B
Government
committee-
our
chair
is
not
present
today
and
so,
let's
start
off
calling
me
to
order
and
doing
a
roll
call.
Please
arenas.
D
B
You
and
before
we
begin
I,
do
want
to
remind
the
rules
and
open
government
committee
members
and
members
of
the
public
to
follow
our
code
of
conduct
at
our
meeting.
This
includes
commenting
on
the
specific
agenda
item
only
in
addressing
the
full
body
public
speaker
so
not
engage
in
conversation
with
the
chair
council,
members
or
staff,
and
all
members
of
the
rules,
committee,
staff
and
public
respect
to
refrain
from
abusive
language.
B
Repeated
failure
to
comply
with
the
code
of
conduct
will
this
that
will
disturb,
disrupt
or
impede
the
orderly
conduct
of
this
many
may
result
in
removal
from
the
meeting.
Okay
and
now
we'll
start
with
our
first
item
on
the
agendo,
which
is
our
review
of
the
November
22nd
final.
Oh
excuse
me
never
mind
that
one's
canceled,
the
review
of
the
November
29th
draft
agenda.
B
C
B
B
B
B
B
D
B
B
B
B
E
Thank
you,
Vice
chair,
actually
I
raised
my
hand
because
I
wanted
to
see
if
we
could
have
the
sorry,
the
item
8.4
an
8.5
which
is
to
be
heard
concurrently.
If
we
could
have
that
as
time.
E
Certain
for
six
I
believe
there's
interest
in
in
my
community
to
to
be
heard
and
I
think
it
would
be
very
convenient
for
for
our
community
members
to
be
heard
at
6,
00
PM,
so
I'll
make
a
motion
and
include
that
in
the
motion,
the
motion
to
approve
agenda
with
a
Time
certain
for
8.4,
which
is
to
be
heard
concurrently
with
8.5
at
6
pm.
B
Thank
you.
We
don't
have
a
second
but
I,
see.
F
But
I
have
a
question:
okay,
just
about
that
about
the
time
certain
questions
we
have
a
lot,
I
mean
the
agenda's
gonna
be
really
long
and
we
have
the
like
four
land
use
items
after
so
what
is
our
feeling
about
the
length
of
the
land
use
items
and
what
the
right
time
is?
Maybe
Lady
of
feeling
about
the
correct
time
for
time,
certain
on
eight
four
and
five.
D
D
F
G
D
Yeah
I
think
it's
appropriate.
If
anything,
it
does
give
you
a
little
bit
of
a
if
you
want
to
do
your
break
earlier
in
the
night,
like
a
dinner
break
like
at
5,
30
or
something
and
then
come
back
at
six.
Okay,
all
right.
B
D
B
Okay,
because
if
we
did
start
at
11,
I
I'm,
actually
looking
at
the
agenda
and
thinking
I'm
thinking,
we
may
not
hit
six,
so
we
may
be
at
a
similar
boat
that
our
vice
mayor
got
chastised
before
yesterday,
which
was
a
lengthy
Break
and
so
do
we
have
we
have
a
lunch
break.
That's
that's
kind
of
what
brought
up
some
conversation
yesterday.
Right
was
we
we
took
a
lunch
break
for
an
hour
and
a
half
or
so
that.
D
Is
correct,
I
think
the
conversation
I
remember
yesterday
and
it
got
deferred
for
a
decision
today
was.
Did
the
rules
committee
want
to
advertise
on
this
agenda
early
that
we
could
read
it
in
the
orders
of
the
day
or
advertise
when
Council
starts
at
11,
when
the
lunch
break
would
be
and
possibly
shortening
it?
So
the
public
had
a
greater
ability
to
anticipate
when
items
would
come
up,
so
you
certainly
have
the
right
to
do
that
as
a
Rules
Committee.
F
Yeah
and
then
the
eih
and
RV
parking
could
take
a
little
while,
but
if
we
presumably
well
and
then
the
the
ceremonial
items
happen
at
1,
30
still
right,
correct,
okay
I
mean
I'm
okay,
with
an
hour
with
doing
one
hour
and
then
taking
the
hour
and
a
half
lunch
I
mean
I,
don't
think
that's
a
problem
as
long
as
we
know
ahead
of
time.
That's
what
we're
planning
to
do
I,
don't
that
way
at
least
we're
finishing
the
things
we
can
finish
so
that
we
can.
B
Yeah
I
guess
I'm
I'm
I'm
actually
fairly
optimistic
that
the
meeting
may
go
fast,
but
but
then
we
have,
but
then
we
have
spread
it
out
so
long
that
we
will
be
here
essentially
all
day
and
and
then
considering
the
the
land
use
items
that
may
you
know,
generate
some
conversation.
B
If
we
have
time
certain
at
six
for
these
concurrent
items,
these
likely
are
to
be
lengthy
as
well
and
as
councilmember
Arenas
is
stating
right
with,
especially
with
some
interest
from
her
community
members
I'm
assuming
we
may
have
stretched
our
day
to
be
a
very
long
day
with
some
long
breaks
right
which
doesn't
benefit
anybody.
That's
kind
of
what
I'm
what
I'm
concerned
about
so.
B
Yeah
I'm,
almost
thinking
similar
to
what
our
assistant
city
manager,
Lee
Wilcox
just
said,
which
is
maybe
do
we
do.
We
have
to
start
at
11
for
this
meeting.
