diverse

initiatives

revitalized
our
amazing
Community
District
on
Post
Street

together

stand

anti-drag
anti-gay
anti-trans
legislation
and
the
continued
injustices
toward

lgbtq

performing
drag
allows
our
lgbtq
folks

be
their
authentic
selves.

shouldn't
be
making
it
illegal.
We
should
embrace
it.

the
sanctuary
where
we
invest

uplift
our
lgbtq
and
non-binary
folks,

they

develop

talent,

builds

stronger
San
Jose.

offers

programs
English

a
second
language
classes,
computer
classes
a
teen
center
in
in
coordination
with
the
Bascom
Community
Center,
which
is
on
the
same
site
story
times
and
even
amends
emotional
support
group
in
2022
they
had
over
69
000
visitors.
It
is
one
of
our
libraries
that
is
open
on
Sundays,
and
this
number
will
certainly
continue
to
grow
with
awesome
services.

visit

public

doesn't
have
to
be
Bascom.
It

one
closest
to

There
are
so
many
free
ways

cultivate

curiosity

creativity

one

library

the
city's

more
than
350
incredibly
dedicated
volunteers,
who've
donated
more
than

000
hours
of
their
time
to
the
library,

as

council
member

seven

week,
which
is
why
the
majority
of
the
Bascom
staff
is
actually
at
the
branch
right
now
surveying
the
public,
and
so
we
want
to
honor
them
and
thank
them
for
all
their
hard
work.

Babylonians

Mesopotamia

the
first
to
observe
the
changes
of
months
seasons
and
created
the
calendar
based
on
the
movement

sun

moon
and
celebrated
the
Looney
solar
calendar

observance

spring
equinox
as
a
Syrian
New
Year.
This
celebration
is
a
symbol
of
Rebirth
of
Life,
hope
and
Order.
The
city
of
San
Jose
has
a
large
vibrant
population
that
observes
the
Assyrian
New
Year,
and
the
festivities
that
take
place
provide
an
opportunity
for
all
in
San
Jose
to
experience
the
richness
of
Assyrian
culture
and
Foster
an
appreciation
for
traditions.

2009,
unlock
began,
serving
Santa
Clara
county
seniors
by
addressing
their
complex
medical
needs
and
connecting
them
to
vital
care
unlock
then
purchased
an
adult
day.
Health
Care
Center
in
East
San
Jose,
originally
founded
by
moxa,
the
Mexican-American
Community
Service
Agency,
the
unlock
East
San
Jose
Center
opened
as
an
adult
Health
Care
Center
and
Pace
Alternative
Care
setting,
and
earlier
this
month
the
location
celebrated
its
fifth
anniversary.

The
PACE
program
has
allowed
for
seniors
and
in
particular
senior
women
to
age
and
live
out
their
lives
comfortable
comfortably
within
the
comfort
of
their
own
homes,
surrounded
by
the
memories
and
Legacies
that
they
have
created.
Our
city
owes
a
great
amount
of
gratitude
to
the
caring
team
at
unlock.

in
this
moment
is
predominantly
women-led.

seniors

role

women

co-founded
by
a
woman,

ansac,
but
over

the
four
Executives
at
unlock
have
been
women,
and
today
a
majority
of
our
senior
leadership
team
are
also
women.

the
women
that
we
celebrate
during
women's
history
a
month
are
those
who
have
been
front
and
center,

innovators,
the
Pioneers,
those
who
have
made
amazing
contributions
to
society,
but
we
also
want
to
celebrate
women
who
do

work
behind

scenes,
such
as
our
caregivers,
who
provide
crucial
care
to
loved
ones
in
their
homes.
Our
social
workers
who
provide
heartfelt
support
to
seniors
and
their
families
today
is
also
World
social
worker
appreciation
day
and
the
work
that
they
do
is
so
profoundly
deserved
of
this
recognition.

his
leadership,

established
numerous
Ministries

meet
the
needs
of
the
underprivileged,
Foster
healthy
family
relationships
and
address
various
challenges
facing
our
youth.
Bishop
Dace
was
very
civically
involved

well.
He

part
of
the
black
leadership
kitchen
cabinet,
the
NAACP
and
people
acting
in
community
Spirit
or
Pact
and
Community
together,
I
believe
were
packed.
He
also
served
on
the
San
Jose
police
chaplaincy
and
was
part
of
the
Envision
San
Jose
2040
task
force.

leadership
and
commitment
to
his
community
won
him.
Many
awards,
including
clergy
of
the
Year
by
the
100
black
men
of
Silicon
Valley
in
the
NAACP
Legacy
award,
now
I
believe
there
are
a
few
visitors
here
today

Bible
Way
who
have
come
here
for
this
adjournment.

them

After
a
long
period
of
feeling,
weak
and
fatigued,
my
dad
went
to
the
hospital
and
learned
that
he
had
heart
failure
and
over
the
course
of
his
life
he
had
under
undergone
countless
surgeries
and
procedures
to
keep
his
heart.
Beating
many
doctors
and
onlookers
may
say
that
he
had
a
weak
heart,
but
they
couldn't
be
further
from
the
truth.

dad's
heart
was
very
strong
and
most
that
I've
ever
known
him
would
say
that
he's
probably
had
the
most
heart
of
anyone
that
they've
ever
known,
Bishop
Oscar
Dace
had

heart
for
serving
his
community
Through,
supporting

houseless
youth
and
as
an
activist
for
social
justice,
he
had
a
heart
to
honor
God
and
to
be
a
spiritual
leader
to

crossed

with
the
presentation.

wanted
to
provide
this
council
with
an
overview
of
your
role
as
elected
officials
and
Municipal
Bond
disclosure,
so
just
kind
of
a
little
introduction
over
my
30
plus
year
career
with
the
city
government
issuers
are
municipal
bonds
across
the
country,
I've
seen
the
most
transformative
period
with
respect
to
repairing
disclosure
documents
and
continue
to
report
on
annual
operating
data
and
material
events
to
the
market.
These
are
terms
and
Concepts
that
we
were
introduced
during
the
presentation.

