Description
Regular City Council Meeting - 5/19/2021
D
B
A
B
B
nancy
and
I
were
were
knighted
on
saturday
morning
from
the
royal
order
of
ponce
de
leon
conquistadors,
and
so
I
just
thought
it
would
be
fun
to
have
this
for
a
minute.
But
now
that
I
have.
B
Now
that
I
have
hat
hair,
we
won't
do
that
anymore,
but
we
want
to
thank
the
conquistadors
for
their
fun.
We
had
a
little
fun
with
them
on
saturday
and
we
thank
them
for
igniting
us
with
our
new
helmets
and
now
joha.
We
all
three
of
us
have
one
okay,
so
I'd
like
to
call
this
meeting
to
order
and
let
the
record
reflect
all
city,
council,
members
and
city
officials
are
present
or
in
the
building.
If
you
please
stand
and
join
me
for
the
invocation
followed
by
the
pledge
of
allegiance,
shall.
E
We
thank
you,
lord
for
this
council
and
we
pray
that
as
they
go
through
this
meeting
today,
that
each
decision
that
they
make
be
pleasing
to
you
and
the
people
of
point
of
order,
it's
in
the
lord's
name.
We
pray.
D
B
Thank
you,
carlo.
Okay,
we'll
begin
the
meeting
with
public
comments.
You
if
you
would
like
to
address
the
city
council
on
any
matters
that
are
on
the
agenda
today.
Please
come
forward
state
your
name,
and
you
have
three
minutes,
and
if
you
sent
a
letter
before
the
meeting,
you
would
either
be
able
to
have
us
read
the
letter
into
record
or
you
can
speak
to
the
city
council,
but
not
both.
So
please
indicate
if
you
come
to
the
podium.
If
you
have
already
sent
a
letter
to
us,
any
citizens
comments.
F
Good
morning,
city,
council
and
mayor
I'm
bill
dryberg,
I'm
here
representing
the
the
board
of
realtors,
as
their
president
are
all
1600
members.
I
know
we've
come
to
an
impasse
on
on
the
sign
orders
when
it
comes
to
opposite
open
houses,
and
I
know
that
our
industry
caused
that
to
come
about.
I
rarely
admit
that,
and
obviously,
with
the
signs
being
neutral,
maybe
it's
time
that
our
industry
looks
at
it
at
a
different
way.
F
So
I
offered
to
you
this
morning
something
that's
content
neutral,
and
that
is
a
sign
that
I
showed
you
before
the
only
difference
be
is
it
will
have
no
writing
on
it.
It
will
only
have
the
hibiscus
and
then
our
agents
then
can,
as
in
their
part
of
advertising,
will
strictly
tell
them
look
for
the
hibiscus
sign.
F
F
F
The
problem
is
before
you
today.
Most
of
others
understand
how
the
law
works,
put
their
signs
out
that
we
picked
them
back
up
again,
but
we
had
some
that
don't
and
one
of
the
biggest
offenders
unfortunately
was
not
even
from
here.
They
were
from
venice
and
they
put
out
eight
signs
for
a
single
open
house
and
that's
sad,
but
but
I'd
like
to
work
with
you
all,
hopefully
something
like
that
would
work
for
our
industry
as
well.
B
G
Mayor
for
my
yes,
mr
driver,
where
would
that
sign
be
proposed
to
be
placed,
and
are
you
saying
in
the
city's
right-of-way.
F
Well,
we
could,
or
we
could
work
with
homeowners
who
have
a
lots
in
the
area
where
we
could
put
it
up
on
on
their
lot
that
we
proposed
that
was
before
here
in
the
city.
You
know,
unfortunately,
this
is
the
this
has
been
12
years
and
coming
the
first
time
I
stood
before
you
all
and
that
the
podium
over
there
was
12
years
ago
and
now
we're
back
at
it
again.
But
in
interim
in
between
there,
I
think
about
the
six
year
mark.
F
We
agreed
we
could
have
open
house
signs,
but
they
had
to
be
on
somebody's
property
with
their
with
their
approval
and
not
on
the
right-of-way.
F
G
The
code
as
it's
proposed
would
allow
a
sign,
such
as
that
to
be
placed
on
private
property,
with
the
consent
of
the
owner
and
counting
towards
one
of
the
four
signs
that
they
would
otherwise
be
permitted
on
their
property.
So
there
wouldn't
be
any
really
need
to
change
the
proposed
draft
to
accommodate
that
sign.
Under
those
circumstances,.
B
G
Why
I
just
wanted
to
clarify
mr
driver's
request.
H
Good
morning,
mayor
and
city
council,
I'm
sam
sanders,
I'm
a
realtor
in
charlotte
county
have
been
for
a
long
time,
and
I
know
the
issue
I
live
in
bernstein
meadows,
I've
seen
it
I've,
seen
it
abused
and-
and
I
applaud
you
for
bringing
it
back
up-
and
I
like
bill's
idea,
I'd
like
to
have
something
out
there,
but
you've
been
extremely
tolerant
with
our
industry
and,
like
bill
said
most
of
us
locally.
I've
been
adhering
to
it,
but
we
get
some
that
just
are
clueless.
H
B
Okay,
is
there
anyone
else
that
would
like
to
speak
to
the
council,
okay,
seeing
no
one
else,
mr
murray,
I
believe
you
have
a
couple
of
letters
to
read
into
the
record.
I.
I
Do
I
just
took
a
big
drink
of
coffee,
so
we're
ready
to
go
first,
we
have
from
kathy
and
tom
fixmer
and
it
states
please
do
not
consider
our
sign
ordinance
for
punta
gorda
to
become
as
polluted
as
those
in
p
dot
c
dot,
and
I
wasn't
sure
what
that
was,
but
charlotte
port
charlotte
there
we
go,
didn't
define
it.
Thank
you.
We
do
not
need
larger
signs.
We
do
not
need
more
and
more
signs.
Please
consider
this
my
plea
to
not
increase,
sign
and
or
number
of
signs
allowed.
I
Then
we
have
kenley
george
from
pgi,
says
good
morning.
The
new
proposed
sign
code
is
a
restriction
on
free
speech,
defining
fight
speech
and
indecent
speech
is
open
to
interpretation,
even
as
it
attempts
to
narrowly
define
it,
such
as
in
the
supreme
court
decision
in
2015,
because
content
based
laws
target
speech
based
on
its
communicative
content.
I
The
same
is
true
for
laws
that,
through
facially
content
neutral,
though
facially
content
neutral,
cannot
be
justified
without
reference
to
the
content
of
the
regulated
speech
or
were
adopted
by
the
government.
Because
of
disagreement
with
the
message
conveyed
b,
the
sign
code
is
content
based
on
its
face
that
defines
the
categories
of
temporary
political
and
ideological
signs
on
the
basis
of
their
messages
and
then
subjects
each
category
to
different
restrictions.
The
restrictions
applied
thus
depend
entirely
on
the
signs
communicative
content,
because
the
code
on
its
face
is
content-based
regulation
of
speech.
I
There
is
no
need
to
consider
the
government's
justifications
or
purposes
for
enacting
the
code
to
determine
whether
it
is
subject
to
strict
scrutiny,
see
none
of
the
ninth
circuit's
theories.
For
its
contrary,
holding
is
persuasive
its
conclusion
that
the
town's
regulation
was
not
based
on
a
disagreement
with
the
message
conveyed
skips.
The
crucial
first
step
in
the
content.
Neutrality
analysis
determining
whether
the
law
is
contra
neutral
on
its
face.
I
A
law
that
is
content
based
on
its
face
is
subject
to
strict
scrutiny,
regardless
of
the
government's
benign
motive,
content,
neutral
justification
or
lack
of
animus
towards
the
ideas
contained
in
the
regulated
speech.
Thus,
an
innocuous
justification
cannot
transform
a
facially
content-based
law
into
one
that
is
content
neutral.
A
court
must
evaluate
each
question
whether
a
law
is
content
based
on
his
face
and
whether
the
purpose
and
justification
for
the
law
laws
are
content-based
before
concluding
the
law
is
content.
Neutral
word
does
not
require
otherwise,
for
its
framework
applies
only
to
a
content
neutral
statute.
I
The
ninth
circuit's
conclusion
that
the
sign
code
does
not
single
out
any
idea
or
viewpoint
for
discrimination
conflates
two
distinct
but
related
limitations
that
the
first
amendment
places
on
government
regulation
of
speech,
government
discrimination
among
viewpoints
is
a
more
blatant
and
egregious
form
of
content
discrimination.
Thank
you.
That's
three
minutes.
I
You
get
the
opinion.
The
point
I
believe
from
thank
you.
That
was
a
lot
of
big
words,
so
we
have
one
from
julie,
mcgillivray
that
states.
I
I
Semi-Permanent
signs
on
their
neighbor's
property
going
will
be
the
days
of
nicely
landscaped
lawns
unadorned
with
the
helter
skelter
of
political
and
ideological
signage.
Effectively.
Online
social
media
wars
will
visually
manifest
onto
our
front
lawns
and
flagpoles
visual
pornography
intended
to
harass
others
or
promote
anything.
But
the
common
good
punta
gorda
has
a
history
of
strong
community
ties
and
racial
tolerance.
This
sign
ordinance
plan
serves
to
dismantle
that
allegiance
and
precedence.
We
move
to
pgi
due
to
its
beauty
and
community
standards.
Future
residents
won't
be
so
lucky.
I
This
new
ordinance
plan
will
destroy
our
local
control
in
favor
of
an
overreaction
to
a
lawsuit.
Far
away.
Our
city's
legal
interpretation
for
conforming
to
an
out-of-state
sign
law
is
wrong.
It's
giving
to
cover
the
force's
intent
on
separating
our
community
and
dividing
us
up
under
this
legislation.
Flags
up
to
four
by
six
will
be
allowed
to
fly
year
round
unabated.
Remember
the
days
when
real
estate
signs
the
size
of
a
recipe
card
going
in
favor
of
up
to
four
signs,
modestly
located
10
feet
from
the
street.
I
Who
will
interpret
what
content
is
vulgar
or
intimidating?
Will
there
be
a
new
signs
about
czar?
We
ask
that
you
do
not
adopt
the
modification
to
the
existing
sign
ordinance.
Please
stand
up
to
outside
forces
and
a
misguided
legal
interpretation
intended
on
hurting
our
community
standards
and
spirit.
I
The
next
we
have
is
from
robert
and
debbie
troyes,
I'm
writing
to
express
my
displeasure
with
any
changes
to
the
city's
current
flag
sign
ordinance.
I
am
a
permanent
resident
city
resident
a
layman
and
do
not
have
much
knowledge
of
what
federal
or
city
law
currently
allows.
What
I
do
know
is
that
I'm
very
pleased
with
how
the
city
currently
looks
in
terms
of
what
we
allow
to
hang
and
post
regarding
signs
and
flags
and
associated
sizes.
I
believe
we
are
opening
a
large
can
of
worms
here
with
any
new
proposal.
I
I
What
about
political
flags
that
remain
up
for
extended
durations
regarding
flags?
What
is
actually
considered
a
flag
is:
there's
anyone
hung
from
a
pole
what
about
those
hanging
from
a
small
metal
rod,
garden
flag
size?
What
about
those
used
in
front
of
commercial
establishments?
They
can
be
considered
flags
and
will
meet
size
requirements.
Do
we
want
those
in
front
of
homes
flowing
about
all
night
in
the
wind
we
all
bought
homes,
condos,
etc
and
pg,
because
of
its
beauty?
I
Part
of
that
comes
from
our
current
laws
to
keep
it
that
way,
allowing
more
signs
flags
will
take
away
from
all
this.
I
believe
we
need
to
keep
our
current
ordinance
with
the
exception
of
anything
regulated
by
federal
law.
As
you
know,
one
of
the
biggest
problems
the
city
faces
are
complaints
about
signs
loosening
the
regulations
is
not
the
answer.
Apparently,
people
don't
like
to
see
them
it's
if
more
education
and
enforcement
is
needed,
so
be
it
and
the
last
from
nancy
mcclary.
I
It
says
sorry,
I
can't
be
there
in
person
for
tomorrow's
meeting,
but
I'm
totally
against
the
new
signage
recommendations.
Four
signs
per
lots
is
outrageous,
and
the
sign
will
degrade.
The
value
size
will
degrade
the
value
of
the
properties.
Nearby.
We've
lived
well
with
the
current
law,
as
they
say,
if
it
ain't
broke,
don't
fix
it.
Thanks
for
listening
and
obviously
many
of
these
questions
are
addressed
in
the
current
ordinance
and
will
be
during
discussion,
complicated
subject
that
you've
certainly
had
a
lot
of
time
to
deal
with.
B
Okay,
thank
you.
Okay.
We
have
two
proclamations
today,
but
let
me
first
start
by
saying
I'd
like
to
acknowledge
police
appreciation
week,
which
was
last
week,
and
I
would
like
to
congratulate
all
of
our
first
responders
and
our
punta
gorda
police
department
for
all
their
diligent,
hard
work
and
and
keeping
people
safe
in
our
community.
B
They
are
all
very
much
respected
and
we
certainly
certainly
give
them
a
lot
of
kudos
for
all
their
wonderful
things
they
do
in
in
spite
of
having
a
very
difficult
job
in
the
latest
climate
we're
living
in.
So
thank
you
to
the
police
department.
Our
first
proclamation
today
is
for
the
healing
feel
of
field
of
honor.
This
is
a
proclamation
for
the
city
of
punta
gorda
florida,
whereas
the
men
and
women
who
serve
and
have
served
in
the
armed
forces
of
the
united
states.
First
responders.
B
Now,
therefore,
the
city
council
of
the
city
of
punta
gorda
florida
does
hereby
proclaim
memorial
day
weekend
from
may
28
to
31
2021
as
healing
field
of
honor
weekend
past
and
duly
adopted
in
regular
session.
This
19th
day
of
may
2021
signed
lynn,
matthews,
mayor
and
allison
burch
is
going
to
receive.
Thank.
J
K
Good
morning
and
thank
you
mayor
and
thank
you,
city
council,
I'm
very
proud
to
be
here
representing
the
puna
gorda
rotary
club
to
accept
this
proclamation,
and
I
invite
everyone
in
the
community
to
please
come
out
over
next
weekend
and
see
this
stunning
display.
We
will
have
500
united
states
flags
flying
at
lashley
park
and
each
flag
represents
a
hero.
So
what's
really
nice
is
people
come
out
and
the
event
is
free
and
open
to
the
public.
K
But
as
people
come
out
and
admire
the
flags,
they
can
walk
through
the
rows
and
see
who
purchased
the
flag
and
who
it
is
in
honor
of
so
it's
it's
going
to
be
a
very
moving
tribute.
We
are
very
excited
about
it.
We
have
an
opening
ceremony
planned
for
friday
may
28th
at
10
a.m
and
at
the
conclusion
of
that
ceremony,
which
will
be
very
short
about
20-25
minutes.
So
we
hope
you
can
all
come
out.
We'll
have
a
flyover,
so
we'll
have
some
planes
flying
by
from
the
gulf
coast
raptor
club.
K
B
J
D
J
D
H
I
Ahead,
if
I
may
just
to
add
to
that
proclamation,
certainly
it's
nice
that
the
council
has
issued
this
proclamation.
But
I'd
just
like
to
mentioned
that
the
council
also
is
very
adamant
about
safe
boating
and
the
safety
of
our
canals
and
really
does
more
than
just
issue
the
proclamation
by
your
support
and
by
your
very
comments
on
