Works
Committee
this
day,
February
5th
2019
I'm
councilman
Rick
I
chair
the
committee
and
I'm
joined
by
my
colleagues,
the
councilmembers
Johnson,
Palmisano,
Fletcher
and
Gordon.
We
will
proceed
with
today's
agenda
with
a
quorum
on
the
agenda.

is
an
agreement
with
the
University
of
Minnesota
for
shared
use,
access
item,
6
of
the
temporary
easement
agreement
with
the
university
Minnesota
for
the
10th
Avenue
South
East
River
Bridge
project
item
7
is
a
lease
agreement
with
Burlington
Northern
Santa
Fe
for
the
10th
Avenue
South
River
Bridge
project
item
8
is
a
bid
for
mid-city
industrial
reconstruction
project
phase
2
item
9
as
the
special
service
district
appointments.
There's
a
whole
series
of
those
listed.

A
lot
of
people
are
looking
at
it,
and
I
actually
was
contacted
by
folks
about
both
of
these
issues,
mostly
having
to
do
with
small
underutilized
business
and
workforce
representation,
and
in
terms
of
this
we,
this
is
authorizing
an
agreement
with
the
state
and
that's
gonna
come
back
to
us
and
so
we're
gonna
get
another
opportunity
to
look
at
workforce
goals
and
small
and
underutilized
business
program.
Is
that
correct,
good.

Well,
I
appreciate
that
I
do
know
that
sometimes
these
downtown
construction
projects
bring
people
to
check
and
look
and
work
and
I
know.
We
were
discouraged
in
the
past
whether
it
was
mark
2
or
even
on
the
niccola
project.
Sometimes
people
would
come
and
they
look
and
they'd
wonder.
Why
is
it
only
white
men
doing
this
project
so
I
just
appreciate
that
we
have
these
goals
and
we're
moving
forward
now
the
other
one
number
eight
we
actually
did
go
out
for
a
good
and
we
now
have
a
company.

That's
come
back,
we're
awarding
the
bid
I,
don't
want
to
change
that
at
all
necessarily
or
anything.
I
was
concerned
to
see
that
it
was
white
and
I
know
that
I'm
sure
white
has
done
some
good
projects
and
they've
accomplished
some
goals
too,
but
they
have
a
long
history
with
the
city
and
I
think
they
were.
They
are
the
only
company
that
I
know
of
that
we
ever
actually
suspended
from
putting
in
bids
for
about
a
six
months
time,
maybe
some
of
the
old
older
folks.

You
might
remember
that,
along
with
me
and
I'm
just
curious
about
it,
looks
like
they
were
the
low
bid,
but
we
did
have
six
other
bids,
and
so
one
of
the
things
I
always
wonder
about
is
when
are
we
going
to
get
over
only
takings
a
little
bit
I
think
there
might
be
times
when
we
could
set
some
policy.
That
say
you
can
exceed
that
little
bid
by
a
certain
percentage.
If
we
think
we're
really
gonna
get
some
other
benefits.

I,
don't
necessarily
want
to
change
this
now,
I
guess
my
only
question
would
be
what
would
the
consequences
be
for
the
company
if
they
didn't
accomplish
it
and
achieve
their
goals
and
I,
don't
know
if
some
I
do
know
actually
I
think
somebody
hears
from
civil
rights
could
maybe
just
answer
that
question.
If
that's
all
right,
certainly.

concerns

us
beforehand.
It
gave
us
an
opportunity
to
prepare
for
you.
We've
worked
with
civil
rights
to
make
sure
that
we
have
Shaun
here
who
can
answer
some
of
the
more
specific
questions
about
non-compliance.
I
will
add
that
before
any
bit
comes
to
you
at
tpw,
it
is
reviewed
by
Civil
Rights
for
compliance.
So
you
don't
see
any
bids
from
us
that
haven't
gone
through
that
review
process.

I'll
just
note
that
was
clear
from
the
report.
It
had
gone
through
the
process,
it
was
signed
off
on
by
civil
rights
and
even
the
goals
are
listed
in
RCS.
So
I
really
appreciated
that.
So
just
maybe
tell
us
what
we
do
to
make
sure
they're
bouncing
the
goals
and
some
consequences.

Councilmember

right
councilman,
regarding
there
are
a
variety
of
ways
that
we
can
award.
I
think
that
the
standard
is
low
bid
for
a
variety
of
reasons.
That's
the
sort
of
the
default
we
can
award
by
vestment
best
value,
either
way,
though
the
requirements
from
the
small
business
and
the
workforce
standpoint
are
really
very
similar.
I
mean
they
have
to.
They
have
to
meet
those
goals
or
shall
good-faith
efforts,
that's
not
something
they
can
avoid
under
any
scenario
and
that's
ultimately
the
question.

If
they
didn't
meet
a
good-faith
effort,
if
they
didn't
make
a
good-faith
effort
to
meet
the
goals
and
they
we
will
go
to
the
next
better,
and
that's
really
probably
the
scenario
where
we
would
do
that
if
they
had
been
in
a
project
when
they
were
suspended,
I
suppose
that's
another
situation
where
we
can
do
that
as
well,
because
they
may
be
ineligible
to
be
awarded.
They
wouldn't
a
bit
in
the
first
place,
but
those
are
probably
the
scenarios
really
all.
