meeting
for
today
april
eighth
I've
been
joined
by
council
president
johnson
and
council
vice-president
glidden
majority
leader
Quincy
and
Minority
Leader
Gordon,
which
is
a
quorum
of
this
committee.
This
is
the
first
committee
meeting
for
this
year,
so
I'll
remind
members
of
the
committee
who
have
not
had
the
benefit
of
serving
on
this
committee
that
we
would
ask
mr.
skarda
to
give
us
some
instruction
as
to
how
we
would
view
whether
or
not
the
city
is
liable.

will
then
ask
the
staff
to
come
up
and
give
the
report
will
ask
the
claimant
to
give
their
side
of
the
story
we'll
see.
If
there
are
any
questions
for
staff
or
the
claimant,
and
then
we
will
have
the
opportunity
to
discuss
if
needed
and
or
have
a
motion
to
approve
or
deny
with
that.

if

could
give

a
reminder
briefing
on
what
it
is
we
should
be
discussing
today,.

Negligence
standard,
that
is,
the
failure
of
the
city
or
the
city's
personnel
to
use
reasonable
care
in
the
doing
of
something
that
a
reasonably
prudent
person
would
have
done,
or
the
failure
to
do
something
that
a
reasonably
prudent
person
wouldn't
would
do
under
the
circumstances.
That
is
a
departure
from
what
is
what
an
ordinary,
reasonable
member
of
the
community
would
do.
In
the
same
circumstances,
the
elements
of
a
cause
of
action
are
a
duty,
a
breach
of
that
duty,
and
that
the
breach
of
the
duty
is
the
proximate
cause
of
the
claimants
injuries.

case

birch,

2013.
She
came
before
the
staff
claims
committee
seeking
376
dollars
for
parking
and
towing
after
she
was
cited
for
parking
in
a
crosswalk.
The
claimant
stated
that
her
van
was
parked
at
thirteen
twenty
five
twenty
seventh
Street
West
and
that
the
address
on
the
citation
is
incorrect
that
her
van
was
properly
parked
and
there
are
no
crosswalks
at
that
intersection.

were
in
that
she
had
two
witnesses
who
felt
that
the
van
was
properly
parked.
The
claims,
the
staff
claims
committee
reviewed
photographs
of
the
of
the
location
and
additionally,
I
wanted
to
bring
to
the
committee's
attention
that
I
did
research.
The
Minnesota
statute
169
point
11,
which,
in
paragraph
20,
provides
a
definition
of
what
a
crosswalk
is
and
I'm
quoting
from
the
statute.
Crosswalk
means
one
that
portion
of
a
roadway,
ordinarily
included
in
the
prolongation
or
connection
of
the
lateral
lines
of
sidewalks
at
the
intersection.

all,
just

I
got
a
$32
ticket
on
this,
and
the
toe
was
156.
On
top
of
that,
I
lost
time
at
work.
I,
don't
believe
that
my
van
should
be
towed,
for
whatever
violation
is
in
that
picture
and
I
don't
end
the
loss
of
time
and
money
for
the
violation
that
I
actually
just
cannot
perceive
from
that
picture.
I
can't
afford
the
towing
costs.
I
couldn't
afford
the
time
off
work
for
that
violation,
and
that's
that's
what
I'm
arguing
so.

city
minneapolis
traffic
control
on
July,
sixteenth.
One
of
our
agents
was
out
on
the
intersection
of
West
27th
and
Gerrard
and
identified
the
vehicle
in
this
photo
and
had
a
decision
to
make
whether
or
not
to
issue
the
citation
for
parked
on
a
crosswalk
or
being
parked
within
20
feet
of
an
intersection.
Regardless
of
what
violation
he
selected.
Both
of
them
are
towable
offenses.
So
the
agent
issued
the
citation
based
on
the
car
impeding
on
the
crosswalk.

was
a
transaction,
never

On
this
case
the
vehicle
is
parked
on
the
crosswalk
and
when
he
arrived,
he
wasn't
sure.
I
talked
to
the
agent
regarding
the
citation
and
showed
him
the
pictures
and
he
remembered
it
and
he
said
he
wasn't
sure
if
it
was
parked
on
the
crosswalk.
So
he
got
out
measured
and
he
said
either
way.
I
would
have
issued
a
citation
for
either
being
parked
on
the
crosswalk
or
within
20
feet
of
an
intersection.
So
he
got
out
his
measuring
tape.

