Description
Code Enforcement Board 9-15-2021
B
I
don't
know
a
strict
sunshine
part
of
this,
but
it
seems
to
me
that
if
there's
going
to
be
any
stage
the
way
these
words
are
kind
of
open-ended-
and
I
wouldn't
want
to
say
something
like
a
set
court
date.
B
C
A
E
F
A
B
A
Okay
with
all
those
persons
who
plan
to
provide
testimony
before
this
board,
please
stand
and
be
sworn
in.
B
A
A
Okay,
I'll
read
off
the
case,
numbers
and
the
citation
and
then
at
the
end
we
will
ask
for
a
motion
pursuant
to
the
city's
request.
A
B
Once
again,
david
mccarty
compliant
supervisor,
I've
been
sworn
the
reason
we're
asking
for
these
continuances
is
for
the
reason
of
illness
of
the
two
respondents.
That's
the
reason
we're
asking
for
it
continues.
E
Yeah,
I
don't
know
that
it'd
be
appropriate
to
do
that.
We
received
letters
from
each
of
the
respondents
indicating
that
they
were
ill.
There's
no
reason
for
us
to
based
on
this.
You
know
the
privacy
of
the
respondents
and
and
all
I
let's
just
go
ahead
and
grant
the
continuance
based
on
their
allegation
of
illness,
and
I
think
that
would
be
the
appropriate
action.
E
E
If,
if
it,
if
it
is
prolonged,
we
might,
I
might
have
a
different
opinion,
but
but
right
now,
I
think
that
it's
best
to
grant
the
continuance
based
on
the
alligator
written
allegations
that
we
received
the
written
requests
we've
received
by
both
respondents
and
and
and
if
necessary,
reconsider
that
at
the
next
at
the
next
code
enforcement
board
hearing,
if
we
proceed
without
them,
they
have
an
immediate
argument
of
denial
through
process.
So
let's
take
the
the
path
of
least
resistance,
take
their
allegations
at
face,
value
and
and
and
move
on.
D
On
advice
of
the
attorney,
my
motion
is
now
just
to
continue
these
cases
until
the
next
board
meetings.
Thank
you.
C
D
A
Have
a
a
motion
to
continue
cases
two
dash
a
in
the
list,
two
dash
h.
This
has
been
a
second.
Is
there
any
discussion
on
the
motion?
All
those
in
favor
of
granting
the
motion,
please
signify
by
saying
aye
aye
motion
carries.
A
B
A
I
have
no
problem
with
any
any
type.
Okay,
that's
fine!
We
will
now
take
up
a
request
for
fine
reduction
in
case
20-77962.
H
H
I
I
Would
it
be
okay
if
I
wait
on
the
outside,
because
both
my
husband
and
I
are
high
risk
medically,
have
highest
medical
issues
and
I'd
like
to
know
when
my
name
is
called?
Would
it
be
okay,
if
I
just
wait
outside
until
my
name
is
calm.
A
Okay,
we're
back
on
the
record.
A
We
are
we'll
consider
a
request
for
fine
reduction
in
case
two
zero:
seven:
seven,
nine
two
co-compliance
officer,
alan
mcdaniel
respondent
anna
marazova,
address
of
violation,
2735
rio
court
violation
of
chapter
26,
section
8.11.,
sub
e,

palm
fronds,
violation
of
chapter
9,
section,
9-2,
subset,
h,
stagnant
pool
water,
who
will
be
testifying.
Please
state
your
name
well.
This.
J
A
A
Well
then,
I'm
going
to
ask
you
you're
asking
for
a
fine
reduction.
It's
your
opportunity
to
tell
us
why
you're
entitled
to
this
relief.
B
C
B
H
G
H
C
E
E
Familiar
with
with
the
respondent's
position,
okay,
the
interpreter
will
be
available
to
answer
any
questions
that
the
respondent
may
have
to
clarify
the
situation,
but
it
might,
it
might
make
things,
go
a
little
smoother
we're
dealing
with
basically
an
argument
by
the
respondent
as
to
why
the
the
fine
should
be
reduced,
and
then
his
porter
could
speak
on
her
behalf
if
the
respondent
is
okay.
With
that
all.
H
G
This
is
the
interpreter
speaking.
Would
you
like
me
to
interpret
this
part.
H
H
H
G
Oh
sorry,
this
is
the
interpreter
speaking.
Would
you
be
so
kind
to
repeat
from
section
162.
E
Well,
if
I
might
yes,
this
is
the
opportunity
for
the
respondent
to
ask
or
tell
you
why
she
wanted
why
she
feels
entitled
to
the
reduction
in
fine.
I
understand
there
were
some
extenuating
circumstances
about
her
ability
to
be
back
to
the
united
states
after
traveling
to
russia
and
so
interpreter.
