First
of
all,
the
regular
City
Council
meeting
of
august
twenty-third
has
been
cancelled
and
I
would
like
to
formally
announce
that
on
September
9th
the
one-year
anniversary
of
the
crust
more
to
glenview
area
disaster,
we
will
be
having
a
formal
memorial
and
that
will
take
place
at
Skyline
College
quad
area,
which
is
an
open
area
and
skyline
college.
Within
the
buildings
there
it's
almost
like
an
amphitheater
and
that's
to.
A
Honor,
the
neighborhood,
the
people
that
died
that
evening,
the
people
that
continue
to
suffer
so
that
will
be
a
formal
remembrance
and
am
saying,
as
you
word
crestmore
to
glenview.
We
are
going
to
also
start
referring
to
that
area
as
crestmore
to
glenview
to
to
re-identify
what
that
neighborhood
really
is.
It's
always
been
talked
about
as
glenview,
because
it
started
with
an
incident
of
a
command
situation
when
it
first
occurred,
but
it
is
really
crestmore
too.

we
will
be
having
that
on
September
19
in
the
evening
on
or
about
the
same
time
that
the
disaster
occurred.
You
can
go
to
the
San
Bruno
city
website
and
look
at
the
details
of
that
evening,
and
it
will
also
be
published

a
number

newspapers
and
at
city
hall
and
the
library
you'll
be
seeing
quite
a
bit
of
information
about
that
evening
and
also
on
Sunday
September,
the
11th.
We
will
be
hosting
crestmore
to
glenview
area
one
year.

Gathering
we've
had
a
number
of
gatherings
this
last
year
for
the
at
the
time
the
glenview
residents.
This
will
be
a
gathering
for
whoever
would
like
to
attend
the
entire
city
of
san
bruno.
Anyone
else
who'd
like
to
come
and
share
with
us
a
rebirth
and
in
a
rebuilding
of
our
city,
not
just
to
crestmore
to
in
glenview,
but
what
we've
been
through
this
last
year
and
going
forward.

it's
going
to
be
a
celebration
of
life
in
September,
the
11th
and
that
again
also
will
be
posted
on
our
city
website.

large
public

a
city
council,
where
you
are
the
board

directors

Municipal

you
do
things
extraordinary,
if
you
provide
tremendous
leadership
that
goes
above
and
beyond
you're
rewarded
and
generally
you're
rewarded
in
those
corporations
with
stock
bonuses,
high
salaries
and
everything
else-
and
we
know
that
doesn't
happen
here.

July
twelfth
city
council,
meeting
two
new
state
was
that
significantly
affect
redevelopment
in
California
were
passed
as
part
of
adopting
the
state
budget
a
be
126.
The
elimination
bill
eliminates
redevelopment
agencies
as
of
October
first
2011,
and
immediately
suspended
most
redevelopment
activities
and
prohibits
agencies
from
incurring
new
debt.
A
b27
provides
an
opportunity
for
for
redevelopment
agencies
to
opt
in
and
to
continue
to
operate
by
participating
in
an
altar
of
redevelopment
program.

The
state
is
using
these
bills
to
help
solve
its
own
budget
problems
in
the
tooth.
In
two
thousand
eleven
and
twelve,
by
diverting
1.7
billion
dollars
from
redevelopment
agencies
to
close
an
unprecedented
precedented
state
budget
gap,
the
City
Council
directed
staff
to
pursue
the
option
for
the
city
to
opt
in
to
the
alternative
program
to
allow
the
San
Bruno
redevelopment
agency
to
remain
in
existence.
This
presentation
outlines
the
reasons
for
the
city
to
opt
in,
and
the
process
involved
in
complying
with
a
b27
San
Bruno
has
a
very
strong
interest
in
maintaining
its
redevelopment
program.

Redevelopment
was
key
in
laying
the
groundwork
for
the
development
at
the
crossing.
The
agency
prepared
the
Navy
site
specific
plan,
an
de
ir
and
provided
affordable
housing
subsidies.
The
developer
relied
on
this
agency
investment
and
commitment
in
making
its
decision
to
purchase
the
site
from
the
federal
government.
The
agency's
investment
leveraged,
the
development
of
one
town
over
1,000
housing
units,
including
325,
affordable,
multifamily
and
senior
units,
15,000
square
feet
of
retail
space
and
the
site
for
a
hotel.

