and
Zoning
Commission
I
will
start
by
reading
the
rules
and
procedures.
The
plan
and
Zoning
commission
is
generally
an
advisory
body
to
the
city
council.
The
city
council
will
hold
a
public
hearing
and
make
the
final
decision
on
all
matters
before
the
commission
other
than
site
plans
and
subdivision
plots
unless
denials
or
conditional
approvals
thereof
are
appealed.
Please
contact
the
city,
clerk
or
development
services
department
staff
for
details
on
Council
hearings.
A
Applicant
will
be
given
10
minutes
to
present
to
the
public
proponents,
and
then
opponents
from
the
public
are
then
allowed
to
speak
in
that
order
with
each
speaker
allowed
a
maximum
of
five
minutes
applicant
is
then
allowed
five
minutes
for
rebuttal.
The
hearing
will
then
be
closed
and
the
commission
will
dissolve
and
vote
on
the
issue.
All

be
germane

the

from

is
kind
of

the
northeastern
quadrant
of
the
city
right
by

Pleasant
Hill

Copper
Creek
Lake
Recreational
Area
to
the
South.

non-motorized,

you

parking
area

right

Crossing

to
connect
to
the

future

Loop
that
extends
on
Four
Mile
Drive,
so
that
allows
an
additional
walking
Loop
to
park
users,
and
so
the
intention
is
to
be
able
to
have
a
trail
users
safely,

The
exact
alignment
of
the
connection
from
here
down
to
the
Gail
eagleson
Trail
dead.

So,
as
I
mentioned,
the
proposal
that
we
are
looking
at
is
to
rezone
approximately
50
acres
of
this
area
for
for
Park
amenities
staff
has
reviewed
this
proposal
and
the
the
staff
rationale
for
this
particular
item
is
that
this
this
proposed
Zone
and
the
use
is
appropriate
for
this
area
as
there
as
a
significant
portion
of
the
of
the
property
is
within
the
flood
zone.

Park
type
users
are
complementary
and
and
provides
a
good
opportunity
for
for
the
public
to
be
able
to
use
the
the
space
without
the
dangers
of
having
structures
and
so
on
in
a
in
a
flood
zone.
This
also
given
its
location
to
the
proximity
of
the
Regional
Trail
system,
as
well
as
the
Copper
Creek
Lake
Recreational
Area
provides
a
great
opportunity
for
the
public
to
be
able
to
enjoy
the
the
trail
amenities
provides
non-moralized
connection.

impact
on
the
adjacent,
low
density,
residential
use,
we
being
a
park
amenity
and
provides
an
opportunity
for
the
residents
to

able

use
this
amenity
as

with
that,
with
that
rationale,
staff
is
recommending
approval
of
this
rezoning
request,
subject
to
all
areas
that
are
within
the
FEMA
100
Year
floodplain
to
be
developers
went
to
chapter
50
of
the
City
municipal
code
that
deals
with
the
floodplain
areas,
so
the
applicant
did
do
a
neighborhood
meeting
and
also
visited
with
the
neighborhood
association.

As
you
know,
I'm
with
Polk
County
Conservation
board.
We
manage
about
16
000
Acres
of
Parkland
throughout
Polk
County,
mainly
focused
on
Prairie
restoration,
Wetland
and
Timber
Restorations.
Recently,
in
the
past
years,
with
some
of
the
flooding
of
Four
Mile
Creek
we've
been
in
partnership
with
city
of
Des
Moines
to
do
the
buyout
on
a
lot
of
these
properties.

So
what
I
do
want
to
talk
about
a
little
bit
going
more
in
depth
about
is
why
we're
calling
this
a
mountain
bike
park
and
kind
of
get
to
more
of
the
specifics
of
what
this
really
looks
like
so
there's
this
site.
There
is
our
conceptual
plan
you
guys
are
pretty
familiar
with.
These
are
just
some
Hyster
oil
Aerials
site
was
formerly
of
grazed
and
then
leftover
time
to
be
overgrown
with
trees
and
invasives
few
site
photos
we
have
now.

