There's
an
existing
four
foot
tall
chain
link
fence
here
along
the
east
property
line
that
predates
our
code,
so
that
fence
is
considered
to
be
legal
non-conforming.
But
what
you
see
in
black
here?

applicant
has
provided
this
letter
here,
which
I'll
leave
up
here,
I'm
just
explaining
why
they
feel
that
their
fence
is
needed,
as
you
read
that
I'll
just
give
the
staff's
rationale
staff's,
not
supportive
of
this.
Just
because
we
don't
feel
that
the
five
foot
tall
fence
in
the
front
yard
area
is
appropriate
if
it
was
like
a
decorative
wrought
iron
fence.
I
think
staff
might
be
a
little
more
supportive
of
perhaps
like
a
four
foot
tall
chain
link
fence.

sorry,

foot
tall,
decorative
wrought
iron
fence,
but
staff
does
not
believe
that
the
five
foot
tall
fence
is
within
the
character
of
the
surrounding
neighborhood.
So
we
have
recommended
denial
of
the
of
the
request.
We
do
not
receive
any
comment
cards
back
from
any
of
the
neighbors
or
any
public
comment
from
any
neighbor.
So

started
my
project
for
our
fence
was
prior
to
your
code
change
and
unfortunately
it
took
a
little
time.
I
had
to
special
order
a
lot
of
this
and
so
then
a
lot
of
storms
hit
across
the
country
and
I
was
unable

get
the
material.

when
I
started
this
project,
I
thought
I
was
within
code
being
under
six
foot
in
my
front
yard.
There
were
many
reasons
that
I
put
it
in.
I
don't
know
if
you
have
a
copy
of
this
letter,
we
have
kind
of
a
halfway
house
that
is
behind
us
and
some
of
those
gentlemen
were
coming
over
camping
out
in
our
driveway
asking
my
visitors
for
money
and
we
couldn't
get
them
to
stop
doing
that.

with
that
brings
a
lot
of
attention
to
my
address.

name.
People
were
coming
to
my
home
needing
help,
and
I
mean
I
couldn't
help
everyone.
Obviously,
so
I
had
to
find
a
way
to
kind

curtail

little
bit
I
still
have
children
at
home.

and
I
wanted
them
to
still
feel
safe.

that
was
another
big
reason.
I
also
on
a
smaller
reason.
I
have
a
great
vein
that
now
gets
to
run
a
little
bit
in

yard,

I
wanted
to
give

dog
a
little
bit
of
run
space,
but

biggest
issues
were
feeling
safe
and
secure,
and
my
children
feeling
safe
and
secure
and
being
able
to
still
continue
my
community
giveaway
at
christmas.

blocks

home

people

same

question
about
precedence,
and
my
concern
is
that
we,
I
think,
need
to
have
some
kind
of
reason
for
allowing
this
des
moines
street
is
a

It's
a
brick
street
and
it's
really
quite
quite
an
interesting
and
lovely
street.
What
would
you
suggest
if
the
commission
wished
to
waver
this
as
justification.

I
hinted

it
before

If
staff
were
to

supportive
of
a
fence
within
a
front
yard,
we
would
probably
be
supportive
of
a
wrought
iron
fence.

mean
it's
great,
that
it's
black
clad

step

the
right
direction,
but
I
think
staff
would
prefer
that
it
was
a
different
material
than
chain
link.

asking
if

commission's
inclined

approve
this,

their
rationale?
What's
unique
about
the
site,

think
some
things
that
you
could
put
into
the
record
if
you
want
to
distinguish
this

applications

in
the
future
applications
that
we
see
as
staff.
I
actually
review
type
one
design,
alternative
requests
for
fencing
all
the
time.
So
what
you
know
you
could
speak
to
maybe
unique
security
needs
if
you
believe
that
she
has,
that
is
based
off
of
her
testimony.

go
to
the
one
of
the
sites
that
she
found,
or
she
mentioned,
and
it
does
appear
in
google
street
view
that
that
fence
is
likely
five
feet
tall,
one
of
the
other
ones
that
she
mentioned.
I
can't
find
any
record
offense
permit
for
it
and
I
don't
see
it
on
google
street
view.
So
I
imagine
it's
a
violation
that
hasn't
been
caught
yet,
and
I
do
want
to
let
you
guys
know
that
this
isn't
a
case
that
staff
was
looking
for.

sort
of
to
will's
point
looking
for
something
unique
about
the
property
and
how
you
mentioned
security
issues
and
the
surrounding
houses
having
chain
link
fences.
So
if
we
were
to
wave
this,
it
would
sort
of
open
up
the
door
for
any
of
the
homes
in
that
area
to
put
up
similar
chain
link
fences.
Is
that
correct?
It
wouldn't.

absolute
right
the
same
zoning
code
that
is
hanging
her
up,
would
still
hang
them
up,
but
they
would
be
back
in
front
of
you
and
then
you're
right.

you'd
probably
have
a
harder
time
saying.

mean

situation
could
be

little
bit

going

houses
already
have
some
sort
of
fence
in
the
front
yard.

comfortable

complaint
