The
item
before
you
tonight
is
a
proposed
extension
of
the
city's
ordinance,
which
temporarily
suspends
evictions
for
non-payment
of
rent
by
residential
tenants
impacted
by
the
coab
in
nineteen
emergency,
which
is
set
to
expire
on
May
31st
at
its
May
12th
meeting
Council
requested
consideration
of
a
potential
extension
of
the
ordinance
prior
to
the
expiration
of
the
initial
term.
I
wanted
to
provide
some
background
and
the
origins
of
the
initial
ordinance
then
discuss
staffs
recommendation
for
extending
the
term
and
then
options
within
that
recommendation.

In
March,
the
governor
issued
two
executive
orders,
the
first
on
March
16th,
which
suspends
state
laws
which
preempt
or
restrict
local
jurisdictions
authority
to
prohibit
evictions.
The
second
on
March
27th
prohibited
enforcement
of
individual
orders
for
renters
affected
by
koban
19
through
May
31st
2020.
As
of
today,
the
governor
has
not
extended
that
order
close
in
time
to
the
governor's
order.

The
city,
along
with
five
other
cities
in
the
county,
adopted
urgency
ordinances
which
prohibit
eviction
of
residential
tenants
impacted
by
COBIT,
the
County
of
Santa
Clara,
also
adopted
in
urgency,
ordinance,
which
covers
the
unincorporated
areas
and
all
cities
in
the
county,
but
Allah
four
cities
to
adopt
their
own
ordinances.
Two
cities
elected
not
to
adopt
local
ordinances
and
therefore
follow
the
county.
Ordinance.
There's
been
considerable
uncertainty
surrounding
the
question
of
whether
the
governor
intends
to
extend
his
executive
order
and,
if
so,
to
what
date.

This
has
made
it
very
challenging
for
those
cities
who
have
ordinances
with
the
May
31st
exploration
term
to
determine
whether
to
extend
and
if
so,
to
what
date.
What
has
become
clear
as
the
Kobe
crisis
has
evolved,
is
that
cities
in
the
county
are
taking
increasingly
independent
and
individualized
action
under
their
own
police
powers
and
the
legal
authority
granted
them
is
under
emergency
circumstances.

The
order
of
Harvard
importantly
does
not
prohibit
landlords
from
serving
tenants
with
notices
to
pay
rent
or
move,
and
the
receipt
of
such
notices
often
results
in
tenants
who
are
unable
to
pay
the
rent
moving
out
for
fear
of
adverse
consequences.
This
is
another
reason
why
many
cities
are
considering
extending
their
ordinances,
because
the
local
ordinances
do
have
a
protective
effect
beyond
the
judicial
council
order.

The
legal
basis
for
extending
the
ordinance
is
that
the
impacts
of
the
koban
19
crisis
continue
to
significantly
impact
tenants
ability
to
pay
rent
and
the
consequences
of
potential
mass
evictions
justify
extending
the
term
of
the
ordinance.
Since
its
adoption,
the
ordinance
appears
to
have
been
in
a
effective
tool
which
has
strengthened
the
cities,
rent
relief
efforts
and
there's
more
detailed
information
about
that.

In
the
staff
report
and
I
know,
we
just
received
some
updated
information
late
this
afternoon,
staff
originally
recommended
extending
the
ordinance
to
June
30th
amidst
much
uncertainty
over
the
next
steps
from
the
governor
and
the
county
staff
also
acknowledged
that
a
later
date
would
also
be
appropriate.
If
council
chooses
June,
30th
was
initially
recommended
as
a
short
duration
and
a
measured
approach
for
an
extension,
and
that
was
supported
by
a
high
degree
of
certainty
that
emergency
conditions
and
the
shelter
in
place
order
will
continue
through
June.

Unfortunately,
the
way
the
crisis
has
unfolded
has
created
different
levels
of
regulation
and
interplay
among
the
state
order
and
the
county
order,
which
does
not
yield
a
simple,
one-size-fits-all
approach
for
the
cities
and
the
county.
The
county
itself,
as
you
know,
will
not
have
taken
final
action
on
this
matter,
extending
their
ordinance
until
after
the
governor's
order
expires
on
May
31st.

