property

property

area
of

195
square
feet.
The
existing
principal
use
and
structure
on
the
property
is
a
single
family
dwelling
with
an
attached
garage
and
other
exterior
site
improvements.
They

large
open
yard
spaces
on
the
north,
west
and
south
sides
of
the
house.

lot
with
frontages
along
fremont
avenue
to
the
west
and
summit
avenue

the

The
house
itself

addressed

the
platted
front
of
this

face
is

other
proposed
improvements

pool
equipment,

landscaping

vegetation

require
any
variances.
But
the
pool
of
patio,
two
pergolas
and
part
of
the
turf
area
all
require
this
front
setback,
variance
on
the
fremont
avenue
side
to
the
west.

As
the
members
of
the
committee
are
aware,
all
variance
applications
are
subject
to
three
required
findings
and
I'll.
Just
go
over
staff
analysis
regarding
those
findings.
Briefly,
the
first
required
finding
regarding
practical
difficulties
due
to
circumstances
unique
to
the
property
which
are
not
created
by
a
person's
presently
having
an
interest
in
the
property
staff
finds.
This
is
not
met.
The
subject.
Property
is
relatively
large.

It's
almost
30
000
square
feet
in
area,
and
they
have
a
lot
of
open
undeveloped
yard
space,
including
a
significant
portion
on
the
north
side
of
the
house,
which
is
outside
of
all
required
yards
a
lot
of
existing
open
space
where
they
could
construct
improvements
like
pools,
patios,
pergolas,
etc,
without
needing
a
variance,
so
staff
finds
that
the
the
need
for
the
variance
in
this
case
is
based
on
the
design
which
has
been
created
on
behalf
of
the
property
owner.

The
zoning
code
does
allow
some
types
of
improvements
to
be
what
are
called
permitted
obstructions
within
a
required
yard,
but
only
within
certain
limitations
set
by
the
zoning
code.
Things
like
a
maximum
square
footage
and
those
permitted
obstruction
standards
are
intended
to
allow
smaller
improvements,
which
are
less
likely
to
have
negative
impact
on
adjacent
areas
to
be
closer
to
property
lines.
But
in
this
case
the
proposed
improvements,
the
pool
and
and
other
things
needing.

The
variance
are
either
not
permitted
obstructions
in
any
circumstance
or
exceed
the
size
requirements
of
the
zoning
code
for
being
in
a
setback.
So,
in
that
sense,
staff
finds
that
this
proposed
variants
would
not
be
in
keeping
with
the
spirit
and
attended
the
ordinance
regarding
required
front
yards,
especially
when
there's
other
undeveloped
yards
facing
the
property,
which
wouldn't
require
a
variance.

Other
types
of
improvements,
like
landscaping
are
common
in
front
yards,
but
more
permanent
gathering
spaces
with
with
permanent
improvements
are,
are
not
common
in
front
yards
and
staff
finds.
There
is
some
potential
for
negative
impacts
on
the
neighboring
property
and
in
the
public
right
of
way
due
to
the
proximity
of
this
substantial
outdoor
gathering
space.

Ultimately,
the
board
of
adjustment
did
vote
to
adopt
staff
findings
and
recommendation
and
voted
to
deny
the
requested
variants
to
the
required
front
setback.
For
these
specific
improvements,
there
were
several
written
public
comments
which
were
received
both
before
and
after
the
board
of
adjustment
hearing,
all
of
which
should
be
available
in
your
packets.
I
believe
the
the
appellant
in
this
case
is
in
attendance
during
this
hearing.
This
concludes
my
presentation,
but
I
can
stand
for
questions.

There
is
other
space
on
the
property
for
the
pool.
The
problem
is,
is
that
and
I'm
not
sure
if
you've
seen

packets,
but
the
pool
would
be
located
behind
the
garage
and
that
would
the
visibility
of
that
is
is
severely
limited.

did
take
some
pictures
and
I'm
not
sure
if
you
saw
them,
but
so
there's
no
way
to
monitor
the
pool
once
it's
behind
the
garage,
so
that
is
the
main
goal
of
this
whole
thing
is
safety.
The
reason
we
want
to
put
it
in
what
we
thought
was
a
side
yard
was
so
that
we
could
see
it
from
the
kitchen
from
the
dining
room
from
the
second
floor,
and
we
can
monitor
it.

That
is
the
main
objective
of
the
location
of
the
pool.
The
reason
that
we
thought
that,
when
we
met
with
the
architect,
we
went
through
the
whole
thing
he
pulled
features
from
other
neighbors
that
had
a
pool
also
in
the
same
area.
So
one
example
there's
two
examples
right
in
the
neighborhood
with
pools,
patios
and
pergolas
within
10
feet
of
their
sidewalk.