The
agency
is
actively
involved
in
a
number
of
critical,
ongoing
redevelopment
projects
identified
in
the
redevelopment
plan,
the
five-year
implementation
plan
and
the
draft
transit
corridors
plan.
The
agency
has
already
made
substantial
investments
in
these
projects
that
would
diminish
in
value
if
they're
not
completed.

The
agency
is
now
in
the
process
of
developing
the
transit
corridors
plan,
which
seeks
to
create
a
similar
framework
as
the
Navy
site-specific
plan
in
order
to
transform
the
downtown
and
commercial
corridors
around
the
new
caltrain
station
into
a
transit
oriented
development
district.
The
plan
will
be
a
guide
for
future
public
and
private
improvement,
designed
to
promote
private
investment,
accelerate
the
economic
recovery
of
the
city
and
to
generate
quality
local
jobs.

Without
the
adoption
of
an
opt-in
ordinance
agreeing
to
comply
with
a
be
27,
the
Redevelopment
Agency
is
operating
under
the
requirements
of
a
b-26.
The
elimination
bill,
which
is
a
b-26,
suspend
suspended.
All
new
redevelopment
activities
and
dissolves
redevelopment
agencies,
effective,
October,
1,
2011,
suspended
activities
include
incurring
new
indebtedness,
restructuring
existing
indebtedness,
making
loans
or
grants
entering
into
contracts
and
amending
existing
agreements.
The
only
permitted
activities
now
include
making
payments
on
existing
bonds
loans,
legally
binding
agreements
and
contracts
for
administration
of
the
agency.

Additional
requirements
of
a
b-26
include
the
preparation
of
an
enforceable
obligation,
payment
schedule
by
August
twenty-eighth
2011.
If
the
ordinance
is
not
enacted
by
that
date,
the
opt-in
ordinance,
that
is,
creation
of
a
successor
agency
and
an
oversight
board
to
pay
enforceable
obligations
and
administer
the
dissolution
of
the
of
the
agency.

Once
the
agency
adopts
the
opt-in
ordinance,
it
can
resume
normal
operations
without
the
threat
of
dissolution
imposed
by
a
b-26.
The
primary
obligation
incurred
by
the
opt-in
ordinance
is
for
the
city
to
make
annual
payments
to
the
county
order
auditor-controller
beginning
in
this
fiscal
year
and
in
all
succeeding
years
of
the
agency's
existence.
If
the
city
fails
to
make
a
payment,
the
sanction
is
dissolution
of
the
redevelopment
agency
under
a
b-26.
Therefore,
the
general
fund
and
other
funds
are
not
at
risk.

If
the
agency
fails
to
make
a
payment,
I
mean
if
the
city
fails
to
make
payment,
a
b27
is
designed
to
generate
a
total
of
1.7
billion
dollars
from
all
redevelopment
agencies
in
the
state.
In
this
initial
year,
the
California
Department
of
Finance
published
the
payments
for
each
Redevelopment
Agency
in
the
last
week
and
San
Bruno's
payment
amount
will
be
three
million
one
hundred
and
fifty
two
thousand
dollars
in
subsequent
years.
The
intent
is
to
raise
four
hundred
million
dollars
annually
from
payments.

Unfortunately,
the
formula
for
raising
those
funds
is
complex
and
dependent
on
future
factors,
so
it
is
not
possible
to
know
at
this
time
what
the
what
the
city's
annual
payment
will
be.
After
the
first
year,
clean
up
legislation
is
in
progress
which
should
clarify
that
calculation,
a
be
27
payments
to
the
county.
Auditor
controller
are
due
in
two
payments
on
January
15
and
May.
Fifteenth
funds
to
make
the
annual
payments
may
come
from
any
available
fund
source,
including
the
agency's
non
housing
fund,
which
it's
assumed
where
most
of
the
funds
will
come
from.