So
since
this
is
one
of
my
last
two
presentations
before
the
city
council,
try
not
to
be
a
little
emotional
about
it,
but
I
wanted
to
leave
you
with
some
of
my
knowledge
and
hopefully
a
little
bit
of
passion
about
the
municipal
bond
market.
It's
a
market
that
provides
communities
across
the
country
just
like
ours,
with
essential
public
infrastructure,
from
airports
to
zoos,
and
we
have
financed
in
San
Jose
projects
from
A
to
Z,
so
I
just
wanted
to
kind
of
set
that
little
tone
for
you
and
leave
you
with
some
of
my
passion.

So
with
that
we'll
start
off.
So
we
have.
We
have
quite
a
presentation
for
you
and
we
had
a
little
preview
of
it
last
week
with
our
key
staff
members
across
the
organization
nearly
70
people
participated
in
a
zoom
presentation.
It
was
a
little
longer
because
we
went
into
specific
details
about
their
roles,
but
I'm
happy
that
you're
here
today.

So
next
we
have
a
little
bit
and
you
probably
see
it's
your
tape
at
your
at
your
desk.
There,
a
laminated
version
of
this
slide
right
here
and
we
hope
you
can
take
this
away
as
a
kind
of
a
remembrance
of
the
municipal
bond
process
and
I'll
walk
through
it
with
you
there's
a
little
game
piece.
If
you
want
to
follow
along
it's
laminated,
so
you
can
use
it
as
your
placemat
in
your
office
when
you
eat
your
lunch
but
anyway,
so
we
have
it
there
for
you
kind
of
as
a
memory.

So
this
is
we're
using
this
an
example
of
kind
of
building
a
new
city
hall.
I
can
tell
you
our
process
of
building
our
city
hall
was
a
little
bit
more
complicated
than
this,
but
it
provides
a
good
example,
so
we
start
off
with
the
city
or
a
government
agency
deciding
to
issue
bonds
and
in
our
case
the
city
was
deciding
to
issue
bonds,
because
City
Hall
was
overcrowded
and
we
had
at
that
time
about
two-thirds
of
our
workers
in
lease
space.

So
we
make
that
decision
to
issue
and
we
hire
Municipal
advisors,
Municipal
advisors
advise
the
issuer
on
the
structuring
and
marketing
of
the
bonds.
They
have
a
fiduciary
responsibility
to
the
issuer,
so
their
their
obligations
are
to
us.
They
assist
us
with
selecting
other
members
of
the
financing
team.
They
help
us
with
projected
financial
information,
the
impact
of
the
plan
financings,
and
they
also
review
the
official
statement.
This
document
that
we
ultimately
put
together,
but
they
don't
have
affirmative
due
diligence
under
Federal
Securities
Law.

At
the
same
time,
we
also
hire
Bond
and
disclosure
Council
to
help
us
start
with
the
formation
and
putting
together
those
documents.
Then
we
select
the
underwriter,
the
underwriter
or
the
purchasers
of
the
bond.
They
purchase
the
bonds
from
us
and
resell
them
to
the
investors.
But
it's
important
to
remember
that
they
don't
have
a
fiduciary
responsibility
to
the
issuer,
but
they
have
a
due
diligence
obligation
under
Federal
Securities
Law
and
they
do
hire
their
own
legal
counsel
to
represent
their
interest.

First
to
the
initial
investors,
investors
are
the
folks
who
decide
to
purchase
those
bonds
and
I
can
tell
you
because
of
the
strong
credit
ratings
we
have.
We
have
a
lot
of
interest
in
our
municipal
bonds
when
we
sell
them
in
a
negotiated
Market,
which
means
we
have
an
underwriter
sitting
across
the
table
from
us.
It's
not
uncommon
for
us
to
have
three
four
five,
even
eight
times
the
number
of
orders
for
our
bonds.
Then
we
have
bonds
to
give.
So
that
means
more
people
want
them
supply
and
demand.

That
means
we'll
provide
operating
data
to
the
marketplace
so
that
investors
can
trade
our
bonds
in
the
secondary
market
and
we'll
also
talk
about
that
a
little
bit
later
as
well,
and
then
the
Brokers
also
have
a
responsibility
to
report
those
trades
on
Emma,
so
I
actually
get
a
report
every
day.
I'm
signed
up
and
I
can
see
how
our
bonds
are
trading
in
the
secondary
market,
and
that's
also
important
too,
because
it
means
there's
a
continued
interest
in
our
bonds
and
then
we
pay
our
principal
and
interest
in
the
bonds
until
they
mature.

