mayor
of
Minneapolis
and
this
chair
of
this
committee.
As
we
began,
I'll
know
for
the
record
that
this
meeting
has
remote
participation
by
committee.
Members
and
city
staff
has
authorized
under
Minnesota
statute,
section
13
D
point
0
to
1
due
to
the
declared
local
public
health
emergency.
At
this
time,
I'll
ask
the
clerk
to
call
the
roll,
so
we
can
verify
a
quorum
for
the
meeting
council.

discussion
items.
The
first
item
is
an
update
from
the
human
resources
department
regarding
waivers
granted,
since
the
implementation
of
the
city's
hiring
freeze
and
I'll
note
that
this
is
a
follow-up
to
the
initial
presentation
that
we
received
at
this
committee.
The
last
time
around
and
staff
should
be
on-hand
to
respond
any
specific
questions,
however,
given
the
nature
of
our
agenda
today,
I
would
suggest
that
we
postpone
the
reports
itself
to
our
next
meeting.

agenda
is
the
consideration
of
allegations
regarding
the
Director
of
Community
Planning
and
Economic
Development
Department.
At
our
last
meeting,
the
committee
took
up
preliminary
considerations
of
these
allegations
in
a
closed
session
and
scheduled
a
hearing
for
today's
meeting
and
I'll
invite
ethics
officer,
Susan
Trammell
from
the
City
Attorney's
Office,
and
bill
Champa
with
the
Human
Rights
Department
to
breathe
the
Committee
on
those
prior
actions
and
to
set
forth
the
framework
for
consideration
by
this
body.

city's
ethics
officer
as
mayor
fry
stated
in
his
introduction
to
this
agenda
item
the
executive
committee.
In
a
closed
session
on
June
17th
2020,
considered
whether
allegations
against
the
Director
of
Community,
Planning
and
Economic
Development
might
warrant
disciplinary
action.

committee
did
vote
affirmatively
and
set
today's
hearing.
City
Charter
section
8.2,

3,
provides
that
at
today's
hearing
the
committee
will

make
findings
of
fact
to
make
conclusions
about
the
allegations
and
three,
if
concluding,
that
violations
of
city
policy,
ordinance
or
other
law
kurd
consider
what
if
any
discipline
is
warranted.

the
documents
underlying
the
matter
before
the
committee
today
are
not
public
are
not
public,
they
are
personnel
data
protected
by
the
Minnesota
government
data
practices
that
this
hearing
is
required
to
be
open
to
the
public.
The
Minnesota
open
meeting
law
permits

may
be
discussed

meeting
subject
to
this
chapter
without
liability
or
penalty.

action
today
is
the
finding
of
fact,
city
charter,

committee.

frank
and

separation
letter
in
the

work

the
city
would
be

6
2020,
but
that
the
city
would
pay
employee
1
through
May
31st
2020.

fraudulent
timesheet
entries
may
result
in
discipline

to
an

discharge

the

of
Minneapolis,

prosecution.

city
ordinances,
chapter
2,
article
8,
provide
for
sick
leave
to
be
used
for
an
employee's
illness
or
injury
incurred,
while
said
employee
actually
is
in
the
service
of
the
city.
The
city
sponsors
a
healthcare
savings
plan
through
which
50%
of
an
eligible
employees
sick,
are
an
employee's
accrued.
Sick
leave
could
be
converted
into
cash
and
paid
into
a
tax-free
savings
account
for
payment
of
post
employment,
eligible
health
care
expenses,
Minneapolis
city
ordinances
prevent
the
use
or
payment
of
accrued
sick
time
after
separation.

that
I
as
mayor

calling
for
a
special
meeting
of
the
full
City
Council
on
Monday
July
6th
at
1:30
p.m.
for
the
purpose
of
receiving
and
acting
upon
this
body's
recommendation
with
respect
to
the
removal.