things
like
speed
in
the
canals
and
safety
when
it
comes
to
the
pilings
that
may
need
painted
or
reflective
tape
or
encroachments
on
the
seawalls.
I
We
are
looking
at,
and
staff
has
come
up
with
some
ideas
where
we
can
increase
patrols
in
our
canals
to
add
to
the
safe
boating
for
our
residents.
We
would
be
able
to
use
some
of
our
volunteer
forces
and
provide
some
support.
That
would
allow
not
only
support
for
things
like
speed
enforcement
or
at
least
being
able
to
be
there
to
monitor
that,
but
also
the
code
issues
that
may
hinder
safe
boating,
especially
in
nighttime
hours.
So
we
do
have
a
program
that
we'll
be
discussing
in
the
upcoming
weeks.
I
Hopefully
that
could
help
facilitate
that,
and
we
certainly
appreciate
the
support
that
the
council
has
provided
to
ensure
that
we
do
have
safe
boating,
not
only
in
our
harbor
and
inlets,
but
in
the
canals
themselves,
and
we
look
forward
to
helping
increase
the
the
safety
that
the
residents
see
as
they
navigate
our
waterways.
So
thank
you
for
the
support
you've
provided
in
that.
M
Cj
metcalf
here,
a
resident,
full-time
resident
of
puna
gorda
sometime
back
our
city
manager,
howard
kunick,
was
preparing
to
exit
our
city
and
our
council
had
the
undaunting
task
of
seeking
and
searching
for
a
new
city
manager,
and
I
know
the
hours
you
all
put
into
it
and
the
reading
the
research
the
reaching
out
the
interviews
and
I've
got
to
tell
you
you
guys,
went
over
the
top
when
you
found
our
city
manager
greg
murray.
Thank
you
thank
you
for
finding
him.
M
So
shortly
thereafter,
there
was
a
ceremony
held
at
pgica
in
which
howard
kunik
was
going
to
pass.
Well,
he
did
pass
the
key
to
the
city
over
to
our
new
city
manager,
greg
murray,
and
I
sat
there
with
just
such
anticipation,
because
a
key
to
the
city
is
it's
such
an
honorable
token
it
it
is
given
to
someone
that
we
trust
and
howard
stood
up
there
with
his
paper
bag.
M
And
he
pulled
out
this
key,
and
that
was
the
drabest
thing
I've
ever
seen
in
my
life
and
when
he
said
that
he
found
it
in
the
bowels
of
the
basement.
I
was
like,
oh
my
god.
M
Probably
a
dollar
59
someone
tried
to
make
an
attempt
to
make
that
ugly
elephant
look
better,
but
so
shortly
thereafter,
I
asked
mr
murray,
if,
if
I
may
take
possession
of
his
key
for
a
while
and
it
has
been
a
while,
but
today
I
am
here
with
the
help
of
my
husband
who
I
had
to
ask
some
honeydews
on
this
to
present
to
the
city,
city,
council
and
our
city
manager,
a
gift,
a
donation
from
my
husband,
and
I
hopefully
you
won't
misplace
this
one
in
the
basement.
M
So
today,
I'm
going
to
I'm
going
to
present
to
our
city
manager,
the
refurbished
key.
I
H
I
I
M
It
so,
as
I
said,
hopefully,
this
one
won't
get
lost
in
the
basement.
A
I
D
I
Could
you
take
one
if
they
stand
that
way
with
council,
just
in
the
background,
why.
P
I
I
can
do
that.
I
can
certainly
help
you
get
it
up
to
the.
B
M
A
D
M
One
more
thing,
just
real
quick,
not
that
I
want
to
toot
horns
I'll
go
ahead.
That
is
an
estate
frame,
and
I
don't
know
if,
if
it's
okay,
to
talk
dollar
value
donations
or
not,
I
don't
I
don't
know
but
say
whatever
you
want.
C
C
M
Okay,
anyway,
frames
by
fred,
gave
me
an
estimated
value
on
the
frame
itself.
Have
you
guys
had
any
framing
done
anyway,
1800
on
the
frame
itself
yeah?
M
M
No,
but
I
hope
it
has
a
lot
of
dust
on
it
before
it
ever
gets
used
again.
I
Indeed,
the
new
city
hall
coming
certainly
we'll
be
able
to
store
this
in
a
place
where
we
can
make
good
use
of
it.
B
B
Okay,
we're
going
to
continue
on
with
the
rest
of
the
meeting
next,
if
there
are
any
members
of
the
audience
who
have
submitted
a
resume
for
a
border
committee
and
you'd
like
to
introduce
yourself
to
council,
please
come
to
the
podium
and
you
have
three
minutes
to
introduce
yourself
anyone
in
the
audience:
okay,
seeing
none!
B
If
it's
okay
with
everyone
here,
I
would
like
to
move
item
number
5b
up
and
do
that
now
before
we
do
all
the
public
hearings.
I
know
we
have
some
people
in
the
audience
that
are
here
for
that
hearing,
and
does
anybody
have
an
objection
to
that.
N
D
B
G
And
before
lisa
makes
her
presentation
I'd
like
to
set
the
stage.
Procedurally,
this
is
a
purely
discretionary
act
by
the
city
council
as
to
whether
to
grant
the
request
for
the
extension
doesn't
require
public
hearing
and
doesn't
require
the
same
type
of
quasi-judicial
consideration
that
the
original
special
exception
required.
Thank
you.
O
Lisa
good
morning,
lisa
hannon
zoning
official.
We
received
additional
information
which
was
included
in
your
packet
for
consideration
at
council's
request
from
two
meetings
ago.
So
again,
staff
is
just
recommending
approval
of
the
one
year
extension.
But
again
it
is
at
the
discretion
of
city
council,
the
applicant
and
their
representatives
are
here
for
any
questions.
B
B
Okay,
yeah.
Okay,
would
you
have
comments
for
the
applicant
that
you
would
like
addressed.
C
Well,
I
yeah.
I
would
like
to
hear
from
the
the
person
who's
responsible
for
all
of
the
resort
properties.
C
In
this
I
we've
heard
from
patty
allen,
who
I
I
greatly
respect,
and
I
know
we
all
do
who's
the
gm
ford
fisherman's
village
themselves,
but
we
haven't
heard
from
anyone
who's
really
directly
responsible
for
the
properties
in
751,
and
you
know,
as
I
look
at
751
it's,
it's
really
falling
into
disrepair,
much
beginning
to
look
a
lot
like
900
west
marion,
and
it
concerns
me
greatly
because
you
know
I
think
of
reda
esplanade
is
an
iconic
street
of
beautiful
homes,
large
and
small,
that
it's
a
stately
street
and
it's
it's
one.
C
That's
much
photographed
in
our
community
and
to
see
this
house
that
is
the
fence
is
falling
apart.
The
vegetation
is,
is
dead.
You
know
it
used
to
have
beautiful,
yellow
alemanda
blooming
on
the
fence
and
was
just
very
stately.
C
Looking
and
and
the
landscaping
that's
live,
needs
a
lot
of
trimming
and
pruning,
and
it
just
needs
a
lot
of
tlc,
and
so
it
greatly
concerns
me
that
you
know
I
just
don't
know
what's
going
on,
and
I
feel
I
feel
that
as
city
council
as
much
as
patty
always
communicates
with
us
and
and
always
you
know,
if
you
have
any
questions,
ask
me
and
but
I
I
really
hate
to
put
that
burden
on
patty
when
I
realized
that
you
know
she's,
the
gm
of
fisherman's,
village
and-
and
there
is
the
the
management
of
the
resort
properties
is-
is
not
part
of
her
responsibility.
Q
That
would
be
me:
brittany,
williamson,
I'm,
the
director
of
development
for
archeterra
and
all
the
puna
quarter
properties.
I
live
just
down
the
street
on
gill
street
downtown.
Q
We
have
been,
I
mean
we
were
in
the
middle
of
season,
so
we
weren't
able
to
get
some
of
the
repairs
done.
But
if
you
go
over
to
the
property
now,
we've
completely
renovated.
The
cottage
house
we've
met
with
the
fire
marshal
on
may
7th
to
have
the
fire
system
installed
and
the
summer
the
landscaping
project
is
slated.
Q
C
C
Q
We
have
to
install
all
interconnected
fire
alarm
systems
which
will
require
taking
out
some
of
the
drywall
inside
so
that
june,
to
august
timeline
gives
us
the
time
for
the
fire
alarm
system
to
get
in
there
and
then
our
construction
subcontractors
to
go
back
and
repair
drywall
paint,
and
then,
between
july
and
september,
we're
tentatively
scheduling
we're
going
to
start
the
state
requirements.
Once
we
have
the
fire
alarm
system,
the
landscaping
july
october,
we'll
probably
do
some
bathroom
renovations
and
then,
after
that,
we
have
to
find
someone.
B
C
O
Yes,
lisa
and
it's
only
official
yes,
if
they
have
a
permit
and
how,
if
they
have
a
permit
building
permit
for
renovation,
they
can
continue
on
with
the
special
exception.
You
either
need
the
use,
the
license
for
the
use,
a
permit
in
place
or
a
co
and
be
operating
at
it
as
the
bed
and
breakfast
or
it
does
expire.
The
use
terminates.
Q
So
we
will
have
to
pull
a
permit
for
the
fire
system,
which
we
will
do
our
fire
contractor
will
do
that,
but
the
interior
renovations
that
we've
been
doing
painting
you
know
replacing
tile
doesn't
require
a
permit,
so
there's
no
reason
to
pull
a
permit.
Q
B
Speaking
personally,
we've
had
two
years
to
get
this
started,
and
nothing
has
been
done
at
this
point.
Nothing
visible
anyway
to
the
human
eye.
B
I
have
to
say
I
kind
of
agree
with
nancy
in
terms
of
west
redda
is
an
iconic
street,
but
I
think
just
as
importantly,
all
the
residents
on
west
reda
really
take
very
good
care
of
their
properties
and
keep
them
in
very
good
working
order
and
when
it
was
owned
by
its
previous
owner,
that
property
was
meticulously
maintained
and
we're
not
seeing
that
now
and
I
think
we
pressure.
B
Right,
you
know
I,
I
we
get
complaints
as
council
members,
we
get
complaints
about
these
projects
when
they
don't
get
done,
and
we
I
mean
just
like
we
get
numerous
complaints
about
the
property
at
900
west
marion.
I
can't
tell
you
how
many
emails
and
phone
calls
I've
received
personally
about
that
property.
B
B
What
I'm
saying
is
if
the
property
is
maintained,
as
other
properties
are
on
that
street,
we
wouldn't
get
those
complaints,
and
that
has
not
been
the
case
up
until
very
recently,
and
I
think
I
think
it's
you
owe
that
to
the
residents
on
the
city
who
expect
to
have
a
street
that
is
impeccably,
maintained
and
and
looks
nice
and
fits
in
with
the
rest
of
the
street.
That's
a
big
problem.
B
Q
Couldn't
agree
with
you
more
I
mean
I
live
downtown.
I
maintain
my
yard.
I
walk
those
streets
the
same
way.
I
think
that
we
had
some
setbacks
with
kovid
and
then
doing
the
interior
renovations
again
kind
of
put
the
exterior
renovations.
You
know
the
landscaping
cleanup
aside,
but
we
have
pressure
washed,
the
entire
building.
Q
If
you
can
see
from
the
back
side,
we
did
repair
the
and
replace
a
whole
new
pool
deck
because
it
was
in
it
was
collapsing
and
falling
and,
like
I
said
all
of
these
exterior
improvements
that
you're
requesting
are
slated
for
the
summer.
Q
B
I
again
speaking
from
my
personal
opinion,
I
don't
have
a
problem
extending
this
for
one
year,
but
I
want
to
see
activity
happening
and
I
would
like
to
see
this
get
done
and
I
don't
want
to
see
every
once
a
year.
We
have
to
go
through
this
process
for
every
year
for
the
next
three
years.
The
original
request
was
for
a
three-year
extension.
Then
it
was
modified
to
a
one-year
extension.
B
I
I
would
be
okay
with
the
one-year
extension
as
long
as
we
have
assurance
that
it's
going
to
get
started
and
get
done
and
a
year
from
now
we'll
have
a
business
that's
in
place.
That
is
actually
doing
what
it's
supposed
to
be
doing.
You
know
we
in
good
faith,
approve
the
special
exception
two
years
ago
and
we
thought
that
by
now
this
would
have
been
up
and
running
and
it
isn't.
B
C
Yeah,
I
think
you
know
and
thinking
about
this,
what
bothers
me
is
that.
C
C
Yes,
I
understand
code,
it
affected
a
lot
of
people,
but
but
a
lot
of
building
a
lot
of
construction
has
been
going
on
in
this
community
covered
or
no
coded,
and
so
it's
really
hard
to
accept
covet
as
an
as
an
excuse
and-
and
I
use
the
word
excuse-
because
I
don't-
I
don't
see-
covid
as
a
reason-
a
valid
reason
in
the
construction
industry
to
have
caused
a
problem
when
we
have
so
much
construction
going
on
in
this
community,
our
numbers
prove
it
a
number
of
building
permits
and
a
number
of
certificates
of
occupancy
that
have
been
issued.
D
C
And
and
to
me,
it
was
an
organization
that
that
this
was
a
part
of
an
overall
property
of
properties,
but
the
focus
wasn't
on
getting
this
job
done.
It
was
just
there
were
distractions
by
the
desire
to
work
on
other
things
and
and
so
or
the
need
to
work
on
other
things.
But
yet
this
project
didn't
get
done
and
so
to
me
it's
an
overall
project
management
issue
and
and
allowing
it
allowing
the
to
be
distracted
and
and
not
look
at
what.
What
is
the
goal
in
the
target?
C
And
so
I
think
that
you
know
I'm
just
concerned
here.
We
are
and
we're
we're
talking
about
this
and
we
really
shouldn't
even
need
to
be
yeah
in
my
opinion.
So
it's
really
concerning
to
me
that
we're
even
needing
to
have
this
discussion
so
draha.
N
One
thing
in
this
regard:
we
can't
forget
that
we're
preempted
from
regulating
self-turn,
short-term
rentals
and
that
this
use
actually
is
one
which
is
far
better
for
the
city
neighborhood.
We
also
can't
forget
the
properties
under
litigation
at
the
beginning,
and
so
if
there
was
a
certain
momentum
to
get
this
done,
that
was
interrupted
and
we
can't
forget
that
that
was
right
before
coveting.
So
this
it's
not
that
this
wasn't
going
to
get
done,
that
they
actually
were
prevented
from
actually
doing
the
intended
use.
N
A
A
It
seems
to
me
like
that
would
have
been
the
first
thing
that
you
wanted
to
do,
because
you
just
said
that
you're
going
to
have
to
remove
drywall
to
put
in
the
sprinkler
system
and
if,
if
you
couldn't
find
contractors
to
work
on
the
inside
of
the
house,
I
don't
understand
what
covet
had
to
do
with
the
landscaping,
because
I
can
go
get
landscaping
done
anytime.
I
mean
I
realize
I'm
not
a
big,
you
know
hoo-ha
like
you,
guys
are,
but
I've
had
trees
delivered.
A
I've
had
plants
delivered,
and
it
would
just
seem
to
me
that
you
would
help
your
cause
if
the
outside
looked
presentable,
and
then
you
worried
about
the
inside.
I
think
you
guys
did
this
backwards,
I'm
just
giving
you
my
my
insight,
okay,
and
I
think,
because
this
is
such
a
focus
and
we
do
get
complaints
about
it
and
we
do
have
to
take
those
complaints
seriously,
that
it
would
make
us
feel
better
if
we
had
a
little
confidence
going
forward
that
you
know
you're
going
the
right
way.
Q
Q
Like