We
built
the
building-
and
in
this
case
here
we
are
in
the
new
city
hall.
So
hopefully,
that
kind
of
helps
you
kind
of
outline
what
the
what
the
process
is
so
now
I'm
going
to
turn
it
over
to
the
folks
at
Jones,
Hall
and
they're,
going
to
talk
about
what
issuers
or
municipals
what
you
need
to
know
about.
Securities
Law.

So,
as
Julie
mentioned,
we'll
now
talk
about
what
issuers
of
Municipal
security
should
know
about.
Federal
Securities
laws.
AB
Here
we
go
so
the
first
law
that
we'll
focus
on
is
the
Securities
Act
of
1933..
This
act
was
enacted
by
Congress,
shortly
after
the
market
crash
of
1929
and
in
response
to
the
widespread
lack
of
disclosure
and
lack
of
information
around
that
time.
It's
often
referred
to
as
the
truth
and
securities
laws
and
has
two
basic
objectives.
It's
primary
objective
is
to
promote
the
disclosure
of
information
to
potential
investors
by
issuers
of
security,
so
that
those
investors
can
make
informed
investment
decisions.

Those
disclosures
are
made
through
filings
or
what
the
ACT
refers
to
as
registrations
by
the
issuer
of
those
Securities
when
they're
first
sold
to
the
primary
Market.
It's
second
basic
objective
is
it's
a
deter
fraud,
and
in
that
respect
it
prohibits
deceit,
misrepresentation
and
other
fraud
in
the
sale
of
securities.

A
basic
element
of
a
claim
for
violation
of
the
anti-fraud
provisions
in
the
33
and
the
34
Act
is
that
the
the
emission
or
misstatement
was
material
to
the
transaction.
However,
neither
the
33
act
or
the
34
act
Define.
What
immaterial
mission
or
misdemon
is
fortunately,
in
a
case
called
basic
Inc
versus
Levinson.
The
Supreme
Court
provided
the
following
definition
of
material.

In
the
deliberations
of
the
reasonable
investor,
again
again
note
the
use
of
the
words
reasonable
investor
as
a
standard
yeah
in
1988,
the
SEC
adopted
SEC
rule
15c212
in
order
to
regulate
the
disclosure
of
information
by
Municipal
issuers
like
the
city
of
San
Jose.
However,
because
Municipal
issuers
are
exempt
from
the
registration
requirements
of
the
33
and
the
34
Act,
it
cannot
directly
regulate
or
require
Municipal
issuers
to
make
disclosures.

However,
it
is
the
issuer's
responsibility
under
the
law
to
ensure
its
accuracy
and
completeness,
and
as
Julie
also
mentioned,
it's
required
to
be
approved
by
the
governing
board
of
the
applicable
issuer
under
rule
15
c212
before
it
is
delivered
by
the
issuer
to
the
underwriter.
It
must
be
deemed
final
by
the
issuer,
which
means
that,
except
for
certain
information
that
is
permitted
to
be
emitted,
the
preliminary
official
statement
is
Final
in
all
respects
and
does
not
contain
any
material,
misstatement
or
omission.

The
official
statement
is
very
similar
to
the
preliminary
official
statement,
but
it's
completed
upon
the
issuance
the
pricing
of
the
bonds
and
includes
all
of
the
information
that
was
previously
permitted
to
be
emitted.
Under
the
rule,
it's
required
to
be
delivered
by
the
issuer
to
the
underwriter
within
seven
business
days
of
the
sale
date
oftentimes.
The
only
difference
between
the
POS
and
the
official
statement
is
that
information
that
was
previously
emitted,
however,
to
the
extent
that
additional
material
facts
or
material
events
occur
between
the
preliminary
official
statement
and
the
date
of
the
official
statement.

includes

specified
events
and
they
consist
of
or
include
principal
and
interest
payment,
delinquencies
rating
changes
and
then
unscheduled
draws
of
Debt
Service
Reserve
funds
slide.

those
events,
as
well
as
the
the
handout
that
was
provided
earlier
at
the
presentation
like
Julia
mentioned
in
each
case,
the
annual
report
and
those
notices
are
required
to
be
provided
to
the
market
through
Emma,
which
is
maintained
by
the
MSRP.

Those
include
the
continued
disclosure
reports
like
we
were
just
talking
about
those
annual
reports,
as
well
as
the
notices
of
occurrence
of
listed
events,
as
well
as
statements
which
are
reasonably
expected
to
reach
investors
in
trading
markets.
Those
include
budget
messages,
press
releases
and
website
postings.

On
this
slide,
you
see
language
that
was
included
in
a
recent
official
statement
for
Bond
issuance
of
the
city.
We've
added
the
language
in
red.
Let's
see
there,
we
go
the
type
for
as
examples
of
the
type
of
language
that
should
generally
be
avoided
when
speaking
of
the
market
and
with
that
I'll
turn
it
over
to
my
colleague,
Katie
Dobson.
Thank

Thank
you
good
afternoon,
mayor
and
Council.
I
am
here
as
the
bearer
of
bad
news
to
talk
about
some
SEC
enforcement
actions
and
I
will
start
by
saying
that
most
of
the
actions
brought
by
the
SEC
are
under
the
Securities
Act
of
1933,
and
that's
because
it
only
requires
that
they
show
negligence,
meaning
an
issuer,
official,
knowingly,
misstated
or
omitted
facts
or
failed
to
discover
facts
that
were
available
or
could
have
been
reasonably
discovered.
So
they
don't
need
to
prove
any
intent
to
defraud.