If
we're
going
to
do
a
Time
certain
at
six,
you
know
we
do
have
the
the
interviews.
I
I
recognize
that
and
then
we
have
the
the
hap
program,
the
RV
parking.
B
In
the
quick
build
quick
build
housing,
so
we
have
those
those
three
essentially,
which
you
know
in
my
mind,
probably
could
be
done
within
time.
So
go.
D
I
can't
see
there
being
any
circumstance
in
which
we
would
recommend
changing
December,
6
or
December
13th
from
the
11
A.M
start
time,
given
the
amount
of
items
on
those,
and
there
probably
will
be
a
need
for
some
time
and
space
for
closed
session
before
the
end
of
the
year.
So
you
know
based
off
of
the
conversation
here
in
this
discussion.
F
B
Yeah
I
know
we
cut
closed
session,
essentially
short
right
yesterday
and
and
again
kind
of
giving
quite
a
gap
right
and
then
another
gap
for
lunch.
Excuse
me
so
yeah
I
mean
if
we
can
take
advantage
of
the
closed
session
time
and
actually
have
a
good
discussion
there
not
have
to
rush
our
city
attorney's
office.
I
I
might
suggest
that
then
we
can
keep
the
6
pm
time
certain
and
not
necessarily
have
to
meet
at
11,
and
we
can
just
start
at
1
30.
B
E
Sorry,
what
Vice
chair,
what
what
was
your
suggestion
so.
B
Okay
with
a
second
there:
yes,
okay,
so
just
making
it
clear
for
the
public.
The
the
two
changes
is.
We
will
no
longer
start
the
afternoon
session
at
11
as
we
were
before.
We
will
start
at
the
regular
time
at
1
30
and
we
will
have
a
Time
certain
of
6
p.m.
For
the
concurrent
items
of
8.4
and
8.5
and.
B
B
Yes,
thank
you.
Okay,
thank
you
and
I.
Didn't
even
ask
the
question
that
our
chair
usually
asks
but
I'll
save
you
from
it.
Lee,
okay,
that'll,
take
us
down
now
to
our
consent,
agenda
and
I'll
go
to
members
of
the
public
person.
C
B
Back
to
members
of
the
committee
move,
approval
of
consent
and
a
second
see
no
hands.
So
let's
do
real
cover.
Please.
B
C
B
Thank
you
and
that'll
take
us
down
to
item
C1
and
just
as
reference
you
see
C2
there,
but
that
was
dropped.
We
don't
have
to
hear
that
here.
So
we
just
have
the
C1,
which
is
filling
vacancies
and
did
the
city
manager's
office
have
any
I
know
you
don't
have
any
kind
of
early
consideration
on
this,
but
did
you
have
any
comments
before
we
go
to
the
public
comments.
D
B
Okay,
then
I'll
ask
since
councilmember
Cohen
is
here
with
us.
Are
you
comfortable
if
we
go
to
members
of
the
public
first,
or
would
you
like
to
speak
on
it?
First,
no
Public's,
good!
Okay!
So
let's
go
to
members
of
the
public
I'll
ask
if
we
have
anybody
in
a
person
here.
C
I
Are
David,
O'neill
sure
yeah?
My
name
is
Neil
Park
McClintock
and
I
work
at
working
Partnerships
as
one
of
our
community
organizers,
hello,
San,
Jose
rules
committee.
Thank
you
so
much
for
listening
to
me
today,
like
I,
said
I'm
an
organizer
with
working
Partnerships
USA.
My
job
is
to
listen
to
both
voters
and
non-voters
on
the
ground
to
understand
the
needs
of
our
community
and
how
we
can
best
bring
people
together
to
create
the
San
Jose
that
we
all
deserve.
I
Congratulations
to
council
member
Arenas
on
moving
on
to
represent
San
Jose
and
others
on
the
County
Board
of
Supervisors.
With
regard
to
item
C1
to
craft
a
plan
for
filling
Council
vacancies,
I'm
speaking
in
support
of
a
process
that
would
seek
to
fill
Council
vacancies
by
appointment
for
the
balance
of
the
term.
We
need
to
be
thoughtful
about
City
resources
and
the
timing
of
the
upcoming
2024
elections
as
well.
I
Please
take
into
consideration
the
importance
of
a
thoughtful
process
that
accounts
for
the
impact
of
City
finances
and
also
staff
resources.
The
seat
should
be
filled
through
an
appointment
as
quickly
as
possible
such
that
we
are
able
to
cost
effectively.
Allow
for
the
full
functionality
of
our
Council
and
city
government,
while
also
planning
for
a
standard
election
in
the
future
to
decide
the
longer
term
fate
of
the
district's
leadership
having
another
special
election
when
few
will
vote
will
inherently
politicize
the
process
in
a
way
that
silences
the
voices
of
many.
I
When
you
saw
this
most
recent
midterm
election,
many
folks
in
Latino
Community,
for
example,
did
not
turn
out
to
vote,
and
so
an
appointment
would
be
a
standard
practice
like
many
of
our
cities.
States
and
counties
do
to
fill
a
seat
and
will
also
ensure
that,
as
many
people's
voices
are
heard
as
possible
through
the
long-term
future
of
the
seat
as
well.
Thank
you
for
your
consideration
and
I
look
forward
to
the
dialogue
and
input
from
staff
as
well
thanks.
