A
The
purpose
and
function
of
the
Jacksonville
Beach
special
magistrate,
Hearing
in
accordance
with
Florida
Statutes
chapter
162
and
the
City
of
Jacksonville
Beach
code
of
ordinances,
is
to
reach
an
equitable
expedition
to
enforce
the
codes.
The
city
presents
the
violation
and
evidence
to
the
special
registry.
Next,
the
property
owner
is
sworn
in
and
responds
to
the
violation
and
evidence.
Both
the
city
and
the
property
owner
may
call
witnesses
to
provide
storm
test
really
relevant
to
the
case.
This
is
a
quasi
and
judicial
hearing.
Not
a
public
forum.
B
B
B
C
A
C
C
That
no
later
than
60
days
from
the
day
that
ordered
that
either
a
building
permit
should
shall
be
obtained
to
for
the
screening
of
the
dumpster
or
to
move
the
dumpster
where
it
could
not
be
viewed
from
the
adjacent
streets,
and
if
none
of
that
was
done,
a
daily
fine
would
be
issued
as
of
today.
C
A
contractor
did
come
in
this
morning
to
apply
for
the
permit
other
than
that
we're
still
waiting
for
them.
This
is
over
the
tune,
submit
the
application
and
to
make
the
necessary
changes.
C
Public
Works
did
approve
the
dumpster
in
the
current
location.
That
is
at
so
at
this
time
being
that
none
of
the
work
has
been
done.
Yet
this
city
is
still
asking
for
a
done.
Developerative.
B
D
D
D
I
was
there
any
pressure?
We
could
just
use
a
Google
Maps
picture.
We
did
and
had
a
relocated
survey.
I
did
meet
with
Mr
McDonald
and
then
I
had
a
phone
call.
This
morning
with
Mr
Knight
there
were
some
they're
gonna
prove
what
we
have
contingent
on
our
RDG
Sony
we're
doing.
But
what
they're?
What
we're
doing
is
we
put
the
ballers
in
the
back?
Those
pictures
you
have
looked
like
they
were
from
May
28th
to
look
like.
So
that's.
C
D
You
can
see
in
the
front
we
wanted
to
put
a
six
by
six
wooden
Post
in
there,
which
would
have
been
approved,
but
Mr
Knight
recommended
that
we
go
I'm
honestly
Miss
McDonald
reckon
we
go
with
a
steel
baller
behind
in
the
back.
There
are
also
two
steel
Ballers,
which
I
don't
think
we
have
a
picture
of,
but
I
do
have
one
on
my
cell
phone.
D
If
I
can
show
that
as
evidence,
if
you'd
like
we
do
have
two
Steel
bollers
in
the
back,
they
recommend
we
put
those
in
first
I'm
just
waiting
on
the
steel
Ballers
and
then
the
other
part
is
the
hinges.
D
Those
hinges
will
rust
out
pretty
quickly
and
I
have
the
order
that
we
put
in
through
the
company
that
Mr
McDonald
gave
us
to
get
them.
They
were
supposed
to
be
delivering
three
to
five
days.
We're
Beyond
well
beyond
the
three
to
five
day:
delivery.
We're
just
waiting
on
those
to
be
delivered.
I
do
have
a
question
that
I
have
to
go
back
to
Mr
Knight
to
ask
if
they
can
be
attached
to
the
to
the
larger
posts
that
are
there
rather
than
the
bollards.
D
But
I
do
have
the
I
do
have
the
permit
I
think
they
went
today
to
ask
about
two
questions
and
I
went
to
the
public
works
this
morning
as
well
to
make
sure
where
they
were
all
going
through
a
Walmart
way
to
getting
it
done.
It's
just.
It's
just
been
a
hurdle.
I
don't
have
the
I,
don't
have
the
hinges
yet
that
I
got
recommended
from
of
the
course
you
get.
We
ordered
them
they're
not
in
yet
the
dollars
are
here
they're
in
place,
except
for
the
two
out
front.
D
I,
don't
know
I
know
it
wasn't.
Today,
we've
had
the
permit.
Our
our
GC
is
out
of
here
waiting
for
a
survey
to
come
in
I,
don't
I
it
wasn't
today,
but
I,
don't
know
exactly
what
day
it
was
I'm
sure
it
wasn't
60
days
ago,
but
it
wasn't
just
today.
I
know
that
and
I
did
meet
with
I
did
meet
with
Mr
McDonald,
but
I
had
to
call
my
GC
to
finally
submit
it.
D
C
Does
that
mean
Public
Works
approved
the
location
of
where
the
dumpster
is
located
so
from
my
understanding
this
morning
and
Christian
just
went
to
double
checking
again,
but
what
we
were
told
about
Mr
Knight
this
morning
that
a
contractor
came
in
this
one
and
saying
that
they
were
waiting
for
the
survey.
C
That's
the
reason
why
they
had
not
submitted
the
permit
application.
Development
official
also
recommended
that
the
daily
fine
begin
until
everything
has
been
submitted
and
completed
and
Christian
has
the,
which
is
our
senior
partner,
has
the
standards
that
were
given
to
Mr
Tilton
in
regards
to
what
Public
Works
required
for
the
downstairs
closings
yeah.
