with
this
Daniel
Chaffetz
property
for
sixteen
thousand-square-foot
development
site.

resolution,
the
key
thing
here
is
that
it
limits
the
city's
liability
against
future
owners.
Environmental
contamination
claims
specifically,
it
gives
us
additional
options:
it's
not
just
the
straight-up
purchase,
but
it
gives
us
the
option
to
acquire
the
property
through
eminent
domain
and
by
purchase.
Not
we
don't
plan
to
do
this
through
condemnation
and
then,
secondly,
it
limits
the
city's
liability
for
environmental
remediation
by
providing
complete
immunity
under
the
comprehensive
environmental
response.
Compensation

The
overarching
purpose
for
doing
it
is
it:
the
city's
acquisition
secures
the
property
in
the
short
term
and
it
positions
it
for
future
redevelopment.
So
we
by
acquiring
a
we
stabilize
that
corner
specifically
we've
invested
a
small
sum
in
some
environmental
studies.
We
understand
we
have
an
estimate
from
the
environmental
consultant
that
to
clean
the
site,
remove
the
for
storage
tanks
and
to
get
it
in
a
position
that
it's
kind
of
capped
and
backfilled
will
cost
approximately
seventy
five
thousand
dollars.
I
wanted
to
point
out
quickly
that
there
are
four
tanks.

site,
the
the
back
taxes,
are
owned
by
a
tax
fire.
They
brought
back
in
2007.
There
was
7,500
outstanding
because
so
much
time
has
elapsed,
penalties
have
accrued
Daniel
Chaffetz
through
his

his
foundation,
owns
approximately
45
thousand
dollars.
It'll
take
45
thousand
dollars
from
to
clear
the
title
and
by
the
way
the
tax
purchaser
has
finally
moved
forward
and
it's
file
deposit
petition
for
deed
with
the
court
and
that's
scheduled
for
july
25th.
So
again
the
city
was
able
to
acquire
it.

would
have
some
control
and
we
would
have
secured
that
corner.
We
don't
know
what
the
taxpayer
would
do
with
the
property
and
then
third,
you
know
we
have
had
this
real
estate
slow
down
that
we're
all
aware
of
so
again
by
acquiring
the
site.
We
have
control
of
it
and
provide
an
opportunity
for
a
stronger
gateway
development,
especially
if
we
assemble
it
with
the
process
to
the
north.
We
don't
know
what
the
the
tax
buyer
will
do.
We
don't
know
what
a
future
buyer
will
do.

the
site
if
we
acquire
it
and
I
want

end.
On
this
note,
we
we've
invested
approximately
fifteen
thousand
dollars
in
studies,
environmental
studies-

we
add
that
to
the

consider

be

127,000
listed
I
think
that's
a
deal
that
we
can
do
with
with
Daniel
Chaffetz
and
you
add,
in
the
remediation.
The
total
acquisition
cost
is
around
217,000.
Remember
the
appraised
value
is
340,000,
so
it's
kind
of
rare
opportunity
to
really
get
a
property.
That's
significantly
below
market
open
it
up
for
questions
other.

shallow

wouldn't

the

would
be

remove
the
storage
tanks
that
that's
the
limit
of
the
depth
that
you
could
dig
on
that
site,
maybe.

you
go
six
inches
down,
that's
as
far
as
you
can
go
to
be
able
to
build
on
the
site,
okay,
which
I
think
is
a
huge
problem.
If
we're
taking
the
site
that
we
know,
has
environmental
hazards
the
city's
taking
on
that
responsibility
and
I
know,
you
said
we're
doing
it
in
a
way
that
we
won't
be
held
liable
for
the
environmental
responsibility.

However,
if
we're
taking
this
property
along
with
the
adjacent
property
that
we
also
purchased
I
believe
two
years
ago,
and
that
with
no
potential
at
this
point
for
redevelopment,
we
have
no
idea.
We
have
a
west
of
instant
plan
that
has
not
moved
forward
in
this
particular
area.
By
doing
by
buying
a
site,
that's
contaminated
were
not
planning
to
do
the
remediation,
which
would
cost
upward
of
a
hundred
thousand.

that's
probably
likely
considering
what
we
heard
recently
and
economic
development
for
the
cleaner
site
on
right
across
from
the
police
station

think
they
actually
might
have
been
more
like

remediate
that
site.

with
that
said,

little
concerned
that
this
limits
are
redevelopment
possibilities
for
that
corner.

would

have
a
firm
estimate.

a
company
whose
reputable

estimate

signed

delivered

to
us,

plan
to

I
need

correct
what
you've
just
said
we
allowed

this
owner
to
pursue
a
classy

fact

remediation
exceeded
a
certain
percent
of
the
value
of
that
property.

it

not
exceed
that
the
actual
remediation
then

not
entitled

that

him

not

forward
with
this
remediation
and
this
property
will
sit
vacant

wants
to
mess
with
it

contaminated,

get
approval

support
my
application

the

remediation
costs
exceed
that
certain
amount,
we

nothing

lose

ahead.

much
money

remediation,
then

get
to
apply
for
the

property

of
property

being

if

had
passed
the
referendum,
you
wouldn't
be
losing

two,

I

wondering

anybody

any
of
