meetings

regards
to
brookside
golf
course
deal.

change
to
the
codified
ordinances
for
the
city
of
norton
was
constructed
solely
for
the
satisfaction
of
one
person
and
one
person
only
as
elected
officials.

represent
the
people
and
the
best
interests
of
the
city
in
whole.

pass
this
in
good
faith
for
one
person
to
financially
gain,
while
the
residents
around
this
property
have
so
much
to
lose
with

stating

proposed
plans

they

told
was
getting

that
proposing

ordinance
which
provides
a
blanket
ratification

quote
all
actions
of
counsel,
the
planning,
commission
and
any
officer
etc
previously
taken
in
furtherance
of
or
in
reliance
on,
the
provision
of
chapter
1287.

closed
quote
is
totally
inappropriate
and
it
is
absurd.

Number
114
2020
is
in
violation
of
section
3.18
of
the
legislative
procedure,
which
provides
that
no
quote
that
re,
which
provides
in
part
quote
no
ordinance
or
resolution,
shall
contain
more
than
one
subject,
which
shall
be
clearly
expressed
in
its
title.
Close
quote
the
subject
matter
of
the
ordinance
is
to
re-adopt
and
ratify
chapter
1287
and
at
the
same
time
the
ordinance
asks
to
incorporate
the
subject
matter
of
numerous
other,
unidentified
and
undescribed
actions
of
the
council
planning,
commission
and
administration,
which
does
not
appear
proper
as
a
practical
matter.

time
from
when
the
mixed
use
district
was
initially
introduced,
based
upon
a
totally
different
proposed
development
to
what
is
currently
being
pushed
through,
based
upon
a
mixed
use
district
for
the
golf
course
under
a
chapter,
1287

disaster.
Overall,
the
public
has
had
a
very
difficult
time
getting
timing,
complete
information
on
the
changing
development
plans.
Moreover,
the
notices
and
streaming
youtube
meetings
that
the
planning
commission
and
council
have
been
using
have
been
inadequate
for
public
participation
and
comment
on
the
brookside
development.

pandemic
has
certainly
not
helped,
but
even
going
to
zoo
meetings
has
been
inadequate
because
of
the
challenges
of
the
technology
to
go
through
this
past
year.
Public
meetings
in
which
the
public
could
not
adequately
participate
has
been
a
real
problem,
especially
when
ordinance
number
114
2020
now
seeks
to
just
whitewash
everything
by
ratifying
and
confirming
every
subject
matter,
and
every
action
undertaken
to
date
involving
chapter
1287
that
simply
just
does
not
work
and
114
2020
should
be
replaced
on
that
should
be
rejected
on
that
basis
alone.

Nonetheless,
despite
all
the
problems,
residents
have
experienced
in
getting
complete
information
timely
relating
to
proposed
for
the
golf
course
and
despite
the
problems
of
not
being
able
to
actively
and
effectively
participate
in
public
meetings,
the
residents
of
norton
have
very
overwhelming
told
the
planning
commission,
council
and
the
mayor
on
numerous
occasions
that
the
development
now
proposed
for
the
golf
course
based
upon
the
proposed
chapter,
1287
mixed
use
district
is
a
terrible
idea.
It
does
not
fit
with
the
neighborhood
or
the
city's
own
comprehensive
plan.

this
point
if
it
is
at
the
five
minute
limit,
is
there
a
motion
to

planning
commission,
while
acknowledging
receipt
of
the
comments,
did
not
address
them,
and
instead
it
was
stated
that
the
decision
ultimately
is
with
council
to
decide
the
meeting
minutes
from
the
july
28
2020
meetings
state

Mr
conklin
stated
that
the
zoning
currently
on
the
property
leaves
little
ground
for
the
planning
commission
to
deny
it
just
on
the
fact
that
we
don't
like
it.

want
to
address
is
he
went
through
100
plus
letters,
and
the
final
decision
does
not
lay
with
us
but
with
the
council,
even
though
I
don't
always
agree
with
her.
I
did
read
charlotte
whitney's
letter
and
he
sometimes
has

ask
himself
if
that
this
legislation
is
what
council
and
the
residents
really
thought
they
were
getting
and
what
they
wrote
it
on.

