we
are
in
the
site
and
that's
the
annexation
that
took
place
in
2015.
So
we
have
u.s.

and

we

block

middle
Jones,
Loop
Road
and
the
surrounding
annexation.
And
it's
because
well
at
the
time
it
was
the
best
fit
for
what
it
was.

applied

we
zoom
a
little
bit
tighter

in
HD
zoning,

we're

the
main

to

development

Dollar
General
and
the
O'reilly's
and
they're
on
the

the

away
width
is
approximately

feet,
we're
developing
on
Jones
Loop
Road,
which
is
170
feet.

the
HC
zoning,
if
you
read
through
it
the
whole
point
of
it,
is
to
take
something
put
it
up
on
on
the
property
line,
make
that
downtown
feel
make
it
walkable
pedestrian
friendly,
which
you
know
the
city
of
Punta
Gorda
that
you
have
that
feel
in
your
downtown
corridor
on
u.s.
41,
but
applying
that
to
170
foot
right
away.
I
mean
that's
like
making
75
walkable.

doesn't
make
the
best
sense,
so
zoom
a
little
bit
more

did
a
quick
overlap
and
one
of
the
key
points
of
the
burdens
of
persuasion
is
at
flickable

other
land

zoning

this
annexation

is
more

less
than
a
tenth

the
code

what
the
HC
zone
is
trying
to
accomplish.

dollar
general
same
thing
up
on
the
right
away
line
parking
in
the
rear
and
the
side-
and
this
is
the
tenth
of
HC
zoning
just
doesn't
fit
our
site
in
our
area
with
what's
going
on,
here's
just

development
in
the
area
and
what
what
we're
trying
to
compete
against
in
our
site,
design
and
and
what
works
in
this
area,
because
it's
a
hundred
seventy
foot
right
away.

a
lot
of
traffic
coming
off
of
75.

areas

just

Charlotte

in
the
county
and
the
Walmart
is
my
understanding

being
considered
for
annexation.

that

took
was

feet,
but
the
Walmart's
190
feet
were
requesting
160
feet,

we're
right
there
within
what

we're
asking
for
the
next
Burton
persuasion,
strict
and
literal
enforcement
and
the
zoning.

the
strict
and
literal
enforcement
of
the
HC
zoning
and
applying
it
to
our
site
really
creates
a
hardship
because
we
can't
be
pedestrian
scale
with
107-foot
right
away.
I
mean
it's
that
simple
of
that.
If

strict
and
little
enforcement,
the
HC
zoning
on
this
property,
we
just
can't
achieve
it.
It's
a
it's,
not
walkable
site.
It's
not
pedestrian
friendly.
If
it
was
downtown
city
of
Punta
Gorda,
absolutely
it
makes
sense.
You
can
have
the
pedestrian
traffic
kitchen.
Three.

Such
hardship
is
not
shared
generally
by
other
properties
in
the
same
zoning
district
and
in
the
same
vicinity
same
vicinity.
So
here's
our
site,
here's
recent
development
that
would
be
the
Dollar
General
and
the
O'reilly's-
and
you
know,
they're
the
most
recent
today
the
two
additions
to
your
to
your
city,
the
rest
of
development.
They
there
are
set
back
further,
but
they're
more
or
less
grandfathered
and
and
they're
older
sites
so
again
same
vicinity,
there's
nothing
in
our
facility
in
our
annexation
area.
Here's
another

no
development
in
area
of
annexation.

condition
number
four:
the
granting
of
the
variance
would
not
be
injurious
to
or
incompatible
with
contiguous
uses,
the
surrounding
neighborhood
or
other
otherwise
detrimental

the
public
welfare.
The
aerial
says
it

the
previous
one
with
the
setbacks,
were
right
there
in
line
with
the
Walmart
or
right
there
in
the
sweet
spot,
with
other
setbacks
in
the
area
granted
they
are
the
county,
but
you
are
looking
an
X
and
we
feel
you
know
we're
definitely
a
lot
incompatible
with
the
surrounding
area.

request
is
for
166
feet
from
Jones
Loop,
Road
and
142
feet
from
Indian
Springs
Cemetery
Road.
These
are
the
absolute
minimum
that
were
requesting
we're
not
requesting
any
more
than
we
need.
This
is
all
based
off
of
the
work
that
we've
done
with
your
staff.
To
date,
they
ran
through
a
few
of
the
things
that
we
did
and
working
out
how
to
make
this
site
as
walkable
and
pedestrian
friendly
as
possible
for
we're
at,
and
that
includes
multiple
creation
connections.

sidewalks,
enhanced
crosswalks
I
mean
there's
a
covered
bicycle
area,
there's
a
lot
of
bells
and
whistles
that
all
the
does
it
do
normally,
but
we're
doing
it
because
we
want
to
be
here-

we
want
to
make
this
work

is
where
I
really
put
most
of
my
efforts
into
the
PowerPoint
presentation,
because
it's
actually
dynamic.
Here's
the
sidewalks
we
added
Indian
Springs,
also
a
sidewalk
on
the
west
side,
additional
crosswalks
to
the
site.
Here's
the
covered
parking
area
and
excuse
me
outdoor
seating
area
benches
being
at
it,
and
you
know
landscaping
around
it.

doing
some
enhanced
decorative
bollards,
which
is
a
little
bit
above
and
beyond.
It's
gonna
be
like
a
nice
out,

think
it's
a
pebble
stone
or
a
decade

good-looking
bollard,
which
was
again
requested

staffs.
We
added
it
in
there
more
crosswalks,
more
walkways,
scored,
color
concrete
that
way
it
stands
out
if
you're
driving
through
it.
You
know
that
there's
a
walkway
slow
down
so
we're
doing
all
this
covered
bicycle
parking
and
yellow
there's
going
to
be
additional
overhang.

rise
to
the
requested
variance
has
not

created
by
any
person
presently
having
an
interest
in
the
property

conditions

reasonably

the

had
nothing
to
do
with

that
we

this
site
workable
and

HD
zoning,

wits
that
we
have
condition
number
seven.
The
variance
request
does
not
involve
any
use
which
is
prohibited
in
the
district
where
the
property
is
located.

read
through

goals

comp
plan,
increased
economic
development

employment

a
key
we're
going
to
be
the
first
ones

of
launched
this

be
generating
the
utility
income
for
the

stubbing
out
we're
actually
constructing

we
are
constructing

lift
station,
they're
running
a
private
force,
main

stubbing

to
our
property
line.

two

half

when
you
run
your
force
main
down,
Jones
Knob,
Road,
we're
gonna,
be
the
first
ones
plugged
in
and
we're
gonna
be
paying
utilities
to

So
that's
gonna

set

part
of
our

you

forward-thinking
and
that
we
want
to
be
a
part
of
sitting
and
connect
in
and
the
septics
is
just
so.

immediately
because
all
these

city

grocery
store

current

plan

be

for
the

Marijuana
Lobby
themselves

in
support
of
us.

a
temporary

Simple
fact
is
that

voters
voted

they
thought

situation

we're
in

untenable
for

city
to
support
it,

we

voters
interest

legislators

the

helps
them
in
terms

wanting

letting

they

saying
that

and

support

disallow
the
real
discussion

it

real
changes
in
the
bill,

allows
it

someone

retired.

have

workplace
in
terms
of

this
is

cast

any
working
person
who

smoking.
Marijuana

jeopardizing
their

much

entire
life,
and
this

law

language
does
exist
that
they
can
fix
these
issues,

it

no
concern
for
them
to
fix
any
of

real
issues
and

find
that
this
is
nothing
more
than
good
politics
to
play.

vying
for
market
share

on
that