So
we
want
to
talk
about
Trails,
we're
talking
about
doing
sustainable
Trails
here.
Some
key
issues
that
play
into
that
is
our
grade
side,
slope
trail
location.
Those
are
some
of
the
key
factors
that
make
these
sustainable
trails,
and
this
is
why
we
think
this
location
justifies
professional
design
and
professionally
built
trail
system
which
we
are
pursuing.
We
had
our
conceptual
concept
put
together
by
imba,
the
international
mountain
biking,
Association,
and
we
will
be
soliciting
bids
from
professional
Trail
builders.

So
we
look
at
these
trails
and
how
we
are
looking
at
them
in
comparison
to.
What's
in
the
rest
of
the
metro
area,
we
are
calling
these
bike
optimized
Trails.
These
are
not
just
strictly
mountain
bike
trails.
We
want
these
trails
to
be
open
and
usable
to
all
user
groups.
We
want
hikers
Trail
Runners,
everyone
out
there.

Well
people
people
in
wheelchairs,
little
kids
on
Strider
bikes
built
to
use
this.
So
what
that
really
means
is
we're
going
to
be
designing
a
park,
that's
open
to
all
ages
and
all
abilities
of
biking.
So
there's
some
some
key
factors
where
some
key
types
that
we're
looking
at
in
there.
So
the
pump
track
is
an
obvious
one.
That
is,
you
know,
for
the
smaller
children
to
get
them
activated
in
in
outdoor
recreation.

are
looking
at
offering
some
flow
Trails
there.
The
these
trails
are
kind
of
kind
of
more
manicured
and
more
morally
highly
focused
on
design
and
engineering.
We
will
offer
traditional
Trails
out
there,
and
these
are
what
you
typically
see
through
the
rest
of
the
Metro.

We
will
offer
some
technical
Trails
out
there
with
focusing
on
some
more
natural
features
and
then
we're
looking
at
the
possibility
of
doing
some
gravity
trails,
and
these
are
just
basically
Earth
Burns
and
Earth
Earth
jumps,
so
nothing
too
extravagant.
But
if,
if
a
good
mountain
biker
has
enough
speed
and
momentum,
he
can
turn
these
into
some
pretty
fun
features
that
are
writable
and
notice.
Then
all
these
features
are
capable
where
a
hiker
or
jogger
could
easily
navigate
around
these
features.

And
then
so
we
we
kind
of
get
back
to
these
inclusive
Trails.
We
want
to
park.
The
whole
family
can
come
out
enjoy,
especially
with
our
location
next
to
next
at
Copper,
Creek
Lake,
with
that
paved
trail,
that's
a
mile
Loop
and
then
to
the
west
of
the
site.
These
everything
in
that
shaded
green.
These
are
the
properties
that
Polk
County
Conservation
has
ownership
and
management
of
most
of
these
coming
throughout
the
the
buyout
program.

These
are
places
where
the
houses
have
been
removed
and
we're
looking
at
removing
the
streets
and
instead
of
removing
the
entire
streets,
we've
been
focused
on,
remove
only
removing
half
the
streets
and
remaining
the
remaining
Street
would
be
utilized
as
a
trail,
so
that
dash
line
to
to
the
West.
That
would
be
where
we
keep
those
streets
to
turn
into
a
walking
trail.

So
we
see
the
use
patterns
of
these
Trails,
where
it's
families
out
there
with
strollers
small
toddlers
on
trikes.
Those
are
the
people
that
will
be
coming
in
and
using
our
Park
as
a
site
just
playing
off
our
site
context
there.
So
those
were
just
a
few
quick
things.
I
wanted
to
share
with
you
guys,
I'll
kind
of
recap:
our
public
Outreach
operation,
so
this
started
probably
later
in
January
we
we
met
with
the
Edgewater,
neighborhood
I,
think
early
August,
August,
6th
or
something,
and
then
we
met
with
the
Gray's
neighborhood
association.

