we
have
three
public
hearings
on
the
agenda
this
afternoon
and
one
quasi
judicial
hearing,
as
well
as
a
number
more
routine
items
that
have
been
put
on
the
consent
agenda
and
just
a
few
procedural
notes.
Before
we
get
started,
we
will
start
with
our
three
public
hearing
items
and
before
I
begin
I'd
like
to
invite
those
individuals
who
may
be
here
to
speak
to
any
of
those
of
these
items
that
are
listed
on
the
agenda
for
public
hearing
2.

Thank
You
committee
members,
my
name,
is
grant
Wilson
I
managed
the
business
licensing
department.
Today
we
have
a
public
hearing
for
a
a
new
on
so
liquor
license,
which
is
actually
a
new
upgrade
for
a
site
that
held
an
on
sale
liquor
license
before,
and
it's
Randall's
Minneapolis
at
9:21,
Nicollet
Mall
and
the
applicant
seeks
an
upgrade
in
entertainment
to
a
Class
B
which
allows
live
entertainment
on
the
site
indoors.
A
public
hearing
is
required
for
this
upgrade.

This
business
is
located
in
the
seventh
Ward
in
the
downtown
West
neighborhood
Randall's
has
been
operating
at
this
location
with
a
non
sell,
liquor,
Class
E,
which
means
no
live
entertainment
since
the
beginning
of
2017
and
with
the
upgrade
of
a
Class
B
entertainment.
They
anticipate
offering
disc
jockey
services,
dancing
and
small
musical
bands.

For
today's
public
hearing,
we
notified
all
residents
and
property
owners
within
450
feet
of
the
business.
They
also
notified
the
Nicollet
Mall
Advisory
Board,
the
warehouse
district
business
association,
the
Minneapolis
Neighborhood
Association
of
today's
public
hearing
from
that
mailing,
we
received
no
responses
for
or
against
the
application.
My
staff
and
the
police
license
Department
find
that
this
application
meets
all
of
the
requirements
of
the
permanent
ordinances
and
are
recommending
that
the
application
be
approved.

Madam
chair,
we
have
an
application
for
a
brand
new
micro
distillery
which
will
be
our
seventh
micro
distillery
since
the
law
allowed
them
to
operate
with
a
cocktail
room.
This
is
the
Royal
foundry
craft
spirits,
corporation
they're,
opening
up
a
micro
distillery
at
241,
Fremont
Avenue,
North
they're,
seeking
an
on
sale
liquor
license
for
their
cocktail
room
class
c-1,
which
will
allow
live
entertainment
in
an
off
sale,
distilled
spirits
license.
This
is
an
aerosol
neighborhood
in
Ward
5.
It's
correctly,
zoned
c2
will
have
interior
seating
for
266
persons
in
an
outdoor
deck
seating,
54
persons.

Our
application
review
has
found
that
those
are
those
two
folks
are
qualified
to
have
this
license.
A
public
hearing
is
required
because
it's
a
new
micro
distillery
and
a
new
on
sale
liquor
license.
So
for
today's
public
hearing
we
notified
all
residents
and
property
owners
within
600
feet
of
this
business.
We
also
notified
the
Harrison
Neighborhood
Association.
We
received
two
responses
from
that
mailing
both
were
in
support
of
the
application.
Staffs
review
finds
that
they
meet
all
of
the
ordinance
requirements
and
would
recommend
that
the
application
be
approved.

You,
madam
chair,
we
have
an
existing
restaurant
known
as
Dilla's
Bar
and
Restaurant,
an
18-13,
Riverside
and
they're,
seeking
to
upgrade
their
license
to
allow
live,
entertainment
and
also
expand
to
a
private
patio.
This
expansion
and
upgrade
requires
a
public
hearing,
and
that's
why
we're
here
today,
Dilys
is
operated
successfully
at
this
location
since
2013
and
there
has
been
a
restaurant
at
this
location
on
the
west
bank
since
1992.

This
is
in
the
Cedar
Riverside
neighborhood
in
Ward
6,
and
they
will
be
expanding
by
adding
a
new
outdoor
patio
and
upgrading
to
include
live.
Music,
D
Patti
will
add,
16
additional
seats
and
they
have
now
and
the
music
will
allow
all
forms
of
legal
live
entertainment
for
today's
public
hearing.
We
notified
all
residents
and
property
owners
within
600
feet
of
this
business.
We
also
notified
the
West
Bank
Community
Coalition
and
the
West
Bank
Business
Association.
We
received
two
responses
both
in
support
of
this
application.

This
is
a
bit
of
a
unique
situation
that
only
arises
a
handful
of
times
each
year
in
our
business
licensing
department
and
that's
because
it's
governed
completely
bathed
by
state
law
and
a
state
statute
which
requires
cities
such
as
Minneapolis
to
revoke
a
business
license
that
we've
issued
in
this
case
of
restaurant
license.
If
we're
properly
notified
by
the
state
Department
of
Revenue,
of
an
outstanding
tax,
delinquency
are
usually
a
sales
tax,
delinquency
and
I
think
it
has
to
be
in
excess
of
$500.

That
being
said,
it's
a
very
narrow
issue,
that
is
before
the
council,
because
it
is
governed
entirely
by
the
state
statute
and
again,
that's
that
it's
that
that
state
statute
requires
the
city
to
revoke
a
license.
In
this
case,
unless
the
license
holder
can
come
forward
with
what
is
called
a
tax
clearance
certificate,
which
means
that
they
have
paid
the
outstanding
tax
obligation
or
worked
out
an
agreeable
payment
plan
on
that
tax,
outstanding
tax
obligation
to
date
and
I've
checked
just
now
with
mr.
Wilson.