I
said
I
live
here,
I
actually
worked
on
the
harbor
walk
project
with
my
previous
firm,
and
so
I
would
say
that
to
answer
your
question,
one
we
didn't
know
what
the
fire
system
was
going
to
be.
We
didn't
know
that
we
were
going
to
have
to
do
the
interconnected
fire
system.
Initially,
that
was
just
brought
to
our
attention
during
the
may
7th
meeting
with
the
fire
marshal.
Q
C
So
I
guess
that
you
know
to
continue
the
discussion
not
to
kind
of
beat
the
horse
to
death,
but
last
meeting-
and
you
were
not
here
for
it,
but
last
meeting
we
talked
about.
Where
is
the
project
planned
to
me?
If
there
was
a
plan,
then
you
would
have
known
that
the
fire
there
would
need
to
be
new
fire
extinguisher
or
whatever
the
fire
suppression
system
in
the
building.
C
You
would
know
that
you
would
know
that
this
needs
to
be
done
before
this
is
done
and
because
that
is
what
happens
when
you
do
a
project
plan
and
all
the
can
the
dependencies
and
the
contingencies
and
everything
is
all
laid
out.
So
you
know
this
is
our
target.
This
is
when
we
want
to
have
it
done
or
whatever,
and
you
know
what
the
flow
is
and
that's
just
that's
how
it
works
when
you're
in
a
a
project.
Q
This
particular
project
kind
of
switched
apartments
internally,
and
so
I've
been
brought
on
as
of
the
may
7th
meeting
to
oversee
all
the
construction
for
the
fire
alarm
system
and
the
exterior
landscaping.
So
that's
kind
of
why
that
I
think
it
didn't
get
relayed
the
information
internally
you've
just
been
brought
on
to
in
august.
Yes,
I
started
it
with
fisherman's
village
in
august,
working
on
the
suites
and
turtle
bay
cafe,
and
then
I
have
just
been
brought
onto
this
project,
particularly
to
get
it
done
to
get
it
done.
C
I
guess
I
I
would
like
to
say,
since
brittany
has
just
been
brought
on
to
to
this
project,
to
get
it
done,
then
I
feel
I
was
going
to
vote
no,
but
I
feel
that
we
need
to
give
her
a
chance
to
make
it
happen.
Thank.
B
D
G
And
marriages
too,
if
I
might,
what
was
that
to
better
answer?
The
question
that
you
posed
to
me
about
the
that
the
councilmember
prathgate
posed
to
me
about
the
permitting
all
they
need
to
do
is
get
a
permit
for
something,
whether
it's
the
fire
system
or
something
else
that
requires
a
permit
and
then
there's
no
there's
no
deadline
for
for
activating
the
special
exception.
It
wouldn't
expire
after
that.
G
C
Then
go
ahead
and
get
the
fire
the
permit
for
the
fire
extinguisher.
B
So,
and
is
there
any
there's,
no
time
frame
on
a
building
permit.
M
O
G
Months
so
the
way
the
code
is
written,
it
doesn't
require
that
okay,
you
get
a
building
permit,
you
got
to
do
the
work
and
you
get
a
final
inspection
approved
in
order
to
maintain
your
special
exception.
The
way,
the
way
the
code
reads
is
as
long
as
they
pull
a
permit
before
the
expiration,
then
there's
no
expiration
date
on
the
special
exception.
Now,
if
that's
something
that
ultimately
is
a
a
loophole
of
some
sort
that
the
city
council
may
wish
to
close
based.
B
C
A
C
C
We
love,
patty
and
patty,
is
a
wonderful
person
and
is
well
respected
within
the
community,
as
you
know,
but
it
would
be
helpful
so
that,
as
residents
are
asking
us
about,
you
know
whether
it's
900
or
751
that
we
can
help
you
know
communicate.
This
is
what's
happening
that
the
hardy
siding
is
going
to
go
up.
You
know
to
certain.
Q
Yes,
absolutely
I
realize
how.
Q
Yeah,
absolutely,
I
will
have
patty
share
my
email
address
and
contact
information
with
all
of
you
and
if
you
have
any
questions,
I
will
just
give
me
a
call,
and
I
will
get
your
contact
information
from
her
as
well
and
send
you
project
updates
as
they
as
they
come
along.
But
you
guys
will
be
seeing
our
pd
here
very
shortly.
So
you'll
get
the
the
whole
plan
very
soon.
G
Proper
we've
got
provisions
that
talk
about
maintaining
the
cleanliness
of
the
of
the
walls
and
roof
the
exterior
walls
and
roof.
We
have
provisions
that
relate
to
the
landscaping
and
healthiness
of
the
landscaping
and
routinely
through
code
enforcement.
We
we
bring
in
residents
who
have
been
violating
those
codes.
So
if
it
gets
to
a
point
where
the
property
has
been
left
unkempt,
we
do
have
enforcement
capabilities
through
other
means
as
well.
G
G
N
A
I
think
the
fact
that
some
of
us
have
been
on
council
eight
years
nancy-
and
this
is
the
first
time
that
it's
ever
come
up-
might
say
that
staff
could
better
spend
their
time
right
now.
On
other
things,
we've
got
some
really
big
projects
going
and
I'm
not
sure
that
this
is
a
really
big
problem.
This
is
the
first
time
you've
heard
of
it
eight
years.
D
J
Bigger
issues
to
deal
with
right
now
than
that
one
I
mean
we
can
keep
our
eye
on
it
and
if
we're
seeing
something
coming
forward
in
the
future
that
might
cause
us
more
problem,
we
could
take
it
up
that
at
that
time,
but.
C
B
C
S
G
The
ordinance
discussion
which
we've
been
directed
not
to
take
any
immediate
action
towards
was
with
respect
to
the
exploration
of
special
special
exceptions
in.
S
General,
so
it
was
not
just
your
justification,
not
just
me,
okay
and
then
just
to
also
add,
and
thank
you
very
much
for
allowing
us
for
the
extra
year,
brittany-
and
I
she
was
just
brought
onto
this
project
specifically,
she
is
we've
had
a
boatload
of
things
that
we
are
doing
not
only
at
fisherman's
village,
but
at
with
our
other
properties,
and
I
can
assure
you
that
I
will
work
with
her
and
to
communicate
back
with
all
of
you
our
progress.
I
And
likewise,
if
I
could,
I
always
also
have
to
always
say
something,
but
in
regard
to
the
special
exception,
when
we
talk
about
that
not
expiring,
we
are
talking
just
about
a
special
exception,
which
of
course
is
a
whole
different
issue
when
that
special
exception's
approved,
but
if
a
permit
is
pulled,
those
permits
also,
whether
it's
fire
or
building
or
whatever
it
may
be,
have
conditions
where
that
permit
can
then
expire
and
the
whole
thing
expires
if
it
doesn't
come
back
for
extension,
with
a
special
exception,
because
there
would
be
no
permit
outstanding,
and
there
are
a
couple
things
it's
the
permit.
I
It's
you
know
different
things,
the
use,
the
permit
and
construction.
So
there
are
some
safeguards
that
it
doesn't
just
in
perpetuity
continue,
but
at
the
same
time,
as
david
said,
the
special
exception
can
continue
if
they
did
pull
a
permit.
But
then
that
permit
has
its
own
conditions,
which
we
monitor
to
make
sure
that
progress
continues.
I
G
Yeah,
I
guess
the
the
the
nuance
there
is
that
if
they
don't,
if
they,
if
they
pull
a
permit
for
a
let's
say,
a
fire
system
and
the
occupancy
for
the
bed
and
breakfast
is
contingent
upon
them,
completing
the
fire
system
and
can't
occupy
as
a
bed
breakfast
without
that
fire
system,
then
there
is
a
separate
provision
with
respect
to
failure
to
do
the
use
or
abandonment
of
the
use
for
a
period
of
time
also
would
allow
the
special
exception
to
expire.
So
there
is
a
sort
of
a
stop
gap
there
as
well.
D
B
All
right
moving
along,
we
now
have
one
public
hearing
that
is
za-01-2021.
B
D
G
This
is
the
first
reading
of
an
ordinance
which
I'll
read
by
title:
only
it
is
identified
as
za-01-2021
and
it
is
an
ordinance
of
the
city
of
puente
gorda
florida
amending
chapter
26,
article
11
science
standards.
I
want
to
go
to
code
rewriting
and
reorganizing
the
same
in
its
entirety,
providing
for
conflict
and
severability
and
providing
an
effective
date.
I
And
if
I
may
to
start
the
presentation
just
to
lead
into
this,
when
staff
makes
the
presentation
you'll
see
that
there'll
be
some
information
as
to
where
we
were
when
this
started
and
first
went
to
the
planning
commission,
then
what
was
changed
and
then
what
you
see
in
front
of
you
today
and
what
additions
have
been
made
based
on
additional
planning,
commission
and
council
comments.
So
you'll
know
where
you
were
and
where
we
are
and
then
we
can
have
discussion
on
the
changes
or
any
other
additions
or
deletions.
O
Okay,
good
morning,
lisa
hannan,
zoning
official,
so
the
sign
survey
discussion
started
a
little
over
a
year
ago.
Moving
forward,
we
did.
The
sign
survey
went
to
planning
commission
in
january
as
a
discussion.
O
It
was
in
the
form
of
a
draft
ordinance
that
that,
at
that
meeting,
planning
commission
had
some
concerns
with
the
residential
yard,
sign
and
number
that
was
decided
on
by
council,
which
was
four
and
four
square
feet
for
residential
that
concerns
with
profane
obscene
language
and
what
would
be
permitted
under
the
first
amendment
in
freedom
of
speech,
how
that
works
with
content
neutrality,
what
other
communities
were
doing
and
about
creating
visual
blight
at
the
march
3rd
city
council.
Meeting
changes
that
were
directed
by
council
were
to
include
definitions
regarding
defamation,
obscenity.
O
Incitement
include
security.
Signs
under
exclusions
include
flags
with
the
total
number
of
yard
signs,
but
at
that
time
it
did
not
limit
the
flag,
sizes
and
commercial,
reduce
the
freestanding
signs
from
five
signs
per
acre
to
four
signs
per
acre
and
to
change
the
iconic
signs
allowing
them
in
all
commercial
zoning
districts,
not
just
the
cra.
O
So
we
went
to
the
planning
commission
in
april
of
this
year
as
the
first
public
hearing
for
the
ordinance
we
outlined
the
changes
per
the
planning,
commission
and
city
council.
The
definitions
include,
I
can
get
into
the
presentation
now,
because
this
was
just
a
little
bit
of
historical
background,
so
our
sign
code
is
to
provide
signed
standards
that
are
content
neutral,
non-discriminatory,
provide
consistency
and
promote
public
health,
safety
and
welfare.
O
O
So
when
we
go
to
primary
sign
types
for
residential
areas,
the
main
change
was
the
residential
yard.
Signs
no
permit
required
four
square
feet
in
area
per
sign.
Three
feet
in
height
must
be
ten
feet
from
the
edge
of
the
pavement
maximum
of
four
signs
per
parcel,
which
will
include
flags.
However,
flags
are
not
limited
to
the
four
square
feet
in
area.
We
have
added
an
update
to
limit
the
flags
to
24
square
feet
in
area.
O
Let
me
show
some
graphics
here,
residential
flags.
Again,
no
permit
is
required.
We
did
update
and
put
size
restrictions.
The
pole
height
is
40
feet,
maximum
24
square
feet
in
area.
It
does
allow
two
poles
per
parcel
two
flags
per
pole
or
if
you
have
the
nautical
style,
gaff
and
yard
arm
pole,
four
flags
maximum.
O
The
number
of
flags
does
count
toward
the
maximum
number
of
yard
signs
and
maintenance.
That
has
stayed
the
same,
that
the
can't
be
faded,
tattered
torn
flags.
So
now
we
jump
into
commercial
and
commercial
flags.
We
did
not
put
any
regulation
on
size
because
the
maximum
pole
size
will
limit
again
the
size
of
the
flag
unless
council
directs
us
to
add
a
size
for
commercial
flags,
no
permit
is
required
again.
Two
poles
per
parcel
two
flags
per
pole
and
maintenance
stayed
the
same.
O
The
biggest
change
in
in
the
commercial
are
the
freestanding
signs,
which
are
a
little
more
temporal
in
nature.
Size
restrictions
stayed
the
same
at
32
square,
feet,
nary
and
six
feet
in
height,
but
as
far
as
number
of
signs,
it
was
lowered
from
what
originally
was
suggested
as
five
signs
per
acre
to
four
signs
per
acre.
O
O
They
were
concerned
about
the
solid
base
signs
being
a
hiding
place
for
people
with
not
good
intentions,
so
we
have
added
setback
requirements
for
all
zoning
districts.
As
far
as
the
ground
signs,
we've
asked
also
added
landscape
requirements
in
there,
so
that
all
ground
signs
would
have
to
be
landscaped
around
the
bottom,
not
real
tall
plants
but
like
more
of
a
ground
cover
and
it
has
to
be
low
growing
within
so
many
feet.
We
put
it,
we
put
the
dimensions
in
there
window
signs
the
most
obvious
change
was.
O
We
do
not
allow
the
opaque
or
solid
graphics,
even
the
the
ones
that
you
can
read
through
looking
looking
into,
but
you
can't
look
out
that's
for
safety,
because
you
want
to
be
able
to
see
through
the
window
as
you're
coming
out.
Those
have
been
requested
to
be
not
permitted,
so
we
we
added
that
as
a
prohibition
on
the
iconic
signs,
we
are
allowing
them.
We
took
out
that
they
were
permitted
only
in
the
cra
district
at
council's
request
that
they
are
allowed
in
any
commercial
zoning
district.
O
It's
to
enhance
any
architectural
compatible
architectural
elements
of
of
the
building
that
it's
adjacent
to
again.
We
have
permitted
materials
and
prohibited
materials
for
for,
like
some
of
the
iconic
ground
signs
or
facade
signs
or
projecting
signs.
If
it's
in
a
design-
and
I
can
try
to
answer
any
questions
legally-
I'm
going
to
turn
a
lot
of
it
over
to
mr
levin.
If
he
hasn't.
If
there's
any
legal
questions
that
need
to
come
out.
A
G
Is
this
suggesting
that
maybe
there's
a
concern
about
the
500
flags
at
lashley
park?
Oh.
G
O
O
So
public
park,
our
parks
are
public,
it's
up
to
city
council,
what
they
will
permit
and
not
permit
so
the
flags
and
the
flagpoles
that
are
at
veterans
park
are
absolutely
permittable
because
you
can
permit
whatever
you
want.
Everything
that
goes
into.
One
of
our
parks
is
approved
by
city
council
when
it
is
constructed
as
far
as
the
military
heritage
museum
that
is
actually
part
of
their
plan
development.
O
A
Okay,
I
would
just
like
to
go
on
the
record
as
saying
that
I
appreciate
the
time
and
the
effort
that
our
staff
has
put
into
this
and
mr
levin.
I
really
appreciate
your
guidance
in
all
of
this,
but
on
the
record
I
would
like
to
say
that
I
debbie
carey,
like
our
ordinance
just
as
much
as
all
of
the
residents
of
punta
gorda
do
and
I
wish
like
heck.
We
didn't
have
to
change
it.
I
agree.
G
C
Yeah,
I
would
actually
like
to