However,
the
agency
may
use
the
low
and
moderate
income
housing
fund
in
the
first
year,
if
no
other
funds
are
available,
staff
has
identified
redevelopment,
Housing
and
non
housing
funds
to
make
the
initial
payment.
Although
the
finance
department
is
evaluating,
what
portion
could
come
from
housing
funds
which
will
be
presented
at
a
future
meeting,
the
opt-in
ordinance
has
been
crafted
as
an
urgency,
ordinance
effective
immediately.
An
urgency
ordinance
does
not
require
a
second
reading
or
a
30-day
wait
period.
Adoption
of
an
urgency
ordinance
requires
for
both
votes
for
approval.

State
law
states
that
an
urgency
ordinance
may
be
adopted
when
it
is
necessary
to
take
immediate
action
in
order
to
protect
public
peace,
health
or
safety.
Redevelopment
agencies
protect
public
peace,
health
and
safety
by
eliminating
play,
providing
affordable
housing
and
expanding
economic
growth
within
the
project
area.
Under
the
current
conditions
of
a
b-26,
the
Redevelopment
Agency
no
longer
has
the
tools
necessary
to
carry
out
these
stated
goals
without
this
or
urgency
ordinance.

The
RDA
would
be
in
limbo
until
November,
one
or
even
later,
disabled
from
acting
while
the
legal
wrangling
continues
in
the
Supreme
Court
during
this
prolonged
nationwide
recession,
where
investment
and
lending
activity
can
be
deterred
by
even
the
slightest
negative
veritable.
It
is
critical
that
local
government
provide
a
stable
and
predictable
environment
in
which
to
operate
without
a
redevelopment
agency.
The
local
environment
is
neither
stable
nor
predictable.
Furthermore,
the
transit
corridors
plan,
a
ir,
will
soon
be
released
after
a
two-year
visioning
process.

Agency,
therefore,
is
necessary
to
immediately
enact
this
ordinance,
which
will
allow
the
Redevelopment
Agency
the
day-to-day
tools
necessary
to
eliminate
blight,
provide,
affordable
housing
and
expand
economic
growth
while
providing
the
stable
environment,
which
is
necessary
to
encourage
private
sector
investment
in
today's
tenuous
economy
should
also
be
noted
that
the
California
redevelopment
Association
and
the
California
League
of
Cities
have
filed
a
lawsuit
in
this
in
the
California
Supreme
Court
challenging
the
constitutionality
of
a
b-26
and
a
b27.
The
suit
asks
for
a
stay
while
the
case
is
being
decided.

As
the
next
step
will
be
for
the
agency
and
the
City
Council
to
approve
an
agreement
whereby
the
agency
will
transfer
tax
increment
to
the
city
for
the
required
annual
payment,
this
should
be
done
sometime.
This
fall
prior
to
making
the
first
payment
staff
will
also
be
monitoring
and
report
back
on
clean
up
legislation
that
is
currently
in
progress,
which
should,
as
I
mentioned
before,
clarify
the
calculation
of
payments
after
the
first
year.

choice

council

three

were
johnny-come-lately
to
to
the
game
in
the
first
place,

we
saw-

we
still
see
the
benefits
of
redevelopment
and
it's
just
like
san
bruno
to
get
tripped
up
every
once
in
a
while.
You
know,
911
happens
and
we
get
stuck.
I
Explosion
happens
and
we,
you
know,
and
we
got
to
regroup
and
it's
just
san
bruno,
the
resilient,
City
and
I
think
we're
going
to
do
it
again
and
I.
Think
we've
got
some
great
plans
for
redevelopment
and
what's
that
I
think
we
should
keep
redevelopment
and
I'd
like
to
introduce.
The
resolution
introduced
the
ordinance
we've.

Before
we
move
on
to
the
next
item,
I
just
want
to
say
also
since
the
Assemblyman
is
here
joining
us
this
evening,
I've
spoken
to
him
personally,
any
public
that
I
believe
this
is
a
form
of
extortion
and
I'm,
not
really
in
favor
of
it,
but
as
councilmember
I
Barisan.
We
really
have
no
have
no
choice:
I
guess
the
you
know,
Prop
22
a
while
ago
said:
don't
touch
our
money.
The
governor
pretty
much
said
well
yeah.