council
and

residents
need
to
look
at
this
and
decide
if
they
want
this
kind
of
density
or
do
council
on
the
residents
need
to
rethink
this
for
the
future.
Currently
with
what
we
have,
he
didn't
think
the
planning
commission
has
any
basis
for
denial
at
this
point,
as
their
application
fills
the
requirements.

dowling
thanked
mr
conklin
for
clarifying
the
fact
that
sometimes
the
commission
has
no
choice
when
the
application
and
drawings
comply.
Mr
conklin
stated
he
struggled
with
this
type
of
application
being
held
as
a
zoom
level
due
to
the
lack
of
public
input.
Future
meetings
should
be
held
even
if
the
school
auditorium,
to
allow
personal
presence,
as
opposed
to
zoom
meetings.
Mr
dowling
stated
from
the
residence
standpoint
where
we
are
recommending
body
and
look
at
the
code.

be
up
to
council
to
have
public
meeting
generally
as
the
second
meeting
and
the
decision
make
on
the
third
meeting.
Accordingly,
the
planning
commission
believed
it
had
to
approve
the
preliminary
plan
as
july
28
2020.
The
developer
presented
based
upon
wonky
use
district
zoning
created
with
1287,
and
it
was
ultimately
up
to
the
council
to
decide
if
it
is
a
good
idea
to
approve.

all
the
residents
and
public
comments
have
overwhelmingly
indicated
is
that
chapter
1287
should
not
be
adopted
and
used
as
the
zoning
applicable
to
the
golf
course
using
the
mixed
use.
District
zoning
for
the
golf
course
has
resulted
in
a
developer,
proposing
to
build
600
to
700
packed
houses
and
apartment
buildings
which
no
residents
of
norton
want.

support
its
planning
commission
on

meeting
for
review
and
consideration
by
the
council.
All
the
comments,
issues
and
concerns
provided
by
the
residents

explain
why
chapter
1287
should
vote
against,

vote
against
any
ratification
re-adoption
because
it
is
the
wrong
type,

it

the
wrong

of

planning
commission
did
not
address
these
comments
and
plainly
deferred
to
council.

such

it

multi-family
units
and

single-family

though
each
proposed

no
indication
of
where

multi-story

to
be
built
and
where
the
single
family
homes
are
to
be
located.
Why
is
this?
It
also
states
on
the
plans
that
the
multi-family
homes
are
designated
to
be
two
stories,
but
code
allows
for
three
stories.

are
currently
doing
soil
tests

golf
course
property,
which
indicates
that
they

preparing
to
begin
building
these
multi-family
units.
The
type
of
soil
tests
being
done
are
not
for
individual

for
many

did
both
residential

commercial

The
same
builder
ryan
holmes,
who

designated
as
the
builder
for
this
development,
is
currently
building
units

were

told
that

was

to

but

in
and

all
the

practice

such

many
community

pains
when

purchased

course,

was
understood

it

integral
part
of
norton
and
would
remain
so
throughout

that
it
was
zoned
to
remain
a
golf
course
or
for
similar,
similar
recreational
use,
which
would
maintain
the
beauty
and
integrity
of
the
area
and
the
city
as
a
whole,
a
highly
desirable
location.

also

that
the
golf
course
owner
was
responsible
for
the
upkeep
of
golf
course
drive
now
comes
the
golf
course
owner
deciding
to
sell
his
property,
which
he
is
more
than
entitled
to
do
within
the
limits
of
the
law.

any

us
would
have
the
same
expectation
to
do,
however,
that
is
not
what
is
happening.
Zoding
codes,
responsibilities,
clear-cut
plans,
impact
reviews,
etc
have
not
been
given
due
diligence,
nor
has
transparency
regarding
this
undertaking.

family
dwellings

services

course
was

does
that
leave

future

golf

drive

ultimate
responsibility

follow-through
does
not

trust
due
to
the
vagaries
of
this

residents

golf
course
drive
pay

fair
share

taxes

support
this

do
not
have

service

residents
enjoy.

has
supported

for

dollars

supposed

of
its
residents
through
due
diligence,
enforcement

codes
and
laws

place
to
serve
the
whole
community
proper
legislation,

ensuring
that

misuse
of
our
tax
dollars.

should
be
no
favoritism.

city
prior

any
code
change

should
be
required
at

expense

persons

companies
standing

size

as
a
separate
and
distinct
subject
matter,
ordinance
114-2020
also
seeks
to
re-adopt
and
ratify
chapter
1287,
which
was
previously
the
subject
of
ordinance
44-2019.