Please
explain
that
to
the
respondent
and
then
the
respondent
can
tell
her
story
and
you
can
interpret
it
for
the
board.
Please.
J
E
J
J
G
Go
to
russia
all
right.
This
is
in
terms
of
second,
I
will
ask
the
client
to
to
use
much
bigger
segments
of
information,
so
I
can
translate
part
by
part.
G
G
J
G
So
I
couldn't
leave
my
husband
alone.
Even
if
the
flies
were
were
available
again,
he
continued
to
be
very
ill
with
the
covet.
He
had
a
very
severe
covet,
but
not
me
so
then
he
also
took
a
time
for
recovery.
G
G
G
So
on
june
27th
2021
the
doctors-
they
decided
that
my
husband's
able
to
fly
the
long
distance,
so
I
had
just
one
day
to
prepare
all
of
the
documents
and
to
translate
that
doctor's
record
notes
about
my
husband's
condition.
So
if
it's
needed,
we
have
the
whole
folder
of
additional
documents,
which
I
can
I
can
send
to.
The
translation.
E
Mr
chairman,
if
I
might
yes,
the
the
respondent,
as
part
of
her
request,
submitted
a
letter
which
she
signed
apparently
dated
august
10
2021.
E
And
if,
if
the
interpreter
would
ask
the
anna
the
respondent,
if
she
would
adopt
that
letter,
plus
the
documents
that
were
submitted
with
that
as
true
and
accurate,
as
and
as
her
testimony
under
oath,
we
might
be
able
to
move
this
along
a
little
bit
quicker.
E
I'm
sorry,
I'm
sorry,
I'm
wearing
a
mask.
Ask
please
ask
ms
morizova
if
she
would
adopt
the
letter
that
she
dated
august
10th
2021
and
the
supporting
documents
that
were
submitted
to
the
city
along
with
that
letter,
as
as
her
testimony
under
oath.
E
Would
you
ask
her
please
if
she
has
anything
else
to
add
other
than
what
she's
already
said
under
under
oath
today,
as
well
as
with
respect
to
the
documents
she
submitted
in
support
of
her
request.
G
G
So
these
documents
I
mentioned
before
I
have
this
big
folder
of
the
document
they
are
stating
about
all
my
husbands,
illnesses
diseases
and
it's
described
in
detail
because
and
the
time
frame
as
well,
because
this
letter,
which
was
attached
to
to
this
claim
it's
written
shortly-
it's
just
the
date
and
time,
but
the
documents
I
have
there
is
there
is
my
husband's
condition
described
in
detail.
But
it's
not
translated
yet.
E
Thank
you.
I
I
think,
mr
chairman,
I
think
the
documents
that
were
submitted
with
her
letter
and
the
interpretation
or
additions
that
the
witnesses
testified
two
should
be
sufficient.
I
don't
think
we
need
those
originals
since
they're,
not
in
english
anyway,.
G
G
A
B
A
B
A
A
And-
and
I
agree
with
mr
stockolatto
that
I
find
that
the
documentation
is
more
than
adequate
to
establish
a
cause
for
the
problem
and
officer
faulkner
has
testified
that
the
problem
has
been
resolved.
So
that's
our
purpose
here.
C
Eight
one
percent
applicable
interest
issued
in
the
previous
order
on
march
24,
2021
plus
additional
case
costs
incurred
in
the
amount
of
18
and
84
cents
is
reduced
to
200,
and
it
is
further
ordered
that
the
respondent
shall
submit
full
payment
within
10
days
of
the
entry
of
this
order
after
payment,
the
city
shall
issue
a
satisfaction
of
lien
which
shall
be
recorded
by
the
respondent
at
their
sole
costs
and
expense
and
further
order
that,
if
the
respondent
fails
to
submit
full
payment
to
the
city
within
the
time
frame
specified
here
in
the
remaining
unpaid,
fine
in
the
amount
of
seven
thousand
thirty
four
dollars
and
fourteen
cents
plus
four
point.
E
A
A
I
E
Okay,
so
if
we
might
interpreters
stay
on
the
line
just
for
a
moment.
E
All
right,
I'm
this
by
the.
G
E
Yes,
this
is
the
city
attorney
speaking
just
advise
the
respondent
who
it
is
that
is
speaking
presently.
G
E
All
right,
I'm
going
to
I'm
going
to
read
the
order
that
was
just
approved,
so
I'm
going
to
read
it
slowly
and
stop
at
appropriate
spots.
E
And
it
is
further
ordered
that
if
the
respondent
fails
to
submit
full
payment
to
the
city
within
the
time
specified
herein
defined
in
the
amount
of
seven
thousand
dollars
plus
case
costs
incurred
in
the
amount
of
thirty
four
dollars
and
fourteen
cents
plus
4.81
percent
applicable
interest
shall
remain
valid.

L
As
of
this
morning,
everything's
been
removed,
as
I've
been
corresponding
with
mr
faulkner.
