A
A
A
A
Thank
you
anybody
else
wishing
to
speak
tonight
for
being
numb.
I
will
close
the
floor.
The
citizens
open
forum,
okay,
on
the
agenda
items
number
one
we'd
like
to
have
an
approval
of
the
minutes
dated
september
25th,
2019.
I'll
make
a
motion
to
approve
a
second
all
in
favor
signify
by
saying
hi,
all
right
carried
all.
B
Okay,
I'd
like
to
do
that.
First
of
all,
we
have
steve
graber,
who
was
an
alternate.
He
has
moved
up
to
take
jerry
walters
position.
Jerry
was
a
long-term
member,
as
you
know,
and
resigned
for
health
reasons.
B
E
Matt
clark,
you
know
me
from
running
2018
been
involved
with
the
community
for
10
years,
but
just
recently
last
few
years
really
got
involved
in
that.
So
I'll
do
what
I
can
for
the
let's
see.
F
C
Setback
along
st
petersburg
drive
in
south
bayview
boulevard,
st
petersburg
drive
will
be
undergoing
redesign
and
is
funded
under
the
complete
streets
program
will
be
aimed
at
improving
access
for
modes
of
traffic
around
the
corridor,
including
pedestrian
and
visalus,
and
seen
as
a
transformative
catalyst
for
adjacent
businesses.
In
addition,
the
property
is
located
across
from
the
cra.
C
The
portion
of
the
proposed
deck
is
within
the
front
setback
area
and
requires
approval
of
the
variance,
and
there
is
a
proposed
plan
granting
the
variance
is
necessary
for
the
preservation
and
enjoyment
of
a
property
right.
It
does
not
merely
serve.
There
could
be
means
for
the
applicant
relief,
for
the
variance
thought
did
not
result
from
the
action
by
the
applicant
or
with
prior
knowledge
or
approval
of
the
applicant.
C
It
is
the
minimum
variance
we'll
make
possible
amid
reasonable
use
of
land.
St
petersburg
drive,
as
I
said,
is
going
under
complete
streets
and
will
have
a
10
foot
wide
multi-use
path
that
will
run
adjacent
to
the
property.
Locating
the
building
closer,
which
is
what
the
deck
will
do,
will
create
a
more
walkable
community.
C
Regulations,
it
will
not
constitute
an
amendment
for
the
old,
smart,
comprehensive
inland
code
or
the
county-wide
comprehensive
plan.
An
amendment
to
another
land
use
category
available
on
our
comprehensive
plan
and
the
county-wide
future
land
leaves
plan
has
been
considered
by
the
applicant
in
the
city
have
been
determined
that
such
an
amendment
will
not
be
required.
A
Okay
being
there's,
I
do
have
one
being
it's
on
two
different
streets.
Is
it
inclusive,
usually
when
it's
like
that
on
the
corner
lot
there'll
be
two
different
variances
one
for
st
pete
drive.
A
Single
variance
for
for
both
three
questions
for
both
streets-
okay-
just
that's
fine
and
doc-
says
I
I'm
guessing
that
the
circles
under
signify
by
saying
the
three
tiki
huts.
Yes,
okay
on
the
picture,
it
had
like
four
circles.
A
C
G
C
H
Then
the
excuse
me,
the
trees
that
are
there
on
the
site.
Photos
are
those
gonna
have
to
be
removed,
I'm
guessing
or
this
is
the
deck
going
to
be
built
around
them
because
it
said
landscaping
in
the
write-up.
So
just
I
wasn't
sure
what
the
landscaping
would
consist
over
if
this
was
going
to
be
built
around
it.
C
I
don't
know
the
applicant
here:
okay,
he'd
be
able
to
answer
more
specifically.
I
you
know,
I
think
he's
going
to
try
to
preserve
what
he
can,
but
those
are
those
palm
trees
and
they're,
not
a
protected
tree.
To
begin
with.
G
A
Okay
right,
no
more
questions
from
the
staff.