commend
david
for
all
of
his
hard
work
and
the
research
that
he's
put
into
this,
and
I
watched
the
the
planning
commission
meeting
in
april.
It
was
a
wonderful
meeting,
an
excellent
dialogue
appreciate
planning
time
that
they
put
into
this
and
the
thought
and
that
I
agree
it's
kind
of
like
in
some
ways.
C
I
feel
like
we're
trying
to
solve
a
problem
that
didn't
exist
in
a
way,
but-
and
yet
it's
in
trying
to
go
through
this-
it's
been
painful
but
and
painful
for
the
community
and
as
we
continue
to
explain
to
people,
why
we're
doing
this
and
people
keep
asking
questions.
C
I
do
have
one
question
and
that
is
today
under
our
current
code.
I
think
you
can
put
a
sign
in
your
yard.
There
isn't
any
restriction
if
I
wanted
to
put
a
happy
birthday,
lisa
sign
in
your
yard,.
O
They're
just
limited
in
size
to
the
non-commercial
at
100
square
inches,
yes,
ma'am.
C
So
it's
not
like
you
know,
because
we
don't
see
a
lot
of
signs
because
people
just
don't
do
it
so
and
I
don't
think
people
will
just
because
you
can
people
will
yeah
yeah.
J
D
J
J
You
know
is,
is
our
comments
about
profanity
and
fight
words
legislative?
Can
we
really
prove
that
or
can
we,
and
so
we
could
be
setting
ourselves
up
for
a
lot
more
legislation,
both
in
turn?
Excuse
me
internally
or
maybe
in
a
court
of
law.
So
the
other
comment
is
we've
been
actually
without.
We
have
not
adhered
to
or
used
our
code
for
the
last
year
plus,
and
yet
we
are
seeing
very
few
problems.
C
J
Well,
going
back
to
the
point
that,
as
we
put
more
restrictions
on
what
you
can
do
and
be
more
sp
every
time
we
be
more
specific
on
things,
we're
going
to
get
more
questions
about
them
and
I
think.
J
Staff
have
done
a
great
job
in
trying
to
put
all
the
things
in
there
that
actually,
we
wanted
in
there
to
help
protect
us
specifically
with
with
fight
words
and
profanity
lisa.
O
Just
a
clarification
for
miss
pravke,
councilmember
prafke
on
the
incidental
signs,
the
100
square
inches.
They
are
limited
to
no
more
than
three
per
person
for
residential.
So
right
now
we're
increasing
it
to
four
people.
Sorry,
okay,
but
that.
C
G
Right
right,
so
you
could
have
had
many
more
than
the
four
signs
for
each
of
the
different
classifications
right
right.
N
Mean
mainly,
I
guess
we,
we
have
to
make
sure
that
we
remind
the
public
that
it
was
our
enthusiastic
enforcement
a
year
ago.
Is
that
what
brought
us
into
this
regulation
of
speech
things?
So
this
is
where
we
are.
B
Yeah,
I
just
have
a
couple
of
specific
things
I
want
to.
I
want
to
bring
up
the
term
abandoned
sign.
First
of
all,
I
want
to
ensure
that
every
and
I
know
we're
not
allowed
to
single
out
one
particular
kind
of
sign,
but
any
event
that
is
done
and
over
with
whether
it
be
the
sale
of
a
home,
whether
it
be
a
birthday
party,
whether
it
be
a
political
sign
for
a
campaign
that
ended
in
november,
whatever
the
sign
is,
when
you
say,
an
abandoned
sign.
B
We
have
dozens
of
dozens
of
signs
and
flags
all
over
the
city
that
people
are
still
advertising
for
their
candidate
from
november,
and
that
campaign
is
over.
It's
done.
It
was
over
on
whatever
november
4th
or
5th
or
whatever
the
date
was,
and
a
month
after
that,
all
those
signs
should
have
been
pulled
down
and
florida
statute
does
stipulate
that.
So
I
want
to
make
sure
we
don't
have
this
go
ongoing
for
the
rest
of
our
life.
That's
a
very
big
thing
for
me.
C
The
question
I
have
is:
does
the
florida
statute
say
that
that
the
campaign
the
person
has
to
remove
it,
or
is
it
if
I
go,
buy
a
sign
supporting
some
cause
or
whatever,
and
I
put
it
up,
does
that,
and
that
was
something
that
was
voted
on
in
that
election,
but
I
I
bought
it,
the
campaign
team
didn't
do
it,
I
did
it
myself
do
I
have
to
take
it
down
because
that's
so
it's
a
question
in.
Do
you
understand
what
I'm
saying.
B
I
do
and
but
all
those
signs
are
purchased
from
a
campaign
headquarter
normally
most
of
the
campaign
signs
work.
You
can
go.
C
Motivated
kinds
of
things
and
that's
different
than
going
to
a
campaign
headquarters
to
procure
a
signs,
but
what
I
wanted
to
hear
from
david
is:
what's
the
interpretation
here
on?
C
Is
it
just
the
campaign
like
if,
when,
when
you
run
for
city
council,
and
one
of
us
runs
for
city
council-
and
you
know,
we
are
working
hard
as
a
campaign
team
to
put
the
signs
up
versus
somebody
deciding
I
like
you
know
so,
and
so
I'm
just
going
to
write
my
own
sign
and
put
it
in
my
yard
kind
of
thing.
B
A
J
G
Definition
of
signs,
page
9,
number,
58
means
any
device
structure.
Item
thing,
object,
fixture,
painting,
printed
material
or
visual
image
using
words,
graphics,
symbols,
numbers
or
letters
designed
or
used
for
the
purpose
of
communicating
a
message
or
attracting
attention.
I
don't
think
that
that
would
preclude
handwritten
signs.
I
think
I
think
the
the
there's
a
the
printed
sign.
The
requirement
of
printed
sign
is
with
respect
to
a
particular
type
of
sign.
Did
you
find.
D
G
No
and
I
and
and
that's
you
know,
that's
where
you
get
into
the
how
many
angels
are
dancing
on
the
head
of
a
pin.
You
know
even
the
u.s
supreme
court's
decisions.
G
G
But
that's
that's!
Those
are
the
cards
that
the
supreme
court
has
given
us
and
we're
trying
to
utilize
those
cards
as
best
we
can
to
protect
the
interests
of
of
our
citizens
and
as
long
as
we
follow
the
very
narrow
limitations
that
the
supreme
court
has
expressed,
we
should
be
okay
from
being
sued
in
violation
of
the
constitution.
We
can
always
use
the
u.s
supreme
court's
decision
as
a
defense
in
any
legal
action
taken
against
us.
Okay,.
G
Right
and
so
the
very
controversial
subject
throughout
the
drafting
of
this
ordinance
was
how
to
handle
political
science
and,
and
most
of
the
research
that
I
did
would
indicate
that
regulating
political
signs
and
duration
of
political
signs
is
a
clear
restriction
on
free
speech.
G
Fortunately,
it
was
brought
to
my
attention,
I
think
mayor,
maybe
we're
the
one
that
did
so
with
respect
to
the
provisions
of
florida
statute
106.143,
which
did
have
a
particular
time
limitation
for
political
science.
G
B
I
can't
believe
we're
the
only
city
in
the
united
states
that
is
facing
this
problem,
and
other
cities
are
controlling
it.
Why
can't
we?
I?
I
just
have
a
real
problem
with
this,
and
this
is
the
most
frequent
complaint
that
I
have
received
since
I've
been
in
office
is
getting
these
signs
taken
down
after
an
election,
and
this
year
in
particular,
has
been
the
worst
ever
and
now
now
what
somebody
did
was
on
on
bell
harbor.
They
have
a
a
trump
sign
and
it
says,
make
america
great
again
2024..
G
So,
if
I'm
to
play
devil's
advocate-
which
kind
of
I
have
to
do
here-
that
is,
that
person's
political
expression
of
support
for
a
candidate
who
hasn't
even
announced
but
support
for
a
candidate
for
an
election.
That's
four
years,
that's
three
years,
four
years
away,
four
years
away
or
less
than
that.
Obviously
math
is
not
my
strong
seat.
G
G
It
there
for
four
years
they
can
leave
it
there
as
long
as
they
want
and
and
and
the
other
side
of
that
coin
is
even
if
it's
an
even
if
it
was
a
let's
say,
biden
2020,
and
somebody
left
that
on
way
beyond
the
way
beyond
the
election.
G
So
it
would
be
a
very
easy
argument
for
someone
in
made
that
this
is
my
political
free
speech
right
to
put
that
out
and
again
I
am
making
a
prediction
as
to
what
the
outcome
would
be.
If
someone
sued
us
that's
a
prediction,
I
based
my
predictions
on
understanding
case
law
as
much
as
I
was
able
to
read.
G
It
is
a
protection
against
potential
liability.
What's
the
chance
of
us
being
sued,
I
can't.
I
can't
predict
that
if
the
city
council
wanted
was
going
to
take
the
risk
we
could
mon,
we
could.
We
could
regulate
any
of
these
activities.
Arguably
our
political
speech,
we'll
draft
the
ordinance
any
way
you
want
us
to
draft
it.
I'm
just
expressing
to
you
what
I
think
the
courts
would
say
if
it's
directed
that
way.
B
That's
that's
why
I
brought
that
to
you
to
begin
with,
and
I
I
have
a
serious
problem
with
allowing
political
signs
to
go
on
and
on
and
on
forever.
I
just,
I
think
it's
ludicrous
and
we're
getting
so
many
complaints
from
residents
so
many
complaints.
Every
week
I
get
complaints.
G
I
I
did
read
to
you
previously
from
it
was.
I
think
it
was
a
dissenting
opinion
from
one
of
this
one
of
the
supreme
court
decisions
that
gave
a
list
of
the
kinds
of
things
that
could
be
regulated
and
they
didn't
indicate
a
limitation
of
an
event
and
the
discussion
we
had
at
that
time
was
isn't
an
election,
an
event.
It
isn't,
and
I
think
arguably
it
is.
But
there
are
events
like
a
a
church,
bazaar
event
and
then
there's
events
that
have
political
connotation.
G
B
Okay,
that
isn't
resolving
the
situation,
and
I
don't
want
to
belabor
this
anymore.
Another
thing
that
I'd
like
to
bring
up
is
on
line
item
268
fighting
words.
I
would
like
to
personally
I
looked
at
this
and
I
thought
one
thing
that's
missing
is
the
last
sentence.
Has
some
disclaimers
about
defamatory
remarks?
There's
nothing
mentioned
about
political
affiliation.
Can
we
add
that
as
a
term
in
that
description,
because
that
is
also
a
problem.
G
I
was
recently
provided
with
a
court
opinion.
Actually,
I
think,
was
monday,
a
court
decision
interpreting
fighting
words,
and
in
that
case
they,
the
court
suggested
that
even
the
use
of
the
n-word
would
not
constitute
fighting
words.
G
G
I
believe
that
singling
out
political
speech.
G
G
I
think
the
key
is:
would
a
typical
normal
person
be
incited
to
fight
physically
by
just
simply
seeing
that
sign?
I
think
that's
the
way
the
courts
look
at
it
and
there's,
and
I
don't
think
that
they
would
see
it
that
way.
A
G
Candidate,
so
thank
you
if
the
f
word
appears
so
that
it's
visible
from
a
public
area
that
visible
to
someone
under
the
age
of
17,
yeah.
G
Then
then
we
would
have
the
ability
to
regulate
that,
and
let
me
suggest
even
that
is
somewhat
of
a
stretch.
G
I
I
relied
upon
a
particular
decision
of
involving
the
federal
communication
commission
with
respect
to
violating
a
a
provision
leading
to
decency.
A
G
Where
the
program
was
broadcast
during
the
afternoon
when
it
could
have
been
heard
by
a
minor
and
it
used
the
f
word
among
others,
the
court
distinguished
that
because
it
was
could
have
been
listened
to
or
heard
by
minors.
That
was
a
problem.
But
if
the
same
presentation
was
made
at
night,
it
wouldn't
have
been
so
using
that
court
as
a
basis.
G
I
have
defined
that
type
of
language
as
indecent,
so
that
we
could,
in
our
city,
prevent
a
sign
such
as
that,
okay,
so
include,
and
and
as
well
as
if
someone
was
wearing
it
on
their
shirt
like
at
the
flea
market
or
on
on
harbor
walk.
That
would
be
something
that
that
we
would
be
able
to
enforce
under
our
ordinance
and
what
about
handheld.
I
G
Are
not
prohibited
in
general,
but
if
the
handheld
signs
had
a
an
indecent
word
on
it,
then
yes,
it
could
be,
but
but
we
cannot,
you
know
the
people
with
the
spinning
signs
and
stuff.
We
cannot
prohibit
that.
G
Now
again,
the
the
correct
use
of
the
correct
words
would
be
indecent
language
for
in
lieu
of
profanity.
G
Well,
we
have
obscene
obscenities.
You
know,
that's
not
that's
a
totally
different
class
from
what
we
would
consider
to
be
propane.
What
I
consider
what
I've
defined
as
indecent,
consistent
with
the
the
case
law?
Okay,
so
I
mean
we've
got
it
all
covered
we've
got
obscene,
we've
got
a
decent
and
we've
got
fighting
and
the
definitions
that
that
I've
proposed
are
consistent
with
what
the
case
law
is.
G
So
I'm
comfortable
that
you
know
if
we're
challenged
on
that
as
a
violation
of
free
speech,
we
have
sufficient
case
law
to
give
us
a
decent
chance
of
success
in
that
litigation.
I
So
let
me
tie
all
this
together
for
a
second
which
will
probably
be
impossible,
but
so
just
as
a
couple
things
when
we
talk
about
in
on
page
six
number
22,
which
started
at
line
268
and
we're
talking
about
the
fighting
words
and
that
added
graphics.
So
it's
graphics
in
there
and
and
you're
just
generalizing
here.
In
your
opinion,
the
words
political
affiliation
would
not
be
able
to
be
added
there
correct.
G
I
And
then
we
go
over
to
page
seven,
which
has
number
34
starting
in
line
317
yep
and
we're
at
indecent
speech,
which
is
language
or
graphics
that
depict
or
describe
what
it
says
there
in
a
manner
that's
offensive
as
measured
by
contemporary
community
standards.
So
that
would
be
including
a
graphic
on
a
t-shirt,
a
handheld
sign,
whatever
the
case
may
be
that
had
that
type
of
indecent
speech
on
it,
then
we
go
to
the
next
page.
G
I
It
does
we'll
get
there.
Oh
okay,
yep,
I'm
gonna
dive
into
that
all
right,
and
then
we
go
to
page
eight
number
44,
which
starts
at
line
359
right
and
we're
also
talking
there
then
about
obscene
language
which
language,
geographic
that
depicts
that
and
taken
as
a
whole
lacks
any
justification
from
a
political,
literary,
artistic
or
scientific
value.
So
that's
the
definitions
of
what
those
are
right
and
then,
when
we
go
back
to
page
12.
I
Which,
oh
yeah?
Oh
yeah,
thank
you
yeah,
which
under
number
two
at
line
568.
So
these
are
one
of
the
list
of
prohibited
signs
which
there's
rotating
signs
and
penance
signs
that
are
on
there.
But
it
doesn't
say
if
someone's
rotating
them
in.
But
when
we
go
to.
I
Yeah
right
these,
these
are
all
just
definitions
and
that's
what
we're
going
through
the
list
of
definitions,
which
is
really
where
the
meetup
it
is,
and
the
reason
I
want
to
highlight
those
definitions
is
because
staff
has
to
enforce
this.
So
we
want
to
make
sure
we
have
an
understanding
of
what