We
place
the
ticket
and
the
toe
slip
in
one
of
our
envelopes
and
we
place
the
ticket
on
the
vehicle
with
the
red
stripe
up,
and
that
indicates
to
the
tow
drivers
that
it's
a
towable
offense
and
that
it
has
a
tow
request
in
it,
and
so
they
in
their
contract
that
required
a
look
for
tows
within
the
city
and
that's
why
we
put
the
red
stripe
up
for
total
offense.
The
soil
points
out
that
it
has
been
ticketed
and
so.

Normally,
even
in
a
snow
emergency,
there
are
four
vehicles
that
fit
outside
of
that
apartment:
building
that
don't
get
ticketed
that
don't
get
towed
I'm
requesting
reimbursement
for
this
toe,
because
I

understand
due
to
the
statute.
I
owe
$32
for
parking.
My
van
on
that
day,
but
towing,
my
van
is
cruel
and
unusual
punishment.

could
go
there
right
now

vehicles

maybe
it's
it's
a
case
of
luck
as
as
you
mentioned
earlier,
it
could
be
five
minutes.
It

parked
it

at
about
11
p.m.
the
night
before
and
I
came
out
at
probably
1130
that
morning
and
my
van
was
gone.
So
is
it
negligence?
Is
it
bad
luck?

claim:

the

case

Michael
Brown
mr.

is
bringing
a
claim
with
a
date
of
loss
of
June,
twenty-eighth
2013.
The
staff
claims
committee
did
recommend
a
denial
of
the
claim.
Mr.
Brown
parked
his
car
at
52-49
DuPont
avenue
south.
When
he
was
visiting
a
friend.
He
last
saw
his
vehicle.
He
indicated
on
the
night
of
jun
27
2013
when
he
returned
from
a
funeral.
He
found
that
his
car
was
missing
when
he
went
back
to
wreak
to
retrieve
it
and
filed
a
police
report
or
attempted
to
file
a
police
report
with
a
brooklyn
center
police
department.

The
information
presented
the
staff
claims
committee
was
that
regular
regulatory
services
ticketed
a
vehicle
received
a
complaint
of
a
vehicle
abandoned
over
72
hours
on
a
311
complaint
that
was
made
on
june
twenty-fourth.
The
the
caller
indicated
that
the
vehicle
had
been
parked
at
the
same
location.
For
approximately
two
weeks
regulatory
services
marked
and
chalked
the
vehicle
on
jun
25th
2030
teen.
It
was
ticketed
on
jun,
28th
2013.
It
was
towed
to
the
Minneapolis
impound
lot
and
a
certified
notification
letter
was
sent
to
mr.

and
I
was
bout
to
attempting
to
move
the
vehicle
and
I
actually
backed
it
up.
I
want
to
say
a
few
feet
and
then
I
got
out
of
and
jumped
in.
Another
car
and
I
left
came
back
the
next
day
to
take
a
rental
back
and
pick
up
my
car
and
it
was
gone
and
I
only
called
Brooklyn
Center,
because
I
called
around
Minneapolis
and
they
had
no
knowledge
of
it
and
they
said
if
we
would
have
took
it
or
anything.
We
would
know
anything
about
it.

Brooklyn
Center
was
actually
the
intersect
across
the
intersection
and
that's
no
parking.
But
on
the
other
side
it's
residential
nearest
car
is
up
and
down
on
both
sides
of
street
and
so
yeah
called
brooklyn
center
after
I
spoke
with
minneapolis
and
he's
hoping
to
just
put
in
a
report
and
I
did
everything
on
the
phone
instead
of
actually
going
down
here,
because
I
was
at
a
loss
of
vehicle
at
the
moment.
So
I
don't
want
to
really
take
bus,
trips
and
caps,
and
so
yeah
and
I'll
put
in
a
report
and
nothing.
No
one.

city
was
negligent
because,
like
I
said,
it
was
basically
someone
that
personally
felt
like
my
vehicles.
I
didn't
belong
in
the
area
or
I
was
in
a
resident
of
the
neighborhood
of
some
sort.
I,
don't

took
place,
but,
like
I
said,
I
was
in
the
area
frequently
visiting
walking
up
and
down
the
streets
constantly.
So
people
saw
me
in
the
area
and
I,
don't
know
who
complained
or
why
they
will
complain.
I
wasn't
blocking
anyone's
crosswalk
anyone's
I
wasn't
parked
in
any
one
space
in
front
of
their
house
or
anything.

