We
have
a
resolution
which
I'll
read
the
title:
only
a
resolution
adopting
a
tentative
levy
of
annual
special
assessment
for
the
burnt
store,
aisles
canal
maintenance
assessment
district
for
fiscal
year,
2017
2018
setting
a
date
time
and
place
for
public
hearing
to
consider
final
adoption
of
the
assessment
providing
effective
days.
Thank.

Ahead,
croquet
Christmas
Savino,
with
finance
again
and
for
the
BSI
canal
maintenance
fund.
We
are
recommending
a
proposed
decrease
in
the
assessment
to
five
hundred
and
fifty
five
dollars
fiscal
year.
2018
is
balanced
for
operations
with
a
$460
assessment
and
then
the
dredging
part
of
the
assessment
has
been
lowered
to
ninety
five
dollars
from
110,
so
for
all
non
single
residential
families.
Properties
rate
would
be
the
zero
point:
point:
zero
five,
eight
per
square
foot
of
land,
blowing
less
than
120
lineal
feet
from
the
seawall.

A
And
we
have
a
resolution
which
I'll
read
by

setting

E
You
and
Kristen
Simeone
from
finance
again
so
for
the
Punta
Gorda
isles
canal
maintenance
fund.
The
recommendation
is
to
maintain
the
assessment
rate
of
$550.
The
budget
is
balanced
with
no
change
in
the
assessment
and
fiscal
year.
18
starts
the
use
of
the
seawall
replacement
reserve
that
will
be
used
up
through
fiscal
year,
18
through
2022.
So
next.
C
Questions
before
we
open
the
public
hearing,
this
is
a
public
hearing.
If
you
would
like
to
speak
on
the
PGI
Canal
main
and
spawned
assessment
now
would
be
the
time
anybody
like
to
speak
on
the
PGI
Canal
Fund
assessment
last
call
to
speed
on
the
PGI
canal
fund
assessment
on
sugar
closer
hearing
seconds.
We
have
a
motion,
a
second
to
close,
the
public
hearing,
all
in
favor
aye
opposed
carried
unanimously.
H
C
I
A
We
have
a
resolution
which
are
really
Tyrell
only
resolution
adopting
a
tentative
levy
of
annual
special
assessment
for
the
city
of
Punta
Gorda
lot:
mowing:
assessment
district
for
fiscal
year,
2017
2018
setting
a
date
time
and
place
of
public
hearing
to
consider
final
adoption
of
the
assessment
finding
an
effective
date.
Thank
you.
J
C
Is
a
public
hearing
if
you'd
like
to
speak
on
the
lot
mowing
program
assessment
now
would
be
the
time
anybody
like
to
speak
on.
One
hundred
and
sixty-five
dollars
for
the
whole
year
will
mow
your
lot
for
you.
That's
the
assessment,
we're
speaking
of
if
you'd
like
to
speak
on
that.
Please
come
to
the
podium.
Last
call.
K
For
the
record
bill,
leech
put
quartiles
I
took
advantage
of
this
situation
several
years
ago
before
we
built
our
home
and
I
thought
it
was
a
wonderful
bargain,
because
I
went
out
initially
and
asked
other
independent
contractors
what
it
would
cost
to
maintain.
My
lot
before
I
was
ready
to
build
and
those
prices
were
well
in
excess
of
Oh
$65
and
people
here
may
want
to
shoot
me.
But
is
this
the
point?
Is
this
a
particular
place
where
the
city
could
maybe
make
a
more
reasonable
assessment
of
the
value
of
that
service?
K
I,
don't
know,
I
have
to
pick
a
number
it
out
of
the
air
250
bucks
a
year,
200
bucks
a
year
225
without
the
research
I,
don't
know,
but
it
seems
to
me
that
it's
probably
costing
you
money
to
do
that
and
I'd
like
as
a
citizen,
not
to
see
the
town
cost
having
to
put
money
out
in
order
to
address
the
issue.
So.