We
can't
touch
the
money,
but
we
can
sure
try
to
eliminate
the
agencies
circumvent
what
the
people
really
want.
I
still
believe
that
the
people
don't
want
this
touched,
but
unfortunately,
at
this
point
in
time
we
really
have
really
have
no
choice,
so
hopefully,
as
the
council
member
said,
you
know
this
is
to
receive
the
light
at
the
end
of
the
tunnel.
It's
just
a
little
further
out
there
and
hope
it's
not
a
train
coming
the
other
way.
So
anyway,
don't.

wanted
to

see
that
there's
no
one
here
that,

my
block
at
least
that's
complained
to
me
so
I
guess:
I
stand
alone
about
I'm
just
getting
over
the
sticker
shock
on
our
our
recent
bill
for
the
water
and
sewage
and
so
forth,
which,
on
my
own
account,
has
gone
up
by
about
thirty
percent.
This
time
oh
I
see
where
mayor
has
said
that
the
rates
have
increased
aggressively
to
pursue
infrastructure
over
the
last
few
years.
I
I
think
that's
really
an
understatement.

Packing
and
packing
us
are
hitting
us
with
such
such
bills,
even
if
we
could
get
something
as
a
proposition.
Maybe
when
you
people
are
going
to
be
reelected
or
something
have
a
proposition
on
there,
so
people
will
see
what
you're
doing
and
why
you're
doing
it
or
why
you
say
you're
doing
it,
people
just
don't
open
up
there
PG&E
bill
in
and
there's
water
Billings,
and
then
they
see
these
inserts
and
then
I
think
all
just
more
garbage,
and
so
they
drama
way
and
they
don't
read
them.

I
read
every
one
and
I
talked
to
my
neighbors
about
it
and
they
say:
I
didn't
see
that.
Why
don't
you
go
the
City
Council
me
I
didn't
know
there
was
one
well
I
didn't
either
until
I
went
down
to
the
the
water
department
in
and
raised
a
little
hell
about
that
water
bill
and
I.
Just
don't
know
it's
it's
just
I,
guess
I'm
by
myself.
It
just
seems
that
we
have
no
budgetary
or
fiscal
responsibility
at
the
local
state
or
federal
level
anymore
and
I.
Just
don't
understand
it's
like
a
sembrano
cable.

very
much
you
know
we're
really
not
supposed
to
comment,
but
I
will
tell
you,
I
am
believe
it
or
not
as
as
frustrated
as
you
are
with
with
the
situation.
It's
not
just
water.
When
you
talk
about
cable,
that's
a
frustrating
thing
for
us.
Those
are
some
costs
that
are
passed
on
to
us
that
we
in
fact
have
no
control
over,
and
so
it's
a
very
difficult
situation
that
will
put
ourselves
into.
We
are
not
a
new
city
with
and
I
talked
about
infrastructure.

We
have
a
lot
of
them
and
we're
trying
our
damnedest
frankly
to
correct
the
situations
very
difficult,
but
we
were
just
sued
recently
and
had
to
pay
a
ton
of
money
that
should
have
gone
underground
into
our
streets
to
other
entities
for
things
like
attorneys
fees
and
things
like
the
rose
foundation
and
all
different
kinds
of
stuff
that
won't
come
back
to
our
city.
So
we
are
working
closely
with
our
elected
representatives
higher
up
to
see
what
we
can
do
about
that
particular
situation.

the

County
mosquito
and
Vector
Control,
District
I
dislike
to
give
you
and
the
residents
of
San
Bruno
short
update
on
the
district's
activities
as
part
of
the
district's
ongoing
education
and
outreach
program.
Dr.
colleges,
dr.
sinja,
TV
and
I
men
are
information
table
Sunday
july
twenty.
Fourth,
as
part
of
your
Seminole
farmers
market,
we
spoke
to
a
number
of
cembran
or
residents
and
even
scheduled
a
couple
of
resident
visits.

We
handed
out
are
a
number
of
our
state
be
aware,
via
West
Nile
virus
flyers
and
had
also
been
able
to
get
these
in
a
number
of
san
bruno
businesses.
I
left
a
few
in
the
back
today,
some
of
the
businesses-
california,
prudential
realty,
the
pharmacy
here
at
walgreens,
big
joe's
number,
eight
on
san
mateo
avenue,
rolling,
pin,
donuts,
red
lobster
and
lunardi's
market.
I
believe,
there's
a
couple.
Others
we're
agreed
to
post
this
choir,
asking
residents
to
report
to
the
state
dead,
birds
and
squirrels
that
could
be
affected
with
West
Nile
virus.

want
to
thank

your
staff
and
the
various
city
departments
who
have
put
up
this
displayer.
The
Senior
Center
also
has
won
a
Senior
Center
hat.
These
are
not
flyswatters.
We
handed
these
out.
These
are
mosquitoes
water's
going
to
give
one
to
the
city
clerk
to
use
it
on
other
than
mosquitoes.