was
actually
a
space
in
between
there's
the
intersection.
There's
a
couple
cars
and
there's
Mark
hard
in
their
houses.
Further
up
and
so
I
don't
feel
like
I
was
inconveniencing
anyone
they're,
making
it
harder
for
their
daily
living,
and
also
it
was
just
like.
As
far
as
the
way
the
city
handle
things
I
put
in
a
report,
no
report
was
actually
made
and
as
far
as
lien
holders
and
everything
I
just
paid
the
vehicle
off
I
got
the
vehicle
at
a
repossession.

a
few
months
back
and
I've
had
parking
issue
with
st.
Paul
Roth
park,
downtown
and
I
guess
they
ran
my
plates
and
I
had
a
certain
amount
of
violations
under
my
name
from
Maplewood,
where
I
used
to
stay.
They
just
told
my
vehicle
when
I
recovered
it
from
there,
and
so
as
far
as
the
toilet
and
everything
I
was
telling
my
well,
you
guys
sent
this
letter.
The
letter
never
actually
came
to
my
house.

basically
walked
me
through
the
process
and
so
I
just
followed
their
instruction
in
the
day
this
but
yeah
other
than
that
it
was
just
like
I,
wasn't
notified
or
anything,
and
if
I
felt
like
someone
should've
contacted
me
like
well,
sir,
your
vehicle
and
I
had
good
plates
tabs
everything
else.
Everything
was
coming
on
in
my
registration,
everything
so
I
don't
see
how
my
vehicle
could
have
been
abandoned.
There
was
no
broken
windows
or
anything.

we
were
thinking
about.

center

street

completely
no
parking
over
there

residential
and
that's
minneapolis,

so

I
called
Minneapolis.
First,
they
didn't
know
and
didn't
have
any
knowledge
of
it.
Anything
soft
spoken,
Brooklyn,
Center
and
I
put
the
report
in
from
over
there
because,
basically
it
says
they
told
vehicles
on
that
other
side.
So
I
was
thinking.
Well,
maybe
it
was
some.

only
after
many
apples
told
me
that
they
didn't
have
any
knowledge
of
it,
and
doing
so
with
them
would
just
basically
be
0.
It
wouldn't
be.
It
would
be
pointless
because
if
they
didn't
have
any

have

in
their
impound
lot,
what
would
be
the
point?

somebody
calls
the
impound
lot
wants
to
know

their
cars

think
there
was

negligence

72-hour
laws

results

getting

car
back

worried
about
other
people's
cars

strange
car
here,
I'm
worried
about
it,

so
that's
a
whole
different
thing.

laws

people

they
call

lot

being
made
aware
where
my
vehicle
was

then
I
know
that
I
was
being
charged
to
reclaim
my
vehicle.

the

spoke
with
the
impound
lot
multiple
times
and
I
believe
they
probably
should
remember
me,
because
I
was
kind
of
right
about
the
situation
and
it
was
like
well
I
reported

vehicle
stolen.

one
notifies
me
or
contact
me
anything
and
then
all
of
a
sudden
I
get
a
letter
that
doesn't
even
come
to
my
house
out
to
pick
it
up.

move

deny
the
appeal,
though
I
don't
see
any
negligence
in
this
regard
and
in
fact
that
booking
got
the
letter
and
it
just
told
us
white

pick
up
the
car.
Unfortunately,
we
sell
within
15
days
on
the
motion
to
deny
all
in
favor
signify
by
saying
aye,
and
he
opposed
that
item
is
denied.
Our
last
item
is
a
torts
summary
report.
I
did
ask
Ellen
to
give
this
report
today.
Just
so
we
could
see
where
we're
at
many
of
you
know.

are
moving
towards
a
system
where
the
City
Attorney's
Office,
along
with
the
risk
management,
managed
these
claims
without
City
Council
process
were
not
at
that
point.
Yet
so
I
thought
but
I
hope
we're
going
to
be
close
to
it
by
the
end
of
the
year.
But
one
of
the
things
since
there's
so
few
claims
this
cycle,
we
thought-
maybe
we
could
just
hear
where
we're
at
on
overall
tort
claims
just
for
five
minutes.
If
the
committee
would
indulge
us
in
that,
is
there
any
objection
seeing
none

That's
automatically
also
referred
over
to
the
City
Attorney's
Office,
when
you
move
over
to
the
total
claims
on
the
bottom
of
the
claims
received
were
up
by
thirteen
percent
for
the
same
time.
Period
in
2012
for
denials
were
up
by
fourteen
percent
regarding
the
amount
of
denials
that
have
occurred
and,
more
importantly,
when
you
look
at
the
paid
amounts,
our
total
amounts
of
claims
paid
were
actually
up
by
seven
percent
and
we
paid
300
page
thirty-eight
percent
more
than
the
previous
year
and
a
lot
of
it
when
I
look
at
the
increases
by
the
department's.