So
in
1996
the
SEC
brought
its
first
major
case
against
a
municipal
issuer,
and
it
was
a
surprise
because
historically,
the
SEC
had
only
brought
actions
of
this
type
against
corporate
issuers
and
that
was
Orange
County
in
Orange
County.
The
county
was
using
risky
investment
strategies
to
balance
its
budget
and
it
failed
to
disclose
those
risky
Investments.
The
county
actually
filed
for
bankruptcy.
Protection
in
1994
and
the
sec's
action
came
in
1996.
So
it
did
not
involve
the
failure
to
pay
any
bonds,
but
rather
involved
the
material,
misstatements
and
omissions
in
their
offering
documents.

So
there
are
11
issuances
in
the
county
that
included
information
about
the
county
pool
and
the
SEC
found
that
all
of
those
included
material,
misstatements
and
omissions.
The
SEC
said
that
the
supervis,
the
Board
of
Supervisors,
failed
to
take
steps
appropriate
under
the
circumstances,
to
assure
that
the
County's
financial
situation
was
being
adequately
disclosed
to
potential
investors.

AC
and
found
that
in
2002
and
2003,
the
city
of
San
Diego
issued
260
million
dollars
of
bonds
through
five
separate
issuances
and
the
SEC
alleged
that
City
officials
had
engaged
in
Securities
fraud
for
failing
to
disclose
material
information.
In
its
official
statements,
its
Audits
and
information
provided
to
rating
agencies.

The
officials
had
falsely
certified
that
there
were
no
mystery
material,
misstatements
or
omissions
in
the
documents,
and
this
is
typical
in
every
issuance
of
debt
which
the
city
of
San
Jose
does.
One
of
the
city
officials
makes
this
certification
and
the
SEC
also
found
that
San
Diego
did
not
hire
Auditors
with
the
skills
and
resources
necessary
to
adequately
audit
the
financials
in
connection
with
the
Securities
offers.

The
city
should
adopt
disclosure
policies
and
procedures
which
the
city
of
San
Jose
has
done,
should
provide
appropriate
training
to
everyone
involved
in
the
disclosure
process,
which
is
why
we're
here
today
focus
on
Big
Picture
issues
facing
the
city,
and
you
want
to
think
about
what
a
reasonable
investor
would
want
to
know.

have
to

from

toward

public
projects
of

that
as

East
side,
I
know
that
many
minority
communities
are
over
policed
and
treated
with
less
urgency

other
communities

I
really

the

certain
zones
where

cannot

So
the
re-establishment
we
clear
people
from
an
area
and
then
they're
allowed
to
come
right
back.

just
think.
That's
absurd!

to

build

complete
unit
in
five
years

ten

However
long

going
to

converters
stolen

insurance

will

there's
probably
a
five
to
six
month
backlog
in
catalytic
converters.

regards
to
the
budget,
specifically
the
police
budget,
I
think
that
it
does
not
do
justice
and
encapsulate
the
actual
feelings
of
San
Jose
State
residents,
myself
and
multiple
students
have
expressed
concern
and
discussed
over
the
increase
in
the
budget,
because
I
don't
know
where
any
of
you
have
been
for
the
past
three
years,
but
I've
been
out
in
the
streets,
protesting
police
brutality
and
advocating
for
the
decrease
in
police
budgets,
and
this
does
quite
literally
the
opposite
and
makes
all
of
those
efforts
in
standing
face
to
face
with
police
with
guns
in
our
faces
and
smoke.

being
thrown
at
us
feel
like
it
was
for
nothing
police,

prevent
crime,

respond

should

two
years

safer
San,
Jose,
installed
commercial
grade,
license
plate
readers
and
4K
cameras
on
nearly
300
houses
in
just
over
one
square
mile,
all
cameras
point
to
streets
and
sidewalks.
This
implementation
of
cameras
has
increased.
The
safety
in
our
neighborhood
I
know
that
the
mayor
is
deeply
invested
in
establishing
strong
communities
that
lean
on
each
other,

reduce
crime
and
to
empower
us

keep

corner
of
San
Jose,
clean

existing
code
enforcement
program
in
the
city
of
San
Jose
that
assigns
properties
into
tears
is
deeply
flawed.
Owners
who
are
in
tiers
two
or
three
describe
the
program
as
being
in
purgatory
as
there
isn't
a
clear
or
defined
approach
to
elevating
to
the
next
tier
owners,
often
are
arbitrarily
penalized
for
minor
permitive
violations.

violations
caused
by
tenants,

as
a
removal
of
smoke
detectors
and
a
lack
of
consistency
by
Code
Enforcement
Officers,

than
creating
another

reduced

add
up

less
time
for

usage,
but
also
for
programming

connection
to

meetings

entire

hear

issues
of
blight

lacks
code
enforcement

illegal
dumping

graffiti

issue

the
kind
of
challenges

people
just
walking
out

door
and
not
feeling
that
their
city
is
taken
care

that
it's
a
place
that
they
can
take
pride
in
or
feel
safe
in
and
then,
of
course,
the
greatest
challenge
that
we
all
see
on
our
streets
every
day
the
immense
humanitarian
crisis
entailed
and
having
5
000
people
in
our
city
live
in
unmanaged,
unsheltered
conditions
out
there
on
our
streets
and
the
incredible
toll
on
both
the
unhoused
community,
those
5
000
individuals,
but
also
the
broader
effect
on
our
entire
Community,
from
our
small
business
owners
to
the
health
of
our
local
environment.