Does
the
applicant
wish
to
speak
on
this.
A
If
you,
if
you'd
like
to
speak
on
this
matter,
okay,
that's
fine,
please
state
your
name
and
address
for
the
record.
E
Matt
clark
from
501
pine
avenue
south
ultima,
this
this
actual
variance,
was
put
in
place
a
year
and
a
half
ago,
as
when
we
owned
the
house
across
the
street.
We
had
a
hell
of
a
time
trying
to
sell
our
house
because
of
what
was
going
on
at
that
hotel
and
it
was.
E
I
can
only
sum
it
up
using
the
s
word
and
hole
after
it,
and
I
put
something
to
joey
the
owner
that
hey
look.
How
about
you!
Let
me
fund
and
I'll
pay,
twenty
thousand
dollars
to
clean
up
your
property,
because
it's
an
eyesore
and
in
the
end
he
said
yes,
because
it's
free,
twenty
thousand
his
place
looks
good
and
then,
in
the
end,
we
put
some
investors
together
and
we
purchased
the
property.
So
we
could
really
make
something
of
it.
E
So,
to
answer
the
question
with
the
trees,
they're
actual
trees
that
we've
brought
in
those
royal
palms
and
we've
done
all
the
way
down,
we're
going
to
deck
around
it
and
the
purpose
for
the
deck
isn't
so
much
going
to
the
boundary.
E
It's
doing
my
head
in
how
to
make
the
place
look
pretty
without
making
it
look
uniform
and
direct.
So
the
idea
is
to
put
the
deck
out
there.
It's
only
going
to
be
the
same
height
as
two
steps.
So
that
way
we
can
just
go
a
little
bit
higher
than
the
two
steps
make
it
all
ada
compliance
for
wheelchair
access
and
have
it
so
you
can
come
right
around
the
whole
building,
because
at
the
moment,
there's
five,
six
or
seven
different
access
points
that
nobody
else
can
get
to.
E
So
that's
my
way
of
trying
to
make
it
look
more
uniformed
ada
compliant
and
pretty
it's
more
of
a
pretty
thing
than
anything
else.
So
we're
not
planning
on
one
of
my
neighbors
has
actually
mentioned
tonight.
He's
here
to
make
sure
that
there's
no
it's
not
going
to
be
moved
any
further.
It's
not
going
to
be
extended
onto
or
anything
like
that
and
the
height
isn't
going
to
change,
we're
literally
just
bringing
up
all
the
concrete
steps
and
hiding
them.
E
So
that
way
the
place
looks
more
uniformed
and
as
it
comes
around
the
corner,
we
can
have
it
drawn
in
for
an
ada
compliant
wheelchair
ramp.
That's
the
goal
of
it
to
make
it
more
compliant,
because
it's
not
at
the
moment
it's
how
it's
been.
That
way.
I
don't
know,
but
I
just
want
to
try
and
clean
it
up
new
handrails
and
stuff
like
that,
so
so
yeah
any
other
questions.
H
The
only
with
the
trees
they
they're
nice,
I'm
glad
that
you
put
them
in
there
and
that's
just
with
the
deck
being
built
around
them
and
the
tickets.
I
think
it's
going
to
look
nicer,
but
then,
of
course,.
E
And
the
tiki
hats
are
drawn
in
that
was
an
old
drawing
before
I
I
think
it's
an
old
drawing,
but
I
submitted
a
long
time
ago
or
two
of
three
or
four
months
ago,
before
I
put
those
palm
trees
in
so
where
they're
drawn
in
now,
it's
physically
impossible
to
put
it
there.
It
actually
comes
closer
to
the
building
and
they're,
not
tiki
hats.
Those
little
tiki
hut,
poles
that
go
in
the
ground
and
that's
come
up
with
an
umbrella
and
even
then
that's
a
maybe
we
just
thought.