these
means
that
we
can
properly
enforce.
C
So
you
know
one
of
the
things
that
I
think
I
hear
this
from
my
colleagues
that
we
get
complaints
about
people
putting
up
whether
it's
a
flag
or
a
sign
or
whatever
that
has
the
f
word
on
it
or
if
it's
on
an
apparel
or
whatever
I
mean
I
was
at
fisherman's
village.
C
You
know,
sitting
in
one
of
the
chairs
in
the
concourse
and
a
family
comes
walking
down
the
concourse
and
their
teenage
son.
Who
was
maybe
you
know,
13
ish.
I
mean
that
early
teen
kind
of
thing
had
on
a
hat
and
the
hat
said:
f,
20
20
on
it
and
it's
like,
and
I
looked,
and
I
thought
the
parents
would
let
this
kid
wear
this
and
it's
like
you
know,
and
then
other
parents
are
going
to
see
because
that's
we
get
this
because
we
the
complaint
we
get.
C
B
I
do
think
we
should
include
something
specific
about
apparel
of
any
kind.
B
G
Maybe
we
decided
that
under
par
number
58,
the
definition
of
sign,
which
means
it
includes
any
item
or
thing.
I
think
that
would
arguably
include
something
that's
being
worn,
but
it
could
it.
I
Well,
this
is
this
is
where
we
get
to
this
when
we're
tying
all
this
together.
This
says
any
sign
so
signed
includes,
whatever
definition
we
have
for
sign,
which
contains
obscene
language
or
graphics
and
any
sign
containing
fighting
words
or
indecent
speech,
which
ties
all
these
definitions
into
this
correct,
which
is
legible
from
any
public
right
away.
I
Well,
you
know
a
road
is
a
public
right-of-way,
a
canal
is
a
public
right-of-way,
there's
a
lot
of
public
radars
out
there
and
which
or
within
any
public
space
and
which
can
potentially
be
viewed
by
children
under
the
age
of
17.
Provision
includes
signs
on
vehicles,
so
where
is
this
enforceable
when
it
comes
to
the
city
we're
talking
about
from
a
public
right-of-way?
I
So
that
means,
if
you're
driving
down
the
street,
someone
has
that
sign
in
their
yard:
that's
enforceable,
but
if
you're
in
fisherman's
village
on
private
property,
where
you
can't
see
it
from
a
public
right
away,
then
that's
not
enforceable.
So
if
the
kids
outlaw
then
comes
from
fisherman's
village
and
goes
down
harbor
walk,
is
it
then
enforceable?
Yes,
so
that's
the
answer
yeah
in
theory,
if
someone
complained.
B
My
next,
my
next
comment
would
be
that
I
have
already
received
one
complaint
about
the
maximum
size
of
the
flags
and
as
it
pertains
to
american
flags,
I
I
know
someone
that
wants
to
put
a
flag
up.
That's
a
lot
bigger
than
24
square
feet
and
they
have
a
40
foot
pole
and
my
request
would
be
that
we
should
consider
exempting
the
american
flag
from
that
rule.
B
B
O
From
the
from
excuse
me
from
the
sorry
to
interrupt,
but
from
the
website
I
went
to
regarding
flag
sizes
based
on
the
poll
size,
it
would
be
a
40-foot
pole
can
hold
a
six
by
ten
flag,
which
would
be
sixteen.
B
And
I
doubt
that
he
would
fly
one
that
big,
but
but
the
point
being
that
he
was
very
upset
with
the
24
square
foot.
Okay,.
G
I
personally
don't
agree
with
some
of
these
cases
that
I
read,
but
it's
not
my
privilege
to
agree
or
disagree
with
what
the
supreme
court
justices
or
the
federal
court
justices,
say
and
there's
case
law
directly
relating
to
discriminating
between
an
american
flag
and
some
other
flag.
That
somebody
feels
is
equally
important
in
their
mind.
G
So
if,
if
we
want
to
allow
for
a
larger
size
flat
american
flag,
then
we
can
put
as
for
all
flags
a
much
larger
sign
size
flag,
whether
other
people
are
going
to
put
other
size
flags
that
big.
I
doubt
whether
those
other
size
flags
are
even
available,
but
but
we
cannot
differentiate
between
an
american
flag
and
any
other
type
of
flag.
I
Now,
personally,
I
think
it
would
be
nice
and
not
nice.
Having
someone
sue
you
because
you
allowed
them
to
fly
a
bigger
american
flag,
wouldn't
be
a
bad
lawsuit
to
be
in,
but
at
the
same
time
we
would
probably
lose
and
the
problem
would
be
what
damages
are
assessed
and
what
it
would
cost
the
city
to
lose.
But
just
saying
you
can
fly
an
american
flag
because
you're
in
america
you
know
if
you're
going
to
be
sued
for
something.
That's
that's
what.
A
A
G
I
B
J
Other
number,
a
number
of
things
I
wanted
to
say,
but
in
terms
of
the
height
of
the
flagpole
and
how
big
a
flag
it
can
handle,
I
mean
you
could
build
a
flagpole,
that's
this
big
around
it's
40
foot
tall
and
it
could
handle
a
flag.
That's.
J
D
D
O
B
G
Things
and
then
I'll
be
done.
We
won't
be
able
to
complain
when
somebody
puts
a
biden,
20
24,
six
by
10
or
bigger
on
their
on
their
flagpole.
B
Okay,
going
to
line
number
881,
it
says
message
may
not
be
changed
more
than
once
in
a
24-hour
period.
We
have
two
at
least
that
I
know
of
in
the
city
that
are
changeable
digital
signs
ones
at
the
vac
and
one
is
at
the
event
center.
Are
they
grandfathered.
O
No,
the
event
center
has
a
variance
okay,
and
it
is
the
event
center
is
regulated
by
the
criteria
of
the
variants
and
the
visual
arts
center.
If
it's
changing
more
than
once
a
day,
then
it
is
actually
in
violation.
It.
O
They,
usually
they,
the
the
former
executive
director
and
the
current.
They
know
that
it's
only
supposed
to
change
once
every
24
hours
it
doesn't
flash
or
scroll,
but
we
can.
We
can
definitely
let
them
know,
but
no
it
that
that's
not
new
in
here,
that's
been,
and
that
that's
been
in
effect,
and
it
was
in
effect
when
they
put
that
sign
up.
B
There
are
a
number
of
boats
that
have
signs
on
them,
whether
they
be
for
sale,
signs
or
other,
and
a
lot
of
boats
who
fly
huge
american
flags
on
them
now
are
they
subject?
It
would
would
a
boat
be
considered
part
of
the
four
signs
or
flags,
or
is
that
a
separate
entity,
because
it
is
separate
from
the
house
I've?
I
got
asked
this
question
yesterday
because
I
have
someone
who
had
a
68-foot
mast
on
their
sailboat
and
they
fly
a
big
american
flag
on
it.
G
Well,
we
discussed
that
the
the
boat
and
that's
why
it's
anything
water
over
the
sea
will
seawall
is
actually
on
city,
city-owned
canal,
so
other.
D
G
Other
than
the
what
we
provided
for
the
burgie
and
we
provided
for
the
ensign
that
typically
are
on
on
boats.
No
other
signs,
including
flags,
would
be
permissible
on
a
boat,
that's
located
in
the
canal.
B
C
I
would
say:
oh
well,
it
raises
a
question
I
hear
where
we're
going
with
this,
but
we
work
so
hard
to
insert
the
the
indecent
the
fighting
language
that
kind
of
language.
I
would
really
hate
to
see
us
now.
All
of
a
sudden.
Somebody
goes
oh,
but
I
can
put
this
sign
on
my
boat
right
and
it
can
sit
in
my
back
behind
my
house
and
have
all
this
bad
language
on
it
and
I
and
they
can't
do
anything
about
it.
G
On
the
one
hand,
we're
criticized
for
having
too
many
regulations
and,
on
the
other
side,
we're
recognizing
that
there's
all
kinds
of
potential
flags
that
can
show
up
in
all
kinds
of
places
that
we
may
not
have
experienced
a
problem
in
the
past,
but
I
already,
but
we
know,
for
example,
that
we've
received
complaints
about
somebody.
That's
got
four
or
more
flags
on
their
dock.
That's
clearly
visible
and
somewhat
political
in
nature,
and
can't
we
do
something
about
that.
B
N
B
A
B
G
B
C
C
I
G
All
right,
so,
I
think,
you're,
on
on
the
right
track.
If
we,
if
we
say
that
and
the
only
thing
that
we're
saying
with
respect
to
boats
is
that
signs
on
boats
would
not
be
included
in
the
maximum
number
of
flags
of
signs
for
any
private
property.
A
G
A
G
The
if
you're
talking
about,
for
example,
the
indecent
language
by
by
not
excluding
the
votes
entirely,
but
just
including
them
or
excluding
them
from
the
number
of
maximum
number
of
signs,
then
they
still
would
be
subject
to
all
the
other
provisions,
including
the
profound
you're.
G
G
I'm
good
now,
since
we're
having
the
discussion.
What
about
flags
on
docks
is
that
is
it
is
that
to.
G
So
we
can
continue
to
maintain
the
prohibition
on
signs.
Seaward
of
the
sea
wall,
with
the
exception
of
signs
on
boats
are
okay
with
that.
A
B
I
It's
really
the
the
two
categories,
one
being
definitions
which
really
define
how
we
enforce
this
and
what
staff's
going
to
do
with
it,
which
is
the
obscenity,
the
indecent,
the
and
then
what's
permitted.
When
we
went
through
the
prohibited
signs,
which
includes
anything,
you
can
see
seventeen-year-old
blah,
blah
blah
all
those
things
and
then
the
other
category
being
other
detail
in
the
sign:
ordinance
like
flag
size,
boat
restrictions,
etc.
So
definitions
prohibited
signs
and
the
other
miscellaneous
detail
that
there
were
questions
on
yeah.
B
G
C
A
Yeah
day
you
want
it,
I
have
one
question:
can
I
okay,
I'm
sorry,
do
the
little
garden
flags
on
the
sticks
count
as
a
flag
or
a
sign.
Somebody
asked
me
that,
either
or
because.
O
C
I
was
just
going
to
make
a
comment
because
I've
got
a
resident
question
from
a
resident
in
seminole
lakes
about
a
billboard
sign
that
is
across
from
seminole
lakes
on
us41
northbound.
It's
not
in
the
city's
jurisdiction.
It's
not,
it
is
either
in
fdot
or
it's
probably
it
could
be
in
the
county.
C
I
mean
for
sure
it's
in
the
county,
but
it's
it
could
be
in
the
railway.
Right-Of-Way,
don't
know
who's
right
away,
it's
actually
in,
but
it
is
a
political
sign.
C
B
C
So
I
just
you
know,
I
think,
but
it's
helping
us
in
this
discussion
to
understand
how
we
respond
to
people
and
you
know
like
it
or
not
like
it
it's.
This
is
what
we're
faced
with
yeah.
J
Yeah,
first
of
all,
I'd
like
to
go
back
to
my
first
comment
about
not
being
any
problems
with
science.
I
my
brain,
had
totally
forgot
about
the
political
science,
but
the
other
thing
mine's,
a
simple
question.
Hopefully
it
has
to
do
with
political
signs
on
commercial
properties.
Is
that
the
political.
K
R
J
O
J
J
J
I
If
there's,
could
I
just
summarize
one
day
just
because
we're
gonna
live
with
this
now,
as
adopted
eventually
so
we've
talked
about
the
abandoned
signed
and
we've
talked
about
section
106.
We've
talked
about
the
definition
of
fighting
words
and
we
understand
what
the
graphics
handheld
signs
and
disgust
apparel
in
the
definition
of
signs.
We've
talked
about
the
indecent
speech
that
was
number
34..
I
We
discussed
that
then
we've
also
identified
in
another
category
the
flag
square
footage
which
one
would
be
of
a
larger
size
and
how
we
would
deal
with
boats
that
are
waterward
of
a
seawall
and
then,
of
course,
we
also
just
briefly
discussed
the
change
in
every
24
hours
for
a
message
board
and
that
that
was
already
required
and
is
so
other
than
that
and
knowing
the
changes
that
were
required
now
we're
our
changes
that
were
discussed
now,
we're
disciplined.
B
F
I
can't
pass
this
up
bill.
Driedberg
put
the
gorda
for
the
record.
I
wish
you
could
sit
where
I've
been
sitting
and
watch
you
all's
faces
over
the
last
hour
when
you've
dealt
with
this
thing,
there's
a
gentleman
that
at
the
corner
of
taylor
and
olympia,
every
saturday
who
doesn't
like
the
sheriff-
and
he
has
a
sign
and
a
shirt
so
as
far
the
the
enforcement
part
of
it,
I'm
glad
to
see
that,
because
every
time
I
go
by
that
disgusts
me
to
see
that
gentleman
there.
F
F
They
have
regulated
themselves
to
the
point
where
nobody
wants
to
even
work
in
there.
They
can't
get
anything
done.
I
worry
that
we
might
be
going
down
that
same
road
here
where
this
thing
is
so
convoluted,
and
so
I
can't
I'm
tr.
I
work
with
it.
I'm
working
with
you
all
the
time
and
I've
read
it
like
20
times.
I
can't
figure
it
out
myself.
F
I
I
called
the
national
association
of
realtors
and
asked
them
the
question:
is
there
cities
around
the
country
that
are
that
are
not
allowing
open
house
signs
and
to
their
knowledge?
Then
they
didn't
know
of
any,
but
they
were
going
to
get
back
to
me.
Unfortunately,
get
back
to
me
before
this
meeting
and-
and
I
don't
know
of
many
cities,
and
maybe
our
attorney
can
answer
that
question
is-
are
actually
looking
to
go
down
to
this
content
neutral,
sign
ordinance
that
we're
trying
to
do
now.
Here
I
I
mean.
F
B
O
Okay,
so
again
we
go
into
content
neutral,
not
looking
at
the
content,
whether
you
could
have
the
sign
on
somebody's
private
property.
With
their
permission,
it
would
just
count
toward
those
total
number
of
four
signs
or
flags
as
long
as
it's
not
in
the
right
of
way
as
long
as
it's
with
it
as
long
as
it
is
10
feet
back
from
the
edge
of
the
pavement.
B
B
C
I
guess
I
will
move
that
we
approve
the
sign
ordinance
as
needed
during
our
discussion
today.
B
D
O
D
O
D
B
Okay,
we're
back
in
session,
and
there
are,
there
are
three
quasi
excuse
me.
Thank
you.
We,
there
are
three
quasi-judicial
public
hearings
and
if
anyone
in
the
audience
wishes
to
speak
on
any
of
these
hearings,
please
stand
now
and
be
sworn
in
and
I
don't
know
who's
going
to
do.
The.
G
B
G
D
G
Which
I'll
read
by
title?
Only
an
ordinance
of
the
city
council
of
punta
gorda
florida
annexing
within
the
municipal
limits
of
punta
gorda,
16.8,
plus
or
minus
acres
of
city-owned
property
located
in
charlotte
county
florida,
commonly
known
as
the
city
of
puente
gorda,
public
works
and
utilities
campus
and
addressed
as
3130
and
3132
cooper
street,
as
more
particularly
described
in
exhibit
a
in
accordance
with
the
voluntary
annexation
provisions
of
section
171.044
florida
statutes,
redefining
the
boundary
lines
of
said
city
in
conformance
therewith.
O
O
This
will
allow
the
applicant
the
city
to
become
part
of
our
own
municipality
and
it
contributes
to
contiguous
growth
and
it
does
strengthen
our
municipality.
It
is
16.8
plus
or
minus
acres.
We
are
contiguous
with
the
annexation
of
ninos
and
pendleburg
self.
It
made
us
contiguous
to
the
city
property
and
it
does
not
create
an
enclave.
O
Six

