property

it
encroached

up
there,

background
information.
So
city
madison,
along
with
dozens
of
other
communities
across
the
state,
are
involved
in
a
class
action
lawsuit,
as
council
had
mentioned,
governor
signed
legislation
authorizing
the
settlement
this
year.

Some
notes
here
effectively
is
that
this
is
all
the
premise
on
this
opt
out
is
so
that
communities
of
our
size
could
control
more
of
the
settlement
discussions
rather
than
them
being
dictated
through
the
attorney
general's
office.
Who's
handling
it
on
behalf
of
the
state
so
based
on,
based
on
the
advice,
we're
getting
from
lead
counsel
in
a
class
action
lawsuit.
It's
beneficial
for
us
to
opt
out,
conduct
our
home
settlement
discussions
as
a
as
a
party
to
a
class
action
lawsuit
and
then.

So
I
think
our
strategy
here
would
be
opt
out,
negotiate
settlements
with
our
lead
attorney
for
the
class
action
lawsuit
and
then
see
where
that
goes
over
the
course
of
the
next
60
days,
and
it's
either
going
to
be
a
an
additional
amount
of
money
that
would
be
distributed
to
the
cities
or
not,
and
then
you
could
pop
back
in
and
just
go
through
the
settlement
process
with
the
attorney
general's
drop.
So
this
really
seems
to
be
a
like
a
low
risk.

in
addition
to
that
would
be
the
control
over
the
way
in
which
the
monies
that
did
come
in
the
governing
on
that
would
be
a
little
different
if
they
were
settled
separate
from
the
ag's
office.
So
the
way
that
the
money
would
come
in

settlement
were
separate
from
that,
I
think
that
the
control
over
those
local
dollars
is
a
little
different,
gives
the
city
a
little
bit
more
flexibility
in
those
times.

incorporate

know
corporations
are
by
law

creature

the

it
even

have
the
full
support
of
the
attorney
general

their
stack

evidence,

we
prosecute
your
case
and
then,
when
the
next
county
prosecutes
their
case

however
they
do

helping
a
friend
of
mine

phone
business
and
we
stringing
lines

jeffersonville
and
one
was
the
methadone
clinic.

counselor,

we
went
in
the
office
and
we
spoke

little
bit.

it
can
pass

through
the
mothers

they

the
middle
bloodline

where
it
passes

the

the
female

that

you
take
an

adversely

combination
and

the

dollar-
fine,
no
jail
time,
maybe
the
night,
but
no
jail

believes

still
remains
significant
effects

flooding
disaster

occurred.

he
was
one

best
friends

ever
had

passed
away

five
years

of
people
all
really
missing
and

sure

about
fred,

loved
tiger
playing

wrote

he's

miss

to
make
sure

name

retire

for

hydroplane

races

could

again,
I
reside
at
the

woody
park
lane
and
I
went
through
this
a
few
years
ago,
back
in
july
of
2015
as
well
and
back
on
that
north
side
used
to
be
known
as
940
north
wallet
used
to
have
five
old
clapboard
shacks
down
there,
and
I've
been
told
back
before
that
it
was
a
sawmill
of
some
type,
any
rape
back
in
the
day,
my
dad
had
all
those
shacks
destroyed
and
told
to
pour
down.

when
I
guess
the
park
officially
opened
1974
my
dad
passed
and
then
my
mom
took
it
over
and
she
had
the
old
king
house
that
used
to
be
kings,
at
least
not
moody,
parklane,
and
it
wasn't
very
wide.

think
it's
only
about
eight
or
ten
feet.
Officially
she
knocked
down
the
old
capia
sedan
contract.
He
knocked
down
the
old
king
house
hall
off
and
basically
put
those
pads
and
stuff
in,
and
that
was
in
1974.

it

but
I
don't
remember,
and
then
I
guess
I
don't
know,

don't
think
it
got
worse,
but
up
until
that
time,
the
worst
I
had
ever
saw
it
before
then,

the
water
got

moody
park
lane

close
to
the
garage
believe
that
up
there,

not
high
enough
to
get
the
mobile
home.

