Description
Part 1
B
B
B
As
I'm
looking
at
it,
everyone
is
muted,
except
myself
and
assistant
director.
B
A
A
B
C
B
The
agenda
any
opposed
the
agenda
is
accepted
at
this
point.
We
have
public
comments.
This
time
has
been
set
aside
for
members
of
the
public
to
address
the
planning
commission
on
consent,
calendar
and
other
agenda
items
and
items
of
general
interest
within
the
subject
matter.
Jurisdiction
of
the
commission.
B
B
B
If
you
are
here
for
the
public
hearings,
2a2b2c
and
2d,
you
can
comment
now
or
wait
until
the
public
hearing
on
those
items.
Are
there
members
of
the
public
who
would
like
to
testify.
B
Can
we
have
roll
call
on
that?
Please.
C
Commissioner
irvin,
yes,
commissioner,
hershbein
yeah,
commissioner
lewin.
Yes,.
B
B
F
F
F
It
should
read
so
that
should
read
issue
have
the
addition
of
distilled
spirits
to
the
sale
of
beer
and
wine
from
the
bar
area
in
building
f.
So
again,
pln1
should
have
the
addition
of
distilled
spirits
to
it.
I
also
want
to
reference
your
attention
to
pln
9
hotel
guests,
so
staff
is
proposing
that
the
restaurant
shall
be
for
the
primary
use
of
hotel
guests
outside
patrons
patrons.
Not
staying
at
the
hotel
shall
be
limited
to
dinner
service
only
up
to
three
times
per
week.
F
That
condition
was
added
just
to
be
consistent
with
the
other
boutique
hotels
in
the
city.
However,
that
would
be
at
the
the
pleasure
of
the
commission,
if
you
so
choose
to
change
that.
That
would
be
at
your
pleasure,
so
real
quick
just
want
to
go
over
some
of
the
slides
that
I
have
here
for
you.
F
So
this
is
the
area
view
and
of
the
site
and
the
surrounding-
and
this
is
the
the
site
plan
and
the
flow
layout
of
the
site.
It's
been
like
that
for
a
while,
this
particular
operators
started
sparrows
hotel
in
2014
and
since
then,
we've
had
no
serious
call
for
service
at
the
location.
F
These.
These
are
pictures
of
the
site.
This,
a
very
recent
picture
that
was
actually
taken
today.
The
landscape
and
outside
of
the
hotel,
are
in
good
condition
and
so
again
with
that
staff
will
be
recommending
approval.
It
is
a
public
hearing
and
again,
staff
is
available
to
answer
any
questions
that
the
commission
may
have.
Thank
you.
C
Does
the
current
alcohol
license
or
cup
that
allows
beer
and
wine
also
prohibit
sales
to
non-hotel
guests?
Yes,.
F
It
is
primarily
limited
to
the
hotel
guest,
but
according
to
the
to
the
applicant
he
does.
He
did
mention
that
once
in
a
while
guests
do
have
guests
at
the
hotel
and
there
are,
but
primarily
it
is
for
the
hotel
guests.
C
No,
that's
not
what
I'm
asking
I'm
asking.
Does
the
current
cup
prohibit
the
sale
of
alcoholic
beverages,
beer
and
wine
to
non-hotel
guests.
F
So
going
back
to
the
old
conditions,
there
one
specific
reference
to
that.
However,
because
of
the
size
of
the
hotel,
specifically
because
of
parking
limitations,
it
was
only
limited
to
hotel
guests,
the
current
ceop
and
then.
C
Official
police
or
other
code
enforcement
officials
called
to
the
hotel
subject,
subject
being
rowdiness
due
to
alcohol
consumption.
Anything
like
that
has
there
been
any
problems
with
the
hotels
since
it's
been
operated
by
these
current
owners.
F
None
so
yeah
it
was
this.
This
request
was
routed
to
the
police
department
and
none
of
us
were
not
provided
with
any
reports
of
call
to
service
at
the
location.
C
F
No,
it
is
not,
but
again,
the
reason
why
that
was
added
is
to
be
consistent
with
the
two
other
boutique
hotels
of
the
same
size
within
the
city.
Those
two
actually
came
to
the
commission
within
the
last
couple
of
years,
so
staff
was
just
trying
to
be
consistent
with
the
other
boutique
hotels
of
this
size.
