pursuant
to
previous
direction
that
was
provided
to
staff
via
properly
noticed
and
legally
conducted
closed
sessions.
I,
as
your
city
manager,
have
proceeded
to
fulfill
the
City
Council
as
a
direction
to
execute
a
purchase
and
sale
agreement
for
purchase
of
two
parcels
commonly
known
as
parcels.
Seven
and
eight
were
the
hotel
side
from
arden
Regis
San
Bruno
associates
at
the
crossing
san
bruno
development
site.

The
purpose
of
the
report
tonight
is
both
to
give
you
an
update
on
that
transaction
as
well
as
to
provide
the
opportunity
for
public
disclosure
about
this
transaction
purchase.
Price
it
was
negotiated
for
this
purchase
is
1
million
four
hundred
thousand
dollars,
and
the
purpose
of
the
purchase
is
to
provide
the
city
with
full
control
over
the
ultimate
end
user,
as
well
as
to
avoid
sale,
pending
property
owner
urgent
interest
to
sell
the
property,
potentially
even
to
a
speculator.

Who
may
determine
that
immediate
development
of
the
site
is
not
in
his
interest
but
to
hold
the
property
for
various
speculative
purposes.
As
the
City
Council
is
well
aware,
this
particular
location
at
the
at
the
border
of
the
property
adjacent
to
380
and
El
Camino
has
long
since
the
property
was
originally
developed.
Under
the
concept
of
a
specific
plan
completed
by
the
city
in
the
early
2000s.

Unfortunately,
over
the
last
decade,
plus
the
hotel
market
has
languished
and
hotel
development
has
not
been
proceeding
aggressively
more
recently,
and
this
is
part
of
the
reason
I
think
for
the
property
owners,
lack
of
patience
and
and
finding
that
the
time
is
right
to
sell
the
property.
More
recently,
the
hotel
market
has
heated
up
a
bit
and
in
fact,
city
has
been
in
discussion
informally
for
a
period
of
months
with
some
what
appear
to
be
very
highly
qualified
individuals,
multiple
representation.

May
ultimately
be
able
to
complete
development
of
a
hotel
with
associated
conference
facilities.
That
is
the
city's
ultimate
anticipated,
not
just
dream,
by
a
requirement
for
that
property
again.
Purchase
of
the
property
will
allow
the
city
to
control
who
ultimately
develops
a
hotel
and
conference
facilities
on
that
site
and
by
so
doing
will
allow
the
city
to
better
realize
its
goal
of
having
an
all-suite
hotel
and
conference
banquet
facility
within
the
city
limits
which
again
has
long
been
a
dream
and
a
necessity
for
the
furtherance
of
the
city's
interests
as
the
owner
of
the
property.

In
addition,
the
city
may
want
to
consider
putting
out
a
request
for
proposals
in
the
relative
near
term
for
the
in
order
to
take
advantage
of
what
appears
to
be
heating
up
development
interests.
Market
development
interest
in
the
hotel
sector
purchase
agreement
was
signed
on
July,
twelve
two
thousand
twelve
and
twenty
five
thousand
dollars
in
deposit
money
was
paid
into
an
escrow.
The
purchase
is
contingent
upon
the
city
receiving
final
appraisal
supporting
the
purchase
price,
as
well
as
the
city's
complete
review
of
the
environment,
environmental
remediation
status
of
the
site.

Although
staff
has
not
yet
received
the
final
complete
appraisal
documents,
our
appraiser
has
verbally
confirmed
a
valuation
of
1.65
million
dollars.
City
has
engaged
in
environmental
consultant
to
review
the
remediation
documents
and
that
work
is
in
progress.
The
due
diligence
period
will
end
on
august,
1st
2012
and
close
of
escrow
under
the
purchase
and
sale
agreement
is
anticipated
to
occur
honor
before
August
15
2012.

You,
the
city,
has,
over
the
last
several
years,
incrementally
received
development
impact
fees
from
the
development,
primarily
at
the
crossing
site,
as
the
various
buildings
at
the
crossing
have
been
completed
under
the
development
agreement
that
we
negotiated
many
years
with
the
developer.
An
incremental
payment
of
development
impact
fees
has
occurred
with
each
new
building
that
has
been
permitted
for
construction
city
has
received
in
total
approximately
1
million
dollars
in
such
fees,
which
have
not
otherwise
designated
or
earmarked
for
a
media
tother
purpose
and
have
not
been
spent
in.

It's
actually
a
tax
that
that
occurs
on
each
new
residential
unit
that
is
constructed
in
the
city.
So
over
the
course
of
the
last
several
years
with
the
merriman
and
marisol
and
other
smaller
developments
that
have
occurred
around
the
city,
the
city
has
accumulated
a
relatively
modest
amount
of
development
fees
that
have
otherwise
not
been
designated
for
some
specific
purpose.