Our
ability
to
access
and
use
public
space
and
to
me
the
value
of
focus,
is
to
say
for
these
issues
we're
going
to
set
more
aggressive
goals,
we're
going
to
acknowledge
that
we
need
real
transformation,
that
we
need

efforts

change
the
outcomes.
We're
getting
business
as
usual
is
simply
not
good
enough,
and
we've
heard
that
loud
and
clear
from
our
committee

across
every
neighborhood

the
city
and
so
for
those
Focus

encouraging

do
is
to
elevate
them
to
set
very
clear
goals
to
post
them

our
City
website.
To
have
our
city
manager
come
back
more
regularly
to
update
on
them
than
other
issues,

take
more
risks,

experiment
more

to
basically
hold
ourselves
more
accountable
for
delivering
outcomes.
Even
if
we
try
things
that
don't
work
but
putting
more
focus,
more
creativity,
More
Money
More
risk
taking
more
reporting
more
regular
conversations,
a
council
around
a
few
foundational
things.
Now
we
can't
possibly
do
that
for
everything,
there's
so
many
other
important
issues.

about
many
of
them
from
Child
Care
to
wage
theft
to
climate
change.
We
heard
about
a
number
of
them
today
in
public
comment
as
we

we
all
are
aware,
as
we
hear
about
the
many
needs
in
our
community,
but

can't
possibly
Elevate
all
of
those
into
a
top-line
focus
that
we're
going
to
come
back
to
on
a
regular
basis
and
concentrate
more
resources,
more
staff,
time
and
more
experimentation
on.
So
that
to
me
is
the
the
rationale
for
Focus.
What
it
does
not
mean.

I
just
want
to
be
really
clear
about
this.
Is
it
all?
Those
are
the
things
I
just
mentioned,
aren't
continuing
forward.
We
have
a
very
aggressive
I'd
argue
nation-leading
climate,
smart
plan
that
is
moving
forward
and
it's
been.
We've
made
huge
progress
and
now
need
to
continue
executing
on
many
of
the
climate.
Smart
policies
we've
put
in
place
and
I'd
argue
we
have.
The
greatest
Leverage
is
around
our
clean
energy
program
that
is
signing
purchasing
agreements
on
the
order
of
hundreds
of
millions
of
dollars,
not
the
10
15
million.

may
be
able
to
change
here
in
the
general
fund,
but
hundreds
of
millions
of
dollars
where
we
can
push
the
envelope
on
renewable
energy,
on-site
storage,
but
that's
not
an
area
where
the
council
needs
to
be
checking
in
every
month
on
what
are
we
doing
to
transform
the
outcomes?
We're
getting?
That's
following
a
very
well
thought
out
plan
that
we
have
implemented.

true
for

number

other
areas.

have
a
whole
body
of
work,
moving
forward
around
wage
theft
and
we'll
be
hearing
more

Council

the
coming

On
that
there
are
many,
many
other
important
bodies

work,
existing
work,
streams
that
need
to
move
forward,
but
I
think
what
you'll
see
in
those
work
streams
is
to
be
very
honest.
You
will
see
steady
but
incremental
progress
because
we
have

programs,
so
the
Baseline
is
for
the
264
programs.

that's
the
rationale
for
Focus.
It's
in
the
message.
Part
of
why
I
lay
that
out,
though,
is

listening
to
public
comment.

got
the
sense
that
maybe
not
everyone
has
read
the
message
and
I'm

that.

it
is

and

perhaps
a
little

boring
in

want
to
just
note

on

few
issues
that
came
up
in
public
comment,
number
one,
no
one
is
suggesting
criminalizing

court
tells
us
we
cannot
do
that.

not

homelessness

not
conflate
the
two
and

unfortunate

we've
had

folks
out

talking
points
to
people
saying

homelessness.
We
have
no
encampment
zones
in
our
city.
Today
we
have
one
of
the
flight
path
to
SJC
imposed
by
the
federal
government
for
safety
reasons.
We
have
them
150
feet
around
schools.

have
areas
where
we
say
it
is
not
safe,
it
is
not
appropriate,
it
is.
It
is
so
impactful
in
a
negative
way
on
the
rest
of
the
community
that
there
are
going
to
be
some
places
where
we
don't
allow
encampments.
But
if
you
read
the
message
you
will
see,
that
is
a
very
small
note
toward
the
bottom
that
says.

importantly,
what
we
have
to
do
is
push
ourselves
to
scale
up
safe,
dignified
places
for
people
to
go

on-site

debate

the

has

community

slow

capacity

follow-up
investigations

it

the
polling
and

hear
it

community
meetings.

can
debate
what
the
right
Staffing
level
is,
but
I
want
to
just
level
set
and
then
finally,
on
the
concept
of
mental
health,
hospital

want

be
clear.

