found
a

the

section

G
I'm
submitting
four
photos
for
the
record.
The
pictures
submitted
for
evidence
are
a
true
and
accurate
representation
of
the
conditions
of
the
site.
At
the
time
the
picture
was
taken
on
september
29th
2021.
They
noticed
a
violation.
An
order
of
corrective
action
was
sent
to
the
respondent,
be
a
certified
mail
which
was
received
on
october
18,
2021,
ordering
corrective
action
be
taken
and
that
the
fallen
dead
tree
be
properly
removed
from
the
property
and
the
tall
grass
and
the
weeds
be
trimmed
and
maintained.
G
On
december
13th,
an
affidavit
of
a
violation
and
notice
of
hearing
was
sent
to
the
respondent
via
certified
return
receipt
mail,
which
was
received
on
january
5th,
2022.
on
january,
4th
2022.
I
posted
affidavit
and
notice
of
hearing
on
the
property
and
at
city
hall
I
reinspected
the
property
on
january
25th
and
found
that
the
fallen
dead
tree
and
the
tall
grass
interweaves
remain
on
the
property.
I'm
submitting
the
invoice
in
the
amount
of
52
dollars
and
61
cents
for
case
cost
incurred.
D
Officer
price
looking
at
this
picture
is
that
cement
is
that
the
sea
wall.
D
D
A
So
one
other
question,
then
so
does
this
fall
within
the
purview
of
of
something
within
six
feet
of
a
sea
wall.
A
G
You
can't
plant
anything
within
that
was
on
the
water
and
fell
over
whatever.
G
That's
considered
part
of
his
property.
H
Okay,
mangroves
are
protected
yeah.
The
issue
isn't
that
he
didn't
maintain
the
vegetation
on
the
water
side
of
the
seawall,
because
those
are
protected
species.
The
issue
is
that
the
tree
has
fallen
onto
the
private
property
on
the
upland
side
and
that's
the
violation.
Is
that
there's
a
dead
tree
or
remnants
of
a
dead
tree
that
needs
to
be
removed.
D
A
H
Yeah
and
and
all
these
questions
are
appropriate
to
ascertain
whether
the
city
has
made
a
prime
official
case,
but
at
some
point
in
time
you
might
want
to
consider
whether
the
city's
improving
the
prime
private
facilitation
that
we
can
move
to
the
next
phase.
Okay,.
B
H
Yes,
so
so
the
issue
before
you
today,
you
know
we
we've
made:
we've
had
prob
cases
with
fallen
trees,
excessive
palm
fronds.
You
know
that
that
have
maintained
on
the
property.
It's
a
maintenance
issue.
That's
why
it's
not
you
know
planting
a
tree
or
having
a
tree
within
six
foot
of
the
seawall.
This
is
dead,
dead,
vegetation
and
the
tall
grass
and
weeds
that
are
in
the
same
area
of
the
tree,
maybe
because
the
landscape
or
the
mower
couldn't
get
to
it.
B
Yeah
but
they're
not
responsible
for
taking
the
part,
that's
on
the
on
the
seaward
side
of
the
scene.
H
That
is
correct,
presumably
the
sea
wall.
This
the
waterway
side
of
the
sea
wall,
was
within
the
city-owned
canal
system.
Thank
you.
J
J
B
B
K
Lisa
hannan's
hannan,
zoning
official,
we
don't
have
the
personnel,
we
don't
have
the
means
to
go
out
and
remove
trees
from
from
private
properties.
K
K
When
it
falls
into
on
private
property,
then
it
becomes
the
private
property's
owner's
responsibility
to
remove
it
just
like.
If
your
neighbor's
tree
falls
on
you.
That
would
be.
It
would
be
a
civil
issue
between
the
two
of
you,
but
if
a
big
branch
fell
from
theirs
onto
yours,
it
would
end
up
being
your
responsibility
to
remove
it,
not
your
neighbors,
because
the
actual
violation
is
on
your
property.
K
H
If
they
ask
the
city
to
remove
the
tree,
one
of
the
things
that
I
would
look
at
and
I'm
trying
to
remember,
there's
a
there's,
a
split
of
authority
as
to
whether
or
not
a
neighbor
is
responsible
for
damage.