It
is
the
city's
intent
to
use
those
fees.
Are
those
amounts
that
have
been
accumulated
in
a
one-time,
Reserve
account
to
complete
this
purchase
and
ultimately
I
believe
it
is
the
City
Council's
intent
once
and
whenever
that
is
a
successful
hotel
development
can
be
a
an
agreement,
can
be
entered
into
for
such
a
development
and
a
developer
is
in
place.
It
would
be
the
city's
option
at
that
point
to
include
sale
of
the
property
into
a
negotiated
transaction
for
development
of
a
hotel.

asked
for
the
opportunity
to
comment,
because
late
this
afternoon,
staff
received
a
comment
from
a
resident
of
sannen
as
Santa
Ynez
who
lives
on
that
street
near
San,
Antonio
Avenue,
who
was
concerned
about
the
proposed
closure
of
the
street
for
a
temporary
period
of
time
to
accommodate
a
anniversary
party
for
heavy
hauls
preschool.

Although
this
resident
is
not,
this
residence
is
not
within
the
proposed
street
closure
area.
The
resident
wanted
her
concern
to
be
made
known
to
the
City
Council
villa's
staff,
and
that
concern
specifically
was
about
this
resident
not
having
access
to
the
two
on
street
parking
spaces
in
front
of
her
home
on
Santa
Ynez
during
the
closure.

The
resident
also
complained
that
there
are
occasions
where
happy
hall,
schools,
employee
employees
occupy
many
of
the
on
street
parking
spaces
on
Santa
Ynez
and
they
frequently
Park
a
relatively
long
amount
of
time
in
front
of
the
residents
causing
inconvenience
to
neighbors.
Staff
recommends
that,
in
addition
to
the
conditions
that
have
been
presented
in
the
written
report
in
your
packet,
that
an
additional
requirement
could
be
provided
to
resolve
or
to
address,
but
at
least
to
address
the
concern
that
I
just
identified.

Persons
who
will
be
monitoring
the
the
barricaded
area
so
that
she
could
utilize
that
parking
space,
even
during
the
time
of
the
street
closure,
apparently
we've
communicated
with
the
owner
of
happy
hall,
and
she
has
agreed
to
provide
that
space
for
use
by
the
resident
who
has
expressed
the
concern,
although
while
it
may
be
somewhat
difficult
to
enforce,
we
believe
that
this
auction
would
be
a
viable
solution
to
the
complaint
that
has
been
addressed
and
offered
that
for
your
consideration.

a
couple
of
things.
One
just
brief.
History:
we've
been
at
Hopkins
70
since
nineteen
fifty-one
and
for
the
past
6
21
years
we
have
seen
over
50,000
children
go
through
our
school,
which
is
incredible
to
think
about
that
I've
been
with
happy
Hall
40
years.
My
name
is
Mary
Lou,
Johnson,
I'm,
sorry
to
introduce
myself
and
initially-
and
I
am
the
owner
of
the
skull
as
well
and
I
I-
understand
that
there
is
a
parking
issue.

I
really
do
and
I'm
really
I'm
really
happy
to
work
with
the
neighbors
to
to
work
this
through,
and
it's
really
not
an
issue
for
us.
We
are
occupying
just
the
area
directly
in
front
of
our
school,
which
is
four
parcels.
We
own
poor
parcels
on
that
side.
We
don't
have
any
neighbors.
Excuse
me.
We
don't
have
any
homes
on
the
north
side
of
santa
inez
and
although
one
faces
San
Antonio,
the
garage
is
on
Santa
Ynez.

We
will
work
with
those
neighbors,
the
neighbor
that
has
made
the
comments,
if
they're
very
valid,
and
we
will
closely
work
with
them
and
be
sure
that
we
accommodate
everything
possible,
not
only
just
for
this
event
but
for
future
situations.
The
complexity
of
our
community
has
changed
quite
a
bit
over
the
past
40
years.
There
are
many
more
multiple
home
people
living
in
homes
and
then
there's
also
around
the
corner
from
us,
and
it's
been
there
probably
much
longer
than
happy
hall.

is
a
really
lovely
apartment
unit,
that's
not
quite
visible,
but
has
20
units,
and
it
does
not
have
any
parking
space
whatsoever.
So
oftentimes
happy
hall
gets
sort
of
label
that
we
are
the
ones
but
there's
community
just
moving
from
place
to
place
and
with
street
cleaning.
It
really
is
a
big
challenge
and
our
teachers
are
instructed
not
to
park
on
Santa
Ynez,
the
neighbor
that
made
the
comment
I'm.
Actually,
the
one
that
parks
there
so
make
a
point
of
staying
away
from
that.

know
we
park
there,
so
I
can
move
mind,
I'm,
probably
the
one
that
can
move
it.
The
best
and
she's
a
renter
and
I
had
not
had
that
level
of
communication
for
a
number
of
with
her,
but
I'm
really
happy
to
open
that
door

make
that

available
to
see
how
we
can
continue
to
provide
her
anything

we
possibly
can

also
we've
contacted

other
neighbors,

they
have
children

excited

events
seasonally
in

time

on

hoping
to
look
at.

an
annual
as
an
annual
event
for
the
families.