C
But
in
terms
of
outside
patrons
using
the
current
project,
not
any
other
project,
but
this
project
as
a
restaurant,
have
there
been
any
code
issues
or
legal
problems
or
or
other
issues
related
to
outside
patrons
using
that
restaurant.
F
E
F
So
there
are
two
of
them:
there
is
the
the
la
serena
and
the
holiday
house.
E
F
Well,
so
majority
of
them
do
not
have
the
type
47
abc
license
that
would
allow
them
to
sell
leeco.
E
B
There
being
no
other
questions
of
staff,
I'd
like
to
open
the
public
hearing,
the
applicant
has
10
minutes
and
for
staff.
Are
there
any
members
of
the
public
who've
asked
to
speak.
C
C
D
D
We
started
with
the
beer
and
wine
license
which
served
us
well
for
many
years,
based
on
feedback
from
our
guests,
combined
with
an
increasing
with
increasing
competition
from
other
boutique
hotels,
and
we
believe
now
that
we
need
a
full
liquor
license.
We
do
not
envision
anything
changing
from
a
day-to-day
or
practical
perspective.
D
B
C
D
From
a
practical
perspective,
we've
not
had
any
issues
and
the
way
that
there's
a
restaurant,
we
we
have
40
seats
at
our
maximum
capacity
and
the
hotel
is
20
rooms.
So,
assuming
you
know
two
gas
per
room,
you
know
that's
40.,
and
so
we,
our
first
priority
as
edward
mentioned,
is
always
for
our
hotel
guests
and
we
we've
we've
made
it
that
way
from
the
beginning,
and
it's
always
worked
out
very
well
in
the
event
that
on
a
particular
dinner
you
know
we
have
excess
space.
D
So
we
have
an
extra
few
tables.
We
open
it
up
to
the
public,
and
you
know
some
of
those
some
of
the
public
comes
from
by
taking
an
uber
or
lyft
some
walk
over
from
the
many
hotels
that
are
within
walking
distance
and
some
of
course
drive.
But
from
a
practical
perspective,
we
have
not
had
an
issue
with
parking
and
we
have
a
you
know.
We
have
a
limited
sized
kitchen,
so
we
can
only
do
so
much
and
we
also
like
to
keep
the
dinners
intimate
and
we've
always
done
that
voluntarily.
C
Thank
you,
first
of
all,
I'll
just
editorialize
and
say
I
really
love
your
your
operation.
I've
been
there
a
couple
times.
I
haven't
stayed
there,
but
I've
had
drinks
there,
and
I
I
have
no
problem
personally
with
the
addition
of
the
spirits,
but
I
wanted
to
ask
you
if
the
recommended
limitations
that
would
be
plm2
and
plm.
No
excuse
me
pln1
and
pln9.
C
If
you're
familiar
with
those,
would
would
impinge
on
your
ability
to
conduct
business,
because
I
I
I'm
not
in
favor
of
them
myself,
but
if
you're,
okay,
with
those
limitations,
I
you
know
I'll
vote
for
them.
I
just
was
wondering
what
view
was.
D
I
I
appreciate
the
question
and
and
certainly
appreciate
your
support,
I'm
sure
we're
okay
with
them,
we're
we're
okay
with
them.
We
can
live
with
that.
You
know,
of
course,
in
a
perfect
world
we
prefer
not
to
have
the
limitations,
but-
and
you
know
going
through
the
process
with
the
city,
I
think
it's
been
very
fair-minded
and
very
appropriate
and
so
we're
you
know
we're
we're
fine
with
the
limitation
of
that
three
times
for
a
week.
C
And
and
and
the
the
bar,
what
does
he
say
otherwise,.
D
I
actually
and
the
bar
and
my
understanding
and
and
I
can
go
back
and
check
with
this
with
the
abc
my
understanding-
is
we're
not
limited
to
hotel
guests,
currently
only
the
hotel
guest.
So
if
you
came
in
for
a
drink,
you
know
we
could
serve
you
or
if
someone
came
in
for
dinner
from
the
public,
we
could
serve
them
a
drink.
So
from
our
perspective,
you
know
we
would
like
to
continue
doing
what
we
currently
are
doing,
which
seems
to
have.
You
know,
been
working
out.
D
C
B
D
It's
a
good
question.