D
E
E
E
In
addition,
the
I
think
what
he
was
referring
to
do
is
that
this
being
a
temporary
structure.
In
essence,
it's
been
approved
for
180
days
as
a
temporary
structure.
I
was
at
the
October
meeting,
but
I
understand
it
has
been
some
discussion
related
to
redoing
the
site
in
the
future.
E
The
planning
departments
had
one
meeting
on
this
project
back
in
May
4th
and
since
that
time,
there's
no
submittals
no
applications
for
rezoning
the
development
plan.
So,
even
if
something
were
to
come
in
today,
I
think
it
highly
unlikely
that
in
180
days
this
dumpster
is
going
to
be
removed.
So
he
may
also
have
to
come
back
in
another
date.
Amazing,
looking
doing
something
improving
it.
A
C
Okay,
so
again
can
I
speak.
Can
I
refresh
you
remember
a
little
bit.
The
reason
why
we
gave
the
six
months
was
because
Mr
Temple
stated
that
there
was
going
to
be
a
whole
refunding
and
everything.
So
that's
what
a
Christian
is
referring
to,
so
the
building
official
was
faded
because
nothing
had
been
submitted
to
the
planet's
Department
in
regards
to
that
rezoning
in
this
additional
time
was
given
and
we're
still
not
in
compliance
with
the
dumpster
six
months
later.
B
E
That
what
does
that
have
to
do
with
a
six-month
authorization,
so
typically
we
don't
approve
temporary
enclosures
for
dumpsters
they're
approved
and
they're
billed
more
substantial
than
this
okay.
It
was
agreed
to
give
him
180
days
with
this
temporary
enclosure
requirement
under
the
auspice
that
an
application
would
be
filed
for
rezoning
and
there
would
be
a
plan
to
develop
the
property.
E
D
Yeah,
so
just
a
real,
quick
recapitulation
when
we
first
got
noted
notified
of
doing
the
dumpster.
What
I
wanted
to
do
is
not
have
to
do
it
because
we
were
trying
to
submit
for
the
property
west
of
us
to
do
an
rd2
rezoning
for
the
entire
half
block
of
the
property
right
came
in
said:
hey.
Can
we
do
this?
D
You
can
wait,
we
waited
and
again
we're
dealing
with
attorneys
and
and
plans
reviews,
and
all
that
stuff
I
was
in
the
impression
that
Mr,
Shaggy
and
Zach
Miller
our
attorney
met
with
the
city,
or
maybe
it
was
the
Chrome
Duke
who
did
it,
who
met
with
the
city
on
doing
an
rd2
rezoning
for
the
property?
There's
been
some
Pearls
of
things
we
have
to
get
through
at
that
point
in
time
you
said:
Hey,
listen,
go,
go.
Do
your
part
we're
not
waiting
anymore.
D
We
gave
you
the
six
months
or,
however
long
it
was
the
greatest
amount
of
time
we
went.
We
built
the
structure,
not
knowing
we
had
a-
and
this
is
my
fault
I
didn't
know.
I
have
ability
permit
to
build
up
a
fence
around
a
dumpster
but
but
had
to
get
one
we
built
the
structure
came
back,
got
the
specs
from
Mr
Knight
I'm,
sorry,
I
got
I
got
the
Mr
Knight
today.
This
is
what
you
have
to
have
special
hinges:
Ballers
and
all
that
stuff.
D
That's
what
we
left
off
before
you
gave
us
I,
think
you
gave
us
30
or
60,
or
some
of
them
have
days
to
get
it
done.
We
are
in
the
process
right
now
of
putting
him
up.
We
were
waiting
and
again.
I
am
gonna.
Somebody's
gonna
be
a
little
bit
of
trouble
here
shortly,
because
I
was
in
the
impression
of
our
permanent
argument.
I
met
with
the
city.
Today
they
had
improvements
in
their
hands,
I
went
to
Public
Works
and
they
had
a
packet
with
them.
D
I'll
find
out
about
that.
But
all
I'm
waiting
on
is
the
Ballers
and
the
hinges
are
coming
they'll
be
done,
but
you
got
to
have
a
permanent
before
you
well
see.
I
I
mean
I
was
at
Public
Works
today
Mr
McDonald's
office,
and
they
had
to
pack
it
there
with
them
and
I.
Don't
believe
they're
going
to
approve
our
permit
they're
going
to
make
it
a
conditional,
because,
apparently
the
building
department
approves
the
win
load.
Public
Works
doesn't
Public.
D
Works
is
going
to
approve
our
followers,
but
Mr
Knight
has
the
temporarily
approved
because
there's
a
wind
mitigation,
flux
capacitor
that
has
to
be
approved,
I,
don't
know
what
it
is
so
I
I.
What
I
heard
on
the
phone
today
was.
He
was
going
to
approve
that
on
it
and
I
I
just
hit
it
from
a
temporary
base.
I,
don't
remember
what
the
term
he
used,
but
all.