J
Good
afternoon
council
members,
and
to
the
attorney
and
assistant
city
manager,
I'd
like
to
compliment
you
for
actually
bringing
this
item
up
at
this
time,
because
obviously
it's
very
timely
since
I
guess
supervisor
Chavez
just
announced
that
she's
conceded
the
election.
My
name
is
David
heindel
I'm,
a
citizen
of
San
Jose
I,
don't
represent
any
group.
I
wrote
it
up
since
I,
don't
want
to
miss
it.
The
highest
priority
of
our
representative
democratic
form
of
government
is
elections,
which
means
that
citizens
have
voted
for,
and
a
majority
have
selected.
The
person
that
represents
them.
J
J
K
Hi,
can
you
hear
me
yes,
hi?
Thank
you
very
much
for
hearing
me
today.
I
am
a
resident
of
district
10
and
I.
Am
speaking
today
asking
you
to
do
an
appointment.
We
will
have
a
very
low
voter
turnout.
Whoever
may
or
may
not
get
elected
will
not
necessarily
represent
the
will
of
the
voters
because
of
low
turnout.
K
There
will
be
a
huge
cost
to
electing
two
people
more
than
likely
that
will
end
up
being
four
various
four
elections
in
order
to
fill
the
seat,
the
seats
on
top
of
which
we're
looking
at
possibly
not
having
anyone
to
be
able
to
go
into
the
position
until
June,
at
which
time
they
will
continue
to
be
in
campaign
mode,
because
the
next
election
will
be
in
March
of
2024.
as
a
resident
of
district
10.
K
What
I
would
like
to
see
is
for
you
to
appoint
and
recommend
that
we
have
an
appointment
for
both
those
seats.
I
would
prefer
that
whoever
is
appointed
not
run
in
2024
so
that
they
spend
the
two
years
doing
the
job
for
the
residents
and
the
city
and
let
the
people
who
want
to
fill
those
seats
for
the
eight
years
or
the
next
four
years.
Let
them
be
able
to
run
otherwise
again.
We're
going
to
have
somebody
elected
who's,
going
to
be
right
into
campaign
mode
and
not
much
time
to
learn
about
the
job.
K
L
Hi
Martha
O'connell
speaking
for
an
election
and
not
an
appointment
on
someone
amused
about
the
comment
that
that
that
a
election
would
politicize
the
the
situation.
What
politicizes
the
situation
is
having
the
current
council
members
make
the
appointment
and
I
can't
think
of
a
more
appropriate
day
to
take
this
position
than
when
every
single
council
member
endorsed
a
candidate
for
mayor
that
lost
the
election.
The
people
said.
Thank
you
very
much
for
your
recommendation,
but
we're
going
to
vote
for
Matt,
Mahan,
so
I
think
we
should
have
an
election
and
I
I.
I
hope!
H
Yes,
thank
you
and
thank
you,
Rules
Committee,
for
the
opportunity
to
speak
on
this.
It
seems
to
me
that
voting
is
where
We
As
Americans
are
most
closely
Allied
to
government
and
by
any
other
means,
is
an
appointment.
Especially
an
appointment
by
this
commission
is
just
it
does
not
work.
In
my
opinion,
I
was
just
wondering
if
we
could
leave
those
two
vacant
and
move
to
an
election
as
soon
as
possible
and
work
with
a
to
work
with
the
council
with
two
empty
seats
for
a
period
of
time.
H
G
Hi
good
afternoon,
thank
you
councilmember,
Jimenez
and
Cohen
for
your
memo,
I
kind
of
have
to
laugh
anyway.
A
true
and
Fair
Way
of
this
is
having
the
city
council
vote
for
the
next
and
pick
the
next
candidate.
The
special
election
is
going
to
cost
you
so
much
money
and
I.
Think
it's
a
waste
of
money,
because
that
money
can
be
going
to
something
else.
Like
you
know
the
unhoused
or
maybe
opening
up
another
owl,
let
the
city
council
vote.
Let
them
pick
the
next
council
member.
G
C
M
Hey
hi,
thank
you
for
this
time,
Council
I'd
like
to
reiterate
and
underscore
all
of
these
speakers
who
have
asked
for
an
election.
The
most
pertinent
point
to
me
is
that
the
entire
city
council
was
public
and
very
vocal
about
endorsing
the
losing
candidate,
the
the
rules
committee
and
the
council
has
spoken.
They
did
not
want
change.
They
wanted
to
continue
with
the
route
that
the
city
was
on.
When
all
of
the
polls
you
took
said,
we
wanted
a
different
direction.
M
We
voted
for
a
different
direction
and
I
don't
feel
comfortable
having
people
who
so
highly
endorsed
the
losing
candidate
hit
someone
to
fill
the
seat
of
the
candidate
that
won.
We
might
even
have
a
third
person
that
has
been
voted
out
on
the
council
as
well.
So
no,
we
need
an
election
and
it
is
a
false
premise
that
it's
too
expensive
when
yesterday
the
city
council
voted
to
give
developers
a
huge
winfall,
removing
all
of
the
fees
and
taxes
to
build.
M
So
no,
we
had
plenty
of
money
if
we
can
give
away
money
to
developers
and
raise
the
individual
contribution
of
the
city
for
each
door,

000.
We
certainly
can
afford
an
election,
it
is
a
democratic
process
and
the
council
is
too
heavily
motivated
to
stay
the
course.
Instead
of
giving
the
people
who
asked
for
change,
change,
I
say
an
election.