The
meeting
Associated
for
the
requirements
of
this
we
held
via
Zoom
last
week,
and
you
know
we
we
sent
out
the
mailer.
We
gave
a
QR
code
on
that
meeting
notice
for
anyone
who
struggled
to
get
connected
to
the
zoom
meeting.
It
was
an
easy
put.
Your
phone
up
to
it
and
Connect
into
the
meeting
had
about
six
people
attend
that
meeting.

a
lot
of
the
questions
we
got,
the
big
one
I
think
mostly
everyone
had
concerns
with.
How
are
we
going
to
keep
four-wheelers
out?
That
is
going
to
be
a
huge
challenge.
That's
basically
the
main
activity.
That's
happening
on
that
site
right
now.
For
the
past
20
years
the
site
was
owned
by
a
bank
that
was
deferred
on
it,
so
it
kind
of
became
breeding
grounds
for
this
type
of
illegal
activity
of
people
going
through
there
with
their
four-wheelers
there.
There
are
some
Design
Elements
we
can
do.

We
can
do
pinch
points
at
all.
Our
entry
points
to
the
trails
to
keep
four-wheelers
out
motorcycles
are
going
to
be
a
little
tougher,
but
what
we
tend
to
see
is
once
we
see
this
place,
get
activated
and
used
tends
to
displace
those
issues.
We
we
really
don't
have
problems
with
four-wheelers
at
Copper
Creek
Lake
Park,
so
we
imagine
that'll
spread
into
this
park
as
soon
as
it
kind
of
gets
established.

Some
of
the
the
other
concerns
out
there
is,
you
know
like
like
park
hours
who's
managing.
If
someone
gets
you
know
out
of
control
and
what
Police
Department's
going
to
be
in
charge
of
this
Des
Moines
or
Pleasant
Hill,
it
falls
under
jurisdiction
of
Des
Moines.

Some
of
the
rest
of
the
work
we
have
going
on
in
the
green
belt
is
some
of
you
may
know.
We
took
over
Sleepy
Hollow
Sports
Complex,
so
in
our
staffing
plan
of
that
in
the
next
come
few
years,
we
will
be
hiring
a
resident
Ranger
at
all
our
other
Parks.
We
have
resident
Rangers
that
live
in
the
park.
We
will
be
creating
a
position
for
a
resident
Ranger
at
Sleepy
Hollow,
so
this
location
is
less
than
a
mile
away,
so
they
will
be
tasked
with
patrolling
this
area.

of
the
other
questions
kind
of
are
focused
around
the
neighborhood
to
the
South
they're,
technically
in
Pleasant
Hill,
all
those
streets
that
service
that
neighborhood
those
are
private
streets.

lot
of
the
concerns
are
coming
is
what
if
people
are
parking
there
and
entering
the
park
through
that
location,
so
design
wise.
We
did
not
specific
Heights
specify
a
entry
point
in
that
section
of
the
park.
We
built
the
the
parking
lot
on
the
west
to
encourage
access
there.

if
we
do
start
to
see
that
becoming
a
problem,
we
we
will
look
at
having
our
Ranger
Patrol
that
if
we
with
some
of
the
residents
we
talked
about
a
buffer.

vegetated
buffer
or

fence,

open

those

and

we'll
kind

just
see
what
we

need
to
do
to
work
through
that.

able

Perimeter
and

the
interior
is
kind

these
interior
Loops.

could
ride
those
ride
back
up
ride
the
next
one,
so
four
and
a
half
miles
would
really
kind
of
translate.