That's
done
to
adjoining
property
from
a
tree
that
falls
or
branch
of
a
tree
that
falls
on
the
property.
H
H
If
the
property
owner
had
asked
us
to
remove
it,
I'm
sure
the
city
would
have
asked
me
to
investigate
that.
What
is
the?
What
is
the
law
in
florida
on
that
issue?
At
the
moment?
I'm
I'm
not
comfortable
to
state
what
what
it
is
at
the
present
time,
the
owner
hasn't
asked
us
to
do
that.
We've
been
in
contact
with
the
owner,
hasn't
given
us
permission
to
go
on
his
property,
and
mr
price
wasn't
having.
We
had
some
contact
with
the
owner
and
his
response
was
that
he's
in
in
austria,
yeah.
H
So
you
know
what
we're
I
think
we're
asking
for
is
that
the
finding
there
is
a
violation,
but
just
give
them
time
adequate
time
to
come
into
compliance,
because,
irrespective
of
the
tree,
still
out
of
compliance
with
respect
to
the
tall
reading
grass.
J
Of
surprise,
when,
when
did
this
issue
start,
how
long
has
it
been
going
on.
G
It
had
to
be
some
time.
I
don't
have
the
exact
approximate
august.
It
was
approximately.
It
would
have
been
august
sometime
in
august
end
of
august,
oh
july,
13th.
That's
enough
time.
I
G
A
C
All
those
in
favor
all
right
all
those
opposed
the
city
has
a
prima
facie
case.
C
H
Okay
again,
recognizing
that
the
respondent
has
indicated
a
desire
to
bring
it
into
compliance,
and
there
may
be
an
issue
in
these
coveted
times
as
to
his
ability
to
actually
come
to
take
care
of
his
property.
H
We're
just
asking
for
a
reasonable
period
of
time
for
him
to
to
come
into
compliance,
but
certainly
in
order
of
requiring
him
to
come
into
compliance
is
what
we're
requesting
at
this
time.
B
I
have
one
more
question
considering
that
the
tree
is
rooted
in
on
city
property,
would
it
be
feasible
for
the
city
to
remove
the
tree
and
build
the
owner
for
that
portion
of
the
tree,
which
is
on
his
property.
H
Well,
the
tree,
it's
yes,
I
mean,
I
presume,
we're
talking
about
a
detached
portion
of
the
tree
or
it's
unrooted
or
whatever
I
I
don't
know.
What
did
it
break
off.
G
H
You
know
if,
ultimately,
the
property
owner
won't
come
into
compliance
or
can't
come
into
compliance.
There
is
a
procedure
whereby
this
board
can
recommend
to
the
city
council
to
take
appropriate
action
to
bring
the
property
into
compliance
charge
them
with
the
with
the
cost
lean
the
property.
Until
it's
done,
I
don't
know
that
we
need
to
go
there.
H
Yet
the
the
property
owner
hasn't
indicated
a
lack
of
willingness
to
bring
the
property
into
compliance,
or
just
you
know
it
sounds
to
me
like
he's
just
asking
for
sufficient
time
to
do
so
and
and
the
same
with
the
you
know,
I
don't
know
how
difficult
it
is
to
cut
the
grass
and
weeds
because
of
the
tree,
and
I
I
I
don't
know
whether
the
the
whoever's
mowing
the
property
isn't.
Is
it
on
the
online
program
yeah
it's
on
a
lot
more
improvement,
yeah
all
right,
so.
H
That
certainly
complicates
things
a
little
bit,
because
a
lot
mowing
program
is
supposed
to
be
blowing
the
line,
we're
not
supposed
to
be
finding
people
in
violation
for
something
that's
they're,
not
responsible
for
mowing,
but
but
I
think
the
fact
that
the
tree
is
there
isn't
is
inhibiting
the
ability
of
the
our
mowers
to
get
in
there
and
remove
it
again.
D
C
H
As
a
practic
as
a
practical
matter,
let's
do
this.
You
know
again,
let's
give
the
the
respondent
adequate
time
to
try
to
bring
it
into
compliance
on
his
own
to
remove
the
tree
if,
if
it
needs
to
come
back
to
you
because,
notwithstanding
the
additional
time,
it's
still
not
in
compliance,
let's,
let's
address
the
situation
at
that
point.