I
don't
know
at
the
moment
how
we
would
monitor
it.
I
think
you
know
from
a
practical
perspective
three
times
per
week,
someone
from
the
public.
That
would
be
a
little
bit
unusual
and
we
have
had
a
very
good.
You
know
track
record
with
with
dealing
with
things
you
know
at
all
of
our
hotels
and
monitoring
them
and
putting
you
know,
putting
procedures
in
place
to
address
them.
D
So
it's
a
good
question
the
answer
at
the
moment
and
but
I
I
will
assure
you
that
we
will
put
something
in
place
to
address
that
appropriately.
B
D
Commission,
no,
I
don't
have
anything
else
on
my
end,
thank
you
for
the
opportunity.
B
The
public
hearing
is
closed.
I
want
to
make
a
comment,
and
perhaps
emotion,
which
is
that
I
remember
holiday
house
los
serena
and,
I
think,
there's
another
hotel.
The
limitations
on
the
number
of
evenings
had
to
do
with
the
downtown
and
events
happening
in
the
downtown,
and
I
think
this
is
a
very
different
circumstance.
B
So
I
just
in
and
maybe
open
for
discussion.
I
I
would
like
to
make
a
motion
that
we
approve
this
excluding
the
language,
including
alcoholic
beverages
in
pln1
and
excluding
the
language
to
hotel
guests
only
and
I'd
like
to
strike
pln
9.
I
don't
see
why
we
should
prove
a
limitation
on
a
restaurant.
That's
been
doing.
A
very
good
job
has
a
great
track
record
and
at
least
for
discussion
purposes,
I'd
like
to
throw
that
out.
E
Could
you,
madam
chair,
could
you
restate,
are
you?
Are
you
striking
pln
1
and
pln
9
no.
B
I'm
striking
the
the
very
I'm
adding
to
pln1
the
language
that
staff
had
added
to
make
sure
that
alcoholic
beverages
are
included
in
pln1
or
distilled
spirits,
I'm
not
sure
exactly
how
they
phrased
it,
but
I
would
exclude
the
last
four
words
to
hotel
guests
only
so
I
would
strike
that
and
the
recommend.
The
second
recommendation
is
to
strike
pln
9
in
its.
C
Entirety,
this
is
malia.
This
is
maria's
home
chairwoman,
with
your
explanation
of
how
the
pl9
applied
to
hotels
are
actually
in
downtown.
I
appreciate
your
explanation
and
I
also
am
in
favor
of
your.
E
Yeah,
so
I
I'm
definitely
in
favor
of
the
amendment
to
pln
one
and
I'm
just
a
little
hesitant
on
pln
9,
given
that
the
applicant
is
okay
with
it
and
then
that
staff
was
kind
of
crafting
something
and
I
I'm
open
to
being
swayed.
But
is
it
something
that
that
we're
better
off
accepting
pln
9
now
and
waiting
a
little
bit
of
time?
E
E
B
So
I
would
like
to
ask
assistant
director
newell
if
he
would
like
to
respond
to
this.
A
Certainly
so
I
think
the
the
reasoning
as
principal
planner
robertson
mentioned
that
we
had
suggested
this
condition
was
to
ensure
that
we
have
a
consistency
with
with
other
operations
that
are
similar
when
we
looked
at
the
parking
situation
here,
we
have
one
space
per
unit
and
then
anything
and
that's
where
essentially,
it
complies
with
the
with
the
addition
or
the
operation
of
the
restaurant.
A
Then
we
start
creating
additional
parking
impacts
that
ultimately
would
end
up
flowing
into
the
neighborhood,
because
there's
no
parking
on
east
palm
canyon,
so
that
was
really
the
kind
of
the
the
basis
for
us
suggesting.
Well,
we
would
allow
a
limited
amount
of
restaurant
operation,
but
again
if
the
commission
feels
that
the
operation
currently
is
appropriate,
given
the
the
way
that
it
has
demonstrated
an
acceptable
operation
in
the
recent
past,
we
you
know
we
would
allow.
I
guess
we
would
be
okay
with
modifying
that
condition
to
an
extent.
B
B
Seeing
no
substitute
the
motion
dies,
the
original
motion
is
before
the
commission.
Can
we
have
roll
call
on
that.