G
E
G
B
Like
to
see,
however,
in
the
future
that
we've
talked
about
this
before
of
having
different
levels
so
that
if
you
have
a
sidewalk
in
your
vacant
lot
that
we
charge
more
because
we
need
to
actually
go
in
and
trim
the
grass
along
the
edge
of
the
sidewalk
and
I
know,
staff
has
gone
out
before
and
done.
That
and
I
know
that
the
vendors
try
to
to
use
to
do
that.
B
But
as
I
Drive
down
Monaco
in
my
neighborhood
I
noticed
that
the
grass
is
starting
to
creep
over
the
sidewalk
and
as
the
summer
goes,
it
will
really
cover
the
sidewalk.
And
so
that
does
cost
more
and
so.
I
think
that
for
us
to
to
maintain
those
I
would
be
in
favor
of
us
having
two
levels
of
service.
One
for
lots
without
sidewalks
someone
with
I
mean.
L
One
thing
I
wouldn't
want
to
have
a
deterrent
to
the
city
to
staying
beautiful,
I
mean
I,
wouldn't
make
this
I,
don't
want
residents
to
have
to
think
about
this
too
much.
This
is
a
very
easy
thing
to
do
with
no
thinking
and
a
lots
of
mode.
I
think
that
we
get
into
the
money-making
business
with
a
lot
more
I
think
that
that
just
unnecessarily
I
think
that
we
just
keep
it
pretty
beautiful.
J
Want
to
say
that
the
program
itself
is
fabulous.
We
had
a
situation
on
our
black
where
there
was
a
hole
in
foreclosure
and
the
bank
wasn't
keeping
it
up,
and
my
Linda
just
had
to
make
a
call
to
the
city,
and
at
least
it
kept
the
weeds
down
it
didn't
keep
it
trimmed.
The
way
it
had
been
previously
was
lived
in,
but
at
least
kept
it
somewhat
reasonable.
It's
still
a
great
bargain,
there's
just
a
part
of
me
that,
even
though
I
understand
Howard's,
point
and
I
understand
jaha's
point.
It's
just
really
good.
J
C
C
E
C
So
we
are
no
longer
the
lot
knowing
assessment
district.
We
are
now
back
in
session
as
a
City
Council
of
the
city
of
ponta
gore
force.
So
now
we're
going
to
take
citizens
comments
on
the
remainder
of
the
items
on
the
agenda,
which
would
be
unfinished
business.
Discussion
of
zoning
regulations
for
medical
marijuana
treatment,
center,
dispensing
facilities,
continued
discussion
of
height
restrictions
in
the
city
center
zoning
district.
C
We
already
heard
the
event
permit
for
the
block
party
and
we
will
have
a
fisherman's,
Ridge
litigation
update
by
the
city
attorney,
and
then
we
also
have
appointment
of
councilmember
to
the
architectural
landscape
committee
for
agape
senior
living
facility.
Those
are
the
items
on
the
rest
of
the
agenda.
If
you
would
like
to
speak
on
any
one
of
those,
now
would
be
the
time.
Take
this
podium
state,
your
name,
and
you
have
three
minutes
good.
M
First,
though,
I'd
like
to
talk
a
moment
to
recognize
Ray's
on
selfish
dedication
to
this
council
ray
was
a
model
of
stability,
colonists
and
logical
thinking,
I'm
sure
he
will
be
missed.
A
service
array
will
be
conducted.
This
Sunday
3
p.m.
at
the
Punta
Gorda
Isles
Civic
Association
all
are
welcome
to
share
their
memories
of
raid.
M
The
Punta
Gorda
Isle
Civic
Association
has
a
membership
in
excess
of
5,000
about
a
third
of
the
city
population
of
the
Punta
Gorham,
and
an
even
larger
share
of
the
tax
pace.
The
Civic
Association
adamantly
opposes
an
increase
in
building
height.
The
board
has
repeatedly
written
letters
of
opposition
expressed
views
at
once.
You
does
not
fit
all
but
have
been
frustrated
that
they're
not
being
taken
seriously.
M
The
Association
is
opposed
to
building
height
changes
and
desires.
Continuation
of
variance
process
based
upon
individual
considerations,
I
guess
I'd
like
to
add
a
couple
comments
of
my
own
associated
with
the
same
subject.
