the
Zoning
Board
of
Appeals
of
the
city
of
Evanston.
The
zoning
ordinance
directs
this
body
to
hear
applications
for
major
variations,
special
uses
and
appeals
from
decisions
of
the
Zoning
Administrator,
depending
on
the
type
of
depending
on
the
type
of
matter.
This
board
will
either
make
a
final
determination
or
send
its
recommendation
to
City
Council
Scott.

with
four
people,
we
do
have
a
quorum,
it's
very
lean,
but
we
do
have
a
quorum.
Also
tonight
present
tonight
is
Planning
and
Zoning
Administrator
Scott
Mangum.
This
is
a
formal
meeting
and
there
are
rules
that
govern
our
proceedings.
Most
importantly,
only
one
person
speaks
at
a
time
so
that
all
testimony
may
be
accurately
recorded.
Anyone
who
wishes
to
address
the
board
regarding
any
matter
on
the
agenda
will
have
the
opportunity
to
do
so
at
the
appropriate
time.

procedure
is
to
hear
from
staff
on
the
documents
on
file
and
then
receive
testimony
and
other
evidence
from
the
applicant.
Our
appellant
next
persons
who
wish
to
make
a
statement
regarding
the
matter
may
do
so
at
that
time,
any
person
with
a
legal
interest
in
property
located
within
500
feet
of
the
subject.
Property
may
present
evidence
reasonably
question
witnesses
or
seek
a
continuance
of
the
hearing.
When
all
supporting
and
opposing
testimony
and
statements
have
been
heard,
the
applicant
or
appellant
will
be
given
the
opportunity
for
rebuttal
or
a
closing
statement.

objection
about
the
parking

not
that

would
go
across
the
corners
of
parking,
but
that
the
turning
radius
to
get
into
a
parking
spot
is
not
adequate

up
taking
up
two
spots
versus
being
only
in
one
spot
and
when
that
happened,
that
would
reduce
the
overall
effective
number
of
parking
spots.

want

make
that
clear.

special

for
a
type
2
restaurant
Frio
gelato
within
the
b1
business
district
and
the
ODM
dempster
main
overlay
district.
This
is
a
case
where
the
Zoning
Board
has
ability
to
make
a
recommendation
on
the
City
Council
City
Council
is
the
determining
body.
In
this
case,
both
city
staff
and
dapper
have
reviewed
the
recommendation
and
recommend
approval.

concern

based
on

plumbing
code.

not

Evanston.

based
on
Illinois
plumbing
code
and
there's
nothing.

can
do
about
that
right.

can't
change
the
unemployment

play

busy
with
people
walking
by

the
sidewalks
are
not
very
wide
on
that
part
of
them

side

street,

it

uncomfortable

people
to
sit
in
there
and
night.

could
be
a
little
bit
more,
but
in
the
afternoon
is
so
hot
in
there
in
the
summer.

don't
think
nobody
will
be
sitting
outside.

predict

employees

have
the

get
your
deliveries,

size
truck
they
take
in

where
that
delivery
happens,

truck
that
we
use
is

small

every

you're
pretty
well

business

that
location.
It
is
a
question
of
the
seating
and
the
plumbing
requirements
based
on
the
amount
of
seating
that
you
have
and
simply

alters

definition

business.
So
hopefully
you
can
remain
within
that
the
seating
restrictions
required
by
code
and
I'll.

people
stand
while
they
eat
their
ice
cream.

you
know
that
corner
location
was
empty
for
a
long
time
and
I
know
that
the
city
was
working
to
encourage
a
business
to
come
in
there
and
I
think
it's
an
important
corner
to
have
anchored-
and
you
know
we're
not
too
far
away,
and
we
were
delighted
to
see
that
you
were
moving
just
a
couple
of
doors
down.
So
great
use
I
think
it's
a
great
model
that
you
have
your
production
facility
in
Evanston,
so
Bravo

Think
businesses
like
yours
make
our
commercial
corridors
interesting
and
vibrant.

it's
a
great
location
and
I
think
outside
seating,
potentially,
if
designed
well,
could
further
add
to
the
sense
of
place
that
is
established
there
in
that
corridor.

guess
the
question
is
to
you
whether
there
is
anything
that
we
as
a
city
body
or
you,
as
staff,
can
do
to
sort
of
further
examine
whether
even
outside
seating
would
be
permitted
and
if
there's
anything
that
we
can
do
to
encourage
that,
because
I
am
concerned
that
that's
not
enough.