B
G
G
The
applicant
has
submitted
a
site
plan
that
indicates
there
are
three
existing
buildings
on
this
property,
with
plenty
of
parking
located
in
the
center
of
the
industrial
park,
as
well
as
along
west
radio,
road
and
mccarthy
road.
Even
though
they're
not
delineated
in
the
site
plan,
there's
parking
along
those
streets
as
well.
G
G
These
are
some
existing
photos
of
the
tenant
space.
There's
no
exterior
changes
proposed.
This
is
just
an
example.
What
the
inside
looks
like
the
only
interior
tenant
improvements
proposed
will
be
expanding
the
restroom
to
make
it
ada
compliant
and
adding
some
shelves
and,
of
course,
the
two
stills
for
the
craft
distillery
process.
G
G
B
Okay,
thank
you
other
questions
I
have
won.
I
didn't
see
any
condition
that
it
operates
with
within
the
the
rules.
Are
there
rules
from
the
county
and
as
to
how
this
would
operate
and
is?
Are
there
any
conditions
regarding
the
safe
operation.
B
And
just
a
question
on
safety:
is
there
any?
Are
there
any
safety
issues
regarding
stills
that
we
know
of
or
you
have
researched?
G
Not
that
I'm
aware
of,
but
I'm
sure
that
with
their
tenant,
improvement,
building
and
safety
will
do
an
inspection
to
make
sure
everything's
safely
secured.
A
C
C
A
D
B
The
public
hearing
is
open
and
the
applicant
has
10
minutes
before
we
start.
Are
there
any
members
of
the
public
that
wish
to
speak
on
this
item?.
B
E
Good
evening,
everyone,
my
name,
is
robert
lanchester
speaking
on
behalf
of
the
modern
distillery,
madam
chair
commissioners,
planning
planners
and
staff.
Thank
you
for
taking
time
to
review
our
conditional
use.
Permit
application
for
the
modern
distillery
we'd
like
to
offer
a
special
thanks
to
alex
perez
who's,
been
our
primary
point
of
contact
for
the
planning
department
and
has
handled
our
application
with
great
diligence
and
responsiveness
at
the
modern
distillery.
E
C
Yes,
the
question
I
have
for
you
is:
how
many
distilleries
do
we.
E
Have
in
palm
springs,
there
is
one
other
distillery
that
we
are
aware
of
called
the
palm
springs
distillery.
We,
the
they're,
offering
a
two
gins
and
a
vodka.
E
E
E
E
The
absolutely
so
what
we
will
be
starting
with
are
distilling
and
adding
flavors
and
botanicals
to
what's
called
gns
grain
neutral
spirits.
So
it's
basically
pure
alcohol,
that's
purchased
and
then
blended
with
flavorings
to
create
the
final
product.
E
But
in
the
in
the
short
term,
it's
going
to
be
sort
of
reprocessing
pure
ethanol,
that
we
would
be
purchasing
and
does
it
have
any
type
of
a
smell
that
will
go
outside
of
the
building.
Not
that
not
that
we
are
aware
of
no
okay.
C
Commissioner,
thank
you.
Could
you
could
you
explain
for
the
people
who
are
coming
to
that
in
room?
What
kind
of
curve
appeal
was
your.
E
The
I
think
the
the
appeal
is
going
to
be
limited
to
the
interior,
given
that
we,
you
know
we're
going
to
be
renting
this
space
and
don't
want
to
invest
a
ton
into
you
know
exterior
modifications.
We
would
have
signage
that
would
go
through
the
appropriate
signage
approval
process
and
then
the
appeal
of
the
site
will
hopefully
be
in
the
the
finishings
and
how
we
how
we
create
the
ambiance
of
the
tasting.
C
Room
and
as
far
as
your
layout
goes,
the
restroom
is
located
in
the
distilled
production
area.
So
if
I,
if
I
were
one
of
your
paper,
would
it
would
it
be
safe
for
me
to
go
through
that
space
to
go
to
the
restroom.
E
Yes,
people
can
have
access
to
the
bonded
warehouse
space
as
long
as
they're
sort
of
limited
and
supervised.
E
There
would
be
nothing
you
know
they
would
have
obviously
have
clear
pathways
and
you
know
whatever
they
needed
for
access
to
the
restroom,
but
the
sorry
I
lost
my
train
of
thought
there,
the
you
know
the
the
space
itself,
the
the
distilling
space
itself
would
allow
for
customers
for
tours,
potentially
as
long
as
people
were
being
monitored
and
supervised.
