agenda

5b,
which
is
sky
crest,
drive
an
environmental
determination
and
negative
declaration,
was
previously
prepared
and
certified
we
requested.
This
is
requested.
The
city
council
adopt
and
ordinance
amending
the
development
agreement
to
provide
for
its
conditional
termination
of
authorized
city
manager
to
execute
the
consent
to
assignment
of
affordable
housing
agreement
and
improvement
agreement
staff
report.

You

This
subject
site
was
part
of
a
five
point:
six
acre
skycrest
shopping
centre,
the
shopping
centre
was
failing
in
the
past,
and
a
developer
came
in
divided
the
site
to
create
the
three-acre
commercial
site,
that's
currently
utilized
for
lunardi's.
They
were
able
to
also
do
some
improvements
to
that
property
and
then
the
remaining
2.5
acre
residential
development
site
in
2005,
the
city
council
approved
the
development
of
24
new
single-family
homes.
The
developers
guide,
crest
partners
has
completed
construction
of
12
of
those
single-family
homes.

They've
also
completed
the
roadway
improvements
utility
improvements,
the
common
landscaping,
as
well
as
the
small
park
that
is
on
site
skycrest
partners,
is
in
contract
to
sell
the
remaining
12
lots
in
the
development
rights
to
dr
horton
bay,
so
that
they
can
come
in
and
complete
the
construction
of
those
12
homes
to
facilitate
this
transaction.
Skycrest
partners
request
that
the
city
council
approve
a
conditional
termination
of
the
development
agreement,
also
approve
assignment
of
the
affordable
housing
agreement
and
assignment
of
the
improvement
agreement
to
the
new
developer,
which
is
dr
horton
bay.

The
City
Council
has
accepted
those
improvements
that
there's
some
other
provisions
relating
to
the
maintenance
and
some
of
the
requirements
that
we
want
to
assign
over
to
dr
horton
Bay,
just
in
case
there's
any
damage
to
the
infrastructure
during
their
construction
timeline.
So
this
is
a
recommendation
to
the
City
Council.
You
do
have
a
resolution
in
front
of
you.

be
recommending
the
city
council
adopt
an
ordinance
to
have
the
conditional
termination
of
the
development
agreement
and
then
also
recommend
the
council
authorized
the
city
manager
to
approve
the
assignment
of
the
affordable
housing
agreement
and
also
be
in
Simon.

recently
at
lennar,
which
is
another
nationwide
builder,
starting
cedar,
Mills
project
down
on
cedar
and
pepper,
and
now
we
have
another
nationwide
developer
interested
in
this
site.
So
that's
that's
just
deposit
another
positive
thing:
that's
you
know
happening
in
San
Bruno
right
now.

We

think
have
done
everything
we
promised
the
city
we've
taken
care
of
lennar
tease.
We
built
the
12
houses,
we
loan
money
to
the
city.
We
took
care
of
the
medians
on
san
bern
avenue
or
share
of
that
we
built
all
the
infrastructure.
It's
all
been
taken.
Care
of.
The
only
thing
left
is
the
belt
built
built,
12
houses
and,
at
this
point,
large
Builders
are
frankly
in
a
better
position
to
build
in
this
market
than
we
are
and
that's
why
we
pursued
a
possible
sale
to
dr
horton.

would
be
another
year
or
two
for
us
to
sit
around
to
wait
for
the
market
to
improve
their
ready
to
build
right
now,
and
I
think
that's
a
win-win
for
everybody.
It's
it's
time
for
us
to
sell
it
to
somebody
who
can
start
construction.
San
Bruno
has
a
need
for
more
single-family
housing
and
these
houses
could
be
built
in
literally
a
matter
of
months,
they're
all
ready
to
go.
So
unless
you

and

mixed

would
like

finish
the
12
houses,
but
it's

bigger
boys

step

they
can

volumes
are
different
than
ours
and
they'll
get
it
built
for
you
faster
than
we
would.
