Welcome

the
august
4th
2022
meeting
of
the
city
of
des
moines
plan
and
zoning
commission,
I
will
first
read
the
rules
and
procedures.
The
plan
and
zoning
commission
is
generally
an
advisory
body
to
the
city
council.
The
city
council
will
hold
a
public
hearing
and
make
the
final
decision
on
all
matters
before
the
commission
other
than
site
plans
and
subdivision
plans,
unless
denials
or
conditional
approvals
thereof
are
appealed.
A
Applicant
will
be
given
10
minutes
to
present
the
request
proponents,
and
then
opponents
from
the
public
are
then
allowed
to
speak
in
that
order
with
each
speaker
allowed.
A
maximum
of
five
minutes
applicant
is
then
allowed
five
minutes
for
a
bundle.
The
hearing
will
then
be
closed
and
the
commission
will
discuss
and
vote
on
the
issue.
All
comments
are
to
be
germaine
to
the
item
under
consideration
and
speakers
are
to
maintain
a
courteous
manner.
A

listed
on

consent
portion
of
the
agenda
will
not
be
individually
discussed
and
will
be
considered
for
approval,
in
accordance
with
the
recommendation
in
the
staff
report.
Unless
an
individual
present
or
member
of
the
commission
requests

property
is
required
to
do
a
preliminary
plant
because
along
east
broadway
avenue
there's
existing
sanitary
sewer
that
needs
to
be
extended
to
the
western
extents
of
the
property.
So
this
included
with
this
subdivision
would
be
the
extension
of
that
sanitary
sewer
along
east
broadway
avenue
to
serve
these
lots
and
then
future
development
to
the
west
could
pick
up
and
carry
it
forward.
Similarly,
there's
water
existing
water
in
east
broadway
avenue
that
would
serve
these
three
lots.

Two
lots
are
around
34
000
and
one
lot
is
quite
a
little
bit
larger
because
it
carries
that
back
portion
of
the
property
as
well

stormwater
management
is
expected
to
be
provided
on
each
individual
lot.
There
would
be
a
stormwater
basin,
so
at
the
southern
ends
of
lots,
two
and
three
and
then
a
basin
on
lot
one
as
well.
These
three
basins
would
be
connected
to
each
other,
so
the
existing
drainage
generally
drains
to
the
southeast.
These
basins
would
generally
match
that
that
pattern
draining
to
the
southeast.

5.1
acres,

it'll
be
about
three
homes
on
5.1
acres.
The
three
lots
immediately
to
the
east
of
this
is
about
three
homes
on
4.7
acres.
So
the
density
between
the
two
is
pretty
similar.

a
pud
rezoning
request
for
property
at
4580,
hubble
avenue
the
applicant
is
requesting
a
portion
of
the
existing
baker
pud
to
be
rezoned
to
mx3
district,
to
allow
a
church
and
associated
users.

This
is
the
map
of
the
of
the
area.
You
can
see
the
the
the
area
that's
being
proposed
to
be
rezoned
out
of
the
bud
is
right.

hubble
avenue,
east
broadway,
east
46th
street.
I
have
a
slightly
bigger
vicinity
map
that
shows
the
area
the
larger
baker.

Is
this
encompasses
this
entire
area?
If
you
can
follow
my
cursor,
the
portion
that
we
are
specifically
looking
at
rezoning
is
right
here
on
the
northeast
corner.
It's
currently
vacant.

It
has
the
tributary
of
the
four
mile
creek
that
runs
kind
of
right
here,
south
west
of
the
property
and
conservation
easement
associated
with
it.
I
This
is
the
conceptual
plan
of
what
the
applicant
is
proposing
for
this
particular
rezoning
request.
So,
as
you
can
see
I'll
just
zoom
in
a
little
bit,
so
it's
a
little
bit
easier
to
see
the
the
applicant
is
proposing
a
church
and
an
an
event
space.
I
So,
as
you
can
see,
there's
a
one
story:
4
000
square
feet,
event,
space,
there's
office,
classroom
area,
there's
an
outdoor
venue
area
which
can
hold
events
such
as
weddings
and
other
associated
events
related
to
the
church.
There's
also
a
play
area,
a
parking
lot
and
the
area
fronting
east
46th
street
currently
doesn't
have
anything
proposed.
But
potentially
there
could
be
some
expansion
of
church
users
in
this
area
as
well.

The
outlaw
z
that
you
can
see
right
here
about
1.5
acres.
Currently,
nothing
is
proposed.
The
applicant
intends
to
sell
that
off
in
the
future
for
commercial
type,
retail
type
development
along
the
hubble
avenue
corridor.
So,
as
you
can
see,
there's
a
few
mix
of
uses
that
the
applicant
has
proposed
and
they
fit
the
best
for
the
fit
the
best
in
an
mx3
district,
which
is
what
is
being
request
requested
for
rezoning.

The
this
particular
pud
was
established
in
1997,
as
provided
in
in
your
in
your
report.
There
have
been
a
few
other
amendments
after
this,
the
most
recent
one
being
the
seventh
amendment.
This
is
number
eight
staff
has
reviewed
this
and
we
do
not
see
any.

Concerns
and
would
recommend
approval
as
it
fits
with
the
character
of
the
area,
the
commercial
nature
of
along
along
hubble
avenue,
as
well
as
the
proposed
uses
that
are
in
alignment
with
with
the
adjoining
area.
So
with
that
staff
is
recommending
approval.
We,
the
the
applicant,
did
a
neighborhood
meeting.
Here's
a
summary.

