variance
by
part
three
section
60
of

Inglewood
City
Charter.

aggrieved

decision
rendered
by
this
board
may
appeal
that
decision
to
a
court
of
record.
However,
such
appeal
must
be
made
within
30
days
of
the
Board's
decision.
Any
approved
variance
is
effective
at
the
end
of
the
appeal
period.

permits
for
construction
associated
with
an
approved
variance
will
not
be
issued
until
the
appeal
period
is
ended,
building
permits
must
be
obtained
and
construction
began
within
180
days
of
the
variances
effective
date
procedure,
for
the
meeting
is
that
the
case
will
be
introduced
and
an
overview
will
be
given
by
staff.
Applicant
will
present
the
request
and
reasons
that
the
variance
should
be
granted.
Proponents
will
be
given
an
opportunity
to
speak.

the

applicant

variance

the
applicant
is
requesting
is
there
is
a
requirement
in
the
MU

zone
districts
to
incorporate
a
commercial
use
into
50%
of
the
ground
floor
space.
The
applicant
is
requesting
that
that
that
percentage
be
taken
down
to
zero.
The
second
variance
request
is
for
this
concrete
drive
on
the
north
side
of
the
property
it
was.

a

The
only
other
things
I
would
add
is
that
some
of
the
some
of
the
traffic
counts
on
these
streets
in
the
on
Broadway
in
this
area,
traffic
counts

approximately
28,000
vehicles
a
day.
That's
combined
north
and
south
on
Lincoln
there's
less
than
a
thousand.
It's
in
the
hundreds
of
vehicle
counts
per
day,
both
ways
and
then,
if
you
were
to
jump
over
a
couple
of
streets
to
Logan,
it
jumps
back
up
to
eight
to
ten
thousand
vehicle
trips
per
day.

way
this
is
shown

It
is
a
two
way
drive,

there
is
no
outlet
to
Lincoln.
It
is
20
feet
from
that
end,
all
the
way
to
the
alley
traffic
put
a
comment
in

that's

report

what
traffic
was
saying
was
first
of
all
make
it
one
way
if
you're
gonna
make
it
narrower,
and
so
this
would
have
to
be
opened
up
to
Lincoln,
and
but
they
were
also
saying
at
these
two
ends
where
it
meets

street
and
the
alley
make
it

feet.

is
proposing

open

basically

residents.

would
be
using
that
every

that's
really
for
the
board
to
consider.

applicant

think

really
matters

traffic
or

Development
Department.
You
do
have
to
be
in
the
current
configuration.
It
would
probably
be
better
to
enter
off

alley
depending
on
how
this
gets
narrowed
down
to
16
feet,
because
you
can
have
some
sight
distance
issues
with
this
garbage
dumpster
being
right
where
the
drive
meets
the
alley.

conceivable
that
if
this
gets
narrowed
down
and
cars
are
further
away
from
that
dumpster
that
wouldn't
come
into
play.
But
certainly
if
you
were
entering
off
the
alley,
then
you
don't
have
that
sight
distance
issue
and

this
back
here
is
farther
far
enough
away
from
the
sidewalk
to
not
have
that
issue.
So
I
think
it
can
work
either
way,
but
maybe
the
applicant
can
tell
us
how
they
would
intend
to
which
way
that
traffic
would
go
and.

aspect

it

just

not
necessary

sort
of
impossible,
considering
the
traffic

Inglewood
foreclosure
and
then
ask
for
the
actual
dry

over

we

four
criterions
that
we
have
to
address
each
variance
when
the
Criterion's
are
the
first
one
is
that
a
unique
physical
condition
exists,
such
as
size
shape,
location,
topography
or
surroundings,
which
are
peculiar
to
the
land
or
structure
involved
which
deprived
the
applicant
or
privileges
enjoyed
by
others
properties
in
the
vicinity.
The
second
is
that
the
variance
is
consistent
with
the
intent
of
the
zone
district
regulations
to
secure
public
health,
safety
and
welfare.

third
is
that
the
variance
will
not
permanently
impaired
the
use
or
development
of
adjacent
conforming
properties
or
alter
the
essential
characteristic
of
the
neighborhood.
And
the
fourth
is
the
variance
is
not
self-imposed
difficulty
or
hardship.
So
when
you
get
up
here,
if
you
could
address
the
variances
I'll,
give
you
a
little
leeway.
But
if
you
start
straying
off
the
variances
I'm
gonna
have
to
cut
you
off,
because
we
don't
have
power
to
do
something
that

feet

driveway

take
out
that
front
wall,
there's
only
gonna
be
about
enough
space
for
like
one
really
small

bush,

wondering

neighborhood

history
guy

house
was
built
in
1915
that
the
applicant
is

replace
and
it
was
most
likely

Foley,
who
is
a
city
councilman
or
by
Norman
McClellan,
another
city
councilman,
the
clowns
of
a
McClellan
reservoirs
named
after
it
came
out
of
a
catalog

know
if
you
guys
know
at
this
story:
Montgomery,
Ward's
or
Sears.
You
saw
a
picture,
he
ordered
the
you
ordered
your
house.

