Are we reading just base bids? Is that what we're waiting is that, where we're weighing on for selection in the contract.

We had two bidders uh first bids from sd ellen becker and the amount of ninety three thousand seven hundred forty three dollars and seventy cents. Second bids from pembert companies at 269, 671 dollars and 40.

Cents, I would make a motion to go with the low bid of sd ellen becker in the amount of 193 743 dollars and 70 cents I'll.

Item three open storm sewer materials quotations and make a recommendation.

Good job um are we opening these and you guys are going to review and bring them back. Is that where okay first is uh for from ferrell equipment and supply? Do we have sheets in here glory or no yeah? Okay, nothing to read second one. We had a bid from.

Ferguson and third and final bid was from county materials.

A

So we'll have these reviewed by uh chad and then he can bring back our recommendation for us great item. Four was pulled from the agenda. I was not ready at this time item five is discussion and possible action on 2021 landscape maintenance services.

I can speak to that a little bit, so we were. We went out for rfps for landscape services back in 2019 and in their contracts that we could extend it for two additional years. The low bidder was uh bombing and we did extend it in 2020.

and here in 21 we have the option to extend it again. I did speak with the owner, mr bauman. He said that he would hold his prices. He would not ask for any there's. Obviously, in the contract there was a right to negotiate. He said he didn't.

He hold his prices from 19., so I had sent out that that email with those contracts in it so that the contract, the way it exists now includes parking lot, uh nine, which is off of fifth street here, um the police and fire department off of grand avenue, the highway 52 parkway median and city hall park.

So the value of that contract is sixteen thousand two hundred fifty dollars. Now I was asked to look at adding the the thomas street median, the catholic block green space, the 52 park median, which would be west of highway 51. That was just landscaped and also the fire station to the new fire station.

So when I I asked balman for numbers on those and that was included in that email.

So the total proposed contract for two thousand and twenty one would be fifty thousand eight hundred and eighty dollars, which is obviously quite an increase from sixteen thousand two fifty. So I think there's some options out there. I I said in the email we could go that way or we could re-bid the entire package for 2021..

I guess I would prefer- and I guess my thinking would be to stick with bauman for the the uh we're not doing city hall park this year. The lawn maintenance on that um parks decided they'll. Do that themselves. All bauman was doing. There was fertilizing and aerating. So that's going to be taken off.

I guess, if I would, I would say we stick with bauman for parking lot: nine, the police, highway 52 and then I was looking at maybe adding the catholic bloc to that to replace the city hall park and that would be an increase of that contract of thirteen hundred and five dollars.

And if, if the board of public works wants or direct me, I can rebid the the other portions. So I'm looking for input done, which way you want me to go on that.

So alan, do I understand that under I'm, looking at the 2021 under article 2 you'd cross out the 1650 city hall park correct and then you added the catholic block.

Correct yep, I yeah I didn't. I couldn't figure out the strikeout features.

So I agree: I got it: okay, I'm looking back at your email, so the original contract.

Just from a legal standpoint- I don't, I couldn't find any prices in it or that they could renegotiate those, but paragraph 12 has the contract option for extension, which it just says, prices provided for under this rfp, which it's, oh okay, that was the request for proposals in 2019.. I guess.

Well, there was just an rfp: this contract was put together right.

So then you did the 2020. okay, so the 2019 was an rfp correct, wherein we notified the bidders that we reserve the right to extend the contract for two additional years and it doesn't say under what circumstances or put any other limitations on us, except that we have to consider those factors in determining whether or not to extend it to the same person or the same vendor for the following year, and so I would assume that this process was followed in 2020.

So everywhere you see in that rfp where it says 2019 we slot in 2021, so you've negotiated prices, they've kept them the same performance of the work completed in 2020. You were satisfied with that.

That was um under brian barkowiak and yes, when I before his retirement, I talked to him and he was. He was very satisfied with balman's work and wanted to continue with them. So.

I'm trying to get this all into the record that we're considering these factors and their completion and timeliness was also satisfactory to your knowledge.

And the responsiveness by them to any issues that may have arisen was also satisfactory. I assume.

Yep, okay, they had some irrigation issues that they responded to. So I think everything was in order.

So it just says, then: if any of those are unsatisfactory, we reserve the right to publicly bid or re-bid any work to be performed thereafter. So this isn't public construction, as I think we pointed out before, but does not our procurement policy say that if we're um taking bids on services, it's recommended that we get at least three quotes. I don't think it's required.

I wish I'd brought that down with me. Yeah.

And we, and there would only be what one other person, if you bid the additional work that you think would put in a bid or not or you can.

Yeah, I'm not sure I think in the past there's only this last bit in 19. I believe there was only two okay almond and another company. Yes,.

Okay, er in 2020 last year you mean, after we did the.

We didn't rebid it in 20, we just we the last time we put it out for our refuses in 19.

And then in 20 we just extended balance contract. I was looking to extend.

In 21. I didn't mean that we re-bid it, but yes in 2020 right, so I think legally, we have the right to extend it for the additional year with the additional work.

According to the contract language, I'm looking at and now for 2020 and 2021 under contract price, it says the owner, that's the city shall pay to the contractor for the performance of this contract, subject to any additions or deductions provided therein.

So one could argue that you're making some additions to the contract as well and that's what they signed for 2020 and they they because they were told that and that's the way we put out the rfp. They have a bit of a vested interest in having it renewed for those three years. So you know we need to be careful too not to take anything away from them that they may have been counting on, because they responded to that. Rfp were awarded it and told that it could be extended for two additional years.

So I'm going to make a motion to authorize or approve the signing of the 2021 landscape maintenance services, as drafted and presented.

I'll, second, that I think um alan it, I think, from my perspective before uh we signed this just to get a justification from bauman on the 1900 for the 52 parkway median, that's quite a bit more than the existing one, and I mean. Is there some special provisions? We need there or I.

You know I did speak to him with that and basically it's when we, when I looked at it it's three times as large. Oh, it is.

Said so, if you do basically, the math is three times as large. It takes obviously three times as much fertilizer time to cut okay and.

But it's parkway medium is on there twice, one is median west and that's like almost four times the original well 5700, I guess to almost 20 000., so they're not they're, not duplicating that it's the first section and then the median west is three times the length of the first section.