They
are
corner
lots
or
reverse
corner
lots
and
they
were
approved
in
2019,
and
I
have
they're
right
in
the
neighborhood
they're
two
blocks
away
and
I
have
those
addresses
they're,
also
in
your
packets.
So
the
first
question
was:
is
there
practical
difficulty
when
I
met
with
the
zoning
board?
And
they
said
yes,
there
is
a
practical
difficulty.

issue
kind
of
comes
up
is
people
think
that
the
front
yard
is
on
summit
and,
and
the
city
considers
my
summit,
my
side
yard
and
whereas
fremont
is
considered,
my
is
in
1858
was,
was
designated
as
my
front
yard.
So
that's
the
confusion
as
to
where
is
the
front
yard,
and
where
is
the
side
yard
anything
I
do
on
fremont
is
going
to
have
this
problem
because
in
in
1858
it
was
designated
as
my
front
yard.

this

I
will

explain
these
two
items.

two
items
are
based
on
the
same
premise
and
they
are
very
kind
of
unique
items
that
only
arise
occasionally.
I
think
it's
been
a
few
years
since
the
city
has
dealt
with
one
of
these,
and
the
issue
is
that
this
is
dictated
wholly
and
entirely
by
state
law
and
there's
a
state
statute
that
says
if
the
state
department
of
revenue
notifies
a
city
or
a
licensing
jurisdiction
that
a
licensee
has
a
tax
delinquency
with
the
state.

The
city
is
bound
by
that
law
to
revoke
that
business
license
within
30
days.
I
believe
the
time
frame
is
what
the
licensee
must
show
is
a
what's
referred
to
as
a
tax
clearance
certificate,
which
simply
means
that
they've
either
satisfied
the
tax
delinquency
and
paid
it
or
they've
entered
into
an
agreeable
payment
plan
with
the
commissioner
of
revenue
or
the
or
the
state.

In
both
of
these
cases,
we
have
staff
here
to
address
the
items
and
give
update
you
with
regards
to
the
status
of
those
items,
and
certainly
it
is
a
quasi
judicial
hearing
and
the
licensees,
if
they
are
here
or
their
representatives
are
here,
may
also
address
the
committee.
However,
as
I
mentioned,
the
committee's
hands
are,
are
severely
tied
in
this
matter
and
must
move
the
revocation
forward
if
that
tax
clearance
certificate
has
not
been
provided.

week

council
meeting
would

american
indian
center
is
a
non-profit
that
has
been
providing
comprehensive
social
health,
cultural
and
economic
services
that,
in
minneapolis
and
metropolitan
american
indian
community
for
more
than
47
years.
The
indian
center,
which
is
located
at
1530
east
franklin
avenue,
was
constructed
in
1974
and
now
requires
substantial
renovation
and
expansion.

An
18,
000
square
foot
edition
will
accommodate
expansions
of
programs,
including
family,
elder
and
youth
services,
job
training
and
workforce
development,
social
enterprise
and
co-working
initiatives
and
health
and
wellness
services
upon
completion.
The
new
facility
will
include
more
than
sixty
five
thousand
square
feet
of
program
and
meeting
space.

interest
rate
for
this
loan
is
zero
percent,
and
all
payments
are
deferred
for
the
term
of
the
loan,
which
is
20
years
at
the
end
of
the
term.
The
entire
principal
balance
will
be
forgiven
if
there
have

no

the
property
ownership
or
the
community
center
use.

indian
community

over
30
years

have
seen
franklin
avenue
become
a
destination

visitors.

are
well-established
non-profits
and
businesses
that
support

diverse
community

become

Neighborhood
minneapolis
american
indian
center
was
completed
in
1974
as
an
arts
and
cultural
gathering
place
for
our
urban
american
indians.

The
new
minneapolis
american
indian
center
will
be
many
things
for
the
community.
It
will
be
a
training
site
for
our
community
members.
Through
our
gatherings
cafe,
it
will
be
a
center
for
fitness
activities
for
the
community
and
provide
a
safe
place
for
our
community
members
to
participate
in
sporting
events.

indian
center
has
been
the
heart
of
the
urban
american
indian
community
for
nearly
50
years,
and
this
much
needed
renovation
and
expansion
will
ensure
that
the
center
is
there
for
generations
to
come
on
behalf
of
the
minneapolis
american
indian
center.