There
were
about
11
attendees
and
here's
a
summary
of
what
some
of
the
issues
that
were
discussed
and
the
applicant
has
indicated
that
they
will
be
working
on
addressing
some
of
the
issues
that
have
been
brought
forward
by
the
by
the
attendees
at
the
at
the
neighborhood
meeting,
including
addition
of
a
privacy
fence
on
the
northeast
corner
and
exploring
ways
to
slow
down
the
flow
of
the
creek.

and
this
is
the
consent
map,
as
you
can
see,
the
the
the
two
cards
in
in
support
came
from
here
and
from
this
property
directly
north
of
the
proposed
rezoning
area,
and
this
is
the
property
that
was
in
opposition.

approved
and
once
approved
by
the
council,
it
will
come
back

plan,
potentially
a
preliminary
plan

wife
and
I
are
buying
this
property,
and
so
we're
not
with
the
owner.
The
labor
union
is
the
current
owner,
but
they're
in
agreement
with
us
to
to
make
the
zoning
change.
We
are
under
contract
to
buy
it.
Assuming
everything
goes
well
here.
We
we
plan
to
do
that
here
in
the
next
30
days.

Just
add
that
kind
of
our
vision,
for
it
is
my
wife
and
I
are
helping
a
hispanic
church
start
we're
meeting
downtown
right
now
and
we're
hoping
to
have
our
own
building.
Our
vision
is
to
create
a
building
that
can
have
events
to
kind
of
pay
for
the
building,
but
then
have
community
outreach
and
also
have
the
church.

So
it's
kind
of
a
three-fold
thing:
we'd
like
to
partner
with
police
fire
schools
to
do
community
events,
but
we'd
also
want
to
help
this
hispanic
church
get
off
the
ground,
and
so
we're
going
to
donate
the
land
to
the
nonprofit.
The
nonprofit
then
will
get
a
loan
and
build
the
building,
and
then
hopefully
these
the
events
are
enough
to
pay
the
mortgage.
Otherwise
I
got
to
put
in
more
money
so,
but
we're
really
happy
to
do
it
excited
about
the
place.

It's
a
weird
shape
property,
but
it
fits
well
for
us
because
we
kind
of
like
to
tuck
back
in
there
in
the
woods
and
for
this
event
center
and
and
have
a
little
seclusion.
We
met
some
nice
neighbors
the
other
day,
including
shirley
here
and
she's
up
there
on
the
north,
and
so
we're
talking
about
the
privacy
fence
to
kind
of
keep
the
headlights
from
shining
into
her
house
and
then
we'll
also
kind
of
take
a
look
at
some
of
those
other
items
and
see
what
we
can
do.

questions

emerged

the
meeting
with
the
neighbors.

answered
those
questions
with
the
neighborhood
or
could
you
answer

them-

don't
know
so
like
like
that
privacy
one-
was
the
easy
one.
The
biggest
concern
seemed
to
be
that
safety
of
the
creek
they're
very
concerned
about
those
big
flows
that
come
through
there.
When
it
rains
and
just
being
a
hazard
to
kids,
we
could
explore
just
putting
up
a
fence
on
our
side.
There'd
still
be
the
apartments
on
the
other
side
of
the
creek,
but
as
far
as
our
side,
we
could
maybe
look
at
a
fence
which
certainly
could
look
at
the
erosion
going
on
with
the
creek.

But
of
course,
we'd
have
to
get
a
permit.
You
know
from
the
core,
and
you
know
see
what
you
could
we
could
do,
but
we
could
certainly
address
the
safety
issue
that
they
raised.
Some
of
those
others
like
widening
of
the
street
or
the
sidewalk.
I
assume
we'd
have
that
discussion
with
city
staff
and
kind
of
see
what's
required
there.

I
appreciate
the
concern
we're
obviously
we'll
have
to
just
comply
with
any
kind
of
noise
ordinances.
You
know
shutting,
I
assume
it's
probably
10
p.m,
so
shutting
things
off
at
10
p.m.
I
really
anticipate
most
things
that
make
noise
being
inside
the
building.
So
I'm
really
hopeful
it's
not
a
problem
outside,
but
we'll
definitely
have
to
work
on
being
good.

again,
state-
and
our
job
here
is
I'd
like
to
address
the
property
owners
is
as
commissioners
we're
supposed
to
do
what's
best
for
the
city
and
follow
the
rules
and
regulations
and
the
ordinance
of
the
city
what's
in

best
interest,
and
sometimes
those
conflict
with
individual
considerations,
and
we
do
take
individual
considerations
into
in
our
discernment
of
making
decisions.
But
all
in
all,
we
think
it's
best
for
the
city
that
this
current
zoning
is
industrial.
So
actually
a
lot
worse
uses
could
be
done
to
this
property.

main
point
of
entry
is
from
46th
street
correct,
it's
not,
it
won't
be.
The
access
point
won't
be
from
hubble
from
what
I've
seen.
It
looks
like
the
way
it's
drawn
out
and
laid
out
it.

line
so.

have
submitted
a
you

conceptual
sketch
that
has
not
gone
through
any
sort
of
site
plan,
formal
review
just
to
illustrate
their
intent,
but
yeah

mean
they

showing
off

46th
street

a
state
highway,
so
they'll
have
some
input
on
whether
or
not
there
could
be
any
controlled
access
off
the
hubble.
But
I
would
say
the
balance
of
this
site
will
come
off