C
B
E
Nothing
we're
aware
of,
but
we
would
of
course,
work
with
the
fire
department
on
any
considerations
or
constraints.
They
have
around
the
proper
handling
of
the
ethanol.
B
And
the
bathroom
issue,
the
sanitation
issue
with
the
public
coming
into
a
distillery,
that's
making
a
product
is
that
something
you've
looked
at.
E
B
E
I
think
our
expectation
is,
we
probably
won't
be
open
to
the
public
until
we've,
you
know
been
able
to
make
some
some
movement
on
on
covet.
Obviously,
if
that
extends
past
our
our
our
opening
date,
then
we
would
have
to
consider
that,
but
I
think
at
this
point
we're
planning
on
you
know,
certainly
the
next,
several
months
being
around
renovating
the
space
and
getting
things
up
and
running,
we
wouldn't
anticipate
the
tasting
room
being
open
until
spring
or
summer
of
next
year
at
the
earliest.
E
C
How
many
employees
do
you
plan
to
have
to
work
in
the
distillery.
E
Over
we've,
we've
tried
to
map
this
out.
Initially,
it's
gonna,
be
me
just
one
over
time.
If
we
are
successful
and
able
to
make
a
sustainable
business
of
this
within
five
years,
we
would
probably
have
about
five
additional
employees.
B
C
I've
visited
a
number
of
distilleries
in
portland.
They
have
a
pretty
extensive
craft
distillery
industry
there
and
they're
they're,
wonderful
and
the
tasting
rooms
are
great
and
it's
just
another
amenity
for
for
visitors
to
cities
such
as
ours.
So
I
I
can't
see
the
reason
why
I
would
not
support
this
request.
B
E
Just
like
sorry,
madam
chair,
please,
I've
had
the
same
experience
as
vice
chairman
rootsy.
I
think
I've
actually
always
hoped
for
a
craft
distillery
industry
to
get
built
in
the
city
of
palm
springs.
So
I
tip
my
non-existent
hat
to
you,
mr
lancaster.
I
hope
you're
successful.
I
hope
you
inspire
others
because
there's
a
it's
a
it's
a
wonderful
thing
when
you
experience
it
in
the
right
way-
and
I
hope
you're
very
successful-
and
I
hope
the
commission
supports
this.
B
And
question
for
both
of
you
does
that
include
the
condition
that
it's
subject
to
the
regulation
or
the
rules
of
the
county,
health,
commission
and
staff
can
reiterate
that
condition
that
they
that
they
said,
are
you
comfortable?
Are
you,
including
that
condition
yeah?
I.
C
A
Staff
would
just
note
that
all
distilleries
and
breweries
are
subject
to
county
environmental
health.
So
this
really
just
becomes
a
mechanism
in
rcup
or
condition
to
ensure
that
those
regulations
are
being
followed.
B
B
E
Well,
thank
you
so
much.
I
hope
that
once
this
coveted
situation
is
passed,
we'll
have
a
wonderful
opening
that
we
can
invite
you
all
to
don't
forget
to
do
that.
Promise.
E
B
Thank
you
moving
right
along
and
we're
just
going
to
five
o'clock,
so
this
may
not
be
quite
as
long
a
meeting
as
we
anticipated
to
see
the
core
corp
palm
springs,
llc
doing
business
with
out
or
an
amendment
to
an
approved
plan
development
just
complete
the
condominiums
in
a
122
to
122
apartment
units
and
a
revision.
Tentative
trap
stack
map
located
at
112,
east
chocolates,
canyon,
way,
zone,
reo,
section,
14.
H
The
unit
count,
as
I
mentioned,
was
105
condominiums
units
and
they're
requesting
to
convert
to
122
rental
units.
The
planning
department
considers
this
a
minor
amendment
to
the
original
plan.
Development
district
and
the
minor
changes
to
the
site
plan
include
increased
setbacks.
Parking
amenities
are
different
and
landscaping
is
changed.
H
So
when
looking
at
this
slide,
that
is
before
you
the
slide.
That's
on
the
left
is
the
originally
approved
plan
that
the
planning
commission
approved
several
years
ago.
The
one
on
the
right
is
the
new
proposed,
so
you'll
see
that
the
building
has
gotten
smaller.