I
hear
terms
like
set
back
step,
backs
pedestrian
experiences
and
Street
framing.
Are
these
just
smoke
and
mirrors
attempts
to
justify
a
new
city
landscape
I?
Ask
that.
M
C
O
Joe
como,
our
resident
Punta
Gorda
Punta
Gorda
Isles
and
a
member
of
the
Punta
Gorda
isles
community
association,
first
I'd
like
to
thank
the
staff
for
the
excellent
work
they've
been
doing
on
this
project
over
the
extended
period
of
time,
particularly
Mitchell
Austin
has
put
in
an
awful
lot
of
time
and
developed.
What
I
think
is
an
outstanding
proposal
as
a
way
ahead
for
development
within
the
city
of
Punta
Gorda.
O
Next,
as
a
member
of
the
printer
go
to
Isles
Community
Association
I
would
like
to
take
minor
exception
to
the
statement
that
the
Punta
Gorda
Isles
Community
Association
as
a
whole
opposes
this.
As
far
as
I
know,
there's
been
no
polling
of
the
complete
membership,
and
this
represents
merely
the
board
action
or
anecdotal
conversations
on
the
part
of
some
portion
of,
but
not
the
entire
Punta
Gorda
Isles
Community
Association,
so
just
taking
exception
with
the
point
that
the
entire
Association
disagrees
with
this,
the
entire
Association
has
not
been
polled,
and
this
is
a
limited
opinion.
O
D
D
P
Good
morning,
Kim
Devine
city
of
Punta,
Gorda
I,
would
like
you
to
consider
raising
the
height
I
think
that
Mitchell
has
done
a
wonderful
job
and
it's
beautiful
and
I
think
it
would
be
nice
to
change
the
landscape
of
Punta
Gorda
a
little
bit
and
to
have
a
little
bit
more
diversity
and
I'll
use
a
piece
of
property.
I
have
for
an
example,
because
I
could
talk
about
this
forever.
As
you
all
know,
I
have
a
piece
of
property
across
from
the
Justice
Center
I
have
a
price
on
that
property.
P
I've
had
several
people
offer
to
buy
that
property
at
my
price,
but
they
want
to
build
a
5,000
square
foot
building.
They
want
to
build
something
that
personally
I,
don't
feel
would
is
the
proper
thing
to
do
for
the
Gateway
to
Punta
Gorda,
so
I've
held
on
to
it
and
I
haven't
done
it
eivol
and
because
I
just
think
now
we're
going
to
have
a
lot
of
little
block
buildings
50/50
seat.
P
They
don't
even
want
to
do
a
50
building,
and
it
just
doesn't
work
that
way
and
when
you're
trying
to
plan
a
building
and
like
say
for
City,
marketplace
and
I
know
that
they
could
come
in
and
they
can
get
a
variance
for
that.
But
what
it's
doing
is
prohibiting
people
from
coming
here
to
even
try
to
get
in
this
process
and
try
to
take
like
with
the
memory
care
over
at
Madrid.
What
have
we
been
working
on
that
for
six
months?
P
So
as
a
person
who
wants
to
build
something,
you
have
to
take
that
into
account
in
your
development
process?
I
think
that
having
a
diversity
in
the
in
the
different
sizes
of
building,
if
you
can
have
a
little
more
height,
will
actually
get
some
beautiful
architectural
features
on
them,
because
you
can
actually
have
more
offices
to
rent
or
whatever
it
is,
and
to
be
able
to
make
up
and
put
that
money
into
the
project
instead
of
bare-bones,
we've
got
50
feet.
This
is
what
we
have
to
do
just
to
break.
Even
thank
you.
Thank.
C
Q
Good
morning,
patty
Alan,
we
have
heard
time
and
time
again
that
our
population
is
growing
in
recent
article
in
the
Sun
yesterday,
Punta
Gorda
was
ranked
number
seven
in
the
nation
for
young
entrepreneurs.
These
statistics
are
based
on
growth
rates.
Florida
is
the
third
fasting
fastest
growing
state
in
the
country.
It's
now
time
to
look
at
some
of
our
very
old
standards
and
revisit
what
makes
sense
for
our
growing
community
I
repeat
our
growing
community
like
it
or
not.