is
something
certainly

the
briefings

staff

are
discussed,
that
it
feels

unprecedented

we
don't
have
experienced
dealing
with
this-
that
it's
it's
tough,
making
a
decision
on
this,
because
we
don't
really
have
guidance
per
se.
So
I'd
like
to
ask
if
mr.
Ciampa
could
share
some
examples
of
other
instances
where
city
employees
have
done
similar
things
and
what
the
consequences
have
been.

the

this
emergency
meeting
on
June
6
July
6.
So

you
please
explain
that

me

the
reason
for
the
emergency
meeting
is,
for
continuity
purposes,
make
sure
that,
especially
during
this,
these
multiple
crises
that
we're
going
through,
we
have
a
clear
chain
of
the
command
as
as
well
as
leadership
throughout
the
department.
Perhaps
mr.
Karl
can
comment
further
on
the
procedural
logistics.

Mr.
mayor,
the
reason
as
I
understand
for
the
need
for
a
special
meeting
of
the
City
Council
is
because
this
body's
Authority
is
limited.
This
assistant
city
attorney
and
ethics
officer,
Susan
Trammell,
pointed
out.
The
authority
of
the
executive
committee
is
limited
to
a
maximum
suspension
of
up
to
five
days.
Anything
above
and
beyond
that
must
be
referred
to
the
City
Council,
the
City
Council's
next
regular
meeting
is
not
scheduled
until
Friday
July
17th.

Thus,
in
order
to
take
immediate
action
on
the
recommendations
that
have
been
put
forward
in
the
motion
offered
by
the
mayor,
the
mayor
is
also
proposing
to
call
a
special
meeting
of
the
City
Council
so
that
the
City
Council
can
take
action
on
those
items
in
a
timely
manner.
I
would
defer
to
miss
Tramell
if
there
are
further
legal
consequences
or
issues
that
I
may
have
missed
in
a
procedural
summary.

fry
vice-president
jenkins,
mr.
carl,
is
correct.
The
maximum
authority
that
can
be
imposed
for
suspension
by
this
executive
committee
without
further
action
of
the
City
Council
is
five
days.
So
I
believe
that
mr.
mayor
Fry's,
motion
or
action
to
call
a
special
meeting
is
because
otherwise
the
five-day
suspension
would
expire,
and
there
would
be
three
approximately
weeks
of
mr.
Frank
back
as
the
director
prior
to
the
council.

I
agree
with
the
process
as
laid
out
I'm,
not
sure
if
you've
got
a
chance
to
speak
with
any
council
members
about
the
interim
director
or
designation
I
did
want
to
just
state
that
we
do
have
a
pattern
of
interim
directors
becoming
the
permanent
director
and
I
do
think.
It
is
important
to
engage
the
City
Council
in
those
decisions
about
leadership
in
our
city
departments,
so
I
have
full
confidence
in
miss
Brennan's
ability
to
step
into
this
interim
role.

that
for
a
department
of
this
size
covering
so
many
aspects
of
work,
that
is
really
deeply
impactful
of
people's
day-to-day
lives
in
our
city
that
we
have
a
robust
discussion
about
the
leadership
of
this
department
that
includes
the
City
Council
and
members
of
our
community
that
are
impacted
by
the
department's
work.
So
I
just
want
to
say
that
here
for
the
record
and
for
my
colleagues
who
may
not
have
have
known
about
this,
this
particular
appointment
I'm
prior
to
to
right
now.

think

challenged

an
enterprise

note

I
believe
that
everyone
involved
in
this
has
worked
hard

find
the
right
path

move
forward.

In
the
ethics
code,
we
make
very
clear
that
Minneapolis
government
exists
to
serve
the
people
of
Minneapolis
and
in
order
to
do
so
effectively,
the
people
must
have
confidence
and
trust
in
the
integrity
of
their
city
government.
They
deserve
elected
and
appointed
official
city
employees
and
volunteers
who
maintain
the
highest
ethical
principles
and
avoid
misconduct
and
conflicts
of
interests
apparent
or
real.

this
executive
committee

a

suspension
without

which