It
has
decreased
in
size.
It
has
been
rotated
slightly
so
that
the
setback
on
tokowitz
has
been
increased.
H
Also.
Another
change
is
that
the
amenities
package
has
been
as
different
you'll
notice.
In
the
original
plan,
there
was
a
large
pool
that
was
on
the
west
side
of
the
building.
There
were
a
series
of
pickleball
courts,
a
large
green
area
to
the
north.
Those
have
been
changed,
there's
one
pool
now
in
the
in
the
new
plan.
H
H
Obviously,
with
this
design
you
would
not
be
able
to
add
solar
car
ports
to
the
roof.
I
would
like
to
point
out
that
additional
new
parking
has
been
added
in
this
area
here,
along
hermosa
and
along
the
entryway.
When
you
come
off
of
tacowitz
in
looking
at
the
building
architecture,
the
height
of
the
building
has
been
reduced.
H
Originally
the
height
was
34
feet.
The
new
design
lowers
the
building
to
31
feet,
6
inches
to
the
top
of
the
parapet.
The
elevator
shaft,
which
is
the
clad
in
stone
and
I'll
point
that
out
here
that
height
remains
the
same.
That
hasn't
changed,
although
the
overall
height
of
the
building
has
been
reduced
and
when
you
look
at
the
bottom
elevation,
what's
different
and
I'll
move
to
the
elevation
that
was
previously
approved,
you'll
see
that
the
bottom
ground
floor
has
apartments.
Now
we
moved
to
the
previously
approved
in
this
design.
H
So
looking
at
other
changes
to
the
building,
this
is
the
proposed
ends
of
the
building
that
will
face
tacowitz
here
and
then
hermosa
and
you'll
see
that
it
has
the
stone,
clad,
elevator
shafts.
It
also
has
the
balconies
that
wrap
the
building.
Also,
the
balconies
are
the
glass
that
we
had
just
looked
at.
H
Most
of
the
other
elements,
including
the
metal
screens
that
were
on
the
top
floor,
are
proposed
to
remain
so
in
looking
at
the
ends
of
this
building.
If
we
move
to
what
was
a
previously
approved,
you'll
see
that
they're
slightly
different,
the
red
sort
of
bumped
out
where
the
windows
are
is
what
was
originally
approved
and
what
they're
proposing
it's
slightly
different.
H
There
have
been
changes
to
the
design
of
the
second
and
third
floor,
so
in
order
to
increase
the
units
and
the
applicant
will
go
over
the
exact
how
they
came
with
the
increased
number
of
units,
but
some
of
the
internal
workings
of
the
building
have
changed
to
allow
a
greater
number
of
units,
they
will
be
one
one
bedroom
and
two
bedroom
units,
and
if
I
go
back
to
the
summary
one
of
vice
chairman
roosie
asked
that
we
add
a
comparison
from
the
originally
approved
to
what
they're
proposing
today.
H
So
if
you
look
on
the
left
hand
side
under
the
project
summary
here,
this
is
what
they're
proposing
now
the
building
total
square
footage
will
be
204
311
square
feet,
the
building
size
on
this
table
on
the
right.
This
was
that
this
is
what
is
approved.
The
building
size
was
231
thousand
square
feet.
H
H
The
retail
building
that
is
on
the
corner
is
not
proposed
to
change.
I
added
this
slide
just
to
remind
you
of
what
it
looks
like
it's
very
similar
in
design
to
the
rest
of
the
proposed
apartments
and
there's
also
a
discussion
of
a
track
map.
When
they
first
submitted
and
was
approved,
they
were
planning
on
dividing
the
lot
into
four
specific
lots.
H
Remember
that
this
project
was
approved
back
in
2018
since
then
the
2019
california
energy
code
has
has
changed
a
little
bit
and
has
made
it
more
clear
as
to
what
kind
of
wattage
we
could
possibly
get
for
these
systems
and
in
consultation
with
the
building
department.
Being
that
we're
we're
in
climate
zone
15,
each
dwelling
unit
will
be
required
to
provide
1.47
watts
per
square
feet
or
no
less
than
.08
for
all
common
spaces,
such
as
lobbies,
gyms
and
multi-purpose
rooms.
