Description
San Bruno City Council Meeting November 23, 2010 10d. New Chapter to Municipal Code
B
B
It
means
where
the
city
has
gone
and
approved
some
development,
whether
anything
from
a
building
permit
all
the
way
up
to
a
very
large
development,
and
that
that
development
is
challenged
in
court
and
the
city
is
usually
taken
along
as
a
third
party
or
real
party
in
interest,
the
cost
that
the
city
would
incur
legal
fees
and
costs
have
to
be
indemnified
by
the
developer.
Typically,
what
Sam
earnest
staff
has
done
in
the
past
is
is
a
larger
development,
certainly
included
as
a
condition
of
development.
This
same
form
of
indemnity
back
in
2002.
B
There
was
an
attorney
general's
report,
the
opinion
that
said
as
long
as
there's
an
ordinance
in
place.
The
city
can
require
this
indemnity,
whether
or
not
it's
a
condition
of
development,
so
it
was
a
safeguard
just
to
make
sure
it's
there
anytime.
The
city
might
get
taken
a
court
in
the
future
on
a
developer
development
project.
With
this
ordinance
in
place
in
your
city
code,
you
will
always
be
ensured
to
have
your
costs
covered
by
the
developer.