Thank
you.
For
this
time,
foreign.
C
N
I
cannot
say
it
as
well
put
as
Jackie
and
Neil.
So
I
would
ask
that
you
understand
that
I
would
like
them
to
be
appointed
until
their
term
would
have
run
out
and
then
have
a
vote.
I
I,
just
not
comfortable
with
the
amount
of
money
to
have
to
run
another
an
election
and
that
the
turnout
would
be
quite
poor
and,
quite
frankly,
we
need
more
owls.
We
need
tents
and
tarps.
N
N
O
Hi,
yes,
thank
you
for
allowing
me
to
speak
I.
My
feeling
is
that
we
should
have
a
special
election.
I
I
agree
with
the
fact
that
we,
the
entire
city
council,
endorsed
a
losing
candidate
and
for
that
reason,
I
think
that
any
appointment
would
be
unfair
and
would
not
represent
the
people
of
the
districts
that
the
seats
are
ranked.
For
so
I
would
ask
you
to
please
fund
a
special
election
special
elections,
happen
and
I.
Think
in
this
case
it
needs
to
happen.
Thank
you
for
your
time.
P
Hi
Blair
Beekman
here
thanks
a
lot
for
everyone's
public
comment
today
on
this
item,
I
hate
to
bring
it
out,
but
I
I
felt
I
should
I
I.
Guess
you
guys
know
my
feelings
about.
Do
we
have
to
prepare
for
an
earthquake
in
2023
and
if
we
do,
would
that
be
a
part
of
the
thinking?
P
Should
that
be
a
part
of
the
thinking
for
this
sort
of
item
and
do
we
do
do
we
go
for
the
appointment
process
or
the
election
process
if
it's
applicable,
I
hope
it
can
help
in
the
decision
making
at
this
time,
if
it's
not
applicable,
I'm,
really
sorry
for
bringing
it
up
thanks
a
lot
good
luck
on
this
item.
A
Q
Yes,
can
you
hear
me?
Yes,
okay,
also
good
afternoon,
Council
I
think
we
have
to
talk
about
the
just
the
principles
of
democracy.
Q
Okay,
when
you
were
elected,
you
know
you
didn't
discuss
this
at
the
time
that
you
ran,
but
we
all
know-
and
you
know
we
can
keep
it
a
secret
between
us.
There
isn't
a
whole
lot
of
people
that
attend
these
meetings.
You
and
I
both
know
that
you
had
that
on
your
mind,
you
had
political
Ambitions,
okay
and
you
didn't
notify
the
public
of
those
political
Ambitions
it'll,
be
our
secrets,
that's
cool,
but
because
of
that
you
created
this.
Q
So
you
need
to
be
send
this
back
to
the
people
so
that
the
people
can
choose
again,
because
we
didn't
vote
you
in
so
that
you
could
vote
someone
else
in
because
there
is
a
direct
right
there.
At
that
point,
there
is
a
direct
violation
of
the
democratic
process
and
due
process.
So
what
you're
doing
is
you're
doing
things
that
are
like
or
even
suggesting
and
trying
to
normalize
things
that
are
inherently
illegal
and
unethical.
Q
But
what
you
do
is
you
just
go
ahead
and
do
it
anyway
and
you
just
leave
it
to
the
people
now
go
ahead
and
take
us
to
court.
Then
if
you
don't
like
it,
take
it
to
court.
If
you
don't
like
it,
take
it
to
court.
No,
that's
not
going
to
happen!
Man,
that's
not
going
to
happen
just
the
same
way
that
you
try
to
hold
me
to
account.
I'm
holding
you
two
accounts,
that's
my
job
and
my
responsibility
as
a
citizen.
So
no
absolutely
not
you
don't
get
to
pick
and
choose.
That's
our
job!
Q
R
Thank
you
very
much
for
allowing
me
to
speak.
I
hope
you
can
hear
me.
This
is
the
first
time
I've
called
in
on
the
phone.
I
would
greatly
appreciate
a
special
election.
R
F
Comes
from
a
point:
yeah,
thank
you!
So
after
it
was
clear
that
we
would
have
at
least
one
and
now
two
vacancies
on
the
council,
councilmember
Jimenez
and
I
conferred
and
talked
to
City
staff
about
what
the
process
is
to
move
forward.
F
The
decision
about
how
to
proceed
is
a
decision
of
the
entire
Council
has
to
be
made
by
the
whole
Council,
so
this
body
won't
be
making
a
decision
on
the
process,
but
it
is
time
was
of
the
essence,
and
so
we
wanted
to
make
sure
that
today
we
began
the
process
of
agendizing
that
discussion.
F
So
the
memo
that
we're
submitting
is
asking
for
the
city
clerk
to
find
a
date
that
is
suitable
for
the
council
to
meet
before
we
have
our
recess,
which
usually
starts
on
this,
which
this
year
I
think
starts
on
December
17th.
So
that's
why
we
put
the
December
well,
December
18th
is
a
Sunday.
So
is
that
right,
13th
yeah,
something
like
that
anyway.
So
so
the
idea
is
sometime
before
we,
many
of
us
scatter
for
holidays
have
a
meeting.
So
we
can.
We
can
just
we
can
discuss
that.
F
Hopefully,
we
can
schedule
something
before
the
end
of
December,
if
not
then
the
first
week
of
January,
so
we
can
have
the
whole
Council
to
design
the
process
that
we
would
take
moving
forward.