The

the

area
and
is
currently
served
with

O
It
is
a
large
scale,
comprehensive
plan.
I
mean
it
will
require
the
large-scale
comprehensive
plan
and
rezoning
amendment.
They
are
running
concurrently
and
it
supports
the
city's
strategic
plan.
Urban
design
recommends
approval
of
the
annexation
penalty,
development
review
and
planning
commission
both
recommended
approval.
C
G
Well,
it
doesn't
happen
often,
but
we
have
been
challenged
in
the
past
with
respect
to
decisions
that
we
have
made
in
the
land
use
type
of
of
decision
making,
where
it's
required
that
there
be
testimony
on
behalf
of
somebody
that
the
pro
that
the
proposed
development
or
action
is
consistent
with
the
provisions
of
the
comprehensive
plan,
and
we
need
to
articulate
which
provisions
it
is
found
to
be
consistent
with.
G
A
transcript
of
the
proceedings
goes
forward
and
the
the
court
wants
to
make
sure
that
we
have
identified
in
the
record,
specifically
the
provisions
and
the
cleanest
way
to
do
that
is
by
testimony
by
lisa.
Otherwise
you
know
the
printed
page.
B
B
B
We
have
a
motion
and
a
second
to
close
the
public
hearing.
All
those
in
favor,
please
signify
by
saying
aye,
aye
aye
opposed
motion
carries
unanimously.

All

I
and
portions

b
and
e.
All
in
coral

unit
number
two.
According
to
the
plaque
thereof,
recorded
in
black
book
five
page
36
of
the
public
records
of
charlotte
county
florida
and
said
parcel
also
being
a
portion
of
those
lands
encompassed
by
resolution.
B
Let
me
before
lisa
starts,
I
just
want
for
those
who
may
be
watching
by
way
of
their
computer
when
we
have
a
an
annexation
request.
There
are
three
hearings
that
must
take
place:
one
is
for
the
the
actual
annexation
request
and
one
is
for
the
comprehensive.
D
G
D
B
O
You
good
morning
again
lisa
han
and
zoning
official,
a
as
the
mayor
stated.
This
is
the
companion
amendment
for
our
public
works
and
utilities
campus
on
cooper
street
and
this
pers,
the
annexation
precipitates
the
need
for
our
comp
plan
amendment.
O
So
the
amendment
will
change
the
future
land
use
from
county
to
low
intensity,
industrial
from
low
intensity,
industrial
to
city,
public
semi-public,
and
it
will
apply
all
the
provisions
of
the
city's
comprehensive
plan,
its
existing
buildings.
No
new
development
is
proposed,
currently
served
with
municipal
water
and
wastewater,
and
I
was
remiss
I'd
like
to
enter
our
staff
report
into
the
record
in
its
entirety
by
reference.
I
should
have
added
that
at
the
beginning
I
apologize
so
it
is
consistent.
The
comprehensive
plan
amendment
request
is
consistent
with
our
comprehensive
plan.
O
O
7.1.4.5,
intergovernmental
coordination
policy,
9.1.1.1
parent,
b
and
capital
improvements,
objective,
10.1.4
policy,
1.1.4.1
concurrency
requirements
on
basically
all
of
these-
it's
not
applicable
because
it
is
existing,
developed
commercial
properties
for
roadway
facilities.
It
is
served
by
potable
water
and
wastewater
storm,
water
and
drainage.
It
is
existing,
solid
waste
is
collected
and
a
collection
provided
by
the
city.
The
county
zimmer
road
facility
has
sufficient
capacity
through
the
2030
planning,
horizon
parks
and
recreation
is
not
applicable,
since
it
has
developed
commercial
property
and
public
school
concurrency
is
not
applicable
due
to
being
a
commercial
property.
O
The
application
is
in
order.
The
request
is
consistent
with
the
puna
gorda
2040
comprehensive
plan.
The
rezoning
application
will
be
required
and
it
is
running
concurrently
will
be
heard
next,
any
new
or
additional
development
will
require
development
review
approval,
so
the
pentagorda
development
review
and
planning
commission
recommended
approval
urban
design
staff
finds.
It
is
consistent
and
recommends
approval
and,
as
part
of
your
motion,
if
you
could
recommend
approval
and
transmittal
of
the
petition
to
the
department
of
economic
opportunity
and
related
reviewing
agencies,
please.
A
O
G
Okay,
so
I
think
I
can
give
this
a
shot.
G
The
the
first
ordinance,
the
annexation
ordinance
is
identifies
the
boundary
of
the
land,
that's
going
to
be
included
in
the
city
and
the
the
comprehensive
plan
amendment
and
the
and
the
upcoming
zoning
amendment
identifies
the
specific
parcels
that
are
now
going
to
be
affected
by
the.
A
B
Okay,
this
is
a
public
hearing.
If
anyone
would
like
to
address
counsel
on
this
issue,
please
come
forward.
You
have
three
minutes.
If
there's
anyone
that
would
like
to
speak
on
this
issue,
please
come
to
the
podium.
You
have
three
minutes
last
call
anyone
wishing
to
speak
on
this
subject.
Please
come
to
the
podium,
moved.

Yes,
this
is
the
first
reading
of
an

which
I'll
read
by
title:
only
an

of
the

of
the
city

rezoning,

According
to
the
declaration

as
recorded
in
the
official

book,
3231
page
1963
and
subsequent
amendments,
there,
too,
of
the
public

of
charlotte

all
being
more
particularly
described
in
the
boundary

attached
here
to
and
addressed
as

From
its
current

of

and
providing

O
Good
morning
again,
lisa
hannan,
zoning
official
and
I
have
been
sworn
I'd
like
to
in
our
staff
report,
into
the
record
in
its
entirety
by
reference.
This
is
our
final
application
for
the
rezoning
for
public
works
and
utilities
campus
on
cooper
street.
The
companion
applications
are
the
annexation
comprehensive
plan
amendment.
O
It
will
change
the
zoning
from
county
industrial
general
to
city
public
and
apply
all
the
provisions
of
the
city's
land
development
regulations
to
the
properties
existing
buildings.
No
new
development
is
proposed
and
it
is
currently
served
by
municipal
water
and
wastewater
concurrency
requirements.
The
roadway