is
primarily
as

state

County
responsibility.
However,
I
think
a
growing
number
of
policy
makers
from
state
county
to
City
level
are
recognizing
that
the
defunding
and
de-institutionalization
of
our
mental
health
hospital
system
was

mistake.

suggesting
is,

state

County
shift
directions
and
begin
expanding
inpatient
care
again,
especially
for
those
who
are
most
vulnerable.

who

unable
to
make
rational
decisions

already
having
those
conversations,
but
we
should
be
prepared
to
look
at
the
levers
we
might
pull
to
expand
access
to
inpatient

that's
going
to
require
facilities
and,

responsible
for
land
use
decisions,
I
think
it's
appropriate
for
us
to
play
a
supporting
role
there.

one
thing
I

caution
against
and
I'm

to
ask
the
administration
to
chime
in
here.

was
very
careful
to
go
high
level
and
then
talk
about
exploring
different
avenues
for

would
be
incredibly
concerned
if
out
of
the
gate

at
the
beginning

process,

we've
done

budget
study
sessions
before
we
get
to
the
June
message
before
we've
seen
everyone's
budget
documents,
if
we
began
committing
ourselves
and
directing
large
sums
of
money,
in
some
cases,
multiple
millions

dollars
without
understanding
the
trade-offs
without
understanding
feasibility
without
really
understanding
redundancy
with
existing
programs.

The
March
message
was
something
that
had
a
lot
of
input
and
then
a
very
thorough
process
of
some
initial
vetting
with
the
city's
the
city
managers
budget
director
just
to
understand
cross-dependencies
redundancies
and
feasibility,
and
even
there
we
characterized
just
about
everything
as
explored
meaning.
We
know
that
much
more
work
will
need
to
be
done
to
understand
the
Exact
Staffing
levels,
the
budget
implications
and
how
all
these
puzzle
pieces
fit
together.

So
I,
you
know
the
spirit
of
virtually
everything
in
the
memos,
with
the
exception
of
the
need
to
expand,
inpatient
mental
health
care
facilities
and
our
role
in
that,
with
the
exception
of
that
and
councilman
towards

memo,
I'm

comfortable
with
the
the
aspirations
and
all
of
the
recommendations,
but
I
would
strongly
recommend
that
we
frame
all
of
these,

my

things

explore
cost
way
against

would

where
we
are
in

budget
process.
So
at

beginning
of
March,
we

released
our
five-year
general
fund
forecast,
which
the
mayor
had
mentioned.

are
looking
at
a
relatively
small
Surplus
in
the
23-24
year,
followed
by
a
relatively
small
shortfall
in
the
24-25
year,
and
then
that
doesn't
in
include
all
of
the
items
that
are
currently
funded
on
a
one-time
basis,
either
in
the
general
fund
or
in
the
American
Rescue
plan
fund.
So
when
you
kind
of
step
back
and
look
at
the
things
that
we
all
would
want
to
continue
in,
our
community
would
want
to
continue.
We
we
do
look
at
a
structural
shortfall
of
what
we
can
actually
fund
on
and
on
ongoing
basis.

look
at
approaching
the
proposed
budget
process
here,
the

language,
that's
in
the
mayor's

budget
message
talks

the

know
that
we
can't
fund
all
of
it
without
making
service
reductions
elsewhere.

budget
like
we
just

is
a
trade-off
there
that
we
would
have
to
to
make.

already
budgeted
to

budget
process
so

excited

doing

council

Echo
a
lot
of
the
statements
from
my
colleague
council
member
Torres.

My
office
has
introduced
a
what
I
from
what
I
believe
is
a
people
first
oriented
budget
memo
to
support
the
Working
Families
here
in
the
city
of
San
Jose,
including
our
most
vulnerable
residents.
Our
memo
that
we
put
together
prioritizes
eviction
prevention
for
many
of
our
renters
in
this
city,
who
have
been
destabilized
by
the
pandemic
and,
unfortunately,
are
in
danger
of
a
displacement.

The
eviction
help
center
is
running
out
of
funds,
as
we
all
know,
and
we're
seeing
a
ballooning
of
one
out
of
every
195
households
facing
eviction
and
which
will
happen.
Unfortunately,
in
June,
so
the
caseloads
have
doubled.
So
it's
my
hope
that
we
can
continue
to
fund
this
eviction
Center
so
that
we
can
provide
some
some
sort
of
relief
for
these
families.

Our
memo
also
proposes
a
safe
and
healthy
rental
homes
pilot
program
to
address
the
thousands
of
residents
who
live
in
multi-family
rental
housing
with
a
history
of
health
and
safety
concerns,
as
well
as
code
enforcement
violations.
Of
course,
we
have
responsible,
Property
Owners.
Unfortunately,
in
some
areas
of
the
city
of
San
Jose,
we
do
have
what
someone
would
categorize
as
absentee
landlords.
So
it's
important
that
we
have
mechanisms
and
expand
mechanisms
to
get
those
issues
solved
and
do
it
in
a
way.
That's
collaborative
both
with
our
residents
and
land
landlords.

I'm
also
advocating
for
continued
funding
for
San
Jose
learns
the
library,
family,
friends
and
neighbor
neighbor
program.
Child
Care,
citing
and
recreational
preschool
I've
had
the
opportunity
to
visit
some
of
these
preschool
sites
and
service
sites
in
my
own
District.
These
are
truly
making
a
life
of
a
difference
for
for
working
people
here
in
the
city
and
there's
many
who
do
not
have
the
resources
and
funds
to
access
them.
So
I
think
our
our
city
should
be
that
social
safety
net
to
make
sure
that
they
could
be
able
to
be
included
in
these
life-saving
programs.