Q
We
are
growing,
and
it's
time
this
sustained
growth
triggers
changes
in
our
LDRs
in
any
other
rule
that
governs
our
future
growth.
I've
sat
in
that
chair
for
13
years.
Listening
to
countless
people
say
that
they
don't
want
to
be
in
other
Naples
I
just
returned
from
Naples
this
past
weekend
and
I
must
say
everywhere:
I
went
their
landscaping
was
pristine.
Q
Signage
was
consistent
as
well
as
the
architecture
of
buildings
and
homes.
It
was
beautiful.
I
understand
that
20-plus
floor
high-rise
buildings
that
line
the
beach
are
not
what
the
public
desires.
No
one
is
proposing
this.
The
presentation
that
Mitchell
has
expertly
prepared.
You
are
about
what
you
are
about
to
see
is
well
done,
with
an
incredible
thought
to
the
quaintness
of
our
community
breezeways
setbacks.
Courtyards
stair-stepped
height
on
buildings
will
enhance
the
overall
look
of
new
development.
Q
This
is
just
a
small
step
to
keeping
up
with
our
future
as
a
strong
community,
with
a
balance
of
both
residential
and
commercial
properties.
Mayor
and
council
members,
I
respectfully
encourage
you
today
to
have
staff
continue
to
move
forward
with
this
proposal
that
Mitchell
prepared
it
is
what
our
city
needs.
It's
not
an
unreasonable
move
to
our
future.
Thank
you.
R
Good
morning,
everybody
we
move
that
down
for
the
record.
My
name
is
Sara
Desrosiers
and
I
felt
compelled
today
to
come
and
I
wasn't
planning
on
speaking
I
felt
compelled
based
on
the
recent
voting
in
the
county
and
I
wanted
to
speak
just
very
briefly
on
the
medical
marijuana
dispensaries
I'm
not
currently
aware
of
what
the
zoning
requires
to
allow
those
types
of
facilities,
but
as
a
professional
news,
community
I
lived
here
for
30
years,
I'm
raising
my
children
here,
I
make
a
living
actually
selling
this
community
as
a
Realtor.
R
It's
important
to
me
that
the
council
and
the
staff
member
of
the
city
of
Punta
Gorda
do
what's
necessary
to
allow
these
dispensaries
to
come
through
to
the
city
of
Punta,
Gorda
I
think
it
will
be
an
immense
benefit
to
this
community
and
I
just
hope.
Everyone
keeps
an
open
mind
and
were
able
to
proceed
in
that
in
that
respect.
So
thank.
H
H
We
had
to
vote
and
I
think
that
communities
surrounding
us
have
said
no
to
having
medical
marijuana,
dispensaries
and
I.
Don't
want
our
community
to
become
the
magnet
the
draw
for
people
to
come
here
and
get
their
drugs.
I
think
that
the
state
law
is
written
very
loosely
so
that
practically
anyone
can
be
approved
to
have
this
drug
and
that
that's
another
problem
for
us.
H
I
I
am
afraid
that
he
is
already
speaking
out
about
broadening
this
loose
law
and
allowing
medical
medical
Marriner
allowing
marijuana
to
be
smoked
whatever
kind
it
is
rather
than
in
different
forms
of
marijuana,
I.
Think
again,
I
think
this
would
be
a
draw
to
the
community
I
think.
Overall,
it's
a
it's
a
thing
that
we
don't
want
to
become
known
for.
I.
Don't
think
it's
good
for
our
community
if
other
communities
want
to
do
it.
That's
fine
but
I'm.
H
N
Wendy
Mueller
Punta,
Gorda,
Isles
and
downtown
Thunder
Gordon,
two
things.
First
of
all,
if
we
do
the
Medical
Marijuana
and
we've
got
eight
story
building,
so
it's
pretty
it's
pretty
good.
Taxing
centers
on
medical
marijuana
is
just
a
ruse.
It
is
moneymaker,
it
will
bring
people,
it
will
bring
a
lot
of
people
I've
been
to
towns
where
that
is
very
true,
and
it
is
amazing
how
many
people
don't
have
a
prescription
but
have
the
Medical
Marijuana.