L
My
mind
moves
faster
than
my
body
actually
is
willing
to.
I
have
a
lot
of
things
going
on
in
my
in
my
life
right
now,
I'm
tearing
apart
the
inside
of
my
house
to
accommodate
my
father,
who
is
going
to
be
moving
back
with
me.
He
has
parkinson's
and
needs
handicap
and
space
and
everything
to
get
around.
L
So
I've
been
pulling
things
out
and
throwing
things
out.
I
had
to
sell
his
house.
That's
where
a
lot
of
the
things
accumulated
on
the
outside
of
my
house
from
I
had
to
move
it
all
out:
2
400
square
foot,
space
to
my
1200
square
foot
space
doesn't
exactly
fit.
L
It's
a
running
terrible
joke
with
my
family
that
every
holiday
he
hits
he's
in
the
hospital
he's
gone
international
recently
with
cinco
de
mayo
at
times,
which
I'm
constantly
running
there,
I'm
never
at
home.
Unfortunately,
to
do
whatever
I
have
to
do.
I
have
multiple
injuries
to
my
spine
and
cancer,
which
slows
me
down.
I've
corresponded
with
nick
telling
him
this
he's
passed
by
and
stopped,
and
I've
talked
to
him
as
of
this
morning.
I
actually
got
some
help
to
help
clean
up
the
outside
of
the
house.
L
K
As
long
as
everything's
inside
of
that
that's
okay,
if
it's
outside
it
could
be
clearly
seen
from
the
adjacent
property
which
would
be
still
a
violation.
L
Okay,
so
that's
all
been
cleared,
the
walkway
that
I've
been
trying
to
do
since
this
has
been
happening
has
been
completed
and
the
porch
is
cleared.
L
L
L
L
I
have
to
put
a
ramp
on
my
house,
so
I'm
having
stuff
delivered,
probably
within
the
next
couple
of
weeks,
maybe
by
the
end
of
october,
when
the
ramp
is
set
on
my
house.
L

L
Understand
I
don't
like
my
house
looking
like
white
trash
either.
You
know
I
mean
I
joke
with
my
neighbors,
I'm
so
sorry,
I'm
so
sorry,
you
know
you
know,
and
they
understand
and
like
I
said
hopefully
I'll
have
the
ramp
done
by
october.
Again
my
mind
moves
a
lot
faster
than
my
body
does.
Right
now
I
have
multiple
spine
injuries,
so
where
I
say
before
the
injuries
happened,
I
could
have
had
it
done
all
one.
Two
three
now
it's
one,
two
okay,
my
body,
says
shut
down.
K
The
pictures
that
I
took
were
from
yesterday
yeah,
but

yeah.

submitting
an

I
No,
not
at
this
time
I'll
first
explain
what
my
situation
is
and
then
of
course,
I'll
ask
questions
that
I
have
to
first
of
all
good
morning,
everyone.
I
first
wanted
to
bring
to
your
attention
that,
from
march
of
2019,
I've
made
complaints
with
the
city
in
regards
to
the
overflowing
of
the
swell.
In
fact,
my
swell
has
a
tremendous
amount
of
water,
as
fact
so
much
water
until
it
just
pretty
much
is
like
a
lake
I'd
like
to
submit
photos.
I
If
I
can
so,
you
could
see
what
my,
how
do
I
get
it,
she
can
bring.
I
For
the
last
three
years,
I've
been
actively
requesting
that
it
be
checked
out
and
of
course
I
at
one
point
I
spoke
with
mr
everett,
who
then
of
course
was
over
the
that
division,
and
he
stated
to
me
that-
and
this
was
in
march
of
I
think,
march
of
april
of
2019
that
they
were
expected
to
have
the
swell
resurface
or
reevaluated
and
about
four
months
and
of
course
they
did
come
out
four
months
later
and
did
some
resurfacing
of
the
swell
but
made
the
situation
even
worse.
I
So
with
that
being
said,
you
know
I
I
would
constantly
you
know,
reach
out
to
someone
and
hope
that
they
would
say.
Okay,
we'll
come
out
we'll
review.
You
could
see
in
fact,
so
much
that
we
decided
to
just
do
self-help.
We,
you
know,
I
went
out
and
purchased
through,
not
one,
not
two,
but
three
submergible
pumps
and
tried
to
do
it
on
our
own.
You
know
try
to
pump
the
water
out
and
that's
you
know
when
you
don't
know
what
you're
doing
you
just
really
are
at
the
loss.
I
I
we
at
one
point:
we,
we
even
had
a
gentleman
come
out
and
pump
the
water
out
for
us,
but
it
was
costly
and
we're
saying
why
are
you
doing?
In
fact
he
even
said:
why
are
you
doing
this?
Why
are
you
getting
the
city
to
do
this?