Our
current
Animal
Services
is
overwhelmed.
You
know,
there's
many
places
in
East
San
Jose,
where
we
have
groups
of
cats
taking
over
the
land.
So
we
need
to
make
sure
that
we're
investing
in
you
know
making
sure
that
you
know
this.
This
problem
doesn't
get
exacerbated
and
as
a
cat
man
myself
I
want
to
make
sure
that
we're
investing
to
keep
keep.
This
keep
our
pets
safe.

You
know,
San,
Jose
and
Silicon.
Valley
is
the
destination
location
that
it
is
because
of
our
diverse
culture
and
beautiful
history,
and
in
fact,
a
lot
of
that
is
because
our
immigrants
and
communities
of
color
have
made
this
city
the
economic
Powerhouse,
that
it
is
and
that's
why
I've
included
in
my
memo
funding
of
three
cultural
and
historical
projects
that
I
believe
is
really
important
to
our
residents.
The
first
would
be
funding
for
the
support
of
a
formation
of
an
art
and
Cultural
District
district
on
Alum
Rock.

This
would
be
the
first
art
and
Cultural
District
here
in
the
city
of
San
Jose
and
would
allow
for
economic
investment
in
revitalization
of
that
Corridor.
The
second
would
be
supporting
the
thank
you
America
Monument
for
the
Vietnamese
Heritage
Garden,
which
I
know
has
been
promised
to
the
Vietnamese
Community
here
in
the
city
for
over
30
years
and
I
know
that
the
mayor
has
already
committed
to
that.

then
the
third
would
be
making
sure
that
we're
supporting
the
the
development
of
the
African-American
Cultural
Center,
which
will
be
a
much
needed
addition
to
our
city.

All
these
are
very
important
to
the
culture
of
the
city

the
city

San
Jose,
I,
diverse
and
desired
place
to
to
live,
and
then
finelive
submitted
four
recommendations
to
make
the
city
of
San
Jose
a
competitive
employer,
ensuring
the
competitiveness
with
other
local
cities
through
wage
studies,
making
the
city
Paid
Family
Leave
program
comparable
to
Santa
Clara
workers
who
get,
who
have
eight
weeks
of
paid
leave
for
child
bonding.

It's
truly
important
for
our,
whether
it's
a
mother
or
father
to
be
able
to
bond
with
their
child
in
those
most
formidable
times
of
their
life
in
creating
a
child
care
benefit
for
our
city,
Workforce,
by
adding
pre-tax
contributions
to
workers
to
pay
for
daycare,
which
I
know
for
many
families
can
be
one
of
their
highest
expense.
Child
care
and
daycare
can
be
upwards
of
two
thousand
dollars.

So
I
believe
this
would
be
a
great
way
to
attract
new
Workforce
and
retain
existing
Workforce
here
at
the
San,
the
city
of
San
Jose
and
then
finally,
a
reward
for
retention
of
our
staff
kind
of
as
an
incentive
to
make
sure
that
people
continue
to
stay
here.
Work
here
and
provide
the
essential
services
that
are
our
community
needs.

severely
mentally

year
will
consume
more
than
the
money
available
to
us
and
everybody
recommended
something
to
be
either
made
little
larger
or
add

the
program
now
you're

to
help
us
in
terms

juggling
this

which
is
going
to
be
an
avalanche
of
the
snowball.

contain

result

approach

mayor
and
for
starting
with
the
transition
teams
that
was
interesting
and
impactful
and
I
noticed
that
in
your
budget
message,
you've
Incorporated
much
of
what
those
transition
teams
suggested,
including
the
one
that
I
was
proud
to
chair,
which
was
our
co-chair,
which
was
the
one
on
homelessness.

truly
appreciate
being
involved
in
your
brown
act
and
being
able
to
offer
input,
advice,
suggestions,
kind,
coercion
to
get
the
things
in
there
that
we
wanted
to
see
and
I
have
to
say
one
of
the
number
one
issues
that
had
it
not
been
there.

But
I
just
I
do
want
to
point
out
that
they're,
not
all
multi,
my
family
Zone,
some
are
in
do
in
zoned,
Industrial
and
Commercial
and
I
would
assume
or
presume
that
when
you're
referring
to
all
motor
mobile
homes,
you're
referring
to
everyone,
not
just
those
that
are
multi-family
correct.

a
lot
of
detail
and
a
lot
for
me
to
think
about
and
to
consider
and
I
am
supporting
the
substitute
motion,
because
it
really
it
it
does
what
the
budget
should
be,
what
this,
what
we
should
be
doing
at
this
stage,
which
is
offering
direction
to
the
city
manager
having
her
him
having
her
sorry,
her
explore
the
issues
that
have
been
raised
in
a
lot
of
really
good
issues
have
been
raised,
but
there
are
big
monetary
issues
that
a

attached
to
them
and
I'm
very
concerned
about
the
trade-offs,

memos

spending
certain
amounts.

amounts

what
we're

services
we
will
stop
providing

result

the
information
we'll
get

them

city
manager
will
tell
us
how
to
achieve
any

those
things,
whether
they
can
be
achieved
and
what
the
dollar
amounts
are
are
involved
in
and
if
anything
needs
to
be,
what
are
the
trades
trade-offs?
Where
are
we
cutting
expenses,
or
are
we
cutting
services?
Which
programs
are
we
no
longer
going
to
be
fun?