Whatever
decision
is
made,
nobody
would
be
able
to
take
the
seat
before
the
new
year.
F
F
What
I
understand
to
be
two
to
three
potential
methods
that
the
city
has
under
its
Charter
to
fill
the
vacancy,
so
that
we
have
all
the
information
before
us
as
we
make
that
decision
and
I
would
just
ask
that
the
the
clerk's
office
either
through
that
memo
or
supplemental
memo,
provide
the
the
information
about
the
cost
and
whatever
timelines
would
be
required
in
in
any
of
those
methods
to
make
sure
that
we
have
all
the
information
as
we
hold
that
meeting
so
I'll
move
the
memo,
I
wrote
with
councilmember
Jimenez.
S
B
Thank
you.
We
have
Motion
in
a
second
councilman.
E
Thank
you,
Vice,
chair
I,
just
want
to
really
thank
councilmember,
Cohen
and
Jimenez
for
getting
this
started.
It
has
I
apologize
to
the
public,
I'm
terribly
sick,
so
I'm
I'm,
sorry,
if
I'm
taking
a
little
bit
longer
than
what
I
normally
do,
but
just
last
Tuesday.
E
E
County
District,
excuse
me
and
the
reason
I'm
explaining
this
is,
is
because
I'm
part
of
this.
The
reason
why
we're
all
having
this
discussion
and
I
feel
you
know
I
feel
like
the
elephant
in
the
room
and
so
I
I
just
want
to
thank
councilman
for
Cohen
for
and
councilmember
Jimenez
for
taking
the
lead
on
this
I
know
that
these
are
the
types.
E
This
is
the
type
of
kind
of
cleanup
that
we
have
to
do
when
somebody
when
somebody
moves
on
and
I
appreciate
your
attention
to
detailing
making
sure
that
we
have
a
transparent
and
honest
process
for
for
everyone
and
look
forward
to
seeing
what
that
looks
like
together
as
a
whole,
as
a
council
I.
Of
course,
my
myself
I
want
to
make
sure
that
our
my
district
is
is
represented
a
hundred
percent.
E
We
tend
to
be
an
area
that
that
has
a
a
clear
voice
and
where
they
stand
and
development
and
projects
and,
of
course,
Park
regional
park
interests
that
that
that
that
we
want
to
make
sure
that
continue
beyond
my
service,
and
so
this
this
will
just
facilitate
that
very
transparent
process,
and
so
I
just
want
to
thank
you
for
getting
this
going.
Although
it
does
feel
strange
to
be
talking
about
it
just
one
week
later,
I
understand
why
we
need
to
get
moving.
S
Thank
you,
I
just
want
to
make
sure
I'm
I'm
supportive
of
this
motion.
I
am
absolutely
an
agreement
that
we
need
to
know
what
all
of
our
options
are
and
for
the
public
I
just
want
to
I
just
want
to
be
clear.
We
have
no
intention
of
doing
anything.
That's
not
legal!
That's
why
we
brought
the
City
attorney
in
right
away
and
I
just
want
to
ask
Tony
of
the
city
clerk.
If
you
could,
when
you're
giving
us
the
whatever
timelines
are
possible
for
the
options.
S
If
you
can
also
include
in
the
memo
the
the
timeline
for
both
fundraising
and
the
primary
and
the
general
election
for
the
2024,
because
I
know
our
our
primaries
move
around
and-
and
it
would
be
helpful
to
see
all
that
in
one
place-
sure
in
addition
to
the
to
the
things
that
that
councilmember
Cohen
asked
for
I,
think
I
think
it's
going
to
be
really
important
for
us
to
to
also
know
the
last
time
there
was
a
special
election,
what
the
turnout
was
compared
to
what
the
turnout
was
for
the
following
general
election.
S
B
Great,
thank
you.
Okay,
I
think!
That's
it
for
my
colleagues.
I'll
just
share
a
couple
comments
and
I
want
to
say
thank
you
to
my
colleagues
as
well
for
bringing
this
forward
and
ask
a
question
of
Staff.
Do
we
have
an
idea
of
when
we
might
be
able
to
bring
this
discussion
forward
and
do
we
believe
that
it
may
have
to
be
on
us
special
day
sort
of
outside
of
one
of
our
predetermined
Council
meetings.
C
Well,
you
just
moved
the
start
time
on
December
29th
from
11
to
1
30.
You
could
move
it
back
to
11.
and
put
a
discussion
on
for
November
29th.
We
also
have
the
November
28th
I
can
pull.
We
can
do
special
meetings,
I'm
already
starting
a
polling
list
to
send
to
you
guys
this
afternoon
and
we
could
pull
for
a
special
date
as
well.
B
B
I
would
be
more
comfortable
not
having
to
necessarily
have
a
an
additional
meeting
or
special
meeting
rushing
the
time
and
yes,
we
did
just
adjust
the
time
we
could
adjust
it
back
and
that
would
allow
us
maybe
some
time
to
have
a
discussion
there
and
then
maybe
if
there
was
a
subsequent
discussion
needed
before
the
the
19th
or
18th
I,
think
of
December,
then
it
would
allow
us
to
do
so
so
I'd
be
comfortable
with
that.
B
I'll
go
back
to
my
colleagues
to
see
if
there's
any
comment
on
this
coming
back
on
the
29th:
oh
I'm,
sorry,
yeah.
Looking
all
over
the
place,
we're
going.