I'd
count
my
blessings
on
some
of
that,
because
it
only
got
up
the
lit
on
the
legs
of
some
of
the
furniture.
Maybe
about
that
far
it's
not
good,
but
it
could
be
a
whole
lot
worse,

then
you
got
because
we
used
to
live
in
a
big
house.
We
have
a
lot
of
things
that
came
from
a
big
house
all
packed
in
to
a
14-70
mobile
home
they're
in
there,
but
everything's
tight
and
a
lot
of
stuff
was
sitting
on
the
floor.

for
example,
when
my
mother's
funeral
happened
back
in
11.,
her
funeral
log
book
and
everything
happened
to
be
in
a
bag
and
around
the
tv
console,
and
it's
now
sitting
over
there
soaked
and
there's
a
number
of
other
things.
Just
like
that,
a
lot
of
things.
I've
worked
my
whole
life
for
to
accumulate.

It's
rained
quite
a
bit
since
then
a
lot
of
times
more
than
what
it
did
the
last
time,
and
I
know
they
did
some
work
down
there
on.
I
guess
it
was
the
duken
hollow
road
or
something
that
comes
down
through
there
on
the
creek
and
open
stuff
up,
and
I
heard
people
make
some
statements
well,
I
think
we
got
we
got
it
fixed.

But
in
the
meantime
I
have
a
little
cousin
down
in
jeffersonville
just
built
a
new
middle
class
house,
upper
middle
class,
another
middle
class
neighborhood
him
and
all
his
neighbors
kept
getting
flooded.
Because
of
the
way
things
were
architected
they
finally
had
enough.
He
got
some
lawyers,
they
tried
to
take
him
to
court
and
the
city,
the
state
and
the
county
all
point
their
fingers
at
each
other
and
what
the
state
did
they
found.

Was
whenever
a
municipality
allows
excess
development
that
overruns
overrides
the
available
drainage?
That's
a
liability,
whether
it's,
whether
it
causes
it
or
contributes
another
one
is
if
a
municipality
doesn't
have
adequate
drainage
and
so
on
and
so
forth,
that's
the
same
or
if
it
doesn't
maintain
that
drainage
and
keep
everything
cleaned
out.

Was
where
I
had
some
tenants
who
went
around
taking
a
lot
of
photographs,
and
one
of
them
is
where
supposedly
the
city
street
department
through
logs
and
stuff
like
that
debris
in
the
creek,
you
know
it
helped
produce
the
clog,
or
at
least
one
of
the
clogs.
It's
my
understanding.
There
was
multiple
clogs
in
actuality
when
I
remember
back
in
2015
when
they
found
what
it
was.
They
got
it
and
then
the
whole
water
table
drained
like
a
bathtub
just
straight
down
fast
and
actually
the
same
thing
kind
of
happened.

also
remember
we
had
some
more
heavy
rains
in
back
in
15
after
the
big
flood
I
had
and
back
behind
me
is
a
I
guess,
you
call
it
a
culvert,
a
drainage
camel
whatever
you
want
to
call
it.
It's
laid
up
with
rock,
like
some
of
the
other
rock
structures
around
madison
are
and
you've
got
a
huge
culvert
that
runs
underneath

in
the
creek,
at
any
rate,
right
after
that,
somehow
another
you
had
two
huge
pieces
of
logs
or
whatever
in
there
at
the
time
called
street
department.