H
I
F
On
december
14
2021,
I
hand
delivered
the
order
imposing
penalty
to
the
respondent
christopher
s
chase
here
at
city
council
chambers,
I
reinspected
the
property
on
december
28th
2021
and
found
the
property
to
be
in
compliance.
I'm
submitting
one
photo
for
the
record.
The
pictures
submitted
for
evidence
are
true
and
accurate
representation
of
the
site.
F
On
january
3rd
2022,
a
notice
of
hearing
for
reduction
to
find
requests
to
the
january
26
2022
code
enforcement
board
meeting
was
sent
to
the
respondent
which
was
received
on
january
8
2022.
on
january
3rd
2022.
I
posted
a
notice
of
hearing
for
reduction
of
fine
request
on
the
property
and
at
city
hall,
respondent
christopher
s
chase
was
notified.
F
C
L
Well,
at
the
at
the
time
that
I
was
out
of
in
violation,
I
was
in
the
middle
of
moving
and
that's
when
all
this
stuff
occurred.
L
I
was
pretty
much
driving
back
from
to
florida
from
new
mexico
for
about
a
year,
my
wife
passed
away,
and
I
was
doing
all
this
myself,
so
I
made
13
trips
so
other
than
that
I
mean
I
didn't
even
get
any
of
the
violation
notices
to
my
mailbox
and
because
that
was
closed
down
and-
and
you
guys
didn't
know-
and
I
didn't
know
so-
there
was
no
way
for
either
of
us
to
know
where
I
was.
L
I
was
in
transition,
so
I've
been
here
now
for
about
eight
months
permanently
and
I'm
trying
to
get
everything
in
up
to
up
and
up
to
shape.
I've
got
a
gate
that
I'm
making
now
for
the
for
the
front
there
to
close
that
off
a
movable
gate.
C
Okay,
does
the
board
have
any
questions
for
mr
chase.
B
I
do
mr
chase:
did
you
request
that
the
city
re-inspect
your
property
when
you
got
it
into
compliance.
L
Yes,
I
nick
sent
me
an
email
and
said
that
to
when
you
request
the
hearing
and
at
that
time
I
did
actually
call
him
and
talk
to
him.
He
was
very
nice
to
answer
the
phone
and
he
said
he
would
reinspect
it
to
make
sure
that
it
was
in
compliance.
C
L
Where
can
I
pay
that
now?
So
I
don't
city
clerk's.
F
Office
right
here:
okay,
okay,
thank
you
very
much
for
coming
in
mr
chase,
mr
chase.
Yes,
if
you
wait
a
minute,
we
have
some
paperwork,
for
you
sure.
D
Two
boys,
I
think
the
oldest
one
is,
I
want
to
say
nine,
the
other
one
is
probably
six
and
she
I
was
fixing
my
mailbox,
and
they
came
over
to
talk
to
me
about
the
fact
that
their
children
were
accosted
by
someone
wearing
us
anti-abortion
sign
and
that
person
addressed
her
children
and
said
if
your
mother
had
had
an
abortion,
you
wouldn't
even
be
here
and
the
child.
The
mother
was
really
upset
that
this
happened.
The
child
asked
his
mother.
D
What's
an
abortion
mom,
okay,
they
were
really
upset,
they
reported
it
to
the
police
department.
The
police
department
said
they
couldn't
do
anything
about
it,
because
it
was
free
speech
or
some
other
reason,
and
I
was
just
wondering
if
we
didn't
have
any
knowledge
of
this
happening.
I
think
it
occurred
at
one
of
their
school
at
their
school,
but
I
don't
know
which
school
they
attended.
K
Lisa
hannan's
owning
official
have
been
sworn
I
have
heard
of
this
happening.
I
don't,
I
can't
speak
to
it
because
it
would
be
a
police
department
issue.
I've
heard
that
this
happened
at
sally
jones
for
some
time,
but
I
I
don't
have
any
confirmation
on
it
would
be
a
police
department
issue.
I
can't
I
can't
speak
to
that,
but.
K
With
the
sign
code,
it's
very
specific
on
the
that
that
is
protected
under
the
free
speech.
Unfortunately,.
H
And
and
if
it
was
verbal
there's
nothing
that
we
could
do
about
it:
okay,.