Well,
after
a
while-
and
I
don't
know
if
you
guys
are
familiar
with
this,
but
after
a
while,
the
grass
starts
dying
because
the
water
is
settling
there
for
days.
I
In
fact,
there
had
been
where
at
one
point
the
what
the
water
had
settled
there
for
over
almost
two
weeks.
It
was
there
for
a
long
period
and
we
made
the
complaint.
In
fact
they
sent
someone
out
to
pump
the
area
out
and
the
person
whom
they
sent
out
or
the
the
group
of
guys
that
they
sent
out
decided
to
elected,
to
use
my
electricity.
I
Without
my
permission,
I
wake
up
one
morning
and
I
see
that
I
hear
the
humming
noise
and
I
had
been
hearing
this
humming
noise
for
over
an
hour
and
I
get
up
peep
out
the
window.
I
see
this
long
extension
cord
from
the
side
of
my
house
onto
the
street,
where
they're
pumping
the
water
from
the
swell
area
never
asked.
For
my
permission
or
anything
like
that
and
granted.
I
know
it
took
us
over
four
and
a
half
hours
to
to
get
that
water
out
with
the
pump.
I
I
know
it
would
have
taken
them
that
long
too,
as
well,
but
had
they
they
didn't
even
bother
asking.
They
just
did
it,
and
this
is
when
we
had
another
conversation
with
mr
everett,
I
said:
listen,
you
guys
got
to
come
out
and
check
this
swell
out,
because
you
know
you
could
see
that
it
does
create
a
lot
of
water
and
with
the
not
only
with
the
water
that
it
was
creating.
I
I
It
has
a
horrible
stench
to
it
and
even
once
it
does
dry
out
what
you
have
is
called
brass
rock
or
an
antignosis,
which
is
you
see
this
brown
grass
or
you
know
I'm
a
novice
at
this
now
because
I
did
not
know
before
but
I'll
give
you
an
idea
of
what
it
looks
like
and
how
it
affected
the
grass.
It
literally
killed
the
grass.
I
mean
it
really
wasn't
anything
when
we
and
I
have
to
say
we
did
place
sod
on
top
of
the
area
that
had
already
died.
I
I
What
that
area
looked
like
before
we
laid
the
sod
over
it.
The
grass
would
have
completely
died.
The
there
is
an
area
or
lip
from
the
street
where,
when
it
rains
the
water
trickles
down
from
the
street,
and
it
had
made
itself
a
little
crater,
so
that's
why
we
put
the
grass
and
that
that
at
the
I
guess
at
the
lining
of
the
street,
because
it
had
just
only
made
a
little
one
inch.
You
know
crater
in
that
street
area.
I
Well
with
that
being
said,
I've
reached
out
to
just
about
any
and
everyone
who
I
thought
would
help
us.
I
mean
it
was
it
the
place,
looked
hideous,
because
here
it
is
we
we
we
keep
a
pretty
manicured
yard
and
the
only
thing
that
was
looking
horrible
was
the
swell
and
the
worst
part
about
it.
The
water
would
sit
there,
even
if
it
had
drained
down
some.
You
still
had
about
a
good
three
inches
of
water
that
was
still
there
and
with
that
it
created
a
lot
of
bugs,
and
you
know
I'll
even
say
this.
I
You
know
that
the
water
has
been
sitting
there.
If
you
have
tadpoles
in
the
water,
in
fact,
I
made
a
video
of
the
front
of
my
swell
area
where
you'll
see
the
little
pad
pose
crawling
around,
and
everybody
knows
that
tadpoles.
Then
you
know
they.
You
know
they
they
they
manifest
in
what
about
36
hours
so
that
lets
you
know
the
water
has
been
there
for
some
time
in
order
for
tadpoles
to
to
come
up,
but
not
only
that
it
it
was
it.
I
It
had
fungus
the
guy
who
had
came
out
from
one
of
our
landscapers.
I
said
what
is
this
white
sludge
that
I
see
on
top
of
the
water
and
he
says:
well,
that's
what
you
call
fungus
and
I
was
like
well
wait,
a
minute.
Where
did
it
come
from
and
he
said,
pest
control
companies
who
lawn
pest
control
companies
when
they
spray
or
if
you
fertilize,
and
it's
in
your
yard,
once
the
rain
hits
it.
Then
it
pretty
much
washes
itself
to
wherever
it's
going
to
wash
itself
and
by
it
sitting
in
that
water.
I
I
I
I'm
sorry,
we
bought
pumps,
not
one,
not
two,
but
three,
the
third
one,
I
have
to
say
we
bought
it
off
of
the
offer
up
and
the
guys
it
didn't
work
long
so,
but
we
went
out
bought
two
pumps
along
with
invested
in
sod,
and
I
we
didn't
believe
it's
me
because
my
husband
just
only
does
what
I
asked
him
to
do,
but
we
wasn't
trying
to
do
being.