E
E
Also,
I
had
a
complaint,
not
a
complaint,
but
somebody
mentioned
to
jerry
peruzi
that
when
you
pull
up
to
that
intersection,
now
it's
blocking
line
of
sight
so
we're
taking
three
trees
out,
because
it's
so
the
way
it
curves
around
the
corner.
I've
pulled
up
there.
I've
had
several
other
people
do
it.
They
say
they
have
got
no
problem.
E
F
A
Thank
you.
Okay!
Is
there
anybody
in
the
audience
wishing
to
speak
in
favor
of
this
request?
Anything
please
step
forward
state
your
name
address
for
the
record.
I
Hi
ed
roland
313
park
boulevard
and
I'm
also
the
property
owner
of
the
property.
Just
to
the
south
of
this
I
wanted
to
just
say
that
I
think
the
new
ownership
and
matt
are
doing
a
fantastic
job.
I
think
the
place
looks
great.
It's
going
to
look
great.
I
should
say
that's
in
progress,
obviously,
but
all
the
work
they're
doing
so
far
looks
looks
really
good.
I
I
think
the
deck
in
location
that
is
proposed
on
the
site
plan
would
be
an
improvement
that
would
be
welcomed
and,
as
I
had
mentioned,
to
matt
the
only
questions
or
concerns
that
I
had
was
just
to
make
sure
that
the
footprint
or
that
the
excuse
me,
the
variance,
is
limited
to
the
footprint.
That's
on
the
site
plan.
I
If
it
were
to
encroach
further
south
into
the
residential
area,
I
think
I
would
be
I
would
have
more
concerns
and
maybe
be
against
it
or
it's
located
up
there
near
bay
view
and
sorry
near
saint
pete
drive,
I
think,
is
appropriate
and
we
talked
about
the
height
issue
and
I
think
that
their
codes
that
are
going
to
keep
it
down
to
a
minimum
anyway.
So
I
think
that
that
all
sounds
good
again.
I
A
Let
me
put
the
other
way,
then
anybody
in
the
audience
in
opposition
to
this
request.
A
If
you
want
to
state
your,
if
you
want
to
state
your
position,
that's
fine.
Please
come
forward
state
your
name
and
address
for
the
record.
A
Hold
on
to
second,
please
sure
clark
said
you:
please
swear.
G
Joe
quran
and
valeria
quran
we're
at
512
south
bayview.
I
guess
questions
from
I'm
just
I've
heard
different
things
about.
What's
going
to
happen
with
the
motel,
I
heard
the
tiki
hot
bar
and
grill
okay,
but
then
I
also
heard
the
hotel
and
spa.
So
I'm
just
wondering
what
the
plans
are.
G
The
only
reason
I
have
concerns
really
is
if
it's
just
a
bar
and
grill
that
corner
the
idea
of
that
being
an
outdoor
bar,
particularly
with
the
new
palm
trees,
it
seems
kind
of
small
and
then
some
of
the
neighbors
we've
talked
about
as
it
is
right
now,
if
it's
just
a
deck
out
there
and
it's
it's
not
a
bar
and
grill
the
current
residence,
so
they're,
just
gonna,
walk
across
the
street
to
the
convenience
store
come
over.
Have
some
beers
right
there
on
the
bar?
E
Okay,
so
there's
a
lot
of
rumors
going
around.
Yes,
we
purchased
the
hotel.
It
is
remaining
a
hotel
for
the
next
two
years.
We
have
plans
to
knock
it
down.
So
all
this
money,
we're
spending
is
ridiculous.
I
know,
but
we're
doing
it
more
for
community
and
value
of
land,
I'm
fluff
from
this
the
we
have
no
intention
of
doing
anything
whatsoever
apart
from
cleaning
up
the
the
appearance
of
the
hotel.
Painting
parking
lots.
Everything
like
that
purely
based
on
it's
going
to
remain
a
hotel
from
day
one.