F
Well,
first
of
all,
one
question:
is
there?
Presumably,
we
wouldn't
be
able
to
post
any
vacancy,
regardless
until
after
the
election
is
certified,
which
is
December
8th
is
my
understanding.
Is
that
right,
but
we
could
have
this
discussion
before
the
election
is
certified.
Is
that
just
want
to
make
sure
that
that's.
F
Do
right,
and
so
that
and
that
we
wouldn't
have
to
wait
for
certification
to
have
that
discussion,
but
we
would
have
to
wait
to
certification
to
start
any
process
that
the
council
decides
on
right.
Okay,
the
the
reason
why
we
we
wrote
this
in
the
memo
was
basically
because
we
looked
at
the
next
three
agendas
and
said:
oh,
my
gosh.
These
are
both.
These
are
all
crazy,
they're,
really
long,
I'm
already
concerned
we're
going
to
go
until
midnight
on
the
29th
and
we
had
to
feed.
F
We
feel
that
this
that
the
that
meeting
could
be
a
four
hour
long
meeting.
We
think
there'll
be
a
lot
of
public
comment
that
there
was
a
last
time
this
was
discussed.
There
was
a
the
last
time
this
was
discussed.
This
went
five
hours
just
this
item,
so
we
we
just
did
not
think
it
was
possible
to
fit
it
into
an
existing
council
meeting
given
the
length
of
those
Council
meetings.
So
we
thought
it
was
best
to
schedule
a
separate
meeting.
F
I,
there's
no
reason
why
it
couldn't
be,
except
that
I
don't
see,
certainly
on
the
6th
and
the
13th
any
time
to
have
it
fit
in
and
I'm,
not
sure.
If
we
had
a
four
hour
to
five
hour
discussion
on
the
29th,
you
know
where
we're
going
to
be
carrying
that
meeting
over
to
another
day,
so
that
that's
the
only
reason
it
was
suggested
to
have
a
separate
meeting
and
I'm,
not
100
comfortable
with
trying
to
squeeze
it
in.
Given
the
importance
of
the
discussion.
S
Yeah,
thank
you.
I
I
also
want
to
be
mindful
that
we,
that
is
the
Tuesday
right
after
the
Thanksgiving
holiday,
and
while
we
had
some
robust
public
comment
today,
I
don't
know
how.
Well
we
can
notice
that
meeting,
which
I
think
you
know
given
council
member
Cohen's
assertion
or
or
recall
that
the
the
five-hour
meeting
that
we
would
have
that
that
kind
of
out
turnout.
So
this
is
all
to
say,
I'm
I'm,
not
sick
and
I'm.
S
Sorry
for
my
my
own
scattered
thinking
today,
but
I
think
we
need
at
least
a
one
more
week
past
that
so
that
we
can
get
the
word
out
to
the
community
that
we
are
looking
at
the
options
so
that
they
can
come
out
for
the
meeting.
So
I
I.
Don't
think
that
the
I
think
the
29th
is
a
little
too
soon
in
terms
of
wanting
to
notice.
B
Our
option
really,
then,
would
be
just
having
a
special
meeting,
because
we're
definitely
not
going
to
be
able
to
fit
it
into
the
final
two
Tuesdays
of
the
of
the
year
and
if
we
want
to
keep
it
at
just
one
meeting,
we
may
want
to
wait
till
after
the
eighth,
then,
where
they're
certified
and
that
way
we're
both
getting
educated
and
making
a
final
decision
on
on
the
same
day,
and
you
know,
could
plan
for
a
a
lengthier
meeting
sometime
in
that
final
week
of
the
11th
to
the
17th
and
and
that
could
allow
us
to
make
that
decision
before
the
18th
as
denoted
and
I'd
be
comfortable
with
that
as
well.
B
I
would
ask,
though,
that
if
staff
could
put
together
the
information
that
was
requested
in
the
memo,
so
that
way
we
could
have
a
chance
to
read
that
over
sooner
than
later,
especially
if
it
sounds
like
you,
you
would
have
been
prepared
by
next
week.
I
think,
the
sooner
the
better
that
that's
in
writing
would
be
helpful.
B
That
way,
you
know,
council
members
in
the
community
can
start
to
digest
what
is
possible
because
I
think
you
know
we
heard
a
number
of
comments
today
and
I
will
I
will
say
that
that
if
you're
an
elected
office,
it's
these
difficult
decisions
that
you
know
that
require
a
lot
of
complex
thought
and
consideration
that
make
make
it
worthwhile
what
we
do,
but
absolutely
there's
no
intent
to
do
anything
that
we
wouldn't
legally
be
able
to
do,
and-
and
that's
the
the
interest
to
have
this
discussion
to
see
what's
on
the
table
for
options
and
then
ultimately
to
make
a
decision
as
we
are
entitled
legally
to
be
able
to
do
so
so
yeah.
B
If
staff
could
just
come
back,
you
know
as
soon
as
possible
with
the
memos.
Then
that
way
we
could.
We
could
digest
that
and
then
have
the
discussion
later
in
December
I
had
some
other
comments.
I
was
going
to
share
on
thoughts,
but
I
will
save
that
then,
for
the
lengthier
discussion.
Since
now
we're
just
considering
the
the
date
councilmember
Davis.
S
Oh
I
just
wanted
to
ask:
is
it
possible
for
us
to
have
this
special
meeting
and
make
the
decision
about
what
the
process
is
and
vote
before,
December
8th
it
sounded
like
we
were?