You
know.
I
A
non-compliant
or
anything
like
that
when
it
came
to,
we
just
thought
that
we
had
no
other
choice,
you
know,
but
to
try
and
remedy
the
problem
ourselves,
because
we
were
calling
and
we
really
didn't
get
anywhere
now.
I
have
to
say
this
that
whatever
just
recently
happened,
maybe
for
a
reason
and
the
reason
why
I'm
contesting
it
is
that
it
wasn't
that
we
didn't.
You
know
we.
I
know
we
didn't
know
number
one
that
we
were
doing
anything
I
didn't
know.
I
We
thought
that
we
know
we
have
a
responsibility
as
as
residents
there
that
we
have
to
make
our
or
our
home
appealing.
We
have
to
make
it
as
attractive
as
we
possibly
can
and
with
that
unsightly
swell,
but
the
grass
had
died.
All
you
saw
was
mosquitoes
and
gnats.
It
had
a
horrible
stench
to
it.
You
know
it
was
our
job
to
try
and
remedy,
because
we
didn't
think
we
were
going
to
get
anywhere
else
and
that's
what
we
did
now.
I
I
don't
know
whether
or
not
after
speaking
with
mr
faulkner,
I
think
that
maybe
I
may
have
gotten
the
wrong
information
for
me
when
he
mentioned
that
the
right-of-way.
I
thought
it
was
this
little
stripped
area
around
at
the
front
of
the
street
area,
where
we
had
call
ourselves
trying
to
add
grass,
because
the
water
had
just
made
a
little
indentation
or
in
the
street
area,
and
I
thought
that
was
the
part.
I
So
we
didn't
bother
with
the
swell
because
we
thought
the
swell
area
was
was
okay
and
the
right-of-way
was
the
street
area
and
when
he
had
asked
you
know,
I
told
him
actually
the
day
that
I
met
him.
I
said:
oh,
that's,
no
problem.
You
know
we
had
only
the
grass
had
only
been
there
for
like
three
weeks.
I
You
know
my
husband
just
yanked
it
up
with
his
hand.
So
that's
just
how
long
the
grass
had
been
there-
and
I
said
that's
no
problem
we'll
have
that
removed
today.
There's
no
problem
in
which
we
did
but
comes
out
after
he
rechecked
it.
He
says.
No,
you
have
to
remove
everything
and
I
was
like.
I
Are
you
kidding
me?
Do
you
know
what
this
looks
like
afterwards?
Do
you
know,
and
once
he
mentioned,
that
we
could
not
do
it?
I
was
okay
with
that.
The
only
thing
is
that
I'm
I'm
complaining-
or
I
have
a
concern
about-
is
that
where
were
you
when
we
were
complaining?
Where
were
you
when
we
mentioned
all
these
problems
and
and
we
just
decided
to
get
self-help
and
then
now
we
get
this
violation?
I
D
I
I
E
I
Yeah,
it's
right
in
the
burnt
store.
B
I
I
E
If
I
might
ask
the
respondent
a
question,
please
yes,
so,
according
to
the
testimony,
you
received
a
courtesy
notice
on
july
19
2021,
indicating
that
a
line
and
grade
permit
would
be
required
to
be
obtained.
I
I
immediately
went
to
speak
to
mr
faulkner,
who
had
issued
that
that
notice
I
had
advised
him
what
it
is
that
we
had
done
and
that
we
had
just
actually
placed
the
assad
on
top
of
the
area
less
than
three
weeks
at
that
time
less
than
three
weeks
ago,
and
I
had
told
him
that
you
know,
I
didn't
think
that
we
would
be
needing
one
because
we're
we
would
be
happy
to
remove
the
grass.
If
that
was
the
case,
we
had
not
made
any
alterations.
We
made
no
changes.
I
We
did
not
need
to
do
anything
other
than
just
the
place
facade
on
top
of
the
the
dead
area,
and
I
have
the
pictures
to
show
you
what
it
looked
like
prior
to
us,
putting
the
side
down,
but.
I
What
would
we
need
to
do
in
order
to
to
solve
that
problem
as
opposed
to
getting
that
line
grade,
because
I
told
him
that
we
would
graciously
remove
the
the
the
sod
I
had
also
had
mentioned
to
him
that
I
thought
that
we
were,
you
know,
unfairly
being
reprimanded
after
the
problem
had
been
presented
for
for
several
years,
that
we,
you
know,
and
now,
when
we
do
a
self-help
that
we're
being
now
made
responsible
for
something
that
they
should
have
done.
I
E
So
on
the
screen
is
the
picture
of
the
sod
that
mr
faulkner
said
that
he
observed
and
was
that
sod
removed.
Yes,.
I
It
was
as
a
matter
of
fact,
the
I
immediately
thought
when
he
said,
is
it
okay
to
touch
yeah
go
ahead?