E
We
have
literally
got
rid
of
all
the
selective
guests
that
were
previously
in
there
and
trying
to
clean
that
up
and
we're
probably
day
18
of
no
police
attendance,
which
is
a
record
for
this
place
in
two
years
time.
We
have
got
plans
and
we're
looking
into
knocking
the
entire
structure
down
and
building
oldsmar
resort
and
spa.
That's
what
we
would
like
to
do,
whether
that
goes
ahead.
E
It
goes
ahead
if
it
doesn't
so
be
it,
but
there's
a
lot
of
hurdles
to
jump
through
between
now
and
then
so
for
the
next
two
years.
We
want
to
operate
as
a
nice.
Little
key
westy
style,
hotel,
motel,
there's
no
bars,
there's
no
restaurants,
there's
no
swimming
pools.
Yet
as
much
as
I'd
like
a
swimming
pool
right
now,
it's
it's
going
to
remain
a
motel,
but
a
more
cleaned
up,
boutique
style
hotel,
something
that
we
can
proud
of
versus
something
we're
ashamed
of.
So
that's
the
goal.
A
A
F
I
I
I
was
my
question:
was:
if
their
let's
say
the
deck
will
be
built
around
is,
are
you
going
to
be
in
haze,
enhancing
enhancing
the
motel?
You
know
what
kind
of
people
or
resident
or
what
kind
of
guests.
J
Sure
my
name
is
wendy
st
hilaire.
I
live
at
509,
south
bay
view
two
doors
down
from
the
motel,
so
my
husband
and
I
have
been
in
oldsmar
for
19
years
and
we
rehabbed
our
old
spanish
house
two
doors
down,
so
we're
really
thrilled
with
the
work
that's
been
going
on
at
the
motel.
It's
a
lot
of
sweat
blood
equity.
So
we
recognize
that
hard
work
and
we're
really
appreciative
of
the
purchase
and
the
property
owners.
J
The
only
concern
which
we
have,
which
is
relatively
stomach
churning
on
our
part,
is
what
happens
when
the
wooden
deck
with
the
tiki
umbrellas
gets
put
in
which
we're
thrilled
about.
We
think
it
will
enhance
the
building,
but
prior
to
a
lot
of
room
and
boarding
and
building
upgrades
being
completed.
That
is
the
main
route
that
the
kids
walk
to
and
from
school
in
the
afternoon.
It's
also
a
well-traveled
road
for
foot
traffic
and
for
cars
in
the
city.
J
So,
with
this
enhancement
to
the
motel,
our
biggest
concern
is:
would
the
residents
purchase
beverages
and
then
sit
on
the
tiki
bar
or
the
tiki
and
and
hang
out
for
long
periods
of
time,
almost
making
it
more
of
an
eyesore?
We
don't
think
that
that
isn't
the
intention
at
all.
It's
been
a
huge
investment
for
the
property
owners,
so
we
really
think
that
the
intention
is
great
and
we
think
that
the
we
absolutely
think
that,
but
sometimes
things
go
off
track.
So
we
want
to
see
the
motel
become
more
beautiful.
A
C
C
Matt
is
aware,
and
so
is
the
owner-
that
there
are
distance
requirements
for
alcohol,
so
he's
going
to
need
to
overcome
what
they're
going
to
do
about
that.
So
there
is
going
to
be
various
processes,
should
they
go,
and
you
know
when
they
say,
tear
it
down
and
try
to
do
other
things
that
they're
going
to
have
to
go
through
because
our
code
as
they're
aware
of
has
certain
rules
and
regulations.
C
J
And
we
would,
we
would
absolutely
be
in
support
of
a
nicer
building
in
that
structure
or
even
an
enhanced
building.
That
was,
you
know,
enhanced
in
some
way,
rather
than
the
current
parking
lot
and
building
okay.
Thank
you
very
much.
Thank
you.
A
I
mean
you
don't
have
to,
because
michelle
kind
of
clarified
that
thank
you,
anybody
else
in
the
audience
wishing
to
speak
in
opposition
to
this
request,
they're
being
done.