We
were
talking
about
whether
we
had
to
meet
after
the
eighth
to
make
that
decision
or
whether
we
could
just
make
the
decision,
and
then
you
know
it's
it's
made
and
put
in
place,
but
then
it
doesn't
actually
start.
S
B
My
thought
was
that
if,
if
there
was
anything
that
we
were
going
to
have
to
subsequently
come
back,
for
you
know,
based
on
whatever
decision
we
make,
that
we
might
as
well
schedule
a
date
where
we
can
do
both
versus
having
to
come
back.
So
that
was
the
only
reason.
I
suggested
that
versus
having
to
maybe
have
two
special
meetings
right,
depending
on
our
discussion.
There's.
C
B
Then
so
then,
maybe
I'll
retract,
what
I
said,
or
maybe
we
definitely
have
the
other
meeting
sooner,
which
which
I
would
go
back
to
saying
the
29th
is
not
a
terrible
date,
because
if
we're
just
discussing
what
process
we're
going
to
take,
we
may
need
to
have
a
subsequent
meeting,
which
would
be
a
special
meeting
anyways,
either
way,
I'll
retract.
What
I
was
saying
about
you
know
hosting
one
meeting
between
the
eighth
and
the
in
the
17th,
because
it
looks
like
that's
not
that's
not
gonna
work.
We
may
need
two
meetings,
anyways
well.
F
Yeah
I'll
just
I'll
just
say:
let's
let
staff
try
to
figure
out
when
that
first
meeting
can
be,
and
then
we'll
worry
about
a
second
one.
After
that
I
mean
I,
I
think
scheduling
the
first
one
is
going
to
be
difficult
enough
right
now.
So
let's
schedule
that
and
then
figure
out
what
kind
of
meeting
we're
going
to
need,
because,
based
on
the
decision
that's
made
at
that
first
meeting,
we'll
need
a
different
kind
of
meeting
and
the
timeline
would
be
different
for
when
it's
held,
so
it
I.
Don't.
F
C
D
B
It
yeah
okay,
looking
back
not
seeing
any
other
hands,
we
do
have
a
motion.
We
do
a
roll
call
vote.
Please.
B
B
Okay,
thank
you.
Sorry.
Before
we
go
to
Open,
Session
I
did
have
a
request
in
to
for
the
December
6th
meeting
and
then
the
December
13th
meeting
the
final
two
to
have
an
in-person
closed
session.
B
We've
been
having
virtual
only
closed
sessions,
and
my
understanding
is
that
that
request
would
have
to
be
made
here
and
so
I
did
not
make
that
with
the
agenda
that
we
had
well
at
least
I
guess
so
it's
not
for
the
29th,
but
it
would
be
the
sixth
in
the
in
the
13th,
so
I
wanted
to
make
that
request
here.
I'll
ask
that
clerk.
If
there's
anything
else
that
needs
to
be
done
to
to
make
that
possible.
Besides
just
publicizing
it
yeah.
D
Here
but
I
will
check
with
her
I,
don't
you
know
it's
I
think
up
to
her.
Actually,
there
was
a
conversation
yesterday.
D
B
Then
yeah,
that
would
be
the
request
then,
and
if
that
could
be
noted,
once
we
bring
back
the
agenda
for
the
sixth
I'd
appreciate
it.
B
Okay,
do
you
need
a
I
guess
we
there's
really
no
I,
think
there's
nothing
to
vote
there.
There's.
Obviously
another
agenda
is
on
it.
It's
really
just
a
scheduling
of
something
in
person
or
virtual.
So
and
it's
also
a
closed
session
meeting.
So
not
one
open
to
the
public
yeah
yeah
we'll
vote
on
it,
the
next
Rules
meeting.
Okay,
now
we
will
go
to
open
form.
C
P
All
right,
thank
you.
The
item
about
Richard
Doyle
has
been
dropped
should
that
have
any
sort
of
its
own
time
for
public
comment.
I've
just
mentioned
his
name
at
this
time
and
thank
you
for
all
his
years
of
service.
Good
luck
on
how
this
issue
can
eventually
come
up
in
the
future,
to
name
a
part
of
the
council
chambers
after
him,
former
City
attorney
years
of
service.
P
What
else
was
I
going
to
say?
Oh
you
know
about
the
previous
issue.
I
both
sides
have
good
points
of
view.
Good
luck
on
how
we
can
all
work
on
this
issue,
the
mayor,
you
know
it
was
decided
we
kind
of
went
through
the
same
thing
with
the
mayor.
It
was
decided
to
go
through
the
election
process.
I've
been
kind
of
okay
with
that
at
this
point
boy,
just
a
good
luck!
P
How
we
can
work
on
these
appointment
issues
a
really
impressive
meeting
yesterday,
a
city
council
meeting
it
was
kind
of
like
back
and
forth
I
mean
you
the
downtown
planning
issues
you
guys
could
have
really
talked
about
the
importance
of
parking,
the
future
of
parking
and
and
what
exactly
is
the
future
of
cars
along
Santa
Clara
Street
in
our
future?
And
what
is
that
about?
You
know:
how
can
we
better
talk
about
that
issue?
A
lot
of
people
want
to
know
about.
P
You
know
the
good
things
that
and
San
Jose
is
working
on
with
that
and
to
make
that
a
time
to
begin
the
process
once
again
we're
talking
about
how
we
can
talk
about
less
cars,
more
mass
transit
use.
