meeting
is
public
and
subject

minnesota
open
meeting

For
the
record,
my
name
is
andrea,
rubinstein
and,
along
with
commissioner
tony
newborn,
I
am
one
of
the
co-chairs
of
the
charter
commission's
public
safety
work
group.
I
will
now
call
this
meeting
to
order
and
ask
the
clerk
to
call
the
role
so
that
we
may
verify
the
presence
of
a
quorum.

I
want
to
begin
with
a
very
brief
recap,
starting
with
the
public
safety
amendment
proposed
by
the
city
council
about
a
year
ago
and
where
we
are
now,
as
you
know,
we
spent
a
good
deal
of
time
over
the
summer
of
2020
and
well
into
the
fall
with
interviews
and
study.
As
of
for
our
review
of
the
city
council's
proposed
amendment.
At
that
time
we
developed
standards
of
review
and
applied
them.
We
held
public
hearings
and
received
and
read
extensive
public
comment.

Our
decision
at
the
time
was
to
reject
the
proposal
and
to
hold
off
proposing
a
possible
substitute
amendment
because
of
various
pending
events
that
could
have
on
an
impact
on
an
agent
on
an
amendment.
The
basic
reason
for
our
rejection
at
the
time
was
that
the
amendment
did
not
meet
the
established
standards.

We
also
noted
that
a
number
of
contingencies
were
still
pending,
including
a
minnesota
department
of
human
rights
investigation,
a
staffing
efficiency
study
and
a
lawsuit.
We
thought
that
the
proposed
power
shift
from
the
mayor
to
the
city
council
required
further
study
and
the
government
structure
recommendation
came
out
of
that
concern.

As
we
consider
the
current
proposal
from
the
city
council.
We
should
first
consider
what
events
have
occurred
or
not
occurred
in
the
interim
from
the
last
one.
For
instance,
there's
no
evidence
at
least
known
to
me
of
any
year-long
extensive
public
engagement
regarding
the
proposed
department
of
public
safety,
and
that
was
a
pro
proposed
last
year
by
the
city
council.

There
have
been
some
new
developments.
Of
course,
the
one
we
all
know
about
the
most
is
the
choven
verdict,
but
for
us
the
most
noteworthy
development
is
the
recent
delivery
of
signed
petitions
to
amend
the
charter.
These
are
to
create
a
new
department
of
public
safety
and
eliminate
the
police
department,
and,
as
noted,
the
proposed
government
structure.

start
with
the
first
two
possible
options
to
accept
or
reject
before
we
move
on
and
to
assist
in
this
process.

have
before
you
notes
on
the
amendment
breaking
it
down
into
its
component
parts.

It
is
the
same
in
that
it
replaces
the
police
department,
as
a
charter
department,
with
the
department
of
public
safety,
headed
by
a
commissioner
and
places
oversight
in
the
hands
of
the
city
council
and
not
the
mayor.
The
only
specific
departmental
function
delineated
in
the
amendment
is
to
place
the
police
under
this
department.

we
have
this
pending
petition
and

don't
know
yet
on
whether
that
is
going
to
be
placed
on
the
ballot,
because
there's
quite
a
process
that
the
clerk's
office
must

through.

course,
we
won't
receive
the
petition
until
wednesday,
so
it
seems
appropriate
to
have
some
discussion
about
the
timing
and
one
suggestion
that
I
had
was.

commission
meeting
will
be
our
last
opportunity
to
either
accept,
reject
or
substitute.
So
I
would
suggest
that
we
propose
to
the
full
charter
commission
that
we
adopt
this
substitute
but
hold
it
in
advance
and
request
our
additional
time.

we
can
see
what
develops
in
terms
of
what's
going
to
be
on
the
ballot,
whether
it
will
be
the
petition
question
or
whether
it
will
be
the
council
question
or
both.