The
floor
is
now
closed.
D
Foot,
I
think
it's
saint
pete
drive
it's
on
right,
baby.
A
Okay,
any
discussion
on
the
matter.
F
So
I
I
want
to
say
this
mention
about
school
kids,
trial
traffic.
That's
not
gonna
interfere
the
tiki
bar
with
kids
coming
through
from
school
back
and
forth
with
the
patrons,
or
you
know,
traffic
people
driving
in
and
out
of
the
place
during.
E
Umbrellas
just
for
aesthetics,
and
then
we
might
put
one
in
any

there
is

what
you're

I
have

that

as
in

None
of
that
kind
of
any.

This
is
the
front
yard
setback
and
locating
an
accessory
structure
in
the
front
yard,
variance
request
to
clarify
what
that
means
is
an
accessory
structure,
which
is
what
a
garage
is
usually
defined,
as
is
not
supposed
to
be
located
in
the
in
the
front
yard
of
a
house,
particularly
when
it's
detached
you
wouldn't
want
to
just
have
like
a
garage
sitting
there
along
the
avenue.
This
is
a
corner
lot,
so
the
subject
property
has
a
zoning
designation
of
e2
state,
residential
and
the
city
future
land
use
designation,
a
residential
estate.
C
The
setbacks
in
the
e2
district
are
25
for
the
front
10
for
the
side
and
20
for
the
rear
property
is
a
corner
lot
and
is
considered
to
have
two
fronts:
one
on
lafayette
and
the
other
on
east
state
street
east.
This
existing
structure
is
oriented
towards
lafayette
boulevard
and
is
accessible
from
lafayette.
Boulevard.
C
C
The
relief
for
variants
did
not
result
from
an
action
by
the
applicant
or
the
prior
knowledge
or
approval
of
the
applicant.
The
granting
of
the
variance
requested
will
not
confirm
the
applicant
any
special
privilege,
that's
denied
by
the
provisions
of
this
code,
the
land's
buildings
or
structures,
the
variance
requested,
as
the
minimum
variance,
would
make
possible
the
reusable
use
of
land.
As
I
indicated,
the
original
concept
had
been
to
locate
it
in
the
backyard.
C
C
Area
and
also
on
the
opposite
side
is
the
wastewater
plant,
so
locating
it
on
the
secondary
front
among
state
street
aligned
with
the
main
residents,
makes
it
accessible
from
the
main
driveway
and
provides
the
least
disturbance
to
land
he
has
been
advised.
It
would
be
required
positive
drainage
and
provide
pre-construction
post-construction
elevations,
which
is
a
normal
part
of
the
building.
C
The
branding
of
the
variants
we'll
be
in
harmony
with
serves
a
general
intent
and
purpose
of
land
and
work.
When
I
put
my
glasses
on
intent,
purpose
of
it
is
consistent
with
the
county-wide
future
land
use
plan,
the
old,
smart,
comprehensive
plan
and
these
regulations
does
not
constitute
an
amendment
to
the
oldsmar
comprehensive
plan,
land
development
code
or
the
county
wide
comprehensive
plan,
an
amendment
to
another
land
use
category
under
the
old,
smart,
comprehensive
plan
and
the
county-wide
future.
C
Let
land
use
ban
will
not
be
appropriate
based
upon
the
above
discussion,
staff
recommends
approval
of
the
request
for
reduction
to
the
front
yard
setback
from
25
to
10
along
state
street
and
a
request
to
locate
a
14
by
10
accessory
structure,
metal
garage
within
the
front
yard
setback
area
along
state
street
in
e2.
The
state
residential
zoning
district,
I'd
like
to
submit
the
staff
report
into
the
record.
Thank
you.
G
There's
other
pictures
depict
a
few.
You
know
what
look
like
pretty
good
sized
trees,
probably
oak
trees.
Are
they
impacted
by
the
building's
location
or
the
construction
of
the
building.