Good
luck,
how
to
make
that
a
safe
conversation
for
ourselves
and
my
timer
says
two
minutes:
I
I,
don't
know
what
happened.
P
48
seconds
great
okay,
so
with
my
final
48
seconds,
I
think
what
I
tried
to
say
at
public
comment
yesterday:
I'll,
try
to
say
again
today,
I'm
trying
to
learn
that,
with
you
know
my
accountability
and
Tech
practices,
the
feature
of
so
much
5G
and
Broadband
to
help
bridge
digital
divide,
I,
I,
really
believe
in
the
importance
of
minimal
practices
and
learning
how
to
coordinate
with
local
communities
in
local
neighborhoods.
P
You
know
that
we
don't
have
to
put
in
a
ton
of
technology
in
all
places
and
it's
learning
to
coordinate
with
the
neighbors
how
to
do
that.
Well
and
I
hope.
You
know
for
these
Park
issues
and
and
housing
issues.
We
can
do
the
same
thing.
It's
a
matter
of
coordination.
Good
luck
with
that
and
working
together
to
coordinate
that
for
different
neighborhoods.
C
R
And
thank
you
for
letting
us
speak.
I
would
like
to
remind
the
council
and
all
of
you,
that
what
is
legal
is
not
necessarily.
What
is
morally
right.
We
need
to
do
in
the
city
what
is
best
and
right
and
legal,
but
because
something
is
legal,
does
not
make
it
morally
right.
Thank
you
and
have
a
good
rest
of
the
week
and
a
good
Thanksgiving.
If
I
don't
talk
to
you
sooner.
Q
Yes,
Paul
Soto
from
the
Horseshoe
I
believe
some
congratulations
are
in
order.
District
one
is
in
good
hands
now
for
too
long
we
have
dealt
with
a
conservative
politic
in
that
particular
part
of
of
Santa,
Clara,
County
and
so
I
have
full
confidence
that
the
newly
elected
councilwoman
that
is
going
to
be
representing
that
area
is
going
to
at
least
try
to
amend
some
of
the
damage.
Q
Some
of
the
damage,
some
of
the
generational
damage
that
has
happened
as
a
result
of
that
Republican
stronghold
that
has
had
a
that
has
had
a
grip
on
that
particular
area.
I
have
full
confidence
in
that.
Secondly,
the
mayor
we
have
expectations.
Congratulations
to
our
new
mayor.
I,
look
forward
to
working
with
all
these
council
members
they're
going
to
get
the
benefit
of
the
generational
knowledge.
Q
I
mean
not
not
only
the
generational
knowledge
but
the
institutional
knowledge
that
I'm
going
to
bring
to
them
so
I
hope
they're
up
for
the
challenge,
because
they're
going
to
be
challenged.
I'm
not
going
anywhere
I'm
going
to
die
in
this
city.
I
ain't
going
to
Modesto
I'm,
not
going
to
Madera
I'm,
going
to
die
in
this
city,
I'm,
going
to
be
buried
at
Oak
Hill
period.
So
from
now
until
then,
you're
gonna
deal
with
me
I'm
very,
very
proud
to
announce
another
win
from
Paul
Soto
from
the
Horseshoe.
Q
The
demolition
10
million
dollar
demolition
was
stopped
and
if
you
listen
I
advise
all
of
you
listen
to
the
county
meeting.
Yesterday,
it's
the
last
item,
81.
Paul
Soto,
once
again
bringing
the
history
of
San
Jose
to
the
four.
It
stopped
a
10
million
dollar
demolition
of
that
building
and
I'm.
Not
stopping
there.
Oh
believe
me
I'm
not
going
to
stop
until
we
get
a
Civil
Rights
Museum
made
out
of
that
building,
so
I'm
putting
Gary
dillabo,
Eric
and
unnoticed
I
got
you
on
board
because
you
were
guest
in
my
city.
L
Hi
Martha
O'connell
Sandra
I'd,
like
to
reiterate
what
you
just
said:
I'm,
not
sure
who
stated
the
quote.
It
may
have
been
Sir
Thomas
Moore,
never
tell
the
king
what
he
can
do
tell
the
king
what
he
should
do
so.
I
agree
with
your
comment:
I'd
like
to
state
that
I
think
that
we
need
to
do
something
in
the
memory
of
Rick
Doyle.
He
was
one
of
the
most
decent
human
beings.
I've
ever
met
in
my
life
and
one
of
the
greatest
things
about
Rick.
L
T
Hello,
yes,
I
just
want
to
congratulate
district
one
because
it's
gonna
have
a
fearless
leader
and
it's
finally,
we're
gonna
have
decent
representation
in
the
south
of
the
county,
and
thank
you
for
this
meeting
and
I'm
looking
forward
for
the
next
meetings
and
thank
you
very
much.
B
Thank
you
very
much.
It
just
doesn't
know
because
I
know
it
came
a
couple
times.
I
I
tried
to
mention
in
the
meeting,
but
the
item
for
Rick
Doyle
was
dropped
because
we
just
don't
need
a
vote
on
it.
It's
something
that
was
approved
already
by
the
council
and
the
city
manager
can
move
forward
on
it.
It
is.
It
is
happening
on
that
naming
So
for
anybody
that
was
reading
that
and
interested
okay.
Thank
you.
Meetings
adjourned.