Ordinance
414-2020
is
in
violation
of
session
3.18
of
the
legislative
procedure,
which
provides
in
part
no
ordinance
or
resolution
shall
contain
more
than
one
subject,
which
shall
be
clearly
expressed
in
its
title.

subject
matter
of
the
ordinance
is
to
re-adopt
and
ratify
chapter
1287
and,
at
the
same
time,
the
ordinance
seeks
to
incorporate
the
subject
matter

numerous
other,
unidentified

undescribed
actions

the
council
planning,
commission
and
administration,
which
does
not
appear
proper
as
a
practical

challenge

technology
to

through
this
past

meetings

adequately
participate
has

real

when
ordinance
114-2020
now
seeks
to
just
whitewash
everything
by
ratifying
confirming
every
subject
matter
and
every
action
undertaken

date
involving
chapter
1287
that
simply
just
does
not
work
and

2020
should
be
rejected

that
basis
alone.

all
the
problems,
residents

experienced

getting
complete

timely
relating

proposed
development

the
golf
course

problems

not

able

effectively

overwhelmingly
told
the
planning
commission,
council
and
the
mayor
on
numerous
occasions
that
the
development
now
proposed

the
golf
course
based
upon
the
proposed
chapter.

mixed-use
district

terrible
idea.
It
does
not
fit
with
the
neighborhood
or
the
city's
own
comprehensive
plan
on
these
points.

commission

2020

which
consisted

103
pages
of
emails
from
dozens
of
residents
regarding
application,

approval

The
planning
commission,
while
acknowledging
the
receipt
of
the
commons,
did
not
address
them,
and
instead
it
was
stated
that
the
decision
ultimately
is
with
council
to
decide
the
meeting
minutes

july
28,
2020,
meaning
state

residents

admire

coming

difficult
situations
waiting

time

they're
not
playing
games,
it's
important
to
them

place

outside

city
saying

someone

want

live
here.

want

kids
to
go
in
the
norton
school
system
and
they
can't
get
in
there's
nowhere
for
them
to
go.
There's
not
sufficient
decent
housing.

everybody
wants
to
live
in
the
trailer
park.
So
there's
an
opportunity
here.
The
mixed
use
is
what
we're
addressing,
though
I'm
not
entirely
happy
with
mixed
use.
It
was
what
we
addressed
when
we
talked
about
the
nursing
home
versus,
I
should
say,
assisted
living,
because
I
had
in
mind
this
was
going
to
be
a
senior
type
of
building.

However,
as
we
went
down
the
path
and
discussed
the
possibility
of
multi-family
units,
in
other
words,
some
form
of
a
community
center
with
apartments,
I've
lived
in
apartments
that
were
very
nice.
In
several
cities,
I've
lived

probably
15

my
career
and
maybe
more
and
there's
some
very
nice
places,
and
it
would
not
really
be
obtrusive.

have

real
problem
with
having
some
apartment
buildings
that
are
decent,
because
we
have
a
very
precious
few
and
not
everybody
can
afford
to
buy
a
house,
but
they
do
have
young
people
that
could
go
to
us
our
schools
and
incomes
that
could
be
taxed
and
pay
for
what
they
they
get
out
of
our
city.
So
I
don't
see
it
as
being
a
real
burden
to
us.

concerns

the
resident
about
the
if
we
had
to
do
extra
police
or
extra
fire.

think
you
got
to
remember
this
will
be
an
increased
tax
with
value
to
the
city
inside
millage
to
the
general
fund
and

income
tax,

could
produce
some
money
for
extra
firing
police.
If
we
needed
and
same
with,
if
we
had
to
add
additional
teachers,
remember
this
will
be
more
money
to
the
schools
for
the
property
tax.

just
wanted

put
that
in

added
income
tax

students
out

project
added
students
for
the
school
system,
that's
600
open
enrolled
students
that
could
be
returned
to
their
home
district,

district

forwards

dollars
for
each
and
every
open
enrolled
student.
They
do
not
forward
the
entire
amount
allocated
to
them
from
the
state.

resident

we
replace

schools

money

replacing,

we
would
be

to
start
with

schools

idea

would