I
am
the

president
of
the
central
Iowa
Trail
Association,
so
the
central
Iowa
Trail
Association
Ceta
was
formed
in
1998
where
a
non-profit
organization
we
have
about
180
members,
families,
and
we
are
a
chapter
of
imba
I
thought
I
was
doing
that
we're
a
chapter.
Remember
International
mountain
biking
Association,
so
we
build
and
maintain
all
the
single
track
trails
in
the
in
the
Des
Moines
area.
I
So
to
answer
your
question
about
the
professional
built
trails
at
Center
roller
coaster,
those
are
the
trails
on
the
West
Side.
Those
are
professionally
built,
designed
and
built.
The
trails
on
the
east
side
were
more
traditional
hand,
built
or
Legacy
type
design.
I
So
Ceda
is
in
support
of
this.
We
think
that
this
is
going
to
be
a
a
good
destination
for
mountain
bikers
in
the
state
of
Iowa
and
the
region
as
well.
There.
There
is
not
a
trail
system
in
Iowa.
Currently
that
is
like
this
trail
system.
This
will
be
a
unique
feature
for
us.
We
do
think
that
it'll
be
a
destination
to
like
Adam
said
people
are
willing
to
drive
Miles
and
Miles
hours
to
do
trails
to
ride
Trails
simpler,
similar
to
this
so
Bentonville
was
mentioned
earlier.
I
Canyon
lakes
in
in
Minnesota
is
the
destination.
Marquette.
Michigan
is
another
destination.
Those
are
all
six
eight
hour
drives
and
people
will
willingly
spend
a
weekend
driving
up,
spend
16
18
hours
in
the
car
to
ride
for
a
day,
so
we
do
believe
it'll
be
a
destination
similar
to
how
the
skate
park
has
become
a
destination
for
Des
Moines.

We
think
it'll
help
bring
in
we
don't
it's
not
on
that
scale,
necessarily
like
having
a
do-tour
type
event,
but
as
far
as
a
destination
come
and
spend
the
weekend
in
Des
Moines
spend
your
money
in
Des
Moines.
We
definitely
see
a
benefit
to
that
is
invested
in
in
the
project.
We've
We've
coordinated
with
an
imba
dig
in
Grant
and
have
provided
funds
already
towards
that
development
of
this
trail
system
towards
the
design,
some
of
the
design
costs
and
then
mountain
bikers.
We
just
kind
of
we
just
love
being
outdoors.
I
We're
definitely
we're
stewards
of
the
land
we
enjoy
being
out
in
nature,
enjoying
the
wildlife,
the
the
birds,
the
the
deer
there's,
a
larger
deer
population
in
the
Des
Moines
Area,
almost
every
ride.
You
see
deer
on
your
ride
and
all
the
different
birds
and
everything
else
enjoying
hearing
those
those
sounds
of
nature.
Hearing
the
bugs
and
and
everything
else
another
feature
or
potential
feature
is:
mountain
biking
is
growing
in
the
state
of
Iowa
for
for
high
schoolers,
there's
a
there's,
an
up-and-coming
mountain
bike.
I
I
You'll
see
families
on
the
trail,
Adam
talked
about
Strider
bikes
having
having
young
kids,
kids,
that
are,
that
are
two
three
years
old
riding
with
their
parents,
clear
up
to
the
whole
family
group
of
high
schoolers
and
their
mom
and
dad
Sports.
It's
it's
another
Avenue
for
for
high
schoolers
to
be
involved
in
their
Community,
because
high
schoolers
are
going
to
be
busy
whether
it's
it's
good
things
or
bad
things.
You
give
an
Avenue
for
a
sport,
it
keeps
them
out
of
trouble.
I
There's
another
opportunity
for
us
is
Iowa
is
47th
in
the
state
in
public
land
use.
2.8
percent
of
our
land
in
the
state
of
Iowa
is
owned
by
the
public.
So
this
act.
You
know
it
has
a
floodplain
his
you
know
his
zone
is
a
floodplain
right
now,
most
of
the
public
land
in
the
state
of
Iowa.
Is
that
case.
The
design
of
this
trail
system
will
have
minimal
impact
to
the
trail
system.
I
If
we
do
do
have
a
hundred
year,
flood
event,
so
yeah
I
think
this
can
help
make
mountain
biking
a
destination
for
central
Iowa.
It
expands
the
the
reach
of
the
sport
in
the
state,
and
the
agreement
will
be
once
the
trail
system
is
built,
see
that
we
are
going
to
take
over
the
maintenance
of
the
of
the
trail
system.
That
is
the
agreement
that
we
would
enter
in
with
with
Polk
County
similar.
We
already
have
an
agreement
for
the
Sycamore
trail
system.
I

they
defer
a
vote
on
this
item

withhold
their
their
votes

effort

the

deals

received
one
letter
from

zoo
meeting
the
day
after
Labor
Day.
There
were
only
six
attendees
at
that
meeting,
including
one
Pleasant
Hill
City
employee.