As
of
today,
staff
has
learned
more
information
which
has
been
helpful
in
these
making
these
recommendations
to
council.
Although
the
state
still
has
an
extended
its
order,
staff
learned
that
there
is
some
more
certainty
surrounding
the
county's
decision
to
extend
to
August
31st
and
the
county
is
expected
to
discuss
their
moratorium
extension
again
at
a
meeting
on
June
2nd
in
light
of
the
likelihood
emergency
conditions
will,
just
through
the
next
several
months
and
based
on
review
jurisdictions.

five
votes
are
required
to
adopt
the
ordinance
extension
tonight
and,
if
adopted,
it
will
become
effective
immediately.

one
final
clerical
note
about
the
report.
There
is
one
update
to
the
table
on
page
5
that
I
mentioned
that,
which
initially
indicated
the
town
of
Los
Gatos
does
not
have
a
rent
stabilization
program.
Staff
recently
confirmed
that
they
do
so.
We've
made
that
update
to
the
table
and
the
updated
table
will
be
made
available
to
Council
later
for
their
deliberations.
This

first

let
me
just
say
that
csa
uncharacteristically,
actually
weighed
in
on
this
topic
and
sent
you
all
a
letter
a
week
ago
in
which
we
like
I,
said
uncharacteristically
for
CSA,
advocated
for
an
August
31st
extension
and
the
reason
why
we
did.
That
was
precisely
because
we
felt
that
an
extension
to
the
eviction
moratorium
would
aid
our
ability
to
do
rent
relief
right
now.

Csa
has
a
higher
number
of
people
requesting
rent
relief
than
any
other
agency,
and
the
emergency
assistance
network
and
I
think
it's
important
to
note
that
there
is
a
big
difference
between
rent
relief.
Financial
assistance
is
what's
being
offered
through
destination
home
and
then,
of
course,
the
the
Dre
assistance
for
those
who
are
not
eligible
for
federal
benefits
is
a
very
different
animal.

of
those
are
very
different
kinds
of
things
in
rent
relief
is
by
far
the
most
flex
and
that's
why
as
much
time
as
needed
as
possible,
and
we
have
actually
very
provided
I'm,
not
sure
what
the
staff
provided
you
as
far
as
numbers
that
were
late
in
coming
to
you
this
afternoon.
I
will
tell
you
this
that
we
will
have
served
600
households
over
the
weekend.

will
reach
that
600
number
and
we
will
have
allocated
out
1.25
million
of
the
city
funds
so
of
of
the
600
households
that
have
been
approved
for
rent
relief.
We
have
checks
that
have
gone
out
to
well
over
500
landlords,
so
well.
Over
500
landlords
have
actually
received
in
cash
their
check
at
this
point
and
then
the
other,
the
others
in
the
in
the
system
that
have
been
approved,
that's
already
allocated
money
and
that
all
adds
up
to
1.25
million,
and
so
yes
I
do
think
that
that
does.

But
you
can
see
that
we
do
need
if
we're
going
to
allocate
all
of
the
city
funds
and
then
as
well.
Csa
has
been
raising
funds
on
top
of
this,
which
will
help
to
extend
the
program
even
further
and
as
we
state
in
that
letter,

came
from
my
board
of
directors
actually
and
not
from
from
me
alone,
we
we
feel
like
the
extent
the
city
funds,
plus
the
extension
of
fundraising
funds
that
CSA
has
been
able
to
do,
can
help
to
keep
this
program
going
well
into
the
summer.

the
closer
we
get
to
the
end
of
an
eviction
moratorium,
the
more
panicked
people
are
going
to
be
the
more
difficult
it's
going
to
be
for
our
clients
and
so
to
continue
rent
relief,
as
well
as
all

other
financial
assistance
and
other
assistance.
That's
available
to
folks
that's
going
to
become
much
much
much
more
important
as
we
move
close
to
the
end
of
the
eviction
moratorium.
So
the
more
time
we
can
get
the
we're
going
to
be
able
to
do
a.

we've
ramped
up

a
bit
in
the
case
management
area,
we're
now
starting
to
ramp
up
in
the
finance
area.
We've
already
added
one
temporary
finance
staff,
we're
getting
ready

additional
temporary
finance
staff,
which
will
help
to
close
the
gap
between
the
number
served
and
the
number
of
checks
that
have
actually
gone
out
and
been
cashed
by
landlords
and
then
that
so
I
would
expect
that
it
to
speed
up.

management
staff

level
is
almost
hard
to
describe
to
the
point
where
it's
really

affecting
mental
health
of
families,
because
they're
waiting,
anxiously
they're
waiting
anxiously
to
find
out
if
they're
going
to
get
their
rent
really
and
yet
they're
going
to
have
be
able
to
hold
on
to
their
homes
being
without
a
job
is
so
incredibly
stressful.
I
can't
overemphasize
the
impact
that
this
can
have
on
an
entire
family.