It's
not
a
good
idea,
we're
a
productive
town.
We
don't
need
to
go
to
sleep
and
eat
a
lot.
N
We
already
do.
That's
not
what
I
came
to
talk
about
I,
really,
don't
like
the
idea.
I've,
never
liked
it
and
I
have
smoked
it
so
I'm
from
both
sides
of
the
fence,
but
the
eight
stories
eight
stories.
What
is
eight
stories
is
that
ten
story
is
that
ten
foot,
or
is
that
twelve
or
could
it
be
14
and
could
880
feet
become
120,
it's
very
loosely
written
from
what
I've
seen
I,
don't
like
the
interpretation
at
all
and
the
fact
that
somebody
drew
a
beautiful,
architectural
drawing
of
everybody
being
at
different
heights.
N
Well,
if
one
person
sells
their
property
for
such
or
such
amount
is
happy,
they
do
eight
stories
at
80
feet.
Somebody
else
isn't
going
to
be
allowed
next
door
to
have
another
80
foot,
building
or
8
storeys
and
I
would
make
it
12
foot
because
I
like
high
ceilings,
and
so
my
buildings
going
to
be
90
to
100
foot,
all
of
a
sudden.
N
What
I'm
seeing
is
not
Naples
Naples
has
got
lots
of
money
and
has
been
planned,
although
their
roads
are
not
terrific,
where
you
want
to
go
they're
kind
of
small
and
very
little
parking.
What
worries
me
more
is
the
fact
that
the
competition
will
build
tall
buildings.
You
will
have
a
Fort
Myers
and,
although
you
say
no
look
at
those
different
pieces
of
property
along
water,
that
may
be
condos
don't
now,
but
it
is
amazing
how
we
can
rezone
city
centers.
N
F
For
allowing
me
to
to
share
I'm
Chrissy
Salazar
and
I'm,
with
drug-free,
Punta
Gorda
I
probably
have
way
too
much
to
say
so.
I'm
going
to
I
hadn't,
planned
on
speaking
today,
I
have
been
working
with
Punta
Gorda
youth
for
over
nine
years
now,
first
with
drug
free,
Charlotte,
County
and
now
the
last
three
and
a
half
years
with
drug
free,
Punta,
Gorda
and
I
have
seen
our
actual
usage
numbers
go
up
and
down
in
regard
to
marijuana.
F
That's
come
from
home,
we
do
have
parents
in
the
community,
and
this
is
reported
back
through
Punta
Gorda
police
through
our
SRO
through
our
teachers,
their
own
personal
experience
that
we
do
have
a
percentage
of
parents
in
our
community
who
are
engaging
in
marijuana
use
in
the
home
and
it's
readily
available
to
the
students.
I
am
very
much
in
favor
of
seeing
Punta
Gorda
ban.
F
This
I
don't
believe
it's
good
for
our
community
for
a
myriad
of
reasons,
and
you
could
all
pick
and
choose
any
one
of
those
one
of
my
concerns
in
the
way
the
state
has
brought
it
forward.
Is
it's
attaching
the
word
pharmacy,
we'll
treat
it
like
a
pharmacy
and
a
lot
of
people
that
we
talk
to
when
we're
out
doing
venues
and
and
bringing
prevention
messages,
a
lot
of
people
are
under
the
impression
that
they
can
get
a
prescription
for
marijuana.
You
cannot
get
a
prescription
for
marijuana.
Marijuana
is
a
Schedule
one
substance.
F
It
is
an
illegal
drug,
a
doctor
and
doctor
Liguria
and
sure
can
support
this
cannot
give
a
prescription
for
marijuana.
What
will
be
given
is
a
recommendation.
A
medical,
dispensary,
medical
marijuana
dispensary
will
not
in
any
way
resemble
a
pharmacy
and
to
link
that
I
believe
really
embeds
in
someone's
mind.
Oh
marijuana
prescription
pharmacy.
It
kind
of
equates
it
with
a
legal
scheduled
substance,
and
it's
not
so
many
more
reasons
to,
but
I
just
would
ask
that
you
would
strongly
consider
following
suit
with
Charlotte
County
and
banning
medical
marijuana
in
Punta
Gorda.
