special
magistrate
hearing
in
accordance
with
florida
statutes,
chapter
162
and
the
city
of
jacksonville
beach
code
of
ordinances
is
to
reach
an
equitable
expedition
to
enforce
the
codes.
The
city
presents
the
violation
and
evidence
to
the
special
ministry.

Next,
the
property
owner
is
sworn
in
and
responds
to
the
violation
and
or
evidence
both
the
city
and
the
property
owner
may
call
witnesses
to
provide
sworn
testimony
relevant
to
the
case.
This
is
a
quasi-judicial
hearing,
not
in
public
forum.
Individuals
not
called
as
foreign
witnesses
will
not
be
heard.

I
serve
a
special
magistrate
for
the
city
of
jacksonville
beach
on
code
enforcement.
Matters,
as
clark
has
indicated,
we're
going
to
be
calling
cases
on
the
agenda
one
by
one
and
she
indicated
the
code
enforcement
officer.
Ms
beavers
will
present
evidence
regarding
violation
of
the
status
of
the
case,
after
which
you
will
be
given
an
opportunity
to
speak
and
present
any
evidence
that
you
want
to
you'll
be
scorned
before
you
start
talking.

they're
doing
that,
I
went
by
there
last
wednesday
and
I
spoke
with
the
manager
that
was
on
staff
that
day
and
he
showed
me
the
correct
light
bulbs
that
needed
to
be
switched
out.
He
said
that
the
maintenance
was
coming
on
that
day
to
switch
the
light
bulbs
out.
When
I
went
back
today,
some
of
the
light
bulbs
had
been
replaced,
but
there
were
still
three
that
I
had
showed
him
during
my
inspection
that
still
had
not
been
replaced.
The
manager
that
was
there
today
stated
that
he
would
have
those
replaced
this
afternoon.

the

observed
the
dumpster
with

construction
degree

it

stopped
and
approached
the
property
and
noticed
that
there
were
some
workers
present
upon
interest
of
the

residents

I
observed.
Some
walls
were
removed,
some
wires
were
hanging
from
the
ceiling
and
some
exposed
plumbing
was
in
one
corner
of
the
main
room
that
I
saw
there.

needed
to
stop
what
they're
doing
for
the
stock
work
order.

was
able
to
place
on
the
property
it's
being
issued
because
of
non-compliance
with
sector
105.1
of
the
florida
building
code,
and
that
was
the
original
placement
of
the
stockholder
on
the
property.

what
has
happened
since
then?
I
think
it
was
a
couple
weeks
ago
the
owner's
agent
came
to
our
office
to
kind
of
discuss
what
was
going
on
in
the
property.

went
with
him
and
walked
into
the
residence
and
observed
that
all
the
work
had
been
completed
in
the
house.
Walls
had
been
constructed,
kitchen
cabinets
were
installed,
the
drywall
basically
was
a
finished
renovation,
and
I
I
just
tried
to
discuss
a
little
bit
at
that
point
in
time
where
he
was
as
far
as
in
relation
to
the
florida
building
code.

section
10110.1
states,
no
work
shall
be
concealed
prior
to
not
having
an
inspection,
and
I
was
just
trying
to
give
him
an
indication
of
where
he
was
in
response
in
regards
to
that
and
the
work
was
covered
up
and
it
was
not
permitted
and
he
has
a
couple
avenues
to
know
that
he
can
try
to
hire
a
contractor
to
take
over
the
project
would
be
willing
to
assume
liability
for
the
entire
work
that
was
was
performed
and
would
be
basically
warranted
in
the
future.

night
we
had
this
enforcement
and
at
that
time
I
entered
an
order.
What
I
understood
was
that
one
of
the
problems
was,
he
didn't,
have
a
licensed
plumber
working
on
the
project,
but
that
he
was
going
to
essentially
indicated
he
would
engage
the
license
plumber
and
make
the
necessary
applications
for
permits
for
the
work
or
actually.

building
program
had
been
issued
on
that
on
that
property.
We
cannot
issue
some
permits,
we're
doing
some
targets
without
having
a
main
master
building,
building
permit
sub
trades.
They
can
apply
without
having
a
master
building
permit

encompasses
the
entire
project
as
a
whole.

entire
structure
we've
got
issues
so
tell
me

could

and

to

to

indicated
me
that
they
came

office

attempts
to
get
permits
and

denied

was
denied,
but
dan
with
valdan
electrical
said
that
that
only
a
general
contractor
could
get
a
permit
to
have
the
work
done

as

checklist
which
is
turned

the

that
checklist
has
things
like
make
sure
that
the
kennels
for
the
dogs
have
been
cleaned
in
the
morning
with
particular,
very
particular
mcdonald's
type.

checklist
never
until
now,
because
of
this
and
again
that's
my
shortcoming
for
not
doing
that
earlier.

has
the
gate
being
opened
and
then
gate
checks.

also
put
we're
putting
in
that
checklist
of
checking
at
certain
times
that
nothing
has
changed,
that
the
gate
is
still
open
and
then,
in
the
evening,
after
business
hours,
check,
get
closed
and
locked
and
that
simply
you
know
this
is
new
for
us.

changed
the
fencing.

thought
you

folks

need

what
happens

sometimes

a
business
like
this,

lots
of
moving
ships

not
always
that
simple,

checklist
for
other
things
as

to
address
that.

shortcoming

have
taken

steps

supervise

am
very
confident
that
once

checklist,
things

get
missed

our

fault

not
putting
it

didn't
see

need
for

say
that

needs
to
stay
open,
that

because
we

have
found
homeless
folks
using
our
spigots

just
taking
shelter
there,
sometimes
before
we
put
a
lap
on
it,

so
that
is
necessary.

feel
for
us,
but
again,
that's
only
after
business
hours.

other
thing
is
if
the
gate
is
closed,
it's
not
it's
not
usually
locked
until
the
last
person
goes
home
for
the
day,
so
it
it
even
even
when
it
was
closed
or
is
closed
at
any
point
after
business
hours
it
it
doesn't.

stays
open
so
that
if
anyone
needed
to
access
it,
they
could
it's
not
locked
right.

to
the
fact
that
we
have
been
here
a
couple
of
times
and
the
violation
has
been
repeated
for
the
two
days
that
it
was
observed
blocked,
I
would
like
to
impose
a
fine
for

the

was

vehicle
inside
that

whole
fence
and
that
overhang
is
with
over
two
hundred
thousand
dollars.

door
at
the
very
end
of
the
building
there,

that's

feasible
for
us
to

move
fit.
So
that's
why
we
added
the
temporary
fit
so
that
you
can
feel
more
safe
without
the
animals
and
that's
really
it
where
we
are
very
respectful,
and
we
are
sorry
that
this
campaign

front

you
guys
again.