A
C
A
The
only
one
of
the
concerns-
okay,
yeah,
that
that
is-
and
I
know
we're
basing
it
just
on
the
variance
but,
like
I
said
I
I
also
see
the
topographical
on
it.
I
mean
if,
if
you
bring
it
up
and
look
at
the
layout
of
the
land-
and
there
is
quite
a
big
drainage,
ditch
on
the
state
street
side
of
it
well.
C
I'll
give
you
a
quote
from
the
city
engineer:
the
garage
appears
to
be
in
the
swale,
so
provide
a
lot
grading
plan
to
assure
that
adverse
training
patterns
don't
exist,
so
he
will
when
he
goes
through
the
building
permitting
process.
The
city
engineer
is
one
of
the
ones
who
evaluates
the
placement
of
these
things.
Okay,.
A
A
A
Okay,
I
see
we
do
have
a
variance
somebody's
in
favor
of
this
request
that
it
was
submitted
to
the
city
108
by
a
dennis
denise.
Sorry,
my
bad
okay.
Does
the
applicant
wish
to
speak
on
this
variance
request
if
you
come
forward,
please
state
your
name
address
for
the
record.
D
D
And
then,
if
you
were
to
look
in
the
rear
of
my
property,
you'll
see
that
I
have
nine
large
oak
trees
that
are
over
24
inches
in
diameter
and
based
on
an
ordinance
that
I've
been
aware
of
for
the
city.
I
would
have
to
have
at
least
25
feet
over
the
driveway
from
the
sidewalk,
so
it
would
literally
put
the
garage
in
the
middle
of
and
I
have
to
remove
all
nine
trees.
D
The
main
other
concern
is
yes,
I
do
have
many
garages,
but
I'm
also
beginning
to
face
the
time
where
I
need
to
make
the
house
a
little
more
ada
compliant
and
have
facilities
for
my
parents,
and
I
have
one
living
with
us
now
and
want
to
have
access.
That
would
be
easy
from
the
front
to
be
able
to
make
the
home
compliant.
We
have
a
lot
of
heirlooms
and
make
sure
that
we
have
a
place
for
the
van
that
will
be
being
in
a
short
period
of
time.
D
Unfortunately,
access
for
them
to
be
able
to
transport,
so
it
is
a
personal
use,
only
garage
it
will
be
for
parking
and
for
personal
use
for
storage
and
just
to
make
sure
that
the
home
is
ready
for
that.
A
Okay:
okay,
any
questions
from
the
board
to
the
applicant.
H
I
had
one
it
said
it
was
going
to
mimic
the
facade
of
the
house
currently
and
so
I'm
having
trouble
matching
that
up
in
my
head.
If
it's
a
metal
garage,
are
you
going
to
basically
create
the
same
front
of
your
house
in
order,
so
it
matches
so
basically
this
blends.
So
I'm
sorry,
please
go
ahead.
D
H
A
A
B
Okay,
this
is
an
email
correspondence
I
received
dated
august
24
2020
members
of
the
board
of
adjustment
due
to
the
circumstances
with
coven
19.
Let
this
letter
serve
as
my
input
in
lewis.
Speaking
in
person.
Regarding
the
above
reference
variance
request,
I
am
a
neighbor
located
next
door
to
the
cursed
gestures.
B
Excuse
me.
The
lots
in
this
area
are
large
and
homes
are
not
crowded.
Along
with
this,
the
streets
are
wide
and
state
street
has
a
generous
right-of-way
accommodating
10-foot
wide
sidewalks.
Instead
of
the
usual
five
foot,
reducing
the
set
back
to
ten
feet
would
hardly
be
noticed.
Given
the
width
and
design
of
state
street
as
a
closest
neighbor,
I
have
no
objection
sign
denise
vignet.
A
Okay,
anybody
who
is
wishing
to
speak
in
favor
of
this
request,
okay,
they're,
being
done;
okay,
anybody
in
the
audience
in
opposition
to
this
request
there
being
none.
