That
building
was
constructed
and
stands
today.
A
zoning
inspection
of
the
property
revealed
that
the
rear
yard
setback
was
not
consistent
with
the
original
approvals
and
the
original
variants
that
the
applicant
saw
in
2018.
The
applicant
applied
for
a
variance
to
reduce
the
minimum
rear
yard
from
15
feet
to
11
feet.

The
as
built
survey
that
was
commissioned
recently
revealed
that
the
actual
setback
is
10
feet
at
the
ground
floor
and
9.7
feet
at
the
upper
floors.
So
the
applicant
has
returned
to
the
commission
to
correct
that
error.
In
the
original
approvals,
the
reason
for
that
misinterpretation
of
the
original
setbacks
had
to
do
with
an
inconsistency
in
the
applicant
submittal.

this
is
the
the
survey
that
shows
the
project
as
constructed
it
primarily
fronts
along
8th
street
south
and
then
the
corner
intersects
with
riverside
avenue
to
the
south.

The
yard
that
is
in
question
is
the
rear
yard,
along
the
public
alley
to
the
north
of
the
site,
you'll
notice
that
the
project
backs
up
to
a
large
parking
garage.
That
is
a
part
of
the
hospital
campus
immediately
to
the
rear
of
the
site.
It's
a
five-story
parking
garage
at
the
rear.
There's
a
small
restaurant
to
the
west
of
the
site
and
a
multi-family
property
to
the
east
go
the
next
slide
and
then
this
is
an
image
of
the
project
as
constructed.

recommendation
is
to
approve
the
amended
variants.
As
you
are
aware,
the
built
form
overlay
has
been
implemented
since
the
adoption
of
2040,
so
the
current
setback
requirement
for
a
project
at
this
height
would
be
11
feet.
So
the
variance
request
is
from
11
feet
to
9.7
feet,
and
the
reasoning
for
approving
the
variance
has
not
really
changed
since
the
original
approvals.
The
site
is
unique
and
constrained
in
that
it
is
somewhat
shallower
than
a
typical
development
site
in
minneapolis.

I

how
busy
he

elected

make
these
things

believe