Thank
you.
K
Again
for
the
record
bill,
leach
BGI
just
some
short
comments
on
both
issues,
instead
of
reiterating
which
you've
already
heard
about
the
marijuana
dispensaries
I
implore
you
to
maintain
the
situation
where
we
do
not
allow
these
dispensaries
to
exist
in
our
city.
For
all
the
reasons
that
have
been
stated.
K
K
K
After
looking
at
all
the
information
that
the
mayor
was
kind
enough
to
send
to
me
with
respect
to
building
heights,
I
would
say
that
I
personally
would
be
open
to
some
consideration.
I
do
not
want
to
see
eight
story.
Buildings
and
I
do
not
want
to
see
buildings
designated
or
designed
at
per
story.
I
would
like
to
see
a
height
restriction
in
place,
however,
exceeding
four
storeys
over
parking
would
be
something
that
I
personally
would
possibly
consider
giving
the
nature
of
the
design.
K
K
One
of
the
things
that
I
would
suggest
to
the
council
is
that
these
cardio
areas
be
not
allowed
to
go
out
to
the
extent
of
the
outside
perimeter,
so
a
setback
would
really
mean
a
setback
and
we
would
not
infringe
upon
our
sunlight
or
air
movement.
I
have
spent
many
many
many
many
hours
in
New
York
City
I'm,
not
comparing
this
project
in
New
York
City,
but
it's
very
easy
to
create
a
wind
tunnel
seriously,
and
we
have
a
situation
here
with
our
weather
being
unvarying,
predictable
and
that
could
be
a
serious
issue.
K
S
When
we
first
came
down
here-
and
we
were
writing,
I
was
riding
around
with
my
wife
and
looking
at
the
property.
I
said
there,
one
of
the
great
things
about
Ponte
borders
when
I
have
all
these
high-rise
buildings
in
downtown
I
said
it's
wonderful
and
it'd
be.
Quite
frankly,
that's
one
of
the
reasons.
I've
invested
a
lot
of
money
and
property
in
this
town,
I've
been
to
Naples
my
friends
and
invest
in
Naples
I
like
Naples,
but
I
hate.
S
S
Excuse
me,
the
brain
fog,
I'm
game
for
Myers
to
dinner,
at
a
restaurant
or
have
cocktails
at
a
restaurant
and
believe
me,
the
difference
between
downtown
Fort
Myers
and
the
difference
between
downtown
Punta
Gorda
is
huge
and
I.
Think
most
of
that's
been
called
caused
by
the
small
stores
that
aren't
located
and
don't
have
a
draw
and
the
amount
of
traffic
volume
that
those
high-rises
creates
keep
makes
those
businesses
move
farther
away
and,
as
a
police
officer,
I
can
tell
a
difference
between
being
comfortable
and
unencumbered
and
I.
S
C
T
Morning
for
the
record
Joan
LeBeau
urban
design.
As
you
know,
the
governor
did
sign
into
law
the
amended
legislation
regarding
the
medical
marijuana
and
how
these
treatment,
centers
and
their
dispensary
facilities
would
be
regulated.
The
amended
res
legislation
eliminates
the
city's
ability
to
impose
any
regulatory
control
at
the
local
level
other
than
an
outright
ban.
That
means
that
if
a
local
government
does
not
ban
the
dispensing
facilities,
it
may
not
limit
the
number
of
dispensing
facilities
allowed
within
its
jurisdiction
and
may
not
adopt.
T
Additional
legislation
may
may
not
adopt
additional
regulations
or
fees
that
are
more
restrictive
than
those
currently
in
place
for
pharmacies.
There
is
one
exception
at
the
local
level
that
we
can
consider,
and
that
is
no
dispensing
facility,
may
be
located
within
500
feet
of
any
school.
Currently,
the
city's
land
development
regulations
permit
pharmacies
in
the
city
center.
T
T
T
Within
the
medical
overlay,
district
pharmacies
were
not
specifically
identified
as
the
principal
permitted
use.