Okay.
I
This
here
is
the
street
area
here
and
we
had
placed
a
couple
of
pieces
of
sod
and
those
areas
where
I
told
you
that
the
water
that
that
recedes
from
the
street
had
made
like
a
hole,
and
we
put
that
there
when
I
asked
him,
I
thought
he
meant
the
street
and
that's
what
we
immediately
did
that
the
the
same
20
minutes
after
I
had
spoken
to
him,
but
a
couple
days
later,
when
he
came
out
for
inspection,
he
stated
that
no
I'm!
I
You
know
it
was
everything
so
when
he
said
that
my
husband
just
went
and
took
him
25
minutes
to
rip
up
everything
because
the
grass
had
not
even
caught
root
because
it
was
you
know
it
was
just
we
put
it
there.
Just
before
the
holidays,
we
had
family
that
were
coming
in
for
the
holiday
and
the
place
looked
so
atrocious
and
me
with
my
brainy
stuff,
I
said:
well,
listen.
You
got
to
do
something.
I
It
looks
horrible
out
there,
so
he
went
out
and
purchased
the
sod
and
we
just
split
it
in
half
and
just
laid
it
in
that
little
trench
area.
That
sitting
bordered
that
from
there
from
the
swell
being
sit
there,
it
had
created
a
trench
and
it
had
really
completely
killed
the
grass
I
mean
there
was
nothing
there.
I
Removed
had
been
removed,
in
fact,
the
last
time
that
he
came
out
that
the
day
that
we
spoke,
the
last
conversation
we
had
we
spoke.
I
I
My
husband
had
purchased
about
51
pieces
of
sod,
they
cut
it
in
half
because,
of
course,
the
trenched
area
where
it
had
made
its
little
trench,
was
probably
about
two
feet
deep
and
what
we
did
was
just
lay
the
sod
on
top
of
the
area.
So
it
was
probably
more
for
aesthetic
reasons,
as
opposed
to
here.
In
fact,
here's
the
photo
of
it.
So
you
could
see
what
it
is
that
before.
E
And
and
it
from
from
my
eye,
it
looks
like
that
there
seems
to
be
a
fairly
regular
or
sharp
edge
on
the
house
side
of
the
of
the
ditch.
I
I
Laying
it
on
top
of
the
grass
probably
had
darkened
that
area
or
made
it
look
more
straight
or
maybe
more
asymmetrical,
but
we
didn't
do
anything.
In
fact,
my
husband
is
so
lazy.
He
would
not
use
a
shovel.
If
I
had
told
him,
you
know,
no,
you
need
to
put
it
down,
neither
he
wouldn't
do
it
so
and
he
did
it.
He
and
my
brother-in-law
did
it.
So
I
know
there
was
no
shovel.
There
was
no
soil
or
or
whatever
you
call
it.
The
there
was
no
none
of
that
stuff
used.
I
I
You
put
them
around
the
plants
or
something
like
that
mulch
he
put
a
little
bit
of
mulch
just
so
it
could
be
leveled
and
when
he
removed
it,
he
just
took
the
blower
and
blowed
it
away.
So
that
was
pretty
much.
F
F
The
date
of
that
photo
was
july,
29
july
28th.
F
So
that
there's
this
the
sod
in
the
right
of
way,
I
didn't
lift
the
sod
at
that
time
it
was
just
indicated.
I
do
believe
that
it
was
perched
on
there's
a
lot
of
mulch
in
the
area,
so
I
do
believe
it
was
at
least
an
area
that
was
perched
on
the
mulch.
F
I
had
conversation
with
a
miss
mrs
farquhan.
They
did
remove
the
sod.
I
I
visited
the
site
again
on
august
4th.
F
That
was
the
day
that
we
had
most
areas
of
the
city
had
toward
four
inches
of
rainfall.
I
don't
know
exactly
what
it
rained
there.
This
was
by
lunchtime
that
day
the
water
was
going
down
and
draining
well.
At
that
point
in
time,
I
did
a
follow-up
visit
on
that
friday
august
6th
found
the
best
photo
there's
what
was
remaining
in
the
ditch
on
august
6th.
That's
two
days
after
that
that
rainfall.
F
The
standing
water
that
we
saw
earlier,
I
can't
find
anything
causing
those
kind
of
scenarios
at
this
point
in
time.
I've
walked
the
drainage
system
out
to
the
ditch.
Everything
seems
to
be
flowing
and
moving
at
this
point
in
time,.
F
I'll
also
include
this,
this
photo,
which
is
a
little
bit
of
closer
area
of
this
solid
area.
If
you
note,
this
area
in
particular,
looks
like
the
sod
is
remaining
is
still
there,
this
area
along
the
trench
it
I
don't,
really
see
the
evidence
of
the
sod
being
there
still
so,
and
there
may
have
been
some
kind
of
alteration
done
in
that
area,
in
my
opinion,
but
this
upper
edge.