The
floor
is
now
closed.
A
A
F
A
C
C
C
The
property
is
located
in
the
cul-de-sac
on
cuddy
bay
court
and
has
a
unique
partial
shape,
resulting
in
extending
the
front
yard.
There's
a
45
foot,
drainage
easement
in
the
back
of
the
property,
the
15.8
foot,
drainage,
easement
on
the
south
side
of
the
property
utilized
by
the
city
for
ingress
egress
for
maintenance,
access
to
the
bayside
metals
parked
pond.
C
It
has
an
existing
six-foot,
chain-link
fence
and
gate
which
was
installed
installed
by
the
city
for
prior
owners,
requests
for
safety
to
prevent
trespassing
and
suspicious
activities
near
the
bay
view
metals
park
pond
in
the
back
of
the
subject
property.
The
city
does
not
have
any
records
of
the
prior
issued
variances
for
the
chain
link
fence
for
this
property.
C
Granting
that
application
is
necessary
for
the
preservation
and
enforcement
of
the
property
right
and
does
not
merely
serve
as
a
convenience
for
the
applicant.
The
applicant
recently
constructed
an
in-ground
pool
in
the
sally
of
the
house
and
is
asking
the
variants
to
replace
the
existing
chain-link
fence
with
six-foot
vinyl
fence
for
privacy.
C
District
variance
requested
as
the
minimum
variance
would
make
use
the
possible
and
reasonable
use
of
land
building
or
structure
that
is
not
based
primarily
upon
the
desire
of
the
applicant
to
serve
a
greater
financial
return
from
the
property.
Approval
of
the
variance
will
not
be
detrimental
to
the
surrounding
properties.
C
C
The
grinding
of
variants
will
be
in
harmony
with
serves
the
general
intent
and
purpose
of
consistent
with
the
county-wide
future
land
use
plan,
oldsmar
comprehensive
plan
and
these
regulations
shall
constitute
shall
not
constitute
an
amendment
to
the
oldsmar
comprehensive
plan,
land
development
code
or
the
county-wide
comprehensive
plan.
An
amendment
to
another
land
use
category
is
not
appropriate.
C
A
Thank
you
very
much.
Does
the
board
have
any
questions.
H
I
have
one
question
when
I
saw
pictures
of
the
gate
and
the
applicant
might
be
able
to
tell
me
better,
but
I
think
part
of
the
issue
is
that
people
sneak
through
that
gate
and.
C
H
And
this
goes
beyond
the
variance,
and
so
just
for
my
own
education
here
is
there
a
plan
for
that
chain-link
fence
that
the
two
doors
for
lack
of
a
better
term,
because
that
they're
already
pushed
open
from
what
I
can
see
just
on
like
a
google
maps
search,
and
so
the
concern
I
had
was
part
of
this
is
for
privacy
and
so
the
variance
request.
Of
course
that's
just
for
the
fence,
but
part
of
it
was
for
privacy.
So
I
didn't
know
if
we
were
separately
going
to
address
that
if
that
was
even
discussed.
C
H
I
was
on
the
ground
looking
at
it,
and
so
that
was
my
concern
like
I
said,
I
think
the
applicator
probably
understands
what
I'm
what
I'm
speaking
of
it's
difficult
to
have
without
a
picture,
but
it's
you
know
how
do
I
get
on
land
I'm
not
supposed
to
get
on?
Well,
there's
this
there's
this
gap
with
these
gates.
So
I
just
didn't
know
if
that
was
going
to
be
separate.
H
You
can
see
yeah
and
there
was
and
there's
enough
space
in
there
just
on
that
picture,
when
the
google
car
drove
by
where
I
was
like.
Oh
that's
what
they're
doing
so,
if
those,
if
those
doors
stayed
up
that
was
my
one
concern
like
I
said
it's
outside,
of
the
actual
variance
request,
because
the
vinyl
fence,
I
think,
is
a
good
idea,
but
it
was
just
that.