were
71
people
that
allegedly
received
this
mailing
about
a
zoom
meeting,
and
that
means
93
percent
of
the
property
owners
that
are
adjacent
to
this
property
did
not
attend,
and
it
also
means
that
their
concerns
really
were
not
addressed.
Also,
we
heard
tonight
that
there
was
an
Edgewater
Townhomes
association
meeting.
However,
I
got
no
notice
of
that.

found
out
later
that
two
of
the
attendees,

that
normal
meeting,
that
we
have
monthly
two
of
those
members
of
our
association
attended
that
particular
meeting

of
us
didn't
know

thing
about
this
presentation

Conservation
Commission.

known
about
it,
I'd
have
been

received

notice
from
the
Conservation
Commission
at

that
particular

answers

from

representative

impacts

character

peaceful
neighborhood

board
to

meeting

little
bit

context

The
first
item
is
requesting
a
waiver
of
one
of
the
public
sidewalk
connections.
This
is
at
the
northeast
corner.

amount

landscape
buffering
with
those
trees

that
West
lot
line

addition,
they'll
also
be
trees

trees
along
both

feel
like
every
single
unit
needed
a
connection
to
the
public
sidewalk,
but
staff
did
recommend
providing
a
connection
at
that
Northeast
and
the
southeast
corner
of
the
property.

help
with
residents,
visitors
and
people
delivering
mail

be
able

move
through
that

make

part
of
that
retaining
wall
project,
and
it

modular

would
be
easy
to
modify

they

putting

a
new
stairway
or
sidewalk

concern

northeast
corner.
They
are
okay
with
putting
in

Southeast
Corner

but
with

north
they're

worried
about
the
proximity
to

proposed
that

know
that
was
one
of
their
concerns.
Staff,
however,
is
recommending
denial
of
this
item.

the
maximum
width
allowed
of
this
building,

is
the
eight
unit
building
proposed
normally

building

zoning
would
only
be
allowed
five
units
maximum.
However,
this
site
has
some
constraints

wouldn't

able

is
over

feet
and
the
width
of
the
site
is
only
188
feet,
so
you
can
see

buildings

it
pretty
tricky
to
get

far

averaging
about
42
feet,
and
so
they
are
hoping
to
keep
the
building
fronting
wilamere

little
bit
closer
to
be
able
to
fit
everything

both
of
those.

rear
setback
which,
on
this
site,
because
we
consider
floor
that
front
setback,

consider
the
adjacent
property

30-foot

width

makes
that
pretty
tricky,
so
they're
hoping
to
get
around
20
feet.
Instead,
as
that
setback
and
like
I
mentioned
earlier,
we
do

lot
of
trees
that
are
going
up
there

provide
some
extra
buffering.

staff
does
recommend
approval
and
then
that
last
item
is
the
transparency.

stated

are,
however,
opposed
to
a
development
that
will
forever
change
the
character
and
the
historical
Aesthetics
of
our
neighborhood
we're
talking
about
building
a
three-story
building
on
an
elevated
surface
next
to
single
level
homes.

So,
back
at
that
January
meeting,
you
heard
our
concerns.
You
felt
the
resident's
energy
and
vigor
as
we
protested
this
development,
you
voted
with
us
to
help
protect
our
neighborhood
and
the
charm.
We
fell
in
love
with
when
we
moved
there.
Unfortunately,
a
few
months
later,
the
issue
went
to
city
council,
where
they
chose
to
ignore
the
resident's
concerns
they
disregarded
the
over
800
signatures
in
opposition
we
provided
to
them.