H
So
the
exact
numbers
per
what
is
difficult
to
determine
at
this
stage
being
that
construction
documents
haven't
been
approved,
so
staff
and
the
applicant
is
requesting
that
pln
be
changed.
To
say,
the
project
is
required
to
meet
the
2019
california,
energy
code
for
low-rise
residential
buildings
and
the
system
be
sized
based
upon
standard
set
forth
in
equations
used
to
determine
the
proper
number
of
watts
per
unit,
so
we're
removing
the
two
watts
per
square
foot
and
making
it
consistent.
What
the
california
building
code
requires.
H
So
staff
recommends
that
you
determine
that
the
amendment
is
consistent
with
the
original
that
the
development
stanza
standards
are
substantially
in
conformance
and
the
conversion
of
the
apartments
will
increase
the
rental
housing
stock.
So,
as
I
mentioned,
staff
recommends
approval.
The
final
plan
development
will
return
to
the
planning
commission
and
then
the
aac
will
review
the
final
landscape
plan
so
chair.
That
concludes
my
report
and
the
applicant
will
be
available
to
zoom
in.
E
Thank
you,
madam
chair.
I
had
to
find
my
unmute
button
there
I'd
like
to
ask
a
couple
of
quick
questions
of
staff
back
in
the
old
days,
and
I
recognize
this
may
be
different.
Now
pdds
were
supposed
to
have
some
kind
of
public
benefit.
E
H
If
I
could
get
the
slides
back
up,
so
the
public
benefit
has
not
changed
and
I
didn't
discuss
it
because
it
hasn't
changed.
There
is
a
public
park
that
is
being
added
and
let
me
go
back
to
it
I'll
point
to
it
right
here
at
the
corner
of
hermosa
in
takowitz
there
is
a
public
park
that
was
added,
it'll
have
a
bench,
a
water,
fountain
and
other
features
that
will
be
pedestrian
friendly.
H
Also,
there
was
long
discussion
about
a
bus,
stop
that
is
being
placed
along
tacowicz,
so
those
public
benefits
have
not
changed
and
there
will
move
forward
with
the
new
design.
H
Right,
so
when
we
look
at
public
benefit,
we
we
make
it
consistent
with
what
the
request
was
and
the
reason
why
they
needed
a
planned
development
district
was
because
they
wanted
to
have
this
retail
building
be
able
to
support
pet
services
like
dog,
grooming
and
kennel.
H
No,
that
was
that
is
under
your
purview.
It
was
laid
out
in
the
original
conditions
of
approval
as
to
and
we
have
seen
design
plans
and
I
don't
have
them
on
the
slideshow.
But
we
do
have
a
close-up
of
what
they're
proposing.
E
Will
there
be
well?
I
guess
we'll
get
a
chance
to
see
it
again.
I
I
would
like
to
know
that
the
public
park
has
amenities
that
either
include
playground
or
exercise
equipment,
adequate
shade,
and
things
like
that.
So
I'm
sharing
that
I
don't
want
to
grill
you
glenn
right
now,
but
I'm
sharing
that
with
my
fellow
commissioners.
E
I
had
a
couple
other
questions
for
you.
I
see
that
they're
removing
what
looked
like
a
beautiful
and
very
large
pool
on
the
west
portion
of
the
lot
and
retaining
a
or
redesigning
a
much
smaller
pool
on
the
other
wing.
Two
two
questions
for
you:
when
are
apartment
buildings
required
at
all
to
have
swimming
pools.
Is
that
a
requirement
in
any
way.
H
It's
not
a
requirement
it.
It
was
part
of
the
amenities
package
for
the
approval
of
the
planning
commission,
so
the
applicant
will
be
able
to
explain
the
changes
to
the
amenities
package,
including
the
pool
in
the
west
side.
There
were
pickleball
courts
that
were
in
the
original
that
are
being
eliminated,
so
there's
a
different
scale
of
amenities
that
the
applicant
feels
luxury
condos
versus
the
apartments
he's
proposing
to
offer.
H
It's
part,
it's
usually
part
of
the
amenities
package,
especially
when
it's
a
large
development
like
this
with
the
plant
development
district.
E
C
C
Thank
you.
I
have
a
couple
questions,
so
you,
the
staff
report,
is
proposing
to
amend
the
requirement
of
watts
per
square
foot
from
2.0
to
1.47.
Is
that
what
you're,
what
you
indicated.
