background
here
and
then
we
will
take
everybody
through
this
step
by
step.
So
don't
worry,
we
will
help
you
through
this.
First
and
foremost,
the
board
of
adjustment
is
a
quasi-legal
board.
This
hearing
will
be
conducted
within
the
procedures
and
format
as
authorized
by
iowa
law
and
this
city's
ordinances.

Rather,
they
will
be
considered
for
approval
in
accordance
with
the
recommendation
and
the
staff
report,
unless
the
appellate
does
not
agree
to
the
conditions
that
have
been
presented
and
recommended
by
staff
or,
if
there's
an
individual
in
this
audience
or
a
board
member
that
requests
that
the
item
be
removed
from
the
consent
agenda,
so
that
a
full
discussion
of
the
matter
can
occur
and
I'll
come
back
to
the
consent
agenda.
Here
in
just
a
few
minutes
and
again
we'll
take
you
through
each
step
for
our
regular
agenda.

After
an
item
is
announced,
city
staff
will
first
give
a
brief
overview
of
the
appeal
and
present
any
written
comments
that
have
been
received
prior
to
the
hearing.
The
applicant
or
their
representative
will
then
be
allowed
up
to
10
minutes
to
present
their
reasoning
for
their
appeal
after
the
applicant
has
made
their
presentation.
We
will
move
to
the
public
comment
portion
of
the
hearing
for
that
agenda
item.

After
all,
input
has
been
provided.
The
board
chair
will
then
close.
Any
further
public
comment
on
that
agenda
item
and
the
board
will
immediately
deliberate
the
request
and
we
will
make
a
decision
on
the
appeal
here
today.
Please
note
that
it
takes
at
least
four
affirmative
votes
for
any
zoning
appeal
to
gain
approval.

appeal
is
approved
today
we
ask
that
you
wait
until
at
least
one
week
from
today's
hearing
to
contact
the
city's
permit
and
development
center
if
you
would
need
to
obtain
any
necessary
building
or
sign
permits.
As
related
to
your
appeal,
this
will
allow
the
decision
of
this
board
to
be
documented
in
the
form
of
the
decision
and
order,
which
will
then
be
provided
to
you
and
city
staff
for
the
record
of
these
proceedings.

staff

recommending
approval
of
the
requested
exceptions

some

that

this
item
is
located
on

avenue
and
they
are
looking
for
a
couple
of
type
2
zoning
exceptions
for
their
requested
sign,
whoopsie.

there

the
proposed
signage,
so
a
little
hard
to
see,
but.

Kind
of
in
this
vicinity,
if
you
can
see
that
little
box
highlighted,
is
the
bay
that
the
appellant
is
looking
to
seek
the
exceptions
on
and
then,
as
you
can
see,
they've
already
put
up
some
of
the
approved
signage
that
they
have
just
a
couple
more
shots
to
orient
you
and
then
I'm
actually
going
to
zoom
in
on
this.

they
are
proposing
actually
three
signs.
One
of
them
in
the
center
meets
the
code
regulations,
so
they
are
okay
there,
where
they're.
Looking
for
those
exceptions,
would
be
the
window
sign
on
the
door
front
and
then
this
far
western
window
has
a
signage.
That
is
also
seeking
the
type
2
exception.

then
it's
a
little
hard
to
see,
I
guess
on
the
backlit
screen,
but
this
would
be
the
proposed
signage
going
in
that
far
western
window.

as
you
can
see,
the
proposed
ones
cover
quite
a
bit
of
the
windows
well
over
our
usual
recommendation
and
also
exceeding
our
maximum
exception,
which
is
50
percent
over
the
allowage.
So

would
be
what
we

generally
kind

look
for
to
match
the
character
of
the
area.

no
more
than

percent

window,
I

window
frontage
there,
including
the
upper
set
of
windows,
but
it's
any
window
within
a
separate
pane
or
frame,
and
the
percentage
of
that.

the
total
amount
of
open
space,
correct
that
is
used

of
words

art
is

professional
sign
contractor,
you
couldn't
put

design
concept

understand
from
square
one,

work
within
the
ordinance
itself,
why

that
not

construction
contractor
understands
a
city
building
code,

they
design

build

designs

the
city
ordinance.

it

them
to
figure
that

compromise

the
branding
they
want

council

passed
remains
mostly
kind
of
adhered
to.

the
requested
appeal,
but
to
grant
an
exception
based
on
the
staff's
alternative

window

door.