C
The
way
on
our
Ballers
and
hinges
along
with
them,
so
there's
two
different
things,
I
think
he's
getting
really
mixed
up
where
the
building
permit
is
going
to
be
separate
from
what
Public
Works
issues,
Public
Works
approved
permanent
packet
and
he's
referring
to
in
regards
to
the
location.
The
building
permit
in
regards
to
with
Mr
Knight
has
spoke
to
Mr
typical
about
that's
two
different
things:
I.
D
E
Again,
I'm
not
trying
to
I
just
spoke
with
Mr
Knight
he's
fine,
approving
the
temporary
enclosure
provided
apartment
is
gold,
and
it's
built
in
these
specifications.
Public
Works
provides
the
specifications
with
the
actual
construction
goes
through
the
building
department,
because
there
are
certain
requirements
under
the
building
code
for
building
things
that
have
to
be
met
and
Public
Works
doesn't
inspect
those
the.
B
Building
department
does
all
right:
here's
what
I'm
going
to
do,
I'm
going
to
I'm,
going
to
give
jok
30
days
to
get
this
permit
issued
and
have
this
matter
concluded
and
it
that
is
not
done
in
dirty
days,
250
a
day
penalty.
Thank
you.
D
E
C
Thank
you.
I
have
one
recommendation
instead
of
saying
the
30-day
exchange
essay
to
the
next
hearing
on
August
23rd
yeah,
okay,
prior
to
the
next
part
right,
it
is
August
21st.
Yes,
all
right!
Thank.
C
This
was
in
regards
to
building
permit
not
being
obtained
for
the
work
that
was
done
in
the
rear
yard,
the
pavers
and
the
deck.
C
They
are
within
can
I
give
you
a
copy
of
the
survey.
They
did
obtain
the
survey,
the
survey
explaining
that
they
are
allowed
up
to
52.9
for
their
lot
coverage
and
they
are
in
the
process
of
obtaining
permits
for
their
driveway
and
Christian.
Outlet
Christian
explain
a
little
bit
more
as
Regard
in
regards
to
where
they
are
in
compliance
with
that
and
what
they
will
have
to
reduce.
B
All
right,
let
me
and
you
may
be
able
to
answer,
but
maybe
you
want
to
answer
this
question,
but
you
said
okay
now
see
on
the
survey
52.9.
What
I
recall
is
they
had
an
allowable
percentage
block
coverage
and
the
survey
was
going
to
show
what
the
coverage
was
a
time
that
they
bought
the
house
and
then
what
it
is
now
correct
and
then,
whatever
that
Delta
was
had
to
be,
50
could
be
removed
and
construction
that
was
done
prior
had
to
be
permanent
or.
E
E
B
E
E
To
get
the
permit,
they've
got
to
be
in
compliance
with
this,
so
I
actually
met
with
them.
Today,
they're
going
to
be
they've
got
a
quote
from
an
installer
for
the
papers
and
they're
gonna
submit
the
heart's,
giving
permits
and
we'll
determine
at
that
point.
If
an
electrical
permit
is
needed
for
the
spot
that
was
put
in
so,
if
not,
then
what
they
won't
need
that
permit,
but
they'll
bring
up
hardscaping
permit
forward
to
agree
with
something
Appliance
so.
C
C
My
recommendation
would
be
another
60
days
because
since
60
days,
remember
yeah
60
days
for
everything
to
be
completed.
E
Need
the
permit
to
do
the
hardscaping
work
so
to
get
into
compliance
they'll
need
to
pull
the
permit.
Okay
and
yeah
I
mean
I,
think
60
days
they
run
into
some
supplier
issues.
We
can
always
come
back
at
that
time.
D
A
C
C
The
property
owner
did
apply
for
the
building
permit
and
it
was
approved.
Eve
Mr
Smith
do
need
to
come
in
and
pay
the
135
dollar
fee
for
that
permit.
Once
he
does
that
the
required
work
needs
to
be
completed
and
then
something
to
ask
Bill
a
survey
is
showing
when
it's
been
done
and
then
schedule
a
final
inspection
for
compliance.
B
B
C
Okay,
okay
and
our
last
case
would
be
C
on
the
agenda.
This
is
case.
Number
23-58,
Rebecca
J
come
on
up
at
all
Glenn
crime
and
Bobby
James
R
S.
This
was
at
118
North,
16th
Street.
This
was
was
in
regards
to
a
junk
vehicle,
normally
with
the
junk
vehicle
who
would
have
been
towed.
In
this
case,
the
property
was
a
tenant
of
the
property.
When
we
got
ready
to
tow
the
vehicle
with
Jacksonville
Beach
parking
enforcement,
they
would
block
the
vehicle
in
so
that
they
could
not
be
towed.
C
So
that's
why
I
was
brought
before
the
special
magistrate.
I
did
hear
from
the
property
owner.
She
was
under
the
impression
that
the
vehicle
had
been
moved
when
I
went
back
to
did
an
inspection.
This
was
on
June
27th.
The
vehicle
was
still
there
after
I
spoke
with
her
on
Friday
this
past
Friday.
She
assured
me
that
the
vehicle
would
be
moved
and,
as
you
can
see
today,
during
my
inspection,
they
were
brought
into
compliance.