H
That
is
what
the
california
building
code
is
stating
we
we
don't
know
the
exact
number
until
the
the
plans
are
finalized.
The
constructing
construction
documents
are
finalized,
so
it's
based
upon
the
unit
space
and
then
the
common
area
space.
So
the
common
area
space
is
at
a
lower
calculus
than
the
units
themselves.
C
Now
I
understand
that,
but
are
we
is
planning
commission
allowed
to
impose
a
higher
standard
in
terms
of
watts
per
square
foot
on
a
project.
H
That's
correct
and
my
understanding
is
that
they're
they're
maxing
out
the
roof
space
that
they
could
possibly
fit
as
many
panels
on
the
roof.
As
you
can
see,
it's
it
they're
they're
long
and
thin
the
roof
surfaces
so
and
they
may
be
able
to
address
that
better
than
I
can.
C
Okay.
But
but,
as
you
indicated,
the
shade
structures
don't
allow
for
for
the
proposed
shade
structures,
don't
allow
for
for
panels.
H
The
design,
as
you
can
see,
is
a
curved
design
it
to
me.
It
would
not
allow
all
panels.
C
Right,
that's
the
proposed
design,
okay.
Secondly,
oh
I
would
just
like
to
let
commissioner
lewin
know.
I
I
think
park
is
kind
of
stretching
the
definition
of
what
a
park
is
it's
more
like
a
plaza
out
in
front
of
that,
a
small
retail
building,
that's
supposed
to
be
a
a
pet
store
and
there
were
a
couple
of
amenities.
There
was
a
as
glenn
said:
there
was
a
drinking
fountain,
a
bench
a
tree.
It
didn't
really
go
beyond
that
and
then
I
wanted.
C
H
H
The
resolution
letter
g
yeah
and
then
under
planning
commission
resolve
section
two.
C
Okay,
yeah.
Okay,
thank
you.
B
There
being
no
other
questions,
we
will
open.
The
public
hearing
is
the
applicant
present
and
are
there
members
of
the
public
who
wish
to
speak.
A
Madam
chair,
yes,
there,
the
afghan,
is
present
on
the
meeting
as
well.
We
do
not,
and
also
to
respond
to
your
second
question.
We
do
not
have
anyone
else
who
has
requested
to
speak.
I
I
Madam
chair
commissioners,
thank
you
for
this
opportunity.
I
I
want
to
first
address
why,
but
what's
causing
this
change
from
a
condominium,
a
luxury
condominium
project
to
a
more
of
an
apartment-style
project,
but
it's
still
in
the
same
context
of
a
senior
project
and
addressed
to
the
lgbt
community.
It's
really
a
difference
of
economics,
as
opposed
to
a
difference
in
project
we
found.
I
Even
though
we
had
tremendous
interest-
and
we
had
you-
know
20
deposits
out
of
105,
we
had
30
wait
lists.
You
know
the
lenders
were
getting
very
nervous.
In
addition,
the
cost
of
building
a
condominium
project-
I've
learned,
is
increased
substantially
because
of
homeowner
association,
lawsuits
and
and
the
likelihood
of
litigation,
and
why
you
can
buy
a
an
insurance
policy
to
cover
those
lawsuits
which
cost
in
excess
of
a
million
dollars.
I
I'm
just
collecting
money
monthly,
as
opposed
to
all
at
one
time,
from
a
from
a
sale,
and
so
the
resulting
changes
came
about
because
in
in
a
senior
housing
apartment
model,
you
don't
have
to
offer
exactly
the
same
kind
of
things
that
you
do
with
a
luxury
condo.
Where
you're
asking
for
substantial
dollars
up
front,
so
the
parking
was
the
the
primary
change.
I
I
I
I
don't
need
two
pools
for
for
an
apartment
project,
although
the
pool
that
we
will
ultimately
design
will
have
both
the
features
of
being
able
to
be
a
lap
pool
and
a
resort
kind
of
pool.
It
will
be
a
a
hybrid
pool.
So
that's
where
the
changes
came
from
the
pickleball
courts
came
from
the
fact
that
my
business
partner
lived
out
in
indian
wells
and
they
have
pickleball
thoughts
and
he
said
well
they're
popular.
They
are
so
noisy
that
they
were
really
a
terrible
amenity
for
the
residents
of
his
place.