But
I
am
thankful
in
a
way
that
I
maintain
my
control
and
you
better
believe
a
lot
of
other
people
better,
be
thankful
too,

where
the

run

runs

are

main
changes

think

That's
happened
between
now

a
lot

the
water's
channeled
to
run
the
other
way,
and
I
said
that
doesn't
make
any
difference
as
if
it
runs
the
other

corps

get
this
fixed
they've
got
large
drills
that
actually
drill
underneath
highways

stuff

put
more
culverts

taxes

we

town
refuses
to
do
anything
to
help
people
who
keep
getting
hit
by
this.

my
rear
out
there
right
now
trying
to
get
my
property
up
and
running
so
it
looks
nice
and
represents
the
beauty
of
this
town.

love
this
town
and
then
it
just
keeps
getting
destroyed
again
and
again,

people
are
getting
frustrated
and
sad
and
horrified
do
you
know
how
many
good
pets
there
are
right
now
anything
that
was
chained
up
during
this
they're
gone?

family
uproot
and

200
relatives

this
town,
but
we're
getting
scared
and
the
floods
on
river
road
are
one
thing:
there's
stipulations
in
place
to
make
sure

house
gets

down
there,
there
are
ways
to
repair
it
chill.
Delays
gets
flooded
nearly
yearly.
They
were
actually
surprised.
They
didn't
get
flooded
this
year.

It's
no
secret.
I
grew
up
at
606
north
walnut
street
jim.
You
said
it
too,
when
I
was
a
kid
there
on
walnut
street,
there
wasn't
floods,

and
basically
just
been
put
in,
but
weather
patterns
and
development
patterns
and
lots
of
different
things
have
changed
over
that
time
period.
Since
I
lived
there
in
the
nineteen,
I
grew
up
there
on
the
1970s.

This
flash
flood
didn't
start
downtown,
but
it
dropped
to
downtown
and,
as
it
came
downtown
from
miles
miles
of
tributaries
and
drainage
areas
and
impervious
surfaces,
they
grew
bigger
and
bigger,
while
it
was
still
raining
and
it
had
massive
impact
downtown
for
sure
so
far.
The
damage
assessment
that
we've
received
it's
about
60
structures,
downtown
more
along
crooked
creek
and
some
on
the
hilltop
is
like
I
said
as
far
as
five
miles
away.

Still
a
lot
of
work
to
do
that
starts
started
on
the
recovery
side.
First,
first,
the
rescue
side,
then
the
recovery
side,
and
now
it's
about
working
with
those
other
governmental
agencies
to
determine
if
we
would
qualify
for
any
financial
assistance
or
any
federal
aid
in
order
to
do
storm
water,
drainage
improvement
or
work
in
the
creeks,
our
creek
bed,
the
crooked
creek.
If
you
spend
any
time
there,
you'll
see
where
the
this
storm
actually
changed,
the
path
of
the
creek,
a
lot
of
the
pre-clock,
was
shoved
to
one
side.

So
tomorrow,
we're
meeting
with
the
indiana
department
of
homeland
security
state
of
indiana,
the
governor's
office
is
doing
a
comprehensive
damage
assessment
through
all
the
counties
that
were
affected.
Not
it
wasn't
just
jefferson
county.
It
was
multiple
counties
in
southern
indiana
that
were
affected,
we've
been
in
contact
with
our
congressional
offices,
our
senate
offices,
our
representatives,
our
emerging
management
agency
and
and
we'll
be
continuing
those
conversations.
Until
we
come
up
with
some
some
solutions.

it
could
somehow
be
done,
I
might
say
you
won't
be
able
to
do
all
of
it,
but
maybe
if
we
could
somehow
find
a
way
if
you
got
an
aerial
topographical
map,
so
you
could
actually
look
at
it

top

view.
It
might
tell
you
I
don't
know
how
much
water,
basically
tilts
from
that
area
over
into
the
cricket
creek
system
or
what
but
anything,
would
be
a
help
and
another
alternative
would
be
more
expensive
would
try
to
develop.

protect
us
from
the
noah's
ark
flood.
We
get
that
you
know
tornadoes
coming
down
if
you
got
a
true
act
of
god.
This
is
what
it
is.
All
you
got
to
do
is
you

catch

nothing
else.
You
can't
do,
but
when
it
comes
to
these
things,
like
you
said
we
could,
we
can
certainly
try
to
mitigate
it.

I
guess
that's