not
applicable
its
existing

O
B
B
If
anyone
in
the
audience
would
like
to
address
the
council
on
this
issue,
please
come
forward
last
call
anyone
in
the
audience
that
would
like
to
address
the
council
on
this
issue,
move
to
close
public
hearing.
Second,
we
have
a
motion
and
a
second
to
close
the
public
hearing.
All
those
in
favor,
please
signify
by
saying
opposed
motion,
carries
unanimously
move.
B
B
A
G
Yes,
this
is
a
resolution
which
I'll
read
by
title.
Only
a
resolution
of
the
city
council
of
the
city
of
punta
gorda
florida
authorizing
submission
of
a
florida
department
of
state
special
category
grant
and
aid
assistance
for
historic
preservation,
project
matching
grant
application
and
authorizing
execution
of
the
application
and
grant
agreement
by
the
city
manager
or
his
designee
and
providing
an
effective
date.
L
Good
morning,
julie,
ryan
for
the
record
on
april
21st
city
council
meeting
gave
staff
direction
to
apply
for
a
grant
to
help
with
the
historic
restoration
for
the
ac
freeman
house
as
part
of
the
application
process.
L
The
city
right
now
has
hundred
and
forty
thousand
dollars
that
has
already
been
allocated
to
this
project.
You
will
find
later
on
in
the
agenda
that
we're
getting
ready
to
award
the
the
contract
for
the
restoration
in
the
contract
documents,
so
this
is
just
again
for
us
to
finish
the
grant
application
if
we
are
successful
in
obtaining
up
to
500
000
towards
that,
we
would
be
notified
in
awarded
in
july
of
2022.
N
B
B
Anyone
opposed
okay
motion
carries
unanimously.
Yes,
thank
you.
Okay,
we
have
consent
agenda
next.
Does
anyone
have
anything
they'd
like
to
pull
on
the
consent
agenda.
C
C
So
I
think
our
discussion
at
the
last
meeting
paid
a
dividend
it
did,
and
I
also
want
to
commend
the
mural
society
on
the
how
beautiful
the
new
mural
looks.
So
it's
quite
lovely
and.
B
I
don't
have
anything
to
pull.
I
just
had
a
couple
of
technical
questions
about
the
mural.
I
don't
know.
If
I
need
to
pull
that
item
to
do
that.
Okay,
then
I
would
like
to
pull
it
so
we'll
address
that
separately.
So
if
someone
would
like
to
approve
the
rest
of
the
consent,
agenda
move.
B
Okay,
we
have
a
motion
and
a
second
to
approve
the
consent
agenda.
Minus
item
d1,
all
those
in
favor,
please
signify
by
saying
aye.
Anyone
opposed
motion
carries
unanimously
just
a
couple
of
technical
questions.
I
hope
somebody
can
answer
for
me
on
the
mural.
These
are
questions
that
were
asked
of
me
when,
where
the
old
mural
currently
is,
is
that
wall
going
to
be
painted
a
solid
color
behind
the
panels?
A
A
A
B
N
Emotion
to
approve
letter
d
of
the
consent
agenda.
B
D
D
B
R
R
So
it
will
concur
with
current
business
occupancy
standards
as
they
apply
to
the
national
register
of
historic
places.
Staff
is
recommending
approval,
the
cost
is
102
893
dollars
and
it
will
take
approximately
10
months.
So
staff
is
recommending
approval
of
the
specific
authorization
to
park.
It
mudra
smith,.
R
L
Julie
ryan,
for
the
record,
we're
on
track
with
the
grant.
So
if
we
were
to
get
awarded
the
grant
by
july
of
2022
is
basically
the
same
time
because
we're
about
10
months
for
the
construction
documents
and
then
the
bidding
phase.
So
we're
right
in
line
to
start
the
construction,
the
rehabilitation
around
june
july
of
2022.
L
H
I
Actually,
what
can.
L
I
Well,
they've
done
as
much
as
you
can
to
protect
the
envelope,
so
the
inside
still
nothing's
being
done,
water's
been
turned
off
the
roof's
been
sealed.
We
have
a
couple
things
in
the
foundation
that
we
have
probably
so
they've
secured
everything
there
until
we
can
get
back
in
and
do
replacement
and
that's
about
all
that
can
be
done,
prevent
any
further
intrusion
of
water
prevent
any
further
deterioration
on
the
exterior,
but.
B
B
V
V
One
thing
to
know
is
the
gfoa
no
longer
like
us
to
use
the
acronym
kefir
anymore.
We
have
to
say
it
all
out
comprehensive
annual
financial
report
which
for
us
I
mean
I
preferred
the
acronym
it
was
much
easier
to
say,
but
that
was
one
of
their
items
that
they've
put
out
to
us
that
we
should
no
longer
refer
to
it
as
as
that,
it's
just
new
hard
to
get
used
to,
because
but
going
on
on
our
comprehensive
report,
it
is
information
as
of
a
specific
date
and
time
so
it
is
through.
V
As
of
september,
30th
2020,
that's
the
end
of
our
fiscal
year.
It
reports
all
of
our
financial
activities.
During
that
year
the
auditor
has
given
the
city
a
clean
opinion
on
the
audit
report.
V
So
the
city
has
updated
the
policy
and
this
had
to
do
with
our
vendor,
who
was
supposed
to
be
doing
all
of
our
required
documentation
and
they
turn
it
over
to
us
at
final
payment
and
they
were
not
able
to
do
that.
So
we
are
going
to
now
go
ahead
and
go
forward
with
requiring
that
on
a
monthly
basis
in
any
future
vendor
agreement,
so
net
position
for
the
city
overall
did
increase,
so
we
did
go
up
to
14.1
million,
that's
governmental
and
business
type
related
activities
for
our
governmental
funds.
V
Our
net
position
did
increase
5.6
million
our
unrestricted
net
position.
We
still
have
a
deficit
balance
of
2.2
million,
but
that
is
an
improvement
over
the
prior
year,
where
we
were
at
3.7
million
and
if
you'll
recall,
when
we
first
started
having
that
unrestricted
net
deficit
that
was
related,
putting
on
the
other,
what's
known
as
opeb
other
post-employment
benefits.
Yes,
I'm
sorry,
I
had
a
little
brain
freeze
here.
I
can
still
use
that
acronym,
thankfully
yeah
so
anyway,
so
we
are
improving
in
that
area
and
business
type
activities.
C
Just
one
change
on
the
title
page:
it's
not
the
title
page,
it's
the
second
page
where
it
lists
the
city
council
yeah.
If
I'm
not
mistaken,
I
believe
john
miller
was
the
council
member
and
not
gary
wine,
not.
V
B
I
If
I
could
for
just
a
moment,
thank
you
to
the
finance
department
for
all
the
work
they
put
into
this,
I
know
you're
already
working
on
the
next
one
and
thinking
about
the
next
one
and
the
next
one,
and
it
just
continues
not
to
mention
budget
and
all
the
departments
that
work
so
hard
to
give
us
a
good
clean,
a
lot
of
good,
clean
information
for
in
our
comprehensive
annual
financial
report
and
also
to
the
auditor
for
the
work
they
do
with
the
city.
A
lot
of
good.
I
Good
information
and
good
work
that
they
do
and
they
help
you
know
anything
that
needs
to
come
to
light.
They
help
provide
that
and
we
certainly
appreciate
the
whole
team
effort
that
goes
into
providing
a
document
such
as
this
because,
as
you
said,
you
know
if
anyone's
read
every
single
page
of
all
this
that's
quite
a
bit
of
information
there
and
it
gives
a
lot
of
good
information
about
the
city,
so
people
this
is
that
read
this.
It's
online
people
look
at
it
and
there's
a
lot
of
good
stuff
there.
B
T
Julie,
rogan
sutter
procurement
for
the
record,
I'm
here
to
present
your
award
for
the
agreement
of
a
city-wide
con,
concrete
construction
services
and
the
previous
term
contract
was
cancelled
in
august
26
2019.
Due
to
the
default
of
the
contractor,
the
city
then
piggybacked
a
charlotte
county
contract
for
similar
services,
while
the
scope
and
requirements
were
reviewed
by
the
public
works
department.
T
However,
based
on
the
revised
schedule
and
adding
additional
supplemental
items,
the
agreement
potential
annual
expenditure
should
all
items
be
used,
is
496
thousand
two
hundred
and
eighty
dollars.
Even
it's
important
to
note
this
is
a
term
contract
and
that
purchases
are
going
to
be
as
required
and
will
be
through
various
departments,
divisions
accounts
and
the
funds
are
previously
budgeted.
T
B
Questions
for
staff-
I
do
have
one
question:
what
what
fun
does
the
this
money
come
out
of
and
are
we
adequately
prepared
for
this?
This
is
a
significant
increase.
T
It's
not
the
way
this
is
done
because
they
added
supplemental
items,
and
this
was
like
this
is
the
second
time
I
bid
this
out.
It's
kind
of
the
potential
to
use
all
that
money
is
is
not
they're,
probably
not
they're,
using
funds
that
are
previously
budgeted
and
it's
a
task
orientated
contract,
so
they
they've
added
supplemental
items.
So
in
the
event,
we
need
a
specific
bollard,
there's
pricing
for
that,
and
they
estimated
quantities,
but
the
reality
is
they
may
only
use
it
once
or
twice
a
year.
T
So
all
the
funds
are
previously
budgeted
and
if
they
don't
have
those
funds,
we
probably
won't
use
that
for
95.
That's
what
I'm
saying,
and
in
retrospect
we
I
discussed
it
with
anne
and
there's
maybe
a
way.
We
can
evaluate
it
a
little
differently
next
time.
So
as
it
doesn't
seem,
such
a
big
increase.
R
These
are
funds
that
I'm
sorry
in
height
and
procurement.
For
the
record,
these
will
be
funds
from
budgeted
funds
from
the
general
funds
budgeted
for
each
department
on
a
yearly
basis
for
their
projects,
so
it
has
the
potential
of
possibly
using
at
a
maximum
475
000.
That's
why
we
brought
it
forth
the
council.
However,
it's
going
to
be
governed
by
the
yearly
projects
and
what
is
budgeted
yearly
for
the
different
departments
correct
and
what
we
can
get
finished
does.
B
This
also
include
the
one
percent
sales
tax
sidewalk
projects.
Would
they
be
the
vendors
for
for
the.
R
R
I
I
A
potential
cost
avoidance
that
you
had
listed,
526
thousand.
A
B
D
B
I
And
again,
just
to
lead
into
this.
Obviously
urban
design
has
put
together
a
summary
of
where
we
are
given.
We
don't
have
all
the
right
away
that
was
initially
anticipated
and
also
you'll,
see
in
here
that
there
were
the
original
options
that
you
were
given
when
you
decided
what
direction
you
wanted
to
take
so
they'll
go
over
all
that,
then
you
can
discuss
where
you
want
to
go
with
it
and
we'll
make
it
happen.
I
W
Record
mitchell
austin
principal
planner
urban
design,
as
the
city
manager
mentioned.
The
the
project
here
on
east
virginia
avenue
is
complete
streets
project
between
us,
41,
northbound
and
nesbitt
street.
There
are
four
adjacent
properties,
florida
power
and
lights,
city
mark
the
old
usage
site
and
then
the
ice
house
building
and
the
cedar
point
offices.
W
In
the
middle
of
last
year,
staff
city
staff
provided
the
three
options
that
you
see
on
the
screen
here
in
terms
of
how
the
street
could
be
configured
conceptually.
W
Those
three
options
were
based
on
our
general
understanding
of
the
site
and
the
existing
right-of-ways,
and
those
assumptions
proved
to
be
a
little
bit
less
optimistic
later
in
2020.
The
consulting
engineer
provided
the
following
two
options:
based
on
that
mid-2020
city
council
direction,
the
option
c.
So
the
parking
maximization
that
that
city
council
was
looking
for
was
a
combination
of
parallel
and
diagonal
parking
spaces
on
the
right-of-way
all
operating
entirely
within
the
city's
rights
of
way.
W
There
may
be
some
opportunity
to
increase
that
by
maybe
one
or
two
spaces,
depending
on
how
things
work
out,
but
that's
about
it
in
terms
of
council
asking
us
to
go
to
the
adjacent
property
owners
and
inquire
about
their
interest
in
in
potential
easements
or
closing
driveways
or
any
of
those
types
of
things.
W
If
you
look
at-
and
it
may
be
difficult
to
see,
I
have
a
larger
image
of
this
later
on
the
roadway.
The
engineer
is
showing
it
shifting
the
reason
for
that
is
on
the
north
side
of
the
right-of-way.
There
are
some
overhead
utility
lines
that
are
quite
substantial
and
would
be
tens,
if
not
hundreds
of
thousands
of
dollars
to
relocate
or
reconfigure.
W
W
So
we
did
go
out
and
have
discussions
with
the
stakeholders.
The
property
owners,
cam
realty,
actually
manages
two
of
the
properties,
the
ice
house
and
cedar
point
offices.
So
the
property
owner
directed
us
to
speak
with
them.
They
definitely
preferred
option
c1.
They
wanted
to
see
maximization
of
the
parking
because
it
would
be
beneficial
to
those
area,
businesses
that
are
tenants
of
those
facilities.
W
They
did
recommend
that
the
the
one
provided
accessible,
ada
space
be
moved
as
close
to
the
ice
house
facility
as
possible
because
that's
where
they
see
the
greatest
demand,
those
on-site
ada
spaces
are
frequently
full
during
peak
hours
and
and
people
who
otherwise
would
benefit
from
those
spaces
have
to
park
elsewhere.
So
in
our
discussion
with
bnb
holding,
they
also
and
that's
the
former
usave
site,
they
also
preferred
option.
C1
their
property,
obviously
is
vacant.
Definitely
maximizing
pro
on
street
parking.
W
W
The
final
and
this
actually
took
quite
a
while
because
we
had
to
get
hold
of
the
right
people
and
their
real
estate
and
operations
divisions
was
the
discussion
with
florida
power
and
light
again.
The
the
big
ask
from
the
city
was
an
approximately
10-foot
wide
right-of-way,
our
easement
area,
which
would
run
along
the
length
of
their
property
on
east
virginia.
W
Unfortunately,
florida
power
and
light
did
not
see
it
that
way,
they
do
know
from
an
operational
perspective
that
the
potential
is
there
to
expand.
That
facility.
The
the
electric
demand
needs
are
not
going
to
go
down
in
puna
gorda
anytime
soon
according
to
their
product
projections,
so
they
would
not
entertain
a
permanent
easement
agreement
for
that
property.
For
the
proposed
street
improvements,
they
did
say
that
they
would
entertain
a
temporary
easement
agreement.
W
The
possible
cost
of
that
would
be
unknown
to
the
city,
however,
and
additionally,
they
would
be
able
to
cancel
at
their
sole
discretion
at
any
time
and
usual.
Usually
they
have
a
90-day
removal
clause
for
all
of
the
improvements
within
that
easement
area,
temporary
easement
area,
so
staff.
W
Definitely
given
those
conditions
from
from
florida,
power
and
light
recommends
against
and
entering
into
such
a
temporary
easement
agreement.
W
The
level
of
improvements
required
to
make
the
the
area
safe
to
drain
properly
etc
would
would
would
likely
be
substantial
and
reworking
that
would
be
a
challenge
within
a
90-day
time
frame
and
and
potentially
very
costly.
W
W
I
was
reminded
that
these
funds
are
actually
from
not
the
current
authorization
but
the
prior
authorization,
so
those
funds
would
have
to
be
to
one
of
those
eligible
projects
approved
under
the
previous
sales
tax
extension.
Not
the
current
one
option
two
is
to
proceed
with
a
design
which
is
completely
within
the
existing
city
right-of-way.
W
C
Questions,
it's
not
a
well.
C
I
was
wondering
about
the
idea
of
going
on
ahead
and
doing
the
north
side
of
the
street,
as
we
have
talked
about
and
doing
the
south
side
up
into
the
fpl
property,
and
then,
when
it
comes
to
the
fpl
property,
just
doing
nothing
don't
put
curb
and
gutter
in
just
leave
it
the
way.
It
is
because
and
people
just
park
on
it
anyway,
and
and
then
that
way
we're
not
eliminating
that
parking
on
the
south
side
of
the
street.
C
If
someone
doesn't
feel
like
gee,
I
don't
have
sidewalk
to
walk
on
well,
they
can
cross
the
street
and
walk
on
the
new
sidewalk,
and
but
we
are
at
least
making
the
the
end,
the
par
the
portion
from
41
over
to
the
alleyway
much
more
safer
and
and
then
making
things
safer
on
the
north
side
of
the
street,
where
we
do
have
the
right-of-way
and
then
we're
not
eliminating
all
that
parking.
B
I
agree
that
we
need
to
do
something
we've
already
committed
to
doing
this,
and
the
money
is
allocated
from
last
sales
tax
project
list.
So
I
I
want
to
see
us
finish
something
we've
started
here
as
much
as
I'd
love
to
use
that
money
for
something
else.
I
know
we
can't.
I
I
had
a
similar
suggestion.
What
I
suggested
is
we
don't
pave
any
of
the
fpl
frontage
at
all.
D
B
Maybe
just
put
cement
car
stops
so
that
it
does
designate
some
kind
of
parking
spaces
on
that
area,
but
don't
pave
it
and
don't
put
sidewalks
and
don't
put
any
other
enhancements
on
that
side,
which
is
similar
to
what
you
just
said.
But
but
it
would
still
allow
people
to
use
that
space
for
parking,
unofficially
and-
and
I
don't
know
that
we
would
need
to
get
an
easement
from
fpl
to
do
that.
So
I
I'm
just
and
of
course,
with
all
any
changes
we
make
to
this.
B
It
could
save
us
money,
especially
not
having
to
pay
the
south
side
of
the
road.
I
think
that
that's
something
else,
and
then
we
may
still
have
funds
left
over
to
fund
another
project
from
last