This
is
the
area
that
the
medical
overlay
district
was
created
for
and
the
intent
of
the
medical
overlay
district
is
to
provide
for
the
logical
expansion
of
medical
office
needs
necessary
to
accommodate
our
growing
community
and
region.
T
The
medical
overlay
district
was
established
to
accommodate
future
needs
of
the
medical
field.
City
code
allows
for
uses
and
structures
which
are
customarily
incidental
and
subordinate
to
the
permitted
uses.
So
if
should
City
Council
move
forward
on
this
matter,
staff
would
support
the
addition
of
dispensing
facilities
and
pharmacies
within
the
medical
overlay
district
or
available
for
discussion
for
any
questions.
I
guess.
C
T
C
C
T
T
J
So
if
we
were
to
proceed
further
well,
we
not
I,
guess
I,
don't
the
way.
I'm
ready,
I
have
a
problem
with
the
state
law.
Obviously
I'm,
a
strong
component
that
medical
marijuana
should
be
available
to
people
with
cancer.
Having
been
in
that
situation
myself,
however,
because
of
the
yes/no
and
the
lack
of
home
rule
control,
it
becomes
more
difficult
to
be
able
to
support
this
because,
as
a
community,
I
would
want
us
to
have
the
ability
to
very
seriously
restrict
those
dispensaries
so
that
it's
not
just
the
Walgreens
or
whatever.
A
I'm
not
saying
I
think
the
intent
is
that
these
dispensaries
be
treated
as
if
they
were
pharmacies.
So,
wherever
we're
going
to
have
ever
we
allow
for
pharmacies
currently
under
our
zoning
code,
we
would
have
to
be
able
to
allow
for
dispensaries
now,
if
our
zoning
code,
even
with
respect
to
pharmacies,
they
restrict
things
with
great
size
or
what
happened
with
those
pharmacies.
Then
we
can
impose
that
on
the
dispensaries
as
well.
If
not,
then,
whatever
the
limitations
are
in
that
zoning
district
as
it
applies
to
pharmacies,
would
equally
apply
to
dispensaries.
C
N
J
C
A
No
reason
why
you
have
to
Italy
will
require
a
change
to
the
zoning
code
to
allow
for
standalone
pharmacies
within
the
overlay
district.
You
may
choose
not
to
make
that
change.
I.
Think
conceptually,
and
it
was
just
conceptually
with
the
staffs
discussion-
was
that
since
it's
a
medical
area
since
the
hospital
has
a
pharmacy-
and
it
would
not
be
outside
the
realm
of
reasonableness-
to
have
a
pharmacy
within
that
district.
A
T
T
L
Yeah
is:
is
it
possible
that
we
could
continue
this
later
and
I
say
this
for
worse?
This
reason.
L
On
one
hand,
we
need
to
really
protect
our
youth
in
terms
of
this
being
our
community
the
other
hand
we
have
elders
in
our
community
who
do
need
this-
maybe
we're
very
conservative
community
and
being
conserved
community.
If
we're
conservative,
community
and
70
percent
of
us
voted
for
this,
it
means
there
is
a
need.
This
probably
not.
Recreational
bait
is
really
based
on
the
actual
need
for,
but
these
rules
were
in
right
now
really
untenable
is.
Could
we
possibly
one
wait
to
see
who
surrounding
us
does
or
does
not?
L
So
we
know
that
our
people
could
possibly
have
within
some
reasonable
distance
proximity
that
they
could
obtain
this
and
to
speaks
for
a
much
more
restrictive
pharmacy
code.
A
A
Thinking
that,
unless
those
more
listeners,
more
restrictive
for
regulations
than
what
we
presently
apply
to
pharmacies
are
reasonable
as
related
to
just
the
pharmacies,
then
that
might
be
able
to
withstand
a
legal
challenge.
But
if
you're
making
it
more
difficult
to
put
pharmacies
in
not
because
of
the
impacts
that
pharmacies
might
cause,
but
because
of
the
impacts
that
dispensaries
would
cause
because
they're
being
treated
test,
pharmacies
I,
think
that'd
be
difficult
to
defend.
Well,.