appreciated
before

live
on
the
block

you
could
use

argument

there's

story,
building
one
block
from
me
on
what
1,100,
East,
Gerrard

then
plunk
one
of
these
on
my
property
one
day,
because
my
lot
is
so
big
and
and
it's
it's
very
sad
because
it
is
degrading
the
residential
nature
of
Englewood
and
that's
what
I
came
to
say.

design

think
about
the
residents
instead

the
builders
for
a
change,
because
that's
what
we're
seeing

especially
in
our
older
homes,

getting
calls
on
the
phone.

homeowners

get

of

living

of
character
with

housing

crowding

character

the
old

we
didn't
know
enough
to
ask

would
be
the
hours
of
operation
right
now,
they're
operating
three
days
a
week,
but
no
Saturday
morning

had
to
go
to
waste
management.

take
it.

garbage
I'm,
getting
so
I
talked
to

don't
call
the
play
it's

Is
this

kind

a
surprise

all
these

property
sits

off
of
our
property

owner

sold
it

Meeks.
He
thought
we
were
on
his
property
and
my
wife
is
in
construction
and
if
she
look,
she
got
the
property
record,
so
everything
has
to
be
right
as
far
as
property
line,

got
a
fence
here,
I,
don't
know
that's
going
to
get
replaced
with
his
balls.

it
comes
to,
it's
all,
gonna
be
better
than
a
boarded
up
house.
The
court
officer
told
me
that
the
boarded
up
house
had
burned
three
and
a
half
years
ago
across
the
alley
to
the
east
that
they
can't
do
anything.

doctor
at
the
clinic,
that's
one
of
the
reasons
he
sold
the
clinic.
He
was
getting
tired
of
parking
and
all
of
its
people
parking
next
to
this
boarded
up
Hollis
with
with
all
homeless
people
crouching
in
there,
which,
which
I
prevented
by.

And
those
help
that
way,
I'll
be
better
in
the
court
officers
said
that
there's
a
boarded
up
building
can
stay
there
for
years
and
so
long
as
it
doesn't
present
a
falling-down
danger
right,

think
that's
something
else.
City
calls
for
games
and
the
doctor
was
astounded
that
they
wouldn't
that
they
wouldn't
have
some
sooner
time
framework
than
then
right.

It
comes
down
to
it.
We
figure
some
of
these
other
folks,
eventually
that
lot
rate
to
the
salt.

the
gravel
one
could
eventually
turn
into
an
apartment
building,
but
the
way
that
code
is
not

go
up

floors

you
can't
stand
in
the
way
of
that.

we

prevent

I
think
it
was
a
false
premise
and
doing
that
kind
of
thing,

think
it
came
from
a
very
bad
place
and
I
know

over
at
Swedish
there
were
some
areas
that
this
staff
wanted
desperately
to
rezone
to
MU.
So
they
could
build
these
gigantic
apartment
buildings
and
the
people
that
owned
the
property
down
graded
their
zoning
to
the
chagrin
of
staff.
And
now
those
people
have
died.
So
now
staff
is
all
eager
to
do
the
zoning
again
and.

they
have
to
have
there's
a
requirement
for
20%
of
the
space
that
20%
of
the
space
be
landscaped
that
comes
out
to
1200
square
feet
and
some
change?
There
are
alternative
methods
of
compliance
on
landscape
plan,
there's
alternative
landscape
materials,
some
of
those
aren't
shown
they
will
have
to
comply
with
the
landscape.

instance,
there
are
green
screens
that
you
can
get
credit
for
in
terms
of
a
vine.
We've
talked
about
some
vines
or
green
screen
on
the
south
side
of
the
property
and
perhaps
even
on
the
north,
and
so
there
are.
There
are
ways
to
achieve
that
land
that
landscape
requirement,
there's
also
provisions
for
rooftop
gardens
that
can
count
towards
the
landscape
requirement.

get
right
down
to
trees
and
shrubs,
there's
a
requirement
for
two

trees
and
thirteen
shrubs,
and
at