year's
sales.
Tax
list.
C
A
I
had
a
member
of
my
cabinet.
Ask
me
if
we
could
make
a
suggestion
to
punta
gorda
in
bloom
that
they
plant
some
planters
or
trees
at
appropriate
places
along
there,
so
that
at
least
the
fpl
site
wouldn't
be
so
ugly.
Because
you
know,
if
we're
trying
to
turn
this
into
a
pretty
place
and
they
won't
let
us
park
there.
Then
maybe
a
couple
planters
with
some
flowers
would
do
the
trick,
but
I
want
to
take
up
parking,
but.
B
W
Oh,
so
that
that's
on
the
the
the
old
you
save
site
right,
so
he
was,
he
was
basically
their
position
was
if
the
city
needed
an
easement
for
them,
we
would
have
to
negotiate
compensation
for
that
easement.
D
B
W
Yeah
everything's
within
the
right-of-way,
in
fact,
and
it's
difficult
to
see.
Sorry
it's
difficult
to
see,
but
the
the
property
line
is
is
right
here.
This
dashed
line,
okay,
there's
actually
a
little
gray
space
here
that
represents
where
those
poles
occur.
So
our
improvements
have
to
be
south
of
that,
essentially,
because
those
poles
are
substantial
and
there's
guy
wires
and
all
kinds
of
obstructions.
J
I
was
going
to
come
up
with
the
same
proposal
that
nancy
came
up
with.
I
like
the
idea
at
least
to
put
temporary.
What
do
you
call
those
things
the
the
wheel
stops
the
wheel
stops
over
there,
so
that
gets
a
little
bit
more
properly
used
right
now.
I
notice
people
walking
here
driving
in
there.
They
just
park
any
which
way,
and
you.
H
D
T
J
A
couple
more
spaces
than
normally
out
of
that
side,
and
so
I
was,
and
we
do
have
a
what
the
broken
ground
project
still
from
the
last
go
around.
So
I
don't
think
we've
got
any
issue
with
where
the
money
rest
of
the
money
could
go,
that
we
could
save
by
not
doing
anything
on.
B
C
N
B
N
B
C
That
right,
I'm
proposing
no
curbing
right,
that
we
do
the
curbing
and
stop
it
at
the
fpl
property
line
right
so
that
that
from
the
fpl
property
line
eastward
there's,
we
don't
do
anything.
W
Just
to
clarify
what
we're
talking
about
option,
two,
as
stated
here,
is
a
complete
redo
of
the
entire
city,
controlled
public
right-of-way,
which
is
66
feet
wide.
That
would
include
conceptually
parallel
parking
and
sidewalk
on
that
side.
To
finish
that
out,
no.
J
W
I
Right,
we
wouldn't
do
that.
We
would
just
obviously
that
corner
as
you've
said
before,
really
needs
cleaned
up.
So
we
would
just
do
the
project
clean
up
everything,
stop
at
fpo
and
be
done.
A
C
C
N
B
D
B
W
I
I
That's
been
had
recently
on
the
reduction
or
elimination
of
restrictions
that
were
related
to
covet
19
pandemic,
especially
given
the
executive
orders
that
the
governor
issued,
which
we
know
we're
still
within
our
right
to
do
what
we're
currently
doing,
but
it
certainly
bumps
up
against
the
line
of
what's
being
required
by
the
governor's
executive
order,
and
certainly
what
other
people
were
doing
with
our
event
permits
when
we
opened
up
our
permits.
I
We
still
have
that
in
place,
and
at
this
point
it's
it's
becoming
an
issue
where
we
may
require
certain
social
distancing
functions,
but
then
the
general
public,
that's
around
all
those
functions,
certainly
limits
the
effectiveness
of
anything
we're
trying
to
accomplish.
As
a
matter
of
fact,
it
creates
some
additional
problems
that
we
have
to
deal
with.
At
this
point
and
just
as
an
extreme
example,
we
could
even
use
something
like
the
farmer's
market,
where
we
have
certain
tents
and
those
tents
may
be
distanced
by
a
certain
amount
and
in
front
of
those
tents.
I
We
have
hundreds
of
people
that
are
all
not
masking
or
milling
around
coughing
and
spitting
on
the
tomatoes
you
know
whatever
it
may
be,
but
you
know
with
all
the
people
that
are
there.
You
know
we.
We
have
to
allow
that
number
of
people
and
can't
enforce
any
mask.
Indeed,
there's
no
requirement
for
mask,
but
at
the
same
time
we're
preventing
one
vendor
that
wants
to
sell
corn,
because
we
have
that
space
open
for
social
distancing.
I
So
we're
really
not
accomplishing
anything
by
doing
that,
except
restricting
some
of
the
vendor
participation
that
we
may
want
to
see,
and
that's
one
example.
Obviously,
but
that's
the
issue
with
requiring
still
requiring
a
coveted
plan
or
a
distancing
plan
for
special
events
permits.
I
believe
that
pretty
much
encompasses
that
and
then,
of
course,
we
still
have
other
distancing
requirements.
I
For
example,
when
we
look
at
the
first
page
of
the
agenda,
you
can
see
that
it
says
that
there's
a
limitation
on
things
specifically
in
this
room,
even
which
is
why
we
still
take
email
and
when
we
talk
about
limitations
or
restrictions,
that's
exactly
what
some
of
the
orders
out
there
are
trying
to
remove,
so
that
everything
is
now
more
open
and
able
to
be
accessed
by
the
general
public.
I
So
as
discussion,
the
event
permits
that
it
was
requested
that
we
have
a
coveted
plan
if
you
were
interested
in
at
this
point,
removing
that
limitation.
That
could
be
viewed
as
a
positive
thing
by
some
of
the
vendors
specifically
or
the
ones
that
are
applying
for
the
event
permits
and
certainly
in
our
own
offices.
We
still
encourage
you
know
anyone
that
feels
it's
necessary
to
be
compliant
with
the
wearing
mask
or
distancing.
B
I
think,
just
as
importantly,
you
know
I
was
at
the
murdoch
administrative
center
this
week
for
the
mpo
meeting
and
they
don't
have
masks
anymore.
Nobody
in
the
building
had
to
have
a
mask,
so
I
think
we
may
be
at
that
precipice
right
now,
whether
we
enforce
it
even
here
in
our
buildings,
anymore,.
C
C
B
C
A
B
B
I
G
Attorney,
thank
you.
Yes,
chief
davis
asked
me
to
present
something
to
you
this
morning.
You'll
recall
that
we
adopted
an
ordinance
to
try
to
protect
the
fuel,
dispensing
machines
from
being
circumvented
and
skimmers,
and
all
that
and
and
not
withstanding,
that
ordinance
the
the
equipment
has
been
circumvented.
G
So
you
suggested
that
we
propose
an
ordinance
to
come
up
with
some
stricter
security,
and
so
we
did
draft
that
and
and
chief
davis
ran
it
by
the
department
of
agriculture
and
consumer
services,
and
we
were
informed
that
in
this
past
legislative
session,
the
legislature
preempted
all
regulation
of
the
the
fuel
dispensing
equipment
and
we've
verified
that
our
ordinance
would
be
governed
by
that
preemption.
So
you
will
not
be
seeing
an
ordinance
making
our
our
current
ordinance
more
stringent.
Our
current
ordinance
is
consistent
with
the
requirements
of
the
state
law.
Okay,
but.
G
Do
anything
further
than
what
we
already
have
and,
on
a
personal
note,
I'd
like
to
give
a
shout
out
to
my
wife,
who
is
up
in
maine,
watching
she's
there
and
providing
comfort
to
a
relative
that
is
in
the
hospital
with
covid.
So
as
a
personal
public
service
announcement,
please
get
vaccinated,
ignoring
the
virus
does
not
make
it
go
away.
Thank
you.
D
B
G
P
They'll
find
a
way,
it'll
be
a
challenge:
okay,
good
afternoon,
hello,
just
a
few
vacancies,
so
we
currently
have
vacancies
on
the
board
of
zoning
appeals
for
two
alternates,
the
code
enforcement
board.
We
have
one
alternate
and
one
unexpired
term.
As
a
regular
member.
P
We
have
a
three
year
term
on
the
burnt
storals
canal
advisory
committee.
We
have
a
three-year
term
on
the
general
employees
pension
board,
that's
their
fifth
member,
it's
actually
appointed
by
the
other
four
boards.
However,
we
still
announce
that
vacancy
through
council
and
council
will
confirm
that.
B
Under
policy
and
legislation,
I
just
have
a
couple
of
quick
things:
the
mpo
board
meeting
was
a
monday,
and
one
of
the
things
I
was
asked
to
do
by
my
contact
at
fdot
was
to
extend
my
comments
to
fdot
on
their
proposed
median
changes
on
41
for
those
who
were
at
the
meeting
last
week.
I
don't
know
how
you
felt,
but
I
was
pretty
disappointed
in
the
presentation,
but
the
fdot
is
proposing
to
make
numerous
median
changes
on
41
from
rio
villa
south
to
payne
road.
B
I
guess
it
is,
and
I
had
I
had
a
couple
of
comments
about
two
intersections
in
particular
that
I
feel
very
strongly
about,
so
I
was
asked
to
put
it
in
writing,
which
I
did
and
we
discussed
it
at
the
mpo
meeting
on
monday.
B
Eckline
road
is
a
major
funneling
point
for
our
fire
station
and
I
have
a
huge
concern
if
they
close
off
the
full
opening
at
that
median
there.
I
think
that
would
be
a
major
major
safety
and
security
problem
for
our
fire
station.
Just
last
week
we
had
an
eight
car
pile
up
between
akline
and
and
jones
loop
and
all
of
our
first
responder
vehicles
had
to
go
to
that
scene,
so
it
is
definitely
a
necessary
opening.
B
While
I
know
rio
villa
is
a
problem.
What
they're
proposing
to
do
is
close,
that
median
off
as
well
and
make
left
and
right
turn
lanes
only
for
a
left
turn
northbound
onto
rio
villa
and
and
a
u-turn
to
go
northbound
off
of
41
from
southbound
to
northbound
and
by
doing
that,
all
of
the
semi
tractor
trailer
deliveries
for
all
the
businesses
on
rio,
villa
on
baynard
and
all
those
streets
back.
B
There
are
going
to
be
funneled
over
to
a
kia
star
and
we've
already
got
a
huge
tie
up
of
traffic
on
akiesta
and
that
first
block,
where
it's
got
the
divided
road.
When
you
come
in
off
of
41,
you
you
frequently
back
up
on
to
41
in
the
through
traffic
lane
to
turn
left
going
northbound
onto
onto
a
kia.
Stop
so
we're.
C
B
I'm
really
being
loud
about
it,
so
you
know,
and-
and
chris
constance
backed
me
up
and
so
did
stephen
r
george
and
so
did
joe
tuseo
and
jim
hurston.
So
I
brought
it
up
at
the
mpo
meeting,
so
it
would
be
out
there
it's
on
the
public
record.
I've
also
sent
a
letter
to
them
and
I
signed
it
as
the
mayor.
B
I
didn't
sign
it
on
behalf
of
the
city,
but
I
signed
it
as
the
mayor
with
my
personal
comments,
and
I
prefaced
it
in
my
email
by
saying
these
are
my
personal
opinions,
but
as
a
full-time
resident
who
travels
these
roads
frequently
every
day.
This
is
how
I
feel
about
it.
I've
shared
it
with
all
the
mpo
board
members,
I've
shared
it
with
lk
nandam
and
I've
shared
it
with
wayne
gaither
from
fdot.
B
Stop
because
on
at
least
four
occasions
since
april
1st,
I
would
say
I
have
been
in
the
through
traffic
lane,
waiting
to
get
into
the
left
turn
lane,
and
so,
when
you're
sitting
out
there
and
moving
straight
line
traffic
and
you're
trying
to
make
a
left
turn,
the
back
end
of
your
car
is
going
to
get
clipped
off
sometime
or
another,
and
I
think
it's
very
unsafe
and
they've
already
extended
turn
lanes
on
other
intersections
north
of
us.
I've
asked
that
they
consider
doing
that
at
that
intersection.
So
I'm
fighting
for
those
changes.
B
I
hope
I
hope
that
everybody
agrees
with
me
on
those,
but
I
feel
really
strongly
about
public
safety,
and
I
think
those
are
all
big
safety
concerns.
So
I
share
those
with
you.
If
you'd
like
to
write
letters,
I
would
welcome
you
to
do
that
as
well,
and
I
can
give
you
who
to
contact
and
I'd
be
happy
to
share
that
with
you.
So,
in
fact,
I
can
even
share
the
letter
with
you,
since
I've
already
discussed
it
at
this
meeting.
B
So
that's
all
I
have,
and
I
thank
you
for
indulging
me
for
a
minute
and
one
last
time,
thank
you
to
all
the
staff
and
to
the
city
attorney
for
all
your
work
on
the
sign
ordinance.
It
was
a
lot
of
work.
I
know
it
was
a
lot
of
work
and
we
feel
we
feel
your
pain
because
we've
been
through
it
too,
but
you
know
hopefully
we're
on
the
right
track.
So
thank
you
and
we
go
to
mr
cummins
yeah.
J
J
J
That
I
too,
on
echo
lynn
concerning
the
sign
ordinance
and
the
work
that's
gone
into,
that
it
can't
be
easy.
It
was
just
difficult
enough
for
me
to
read
it
every
time,
and
so
thank
you
for
that.
A
Thank
you.
I
would
like
to
give
a
shout
out
to
the
civic
association's
board
of
directors.
I
met
with
them
last
week
and
I
told
them
that
you
know
it's
usually
a
one-way
street.
They
usually
are
coming
to
us
asking
for
things,
and
this
time
I
was
coming
to
them
asking
for
something
as
a
continuation
of
trying
to
keep
our
canals
and
our
waterfront
properties
pristine
and
our
you
know
everybody
working
from
the
same
plane.
A
I
remembered
that
I
had
been
given
this
pamphlet
when
I
came
to
the
city
and
so
julie,
ryan
who's.
My
new
best
friend
printed,
several
hundred
copies
of
these,
the
civic
association,
is
going
to
be
handing
them
out
to
all
new
members
and
anybody
at
the
civic
association
who
wants
to
come
in
they
will
be
in
the
kiosk.
You
can
pick
it
up.
A
We
will
be
able
to
curtail
some
of
that,
and
you
know
I
would
encourage
if
anybody
out
there
is
still
listening,
though
we're
going
into
late
afternoon.
Meeting
please
stop
by
you.
Don't
have
to
be
a
member
of
the
civic
association
to
pick
it
up,
and
I
have
several
hundred
more
that
the
utilities
department
printed
for
me
because
there
was
a
crossed
wire
somewhere,
we'll
get
them
to
you
if
you
need
it,
and
I'm
also
going
to
start
talking
to
realtors
about
handing
this
out
to
new
homeowners.
C
Nancy,
yes,
I
echo
the
same
comments
about
to
staff
and
to
david
about
the
sign
ordinance.
I
know
that
we're
still
going
to
be
spending
a
lot
of
time,
educating
residents
about
it,
we're
still
going
to
be
educating
residents.
Why
we,
the
signs,
are
the
size
they
are
whatever,
but
I
sent
a
letter
off
to
zack.
C
It
was
the
chair
of
the
the
the
the
project
for
the
repaving
and
the
closing
the
planes
from
the
pain
to
rio
villa
regarding
madrid
boulevard,
and
I
did
not.
I
copied
the
mitchell,
but
I
didn't
copy
any
of
the
council.
I
think
I
copied
city
managers
didn't.
I.
C
Now
that
I'm
talking
about
it
here,
I
can
send
it
to
you
all,
but
I
didn't
copy
you
all,
because
I
didn't
I
didn't
want
to
violate
the
sunshine
but
the
I
I
included
a
document
that
I
think
mark
gearing
helped
create
about
it
and
I
included
a
visual
of
diplomat
boulevard
and
I
copied
bill
courtney
from
burnsville
owes
association,
and
I
know
he's
commented
on
it.
Trying
to
stress
that
diplomat.
We
believe
diplomat,
parkway
the
what
the
solution
that
they've
fdot
implemented.
There
would
be
a
perfect
solution
for
madrid.
C
It
would
never
stop
northbound
traffic
on
41.
It
would
only
signalize
the
southbound
lane
and
the
southbound
the
the
traffic
could
stop
and
be
concurrent
with
the
the
light
at
41.
So
it
would
you
know
it
would
be
so
easy
to
do,
but
they
just
refuse
to
listen
because
it's
not
in
their
reading
book,
and
so
I
don't
know
if
sending
it
to
zach
is
going
to
make
any
difference.
C
C
You
know
I
mean
because
it
was
there
weren't
that
many
houses
built
in
burnt
store
isles
and
people
were
playing
golf
and
you
could
see
across
you
know
you
could
there
were
hardly
any
homes
in
the
beginning,
but
you
know
that's
different
now
and
so
and
they're
not
they
don't
live
here.
They
don't
see
this
every
day.
So.
B
I've
invited
them
to
come
and
sit
at
the
intersection
near
baynard
and
akiyastra
for
just
five
minutes
to
see
what
we're
talking
about
with
the
traffic
flow
that
goes
through
there
same
thing,
I
mean
they're,
making
decisions
that
they
feel
are
safer,
but,
in
my
opinion,
neither
one
of
those
changes
that
I
mentioned
earlier
are
safer
they're.
In
fact,
it's
going
to
make
it
worse,
it's
definitely
not
going
to
improve
safety.
C
And
I
understand
one
of
the
reasons
why
they
want
to
do
what
they
want
to
do
at
rio.
Villa
is
because
of
accidents
and
so
they're
they're
using
statistics
and
they're
saying:
okay,
we
have
to
to
reduce
the
accidents
and
they
don't
want
to
add
more
signals
because
they
say
well
the
the
speed
of
the
road
and
the
traffic,
and
I
they
have
all
their
their
traffic
theories.
I
am
not
a
traffic
engineer,
but
you
know
it
was
it's
40
miles
an
hour
there.
We
don't
need
to.
C
We
can
keep
it
40
down
to
rio
villa
they
can
keep
it
so
that
it
it
makes
logical
sense
to
have
a
light.
There
I
mean
it's
and
I
you
know,
I've
had
them
say
well.
Signalization
does
not
necessarily
improve
safety,
so
I
guess
there's
an
answer
for
everything:
if
they
don't
want
it,
they've
got
a
retort
so
yeah
anyway,
I
said.
Thank
you.
It's
been
interesting,
you
know
it's
been
a
good
meeting.
Good
dialogue,
yeah.
B
Okay,
are
there
any?
Well,
then
we
don't
have
citizen
comments
at
the
end
anymore.
Okay,
so
have
there's
no
further
business.
We
are
adjourned.