Funding
as
a
in
exchange
for
funding
the
the
new
things
I
mayor,
I,
really
appreciate
that
you've
moved
the
the
Staffing
is
one
of
the
number
PRI
the
top
priorities
in
your
memo
and
I
I
want
to
point
to
something
that
I've
been
pushing
and
recommending
for
a
long
time
that
you
state
in
your
memo,
and
that
is
that
we
look
at
eliminating
four-year
degree
requirements,
shifting
to
skill
based
hiring
and
allowing
consideration
for
alternative
qualifications.
Like
direct
experience
that
is
so
important.

We
have
staff
people
who
have
been
in
really
successful
positions,
but
because
they
don't
hold
degrees,
are
unable
to
move
up
so
anything
we
can
do
to
which
means
that
they
look
elsewhere
for
for
employment,
they
look
elsewhere
to
move
up
the
ladder
and
be
more
challenged.
We
can't
have
that
we
need
to
incorporate.
We
need
to
encourage
our
staff
to
stay
here
as
long
as
possible,
and
that
means
we
need
to
recognize
the
years
of
service
they've
done
and
promote
them.

Based
on
that,
and
not
necessarily
having
a
degree
one
way
or
the
other,
so
I
truly
appreciate
that
you're
lifting
up
Staffing,
because
we
know
that
all
of
the
things
that
we
want
to
do
as
a
city
we
cannot
accomplish
without
having
a
staff.
We
have
a
very
small
staff.
We
need
a
larger
staff.
We
need
to
show
them
that
they're
respected.
We
need
to
pay
them
well,
we
need
to
retain
them
and
promote
them
as
possible.
So
that
is
so
important.

I
really
was
glad
to
see
that
I
also
just
want
to
emphasize
that
there
were
a
lot
of
public
comments
that
were
really
really
important
to
hear
and
but
after
you
read
the
budget
message,
which
is
a
long
document
most
of
what
the
public
called
in
for
is
called
out
for
in
the
mayor's
budget
towards
the
end
of
the
budget.
He
has
the
focus
areas
that
we've
that
he's
talked
about
and
that
were
emphasized,
homelessness,
Public,
Safety
and
beautifying
San
Jose.

But
it
also
says
continue
to
do
the
other
things
that
we're
doing,
and
that
is
the
libraries
I
hope
to
see
an
MBA
for
increased
hours.
For
the
libraries
where
we
have,
we
can
fund
all
of
our
libraries
on
Sunday
and
extend
the
hours
that
would
be
wonderful.
I
know
our
community
would
really
benefit
from
increased
Sunday
hours.
They
they
already
are
using
them,
but
they're.
It's
not
available
at
all
of
our
libraries
and
I'd
love
to
see
that
I
also
want
to
encourage
I
in
in
Vision
zero.

We
got
a
lot
of
calls
or
prior
to
the
budget.
I
got
a
lot
of
calls
about.
Foley
funding
and
people
were
using
the
terminology
fully
funding
Vision
zero.
But
if
the,
if
my
colleagues
will
recall
a
few
meetings
ago,
director
John
risto
came
down
and
said
you
can
fully
fund
it,
but
I
don't
have
the
staff
to
deliver
it.

All
in
all,
I
think
this
is
a
a
good
message.
It
covers
all
the
areas,
including
are
climate,
smart
goals.
It
maintains
it
doesn't
change
our
focus
at
all.
We
already
have
a
strong
commitment
to
carbon
neutrality
by
2030.

We
talk
about
those
goals
on
a
regular
basis
and
how
we're
going
to
continue
to
Electrify
the
city
and
that
those
are
all
things
that
are
extremely
important,
that
we
still
focus
on
keeping
our
environment,
reducing
the
amount
of
carbon
that
we
emit
into
the
environment
and
that's
primarily
from
our
vehicles
by
the
way,
so
everyone
should
get
out
of
their
vehicles
and
just
either
have
one
car
or
not
not
take
mass
transit
with
that
I'm
gonna,
I'm,
gonna,
close
and
say
I
support
the
substitute
motion,
primarily
because
I
want
to
see
more
of
the
budget
in
place,
see
what
we
might
lose
if
the
other
things
are
focused
because
that's
really
critical.

I
just
want
to
highlight
that
much
of
the
best
thinking
in
there
around
Workforce
Development
and
staff
retention.
Quite
a
bit
of
that
came
out
of
substantive
conversations
with
councilman
Jimenez
and
his
team.
They
really
I
know
have
thought
very
deeply
about
those
issues,
which
is
something
that
is
very
high
on
my
list,
because
this
council
member
Davis
said,
and
his
councilor
Cohen,
highlighted
many
times
in
our
conversations.
That
is
the
foundation.

If
we
talented
people
and
grow
them
here
and
and
be
a
great
workplace,
we
will
not
be
able
to
deliver
the
services
and
the
impact
that
we
want.
So
I
just
wanted
to
thank
councilman
Jimenez
for
some
really
great
thinking
in
that
area.