extend
it
one
more
month
would
I
think
to
a
great
extent
continue.
This
state
of
uncertainty
and
panic
and
that
extending
it
as
long
as
you
believe
that
you
can
reasonably
do
it,
would
would
help
a
great
deal
as
work,

time
that
people
are
going
to
have
to
repay
the
rent,
because
that's
the
next
issue
that's
going
to
drop
here.

we
managed
the
Mountain
View
rental
housing
helpline
in
the
Mountain
View
mediation
program.
We've
been
dealing
with
or
navigating
a
patchwork
of
laws
at
the
federal
state,
county
and
city
level.
That
seemed
to
change
my
week
back
week.
That's
presented
some
challenges
and
advising
our
counseling,
our
callers
I,
wanted
to
give
you
guys
a
picture
of
the
types
of
calls
we've
received
since
the
shelter
in
place
began
between
the
mountain
view,
mediation
program
and
the
rental
housing
helpline.

We
have
had
about
280
calls
or
emails,
and
over
60%
of
those
have
been
from
people
who
are
impacted
by
code
19
and
the
colors
come
from
all
walks
of
life
and
even
include
those
considered
to
be
middle
income.
The
most
frequent
concern,
of
course,
is
the
inability
to
pay
rent
due
to
lost
work
or
needing
to
stay
home
with
kids.

also
get
calls
from
landlords
wanting
some
clarity
on
how
they
can
proceed
and
try
to
work
out
arrangements
with
their
tenants.
For
a
myriad
of
reasons,
everyone
is
panicked
and
that's
what
that
has
to
do
with
the
uncertainty
of
the
whole
situation.
What
would
aid
our
efforts
and
assisting
parties
in
working
out,
realistic,
Arrangements
around
rent
payment
is
once
they
get
back
to
work?

years

I'd
like

thank

responded
to
this
crisis
with
really
courage
and
caring
and
flexibility
I've
always
been
proud
of
Mountain,
View
and
I'm,
particularly
proud
of
that.

So

place
the
eviction
moratorium
as

your
response
to
protect
the
community
and
thank
you
today
for
considering
to
extending
the
moratorium
by
another
month,
I'm
wondering,
however,
why
you
would
do
it
for
only
30
days,
I
personally
doubt
that
it
will
be
out
of
the
woods
by
July,
1st
and
I
know
that
the
distribution
of
even
current
relief
monies
will
take
longer
than
one
month.

renters
are
terrified
of
losing
their
homes
and
the
small
landowners.
Our
landlords
are
anxious
about
a
dangerous
loss
of
income.

not
give
them
more
breathing
space
to
deal
with
the
emergency?
Also,
why
force
yourselves
and
the
city
is
very
hardworking
staff
to
revisit
the
issue
so
soon,
when
the
likelihood
of
significant
change
very
soon
is
really
low.
So
please
consider
extending
the
moratorium
through
the
end
of
August
following
the
County
Road,
and
thank
you
very

holding

weekly
meetings
about
this
ongoing
crisis.
Our
residents
are
taking
advantage
of
rent
relief,
food
assistance
and
other
help
offered
by
CSA
hopes,
Corner
Mountain,
View,
Wisman,
School,
District
and
other
fantastic
organizations
we're
a
strong
community,
but
many
of
our
members
are
struggling
with
loss
of
income
cause
the
Cova
19.
This
is
on
top
of
years
of
rent
increases
that
have
made
our
households
less
resilient.
Is
systemic
shocks.
There's
a
huge
emotional
toll.

When
you
lose
your
job,
it's
only
compounded
when
you
might
also
lose
your
housing,
the
eviction
moratoriums,
at
least
we
can
do
to
try
to
help
alleviate
the
burden
on
our
community
members
as
you,
whether
these
harrowing
times,
please
extend
the
moratorium
for
as
long
as
you
can
to
help
give
people
a
greater
sense
of
stability
and
extend
the
repayment
schedule
to
allow
them
to
recover
as
we
acclimate
to
whatever
we
call
normal
going
forward.