F
I
do
think
the
the
laying
of
the
sod
created
this
this
sharp
edge,
which
is
much
different
than
the
photos
that
we
were
looking
at
earlier.
You
can
see
it's.
This
area
is
now
much
wider
and
and
larger
than
where
are
those
photos.
F
So
the
building
department
issues
the
lining
grade.
However,
the
inspector
that
sets
and
and
checks
everything
is
ran
out
of
my
office.
E
F
F
Well,
I
know
that
one
you
have
to
use
a
a
a
contractor
approved
by
the
city.
F
Do
the
work
so
so
this
would
be
more
like
a
resawed
or
whatever
we
would
set
the
grades.
The
contractor
would
come
in
and
and
contour
and
profile
the
swale
to
meet
our
grade
stakes.
We
will
we'll
drive
grade
stakes,
so
they
can
pull
a
string
and
check
the
grades
and
then
they'll
come
in
and
sod.
We
will
check
the
grades
and
make
sure
it
meets
the
permit.
F
B
Okay,
a
couple
couple
questions
in
I
know
over
the
last
several
years,
swales
and
and
drainage
have
been
a
very
high
interest
item
around
the
city
and
a
lot
of
time
and
money
and
effort
has
gone
into
it
and
as
part
of
that,
there
was
quite
an
extensive,
either
gis
or
videotape
survey
done
in
several
parts
of
the
city.
Do
we
have
any
other
records
of
this
area
as
being
sort
of
a
you
know,
redundant
or
a
trouble
spot?
That's
been
noted
over
time.
F
F
F
We
then
review
those
videos
identify
the
worst
areas
that
that
we
then
assigned
our
program
and
remediate
those
areas
I
do
this
area
was
done,
I
believe
in
2019,
so
it
was,
did
get
identified
and
redone.
So.
B
It
seems
like
what
about
the
other
yards
because
having
seen
the
swale
program
in
action,
so
to
speak,
it
didn't
look
like.
There
was
drainage
problems
in
in
the
adjacent
yards
to
the
respondent's
house,
and
I
know
sometimes
it's
it's
a
as
much
an
art
as
a
science,
finding
the
trouble
spot
and
the
source
of
of
what
backs
up
water
in
these
floor.
Tam
yards
that
we
have
so
is
there
any
other?
F
So
actually,
the
the
next
we'll
go
back
to
that
photo.
This
photo
here.
F
Beyond
this,
this
this
structure
here
there's
an
yeah,
I'm
certain
it's
right
on
the
other
side,
that
is
the
inlet
which
takes
it
out
to
the
main,
the
the
permitted
drainage
drainage
way
out
in
the
rear
of
these
houses.
So
I
mean
it's
only
from
there
to
to.
There
is
the
inlet
and,
as
you
can
see,
this
was
two
days
after
that
that
rainfall
event.
This
would
be
I'm
standing
on
that
driveway
that
we
were
just
looking
at
with
the
inlet
and
rear
of
me
and
it's
it's
it's
pretty
dry.
I
mean.
D
A
A
F
F
A
F
I
Yes,
I'd
like
to
say
something
now:
the
photo
that
you
have
posted
here,
that's
an
inaccurate
assessment.
You
see
these
lot.
Those
two
sticks
that
are
there.
We
just
had
new
neighbors
to
move
in
just
this
past
november
and
that's
the
property
line
marker
right
there.
So
beyond
that
those
sticks
that
are
out
there
posted
that
belongs
to
the
neighbor.
It's
not
an
accurate
depiction
of
my
property.
This.
I
I
I
If
you,
if
you
could
see
here,
that's
grass
and
it
had
died
as
a
result
of
the
the
water
just
lingering
there
went
up.
I
mean
we
dread
having
the
rainy
season,
because
we
know
that
we're
going
to
get
a
back
up
in
the
swell,
and
we
know
that
the
water
is
going
to
sit
there,
that
the
the
changes
were
made
on.
I
I
want
to
say
the
third
of
july,
one
day
that
you
mentioned,
that
it
was
removed
about
three
and
a
half
weeks
later,
therefore,
not
even
giving
it
time
to
even
catch
the
the
saw
that
we
replaced
also
here's
the
photo
of
the
street.
I
think
that
you
also
had
one
where
we
made
changes
to
the
street
area
or
the
area
that
lingers
from
the
street.
B
C
C
E
It's
been
corrected,
we
need
a
seasoned
assist
and
that
you
know-
and
we
can
leave
it
at
that
and
if
she
wants
to
take
further
action
on
her
own,
then
get
a
do
a
permit.
E
L
C
E
I
know
we
have
no
evidence
at
the
present
time
that
there's
been
a
permanent
alteration
of
the
of
the
swell
area.
Well,.