No
such
tax
clearance
certificate
has
been
forwarded
to
his
office
by
either
the
licensee
or
the
Commissioner
of
the
Department
of
Revenue,
and
based
on
that
I
believe
it's
incumbent
upon
this
council
to
revoke
the
business
license.
I
did
have
an
opportunity
to
speak
briefly
with
the
attorney
for
the
licensee
just
before
the
hearing,
and
he
can
address
this
as
well,
but
I
believe
it
was
his
request
to
delay
this
matter.

While
he
pursues
I
guess
pursues
that
tax
delinquency
with
the
state
I,
don't
believe,
be
my
legal
advice
that
we
you
have
the
ability
to
do
that,
because
this
is
the
last
cycle
of
the
full
council
in
which,
in
the
timeframe
with
which
we
are
statutorily
required
to
revoke
the
license.
That
being
said,
this,
the
action
would
not
become
final,
the
revocation
until
the
full
City
Council
meeting
on
Friday.

So
if,
before
the
end
of
the
week,
the
licensee
was
able
to
obtain
that
tax
clearance
certificate,
we
certainly
could
delete
the
item
from
the
agenda
on
Friday.
But
just
because
of
the
way
the
statute
is
is
is
drawn
up
and
because
of
the
timing
we
are
in
that
crunch
and
I.
Don't
think,
there's
a
lot
of
time
that
we
can
afford
the
licensee
in
this
matter
other
than
the
two
days
before
the
full
council
meeting.
So
with
that
being
said,
I
would
think
I
would
stand
for
any
questions
from
the
committee
and
also
mr.
C

Madam
vice
president
and
committee
members,
the
statute
in
question,
which
I
believe
is
Minnesota
State
statute,
270
point
7
2,
requires
that,
once
we
receive
the
notice
from
the
Department
of
Revenue
that
mr.
Wilson
and
his
staff
have
10
days
to
notify
the
license
holder,
and
then
we
have
30
days
to
revoke
the
license
and
delaying
this
matter
into
the
next
council
cycle
would
push
us
beyond
that
timeframe
in
and
I
think
push
it
make
us
in
violation
of
the
state
statute.
Mr.
C
Wilson
also
notifies
me
that
he
spoke
just
before
this
hearing
within
the
past
20
or
30
minutes
with
the
state,
and
it
is
their
position
that
a
tax
clearance
certificate
has
not
been
issued
and
that
they
still
believe
that
it's
incumbent
upon
this
council
to
revoke
this
license.
I
think
it's
understandable,
as
I
said
that
you
know
that
won't
become
final
until
Friday,
and
so
there
is
a
bit
of
a
window
if
things
can
be
worked
out
in
a
clearance
certificate
obtain
that
that
decision
could
be
changed
if
that
is
the
will
of
the
council.

madam
chairperson,
my
name
is
Howard
Lazarus
I'm,
the
attorney
for
Abdullah
Aid
and
calls
on
restaurants,
and
we
say
that
this
procedure
should
be
done
according
to
regular
procedure,
and
it
should
be
submitted
to
the
economic
committee.
Despite
what
the
previous
attorney
said
were
time
constraints
and
those
time
constraints
need
to
be
tempered
with
issues
of
equity.

My
client,
mr.
an
eID,
is
one
of
only
a
several
owners
of
the
Colson
restaurant
and,
despite
that
he
has
is
the
one
who
is
standing
up
for
this
corporation.
He
just
last
week.
Hired
me
I
am
both
an
attorney
and
a
CPA,
and
despite
the
non-action
of
his
previous
accountant,
the
result
of
which
that
the
sales
tax
returns
for
fourth
quarter
2016
and
all
of
2017
are
still.

That
the
state
of
Minnesota
is
is
ready
to
to
hear
into
for
mr.
Aidid
to
come
forth
with
a
compromise
that
would
result
in
and
could
result
in
a
clearance
certificate.
The
kind
of
letter
that
is
needed
to
take
this
action
off
thee
off
the
desk
off
the
deck.
So
to
speak,
however,
because
all
of
those
sales
tax
returns
are
pending
not
even
submitted,
yet
it.

to
rearrange
our
schedule
for
the
year
because
it's
the
very
first
cycle
before
the

term
is
starting,
and
so
it
did
result
in
this
change
where
normally
this
business
would
go
through
our
economic
and
they've
all

regulatory
services
committee,
but
we
are
holding
this
special
here
hearing
and
meeting
today
of
the
committee
of
the
whole
in
order
to
do
these
tine
sensitive
matters
that
needed
to
come
before
that
council
before
that
meeting
would
be
held
next
cycle.

model
matter

the

The
matter
beheld
heard
here
today
and
with
regard
to
the
corporate
status
of
the
license
applicant,
that
obviously
happens
all
the
time,
but
the
licensee
himself
signed
the
application
as
the
principal
of
that
corporation
and
that's
how
the
license
is
issued
and
that's
how
the
license
is
before
you
today.
It
would
be
my
position
in
my
advice
to
you
that
the
state
is
really
the
one
that
controls
this
matter
through
its
Department
of
Revenue.

Certainly
if
he
can
make
arrangements,
the
licensee
can
make
arrangements
before
Friday,
either
for
a
tax
clearance
certificate
or
some
sort
of
notification
to
us
that
we're
able
to
delay
this
matter
or
that
they're
willing
to
delay
the
statutory
mandate.
That's
you
know,
probably
their
burden.
At
this
point,
though,
it
would
be
my
advice
that
the
law
requires
that
this
license
be
revoked
absence,
a
tax
clearance
certificate.