market
economy,

fine
print
exists
that
says
rental
housing
operators
are
not
subject
to
market
risk
when
I
think
about
hair
salon
operators,
nail
salon,
operators,
restaurant

individuals
who
operate
these
businesses
on
loads
of
personal
risk
at
some
point
to
finance
and
invest
into
these
businesses.
And
now
they
are
also
totally
in
shambles,
and
the
government
is
saying
to
these
individuals.

businesses
must
be
shut
down
because
it's
a
public
health
crisis
and
so
I'm
again
trying
to
think.

is
this
inconsistency
existing?
Why
are
we
not
discussing
nail
salon
really
funds
right
now?

it
not
a
taking
for
the
government
to
say
to
a
barber
shop
owner
pay
all
that
money
that
you
invested
into
your
business,

revenue
that
you
depend
on
to
maintain
your
livelihood
and
your
business
you're
not
gonna,
get
that.

same
right

Everyone
is
sacrificing

none

us

going

be

business
deals

had
on

table
when

someone
going

compensate

salon
owners,

so
we
all

take
a
hit.

that's

depressions
are

a
free
market
economy

about,
there's
risk
in
it.

expectation

happen,

like

kind

understanding
of

our
art

understanding
of
why
rental
housing
operators
need

done

people
who

living

their
homes

not
going

out

streets
from
this

all
over

Many
are
currently
paying
rent
from
their
savings,
but
at
some
point
those
these
savings
will

exhausted,

as
the

shelter
and
place
orders

volume
and
these
businesses
and
the
income
of
their
employees
will
only
increase
over
time.
It
is
important
that
it
was
working
for
the
city
to
take
steps
now
to
prevent
a
massive
displacement
tour
of
our
current
due
to
addiction.

is
quite
fortunate
and
that
many
of
its
renters
employed
in
the
tech
industry
are
still
working
and
able
to
pay
rent.
In
addition,
Social
Security
benefits
in
all
forms
continue
to
be
sent
to
recipients
as
their
pensions
and
similar
retirement
benefits.
As
a
result,
overall
landlords
will
continue
to
receive
rental
income
for
many
of
their
tenants.

Those
tenants
who
are
not
able
to
pay
right
now
will
likely
be
able
to
pay
down
the
road,
since
the
city's
moratorium
doesn't
does
include
a
time
frame
for
repayment
of
background
landlords
will
get
the
funds
they
are
due

resort
to
addiction.
We
request
that
the
city
also
explore
ways
to
support
small
landlords
whose
viability
is
threatened
by
the
temporary
loss
of
cash
flow.
Effective
response
of
the
state,
county
and
city
is
taking
considerable
time
to
implement
many
of
our
community
reported.

CSA
in
April
have

yet

to
struggle
to
keep
up
with
the
staggering
pace
of
unemployment
claims,
as
many
in
our
community
have
not
yet
received
funds
to
which
they
are
entitled

longer
time
frame
for
the
moratorium
is
most
called
for.
Finally,
the
city
staff
report
on
this
topic
knows
that
the
city's
rent
relief
program
administrator
administered
by
Community
Services
Agency,
is
significantly
greater
than
the
resources
available.
It
adds
there
is
only
FINA
funding
to
provide
approximately
1,300
households
one
month
or
rental
support.

applied,
and
one
month
is
not
enough.
Until
we
can
find
a
way
to
close
the
gap,
we
should
not
be
pushing
people
out
of
their
home
because
of
a
signal,
anticipate
or
control.

with

tenure
allowance

rent
paid
back
to
the
state.

are
aware
that
you
cannot
implement
such
a
plan.

you
to
adopt
the
county's
extension,

allows

more
months
plus
one

time
to
pay
back

one

lot
over

past
week
and
what
I'm
think
it's
probably
the
simplest,
simply
to
extend
the
moratorium
and
keep
it
in
line
with
the
county.
But

the
advantages
is
it
would
require
only
one
educational
campaign.

other
challenge,

is

we

our

county

persist

similar

lacks

of
the
minor
modifications
that

feel
like

much
to
gain
from
allowing
our
eviction
moratorium
to
lapse
and
just

county

persist.

knowledge
associated
with

local
moratorium,
expiring
and

confusion
over.
You

what

elements
of

county

like

forgiveness

has,

allowed
ourselves.

time

help
folks

in
their
homes,
but
also
make
sure

rental
property
are
made
whole
in

eviction.

Moratorium
only
applies
to
households
that
can
demonstrate
right

provide
documentation

they've

income
because
of

not
just
sort
of
a
blanket
protection
for
everybody
to
prevent
abuse.

reasons
why

think
you

an
appropriate