Did
the
city
have
any
other
plan
to
address
that
fence,
just
if
it
was
discussed
before
I.
C
Mean
technically
the
city
just
had
it
has
the
request
to
require
to
have
access?
Okay,
how
that
access
is
granted.
You
know
what
the
gate
looks
like
is
really
not
part
of
as
you're
saying
the
variance,
but
they
need
to
provide
us
access.
Okay,
and
in
that
case,
the
applicant
has
chosen
to
use
the
existing
gates.
Okay,
that.
A
K
Good
evening
my
name
is
mary
charissa
murphy.
I
reside
at
1900
cudi
bay
court.
I
purchased
the
home
in
january.
I
love
it,
I'm
so
happy
to
be
here.
The
fence
was
put
up,
I'm
under
my
understanding,
because
there
was
a
lot
of
people
hanging
out
back
there
partying
doing
whatever,
so
the
city
put
the
fence
up.
I've
had
three
fence
people
come
out
and
they've
all
said.
K
So
when
I
spoke
to
the
city
and
the
gates
are
19
feet
wide,
so
I
would
have
to
accommodate
19
feet
wide
of
vinyl
fencing,
a
gate
of
vinyl
fencing
which
is
very,
very
expensive,
plus
put
on
rollers
and
they
come
through
with
heavy
equipment.
So
I
opted
and
speaking
with
the
fence,
gentlemen,
he
said
just
we
will
reset
these
these
gates
properly,
we'll
take
down
the
existing
chain-link
fence.
K
I
just
want
to
put
up
a
white
vinyl
fence
exactly
where
the
chain-link
fence
is,
and
I
we're
going
to
keep
the
gates
but
they're
going
to
be
set
properly.
So
when
they're
chained
closed,
they're
closed
and
the
gates
are
dummy
left,
I
have
a
way
to
open
and
the
city
has
a
way
to
open
the
gates,
as
they
were
there
today
and
there's
no
issue
getting
in
the
defense
is
in
a
lot
of
disrepair
and
it
just
looks
so
ugly,
it's
terrible
plus
the
fact.
I'm
single
I'm
a
nurse.
I
work
shift
work.
K
About
a
month
ago
a
gentleman
was
walking
in
the
neighborhood
with
two
small
children
and
he
pushed
his
kids
through
the
gates
to
go
back
to
look
at
the
water,
and
at
that
time
my
pool
was
not
filled
yet
the
cage
wasn't
up.
I
had
a
concrete
hole
and
I
have
two
little
kids
in
my
backyard,
and
I
said
you
can't
do
that
and
he
was
like
well,
they
want
to
look
and
I'm
like
and
it
you
know
it's
just
not
been
safe
and
I've
come
home
different
times
and
there's
people
climbing
the
fence.
K
A
B
A
A
A
A
A
F
Yes,
you've
done.
There's
nothing
that
says
you
shouldn't,
you
can't
go
there,
but
your
decision
must
be
made
of
everything
that's
presented
tonight.
So
it's
advisable
to
not
go
to
the
site
you're
supposed
to.
As
in
the
courtroom,
you
would
only
listen
to
the
evidence,
that's
presented.
So
that's
what
your
decision
takes
on.
Okay,.
A
As
steve
had
alluded
to,
he
said
he
looked
at
to
get
a
better
clarification
on
the
cuddy
bay
court.
He
looked
at
it
on
with
that
google
maps
or
google
earth
is
that
acceptable.
Is
that.
H
It
was
just
I
had
the
information,
so
I
was
trying
to
see
exactly
the
parameters
of
it,
so
I
wanted
to
come
to
the
meeting
prepared,
but
it
was
like
I
said
that
was
outside
of
the
variance
request
regardless,
but
now
that
I
know
that
it
won't
happen
again.
I
just
I
didn't
know
that
or
I
wouldn't
do,
that
yeah.