does
allow
for
outdoor
cafes,
sidewalk
cafes,
that's
something
we
could
look
at.
It
is
on
a
kind
of
case-by-case
basis,
depending
on
the
dimensions
and
and
making
sure
to
meet
ABA
standards.
So
we'd
have
to
take
a
look
at
the
what
the
sidewalk
dimensions
are
out
there,
but
it's
certainly
something.

that
is
a
very
busy
corner
and
at
this
store
of
course,
comes
right
up
to
the
corner.
So
that's
that
might
not
be
the
very
best
little
benches
as
he
has
that
his
other
store
might
be
a
possibility,
but
you
know,
depending
on
dimensions
but

Don't
think
that
that's
that's
an
issue
for
if
he
decides
to
to
go
for
it
and
in
the
meantime,
I
just
hope
that
there
are
a
lot
of
people
leaning
against
the
windows
which.

there
will

exterior
work

just
a
separate
permit.

all

that
sidewalk
seating
is
a
separate
permit,

application
and
all
that
sort
of
stuff.

if
he
wants
to
go
through
that,

what
he's
allowed
to
do
and
what
he
can

can't
do
so.

think
if
he's
interested
in
pursuing
that
route,
totally
up
to
you,
make
a
little
parklet
out
front
who
know
I'm
nobody's
gonna,

parking
there.

it's
really
just
the
sitting,
so
just
the
standards,
so
we've
heard
from
everybody
I
agree
with
everybody's
assessment.
I
was
so
excited
when
you
moved
into
the
corner.
It's
a
great
location.
That
corner
has
been
Oh
brown
covered
windows
for
way
too
long,
and
it's
gonna
be
it's
just
it's
a
great
spot
and
it's
a
great
neighborhood
location,
again,
I'm
really
just
concerned
about
this
seating
and
that
we
stick
to
eight
seats
because
that's
all
you're
allowed
is
eight
seats
and
that
go
back
to
the
bars.

Take
the
stools
away,
give
people
a
place
to
put
their
glass
and
all
that
good
stuff
and
then
we'll
be
in
good
shape.
So
with
that
we're
gonna
go
through
the
standards.
They're
gonna
be
some
conditions
on
this
one.
So
let's
go
through
this
okay
number
one.
It
is
one
of
the
special
uses
specifically
listed
in
the
zoning
ordinance,
a
type
one
restaurant
certainly
is,
and
there
are
others
in
the
neighborhood.
So
this
standard
has
been
met.
A
Number
two:
it
is
in
keeping
with
purposes
and
policies
of
the
adopted,
comprehensive
general
plan
and
the
zoning
ordinance
as
amended
to
from
time
to
time.
One
of
the
purposes
of
the
comprehensive
general
plan
is
to
retain
and
enhance
a
diversity
of
businesses
in
in
the
areas,
and
this
certainly
is
a
diverse
business
for
this
area.
We're
also
retaining
an
Evanston
business
which
is
made
in
Evanston
and
the
owners
are
in
Evanston,
and
it's
all
good,
so
I
think
that
that
certainly
meets
that
you
that
standard
number
three.

So
I
do
believe
that
that
standard
has
been
met,
number
four:
it
does
not
interfere
with
or
diminish
the
value
of
property
in
the
neighborhood.
That
is
definitely
not
the
case.
Getting
rid
of
a
vacant
storefronts
certainly
improves
the
value
of
the
property
in
in
the
surrounding
area,
so
that
standard
has
been
met,
number
five:
it
can
be
adequately
served
by
public
facilities
and
services.
This
was
an
existing
building
that
is
served
by
streets
and
so
and
the
L
and
public
parking
and
all
that
good
stuff.

So
I
do
believe
that
that
standard
has
been
met.
Number
six.
It
does
not
cause
undue
traffic
congestion.
My
sense
of
it
is
that
the
bulk
of
your
customers
are
within
walking
distance
and
your
radius
is
actually
quite
large.
You
have
a
lot
of
walking
traffic
from
the
east
as
well
as
the
West,
so
I
think
that
the
bulk
of
your
traffic
is
going
to
be
that
way
and
anybody
else
who
wants
to
go
there
is
is
subject
to
the
same
parking
that
would
be
for
any
other
location
in
the
neighborhood.

So
I
believe
that
that
standard
has
been
met.
Number
seven
preserves
significant
historical
and
architectural
resources.
This
is
actually
one
of
the
buildings
where
we
get
to
apply
it.
It's
actually
a
nice
looking
building
and
having
that
tent.
Having
that
be
occupied
and
activated
is
a
nice
thing,
so
I
believe
that
that
standard
has
been
met,
number
eight.
It
preserves
significant
natural
and
environmental
features
which
is
not
applicable
and
nine.