L
I
say
this
one
level
only
because
I
do
think
on
a
tangible
level
that
people
do
benefit
from
this
one
health
level,
and
if
we
were
to
really
be
honest
about
this,
probably
the
biggest
issue
is
with
you
know
which
puts
morphine
on.
You
know
Cloyd,
so
we're
going
to
be
real
about
this
pharmacies
actually
are
a
public
health
threat.
L
If
we're
going
to
just
look
at
it
in
a
very
plain
sense
about
in
terms
of
drug
addiction
in
our
country,
I'm,
just
trying
to
think
I
really
just
think
if
we
just
had
more
time
to
think
about
this
I
think
at
this
moment.
Voting
on
this
now
I
just
think.
I'd
rather
wanted
to
see
what
other
communities
are
doing
so
we'd
have
more
time
to
really
explore
this
and
think
of
possible
solutions
of
working.
For
this.
A
Regarding
item
number
two:
the
expansion
of
what
we
have
presently,
and
so,
if
you
wanted
to
defer
that,
then
then
your
decision
making
is
one
of
two
things:
either
we
prohibit
them
or
we
allow
them
to
take
place
where
pharmacies
presently
exist.
If
you
don't
prohibit
them,
the
law
would
allow
them
under
our
code
to
be
where
pharmacies
would
presently
be
Laxmi.
D
J
A
J
D
C
To
say
we
can't
limit
the
number
that
bothers
me,
but
they
are
limiting.
The
number
of
the
state
is
limiting
the
number
of
licenses
that
they're
going
to
put
out
for
these
dispensaries.
So
the
number
is
already
limited.
It's
not
limitless
correct,
and
it's
in
here
this
memo
says
by
a
region.
So
I
guess
you
know
not
knowing
like
how
many
are
going
to
be
allowed
for
our
region.
I
just
have
a
hard
time
and
it's
you
know
I've
been
to
Colorado.
C
We
you
know
where
the
recreational
you
see
the
places
I
may
be
downtown,
Denver
I
mean,
but
out
in
the
ski
slopes
and
stuff
I
didn't
smell,
it
I
didn't
see
people
token
up
everywhere.
You
know,
I
just
didn't
see
it
so
I
do
agree
that
this
is
for
medical
purposes,
but
I
think
there
are
hoops
that
you
have
to
jump
through
to
get
tsa's.
If
it's
not
a
prescription
whatever
it
is
to
be
able
to
go
in
there
to
get
your
product,
I
mean
I,
don't
know
it
just
it
just
really.
L
T
C
I
kind
of
see
this
as
like
those
bait
stores,
it's
just
they're
like
I'm,
not
going
in
there,
but
obviously
they
have
customers
because
they,
you
know,
we
have.
We
have
those
here
in
town
and
unless
they,
you
know,
unless
they
start
attracted,
we've
had
issues
with
convenience
stores
that
have
sold
pipes
and
whatnot,
and
that
did
cause
a
problem
and
we
were
able
to
control
that.
But
I
just
really
don't
see
this
as
being
a
huge
problem
for
the
for
the
general
public.
C
L
My
problem
is
that,
if
the
entire
county
bandit
where
people
who
need
this
I
mean
I,
know
people
write
to
Samoa
with
health
effects
to
need
this,
that,
where
are
they
going
to
go?
That's
what
I'm
saying
if
there's
any
way
we
can
put
off
our
decision
for
a
little
bit,
at
least
to
make
sure
that
the
north
or
south
of
us
that
our
people
are
somewhere
to
go
I
really
don't,
especially
with
the
fact
that
70%
of
us
in
a
given
order,
community
conservative
community
who
voted
for
this.
This
is
not.
You
know.
L
G
M
J
I
agree
with
what
jaha
says,
however,
the
reality
is
that,
even
if
we
ban
this
a
person
who
would
have
need
for
this,
safer
cancer
relief
does
have
a
place
to
go.
It's
just
not
legal
and
the
point
that
I
think
of
wanting
to
have
a
controlled
ability
to
have
this
substance
dispensed
to
people
who
are
in
need
for
medical
reasons.
Is
that
a
matter
of
not
asking
them
to
do
something
that
is
technically
illegal?.