D
The
the
thing
that
we
have
here
is
not
a
cease
and
desist,
though.
I
I
A
I
guess
my
problem
is:
we
have
a
situation
here
where
we
have
a
homeowner
who
is
giving
credence
to
her
statement
that
she's
talked
to
people
in
the
city
about
this
problem
and
whatever
the
resolution
it's
an
op
homeowner
did
some
self-help
ignorance
of
what
the
procedures
were
when
they
did
it.
I
was
like
I
understand
all
of
a
sudden
we're
in
violation
because
of
that
self-help.
E
L
E
E
The
city
doesn't
have
evidence
that
there's
been
an
alteration,
a
permanent
alteration
right.
There
was
a
re.
The
departments
requested
that.
E
We
enforce
an
alteration,
but
I
haven't
heard,
but
I
haven't
heard
any
testimony
other
than
the
placement
of
the
sod
and
the
removal
of
the
sod.
Yes,
so
the
motion
before
you
was,
I
think,
the
request
of
the
department,
but
I
don't
think
that's
the
that
would
be
the
appropriate
motion
based
on
the
testimony.
That's
been
provided
so
far.
Sorry,
so
I
would
suggest
that
we,
the
motion,
be
that
it's
a
cease
and
desist
finding
a
violation,
cease
and
desist
and
leave
it
at
that
because
already
they're
in
compliance
by
removing
the
sod.
E
Hopefully,
instead,
the
property
owner
will,
if
they
want
to
continue
with
the
self-help,
hire
the
appropriate
professional,
submit
the
appropriate
application
and
have
the
work
done
or
you
know
if
it's
on
the
program
not
on
the
pro
whatever
it
is,
that
the
city
is
go
would
be
doing
you
know,
I
I
I'm
not
even
sure
there's
been
evidence
provided
that
the
property
owner
may
not
her
property.
May
not
be
the
one
that's
responsible
for
the
backup.
I
mean
we
just
we
don't
know,
and
so
there's
no
need
to
even
go
into
that
detail.
E
We,
our
purpose
today,
is
to
try
to
bring
the
property
owner
into
compliance
and
we've
been
by
her
removing
of
the
sod
that
was
done
without
a
permit
she's
done
that
if
she
wanted
to
leave
the
side
there
then
clearly
we'd
be
asking
for
that.
She
get
a
permit
to
keep
the
sod
there,
but
it's
been
removed
so
theoretically
she's
in
compliance.
In
the
absence
of
any
further
evidence
of
a
violation.

and
found
that
the
blue
tarp
remained
on
the
roof
of
the
house
structure
on
the
property
and
the
wooden
planks
remained
stored
in
front
of
the
house
structure
on
the
property.
K
C
Two
questions,
one
is:
are
there
any
open
building
permits
on
this
house.
K
That
I'm
not
aware
of
there
is
a
stop
work
order
posted
on
the
window,
as
you
can
see
there
from
the
building
department.
I
do
not
know
what
the
what
they
were
working
on.
C
Okay,
and
has
the
owner
been
in
contact?
Has
anybody
had
any
contact
with.
D
Do
you
know,
I
don't
know
yeah,
I
don't
know
okay,
it
almost
looks
like
it's
abandoned.
A
C
Here
we
go
I'll,
make
a
motion
jardina
motion
to
find
that
the
respondent
violated
chapter
26,
section
1,
8.11,
b,
chapter
9,
section
9-2,
a
chapter
26,
section,
8.14
b
of
the
punta
gorda
code
and
issue
a
cease
and
desist
order
for
any
future
violation
of
the
punta
gorda
code.
Chapter
26,
section
8.11
b,
in
order
that
the
respondent
bring
the
property
into
compliance
within
15
days
of
receipt
of
this
order.
C
And
it
is
ordered
that
further
order
that
the
respondent
is
required
to
pay
case
costs
incurred
in
the
amount
of
23.46
within
15
days
of
receipt
of
this
order.
And
it
is
further
ordered
that
failure
to
comply
with
this
order
may
cause
the
code
enforcement
board
to
impose
a
fine
of
up
to
250
dollars
per
day
plus
applicable
interest.
C
A
A
B
For
record
dave,
mccarty
cook,
point
supervisor
actually
it'd
be
very
slight.
People
have
been
given
their
name
and
address,
as
required
by
the
new
statute,
maybe
just
a
slight
reduction,
but
we've
had
people
call
and
when
we
tell
them
that
they
don't
want
to.
You
know
make
the
complaint
then,
but
that's
maybe
been
just
three
four
or
five
times
so
it
hasn't
been
a
whole
lot
of
impact
on
what
we
do
we're
proactive.
B
Anyway,
we
were
assigned
areas
and
we
go
out
and
look
so
it
would
affect
a
co-compliance
division
that
is
reactive
more
so
than
it
would
us.
I
would
think.