They
completely
ignored
the
fact
that
the
Iowa
Supreme
Court
has
deemed
this
type
of
spot
zoning
illegal
and
they
belittled
and
disrespected
the
Planning
Commission,
by
overruling
your
recommendation
so
since
that
city
council,
since
the
time
city
council
overturned
your
recommendation,
city
planners
planners,
have
sent
three
letters
to
the
developer.
Each
of
those
letters
touched
on
many
concerns,
including
several
we
are
addressing
tonight.

The
project
has
consistently
been
asking
for
more
than
is
allowed,
it
required.

the
developer
wants

So
let
me
put
this
into
perspective
for
you
old
west
Mexican
restaurant
on
Fleur
Drive,
it's
a
wonderful
place.
If
you
have
ever
been
there,
you
know
how
close
it
sits
to
Fleur
Drive
sitting
by
the
windows.

Even
though
this
statement
was
in
the
previous
letters
to
the
developer,
it
evidently
went
unnoticed
as
every
one
of
those
trees
were
removed.
Several
weeks
prior,
both
the
May
10th
and
July
29th
letter
mentioned
the
grade
of
the
driveway
stating
and
I
quote.
As
previously
noted,
proposed.
Grading
of
the
driveway
at
a
public
sidewalk
is
concerning
slopes
of
15
to
20
percent
after
a
sidewalk
will
result
in
vehicles
bottoming
out
with
this
not
being
revised.
The
designer
acknowledges
risks
of
problems
with
vehicles
entering
and
exiting
the
site.

Again,
no
changes
were
made
to
that
19.8
percent
grade.
To
address
this
concern.
The
developer
is
literally
accepting
risk
to
damage
personal
property
rather
than
fixing
something
the
city
told
him
is
going
to
be
a
problem.
The
scope
creep
of
this
project
is
absolutely
absurd.
Even
when
the
designer
was
looking
to
have
wrecked
a
monument
signed
for
the
property,
he
was
seeking
to
install
a
sign
that
was
quite
literally
90
percent,
larger
than
what
the
city
code
allows.

This

recently
approved
the
Pinnacle
on
Fleur.
There
was
Zero
public
opposition
to
this
development
and
it's
only
a
quarter
mile
away
from
this
location.
The
reasons
are
simple:
the
Pinnacle
is

units

three
acres

Oaks

units
on
less
than
one
acre.
There
are
four
trees
that
plan
to
be
removed
at
the
Pinnacle,
why
the
Oaks
has
already
already
removed.

regards

request

not

sidewalk

children
go
to
school
at
Brody.
There
are
many
children
that
go
to
school
in
Brody
in
those
neighborhoods
from
the
apartments
on
that
side,
there's
no
sidewalks
and
it's

very
important
that
they
get
a
sidewalk,
so
those
children
not
having
to
walk
in
the
street.

same
concerns
about
the
Builder's
requests
to
change
all
of
these
setbacks.
He
wants
to
reduce
one
by
75
percent
another
by

percent.
Another
by
30
percent.
Visibility
on
the
corner
of
Fleur

willowmere
is
very
problematic
and
when
you
are
coming
on
floor,
headed
south
and
you
approach
that
corner
cars
are
going
45
miles
an
hour
plus
up
a
hill.

trying
to
pull
out
from
William
or
onto
floor,
you
have
cars
coming
very
quickly
popping
over
that
hill
and
having
reduced
visibility
is
going
to
be
very
dangerous,
there's
already
issues
with
flooding

everything

on
that
corner.

can
just

exceptions
for
them
all
the
time
they're

in
place
for
a
reason,
and
this
Builder
knew
these
city
codes
when
he
took
on
this
project
and

he
wants
to
his
own
financial
advantage

benefit
to
our
neighborhood

the

building

huge
things,
pushing
them

by

pulling
out
of
the
ruining

southwest

got
the
Elevate
townhome

have

brick
stone
calibers
project
right
on
Thomas
Beck.

breaking

is
incredible
development
on
this
southwest
side

short
period
of
time,
and

Corridor

seen
this
Redevelopment

be