Seminole
cable
continues
to
run
the
district's
monthly,
varying
slides
information,
slides
I
recently
observed
from
the
ground
and
from
the
helicopter.
The
treatment
that
occurs
once
every
2
to
3
occurs,
and
it
will
occur
two
or
three
more
times
on
a
three-week
schedule.
/
Mills
field,
open
space,
east
of
7th
Avenue
property,
where
numerous
ponds
holding
water
are
overgrown
with
julie's,
requiring
that
we
dropped
pellets
into
the
water
from
the
helicopter
because
we
cannot
get
in
on
foot.

An
IRA
recently
observed
the
san
francis
airport
supply
vegetation
eating
goats,
as
they
helped
remove
vegetation
growing
in
the
small
disk
east
of
7th
Avenue
properties.
So
the
district
personnel
could
more
easily
and
more
completely
sample
and
as
needed,
treat
standing
water
and
finally
I
observed
recently,
and
they
did
some
more
work
today
as
they
cut
back
and
and
removed
heavily
overgrown
blackberry,
bushes
growing
into
other
sections
of
that
ditch,
so
that
the
district
personnel
could
more
easily
get
in
test
and
where
necessary,
treat
standing
water
for
possible
breeding.

Mosquitoes
number
of
your
residents
commented
that
they
had
not
seen
our
district
right.
White
right
hand,
drive
jeeps
that
continue
to
treat
on
about
a
three-week
schedule.
All
of
the
city's
storm
drains
sword
rain
catch
stations
for
standing
water,
so
in.
In
conclusion,
if
you
any
city,
employee
or
residents
have
questions,
they
can

come

work
with
the
resident
and
either
correct
their
problem

help
them

on
prior
direction,
at
one
of
your
last
meetings,
I'm
presenting
for
your
consideration
tonight,
a
draft
ordinance
prohibiting
mayor
medical
marijuana,
distribution
facilities
in
the
city,
the
ordinance
is
based
on
best
available
legal
and
policy
research
that
we've
done
and
is
quite
similar
to
ordinances
passed
by
other
cities
both
on
the
peninsula
and
across
the
state
of
California.
As
you
know,
and
as
I
reported
at
the
last
meeting,
there
are
legal
and
regulatory
changes

replacement
of
the
1988
Pierce
fire
engine
after
22
years

service

120,000
miles
city
council
proceeded
to
authorize
staff
to
enter
into
a
purchase
contract
with
seagrave
for
the
Pharaoh
apparatus.
However,
since
the
equipment
replacement
fund
had
only
three
hundred
forty-two
thousand
dollars
of
monies
accumulated
for
the
replacement
of
the
equipment
staff
recommended
that
we
look
at
other
financing
opportunities
to
substantiate
the
purchase.

as
a
result,
City
Council
actually
directed
staff
to
do
that.
To
look
for
such
financing
options,
we've
since
been
notified
by
the
vendor
that
the
fire
apparatus
is
near
construction
and
is
expected
to
be
delivered
to
the
city
the
week
of
august
twenty
seconds.
So
a
staff
proceeded
to
contact
the
number
of
financing
sources
to
determine
what
the
options
are
available
in
terms
of
financing
the
apparatus
and
through
the
solicitation
of
six
firms,
the
lowest
quote
that
we
received
was
from
JPMorgan
Chase
and
an
interest
rate
of
2.95
percent
for
seven-year
term.

way
the
financing
is
structured
is
that
the
full
amount
of
the
loan
for
the
fire
for
the
value
of
the
apparatus
will
be
taken
out.
However,
since
the

I
indicated
earlier
since
the
city
has
reserve
funds
available,
we're

payment
of
300
thousand
dollars
against
that
loan,
thereby
really
financing.