that
in
by
the
end
of
2013,
we
paid
out
317,000
worth
of
claims,
so
the
total
amount
of
claims
actually
paid
was
about
a
hundred
and
eighty
three
out
of
the
five
hundred
sixty
nine
that
were
submitted,

of
them
not
even
belonging
to
us.

of
them
refer
to
the
City
Attorney's
Office
are.

indicated
that,
well,
the
sewer
claims
kind
of
push
this
up
a
little
bit
higher
than
normal.
Otherwise,
we
kind
of
had
a
somewhat
similar
weight
of
claims.

am
I
reading
that
right
to
previous
years,
I
guess
my
question
was:
do
we
have
a
goal
for
reducing
and
how
are
we
trying
to
get
to
that
goal?

executives
overall
tort
claims
general
liability
claims
for
the
city
of
Minneapolis.
It
is
the
job
of
the
staff
claims
to
take
a
look
at
every
single
claim
that
comes
in
that's
filed
by
anybody,
and
they
take
a
look
at
the
city
process
number
one
to
ascertain
as
to
whether
or
not
the
city
had
done
their
job
followed
guidelines
and
procedures.
If
they
had
not,
we
will
pay
those
claims.

there
is
clarification
that
is
needed,
we'll
go
back
to
the
department
and
ask
them
to
please
issue
out
some
kind
of
clarification,
so
it's
very
very
clear
as
to
what
their
procedure
is
and
what
their
process
so
that
we
can
explain
it
to
people
who
actually
file
now
we're
also
dependent
upon
whether
to
and
if
I
remember,
compared
to
2012.
That
was
like
a
down
year
regarding
potholes
in
2013.

I
guess
I
was
looking
for
a
little
bit
more
of
so
that
was
kind
of
a
process
question,
but
do
we
have
particular
initiatives
that
were
looking
at
four?
How
do
we
work
with
departments
to
reduce
claims?
Knowing
that
I
mean
there's
a
lot
of
unpredictability
in
this
area,
but
yet
I'm
certain?
There
are
trends
that
you
follow
and
one
of
the
highlighted
found.

will
see
risk
management
and
claims
working
with
Public
Works
in
unison,
with
equipment
Department
to
actually
come
out
with
two
policies
in
the
near
future:
I
hope
to
have
before
the
whole
Council
on
distracted
driving
and
how
we
would
educate
and
remind
our
field
drivers
out
there
how
to
reduce
distracted
perceptions,
because
there's
so
many
things
coming
at
them
between
the
radio
and
communications.
What
we
need
to
do
to
slow
down
and
take
care
of
those
communications,
but
not
get
distracted
while
we're
driving.

is
unconcerned,
so
that
a
supervisor
can
get
that
tape
and
that
information
within
a
24-hour
period
and
they
can
pull
in
their
employee
and
go
over
what
the
video
I
mean,
what
the
actual
taped
information
is
and
then
it's
up
to

supervisor
to
decide
whether
they
should
have
some
remedial
online
class
training
or
if
nothing
is
necessary,
because
it's
clear
so
those
will
probably
be
things.

will
see

near

that
I
will
bring
up

council,
because
that's
a
major
major
area

served

committee

a
good
period
of

There
have
been
a
lot
of
Technology.
She
changes
that
have
really
helped
us
reduce
the
number
of
claims,
most
of
them
being
in
the
kind
of
regulatory
area
of
traffic
control.
For
example,
we
saw
that
picture
today
and
in
the
past
we
would
have
had
someone
say:
I
was
nowhere
near
the
intersection
and
the
staff
would
have
said.

Yes,
we
were
in
the
intersection
and
and
it
would
have
been
a
question
or
someone
would
have
recreated
the
situation
in
order
to
prove
to
us
that
they
were
correct.
But
here
now
we
have
photographs.
We
have
digital
technology
with
regard
to
the
meters,
so
we
know
if
it's
been
expired
or
not,
and
that
has
exhausted
most
of
the
more
for
less
claims
where
people
aren't
exactly
telling
us
what
happened,
because
we
have
photography,
evidence
that
and
then
councilmember
Quincy
probably
would
know.
We've
made
policy
changes
as
a
result
of
claims.

seen
come
through,
for
example,
the
bridge
parking
issue.

park
on
a
bridge
or
not?

That
was
unclear
in
the
past
council.

Gordon
probably
remembers
that
too,
and
we
changed
all
of
our
online
information
to
make
it
clear.
You
cannot
park
on
a
bridge,
so
we
have
caught
some
of
them
and
